			 concern</term> has the meaning given that term under section 3 of the Small

			<section commented="no" display-inline="no-display-inline" id="H9998CE1560344AE7BFDA329F2BE7ACC2" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Leadership and oversight</header>
				<subsection commented="no" display-inline="no-display-inline" id="id191F5B4C5EC840D1BDF71A17DB9C1D3E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 15 of the Small Business Act (15
			 U.S.C. 644) is amended by adding at the end the following:</text>

						<subsection commented="no" display-inline="no-display-inline" id="H0FCE8C38FC1249E58799A18B409140A6"><enum>(q)</enum><header display-inline="yes-display-inline">Bundling Accountability Measures</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H7CBCC2B984C24E41B2F7001197E982F6"><enum>(1)</enum><header display-inline="yes-display-inline">Teaming requirements</header><text display-inline="yes-display-inline">Each Federal agency shall include in each
				solicitation for any contract award above the substantial bundling threshold of
				the Federal agency a provision soliciting bids by teams and joint ventures of
				small business concerns.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8710F4C6E4A945C696DC42E6B5A22689"><enum>(2)</enum><header display-inline="yes-display-inline">Agency Policies on Reduction of Contract
				Bundling</header><text display-inline="yes-display-inline">The head of each
				Federal agency shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id7AC3649BAB9748259A119DE732600DC8"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of
				enactment of this subsection, publish on the website of the Federal agency the
				policy of the Federal agency regarding contracting bundling and consolidation,
				including regarding the solicitation of teaming and joint ventures under
				paragraph (1); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16B49D0619104D519242BEA5CD6AF548"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 30 days after the date on
				which the head of the Federal agency submits data certifications to the
				Administrator for Federal Procurement Policy, publish on the website of the
				Federal agency a list and rationale for any bundled contract for which the
				Federal agency solicited bids or that was awarded by the Federal agency.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE48D2549A94347CDA96A6415BB8B0CE8"><enum>(3)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				enactment of this subsection, and every 3 years thereafter, the Director of
				Small and Disadvantaged Business Utilization for each Federal agency shall
				submit to the Committee on Small Business and Entrepreneurship of the Senate
				and the Committee on Small Business of the House of Representatives a report
				regarding procurement center representatives and commercial market
				representatives, which shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD27FC372FB5146C5A4FFD6AAC1F73397"><enum>(A)</enum><text display-inline="yes-display-inline">identify each area for which the Federal
				agency has assigned a procurement center representative or a commercial market
				representative;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id179C7574E5504B61BEC68EDE3FE5433C"><enum>(B)</enum><text display-inline="yes-display-inline">explain why the Federal agency selected the
				areas identified under subparagraph (A); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17193C1C244440C8B0103BCBF474277A"><enum>(C)</enum><text display-inline="yes-display-inline">describe the activities performed by
				procurement center representatives and commercial market
				representatives.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id11B34F0F76D0479CB1D00792CC67F4BE"><enum>(b)</enum><header display-inline="yes-display-inline">Technical correction</header><text display-inline="yes-display-inline">Section 15(g) of the Small Business Act (15
			 U.S.C. 644(g)) is amended by striking <quote>Administrator of the Office of
			 Federal Procurement Policy</quote> each place it appears and inserting
			 <quote>Administrator for Federal Procurement Policy</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd4024a0d45a9466db49fbeeee312b2cf"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idB90DA0FAFC1C42C6B4A7C2FC3FFADAF7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 submit to Congress a report regarding the procurement center representative
			 program of the Administration.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD04865A90EA8416C884461C354D5C781"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report submitted under paragraph (1)
			 shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id43FA4D08A13C4C51A1EAFC944AA8AE0C"><enum>(A)</enum><text display-inline="yes-display-inline">address ways to improve the effectiveness
			 of the procurement center representative program in helping small business
			 concerns obtain Federal contracts;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D561F96B7C7449C9069C6CB42B43095"><enum>(B)</enum><text display-inline="yes-display-inline">evaluate the effectiveness of procurement
			 center representatives and commercial marketing representatives; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2043A50331B54D61AD63483B301738A4"><enum>(C)</enum><text display-inline="yes-display-inline">include recommendations, if any, on how to
			 improve the procurement center representative program.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3df85eb9c1494b0d8e2b5686a9856c23"><enum>(d)</enum><header display-inline="yes-display-inline">Electronic procurement center
			 representative</header><text display-inline="yes-display-inline">Not later than
			 180 days after the date of enactment of this Act, the Administrator shall
			 implement an electronic procurement center representative program.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id7730D599B6DB4D58BFB56DF8F57BFCB8" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Consolidation of contract
			 requirements</header><text display-inline="no-display-inline">The Small
			 Business Act (15 U.S.C. 631 et seq.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id61BF6F1E13AD4664B1CD4456166CDE60"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 44 as section 45;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA00E9E5DF7346D9B108D49850EB099A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 43 the
			 following:</text>

