<section id="H004EB83A2D58410D80CF41846E35B356" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Website relating to Federal grants</header><text display-inline="no-display-inline">Section 6 of the Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is amended—</text> 
<paragraph id="H8A8799A495764DA4AD035ECE13C3F40E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (e) and (f) as subsections (g) and (h), respectively;</text></paragraph> 
<paragraph id="H33BD2D2AE8F541CE98EDD64BC734CC23" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following new subsections:</text>

<paragraph id="HD72BCE5E03EE464FA8D3CC64AFB88D28" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall establish and maintain a public website that serves as a central point of information and access for applicants for Federal grants.</text></paragraph> 
<paragraph id="HC7575638A7F143618F7ECD080511B1A0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">To the maximum extent possible, the website established under this subsection shall include, at a minimum, for each Federal grant—</text> 
<subparagraph id="HF11300E34C80474BA45E20A9F966388B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the grant announcement;</text></subparagraph> 
<subparagraph id="H94A6EE0C21044A809FD41B4ECBFCDACF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the statement of eligibility relating to the grant;</text></subparagraph> 
<subparagraph id="H2B10C4ECCF9B4FB487FE50C68F79BCE3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the application requirements for the grant;</text></subparagraph> 
<subparagraph id="H1E4AF30A79EB4E80BE98EE599C2E2D79" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the purposes of the grant;</text></subparagraph> 
<subparagraph id="HF8919A714B884D4DA31F7B5D64F659B7" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the Federal agency funding the grant;</text></subparagraph> 
<subparagraph id="H355183C1F33D49DFB1D90802C5235E62" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the deadlines for applying for and awarding of the grant.</text></subparagraph> 
<subparagraph id="H64FED889E71145D583C5CBCA22256DE9"><enum>(G)</enum><text>all applications received for the grant, set forth in the single data standard adopted under section 9(b); and</text></subparagraph> 
<subparagraph id="HCEDA3A185D004EDBA67D5426D2EB76D0"><enum>(H)</enum><text>all reports relating to the use of the grant, set forth in the single data standard adopted under section 9(b).</text></subparagraph></paragraph> 
<paragraph id="H8D792AF9329C490B8A0B7F63BFBABC87" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Use by applicants</header><text display-inline="yes-display-inline">The website established under this subsection shall, to the greatest extent practicable, allow grant applicants to—</text> 
<subparagraph id="HD57AFB96B114417A8EC7E09FE5A8865C"><enum>(A)</enum><text>use the website with any computer platform;</text> </subparagraph> 
<subparagraph id="HBCB9161E19634D43AFE61E74252BAA73" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">search the website for all Federal grants by type, purpose, funding agency, program source, and other relevant criteria;</text></subparagraph> 
<subparagraph id="H53AC1CDC52F64A2680E7C8726BAD5AA9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">apply for a Federal grant using the website;</text></subparagraph> 
<subparagraph id="HB3E68870B07346F2A2438A6B42276509" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">manage, track, and report on the use of Federal grants using the website; and</text></subparagraph> 
<subparagraph id="H781D10C073FC4BA291B646F56F292999" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">provide all required certifications and assurances for a Federal grant using the website.</text></subparagraph></paragraph> 
<paragraph id="H1155A8F0D5C6484289128C2BF69138E0"><enum>(4)</enum><header>Use by the public</header><text display-inline="yes-display-inline">The website established under this subsection shall, to the greatest extent practicable, allow members of the public to—</text> 
<subparagraph id="H1CD38F7FC2CF4FC3B6A08DB2C6A8B65F"><enum>(A)</enum><text>view the items described in paragraph (2);</text></subparagraph> 
<subparagraph id="H63153418BB4E4B488E5433AD5FE43BDE"><enum>(B)</enum><text>navigate easily among and between the items described in paragraph (2) and other supporting materials;</text></subparagraph> 
<subparagraph id="H2988B232C0334AEB91154D4A2505802F"><enum>(C)</enum><text>download grant applications and reports, in the single data standard adopted under section 9, individually or as a single data set; and</text></subparagraph> 
<subparagraph id="HE22449BF7B1A4930B25A4BCE93D35C6C"><enum>(D)</enum><text display-inline="yes-display-inline">access individual grant applications and reports at web addresses that are distinct, permanent, unique, and searchable.</text></subparagraph></paragraph></subsection> 
