			<section commented="no" display-inline="no-display-inline" id="idD02DED970A634ED69FA81FD00937C401" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Provider screening and other enrollment
			 requirements under Medicare, Medicaid, and CHIP</header>
				<subsection commented="no" display-inline="no-display-inline" id="id63459A05365947ABB59A3015F6F79678"><enum>(a)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">Section 1866(j) of the Social Security Act
			 (42 U.S.C. 1395cc(j)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id7798F81329F94CF59F97627700CA33DD"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by adding at the end
			 the following: <quote>Such process shall include screening of providers and
			 suppliers in accordance with paragraph (2), a provisional period of enhanced
			 oversight in accordance with paragraph (3), disclosure requirements in
			 accordance with paragraph (4), the imposition of temporary enrollment moratoria
			 in accordance with paragraph (5), and the establishment of compliance programs
			 in accordance with paragraph (6).</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD63C4F14EFA74113BD1D50D7AFBA5C80"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph
			 (7); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id080B2ED59A674BE8B7906495D9AA9977"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id42FE6E2C81244E5C9643BC0800D5BF01" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="idB20CCF0799934AB49057C725092F70D0"><enum>(2)</enum><header display-inline="yes-display-inline">Provider screening</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDfa7508b377304848a7fe9ba24cd011ac"><enum>(A)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this paragraph, the Secretary, in consultation with the Inspector
				General of the Department of Health and Human Services, shall establish
				procedures under which screening is conducted with respect to providers of
				medical or other items or services and suppliers under the program under this
				title, the Medicaid program under title XIX, and the CHIP program under title
				XXI.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8D6CC9F843E64DF39492D68A723A950A"><enum>(B)</enum><header display-inline="yes-display-inline">Level of screening</header><text display-inline="yes-display-inline">The Secretary shall determine the level of
				screening conducted under this paragraph according to the risk of fraud, waste,
				and abuse, as determined by the Secretary, with respect to the category of
				provider of medical or other items or services or supplier. Such
				screening—</text>
									<clause commented="no" display-inline="no-display-inline" id="id83F90BE5EA71456BBDE406FE13D087E9"><enum>(i)</enum><text display-inline="yes-display-inline">shall include a licensure check, which may
				include such checks across States; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id7C26DB5B109E4095BF29D09ED823F200"><enum>(ii)</enum><text display-inline="yes-display-inline">may, as the Secretary determines
				appropriate based on the risk of fraud, waste, and abuse described in the
				preceding sentence, include—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDcccfd19249a74c13819c54e944160fac"><enum>(I)</enum><text display-inline="yes-display-inline">a criminal background check;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0abf520d9c9b4186ad5c96baa66caab2"><enum>(II)</enum><text display-inline="yes-display-inline">fingerprinting;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDdd1513ee28f5401a8b443d315f88da58"><enum>(III)</enum><text display-inline="yes-display-inline">unscheduled and unannounced site visits,
				including preenrollment site visits;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf289594ff8ff4a39bc66ff8754fac1d1"><enum>(IV)</enum><text display-inline="yes-display-inline">database checks (including such checks
				across States); and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idC4EA6B5570204BE78C77B51D44BB2AE8"><enum>(V)</enum><text display-inline="yes-display-inline">such other screening as the Secretary
				determines appropriate.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf073467d356e40d2ae264836188b936d"><enum>(C)</enum><header display-inline="yes-display-inline">Application fees</header>
									<clause commented="no" display-inline="no-display-inline" id="id2BB3804A8ED143C1904C0436BAEFAD2D"><enum>(i)</enum><header display-inline="yes-display-inline">Institutional providers</header><text display-inline="yes-display-inline">Except as provided in clause (ii), the
				Secretary shall impose a fee on each institutional provider of medical or other
				items or services or supplier (such as a hospital or skilled nursing facility)
				with respect to which screening is conducted under this paragraph in an amount
				equal to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id8786BAA138B94D4DA7008E074510A41D"><enum>(I)</enum><text display-inline="yes-display-inline">for 2011, $500; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id6995AC1A33B1436686FC8D1F7BCABCC9"><enum>(II)</enum><text display-inline="yes-display-inline">for 2012 and each subsequent year, the
				amount determined under this clause for the preceding year, adjusted by the
