		<official-title>To provide for the establishment of a Health Insurance
		  Rate Authority to establish limits on premium rating, and for other
		  purposes.</official-title>

		<section id="id209E3D551E9740D38E60CEEA52995A55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Insurance Rate Authority Act of
			 2010</short-title></quote>.</text>
		</section><section id="idFCDDB7160BA549E0801FFF8B8F4580C3"><enum>2.</enum><header>Ensuring that
			 consumers get value for their dollars</header>
			<subsection id="idD096AE5035894FA69FA434719525C9D6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part C of title XXVII
			 of the Public Health Service Act (42 U.S.C. 300gg–91 et seq.) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBA1EDE0711EA4140BC51581FA72D8433" style="OLC">
					<section id="id5B0F730F30E2442C8439710B208F6283"><enum>2793.</enum><header>Ensuring that
				consumers get value for their dollars</header>
						<subsection id="idBB80FFC016214C048D191908120FFFE7"><enum>(a)</enum><header>Initial rate
				review process</header>
							<paragraph id="idE57B3702D28E4C6FB0B718ABB1E5FAC2"><enum>(1)</enum><header>In
				general</header>
								<subparagraph id="idCED0E2944B4A4562B7E1ADA8B87315A7"><enum>(A)</enum><header>Establishment</header><text>The
				Secretary, in conjunction with States, shall establish a uniform process for
				the review, beginning with the 2011 plan year, of potentially unreasonable
				increases in rates for health insurance coverage, which shall include
				premiums.</text>
								</subparagraph><subparagraph id="id5AB39061802441729F07C46B986400FD"><enum>(B)</enum><header>Electronic
				reporting</header><text>The process established under subparagraph (A) shall
				include an electronic reporting system established by the Secretary through
				which health insurance issuers shall—</text>
									<clause id="idA5E35297F474472B8BC98EC526D4A1A8"><enum>(i)</enum><text>report to the
				Secretary and State insurance commissioners the information requested by the
				Secretary pursuant to this subsection; and</text>
									</clause><clause commented="no" id="id311DB7EFCBED417CB286153EF9B1B22C"><enum>(ii)</enum><text>submit data to
				the uniform data collection system in accordance with paragraph (6)(A).</text>
									</clause></subparagraph><subparagraph commented="no" id="id4D8C073C4BDD4FC2A31CBD25163E4C1C"><enum>(C)</enum><header>Authority of
				States</header><text>Nothing in subparagraph (A) or (B) shall be construed to
				prohibit a State from imposing additional requirements on health insurance
				issuers with respect to increases in rates for health insurance coverage,
				including with respect to reporting information to a State.</text>
								</subparagraph></paragraph><paragraph id="ID4a8fbb619fd94e589a135a59405b4c7f"><enum>(2)</enum><header>Justification
				and disclosure</header><text>The process established under paragraph (1) shall
				require health insurance issuers to submit to the Secretary and the relevant
				State a justification for a potentially unreasonable rate increase prior to the
				implementation of the increase. Such issuers shall prominently post such
				information on their Internet websites. The Secretary shall ensure the public
				disclosure of information on such increases and justifications for all health
				insurance issuers.</text>
							</paragraph><paragraph id="id8CACE5838B6644D3BEB9957CF59B379B"><enum>(3)</enum><header>Health
				insurance rate authority</header>
								<subparagraph id="id7FBDD60536BA4B2A853F4A062724C4CA"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall establish a Health Insurance Rate
				Authority (referred to in this paragraph as the <quote>Authority</quote>) to be
				composed of 7 members to be appointed by the Secretary, of which—</text>
									<clause id="IDfbcc5082bd09423fb710abbe3c151b19"><enum>(i)</enum><text>at least 2
				members shall be a consumer advocate with expertise in the insurance
				industry;</text>
									</clause><clause id="ID2628a235a3604bac9f645e8db6291423"><enum>(ii)</enum><text>at least 1
				member shall be an individual who is a medical professional;</text>
									</clause><clause id="idB074E51E486041BF8BD586B9AAA4765A"><enum>(iii)</enum><text>at least 1
				member shall be a representative of health insurance issuers; and</text>
									</clause><clause id="ID6637747ab4e2470eb32b9730859c1bfe"><enum>(iv)</enum><text>such remaining
				members shall be individuals who are recognized for their expertise in health
				finance and economics, actuarial science, health facility management, health
				plans and integrated delivery systems, reimbursement of health facilities, and
				other related fields, who provide broad geographic representation and a balance
				between urban and rural members.</text>
									</clause></subparagraph><subparagraph id="id7DE8DCDEE5C344EEACBE22A19CD1609F"><enum>(B)</enum><header>Role</header><text>In
				addition to the other duties of the Authority set forth in this subsection, the
				Authority shall advise and make recommendations to the Secretary concerning the
				Secretary’s duties under this subsection.</text>
								</subparagraph></paragraph><paragraph id="idAA7B080CD37040BDB7893A481C5130D7"><enum>(4)</enum><header>Corrective