<subsection id="H17DFCD5630174C22A942A6809AA9AAEF"><enum>(f)</enum><header>Publication of information</header><text>Nothing in this section shall be construed as requiring the publication of information otherwise exempt under section 552 of title 5, United States Code (popularly referred to as the <quote>Freedom of Information Act</quote>). </text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9A5A1EBF78BC419887F6D0589D26F6AE" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (h), as so redesignated, by striking <quote>All actions</quote> and inserting <quote>Except for actions relating to establishing the website required under subsection (e), all actions</quote>.</text></paragraph></section> 
<section id="HCC1013DF211C4550AE9DE634ECED0E2F" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Report on implementation</header><text display-inline="no-display-inline">The Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is amended by striking section 7 and inserting the following:</text>

<section id="H97E37C5A72424A78B32436A9C6225548" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Evaluation of implementation</header> 
<subsection id="H443331C3F4154372BC94C742A31A4316" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 9 months after the date of the enactment of the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>, and every 2 years thereafter until the date that is 15 years after the date of the enactment of the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>, the Director shall submit to Congress a report regarding the implementation of this Act.</text></subsection> 
<subsection id="H1D04A79AE25B472287C83DE3F5FFE65D" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header> 
<paragraph id="H072BDA92F1E6480996764EAF9C274432" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for the applicable period—</text> 
<subparagraph id="H53B6DA1BB2B8403795A0C114FD1D05EE" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a list of all grants for which an applicant may submit an application using the website established under section 6(e);</text></subparagraph> 
<subparagraph id="H7126DD96888B4F7CA5D945054E6DA23D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a list of all Federal agencies that provide Federal financial assistance to non-Federal entities;</text></subparagraph> 
<subparagraph id="H00BF56D4FE5A4C23A38F31E1D6EDC394" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a list of each Federal agency that has complied, in whole or in part, with the requirements of this Act;</text></subparagraph> 
<subparagraph id="HEFE3AE2A16CC4CF8A3176A4BAFB5437D" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">for each Federal agency listed under subparagraph (C), a description of the extent of the compliance with this Act by the Federal agency;</text></subparagraph> 
<subparagraph id="HAC5A5E29E2764F2D98C8095466FEC28E" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">a list of all Federal agencies exempted under section 6(d);</text></subparagraph> 
<subparagraph id="H38E92078D2DB407590F7DEABC5B4EF88" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">for each Federal agency listed under subparagraph (E)—</text> 
<clause id="H2802C275974147728EC242771A425C59" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">an explanation of why the Federal agency was exempted; and</text></clause> 
<clause id="HCAA982AE068C456DB4EE1A21B8CE6305" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a certification that the basis for the exemption of the Federal agency is still applicable;</text></clause></subparagraph> 
<subparagraph id="H2F34A2DFB6D14F90A008358E08B27421" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">a list of all common application forms that have been developed that allow non-Federal entities to apply, in whole or in part, for multiple Federal financial assistance programs (including Federal financial assistance programs administered by different Federal agencies) through a single common application;</text></subparagraph> 
<subparagraph id="H65D3959993A1439BA741C4F7CD5A2775" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">a list of all common forms and requirements that have been developed that allow non-Federal entities to report, in whole or in part, on the use of funding from multiple Federal financial assistance programs (including Federal financial assistance programs administered by different Federal agencies);</text></subparagraph> 
<subparagraph id="HF0DA284E56574D50B06A8F61571ED00C" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the efforts made by the Director and Federal agencies to communicate and collaborate with representatives of non-Federal entities during the implementation of the requirements under this Act;</text></subparagraph> 
<subparagraph id="HAC27A72AA66B4071A139EF8E93DE8100" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">a description of the efforts made by the Director to work with Federal agencies to meet the goals of this Act, including a description of working groups or other structures used to coordinate Federal efforts to meet the goals of this Act; and</text></subparagraph> 
