		<official-title display="yes">To amend the Atomic Energy Act of 1954 to
		  provide for thorium fuel cycle nuclear power generation.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Thorium Energy Security Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID3947d6675472418c9cdc10f8fee0a089" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDfd30b4cd80294f14b13173396d67e26d"><enum>(1)</enum><text display-inline="yes-display-inline">the United States and foreign countries
			 will continue to demand increasing quantities of energy into the foreseeable
			 future in order to support economic growth;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa1ea9a95ce5e4f4eb4b8dacbd8e59afd"><enum>(2)</enum><text display-inline="yes-display-inline">nuclear power provides energy without
			 generating significant quantities of greenhouse gases;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4620a5f2e3d0479f965384f85264ec90"><enum>(3)</enum><text display-inline="yes-display-inline">the growth of nuclear power in the United
			 States and many foreign countries has faced barriers from concerns related
			 to—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDa36bfc0033f9418a9075ecd2efdf266e"><enum>(A)</enum><text display-inline="yes-display-inline">the proliferation of weapons-useable
			 material; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDeb25c000a6b44db1a8a686c368a3d1b4"><enum>(B)</enum><text display-inline="yes-display-inline">the proper disposal of spent nuclear
			 fuel;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdfeccc7981a142f09f31855e0687eed2"><enum>(4)</enum><text display-inline="yes-display-inline">nuclear power plants operating on an
			 advanced thorium fuel cycle to generate nuclear energy—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID4357fcf8d4ea49c49f85174211c5e4a3"><enum>(A)</enum><text display-inline="yes-display-inline">would not produce weapons-useable material
			 in spent fuel; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID657b7420af874a8d8a3255bafff7ee8a"><enum>(B)</enum><text display-inline="yes-display-inline">would produce less long-term waste as
			 compared to other nuclear power plants;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdd8f015a8cad45b5bee925183c3d5eae"><enum>(5)</enum><text display-inline="yes-display-inline">thorium fuel cycle technology was
			 originally developed and proven in the United States;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91893a90daa9431682b96baac479e20f"><enum>(6)</enum><text display-inline="yes-display-inline">the United States possesses significant
			 domestic quantities of thorium in accessible high-grade deposits;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8adc49697a47474a8a09e025670edff7"><enum>(7)</enum><text display-inline="yes-display-inline">cutting-edge research relating to thorium
			 fuel cycle technology continues to be carried out by entities in the United
			 States; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9a9414983c4463a9ef12e60c17c290a"><enum>(8)</enum><text display-inline="yes-display-inline">it is in the national security and foreign
			 policy interest of the United States that foreign countries seeking to
			 establish or expand generation and use of nuclear power should be
			 provided—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDd64ec03463994a38bcd5002b3f5890a3"><enum>(A)</enum><text display-inline="yes-display-inline">access to advanced thorium fuel cycle
			 technology;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfd243ee930a0432ca9c2908a3e7849f8"><enum>(B)</enum><text display-inline="yes-display-inline">incentives to explore the thorium-based
			 fuel cycle as a means to reduce the risk of nuclear proliferation; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID233c0b6d93bc45a49d0767969afa1edf"><enum>(C)</enum><text display-inline="yes-display-inline">access to a secure domestic supply of
			 thorium.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID5a36f9cedf944ccbbfcddb0834a23ecc" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Thorium fuel cycle nuclear power
			 generation</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD81F26B3E1814797B48027D2606CC57E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 19 of title I of the Atomic Energy
			 Act of 1954 (42 U.S.C. 2015 et seq.) is amended by inserting after section 244
			 the following:</text>

					<section commented="no" display-inline="no-display-inline" id="ID749ed68cb5434513b297d55af6e3b5e0" section-type="subsequent-section"><enum>251.</enum><header display-inline="yes-display-inline">Thorium fuel cycle nuclear power
				generation</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDe7c1fd6b5aa647c6a4f600b8964bc1ce"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDcfcd385b0ef14a9190fce8ba81adaa2f"><enum>(1)</enum><header display-inline="yes-display-inline">Chairman</header><text display-inline="yes-display-inline">The term <term>Chairman</term> means the
				Chairman of the Commission.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09FDC792452D48659A37B17E77D83037"><enum>(2)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
				Department of Energy.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID526da5cbb8a5475ebdfa6951e211307f"><enum>(3)</enum><header display-inline="yes-display-inline">Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means an
				office established under subsection (b)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc728b894e8de40b783489d73b30752d9"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Energy.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbf10a6e37df54415a3a30f089bfca1b7"><enum>(b)</enum><header display-inline="yes-display-inline">Offices for research and regulation of
				thorium fuel cycle nuclear power generation</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