						<section commented="no" display-inline="no-display-inline" id="HBD593EB2489C4F9BC5DB88BAD33C3A4" section-type="subsequent-section"><enum>44.</enum><header display-inline="yes-display-inline">Consolidation of contract
				requirements</header>
							<subsection commented="no" display-inline="no-display-inline" id="id09BBF6C492FF43E58277A63DBEBB4794"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id555F4E620E904E43B38C0810C0BE8146"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Chief Acquisition
				Officer</term> means the employee of a Federal agency designated as the Chief
				Acquisition Officer for the Federal agency under section 16(a) of the Office of
				Federal Procurement Policy Act (41 U.S.C. 414(a));</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8AD1580AD01446BB638E3977512A579"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>consolidation of contract
				requirements</term>, with respect to contract requirements of a Federal agency,
				means a use of a solicitation to obtain offers for a single contract or a
				multiple award contract to satisfy 2 or more requirements of the Federal agency
				for goods or services that have been, are being, or will be provided to, or
				will be performed for or would typically be performed for, the Federal agency
				under 2 or more separate contracts lower in cost than the total cost of the
				contract for which the offers are solicited;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF43E014A73D24829A95F16EED4C9A6F8"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Federal agency</term> does
				not include the Department of Defense or any agency of the Department of
				Defense;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id556A218290F346429885BBC131ED0481"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>multiple award
				contract</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idAB0DB882522D437F913D38BE4062B459"><enum>(A)</enum><text display-inline="yes-display-inline">a multiple award task order contract or
				delivery order contract that is entered into under the authority of sections
				303H through 303K of the Federal Property and Administrative Services Act of
				1949 (41 U.S.C. 253h through 253k); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8D08F556455842AD8592D02E29B64C73"><enum>(B)</enum><text display-inline="yes-display-inline">any other indefinite delivery, indefinite
				quantity contract that is entered into by the head of a Federal agency with 2
				or more sources pursuant to the same solicitation; and</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE3CDB00CD80F4F4BA2BA6BD6E1FE415D"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>senior procurement
				executive</term> means an official designated under section 16(c) of the Office
				of Federal Procurement Policy Act (41 U.S.C. 414(c)) as the senior procurement
				executive for a Federal agency.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id063338B34DFB49A1ABC5C92D6A1B685C"><enum>(b)</enum><header display-inline="yes-display-inline">Policy</header><text display-inline="yes-display-inline">The head of each Federal agency shall
				ensure that the decisions made by the Federal agency regarding consolidation of
				contract requirements of the Federal agency are made with a view to providing
				small business concerns with appropriate opportunities to participate as prime
				contractors and subcontractors in the procurements of the Federal
				agency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H2AFDA1BC49294581FE22709BBEA1B7E"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation on use of acquisition strategies
				involving consolidation</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id3729031528B04EE696210986DE46465B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The head of a Federal agency may not carry
				out an acquisition strategy that includes a consolidation of contract
				requirements of the Federal agency with a total value of more than $2,000,000,
				unless the senior procurement executive or Chief Acquisition Officer for the
				Federal agency, before carrying out the acquisition strategy—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HD4CEE7A546DA0353A99ACD86B43EDFC"><enum>(A)</enum><text display-inline="yes-display-inline">conducts market research;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48A3C4DD42F93EF42ED965B97CF0CFD"><enum>(B)</enum><text display-inline="yes-display-inline">identifies any alternative contracting
				approaches that would involve a lesser degree of consolidation of contract
				requirements; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD69779E8415491DA3AAC9DBCA49143B"><enum>(C)</enum><text display-inline="yes-display-inline">determines that the consolidation of
				contract requirements is necessary and justified.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4F706568436D910C62F7F4A5CFDE285"><enum>(2)</enum><header display-inline="yes-display-inline">Determination that consolidation is
				necessary and justified</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idB914187C45244B808FBF121B413EBE68"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A senior procurement executive or Chief
				Acquisition Officer may determine that an acquisition strategy involving a
				consolidation of contract requirements is necessary and justified for the
				purposes of paragraph (1)(C) if the benefits of the acquisition strategy
				substantially exceed the benefits of each of the possible alternative
				contracting approaches identified under paragraph (1)(B).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBFF04013EAD64208A16E395DEFB88859"><enum>(B)</enum><header display-inline="yes-display-inline">Savings in administrative or personnel
				costs</header><text display-inline="yes-display-inline">For purposes of
				subparagraph (A), savings in administrative or personnel costs alone do not
				constitute a sufficient justification for a consolidation of contract
				requirements in a procurement unless the expected total amount of the cost
				savings, as determined by the senior procurement executive or Chief Acquisition
				Officer, is substantial in relation to the total cost of the
				procurement.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3012ABA342B6BE728FC66CAAD1DAEDC"><enum>(3)</enum><header display-inline="yes-display-inline">Benefits to be considered</header><text display-inline="yes-display-inline">The benefits considered for the purposes of
				paragraphs (1) and (2) may include cost and, regardless of whether quantifiable
				in dollar amounts—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H495FCE6243A2F5C2251BFDB34B76FB7"><enum>(A)</enum><text display-inline="yes-display-inline">quality;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3907BA2C49C9D19BB7CB67A4FC8B60F"><enum>(B)</enum><text display-inline="yes-display-inline">acquisition cycle;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3C27A4D4918D129A32A46B1AAF5BFC"><enum>(C)</enum><text display-inline="yes-display-inline">terms and conditions; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC2AD262F48BF52415E7C6DAC43D46A6"><enum>(D)</enum><text display-inline="yes-display-inline">any other
				benefit.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idCC85826E234B47DFA83D3B3CFD694CFB" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Small business teams pilot program</header>
				<subsection commented="no" display-inline="no-display-inline" id="idDEE34AF18FD6457696A8E00FEA3EDB88"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idFC364614CCCD4CE69BE4993A30460E38"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Center</term> means the
			 Center for Small Business Teaming established under subsection (b); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91410373C24647378B343264C20CCF3D"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>eligible organization</term>
			 means a well-established national organization for small business concerns with
			 the capacity to provide assistance to small business concerns (which may be
			 provided with the assistance of the Center) relating to—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idBB0715D631824020B23BA2800F3C932E"><enum>(A)</enum><text display-inline="yes-display-inline">customer relations and outreach;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2025D30BDAC742AE9C42ABF2C67C7398"><enum>(B)</enum><text display-inline="yes-display-inline">submitting bids and proposals;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1AFDCCD797CB473F827B5F2DA52C0724"><enum>(C)</enum><text display-inline="yes-display-inline">team relations and outreach; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15945E67A3E74EE2A3D32FD381B22F29"><enum>(D)</enum><text display-inline="yes-display-inline">performance measurement and quality
			 assurance.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0E62BB6DD11F4B53805CDD50554D0C55"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a Center
			 for Small Business Teaming within the Administration to carry out a pilot
			 program for teaming and joint ventures involving small business
			 concerns.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id5BDAD01835FD45C3842732ADFBEF44F4"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Center may make grants to eligible
			 organizations to assemble teams of small business concerns to compete for
			 larger procurement contracts.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4C29DEDBABFB4AEE901EA5C260615AA4"><enum>(d)</enum><header display-inline="yes-display-inline">Contracting opportunities</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id319A1A4EA57D4BB0AD7655C673631ACB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Center shall work with eligible
			 organizations receiving a grant under this section to identify appropriate
			 contracting opportunities for teams or joint ventures of small business
			 concerns.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C8938E865AD4A02B5109D458D2302CB"><enum>(2)</enum><header display-inline="yes-display-inline">Restricted competition</header><text display-inline="yes-display-inline">A contracting officer of a Federal agency
			 may restrict competition for any contract for the procurement of goods or
			 services by the Federal agency to teams or joint ventures of small business
			 concerns if determined appropriate by the contracting officer.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE09F7C025F5E479D94DC223C49280D5E"><enum>(e)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The authorities under this section shall
			 terminate 5 years after the date of enactment of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4713AB4E8BA84CC782F06DF7067BA64B"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated for grants by the Center under subsection (c)
			 $5,000,000 for each of fiscal years 2010 through 2015.</text>
				</subsection></section></title><title changed="deleted" commented="no" committee-id="SSSB00" id="idC820D77C52DB42B1A0C7D967354DE06A" level-type="subsequent" reported-display-style="strikethrough"><enum>II</enum><header display-inline="yes-display-inline">Subcontracting integrity</header>
			<section commented="no" display-inline="no-display-inline" id="H3A42D42FC95D4A3CBAEFDEB08B08412E" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">GAO recommendations on subcontracting
			 misrepresentations</header><text display-inline="no-display-inline">Section 8
			 of the Small Business Act (15 U.S.C. 637) is amended by adding at the end the
			 following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="H6F80122F99774B529153235DB8CB3351"><enum>(1)</enum><header display-inline="yes-display-inline">Statement of policy</header><text display-inline="yes-display-inline">It is the policy of Congress that the
				recommendations of the Comptroller General of the United States in Report No.
				05–459, concerning oversight improvements necessary to ensure maximum
				practicable participation by small business concerns in subcontracting, shall
				be implemented Government-wide, to the maximum extent possible.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC108432647BF430C8D9277E629E9E56"><enum>(2)</enum><header display-inline="yes-display-inline">Contractor compliance</header><text display-inline="yes-display-inline">Compliance of Federal prime contractors
				with subcontracting plans relating to small business concerns shall be
				evaluated as a percentage of obligated prime contract dollars and as a
				percentage of subcontracts awarded.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5E481AC98F84B2086873F5D5600E500"><enum>(3)</enum><header display-inline="yes-display-inline">Issuance of agency policies</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the head of each Federal agency shall issue a
				policy on subcontracting compliance relating to small business concerns,
				including assignment of compliance responsibilities between contracting
				offices, small business offices, and program offices and periodic oversight and
				review
				activities.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="H90E9D304230243AF861171896BF2A93F" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Small business subcontracting
			 improvements</header><text display-inline="no-display-inline">Section 8(d)(6)

				including the subcategories of small business concerns identified in subsection
				(g)(2);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27C414F4242D40239B627321F41F5A77"><enum>(2)</enum><text display-inline="yes-display-inline">setting aside orders placed against
				multiple award contracts, Federal supply schedule contracts, and other
				Government-wide acquisition contracts for small business concerns, including
				the subcategories of small business concerns identified in subsection (g)(2);
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59C6C22CE1C343FB9DBF80F1EB33F7ED"><enum>(3)</enum><text display-inline="yes-display-inline">reserving 1 or more contract awards for
				small business concerns under full and open multiple award procurements,
				including the subcategories of small business concerns identified in subsection
				(g)(2).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id0A3C0E6D6AF74585A01C0F21838DF166" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Micro-purchase guidelines</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Controller of the Office of Federal Financial
			 Management shall issue guidelines regarding the analysis of purchase card
			 expenditures to identify opportunities for achieving and accurately measuring
			 fair participation of small business concerns in purchases in an amount not in
			 excess of the micro-purchase threshold, as defined in section 32 of the Office
			 of Federal Procurement Policy Act (41 U.S.C. 428) (in this section referred to
			 as <quote>micro-purchases</quote>), consistent with the national policy on
			 small business participation in Federal procurements set forth in sections 2(a)
			 and 15(g) of the Small Business Act (15 U.S.C. 631(a) and 644(g)), and
			 dissemination of best practices for participation of small business concerns in
			 micro-purchases.</text>
			</section><section commented="no" display-inline="no-display-inline" id="ID8A648E96582E47DE9F7195FA6EEAA817" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Agency accountability</header><text display-inline="no-display-inline">Section 15(g)(2) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.