				percentage change in the consumer price index for all urban consumers (all
				items; United States city average) for the 12-month period ending with June of
				the previous year.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID1DA8268667CE4A38AE5CE7F35F15233F"><enum>(ii)</enum><header display-inline="yes-display-inline">Hardship exception; waiver for certain
				medicaid providers</header><text display-inline="yes-display-inline">The
				Secretary may, on a case-by-case basis, exempt a provider of medical or other
				items or services or supplier from the imposition of an application fee under
				this subparagraph if the Secretary determines that the imposition of the
				application fee would result in a hardship. The Secretary may waive the
				application fee under this subparagraph for providers enrolled in a State
				Medicaid program for whom the State demonstrates that imposition of the fee
				would impede beneficiary access to care.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idD0A399142F3B4091B623E3CF22E7CAE5"><enum>(iii)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Amounts collected as a result of the
				imposition of a fee under this subparagraph shall be used by the Secretary for
				program integrity efforts, including to cover the costs of conducting screening
				under this paragraph and to carry out this subsection and section 1128J.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96509F75075C44CABA7793762CDDFCC8"><enum>(D)</enum><header display-inline="yes-display-inline">Application and enforcement</header>
									<clause commented="no" display-inline="no-display-inline" id="id4659E7EA4B7040B7AB9421BB6EAAE99D"><enum>(i)</enum><header display-inline="yes-display-inline">New providers of services and
				suppliers</header><text display-inline="yes-display-inline">The screening under
				this paragraph shall apply, in the case of a provider of medical or other items
				or services or supplier who is not enrolled in the program under this title,
				title XIX, or title XXI as of the date of enactment of this paragraph, on or
				after the date that is 1 year after such date of enactment.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idB1C84001BF784F2985C43913755813FC"><enum>(ii)</enum><header display-inline="yes-display-inline">Current providers of services and
				suppliers</header><text display-inline="yes-display-inline">The screening under
				this paragraph shall apply, in the case of a provider of medical or other items
				or services or supplier who is enrolled in the program under this title, title
				XIX, or title XXI as of such date of enactment, on or after the date that is 2
				years after such date of enactment.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4D9D7B85F6574F278F8CB6F672AA43EC"><enum>(iii)</enum><header display-inline="yes-display-inline">Revalidation of enrollment</header><text display-inline="yes-display-inline">Effective beginning on the date that is 180
				days after such date of enactment, the screening under this paragraph shall
				apply with respect to the revalidation of enrollment of a provider of medical
				or other items or services or supplier in the program under this title, title
				XIX, or title XXI.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4DCC9C16A8064A1289671E0A81B2CFC3"><enum>(iv)</enum><header display-inline="yes-display-inline">Limitation on enrollment and revalidation
				of enrollment</header><text display-inline="yes-display-inline">In no case may
				a provider of medical or other items or services or supplier who has not been
				screened under this paragraph be initially enrolled or reenrolled in the
				program under this title, title XIX, or title XXI on or after the date that is
				3 years after such date of enactment.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id437552BFA238441D8732BE2DF4E33722"><enum>(E)</enum><header display-inline="yes-display-inline">Expedited rulemaking</header><text display-inline="yes-display-inline">The Secretary may promulgate an interim
				final rule to carry out this paragraph.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID312ff488fb2d4ac49dad1bcd88bcf850"><enum>(3)</enum><header display-inline="yes-display-inline">Provisional period of enhanced oversight
				for new providers of services and suppliers</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id19F5B6CFCEC949EA9A414F11C8F09A70"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to
				provide for a provisional period of not less than 30 days and not more than 1
				year during which new providers of medical or other items or services and
				suppliers, as the Secretary determines appropriate, including categories of
				providers or suppliers, would be subject to enhanced oversight, such as
				prepayment review and payment caps, under the program under this title, the
				Medicaid program under title XIX, and the CHIP program under title XXI.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id480636621BD34A0F90804E308F0662B5"><enum>(B)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">The Secretary may establish by program
