		<official-title display="yes">To amend the Internal Revenue Code of 1986
		  to impose a 50 percent tax on bonuses paid by TARP recipients, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H943CD9D1D0894198BC572ACD22B1D8C1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wall Street Bonus Tax
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HE18B0C79955049A494FC09C644A9FE2D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Excise tax on bonuses received by employees
			 of businesses receiving TARP funds</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDAA9FA55E5144829B970F5B895B09271"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 46 of the Internal Revenue Code of
			 1986 is amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HC619EFAC04A546C79A8A379D0C448070" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H4AA75C8271624590A263E6C9E1757257" section-type="subsequent-section"><enum>4999A.</enum><header display-inline="yes-display-inline">Bonuses paid by TARP recipients</header>
						<subsection commented="no" display-inline="no-display-inline" id="HC060D8B87D974F77BDE9B0F001C54E67"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of any payment of compensation
				during 2010 in the nature of a bonus by a TARP recipient to any employee or
				former employee of such recipient, there is hereby imposed a tax equal to 50
				percent of so much of such compensation as exceeds $25,000.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HE067E567CAA642DCA393627494B03A98"><enum>(b)</enum><header display-inline="yes-display-inline">Tax paid by bonus recipient</header><text display-inline="yes-display-inline">The tax imposed by this section shall be
				paid by such employee or former employee.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H223B84E2A9E248C49A6DA0C32CF6A8B8"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions and special rules</header><text display-inline="yes-display-inline">For purposes of this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H6807A899F54A41A1A88737EBDA2852AB"><enum>(1)</enum><header display-inline="yes-display-inline">TARP
				recipient</header><text display-inline="yes-display-inline">The term <term>TARP
				recipient</term> means any person who receives funds under title I of the
				Emergency Economic Stabilization Act of 2008.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H76A25DC0012F433D8FF8AE671F9E3CAA"><enum>(2)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> includes
				officers and executives.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC2B1C2211D2C49A7B01C4C5AF18D02D2"><enum>(3)</enum><header display-inline="yes-display-inline">Entities acquired by TARP
				recipients</header><text display-inline="yes-display-inline">If more than 50
				percent of the equity interests in any person is acquired by a TARP recipient,
				such person shall be treated as a TARP recipient for purposes of this section
				and subsection (a) shall apply to applicable compensation paid by such person
				after the earlier of the date of such acquisition or the date that such
				acquisition is announced.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H451CCEC83DC54B018248C3BEC5ECD8DD"><enum>(4)</enum><header display-inline="yes-display-inline">Certain controlled groups,
				etc</header><text display-inline="yes-display-inline">All employees who are
				treated as employed by a single employer under subsections (b), (c), or (m) of
				section 414 shall be treated as employed by a single employer for purposes of
				this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB09457F71A6F47759909D3A298FA02F8"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for chapter 46 of
			 such Code is amended by adding at the end the following new item:</text>

				paid by TARP
				recipients.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H04B3538196C8485D8AB17533B901DCA4" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Direct lending program for small business
			 concerns</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB6A8807E9E054B868B3D6360AC5807EB"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Administrator of the Small Business
			 Administration shall establish and carry out a program under which the
			 Administrator is authorized to make loans directly to small business
			 concerns.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5C38B42D892D44E6B3C86B4B134C4904"><enum>(b)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">To the extent practicable, the
			 Administrator of the Small Business Administration shall carry out the program
			 established under subsection (a) in a manner similar to the loan program under
			 section 7(a) of the Small Business Act (15 U.S.C. 636(a)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HED33F1BBCF1B4246B23C0A5F26125CD6"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Administrator of the Small Business
			 Administration shall carry out the program established under subsection (a)
			 using amounts made available to the Administrator under section 9511 of the
			 Internal Revenue Code of 1986.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA4E7310667F1403BB2966D1760B59BCF"><enum>(d)</enum><header display-inline="yes-display-inline">Small business concern
			 defined</header><text display-inline="yes-display-inline">The term <term>small
			 business concern</term> has the meaning given such term under section 3(a) of
			 the Small Business Act (15 U.S.C. 632(a)).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HBABDD9D7B9CE4023AF8E4C2482AC4518" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Small Business Growth Fund</header>
			<subsection commented="no" display-inline="no-display-inline" id="H7025B63992E148DAA6D4A4AEF89C356A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 98 of the Internal Revenue Code of
			 1986 is amended by adding at the end the following new section:</text>

					<section commented="no" display-inline="no-display-inline" id="HB04359858ACD44EA91656E0009D0AB58" section-type="subsequent-section"><enum>9511.</enum><header display-inline="yes-display-inline">Small Business Growth Fund</header>
						<subsection commented="no" display-inline="no-display-inline" id="HE0272D48EF0E4E978CB4D78D775525F8"><enum>(a)</enum><header display-inline="yes-display-inline">Creation of trust fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the
				United States a trust fund to be known as the <quote>Small Business Growth
				Fund</quote>, consisting of such amounts as may be appropriated or credited to
				such Fund as provided in this section or section 9602(b).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HA8E1DA1FE95F4EF392F10637110D4AA9"><enum>(b)</enum><header display-inline="yes-display-inline">Transfers to Trust Fund</header><text display-inline="yes-display-inline">There are hereby appropriated to the Small
				Business Growth Fund amounts equivalent to the taxes received in the Treasury
				under section 4999A.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HDEC588F4A77D47219051A2C62CEE581B"><enum>(c)</enum><header display-inline="yes-display-inline">Expenditures</header><text display-inline="yes-display-inline">Amounts in the Small Business Growth Fund
				shall be available, as provided in appropriations Acts, only for carrying out
				the direct lending program for small business concerns under section 3 of the
				Wall Street Bonus Act, as in effect on the date of the enactment of such
				Act.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1B04874D749F4443B72079EB5D7FDC75"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for chapter 98 of
			 such Code is amended by adding at the end the following new item:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB094D80B63424B4DAD839D13BBE01DE5"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date of the enactment of this Act.</text>