<subparagraph id="H599543E306574FE29B14B1AFD3A9752A" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">identification and description of all systems being used to disburse Federal financial assistance to non-Federal entities.</text></subparagraph></paragraph> 
<paragraph id="HC439CDA9C8CC4F758E50C0DF6F4EE457" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Subsequent reports</header><text display-inline="yes-display-inline">The second report submitted under subsection (a), and each subsequent report submitted under subsection (a), shall include—</text> 
<subparagraph id="H5B3F230C84994302971F0B88D3084698" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a discussion of the progress made by the Federal Government in meeting the goals of this Act, including the amendments made by the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>, and in implementing the strategic plan submitted under section 8, including an evaluation of the progress of each Federal agency that has not received an exemption under section 6(d) towards implementing the strategic plan; and</text></subparagraph> 
<subparagraph id="H7D82F817CDFD434497809C776C4398CC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a compilation of the reports submitted under section 8(c)(3) during the applicable period.</text></subparagraph></paragraph></subsection> 
<subsection id="H800FF659E0EF458094FE9CD842ACD786" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Definition of applicable period</header><text display-inline="yes-display-inline">In this section, the term <term>applicable period</term> means—</text> 
<paragraph id="HBA83A10E641C42A08639DEFC748B566C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">for the first report submitted under subsection (a), the most recent full fiscal year before the date of the report; and</text></paragraph> 
<paragraph id="H6BE02FEDC19042B5AEDB4EA2CF0FBADA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">for the second report submitted under subsection (a), and each subsequent report submitted under subsection (a), the period beginning on the date on which the most recent report under subsection (a) was submitted and ending on the date of the report.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H31CEDE89497E4A2E996D45F2844F521B" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Strategic plan</header> 
<subsection id="H491B49CD13BF4E66BFA3E2788E4F0119" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is further amended—</text> 
<paragraph id="H60339EFF758C455E89D28E49C7AB1DE6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 8, 9, 10, and 11 as sections 9, 10, 11, and 12, respectively; and</text></paragraph> 
<paragraph id="H3935D0C3AB7B4F95BF61098CAD11BADF" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 7, as amended by this Act, the following new section:</text>

<section id="HFF2A051DEEED4F22999C160DEF1E07A0" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Strategic plan</header> 
<subsection id="H5E37EBF3709249D8B71CD753234A6B32" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>, the Director shall submit to Congress a strategic plan that—</text> 
<paragraph id="H4F957961178946E09A1DDF7E153C47A3" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">identifies Federal financial assistance programs that are suitable for common applications based on the common or similar purposes of the Federal financial assistance;</text></paragraph> 
<paragraph id="H1955165D22894987AEBF2296DA592B17" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">identifies Federal financial assistance programs that are suitable for common reporting forms or requirements based on the common or similar purposes of the Federal financial assistance;</text></paragraph> 
<paragraph id="H2160F363F3A34E7AB72CABDBE351611A" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">identifies common aspects of multiple Federal financial assistance programs that are suitable for common application or reporting forms or requirements;</text></paragraph> 
<paragraph id="HF73F943F08804A7B8F20260A9673A35A" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">identifies changes in law, if any, needed to achieve the goals of this Act; and</text></paragraph> 
<paragraph id="H92B32D1EDCB448B386281BF57B87D202" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">provides plans, timelines, and cost estimates for—</text> 
<subparagraph id="H6C7A1F12E65C4E9A87996659B979A9AB" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">developing an entirely electronic, web-based process for managing Federal financial assistance, including the ability to—</text> 
<clause id="HC24E264D09524939823E0C2B3B93F4A7" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">apply for Federal financial assistance;</text></clause> 
<clause id="H9F4598DC66274D0FA9B6FF309F030AC7" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">track the status of applications for and payments of Federal financial assistance;</text></clause> 
<clause id="H3B7B457A7F6B47A5B2B8E1659817676A" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">report on the use of Federal financial assistance, including how such use has been in furtherance of the objectives or purposes of the Federal financial assistance; and</text></clause> 