				instruction or otherwise the procedures under this paragraph.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1864d40237b34b27866a3d88cf4d540b"><enum>(4)</enum><header display-inline="yes-display-inline">Increased disclosure requirements</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID88ada2e19c714df28dbc80fd3155dfe6"><enum>(A)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">A provider of medical or other items or
				services or supplier who submits an application for enrollment or revalidation
				of enrollment in the program under this title, title XIX, or title XXI on or
				after the date that is 1 year after the date of enactment of this paragraph
				shall disclose (in a form and manner and at such time as determined by the
				Secretary) any current or previous affiliation (directly or indirectly) with a
				provider of medical or other items or services or supplier that has uncollected
				debt, has been or is subject to a payment suspension under a Federal health
				care program (as defined in section 1128B(f)), has been excluded from
				participation under the program under this title, the Medicaid program under
				title XIX, or the CHIP program under title XXI, or has had its billing
				privileges denied or revoked.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4e09a82c7e654f8a97a33dbbdd42b4d9"><enum>(B)</enum><header display-inline="yes-display-inline">Authority to deny enrollment</header><text display-inline="yes-display-inline">If the Secretary determines that such
				previous affiliation poses an undue risk of fraud, waste, or abuse, the
				Secretary may deny such application. Such a denial shall be subject to appeal
				in accordance with paragraph (7).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBF5ABD3ABA340D599367AE15FEAC209"><enum>(5)</enum><header display-inline="yes-display-inline">Authority to adjust payments of providers
				of services and suppliers with the same tax identification number for past-due
				obligations</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id2B576F9891FB4B03AFAAD70ACEA72C7F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				title, in the case of an applicable provider of services or supplier, the
				Secretary may make any necessary adjustments to payments to the applicable
				provider of services or supplier under the program under this title in order to
				satisfy any past-due obligations described in subparagraph (B)(ii) of an
				obligated provider of services or supplier.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA74598A5104A4FEE8AB92FD51F45D823"><enum>(B)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text>
									<clause commented="no" display-inline="no-display-inline" id="idA9EEA1605C1F4FB1979F906A6B5BB812"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>applicable provider of
				services or supplier</term> means a provider of services or supplier that has
				the same taxpayer identification number assigned under section 6109 of the
				Internal Revenue Code of 1986 as is assigned to the obligated provider of
				services or supplier under such section, regardless of whether the applicable
				provider of services or supplier is assigned a different billing number or
				national provider identification number under the program under this title than
				is assigned to the obligated provider of services or supplier.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id2447FB32A6DA4F329E46BFC166DBB03B"><enum>(ii)</enum><header display-inline="yes-display-inline">Obligated provider of services or
				supplier</header><text display-inline="yes-display-inline">The term
				<term>obligated provider of services or supplier</term> means a provider of
				services or supplier that owes a past-due obligation under the program under
				this title (as determined by the Secretary).</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76768b20084348909d2f64556a83c327"><enum>(6)</enum><header display-inline="yes-display-inline">Temporary moratorium on enrollment of new
				providers</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idDF25F70C725441B18121467ADFE2E185"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may impose a temporary
				moratorium on the enrollment of new providers of services and suppliers,
				including categories of providers of services and suppliers, in the program
				under this title, under the Medicaid program under title XIX, or under the CHIP
				program under title XXI if the Secretary determines such moratorium is
				necessary to prevent or combat fraud, waste, or abuse under either such
				program.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5105747736E341CC99C2722A4DCDE8A1"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation on review</header><text display-inline="yes-display-inline">There shall be no judicial review under
				section 1869, section 1878, or otherwise, of a temporary moratorium imposed
				under subparagraph (A).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6e6f068d150145c79133d40d75ae6c49"><enum>(7)</enum><header display-inline="yes-display-inline">Compliance programs</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idB9C111B2C2544494B7732FAB97FB0747"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On or after the date of implementation
				determined by the Secretary under subparagraph (C), a provider of medical or
				other items or services or supplier within a particular industry sector or