							<clause commented="no" display-inline="no-display-inline" id="id1E5A1DED45DB49159FB216825C0769AA"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A prime contractor for a covered contract
				shall notify in writing the contracting officer for the covered contract if the
				prime contractor pays a reduced price to a subcontractor for goods and services
				upon completion of the responsibilities of the subcontractor or the payment to
				a subcontractor is more than 90 days past due for goods or services provided
				for the covered contract for which—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id79555FEC033943ECB604031EE5DCFC11"><enum>(I)</enum><text display-inline="yes-display-inline">the Federal agency has paid the prime
				contractor; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idC6C0E8668A044908A8C963E086E57179"><enum>(II)</enum><text display-inline="yes-display-inline">the prime contractor has submitted a
				request for payment to the Federal agency.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id70DCB97E0E584E3BB900E968D8E4F605"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">A prime contractor shall include the reason
				for the reduction in a payment to or failure to pay a subcontractor in any
				notice made under clause (i).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id759642AE374D48829D4F8D3360977B4F"><enum>(iii)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">The head of each Federal agency shall,
				after redacting information identifying any subcontractor, make publicly
				available any notice made under clause (i).</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90512ACFEDDC43178B1256DD5243FDEB"><enum>(C)</enum><header display-inline="yes-display-inline">Performance</header><text display-inline="yes-display-inline">A contracting officer for a covered
				contract shall consider the failure by a prime contractor to make a full or
				timely payment to a subcontractor in evaluating the performance of the prime
				contractor.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id724ED7565D36455B9210C88E2111F377"><enum>(D)</enum><header display-inline="yes-display-inline">Control of funds</header><text display-inline="yes-display-inline">A contracting officer for a covered
				contract may restrict the authority of a prime contractor that has a history of
				untimely payment of subcontractors (as determined by the contracting officer)
				to make expenditures under or control payment of subcontractors for a covered
				contract.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id84E1A0AAC1ED46E39A49A0EC7C320CBC" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Repeal of Small Business Competitiveness
			 Demonstration Program</header>
				<subsection commented="no" display-inline="no-display-inline" id="id33A0D854AEC44A688A9917BED9553631"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Business Opportunity Development Reform
			 Act of 1988 (Public Law 100–656) is amended by striking title VII (15 U.S.C.
			 644 note).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id08BB85127EB74EF9A56015E1DA28F042"><enum>(b)</enum><header display-inline="yes-display-inline">Effective date and
			 applicability</header><text display-inline="yes-display-inline">The amendment
			 made by this section—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id38506D3E6146464BAE64FB8A170E5BE6"><enum>(1)</enum><text display-inline="yes-display-inline">shall take effect on the date of enactment
			 of this Act; and</text>

				set aside, reserved, or otherwise classified as intended for award to small
				business concerns, there shall be a presumption of loss to the United States
				based on the total amount expended on the contract, subcontract, cooperative
				agreement, cooperative research and development agreement, or grant whenever it
				is established that a business concern other than a small business concern
				willfully sought and received the award by misrepresentation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2fc1a3901ece41239b63b16147cead47"><enum>(2)</enum><header display-inline="yes-display-inline">Deemed certifications</header><text display-inline="yes-display-inline">The following actions shall be deemed
				affirmative, willful, and intentional certifications of small business size and
				status:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID182bf27565684ddbab423902fb88c827"><enum>(A)</enum><text display-inline="yes-display-inline">Submission of a bid or proposal for a
				Federal grant, contract, subcontract, cooperative agreement, or cooperative
				research and development agreement reserved, set aside, or otherwise classified
				as intended for award to small business concerns.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa596e887b764e6c82f20e5ad9f421f1"><enum>(B)</enum><text display-inline="yes-display-inline">Submission of a bid or proposal for a
				Federal grant, contract, subcontract, cooperative agreement, or cooperative
				research and development agreement which in any way encourages a Federal agency
				to classify the bid or proposal, if awarded, as an award to a small business
				concern.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDedc2c80663364e17839d5c57cf08ca81"><enum>(C)</enum><text display-inline="yes-display-inline">Registration on any Federal electronic
				database for the purpose of being considered for award of a Federal grant,
				contract, subcontract, cooperative agreement, or cooperative research
				agreement, as a small business concern.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ddce999edf84a199df654bb405b3d0b"><enum>(3)</enum><header display-inline="yes-display-inline">Certification by signature of responsible
				official</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5c5bda3add564b8da993b8fd224ec20b"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each solicitation, bid, or application for
				a Federal contract, subcontract, or grant shall contain a certification
				concerning the small business size and status of a business concern seeking the
				Federal contract, subcontract, or grant.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc1ec607303a84eefb5646f0cbfbca06a"><enum>(B)</enum><header display-inline="yes-display-inline">Content of certifications</header><text display-inline="yes-display-inline">A certification that a business concern
				qualifies as a small business concern of the exact size and status claimed by
				the business concern for purposes of bidding on a Federal contract or
				subcontract, or applying for a Federal grant, shall contain the signature of a
				director, officer, or counsel on the same page on which the certification is
				contained.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04ad88ac0d7a470b939aec687e23d842"><enum>(4)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Administrator shall promulgate
				regulations to provide adequate protections to individuals and business
				concerns from liability under this subsection in cases of unintentional errors,
				technical malfunctions, and other similar
				situations.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="idB32756F0C11147719B8C6CE52512A527" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Annual certification</header><text display-inline="no-display-inline">Section 3 of the Small Business Act (15
			 U.S.C. 632), as amended by this Act, is amended by adding at the end the
			 following:</text>

				concern under this Act shall annually certify its small business size and, if
				appropriate, its small business status, by means of a confirming entry on the
				ORCA database of the Administration, or any successor thereto.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf27e99c187814feb8e35b55c6824ebe0"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this subsection, the Administrator, in consultation with the
				Inspector General and the Chief Counsel for Advocacy of the Administration,
				shall promulgate regulations to ensure that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID994d88627c0244f689779473139fbb24"><enum>(A)</enum><text display-inline="yes-display-inline">no business concern continues to be
				certified as a small business concern on the ORCA database of the
				Administration, or any successor thereto, without fulfilling the requirements
				for annual certification under this subsection; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID034d2253c26f443f8b4995c410b68915"><enum>(B)</enum><text display-inline="yes-display-inline">the requirements of this subsection are
				implemented in a manner presenting the least possible regulatory burden on
				small business concerns.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61AFBE1E5BAA45DE869D1B7634DD0AAE"><enum>(3)</enum><header display-inline="yes-display-inline">Determination of size status</header><text display-inline="yes-display-inline">The small business size or status of a
				business concern shall be determined at the time of the award of a
				Federal—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id389C7FEA742D4B4D935A9BA2E5EE82B4"><enum>(A)</enum><text display-inline="yes-display-inline">contract, except that, in the case of
				interagency multiple award contracts (as defined in section 44), small business
				size or status shall be determined annually, except for purposes of the award
				of each task or delivery order set aside or reserved for small business
				concerns;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD9CEBC9EA9CF47F7A73B341FDB0481BF"><enum>(B)</enum><text display-inline="yes-display-inline">subcontract;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idABDBC83613A8423AB2E89B1ECCD7C9CF"><enum>(C)</enum><text display-inline="yes-display-inline">grant;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03434C0BBB644CBD93E481CA26AD35ED"><enum>(D)</enum><text display-inline="yes-display-inline">cooperative agreement; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4A5310DEAADF476BA9EE38DD9C3C9F1C"><enum>(E)</enum><text display-inline="yes-display-inline">cooperative research and development
				agreement.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id7EA35B7A48FA460CB93B05976ACFC6D0" section-type="subsequent-section"><enum>403.</enum><header display-inline="yes-display-inline">Training for contracting and enforcement
			 personnel</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID1f7b2c580f9f458090308a1f7a64d5e2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Federal Acquisition Institute, in consultation with
			 the Administrator for Federal Procurement Policy, shall develop courses
			 concerning proper classification of business concerns and small business size
			 and status for purposes of Federal contracts, subcontracts, grants, cooperative
			 agreements, and cooperative research and development agreements.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4f5c4517a31144a09da6a9b70c756c8e"><enum>(b)</enum><header display-inline="yes-display-inline">Policy on prosecutions of small business
			 size and status fraud</header><text display-inline="yes-display-inline">Section
			 3 of the Small Business Act (15 U.S.C. 632), as amended by this Act, is amended
			 by adding at the end the following:</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idB0B7E711365B4CE4A527C6F4A85A36ED" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Updated size standards</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and every 5 years thereafter, the Administrator
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idE5D8CD3654E948EBA8AB344B763C1A3C"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a detailed review of the size
			 standards for small business concerns established under section 3(a)(2) of the
			 Small Business Act (15 U.S.C. 632(a)(2));</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idADEF02671E624B66B16ABAAF06F1539D"><enum>(2)</enum><text display-inline="yes-display-inline">make appropriate adjustments to size
			 standards under that section to reflect market conditions; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4AAA331C6092474BB3885EEF76C61B7F"><enum>(3)</enum><text display-inline="yes-display-inline">make publically available information
			 regarding—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB343E035F7AA4DFB9215EA5F06BBC499"><enum>(A)</enum><text display-inline="yes-display-inline">the factors evaluated as part of the review
			 conducted under paragraph (1); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5AFEF3A6BFE346928F65BDAEBBB1987F"><enum>(B)</enum><text display-inline="yes-display-inline">the criteria used for any revised size
			 standards promulgated under paragraph (2).</text>
					</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8214CE8AF8454582B4C59A59E555E205" section-type="subsequent-section"><enum>405.</enum><header display-inline="yes-display-inline">Study and report on the mentor-protege
			 program</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID7778b14d17e34dbbaa01f976859953d0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a study of the mentor-protege program of the
			 Administration for small business concerns participating in programs under
			 section 8(a) of the Small Business Act (15 U.S.C. 637(a)), and other
			 relationships and strategic alliances pairing a larger business and a small
			 business concern partner to gain access to Federal Government contracts, to
			 determine whether the programs and relationships are effectively supporting the
			 goal of increasing the participation of small business concerns in Government
			 contracting.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2d418b0ccee646849f08e8b06aef0fed"><enum>(b)</enum><header display-inline="yes-display-inline">Matters To Be studied</header><text display-inline="yes-display-inline">The study conducted under this section
			 shall include—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id2A7418C289284878B1749EC8F25943D0"><enum>(1)</enum><text display-inline="yes-display-inline">a review of a broad cross-section of
			 industries; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36540067E26B4A9997A85FB2138B9E0E"><enum>(2)</enum><text display-inline="yes-display-inline">an evaluation of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID3333206aa85c4129a47ab1cc23af412b"><enum>(A)</enum><text display-inline="yes-display-inline">how each Federal agency carrying out a
			 program described in subsection (a) administers and monitors the
			 program;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa8f146d67c244ff595a71fd1c5e34cb4"><enum>(B)</enum><text display-inline="yes-display-inline">whether there are systems in place to
			 ensure that the mentor-protege relationship, or similar affiliation, promotes
			 real gain to the protege, and is not just a mechanism to enable participants
			 that would not otherwise qualify under section 8(a) of the Small Business Act
			 (15 U.S.C. 637(a)) to receive contracts under that section; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID74dd415efd3a4485bdee8ae38adda59b"><enum>(C)</enum><text display-inline="yes-display-inline">the degree to which protege businesses
			 become able to compete for Federal contracts without the assistance of a
			 mentor.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa4fc2f7ed03b4953a55fd5cc486c0bb7"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Comptroller General shall submit to the Committee on
			 Small Business and Entrepreneurship of the Senate and the Committee on Small
			 Business of the House of Representatives a report on the results of the study
			 conducted under this section.</text>