<clause id="H3E803947B64D4C04977C33FBAC4DE029" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">provide required certifications and assurances;</text></clause></subparagraph> 
<subparagraph id="H76ED94393B124AAE86EA33D2E70A0228" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">ensuring full compliance by Federal agencies with the requirements of this Act, including the amendments made by the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>;</text></subparagraph> 
<subparagraph id="H8524A0AD09584874B8EDB6C04CF577A1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">creating common applications for the Federal financial assistance programs identified under paragraph (1), regardless of whether the Federal financial assistance programs are administered by different Federal agencies;</text></subparagraph> 
<subparagraph id="H4413DBD4A7EE49DDB38651762971D868" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">establishing common financial and performance reporting forms and requirements for the Federal financial assistance programs identified under paragraph (2), regardless of whether the Federal financial assistance programs are administered by different Federal agencies;</text></subparagraph> 
<subparagraph id="H37D7A082CD1C4668A351BD2004563E36" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">establishing common applications and financial and performance reporting forms and requirements for aspects of the Federal financial assistance programs identified under paragraph (3), regardless of whether the Federal financial assistance programs are administered by different Federal agencies;</text></subparagraph> 
<subparagraph id="HB869A765B16F46F0A8019CDFB28B0586" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">developing mechanisms to ensure compatibility between Federal financial assistance administration systems and State systems to facilitate the importing and exporting of data;</text></subparagraph> 
<subparagraph id="H94373A48B7304E499D2F98E4F50797DB" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">developing common certifications and assurances, as appropriate, for all Federal financial assistance programs that have common or similar purposes, regardless of whether the Federal financial assistance programs are administered by different Federal agencies;</text></subparagraph> 
<subparagraph id="H59E10F3038BE43309642312635BB1D6A" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">minimizing the number of different systems used to disburse Federal financial assistance; and</text></subparagraph> 
<subparagraph id="HBFD1A4B6F3AD45E8B21006A9A96E3063"><enum>(I)</enum><text>applying the single data standard adopted under section 9 to Federal grants and grant applications.</text></subparagraph></paragraph></subsection> 
<subsection id="H70E7D96FF75746239FF6B0AE8B7ED76B" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In developing and implementing the strategic plan under subsection (a), the Director shall consult with representatives of non-Federal entities and Federal agencies that have not received an exemption under section 6(d).</text></subsection> 
<subsection id="HBF22E8EEDB5741F7A5C6EA90AC64F10F" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Federal agencies</header> 
<paragraph id="H3F6AD56E09374196B0A7DF03C8BDBEB3" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date on which the Director submits the strategic plan under subsection (a), the head of each Federal agency that has not received an exemption under section 6(d) shall develop a plan that describes how the Federal agency will carry out the responsibilities of the Federal agency under the strategic plan, which shall include—</text> 
<subparagraph id="HC4A3A93D2A1041F3AB4AD3BB54716296" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">clear performance objectives and timelines for action by the Federal agency in furtherance of the strategic plan; and</text></subparagraph> 
<subparagraph id="HE980D1600E784C25AA2BFAB90F7D2A3C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the identification of measures to improve communication and collaboration with representatives of non-Federal entities on an on-going basis during the implementation of this Act.</text></subparagraph></paragraph> 
<paragraph id="HB0D9EC841FAE4CDCAEA48FE8D78FFE9B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The head of each Federal agency that has not received an exemption under section 6(d) shall consult with representatives of non-Federal entities during the development and implementation of the plan of the Federal agency developed under paragraph (1).</text></paragraph> 
