		<official-title>To direct the Administrator of the Small Business
		  Administration to reform and improve the HUBZone program for small business
		  concerns, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>HUBZone Improvement Act of
			 2010</short-title></quote>.</text>
		</section><section id="id384780D6BBB1433781FD1C8FDE104471"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="idA62D6F60C6D24CE4BFC9C9109BB25E16"><enum>(1)</enum><text>the terms
			 <term>Administration</term> and <term>Administrator</term> mean the Small
			 Business Administration and the Administrator thereof, respectively;</text>
			</paragraph><paragraph id="id7C76DCF12E3B4D95AB227E29C5436552"><enum>(2)</enum><text>the terms
			 <term>HUBZone</term> and <term>HUBZone small business concern</term> and
			 <term>HUBZone map</term> have the meanings given those terms in section 3(p) of
			 the Small Business Act (15 U.S.C. 632(p)), as amended by this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DDA3EB3910643FCB38E39FA504C95D9"><enum>(3)</enum><text>the term
			 <term>recertification</term> means a determination by the Administrator that a
			 business concern that was previously determined to be a qualified HUBZone small
			 business concern is a qualified HUBZone small business concern under section
			 3(p)(5) of the Small Business Act (15 U.S.C. 632(p)(5)).</text>
			</paragraph></section><section id="id3BA30DE28EE448DDB9989B48ACFDCF38"><enum>3.</enum><header>Purpose;
			 findings</header>
			<subsection id="ID22dd438a2b2642349f1e25a30641b479"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this Act is to reform and improve the HUBZone program of the
			 Administration.</text>
			</subsection><subsection id="id7B7FC987BAE34C51ACDD42AD46320129"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="IDb1885b3a639f444bb62862d7f6a67614"><enum>(1)</enum><text>the HUBZone
			 program was established under the HUBZone Act of 1997 (Public Law 105–135; 111
			 Stat. 2627) to stimulate economic development through increased employment and
			 capital investment by providing Federal contracting preferences to small
			 business concerns in those areas, including inner cities and rural counties,
			 that have low household incomes, high unemployment, and suffered from a lack of
			 investment; and</text>
				</paragraph><paragraph id="ID7aec61b3412648be8e6b163eb9b3e03e"><enum>(2)</enum><text>according to the
			 Government Accountability Office, the weakness in the oversight of the HUBZone
			 program by the Administration has exposed the Government to fraud and
			 abuse.</text>
				</paragraph></subsection></section><section id="id14F75EF363654CC2B2C11DE23F24C6DF"><enum>4.</enum><header>HUBZone
			 improvements</header><text display-inline="no-display-inline">The Administrator
			 shall—</text>
			<paragraph id="IDecc252dc32a94bda99ca5cda06a78684"><enum>(1)</enum><text>ensure the
			 HUBZone map—</text>
				<subparagraph id="id87B220122FA64029B987191F7FE808BC"><enum>(A)</enum><text>is accurate and
			 up-to-date; and</text>
				</subparagraph><subparagraph id="idC4DD8657C3794E0C87FD3838E8F246FF"><enum>(B)</enum><text>revised as new
			 data is made available to maintain the accuracy and currency of the HUBZone
			 map;</text>
				</subparagraph></paragraph><paragraph id="IDfbb91bc9979d4bee82933720e6ec54ab"><enum>(2)</enum><text>implement
			 policies for ensuring that only HUBZone small business concerns determined to
			 be qualified under section 3(p)(5) of the Small Business Act (15 U.S.C.