				enactment of this subsection, publish on the website of the Federal agency the
				policy of the Federal agency regarding contracting bundling and consolidation,
				including regarding the solicitation of teaming and joint ventures under
				paragraph (1); and</text>
								</subparagraph><subparagraph id="id858231c0-9e1b-460d-acdf-3edce168ca11"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 30 days after the date on
				which the head of the Federal agency submits data certifications to the
				Administrator for Federal Procurement Policy, publish on the website of the
				Federal agency a list and rationale for any bundled contract for which the
				Federal agency solicited bids or that was awarded by the Federal agency.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id885710a0-feb1-4023-a5ba-14154dcd7a7c"><enum>(3)</enum><header display-inline="yes-display-inline">Reporting</header><text>Not later than 90
				days after the date of enactment of this subsection, and every 3 years
				thereafter, the Area Directors for Government Contracting of the Administration
				shall submit to the Committee on Small Business and Entrepreneurship of the
				Senate and the Committee on Small Business of the House of Representatives a
				report regarding procurement center representatives and commercial market
				representatives, which shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idcec908f5-7934-4560-a2d6-6d8443d045b3"><enum>(A)</enum><text>identify each area for
				which the Administration has assigned a procurement center representative or a
				commercial market representative;</text>

				performed by procurement center representatives and commercial market

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id8414c3d5-3819-4f52-babe-08f2f689ba3b"><enum>(b)</enum><header>Technical
			 correction</header><text>Section 15(g) of the Small Business Act (15 U.S.C.
			 644(g)) is amended by striking <quote>Administrator of the Office of Federal
			 Procurement Policy</quote> each place it appears and inserting
			 <quote>Administrator for Federal Procurement Policy</quote>.</text>
				</subsection><subsection id="id91f86805-7643-4ec9-ab6a-638603ff43e8"><enum>(c)</enum><header>Report</header>
					<paragraph id="id0f355355-bd57-4cef-8ac6-1cdc2a5977a7"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Comptroller General of the United States shall submit to Congress
			 a report regarding the procurement center representative program of the
			 Administration.</text>
					</paragraph><paragraph id="id29b7932b-d3e5-41fd-b3cf-8a3fc7a0d5c4"><enum>(2)</enum><header>Contents</header><text>The
			 report submitted under paragraph (1) shall—</text>
						<subparagraph id="idcfb5da9f-1f09-4489-864c-8ca56ca18b1e"><enum>(A)</enum><text>address ways to improve
			 the effectiveness of the procurement center representative program in helping
			 small business concerns obtain Federal contracts;</text>
						</subparagraph><subparagraph id="id98f0f95e-f739-4ac7-92a4-bcb1e4eccb86"><enum>(B)</enum><text>evaluate the
			 effectiveness of procurement center representatives and commercial marketing
			 representatives; and</text>
						</subparagraph><subparagraph id="id4862b9b4-50a4-4d9e-9818-a9843d4fb018"><enum>(C)</enum><text>include recommendations,
			 if any, on how to improve the procurement center representative program.</text>
						</subparagraph></paragraph></subsection><subsection id="id9a3f3a4b-e23a-4d0d-bf3d-cfa8cddb09a1"><enum>(d)</enum><header>Electronic procurement
			 center representative</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Administrator shall implement an electronic
			 procurement center representative program.</text>
				</subsection></section><section id="id496a0001-bfe3-4724-ac8d-b3b456d9cf61"><enum>102.</enum><header>Consolidation of
			 contract requirements</header><text display-inline="no-display-inline">The
			 Small Business Act (15 U.S.C. 631 et seq.) is amended—</text>
				<paragraph id="idd39c395e-75de-4c9b-a5c3-e1a74796382a"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 44 as section 45;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04f9bdc2-cc80-4f11-a19f-9631a497a28e"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 43 the
			 following:</text>