<paragraph id="HF0E542A3896A491383DC0B14FDC6CBF3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the head of a Federal agency that has not received an exemption under section 6(d) develops the plan under paragraph (1), and every 2 years thereafter until the date that is 15 years after the date of the enactment of the <short-title>Federal Financial Assistance Management Improvement Act of 2009</short-title>, the head of the Federal agency shall submit to the Director a report regarding the progress of the Federal agency in achieving the objectives of the plan of the Federal agency developed under paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H20106E9906F348A8950C5559D5549878" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">Section 5(d) of the Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is amended by inserting <quote>, until the date on which the Federal agency submits the first report by the Federal agency required under section 8(c)(3)</quote> after <quote>subsection (a)(7)</quote>.</text></subsection></section> 
<section id="H8B7EE7E8EEFA4F62A759BD358456FED3"><enum>6.</enum><header>Data standard requirements</header> 
<subsection id="HAB7025C220C24CBABB0C44636466D44C"><enum>(a)</enum><header>Data standard requirements</header><text display-inline="yes-display-inline">The Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is further amended—</text> 
<paragraph id="HE853413D3C6C4293A0F2FA78BEDE19AE" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 9, 10, 11, and 12 as sections 10, 11, 12, and 13, respectively; and</text></paragraph> 
<paragraph id="H98CCE2C6A12740BF94872C50AE760E9F"><enum>(2)</enum><text>by inserting after section 8, as added by this Act, the following new section:</text>

<subsection id="HEB4DA4D1144E474FA8853F6917AE98E6"><enum>(a)</enum><header>Data standard requirements</header> 
<paragraph id="HC7739CBACB0647C6BB4FFFFC7F3D4A08"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall adopt a single data standard for the collection, analysis, and dissemination of business and financial information for use by private sector entities in accordance with subsection (b) for information required to be reported to the Federal Government, and a single data standard for use by agencies within the Federal Government in accordance with subsection (c) for Federal financial information.</text></paragraph> 
<paragraph id="HFFEBEC956DC1401AA5CB1BFD8394AF2C"><enum>(2)</enum><header>Characteristics of data standards</header><text>The single data standards required by paragraph (1) shall—</text> 
<subparagraph id="HD153D2D705CA43D7BE4B7A5D1F956B65"><enum>(A)</enum><text>be common across all agencies, to the maximum extent practicable;</text></subparagraph> 
<subparagraph id="H8CE57A763E1547D1B0D4586C6635F835"><enum>(B)</enum><text>be a widely accepted, non-proprietary, searchable, computer-readable format for business and financial data;</text></subparagraph> 
<subparagraph id="HCF6755889EF74DE1BF05288455236AB6"><enum>(C)</enum><text>be consistent with and implement—</text> 
<clause id="HB418FCA1E1D7483FA2326B732451D4CB"><enum>(i)</enum><text>United States generally accepted accounting principles or Federal financial accounting standards (as appropriate);</text></clause> 
<clause id="H539ABD4B0BED4EE7B18838CFFCD51017"><enum>(ii)</enum><text display-inline="yes-display-inline">industry best practices; and</text></clause> 
<clause id="HE2E30BB42F8546A68040573532D52415"><enum>(iii)</enum><text>Federal regulatory requirements;</text></clause></subparagraph> 
<subparagraph id="H01AAD4A8200845B8BF5F13961516B21A"><enum>(D)</enum><text>improve the transparency, consistency, and usability of business and financial information; and</text></subparagraph> 
<subparagraph id="H8B4C1595495E4DD59A18636BE1E10248"><enum>(E)</enum><text>be capable of being continually upgraded to be of maximum use as technologies and content evolve over time.</text></subparagraph></paragraph></subsection> 
<subsection id="H731C727A4823461A8D6DF769B6E9C34D"><enum>(b)</enum><header>Implementation of single data standard for private sector</header> 
<paragraph id="HA207C259EE1D4CBE83BF058176A7A060"><enum>(1)</enum><header>OMB Guidance</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the Federal Financial Assistance Management Improvement Act of 2009, the Director of the Office of Management and Budget shall issue guidance to agencies on the use and implementation of the single data standard required by subsection (a) for information required to be reported to agencies by the private sector.</text></paragraph> 
<paragraph id="HC4BD8A0CFE1E4AC1834B98A0891BDE50"><enum>(2)</enum><header>Agency requirements</header> 
<subparagraph id="H45E9935AC29740318A57216148BCC959" display-inline="no-display-inline"><enum>(A)</enum><header>Requirement</header><text>To the maximum extent practicable and consistent with the guidance provided by the Office of Management and Budget under paragraph (1), the head of each agency shall require the use of the single data standard required by subsection (a) for business and financial information reported to the agency by private sector companies. </text></subparagraph> 
<subparagraph id="HD988F909AC314286867C19DE0F541690"><enum>(B)</enum><header>Implementation</header><text display-inline="yes-display-inline">The head of the agency shall begin implementing the requirement of subparagraph (A) within one year after the date of the enactment of the Federal Financial Assistance Management Improvement Act of 2009.</text></subparagraph></paragraph></subsection> 