			 632(p)(5)) are participating in the HUBZone program, including through the
			 appropriate use of technology to control costs and maximize, among other
			 benefits, uniformity, completeness, simplicity, and efficiency;</text>
			</paragraph><paragraph id="ID410f499289a84d8d8870ee8cbd379cbb"><enum>(3)</enum><text>submit to the
			 Committee on Small Business and Entrepreneurship of the Senate and the
			 Committee on Small Business of the House of Representatives a report regarding
			 any application to be designated as a HUBZone small business concern or for
			 recertification for which the Administrator has not made a determination as of
			 the date that is 60 days after the date on which the application was submitted
			 or initiated, which shall include a plan and timetable for ensuring the timely
			 processing of the applications; and</text>
			</paragraph><paragraph id="ID17e9196638f94b618b9b0f56432ddf4c"><enum>(4)</enum><text>develop measures
			 and implement plans to assess the effectiveness of the HUBZone program
			 that—</text>
				<subparagraph id="idEF0C5C3385DE46DD833EF117D6A366D1"><enum>(A)</enum><text>require the
			 identification of a baseline point in time to allow the assessment of economic
			 development under the HUBZone program, including creating additional jobs;
			 and</text>
				</subparagraph><subparagraph id="id72DACE381CAE42E99F5DCD0FCDA74B71"><enum>(B)</enum><text>take into
			 account—</text>
					<clause id="idDD5B57BD945640A2BFC60A501C842812"><enum>(i)</enum><text>the
			 economic characteristics of the HUBZone; and</text>
					</clause><clause id="idF279644068BD4F9DBBE8496FB4CF2457"><enum>(ii)</enum><text>contracts being
			 counted under multiple socioeconomic subcategories.</text>
					</clause></subparagraph></paragraph></section><section id="idE53C8DF39BD449A7A006E44C019A09BD"><enum>5.</enum><header>Employment
			 percentage</header><text display-inline="no-display-inline">Section 3(p) of the
			 Small Business Act (15 U.S.C. 632(p)) is amended—</text>
			<paragraph id="id5DB54A5988464B3CB69AA5A2DF60140B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idC7891606D6E54C4FBF8DA9EAC206F0ED" style="OLC">
					<subparagraph id="idF8704FA170F840C99FF57FC88079038C"><enum>(E)</enum><header>Employment
				percentage during interim period</header>
						<clause id="id7B092DD13FA3429E9A037D936F8C040B"><enum>(i)</enum><header>Definition</header><text>In
				this subparagraph, the term <term>interim period</term> means the period
				beginning on the date on which the Administrator determines that a HUBZone
				small business concern is qualified under subparagraph (A) and ending on the
				day before the date on which a contract under the HUBZone program for which the
				HUBZone small business concern submits a bid is awarded.</text>
						</clause><clause id="idF122639991584E2D9CF1E52411C14AA6"><enum>(ii)</enum><header>Interim
				period</header><text>During the interim period, the Administrator may not
				determine that the HUBZone small business is not qualified under subparagraph
				(A) based on a failure to meet the applicable employment percentage under
				subparagraph (A)(i)(I), unless the HUBZone small business concern—</text>
							<subclause id="id84D51A26145E4532A8D198A1E297D838"><enum>(I)</enum><text>has not attempted
				to maintain the applicable employment percentage under subparagraph (A)(i)(I);
				or</text>
							</subclause><subclause id="idAA16BB9B5A744096AA9098EF862D7889"><enum>(II)</enum><text>does not meet
				the applicable employment percentage—</text>
								<item id="id4093549B971E421394019A50DCE60D01"><enum>(aa)</enum><text>on
				the date on which the HUBZone small business concern submits a bid for a
				contract under the HUBZone program; or</text>
								</item><item id="id66568AF5B6154996ACE0CA729CE4C4E8"><enum>(bb)</enum><text>on
				the date on which the HUBZone small business concern is awarded a contract
				under the HUBZone program.</text>
								</item></subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idA020D70CCB7849E49AD57ECEE265C904"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7704C367FAB34EBB96721F0709FD4B3A" style="OLC">
					<paragraph id="id88C4FE6BA3ED4691896BE45CA1124EC2"><enum>(8)</enum><header>HUBZone
				program</header><text>The term <term>HUBZone program</term> means the program
				established under section 31.</text>
					</paragraph><paragraph id="id843CD8B69E934C11963DDE168FCEC115"><enum>(9)</enum><header>HUBZone
				map</header><text>The term <term>HUBZone map</term> means the map used by the
				Administration to identify
				HUBZones.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id4CE70EFAF246423780153C93B4470D72"><enum>6.</enum><header>Redesignated
			 areas</header><text display-inline="no-display-inline">Section 3(p)(4)(C)(i) of
			 the Small Business Act (15 U.S.C. 632(p)(4)(C)(i)) is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="idF245B0165966402ABD956B10906ED671" style="OLC">
				<clause id="idF33D127FA6C2441FA438869CE6A39AD4"><enum>(i)</enum><text>3
				years after the first date on which the Administrator publishes a HUBZone map
				that is based on the results from the 2010 decennial census;
				or</text>
				</clause><after-quoted-block>.</after-quoted-block></quoted-block>