				category shall, as a condition of enrollment in the program under this title,
				title XIX, or title XXI, establish a compliance program that contains the core
				elements established under subparagraph (B) with respect to that provider or
				supplier and industry or category.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39B94192B0804828B680209BF6EE6EF4"><enum>(B)</enum><header display-inline="yes-display-inline">Establishment of core
				elements</header><text display-inline="yes-display-inline">The Secretary, in
				consultation with the Inspector General of the Department of Health and Human
				Services, shall establish core elements for a compliance program under
				subparagraph (A) for providers or suppliers within a particular industry or
				category.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32FBDCF2873F483B8300BAE12E76B26E"><enum>(C)</enum><header display-inline="yes-display-inline">Timeline for implementation</header><text display-inline="yes-display-inline">The Secretary shall determine the timeline
				for the establishment of the core elements under subparagraph (B) and the date
				of the implementation of subparagraph (A) for providers or suppliers within a
				particular industry or category. The Secretary shall, in determining such date
				of implementation, consider the extent to which the adoption of compliance
				programs by a provider of medical or other items or services or supplier is
				widespread in a particular industry sector or with respect to a particular
				provider or supplier
				category.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id781434EDDF1543B69DBCFD2F259F8ED8"><enum>(b)</enum><header display-inline="yes-display-inline">Medicaid</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id7F4B993761B24D64BAB1D609AE20DDAE"><enum>(1)</enum><header display-inline="yes-display-inline">State plan amendment</header><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act
			 (42 U.S.C. 1396a(a)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idA1289080158A4400A2CA1CB6D11E16CD"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
							<clause commented="no" display-inline="no-display-inline" id="id4C6BD3DB534A42D788F47D1ECFFF35C1"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> at the end
			 of paragraph (72);</text>

			 paragraph (73) and inserting a semicolon; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF9BCCF0600044DAEBCB52588B29B0E56"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after paragraph (73) the
			 following:</text>

				provider and supplier screening, oversight, and reporting requirements in
				accordance with subsection (ii);</text>
									</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB427AF3361BC469B809E695603DE0B7D"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idB9A9932C7C7C426D93657F67C82C75D1" style="OLC">
								<subsection commented="no" display-inline="no-display-inline" id="id698433852F494576B088E9E04236DE50"><enum>(ii)</enum><header display-inline="yes-display-inline">Provider and supplier screening, oversight,
				and reporting requirements</header><text display-inline="yes-display-inline">For purposes of subsection (a)(74), the
				requirements of this subsection are the following:</text>
									<paragraph commented="no" display-inline="no-display-inline" id="idC8945AA2EFF540949E1A926BDA990A09"><enum>(1)</enum><header display-inline="yes-display-inline">Screening</header><text display-inline="yes-display-inline">The State complies with the process for
				screening providers and suppliers under this title, as established by the
				Secretary under section 1886(j)(2).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDD0B37A7938476EAF93F39261965A70"><enum>(2)</enum><header display-inline="yes-display-inline">Provisional period of enhanced oversight
				for new providers and suppliers</header><text display-inline="yes-display-inline">The State complies with procedures to
				provide for a provisional period of enhanced oversight for new providers and
				suppliers under this title, as established by the Secretary under section
				1886(j)(3).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0E8C4552ED2410795C75901AE870CB9"><enum>(3)</enum><header display-inline="yes-display-inline">Disclosure requirements</header><text display-inline="yes-display-inline">The State requires providers and suppliers
				under the State plan or under a waiver of the plan to comply with the
				disclosure requirements established by the Secretary under section
				1886(j)(4).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD9272844B794444498C08A3B410D2D31"><enum>(4)</enum><header display-inline="yes-display-inline">Temporary moratorium on enrollment of new
				providers or suppliers</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="idE56DE90BCAAF4D429F7B95C5A2DA0069"><enum>(A)</enum><header display-inline="yes-display-inline">Temporary moratorium imposed by the
				Secretary</header>
											<clause commented="no" display-inline="no-display-inline" id="id206D2EFB46584337BDD2C903BBD000FC"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to clause (ii), the State complies
				with any temporary moratorium on the enrollment of new providers or suppliers