<subsection id="HB1FDE717830445049175A47D485A3196"><enum>(c)</enum><header>Implementation of single data standard for Federal Government</header> 
<paragraph id="HD89B167D377041D785EF8A1C6598FF7C" display-inline="no-display-inline"><enum>(1)</enum><header>OMB development</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of the Federal Financial Assistance Management Improvement Act of 2009, the Director of the Office of Management and Budget shall develop the single data standard required by subsection (a) for use by agencies within the Federal Government for Federal financial information.</text></paragraph> 
<paragraph id="HE4197CF6168E4861A8C5AFEDB16C77CF"><enum>(2)</enum><header>OMB guidance</header><text>Not later than 18 months after the date of the enactment of the Federal Financial Assistance Management Improvement Act of 2009, the Director shall issue guidance to agencies on the use and implementation of the single data standard developed under paragraph (1).</text></paragraph></subsection> 
<subsection id="H1213E03C47BB4D3A9F6BA43CF31C14A7"><enum>(d)</enum><header>Public access to data</header><text>The head of each agency shall ensure that information collected using the single data standards required under this section is accessible to the general public in that format to the extent permitted by law.</text></subsection> 
<subsection id="H854A952BCC564BB4929D207788F9912F"><enum>(e)</enum><header>Report</header><text>Within one year after the date of the enactment of the Federal Financial Assistance Management Improvement Act of 2009, the Director of the Office of Management and Budget shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the status of the implementation of this section.</text></subsection> 
<subsection id="H25140D9157D34C08BB8B03D8184E6B3F"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H772548B25CD5411FB30886ECEB3F8238"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> means any executive department, military department, Government corporation, Government controlled corporation, independent establishment, or other establishment in the executive branch of the Government (including the Executive Office of the President), or any independent regulatory agency, but does not include—</text> 
<subparagraph id="H182467ECC8724AB5A7AD05005487A848"><enum>(A)</enum><text>the Government Accountability Office;</text></subparagraph> 
<subparagraph id="HCC4B29241B6C49D6A74ABF5926EF4C05"><enum>(B)</enum><text>the Federal Election Commission;</text></subparagraph> 
<subparagraph id="H7B965A38276A4784A48B6B85F42F8996"><enum>(C)</enum><text>the governments of the District of Columbia and of the territories and possessions of the United States, and their various subdivisions; or</text></subparagraph> 
<subparagraph id="H84294269B392490591633C28F8D50687"><enum>(D)</enum><text>Government-owned contractor-operated facilities, including laboratories engaged in national defense research and production activities.</text></subparagraph></paragraph> 
<paragraph id="HD81B5002AD6548CBAF738045E04244F5"><enum>(2)</enum><header>Executive department, military department, government corporation, government controlled corporation, independent establishment</header><text>The terms <quote>Executive department</quote>, <quote>military department</quote>, <quote>Government corporation</quote>, <quote>Government controlled corporation</quote>, and <quote>independent establishment</quote> have the meanings given those terms by chapter 1 of title 5, United States Code.</text></paragraph> 
<paragraph id="H4415DE918CB2411F9975F2D5C4A70845"><enum>(3)</enum><header>Independent regulatory agency</header><text>The term <quote>independent regulatory agency</quote> has the meaning given that term by section 3502(5) of title 44, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCA0DD9B32D3349809E9E7E42845810E6"><enum>(b)</enum><header>Requirement for use of single data standard by Federal agencies</header><text display-inline="yes-display-inline">Section 5 of the Federal Financial Assistance Management Improvement Act of 1999 (31 U.S.C. 6101 note) is amended by adding at the end the following new subsection:</text>

<subsection id="HD6406AF5FA6F4C2DBE6332589FEB0E53"><enum>(e)</enum><header>Single data standard requirement</header><text display-inline="yes-display-inline">To the maximum extent practicable and consistent with the guidance provided by the Director under section 9, each Federal agency shall require the use of the single data standard adopted under section 9(b) for—</text> 
<paragraph id="H84ED3A40B1F8446DAAFFF151DF259769"><enum>(1)</enum><text>all applications for Federal financial assistance; and</text></paragraph> 
<paragraph id="H74B1EC5F510A45199744E36E4AEE089D"><enum>(2)</enum><text>all reports on the use of Federal financial assistance that the agency requires non-Federal entities to submit.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
