		<official-title>To designate as wilderness certain land and inland water
		  within the Sleeping Bear Dunes National Lakeshore in the State of Michigan, and
		  for other purposes.</official-title>

		<section id="H82901B50027B47A89AA243D51F512073" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sleeping Bear Dunes National Lakeshore
			 Conservation and Recreation Act</short-title></quote>.</text>
		</section><section id="HBD1C61081C3E4DD396E7D54FFBB817A6" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H6B5241715D284908980FF11504E51F3E"><enum>(1)</enum><header>Line of
			 Demarcation</header><text>The term <term>line of demarcation</term> means the
			 general line formed by the lakeward extent of the first contiguous vegetation
			 that is upland from the high water mark.</text>
			</paragraph><paragraph id="H44D775AFEC1545A19D9FAA310E5E73EB"><enum>(2)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Sleeping Bear Dunes
			 National Lakeshore, Proposed Wilderness Boundary</quote>, numbered 634/80,083,
			 and dated February 2009.</text>
			</paragraph><paragraph id="HA2461184830243CB90372D682AA4D17C"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id5D46168BE39440B88DCDB78DD1E4CDAF"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Michigan.</text>
			</paragraph><paragraph id="id40D042A3ABD04016A16FD82A2B468F5A"><enum>(5)</enum><header>Wilderness</header><text>The
			 term <term>Wilderness</term> means the Sleeping Bear Dunes National Lakeshore
			 Wilderness designated by section 3(a).</text>
			</paragraph></section><section id="H01FF5B413BE84CA3B532AFFBDA66940E"><enum>3.</enum><header>Sleeping bear
			 dunes national lakeshore wilderness</header>
			<subsection id="HB298BCB927674A06990E32E76DA9F974"><enum>(a)</enum><header>Designation</header><text display-inline="yes-display-inline">In accordance with section 3(c) of the
			 Wilderness Act (16 U.S.C. 1132(c)) and subject to subsection (c), certain land
			 and inland water comprising approximately 32,557 acres along the mainland shore
			 of Lake Michigan and on certain nearby islands in Benzie and Leelanau Counties,
			 Michigan, within the Sleeping Bear Dunes National Lakeshore, as generally
			 depicted on the map, is designated as wilderness and as a component of the
			 National Wilderness Preservation System, to be known as the <quote>Sleeping
			 Bear Dunes National Lakeshore Wilderness</quote>.</text>
			</subsection><subsection id="H1FED2E667FCB4507B43207B521A889C8"><enum>(b)</enum><header>Map and legal
			 description</header>
				<paragraph id="HD556B9CFA762466EB74BC8FFEFF725CB"><enum>(1)</enum><header>On
			 file</header><text display-inline="yes-display-inline">The map shall be on file
			 and available for public inspection in the appropriate offices of the National
			 Park Service.</text>
				</paragraph><paragraph id="H1FC6C8766CB14208B7B5F117FC8C14F0"><enum>(2)</enum><header>Legal
			 description</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit a legal description of the boundary of the
			 wilderness area to—</text>
					<subparagraph id="idD06300D648214995A3422D4851EF5324"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="id53B36DFD6D0F45B79E14B97C9459CDBD"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="HED87780AE0A646ABB0A768FA4429FFB0"><enum>(3)</enum><header>Corrections</header><text>The
			 map and legal description shall have the same force and effect as if included
			 in this Act, except that the Secretary may correct clerical and typographical
			 errors in the legal description and map.</text>
				</paragraph></subsection><subsection id="HC86A51DBD32B4B1197011E492B8431E5"><enum>(c)</enum><header>Lakeward
			 boundary of the wilderness</header>
				<paragraph id="id27A26E0006C24A30A91C38AF064B9384"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to paragraph
			 (2), the line of demarcation shall be the lakeward boundary of any portion of
			 the Wilderness that would otherwise be bordered by Lake Michigan.</text>
				</paragraph><paragraph id="idA029B5F9559B42AD9410F9942149A4F2"><enum>(2)</enum><header>Surface water
			 and active wash zone</header><text display-inline="yes-display-inline">The
			 surface water and active wash zone of Lake Michigan, regardless of the
			 fluctuating lake level or the line of demarcation, shall be considered to be
			 outside the boundary of the Wilderness.</text>
				</paragraph></subsection></section><section id="H1F62C300A2364F22B71F6E2750306FF2"><enum>4.</enum><header>Administration</header>
			<subsection id="H8C045276B36F4485B1208BB1C29FF390"><enum>(a)</enum><header>Management</header>
				<paragraph id="HA6BF9DB727F940119293B17CCDFEC073"><enum>(1)</enum><header>Wilderness
			 Act</header><text>Subject to valid existing rights, the Wilderness shall be
			 administered by the Secretary in accordance with the Wilderness Act (16 U.S.C.