						<section id="id9bf2980a-702b-42f1-af2e-d294aa5e7813"><enum>44.</enum><header>Consolidation of
				contract requirements</header>
							<subsection id="id50f647bb-0319-456e-8b0e-3bf52188ac52"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="id01362f8a-5207-4719-b984-d91ebea3fd23"><enum>(1)</enum><text>the term <term>Chief
				Acquisition Officer</term> means the employee of a Federal agency designated as
				the Chief Acquisition Officer for the Federal agency under section 16(a) of the
				Office of Federal Procurement Policy Act (41 U.S.C. 414(a));</text>
								</paragraph><paragraph id="id54d6619e-ed00-42f4-a60f-3ead218e2f49"><enum>(2)</enum><text>the term
				<term>consolidation of contract requirements</term>, with respect to contract
				requirements of a Federal agency, means a use of a solicitation to obtain
				offers for a single contract or a multiple award contract to satisfy 2 or more
				requirements of the Federal agency for goods or services that have been, are
				being, or will be provided to, or will be performed for or would typically be
				performed for, the Federal agency under 2 or more separate contracts lower in
				cost than the total cost of the contract for which the offers are
				solicited;</text>
								</paragraph><paragraph id="id698c706c-8f23-42ce-bad3-36506ff61f54"><enum>(3)</enum><text>the term <term>multiple
				award contract</term> means—</text>
									<subparagraph id="id2e091006-9cd3-4428-83d9-7dc849fb3264"><enum>(A)</enum><text>a multiple award task
				order contract or delivery order contract that is entered into under the
				authority of sections 303H through 303K of the Federal Property and
				Administrative Services Act of 1949 (41 U.S.C. 253h through 253k); and</text>
									</subparagraph><subparagraph id="idf67fc511-107e-44a0-8b09-69dcf1505372"><enum>(B)</enum><text>any other indefinite
				delivery, indefinite quantity contract that is entered into by the head of a
				Federal agency with 2 or more sources pursuant to the same solicitation;
				and</text>
									</subparagraph></paragraph><paragraph id="id465b5ee0-6dc3-4c48-b035-afa3660615fb"><enum>(4)</enum><text>the term <term>senior
				procurement executive</term> means an official designated under section 16(c)
				of the Office of Federal Procurement Policy Act (41 U.S.C. 414(c)) as the
				senior procurement executive for a Federal agency.</text>
								</paragraph></subsection><subsection id="ide772cdff-1ea3-4c13-8bdc-c2b387ab5286"><enum>(b)</enum><header>Policy</header><text>The
				head of each Federal agency shall ensure that the decisions made by the Federal
				agency regarding consolidation of contract requirements of the Federal agency
				are made with a view to providing small business concerns with appropriate
				opportunities to participate as prime contractors and subcontractors in the
				procurements of the Federal agency.</text>
							</subsection><subsection id="id088c7257-d15a-4d27-a83f-ed2cc18bdf0b"><enum>(c)</enum><header>Limitation on use of
				acquisition strategies involving consolidation</header>
								<paragraph id="iddd4c7344-dbe8-4f71-a80f-5dd120752c9d"><enum>(1)</enum><header>In
				general</header><text>The head of a Federal agency may not carry out an
				acquisition strategy that includes a consolidation of contract requirements of
				the Federal agency with a total value of more than $2,000,000, unless the
				senior procurement executive or Chief Acquisition Officer for the Federal
				agency, before carrying out the acquisition strategy—</text>
									<subparagraph id="idb073736a-b7b9-430e-8595-22573e72d8c3"><enum>(A)</enum><text>conducts market
				research;</text>
									</subparagraph><subparagraph id="ida9101ea1-3202-4080-ae8a-b7b5dbc66a49"><enum>(B)</enum><text>identifies any
				alternative contracting approaches that would involve a lesser degree of
				consolidation of contract requirements;</text>
									</subparagraph><subparagraph id="idef36405c-84b4-41fa-891b-84c28ece6657"><enum>(C)</enum><text>makes a written
				determination that the consolidation of contract requirements is necessary and
				justified;</text>
									</subparagraph><subparagraph id="id8B75FB4436BC472CB10CF6C59806B5E9"><enum>(D)</enum><text>identifies any negative
				impact by the acquisition strategy on contracting with small business concerns;
				and</text>
									</subparagraph><subparagraph id="idCFFF14DC83D746D1A797E09F83FE54DA"><enum>(E)</enum><text>certifies that the
				acquisition strategy fulfills the small business contracting goals of the
				Federal agency.</text>
									</subparagraph></paragraph><paragraph id="id66c3d3b0-59e8-4084-ae6a-16aa2d0982c8"><enum>(2)</enum><header>Determination that
				consolidation is necessary and justified</header>
									<subparagraph id="id358379a6-7dd8-40af-babb-e306b5dd13b1"><enum>(A)</enum><header>In
				general</header><text>A senior procurement executive or Chief Acquisition
				Officer may determine that an acquisition strategy involving a consolidation of
				contract requirements is necessary and justified for the purposes of paragraph
				(1)(C) if the benefits of the acquisition strategy substantially exceed the
				benefits of each of the possible alternative contracting approaches identified
				under paragraph (1)(B).</text>
									</subparagraph><subparagraph id="idf8e8e2f2-0d38-428b-8f23-243ab5981845"><enum>(B)</enum><header>Savings in
				administrative or personnel costs</header><text>For purposes of subparagraph
				(A), savings in administrative or personnel costs alone do not constitute a
				sufficient justification for a consolidation of contract requirements in a
				procurement unless the expected total amount of the cost savings, as determined
				by the senior procurement executive or Chief Acquisition Officer, is
				substantial in relation to the total cost of the procurement.</text>
									</subparagraph></paragraph><paragraph id="idb89d184c-1868-43d6-8cac-b6388c10864a"><enum>(3)</enum><header>Benefits to be
				considered</header><text>The benefits considered for the purposes of paragraphs
				(1) and (2) may include cost and, regardless of whether quantifiable in dollar
				amounts—</text>
									<subparagraph id="id5fbb49ed-e98c-4abf-ad94-cc6ffaae0345"><enum>(A)</enum><text>quality;</text>
									</subparagraph><subparagraph id="idfd4c1365-984e-452a-b85b-066d95d20f4c"><enum>(B)</enum><text>acquisition cycle;</text>
									</subparagraph><subparagraph id="id77bfb50a-7661-4559-8e33-9021c1530d99"><enum>(C)</enum><text>terms and conditions;
				and</text>
									</subparagraph><subparagraph id="idf836e8e7-0f7b-4e08-a681-a3d11395199f"><enum>(D)</enum><text>any other
				benefit.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idd3ab595b-a35d-4b28-b550-1d29ccacbbc7"><enum>103.</enum><header>Small business teams
			 pilot program</header>
				<subsection id="iddc2e4efc-1a7a-4283-89e3-2e6b74b7c039"><enum>(a)</enum><header>Definitions</header><text>In
			 this section—</text>
					<paragraph id="id8839f812-69dd-4f95-aefa-60b57126b991"><enum>(1)</enum><text>the term
			 <term>Center</term> means the Center for Small Business Teaming established
			 under subsection (b); and</text>
					</paragraph><paragraph id="idb2fa5788-3a70-4f8e-aacd-06e397551b74"><enum>(2)</enum><text>the term <term>eligible
			 organization</term> means a well-established national organization for small
			 business concerns with the capacity to provide assistance to small business
			 concerns (which may be provided with the assistance of the Center) relating
			 to—</text>
						<subparagraph id="id77c3ea14-b872-4a31-835c-03958bf8e3fe"><enum>(A)</enum><text>customer relations and
			 outreach;</text>
						</subparagraph><subparagraph id="id9b5abeb0-dd07-4727-b22b-2ef14a7aaf8a"><enum>(B)</enum><text>submitting bids and
			 proposals;</text>
						</subparagraph><subparagraph id="idf00b3e41-8481-44aa-9334-bfd4ecd931fb"><enum>(C)</enum><text>team relations and
			 outreach; and</text>
						</subparagraph><subparagraph id="id610b7323-0ad3-4120-8752-145214c1a584"><enum>(D)</enum><text>performance measurement
			 and quality assurance.</text>
						</subparagraph></paragraph></subsection><subsection id="idd36321d1-7ff2-4fed-b708-d8037d3b71bf"><enum>(b)</enum><header>Establishment</header><text>The
			 Administrator shall establish a Center for Small Business Teaming within the
			 Administration to carry out a pilot program for teaming and joint ventures
			 involving small business concerns.</text>
				</subsection><subsection id="id6031526a-3d0f-47b5-8234-ad5f03980d88"><enum>(c)</enum><header>Grants</header><text>The
			 Center may make grants to eligible organizations to assemble teams of small