				action for unreasonable rate increases</header>
								<subparagraph id="id34AE802FF537491B8F722019EF86BF1D"><enum>(A)</enum><header>In
				general</header><text>Pursuant to the procedures set forth in this paragraph,
				the Secretary or the relevant State insurance commissioner shall—</text>
									<clause id="ID0c365ffcea294bb49c4d9a4bd6bc591f"><enum>(i)</enum><text>in accordance
				with the process established under paragraph (1), review potentially
				unreasonable increases in rates and determine whether such increases are
				unreasonable; and</text>
									</clause><clause id="ID4fee8e0624b7462f8fd548ca8406031c"><enum>(ii)</enum><text>take action to
				ensure that any rate increase found to be unreasonable under clause (i) is
				corrected, through mechanisms including—</text>
										<subclause id="ID4c1865f156734d468a53aa98ce092388"><enum>(I)</enum><text>denial of the
				rate increase;</text>
										</subclause><subclause id="ID32e560f3dbce433980599d4a21b98b26"><enum>(II)</enum><text>modification of
				the rate increase;</text>
										</subclause><subclause id="ID3ad5a3df5bbc4161bc81f17ae7870a0d"><enum>(III)</enum><text>ordering
				rebates to consumers; or</text>
										</subclause><subclause id="IDa8227ae971ef4d60a091a3c0ee101a7b"><enum>(IV)</enum><text>any other
				actions that correct for the unreasonable increase.</text>
										</subclause></clause></subparagraph><subparagraph id="id1B79498FEED2454386193853D8B6981B"><enum>(B)</enum><header>Required
				report; definition</header><text>The Secretary shall ensure that, not later
				than 6 months after the date of enactment of this section, the National
				Association of Insurance Commissioners (referred to in this section as the
				<quote>Association</quote>), in conjunction with States, or other appropriate
				body, will provide to the Secretary and the Authority—</text>
									<clause id="idC97A5CDFC2384D3BBB089D2A40B65D4A"><enum>(i)</enum><text>a
				report on—</text>
										<subclause id="IDc250f001f8a2417f8accf268e587d1d0"><enum>(I)</enum><text>State authority
				to review rates and take corrective action in each insurance market, and
				methodologies used in such reviews;</text>
										</subclause><subclause id="ID8521f953fb34487a9b2ac52fca71f4f7"><enum>(II)</enum><text>rating requests
				received by the State in the previous 12 months and subsequent actions taken by
				States to approve, deny, or modify such requests; and</text>
										</subclause><subclause id="ID3e11b0f007424fe5bedccc510a9409ff"><enum>(III)</enum><text>justifications
				by insurance issuers for rate requests; and</text>
										</subclause></clause><clause id="id3343D6377D704CCC98F19570BA674A67"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idFBB397A3CED04BFF9D4415A8B1900CDF"><enum>(I)</enum><text>a recommended
				definition of unreasonable rate increase, which shall consider a lack of
				actuarial justification for such increase; and</text>
										</subclause><subclause id="idBEA239ABB96E41C997C704106A42A4CE" indent="up1"><enum>(II)</enum><text>other recommended definitions for the
				purposes of carrying out this subsection.</text>
										</subclause></clause></subparagraph><subparagraph id="idAA58A3D926C949698DB45C510DA65C0C"><enum>(C)</enum><header>Determination
				of who conducts reviews for each State</header><text>Using the report submitted
				pursuant to subparagraph (B), the Secretary shall determine not later than 1
				year after the date of enactment of this section and periodically
				thereafter—</text>
									<clause id="IDf66fdb2992ea4356ae0556feea6ba9f0"><enum>(i)</enum><text>for which States
				the State insurance commissioner shall undertake the actions described in
				subparagraph (A)—</text>
										<subclause id="id9EB0401E3EF44BB59E8D0EAD0B65A4C0"><enum>(I)</enum><text>based on the
				Secretary’s determination that the State has sufficient authority and
				capability to deny rates, modify rates, provide rebates, or take other
				corrective actions; and</text>
										</subclause><subclause id="id8F31DFB2D6E14A639172CEA9888C8251"><enum>(II)</enum><text>as a condition
				of receiving a grant under subsection (c)(1); and</text>
										</subclause></clause><clause id="IDc4f1184188bb453ab4ffc54fe4a742e3"><enum>(ii)</enum><text>for which States
				the Secretary shall undertake the actions described in subparagraph (A), in
				consultation with the relevant State insurance commissioner, based on the
				Secretary’s determination that such States lack the authority and capability
				described in clause (i).</text>
									</clause></subparagraph><subparagraph id="idAD5CC9D545A245D5A71DAC2647709240"><enum>(D)</enum><header>Transition
				period</header><text>Until the Secretary makes the determinations described in
				subparagraph (C), the relevant State insurance commissioner shall, as a
				condition of receiving a grant under subsection (c)(1), carry out the actions
				described in subparagraph (A) to the extent permissible under State law.</text>
								</subparagraph></paragraph><paragraph id="id0A62866D187A4C52A292EFCE11594468"><enum>(5)</enum><header>Prioritizing
				potentially unreasonable rate increases for review</header><text>The Secretary
				or the relevant State insurance commissioner may prioritize—</text>