				imposed by the Secretary under section 1886(j)(6).</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id76154A3E0CC549C390A5FBEB740187F1"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">A State shall not be required to comply
				with a temporary moratorium described in clause (i) if the State determines
				that the imposition of such temporary moratorium would adversely impact
				beneficiaries' access to medical assistance.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE28DFEEF489F4AEE8E4A9AEDEBCFB2BE"><enum>(B)</enum><header display-inline="yes-display-inline">Moratorium on enrollment of providers and
				suppliers</header><text display-inline="yes-display-inline">At the option of
				the State, the State imposes, for purposes of entering into participation
				agreements with providers or suppliers under the State plan or under a waiver
				of the plan, periods of enrollment moratoria, or numerical caps or other
				limits, for providers or suppliers identified by the Secretary as being at
				high-risk for fraud, waste, or abuse as necessary to combat fraud, waste, or
				abuse, but only if the State determines that the imposition of any such period,
				cap, or other limits would not adversely impact beneficiaries' access to
				medical assistance.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7921552A210E4B86AE6FA7C518228EF7"><enum>(5)</enum><header display-inline="yes-display-inline">Compliance programs</header><text display-inline="yes-display-inline">The State requires providers and suppliers
				under the State plan or under a waiver of the plan to establish, in accordance
				with the requirements of section 1866(j)(7), a compliance program that contains
				the core elements established under subparagraph (B) of that section 1866(j)(7)
				for providers or suppliers within a particular industry or category.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40628C75F95540E59800FFB0BDC1272F"><enum>(6)</enum><header display-inline="yes-display-inline">Reporting of adverse provider
				actions</header><text display-inline="yes-display-inline">The State complies
				with the national system for reporting criminal and civil convictions,
				sanctions, negative licensure actions, and other adverse provider actions to
				the Secretary, through the Administrator of the Centers for Medicare &amp;
				Medicaid Services, in accordance with regulations of the Secretary.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id000CFCFEABA142CBAD3F45A8369E53C7"><enum>(7)</enum><header display-inline="yes-display-inline">Enrollment and npi of ordering or referring
				providers</header><text display-inline="yes-display-inline">The State
				requires—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idAB12EA923FE641AF9552D601A557737A"><enum>(A)</enum><text display-inline="yes-display-inline">all ordering or referring physicians or
				other professionals to be enrolled under the State plan or under a waiver of
				the plan as a participating provider; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id010D90FAF384448C9B30CE8577BB9466"><enum>(B)</enum><text display-inline="yes-display-inline">the national provider identifier of any
				ordering or referring physician or other professional to be specified on any
				claim for payment that is based on an order or referral of the physician or
				other professional.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD9C2D4B0E03A471F9E10A32279C41C61"><enum>(8)</enum><header display-inline="yes-display-inline">Other state oversight</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
				interpreted to preclude or limit the ability of a State to engage in provider
				and supplier screening or enhanced provider and supplier oversight activities
				beyond those required by the
				Secretary.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id839BCFDA4EFA4B73A7FFC9226127BC3F"><enum>(2)</enum><header display-inline="yes-display-inline">Disclosure of Medicare terminated providers
			 and suppliers to states</header><text display-inline="yes-display-inline">The
			 Administrator of the Centers for Medicare &amp; Medicaid Services shall
			 establish a process for making available to the each State agency with
			 responsibility for administering a State Medicaid plan (or a waiver of such
			 plan) under title XIX of the Social Security Act or a child health plan under
			 title XXI the name, national provider identifier, and other identifying
			 information for any provider of medical or other items or services or supplier
			 under the Medicare program under title XVIII or under the CHIP program under
			 title XXI that is terminated from participation under that program within 30
			 days of the termination (and, with respect to all such providers or suppliers
			 who are terminated from the Medicare program on the date of enactment of this
			 Act, within 90 days of such date).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0A2379412C94461DAD7B196B1FFEB909"><enum>(3)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1902(a)(23) of the Social Security
			 Act (42 U.S.C. 1396a), is amended by inserting before the semicolon at the end
			 the following: <quote>or by a provider or supplier to which a moratorium under