			 business concerns to compete for larger procurement contracts.</text>
				</subsection><subsection id="id4a777535-104d-404d-b50b-c63f8a050824"><enum>(d)</enum><header>Contracting
			 opportunities</header>
					<paragraph id="id09ae2dd8-1d72-4aa0-a584-f340bb8b4565"><enum>(1)</enum><header>In
			 general</header><text>The Center shall work with eligible organizations
			 receiving a grant under this section to identify appropriate contracting
			 opportunities for teams or joint ventures of small business concerns.</text>
					</paragraph><paragraph id="idea7710ee-e2a2-488c-872b-41ecdafeead4"><enum>(2)</enum><header>Restricted
			 competition</header><text>A contracting officer of a Federal agency may
			 restrict competition for any contract for the procurement of goods or services
			 by the Federal agency to teams or joint ventures of small business concerns if
			 determined appropriate by the contracting officer.</text>
					</paragraph></subsection><subsection id="id971a3703-a0ce-4dd0-b2a8-332620450809"><enum>(e)</enum><header>Termination</header><text>The
			 authorities under this section shall terminate 5 years after the date of
			 enactment of this Act.</text>
				</subsection><subsection id="id22d7d19f-e5fc-47b7-9528-d4376238add9"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for grants
			 by the Center under subsection (c) $5,000,000 for each of fiscal years 2010
			 through 2015.</text>
				</subsection></section></title><title changed="added" committee-id="SSSB00" id="idccc9349f-8038-459e-823b-0c073dc2dff6" reported-display-style="italic"><enum>II</enum><header>Subcontracting
			 integrity</header>
			<section commented="no" id="id21250fd6-dfce-44e9-8403-2535311135c2"><enum>201.</enum><header>GAO recommendations on
			 subcontracting misrepresentations</header><text display-inline="no-display-inline">Section 8 of the Small Business Act (15
			 U.S.C. 637) is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id1a0278ed-2dd8-4703-a3c3-4da7381c127d" reported-display-style="italic" style="OLC">
					<subsection commented="no" id="idd1ba1d9a-e623-4f89-9f12-48b5095b5d13"><enum>(o)</enum><header>Prevention of
				misrepresentations in subcontracting; implementation of recommendations of
				Comptroller General</header>
						<paragraph commented="no" id="idc35de53c-b112-445e-9d71-eefe1fc97a86"><enum>(1)</enum><header>Statement of
				policy</header><text>It is the policy of Congress that the recommendations of
				the Comptroller General of the United States in Report No. 05–459, concerning
				oversight improvements necessary to ensure maximum practicable participation by
				small business concerns in subcontracting, shall be implemented
				Government-wide, to the maximum extent possible.</text>
						</paragraph><paragraph commented="no" id="id859dcd78-61d8-4bcb-8bfa-139425234313"><enum>(2)</enum><header>Contractor
				compliance</header><text>Compliance of Federal prime contractors with
				subcontracting plans relating to small business concerns shall be evaluated as
				a percentage of obligated prime contract dollars and as a percentage of
				subcontracts awarded.</text>
						</paragraph><paragraph commented="no" id="id9c8e33d4-574e-4ece-a14b-1f4ed87fcab2"><enum>(3)</enum><header>Issuance of agency
				policies</header><text display-inline="yes-display-inline">Not later than 180
				days after the date of enactment of this subsection, the head of each Federal
				agency shall issue a policy on subcontracting compliance relating to small
				business concerns, including assignment of compliance responsibilities between
				contracting offices, small business offices, and program offices and periodic
				oversight and review
				activities.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id046f5702-ee93-4f67-89f1-16fadb821d98"><enum>202.</enum><header>Small business
			 subcontracting improvements</header><text display-inline="no-display-inline">Section 8(d)(6) of the Small Business Act
			 (15 U.S.C. 637(d)(6)) is amended—</text>
				<paragraph id="id2e47172d-769e-416d-93a0-cdda5ba345a5"><enum>(1)</enum><text>in subparagraph (E), by
			 striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id73ef148e-8b1d-42ef-8c20-9c9547b99d80"><enum>(2)</enum><text>in subparagraph (F), by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title changed="added" committee-id="SSSB00" id="id20909473-87ba-4469-a6d0-d33b48439bcc" reported-display-style="italic"><enum>III</enum><header>Acquisition
			 process</header>
			<section id="ida0faab4d-395a-4ca8-8ee4-7ce132919239"><enum>301.</enum><header>Reservation of prime
			 contract awards for small businesses</header><text display-inline="no-display-inline">Section 15 of the Small Business Act (15
			 U.S.C. 644), as amended by this Act, is amended by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id6BEF4C498C714985A986CB21262081E8" reported-display-style="italic" style="OLC">
					<subsection id="idb7cd0a7f-cb76-4f38-b72a-92c6b6d8db65"><enum>(r)</enum><header>Government-wide
				acquisition contracts</header><text>Not later than 180 days after the date of
				enactment of this subsection, the Administrator for Federal Procurement Policy,
				in consultation with the Administrator, shall, by regulation, establish
				criteria for Federal agencies for—</text>
						<paragraph id="id03fcb5b4-7402-4f7d-b272-c7150ae5549b"><enum>(1)</enum><text>setting aside part or
				parts of a multiple award contract (as defined in section 44), Federal supply
				schedule contracts, and other Government-wide acquisition contracts for small
				business concerns, including the subcategories of small business concerns
				identified in subsection (g)(2);</text>
						</paragraph><paragraph id="id0caa05c5-c1be-4c04-ac58-f1dfe5f9ad84"><enum>(2)</enum><text>setting aside orders
				placed against multiple award contracts, Federal supply schedule contracts, and
				other Government-wide acquisition contracts for small business concerns,
				including the subcategories of small business concerns identified in subsection
				(g)(2); and</text>
						</paragraph><paragraph id="id9c55399f-3219-4b40-8500-ed64784991b4"><enum>(3)</enum><text>reserving 1 or more
				contract awards for small business concerns under full and open multiple award
				procurements, including the subcategories of small business concerns identified
				in subsection (g)(2).</text>
						</paragraph></subsection><subsection id="ID8c5b8990abd34e5182be08bd105b350b"><enum>(s)</enum><header>Protecting individual
				small business contract opportunities</header><text>For each fiscal year, the
				head of a Federal agency shall award through competition restricted to small
				business concerns contracts in a total number and amount equal to the total
				number and amount of contracts not awarded through competition restricted to
				small business concerns because—</text>
						<paragraph id="ID1e8796ca258440569588ee23eb777875"><enum>(1)</enum><text>the small business
				concern that is the prime contractor for the contract merged with or was
				acquired by a business concern that is not a small business concern; or</text>
						</paragraph><paragraph id="ID7d8936baa1de4163b90ceb813ec72a37"><enum>(2)</enum><text>the Federal agency
				awarded the contract through full and open competition for the purposes of a
				follow-on
				contract.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id4abee7ed-52b3-460a-84f1-16b0f9768c82"><enum>302.</enum><header>Micro-purchase
			 guidelines</header><text display-inline="no-display-inline">Not later than 1
			 year after the date of enactment of this Act, the Director of the Office of
			 Management and Budget shall issue guidelines regarding the analysis of purchase
			 card expenditures to identify opportunities for achieving and accurately
			 measuring fair participation of small business concerns in purchases in an
			 amount not in excess of the micro-purchase threshold, as defined in section 32
			 of the Office of Federal Procurement Policy Act (41 U.S.C. 428) (in this
			 section referred to as <quote>micro-purchases</quote>), consistent with the
			 national policy on small business participation in Federal procurements set
			 forth in sections 2(a) and 15(g) of the Small Business Act (15 U.S.C. 631(a)
			 and 644(g)), and dissemination of best practices for participation of small
			 business concerns in micro-purchases.</text>
			</section><section id="id6d33a56e-91dc-4e2d-97eb-d7d90f6cef00"><enum>303.</enum><header>Agency
			 accountability</header><text display-inline="no-display-inline">Section
			 15(g)(2) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (15
			 U.S.C. 644(g)(2)) is amended—</text>
				<paragraph id="id3d277d42-4dd3-4dc1-9cf9-4235ba80c270"><enum>(1)</enum><text>by inserting

