		<section id="idB89C0E932D3D48D696E64C5FBB065A54" section-type="section-one"><enum>1.</enum><header>Fiscal years 2010 and 2011
			 earmark moratorium</header>
			<subsection id="id356182D2835141F8AFF2F5A8B10CDAF3"><enum>(a)</enum><header>Bills and joint
			 resolutions</header>
				<paragraph id="id67BC1B0DE773424BB66D0F9E8B168EF0"><enum>(1)</enum><header>Point of
			 order</header><text>It shall not be in order to—</text>
					<subparagraph id="idCFE89AE04C434D4791CC395DA57059DC"><enum>(A)</enum><text>consider a bill
			 or joint resolution reported by any committee that includes an earmark, limited
			 tax benefit, or limited tariff benefit; or</text>
					</subparagraph><subparagraph id="id9DEF21C11DED4A36B9C2629B68995E02"><enum>(B)</enum><text>a Senate bill or
			 joint resolution not reported by committee that includes an earmark, limited
			 tax benefit, or limited tariff benefit.</text>
					</subparagraph></paragraph><paragraph id="idECA0C44ECBF44B878043A9DA366710E2"><enum>(2)</enum><header>Return to the
			 calendar</header><text>If a point of order is sustained under this subsection,
			 the bill or joint resolution shall be returned to the calendar until compliance
			 with this subsection has been achieved.</text>
				</paragraph></subsection><subsection id="id4C252C34A63048469BBD3364668B79ED"><enum>(b)</enum><header>Conference
			 report</header>
				<paragraph id="idA7772B17616541F58E3A2A505B5C1C9A"><enum>(1)</enum><header>Point of
			 order</header><text>It shall not be in order to vote on the adoption of a
			 report of a committee of conference if the report includes an earmark, limited
			 tax benefit, or limited tariff benefit.</text>
				</paragraph><paragraph id="id7BA758AC67934E488B5FE6D2723906DC"><enum>(2)</enum><header>Return to the
			 calendar</header><text>If a point of order is sustained under this subsection,
			 the conference report shall be returned to the calendar.</text>
				</paragraph></subsection><subsection id="idED5A3F546CBF4AFF876C2EB7749C6CE1"><enum>(c)</enum><header>Floor
			 amendment</header><text>It shall not be in order to consider an amendment to a
			 bill or joint resolution if the amendment contains an earmark, limited tax
			 benefit, or limited tariff benefit.</text>
			</subsection><subsection id="id8F3201AAB35140BB85A710918F365993"><enum>(d)</enum><header>Amendment
			 between the Houses</header>
				<paragraph id="idAC1722539E904D949BC21FE523DBD832"><enum>(1)</enum><header>In
			 general</header><text>It shall not be in order to consider an amendment between
			 the Houses if that amendment includes an earmark, limited tax benefit, or
			 limited tariff benefit.</text>
				</paragraph><paragraph id="id49FCD35CA5194A2F8F5C8F613283C5F8"><enum>(2)</enum><header>Return to the
			 calendar</header><text>If a point of order is sustained under this subsection,
			 the amendment between the Houses shall be returned to the calendar until
			 compliance with this subsection has been achieved.</text>
				</paragraph></subsection><subsection id="id81E4B32EA69645F3BC21BE335DB77C4B"><enum>(e)</enum><header>Waiver</header><text>Any
			 Senator may move to waive any or all points of order under this section by an
			 affirmative vote of two-thirds of the Members, duly chosen and sworn.</text>
			</subsection><subsection id="id0D1B0AD371FA43A5BF3D0E62EE19C3F0"><enum>(f)</enum><header>Definitions</header><text>For
			 the purpose of this section—</text>
				<paragraph id="idF5E5B3A57E984505B9D3D3B37B8BC3FB"><enum>(1)</enum><text>the term
			 <term>earmark</term> means a provision or report language included primarily at
			 the request of a Senator or Member of the House of Representatives providing,
			 authorizing, or recommending a specific amount of discretionary budget
			 authority, credit authority, or other spending authority for a contract, loan,
			 loan guarantee, grant, loan authority, or other expenditure with or to an
			 entity, or targeted to a specific State, locality or Congressional district,
			 other than through a statutory or administrative formula-driven or competitive
			 award process;</text>
				</paragraph><paragraph id="id566EEA7F09EC4F62B2B0B0DEC78C3FB5"><enum>(2)</enum><text>the term
			 <term>limited tax benefit</term> means any revenue provision that—</text>
					<subparagraph id="idDB7753022C614E8887B9C2FEBC144420"><enum>(A)</enum><text>provides a
			 Federal tax deduction, credit, exclusion, or preference to a particular
			 beneficiary or limited group of beneficiaries under the Internal Revenue Code
			 of 1986; and</text>
					</subparagraph><subparagraph id="id45A83BEA34F945D2B3E365DB7E42F9DD"><enum>(B)</enum><text>contains
			 eligibility criteria that are not uniform in application with respect to
			 potential beneficiaries of such provision; and</text>
					</subparagraph></paragraph><paragraph id="id94527702A582410EB362F7AF59C785D2"><enum>(3)</enum><text>the term
			 <term>limited tariff benefit</term> means a provision modifying the Harmonized
			 Tariff Schedule of the United States in a manner that benefits 10 or fewer
			 entities.</text>
				</paragraph></subsection><subsection id="id22FE86EBB5AF450698F150B15B72BEFF"><enum>(g)</enum><header>Fiscal years
			 2010 and 2011</header><text>The point of order under this section shall only
			 apply to legislation providing or authorizing discretionary budget authority,
			 credit authority or other spending authority, providing a federal tax
			 deduction, credit, or exclusion, or modifying the Harmonized Tariff Schedule in
			 fiscal years 2010 and 2011.</text>
			</subsection><subsection id="idB753BB9FBA7A492C98F44C068262CD22"><enum>(h)</enum><header>Application</header><text>This
			 rule shall not apply to any authorization of appropriations to a Federal entity
			 if such authorization is not specifically targeted to a State, locality or
			 congressional district.</text>