			 subsection (ii)(4) is applied during the period of such
			 moratorium</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1807B16485514AC18EFF27712EDE54C9"><enum>(c)</enum><header display-inline="yes-display-inline">CHIP</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security
			 Act (42 U.S.C. 1397gg(e)(1)) is amended—</text>

				Secretary of Veterans Affairs.</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="idC1B9274967644A758F1AB86B3A6A5BB4"><enum>(IV)</enum><text display-inline="yes-display-inline">Health-related programs administered by the
				Secretary of Defense.</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id35CC4DBE9E1D4715A6CA063DCE9A8659"><enum>(V)</enum><text display-inline="yes-display-inline">The program of old-age, survivors, and
				disability insurance benefits established under title II.</text>

				described in subclause (I) of such clause in the Integrated Data Repository
				shall be a priority. Data described in subclauses (II) through (VI) of such
				clause shall be included in the Integrated Data Repository as
				appropriate.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDabf7837cbf4441cc94879400f085e684"><enum>(B)</enum><header display-inline="yes-display-inline">Data sharing and matching</header>
										<clause commented="no" display-inline="no-display-inline" id="id8C476A92CE5F40549C3EB3CD9E148700"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall enter into agreements
				with the individuals described in clause (ii) under which such individuals
				share and match data in the system of records of the respective agencies of
				such individuals with data in the system of records of the Department of Health
				and Human Services for the purpose of identifying potential fraud, waste, and
				abuse under the programs under titles XVIII and XIX.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idCA21A1B5210D4AD19DD94D31C7313A55"><enum>(ii)</enum><header display-inline="yes-display-inline">Individuals described</header><text display-inline="yes-display-inline">The following individuals are described in
				this clause:</text>
											<subclause commented="no" display-inline="no-display-inline" id="idC2C763CB890E44A492FF48E43C3533EB"><enum>(I)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security.</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="idBDF7538463F345F381836E51F833C539"><enum>(II)</enum><text display-inline="yes-display-inline">The Secretary of Veterans Affairs.</text>

				databases</header><text display-inline="yes-display-inline">For purposes of
				conducting law enforcement and oversight activities and to the extent
				consistent with applicable information, privacy, security, and disclosure laws,
				including the regulations promulgated under the Health Insurance Portability
				and Accountability Act of 1996 and section 552a of title 5, United States Code,
				and subject to any information systems security requirements under such laws or
				otherwise required by the Secretary, the Inspector General of the Department of
				Health and Human Services and the Attorney General shall have access to claims
				and payment data of the Department of Health and Human Services and its
				contractors related to titles XVIII, XIX, and XXI.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4ed12cf6d6c042c599f5b3341726e5c6"><enum>(b)</enum><header display-inline="yes-display-inline">OIG authority To obtain
				information</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID4bef3d2751c34ceea1ae1232c1a73dbd"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding and in addition to any
				other provision of law, the Inspector General of the Department of Health and
				Human Services may, for purposes of protecting the integrity of the programs
				under titles XVIII and XIX, obtain information from any individual (including a
				beneficiary provided all applicable privacy protections are followed) or entity
				that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id605E43357275484590FEE9E06AC4872B"><enum>(A)</enum><text display-inline="yes-display-inline">is a provider of medical or other items or
				services, supplier, grant recipient, contractor, or subcontractor; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2ed46ec02aca41ea873bf08af855ea98"><enum>(B)</enum><text display-inline="yes-display-inline">directly or indirectly provides, orders,
				manufactures, distributes, arranges for, prescribes, supplies, or receives
				medical or other items or services payable by any Federal health care program
				(as defined in section 1128B(f)) regardless of how the item or service is paid
				for, or to whom such payment is made.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1aff09a8ccd2494bafc6739d4f53ef3e"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusion of certain
				information</header><text display-inline="yes-display-inline">Information which
				the Inspector General may obtain under paragraph (1) includes any supporting
				documentation necessary to validate claims for payment or payments under title
				XVIII or XIX, including a prescribing physician's medical records for an
				individual who is prescribed an item or service which is covered under part B
				of title XVIII, a covered part D drug (as defined in section 1860D–2(e)) for