						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id75e2b4b1-02ef-4a1f-a731-66880920c1aa"><enum>(6)</enum><text>in subparagraph (E), as

				subordinates of the procurement employee or program manager the importance of

								</subclause><subclause changed="added" committee-id="SSSB00" id="idef1fc904-13f8-4580-82cf-4eca45e85f12" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>shall have as a
				significant factor in the annual performance evaluation of the procurement
				employee or program manager, where appropriate, the success of that procurement
				employee or program manager in small business utilization, in accordance with
				the goals established under this subsection.</text>
								</subclause></clause><clause changed="added" committee-id="SSSB00" id="idc89188e6-01ff-4d39-a463-8e5b5bd4bc9c" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>A procurement employee
				or program manager described in this clause is a senior procurement executive,
				senior program manager, or Director of Small and Disadvantaged Business
				Utilization of a Federal agency having contracting
				authority.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="id66d8e7cc-d4c5-4280-abc5-a91b414283e8"><enum>304.</enum><header>Payment of
			 subcontractors</header><text display-inline="no-display-inline">Section 8(d) of
			 the Small Business Act (15 U.S.C. 637(d)) is amended by adding at the end the
			 following:</text>

				subcontractors</header>
						<subparagraph id="id6f278612-aead-4b84-9bc3-0ffdeadad729"><enum>(A)</enum><header>Definition</header><text>In
				this paragraph, the term <term>covered contract</term> means a contract
				relating to which a prime contractor is required to develop a subcontracting
				plan under paragraph (4) or (5).</text>
						</subparagraph><subparagraph id="id3769cb12-0c78-49ae-8a6c-492772a654df"><enum>(B)</enum><header>Notice</header>
							<clause id="id9a09ab8a-0f54-4ff2-85b7-6465dea61c00"><enum>(i)</enum><header>In
				general</header><text>A prime contractor for a covered contract shall pay a
				small business as quickly as possible after the date on which proper
				documentation is received according to the contract terms and before the
				payment due date. A prime contractor for a covered contract shall notify in
				writing the contracting officer for the covered contract if the prime
				contractor pays a reduced price to a subcontractor for goods and services upon
				completion of the responsibilities of the subcontractor or the payment to a
				subcontractor is more than 90 days past due for goods or services provided for
				the covered contract for which—</text>
								<subclause id="id55fa8eff-bdb8-4159-94d5-470ce3426fbf"><enum>(I)</enum><text>the Federal agency has
				paid the prime contractor; or</text>
								</subclause><subclause id="id37f086e8-b14a-4d12-96d7-8022b49db98b"><enum>(II)</enum><text>the prime contractor has
				submitted a request for payment to the Federal agency.</text>
								</subclause></clause><clause id="ide36b19fe-b096-4c4b-9a37-c18598ce233c"><enum>(ii)</enum><header>Contents</header><text>A
				prime contractor shall include the reason for the reduction in a payment to or
				failure to pay a subcontractor in any notice made under clause (i).</text>
							</clause><clause id="id55fef0d9-3631-443e-8f12-bbbaaae73c16"><enum>(iii)</enum><header>Public
				availability</header><text>The head of each Federal agency shall, after
				redacting information identifying any subcontractor, make publicly available
				any notice made under clause (i).</text>
							</clause></subparagraph><subparagraph id="id001cb62e-dfbd-4c07-99e0-a88f8a1bd8f7"><enum>(C)</enum><header>Performance</header><text>A
				contracting officer for a covered contract shall consider the failure by a
				prime contractor to make a full or timely payment to a subcontractor in
				evaluating the performance of the prime contractor.</text>
						</subparagraph><subparagraph id="iddc0138c7-1d22-4834-8b3d-cecfda4f61bc"><enum>(D)</enum><header>Control of
				funds</header><text>A contracting officer for a covered contract may restrict
				the authority of a prime contractor that has a history of untimely payment of
				subcontractors (as determined by the contracting officer) to make expenditures
				under or control payment of subcontractors for a covered
				contract.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idaed730c1-9916-4d59-af53-50b5330add97"><enum>305.</enum><header>Repeal of Small
			 Business Competitiveness Demonstration Program</header>
				<subsection id="id35430144-427b-4f1e-8e35-35a7555fe3af"><enum>(a)</enum><header>In
			 general</header><text>The Business Opportunity Development Reform Act of 1988
			 (Public Law 100–656) is amended by striking title VII (15 U.S.C. 644
			 note).</text>
				</subsection><subsection id="idd11ed7f4-0740-4a70-8225-4c282aacd910"><enum>(b)</enum><header>Effective date and
			 applicability</header><text>The amendment made by this section—</text>
					<paragraph id="id33a2d4e2-75bd-4423-909c-5a9703e4fad6"><enum>(1)</enum><text>shall take effect on the
			 date of enactment of this Act; and</text>
					</paragraph><paragraph id="id5ad4d2ae-eb92-41c8-aae3-62396006e82a"><enum>(2)</enum><text>apply to the first full
			 fiscal year after the date of enactment of this Act.</text>
					</paragraph></subsection></section></title><title changed="added" committee-id="SSSB00" id="id661feda7-4512-4d57-bf8b-43d8aa115920" reported-display-style="italic"><enum>IV</enum><header>Small business size and
			 status integrity</header>
			<section id="id94be58ca-32f9-4cc7-a79e-02fc61aceeb8" section-type="subsequent-section"><enum>401.</enum><header>Policy and
			 presumptions</header><text display-inline="no-display-inline">Section 3 of the
			 Small Business Act (15 U.S.C. 632) is amended by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id143d90c2-88fc-4cdc-b450-d1b8d435cf4d" reported-display-style="italic" style="OLC">
					<subsection id="idcef22ac4-8bfe-434f-a520-0cdef98c0d83"><enum>(t)</enum><header>Presumption</header>
						<paragraph id="ide8fca461-40e5-45fd-9aeb-1f311559abf2"><enum>(1)</enum><header>In
				general</header><text>In every contract, subcontract, cooperative agreement,
				cooperative research and development agreement, or grant which is set aside,
				reserved, or otherwise classified as intended for award to small business
				concerns, there shall be a presumption of loss to the United States based on
				the total amount expended on the contract, subcontract, cooperative agreement,
				cooperative research and development agreement, or grant whenever it is
				established that a business concern other than a small business concern
				willfully sought and received the award by misrepresentation.</text>
						</paragraph><paragraph id="id13312a61-35b5-49f4-aaae-568a899be1e4"><enum>(2)</enum><header>Deemed
				certifications</header><text>The following actions shall be deemed affirmative,
				willful, and intentional certifications of small business size and
				status:</text>
							<subparagraph id="ide4034257-d2b0-439d-a165-9a48d6096fe3"><enum>(A)</enum><text>Submission of a bid or
				proposal for a Federal grant, contract, subcontract, cooperative agreement, or
				cooperative research and development agreement reserved, set aside, or
				otherwise classified as intended for award to small business concerns.</text>
							</subparagraph><subparagraph id="id79c78c95-3adb-4728-a1fa-49e47411dc17"><enum>(B)</enum><text>Submission of a bid or
				proposal for a Federal grant, contract, subcontract, cooperative agreement, or
				cooperative research and development agreement which in any way encourages a
				Federal agency to classify the bid or proposal, if awarded, as an award to a
				small business concern.</text>
							</subparagraph><subparagraph id="idb27b0dac-4815-447e-a231-07ebd46dd302"><enum>(C)</enum><text>Registration on any
				Federal electronic database for the purpose of being considered for award of a
				Federal grant, contract, subcontract, cooperative agreement, or cooperative
				research agreement, as a small business concern.</text>
							</subparagraph></paragraph><paragraph id="idb0d6cd84-c39f-4da7-a047-2f6e7f7702af"><enum>(3)</enum><header>Certification by
				signature of responsible official</header>
							<subparagraph id="id743de2b9-93fe-4df6-a9e1-ef04c5eec6f2"><enum>(A)</enum><header>In
				general</header><text>Each solicitation, bid, or application for a Federal
				contract, subcontract, or grant shall contain a certification concerning the
				small business size and status of a business concern seeking the Federal
				contract, subcontract, or grant.</text>
							</subparagraph><subparagraph id="id0467e9b8-3ede-41e8-a34c-14d1fbd661af"><enum>(B)</enum><header>Content of
				certifications</header><text>A certification that a business concern qualifies
				as a small business concern of the exact size and status claimed by the
				business concern for purposes of bidding on a Federal contract or subcontract,
				or applying for a Federal grant, shall contain the signature of a director,
				officer, or counsel on the same page on which the certification is
				contained.</text>
							</subparagraph></paragraph><paragraph id="id2cce802a-f99c-4aff-bc61-c01434158c88"><enum>(4)</enum><header>Regulations</header><text>The
				Administrator shall promulgate regulations to provide adequate protections to
				individuals and business concerns from liability under this subsection in cases
				of unintentional errors, technical malfunctions, and other similar
				situations.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idb92995da-ffac-4b07-b7c6-b1185a990556"><enum>402.</enum><header>Annual
			 certification</header><text display-inline="no-display-inline">Section 3 of the
			 Small Business Act (15 U.S.C. 632), as amended by this Act, is amended by
			 adding at the end the following:</text>
				<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="idfda59786-fa44-472d-958d-f674a2414a72" reported-display-style="italic" style="OLC">
					<subsection id="id13f77b36-4b37-46bd-a14a-ae3acd308d45"><enum>(u)</enum><header>Annual
				certification</header>
						<paragraph id="ida7dec68d-88d0-4cf3-8122-94e1bef892e0"><enum>(1)</enum><header>In
				general</header><text>Each business certified as a small business concern under
				this Act shall annually certify its small business size and, if appropriate,
				its small business status, by means of a confirming entry on the ORCA database
				of the Administration, or any successor thereto.</text>
						</paragraph><paragraph id="idf2ad8377-9a6f-42e2-b733-f5e381788183"><enum>(2)</enum><header>Regulations</header><text>Not
				later than 1 year after the date of enactment of this subsection, the