			 1131 et seq.), except that—</text>
					<subparagraph id="H351811525D4F48B8A91873EC34F04036"><enum>(A)</enum><text>any reference in
			 the Wilderness Act to the effective date shall be considered to be a reference
			 to the date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="HB935BF5630F04CAF9E8E3A0A4DB5A377"><enum>(B)</enum><text>with respect to
			 land administered by the Secretary, any reference in the Wilderness Act to the
			 Secretary of Agriculture shall be considered to be a reference to the
			 Secretary.</text>
					</subparagraph></paragraph><paragraph id="HF9B0D29E69A0482C9FBB95DA988D0530"><enum>(2)</enum><header>Maintenance of
			 roads</header>
					<subparagraph id="id2CB1F1FC75CD4268953B246E55D41736"><enum>(A)</enum><header>In
			 general</header><text>Nothing in this Act prevents the maintenance and
			 improvement of roads that are—</text>
						<clause id="idBC9C976890EA47BEA24F2D8E47BEF4C6"><enum>(i)</enum><text>in
			 existence on the date of this Act; and</text>
						</clause><clause id="idB16674ACB53543058460024E3D065B04"><enum>(ii)</enum><text>located adjacent
			 to the Wilderness.</text>
						</clause></subparagraph><subparagraph id="idE5DE9C4FA3B84CC78FC5FC77621F2EA7"><enum>(B)</enum><header>Wilderness
			 boundary</header><text>The Wilderness boundary shall be—</text>
						<clause id="id250BBF339C3B48A5AC60F85B89B843F4"><enum>(i)</enum><text>a
			 minimum of 100 feet from the centerline of adjacent county roads; and</text>
						</clause><clause id="idEC86CF6BA908435CAF9260928825BEB4"><enum>(ii)</enum><text>a
			 minimum of 300 feet from the centerline of adjacent State highways.</text>
						</clause></subparagraph></paragraph><paragraph id="H53484085BF5648899819C4786A661C7A"><enum>(3)</enum><header>Hunting</header><text display-inline="yes-display-inline">Nothing in this Act affects hunting under
			 applicable Federal and State laws (including regulations) within the
			 Wilderness.</text>
				</paragraph><paragraph id="H29E7024FB31F4D4BB0C4B4C666AA8E4C"><enum>(4)</enum><header>Fish and
			 wildlife</header><text>As provided in section 4(d)(7) of the Wilderness Act (16
			 U.S.C. 1133(d)(7)), nothing in this Act affects the jurisdiction or
			 responsibilities of the State with respect to fish and wildlife within the
			 Wilderness.</text>
				</paragraph><paragraph id="HB2509FCC41B240158C3188ECDFCBD3CC"><enum>(5)</enum><header>Watercraft</header><text>Nothing
			 in this Act affects the use of watercraft under applicable Federal and State
			 laws (including regulations) within the Wilderness to the extent that the use
			 was allowed on the day before the date of enactment of this Act.</text>
				</paragraph><paragraph id="H9493E66F5E094B9698E0F0C1CC3DAF69"><enum>(6)</enum><header>No Buffer
			 Zones</header>
					<subparagraph id="idF01D0194DD8C4047A417FF7483E71AB2"><enum>(A)</enum><header>In
			 general</header><text>Nothing in this Act creates a protective perimeter or
			 buffer zone around the Wilderness.</text>
					</subparagraph><subparagraph id="idE48EBD3BBA2E4032999CFC44E040788A"><enum>(B)</enum><header>Nonwilderness
			 activities</header><text>The fact that a nonwilderness activity or use can be
			 seen or heard from within the Wilderness shall not preclude the conduct of the
			 activity or use outside the boundary of the Wilderness.</text>
					</subparagraph></paragraph></subsection><subsection id="HB096C894F8614244B052E20A98BF91D5"><enum>(b)</enum><header>Savings
			 provisions</header><text>Nothing in this Act—</text>
				<paragraph id="H80E674CB82A6439CB939FBDC3D944950"><enum>(1)</enum><text>modifies, alters,
			 or affects any treaty rights;</text>
				</paragraph><paragraph id="H88F9E0714D5C41BD9D1123D282A4DC2A"><enum>(2)</enum><text>modifies, alters,
			 or affects any valid private property rights in existence on the day before the
			 date of enactment of this Act;</text>
				</paragraph><paragraph id="H864BED5C058D42C3B8859267096C7629"><enum>(3)</enum><text display-inline="yes-display-inline">alters the management of the water of Lake
			 Michigan within the boundary of the Sleeping Bear Dunes National Lakeshore in
			 existence on the day before the date of enactment of this Act; or</text>
				</paragraph><paragraph id="H21F50A80A38A4F80AF54347835D58D30"><enum>(4)</enum><text>prohibits—</text>
					<subparagraph id="id5DAE469AB8CA4AE2A9B29FC922878250"><enum>(A)</enum><text>the use of motors
			 on the surface water of Lake Michigan adjacent to the Wilderness; or</text>
					</subparagraph><subparagraph id="id34BBD16D8D5A44268F3EE6354ACAF19A"><enum>(B)</enum><text>the beaching of
			 motorboats on the Lake Michigan beach lakeward of the boundary of the
			 Wilderness.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