								<subparagraph id="ID2f84ae55fe27489b8de378ef27ea73d3"><enum>(A)</enum><text>rate increases
				that will impact large numbers of consumers;</text>
								</subparagraph><subparagraph id="IDa66e11c2fb5c4df79482701220f6c160"><enum>(B)</enum><text>rate reviews
				requested from States, if applicable; and</text>
								</subparagraph><subparagraph id="id29E151530B4B423FA270B1D39B765915"><enum>(C)</enum><text>rate reviews in
				the individual and small group markets.</text>
								</subparagraph></paragraph><paragraph id="id25C426CABD6241B5BB2DDC4F3755EDCA"><enum>(6)</enum><header>Annual
				report</header>
								<subparagraph id="id9F4EC5E79D0943C684FA3122C407A96B"><enum>(A)</enum><header>Uniform data
				collection system</header><text>The Secretary, in consultation with the
				Association and the Authority, shall develop, and may contract with the
				Association to operate, a uniform data collection system for new and increased
				rate information, which shall include information on rates, medical loss
				ratios, consumer complaints, solvency, reserves, and any other relevant factors
				of market conduct.</text>
								</subparagraph><subparagraph id="id3631CE4E50A34B958BE1A07A29935392"><enum>(B)</enum><header>Preparation of
				annual report</header><text>Using the data obtained in accordance with
				subparagraph (A), the Authority shall annually produce a single, aggregate
				report on insurance market behavior, which includes at least State-by-State
				information on rate increases from one year to the next, including by health
				insurance issuer and by market and including medical trends, benefit changes,
				and relevant demographic changes.</text>
								</subparagraph><subparagraph id="id591F5B3A0A024DBE91641C03B8F722BE"><enum>(C)</enum><header>Distribution</header><text>The
				Authority shall share the annual report described in subparagraph (B) with
				States, and include such report in the information disclosed to the
				public.</text>
								</subparagraph></paragraph></subsection><subsection id="ID1e16c3dd4d2d4d4783bc89069dd834fa"><enum>(b)</enum><header>Continuing rate
				review process</header><text>As a condition of receiving a grant under
				subsection (c)(1), a State, through the applicable State insurance
				commissioner, shall provide the Secretary with information about trends in rate
				increases in health insurance coverage in premium rating areas in the State, in
				accordance with the uniform data collection system established under subsection
				(a)(6)(A).</text>
						</subsection><subsection id="IDeaf018d913b94478ba6839ee3e9021e9"><enum>(c)</enum><header>Grants in
				support of process</header>
							<paragraph id="IDbc5cb4f6d8fb48a5a2b9a4adac682578"><enum>(1)</enum><header>Rate review
				grants</header><text>The Secretary shall carry out a program to award grants to
				States beginning with fiscal year 2010 to assist such States in carrying out
				subsection (a), including—</text>
								<subparagraph id="id11C4BA63FF364A57864358AADD347904"><enum>(A)</enum><text>in reviewing and,
				if appropriate under State law, approving or taking corrective action with
				respect to rate increases for health insurance coverage; and</text>
								</subparagraph><subparagraph id="id5631A63B2DC74ADE9A0C53C78794D584"><enum>(B)</enum><text>in providing
				information to the Secretary under subsection (b).</text>
								</subparagraph></paragraph><paragraph id="IDa187b801e3074316ad5b1f23f841b2b4"><enum>(2)</enum><header>Funding</header>
								<subparagraph id="IDa076169eeef84773a7585743e80cd52d"><enum>(A)</enum><header>In
				general</header><text>There is authorized to be appropriated to the Secretary
				$250,000,000, to be available for expenditure for grants under paragraph
				(1).</text>
								</subparagraph><subparagraph id="id58330EEE638A4FC4AB0F74676E6B4CFE"><enum>(B)</enum><header>Allocation</header><text>The
				Secretary shall establish a formula for determining the amount of any grant to
				a State under this subsection. Under such formula—</text>
									<clause id="id4BE41481E7D84F4AA7A127EE3BB6BFE2"><enum>(i)</enum><text>the Secretary
				shall consider the number of plans of health insurance coverage offered in each
				State and the population of the State; and</text>
									</clause><clause id="idD6F94D5B8BBF4F61BB948F6D672CC980"><enum>(ii)</enum><text>no State
				qualifying for a grant under paragraph (1) shall receive more than $5,000,000
				for a grant year.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="id31AF0943CE9E4287BF2176D35F3FCA4C"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>In addition to the amount authorized under
				subsection (c)(2), there are authorized to be appropriated to carry out this
				section $5,000,000 for fiscal year 2010 and such sums as may be necessary for
				each subsequent fiscal
				year.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="id5C94381232C440AC99505300D982EDD6"><enum>(b)</enum><header>Enforcement</header><text>Title
			 XXVII of the Public Health Service Act (42 U.S.C. 300gg et seq.) is
			 amended—</text>
				<paragraph commented="no" id="id635A60887347494EA6FED9587EDC3FAC"><enum>(1)</enum><text>in section
			 2722—</text>

			 date of enactment of this Act.</text>