				Administrator, in consultation with the Inspector General and the Chief Counsel
				for Advocacy of the Administration, shall promulgate regulations to ensure
				that—</text>
							<subparagraph id="ida2126628-8952-4fa2-b44b-524d835607d3"><enum>(A)</enum><text>no business concern
				continues to be certified as a small business concern on the ORCA database of
				the Administration, or any successor thereto, without fulfilling the
				requirements for annual certification under this subsection; and</text>
							</subparagraph><subparagraph id="id715498b7-8aa5-4afc-8b1d-c94dc727fd86"><enum>(B)</enum><text>the requirements of this
				subsection are implemented in a manner presenting the least possible regulatory
				burden on small business concerns.</text>
							</subparagraph></paragraph><paragraph id="id991cf792-e62f-4afd-875c-70ba1d367c1a"><enum>(3)</enum><header>Determination of size
				status</header><text>The small business size or status of a business concern
				shall be determined at the time of the award of a Federal—</text>
							<subparagraph id="idfc05a6e1-7744-4840-b4f6-50a5f804f0e6"><enum>(A)</enum><text>contract, except that, in
				the case of interagency multiple award contracts (as defined in section 44),
				small business size or status shall be determined annually, except for purposes
				of the award of each task or delivery order set aside or reserved for small
				business concerns;</text>
							</subparagraph><subparagraph id="id8b56e73e-c2ba-4f69-885b-59ae88e0b74b"><enum>(B)</enum><text>subcontract;</text>
							</subparagraph><subparagraph id="idc1a9d11a-5b02-439a-9b74-58467cbee93a"><enum>(C)</enum><text>grant;</text>
							</subparagraph><subparagraph id="id40deba5a-6c5b-4c12-ab8b-2eb7b254fa78"><enum>(D)</enum><text>cooperative agreement;
				or</text>
							</subparagraph><subparagraph id="ide2c68bd6-3a00-4497-8a42-db2db1b80abc"><enum>(E)</enum><text>cooperative research and
				development
				agreement.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id5084849e-46c2-4ec9-ad7d-573711bb95d9"><enum>403.</enum><header>Training for
			 contracting and enforcement personnel</header>
				<subsection id="idb4cc1824-4bc7-4ee7-a52b-779ad728c0b4"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Federal Acquisition Institute, in consultation with the Administrator
			 for Federal Procurement Policy, shall develop courses for acquisition personnel
			 concerning proper classification of business concerns and small business size
			 and status for purposes of Federal contracts, subcontracts, grants, cooperative
			 agreements, and cooperative research and development agreements.</text>
				</subsection><subsection id="idd3bbc08e-c1ac-4644-ba70-547b110e8610"><enum>(b)</enum><header>Policy on prosecutions
			 of small business size and status fraud</header><text>Section 3 of the Small
			 Business Act (15 U.S.C. 632), as amended by this Act, is amended by adding at
			 the end the following:</text>
					<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id2761121e-2fe8-4527-8ca1-ef7536238c19" reported-display-style="italic" style="OLC">
						<subsection id="id374797fa-4865-4acd-93f2-324986017145"><enum>(v)</enum><header>Policy on prosecutions
				of small business size and status fraud</header><text>Not later than 1 year
				after the date of enactment of this subsection, the head of each relevant
				Federal agency and the Inspector General of the Administration shall issue a
				Government-wide policy on prosecution of small business size and status
				fraud.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id6825e93d-34e6-4869-bd71-46f1b6ff2b68"><enum>404.</enum><header>Updated size
			 standards</header>
				<subsection id="idEB665F8D1DC64FAE99BB601441DDB5F1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Administrator
			 shall—</text>
					<paragraph id="idc35b5963-d1c2-4978-9d5e-82486ecedc07"><enum>(1)</enum><text display-inline="yes-display-inline">once every 5 years, conduct a detailed
			 review of the size standards for small business concerns established under
			 section 3(a)(2) of the Small Business Act (15 U.S.C. 632(a)(2));</text>
					</paragraph><paragraph id="iddd2292d8-c985-4218-a51f-dddc828ded3e"><enum>(2)</enum><text>after each review under
			 paragraph (1) make appropriate adjustments to size standards under that section
			 to reflect market conditions; and</text>
					</paragraph><paragraph id="iddcb89d50-d7aa-4ec7-9afa-6c8e680814e4"><enum>(3)</enum><text>make publically available
			 information regarding—</text>
						<subparagraph id="idf585b4c2-087c-45a6-941a-e916560be0b1"><enum>(A)</enum><text>the factors evaluated as
			 part of each review conducted under paragraph (1); and</text>
						</subparagraph><subparagraph id="ida5a51e21-b16f-4aed-afc9-16d5da6fee3a"><enum>(B)</enum><text>the criteria used for any
			 revised size standards promulgated under paragraph (2).</text>
						</subparagraph></paragraph></subsection><subsection id="id327F71552EDA4F2D864B46DC82C7BE71"><enum>(b)</enum><header>Rules</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Administrator
			 shall promulgate rules for conducting the reviews required under subsection
			 (a).</text>
				</subsection></section><section id="id896d3287-9683-478d-8dae-5106f53469b4"><enum>405.</enum><header>Study and report on
			 the mentor-protege program</header>
				<subsection id="ide90494e5-0c05-4522-ab1f-327174043033"><enum>(a)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct a study of the mentor-protege program of the Administration for small
			 business concerns participating in programs under section 8(a) of the Small
			 Business Act (15 U.S.C. 637(a)), and other relationships and strategic
			 alliances pairing a larger business and a small business concern partner to
			 gain access to Federal Government contracts, to determine whether the programs
			 and relationships are effectively supporting the goal of increasing the
			 participation of small business concerns in Government contracting.</text>
				</subsection><subsection id="id1aa52e28-245e-40b3-8921-5357c151b659"><enum>(b)</enum><header>Matters To Be
			 studied</header><text>The study conducted under this section shall
			 include—</text>
					<paragraph id="idd2797898-6f19-4751-b5da-7f563d8d2cb8"><enum>(1)</enum><text>a review of a broad
			 cross-section of industries; and</text>
					</paragraph><paragraph id="id4f11de05-d52f-44dc-9a2f-08dde454a6b7"><enum>(2)</enum><text>an evaluation of—</text>
						<subparagraph id="idae78e413-2c02-4a52-aa93-168c86a9824e"><enum>(A)</enum><text>how each Federal agency
			 carrying out a program described in subsection (a) administers and monitors the
			 program;</text>
						</subparagraph><subparagraph id="idcb034e2d-629f-4075-9815-b3ecafaf7a1e"><enum>(B)</enum><text>whether there are systems
			 in place to ensure that the mentor-protege relationship, or similar
			 affiliation, promotes real gain to the protege, and is not just a mechanism to
			 enable participants that would not otherwise qualify under section 8(a) of the
			 Small Business Act (15 U.S.C. 637(a)) to receive contracts under that section;
			 and</text>
						</subparagraph><subparagraph id="idb18f2690-0425-4276-a065-b2f1b7c26a8f"><enum>(C)</enum><text>the degree to which
			 protege businesses become able to compete for Federal contracts without the
			 assistance of a mentor.</text>
						</subparagraph></paragraph></subsection><subsection id="id9831748f-f049-48e4-b446-4d34727a4ea1"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Comptroller General shall submit to the Committee on Small
			 Business and Entrepreneurship of the Senate and the Committee on Small Business
			 of the House of Representatives a report on the results of the study conducted
			 under this section.</text>
				</subsection></section><section id="idEE6DA2535E0243CC97EB95A4066BCC71"><enum>406.</enum><header>Policy on support of
			 competitive enterprise system</header>
				<subsection id="id5AC7D9E52628495D87F842846AA8F90D"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that the competitive enterprise system, including small business
			 concerns, is—</text>
					<paragraph id="id241B8CFAD8A24510A53613A28DF66941"><enum>(1)</enum><text>characterized by
			 individual freedom and initiative; and</text>
					</paragraph><paragraph id="idC75C9DAE12334530A5E590DEEB542871"><enum>(2)</enum><text>the primary source of
			 economic strength of the United States.</text>
					</paragraph></subsection><subsection id="idD2FF58D6D5844B05BCA711FDC48F4767"><enum>(b)</enum><header>Policy</header><text>Section
			 2 of the Small Business Act (15 U.S.C. 631) is amended by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="SSSB00" display-inline="no-display-inline" id="id12816E314024482D80C6B69D517FDF52" reported-display-style="italic" style="OLC">
						<subsection id="idBDF48E77D0ED45D0BC2A107204D6AAD3"><enum>(k)</enum><header>Policy on support of
				competitive enterprise system</header><text>It is the declared policy of
				Congress that the Federal Government—</text>
							<paragraph id="idE9F07BAE57E141F5BCA234EB173EAA94"><enum>(1)</enum><text>should support the
				competitive enterprise system of the United States, including small business
				concerns;</text>
							</paragraph><paragraph id="idCEA023CCF3F4401AA15A8A13B26B10A6"><enum>(2)</enum><text>should not compete with
				the citizens of the United States;</text>
							</paragraph><paragraph id="idEC7EBF1793204BE8865545E18A42A9AB"><enum>(3)</enum><text>should rely on commercial
				sources to supply the products and services required by the Federal Government;
				and</text>
							</paragraph><paragraph id="idD64D840212E84560A748F1CA22151CD6"><enum>(4)</enum><text>should avoid starting or
				carrying out any activity that provides a product or service that can be
				procured more effectively and efficiently from a nongovernmental
				source.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="id0C4AEA8688544778A70B25B4454A4ECF"><enum>407.</enum><header>Contracting goals
			 reports</header><text display-inline="no-display-inline">Section 15(h)(2) of
			 the Small Business Act (15 U.S.C. 644(h)(2)) is amended by striking
			 <quote>submit them</quote> and all that follows through <quote>the
			 following:</quote> and inserting <quote>submit to the President and the
			 Committee on Small Business and Entrepreneurship of the Senate and the
			 Committee on Small Business of the House of Representatives the compilation and
			 analysis, which shall include the following:</quote>.</text>
			</section><section id="id92AC583A2FE945798CCC3CB290CF9594"><enum>408.</enum><header>Surety
			 bonds</header><text display-inline="no-display-inline">Section 508(f) of
			 division A of the American Recovery and Reinvestment Act of 2009 (15 U.S.C.
			 694a note) is repealed.</text>