				Chairman, shall establish and provide funds to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id5ED0132B4EBE45C79ADCADE57C610140"><enum>(1)</enum><text display-inline="yes-display-inline">an office for the regulation of thorium
				fuel cycle nuclear power generation within the Commission; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B74A316D0864FB49865244EBD4ADB17"><enum>(2)</enum><text display-inline="yes-display-inline">an office of thorium-based fuel cycle
				research within the Department.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID656c2002a4344839b0b08702aa61accc"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idC494D114C1264066978B96783A0142E6"><enum>(1)</enum><header display-inline="yes-display-inline">Fuel</header><text display-inline="yes-display-inline">Not later than December 31, 2011, the
				Chairman, in consultation with industry and nonindustry experts, shall
				establish standards for the manufacture, testing, use, and management of spent
				thorium-based nuclear fuel.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42899c3c93754499a4316e35bc6ad66e"><enum>(2)</enum><header display-inline="yes-display-inline">Power generation</header><text display-inline="yes-display-inline">Not later than December 31, 2012, the
				Chairman, in cooperation with the Secretary, shall promulgate regulations for
				facilities and materials used in thorium-based fuel cycle power
				generation.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf9deae56c5d94e98bbf334215169b622"><enum>(d)</enum><header display-inline="yes-display-inline">Demonstration projects</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id627491C06A30440C8CDB266FDEA572D3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with
				industry experts, nonindustry experts, and National Laboratories, shall carry
				out demonstration projects for thorium-based nuclear power generation.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A0C2E31B56C4C7A9C468C8A135B3059"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">In preparing for and selecting
				demonstration projects, the Secretary shall consult with reactor designers,
				utilities, engineering, and manufacturing firms to—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID89bcd9a3761247a0af0a2fbc2692665f"><enum>(A)</enum><text display-inline="yes-display-inline">determine the optimum use of thorium in
				different reactor types;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01C2B960590646AAAC589CF5DC9DF371"><enum>(B)</enum><text display-inline="yes-display-inline">prioritize thorium-based fuel cycle options
				that take advantage of existing nuclear power infrastructure and could be
				deployed in support of light water reactors like reactors used in the United
				States in the near term;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID414e5f7407b148caa0194ea28a9cf848"><enum>(C)</enum><text display-inline="yes-display-inline">license the manufacture of thorium-based
				fuels;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID81f38da188f246359b6d3f841139794e"><enum>(D)</enum><text display-inline="yes-display-inline">qualify and license thorium-based fuel for
				use in commercial reactors; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4aab227172844c42b560d678406d69bf"><enum>(E)</enum><text display-inline="yes-display-inline">develop and maintain databases necessary
				for United States industry and regulators to safely license and use advanced
				fuels.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8cdaa9913df545989a82923f92bf1e3f"><enum>(e)</enum><header display-inline="yes-display-inline">International partnerships and
				incentives</header><text display-inline="yes-display-inline">Not later than
				December 31, 2011, the Secretary shall submit to Congress a report providing
				recommendations with respect to methods of—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID355071616e7647abbf61a5f5660bd78a"><enum>(1)</enum><text display-inline="yes-display-inline">strengthening international partnerships to
				advance nuclear nonproliferation through the design and deployment of thorium
				fuel cycle nuclear power generation; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID20d17559e9094a08b4f5e93a05184d5a"><enum>(2)</enum><text display-inline="yes-display-inline">providing incentives to nuclear reactor
				operators to use proliferation-resistant, low-waste thorium fuels in lieu of
				other fuels.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3b74c4df369f41379449b432e9bb4a8e"><enum>(f)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this section and annually thereafter, the Secretary, in
				consultation with the Chairman, shall submit to Congress a report describing,
				with respect to the preceding calendar year—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDe5e2f9dd92e747fd88608f91d0ec349a"><enum>(1)</enum><text display-inline="yes-display-inline">progress made in implementing this section;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDae483bb089a74bf88a6049b1cc01974a"><enum>(2)</enum><text display-inline="yes-display-inline">activities carried out by the Department
				and Commission pursuant to this section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6b5c5c7204f241f68272d7b60fb9fa85"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Secretary to carry out this section
				$250,000,000 for the period of fiscal years 2011 through
				2016.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6853B3FEB2224B5481462CFE06440FEA"><enum>(b)</enum><header display-inline="yes-display-inline">Technical amendment</header><text display-inline="yes-display-inline">Section 11 f. of the Atomic Energy Act of
			 1954 (42 U.S.C. 2014(f)) is amended by striking <quote>Atomic Energy
			 Commission</quote> and inserting <quote>Nuclear Regulatory
			 Commission</quote>.</text>