				which payment is made under an MA–PD plan under part C of such title, or a
				prescription drug plan under part D of such title, and any records necessary
				for evaluation of the economy, efficiency, and effectiveness of the programs
				under titles XVIII and XIX.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7287d7b9d91746e6ab2dc15ebfda0c36"><enum>(c)</enum><header display-inline="yes-display-inline">Administrative remedy for knowing
				participation by beneficiary in health care fraud scheme</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idB646BCEA85FB42DB95DE7CB021DE5C48"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to any other applicable
				remedies, if an applicable individual has knowingly participated in a Federal
				health care fraud offense or a conspiracy to commit a Federal health care fraud
				offense, the Secretary shall impose an appropriate administrative penalty
				commensurate with the offense or conspiracy.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5C46FC2E98EA4100A99162A7F756331B"><enum>(2)</enum><header display-inline="yes-display-inline">Applicable individual</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the term
				<term>applicable individual</term> means an individual—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idD4012C6F731D4D62ACFC71E48C790398"><enum>(A)</enum><text display-inline="yes-display-inline">entitled to, or enrolled for, benefits
				under part A of title XVIII or enrolled under part B of such title;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8984053963E54DC2971D284C81B81BEF"><enum>(B)</enum><text display-inline="yes-display-inline">eligible for medical assistance under a
				State plan under title XIX or under a waiver of such plan; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBACB8C1175484C36857C77CE74D90BA5"><enum>(C)</enum><text display-inline="yes-display-inline">eligible for child health assistance under
				a child health plan under title XXI.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID062702285d3b43e8a78681589895536b"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting and returning of
				overpayments</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID466541d338964ee086cb090d5eeeb856"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a person has received an overpayment,
				the person shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID09a4c93e69444616aa80705ea5160f5a"><enum>(A)</enum><text display-inline="yes-display-inline">report and return the overpayment to the
				Secretary, the State, an intermediary, a carrier, or a contractor, as
				appropriate, at the correct address; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID443e7b3782e941bc8b1c03e17a768b91"><enum>(B)</enum><text display-inline="yes-display-inline">notify the Secretary, State, intermediary,
				carrier, or contractor to whom the overpayment was returned in writing of the
				reason for the overpayment.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8584ba2124ef4fc4a456280aa8c93a6b"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline for reporting and returning
				overpayments</header><text display-inline="yes-display-inline">An overpayment
				must be reported and returned under paragraph (1) by the later of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id001694B6F6FE45D9B800115F7D7C1A82"><enum>(A)</enum><text display-inline="yes-display-inline">the date which is 60 days after the date on
				which the overpayment was identified; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AF01A6FB3E342E78B154665ACA1A38C"><enum>(B)</enum><text display-inline="yes-display-inline">the date any corresponding cost report is
				due, if applicable.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85c298b931a0481fad36e2edd08a177b"><enum>(3)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">Any overpayment retained by a person after
				the deadline for reporting and returning the overpayment under paragraph (2) is
				an obligation (as defined in section 3729(b)(3) of title 31, United States
				Code) for purposes of section 3729 of such title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe1f6fa09988b43f4926bde9ae8add1d2"><enum>(4)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idFA2E8FF70C844701A96DFF2E931E8E6D"><enum>(A)</enum><header display-inline="yes-display-inline">Knowing and knowingly</header><text display-inline="yes-display-inline">The terms <term>knowing</term> and
				<term>knowingly</term> have the meaning given those terms in section 3729(b) of
				title 31, United States Code.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76A4DBFE3F654D0E861CBAF6183CBF47"><enum>(B)</enum><header display-inline="yes-display-inline">Overpayment</header><text display-inline="yes-display-inline">The term <term>overpayment</term> means any
				funds that a person receives or retains under title XVIII or XIX to which the
				person, after applicable reconciliation, is not entitled under such
				title.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD6D481C78D934FBEA691F467971552A0"><enum>(C)</enum><header display-inline="yes-display-inline">Person</header>
										<clause commented="no" display-inline="no-display-inline" id="idF7570A2056944B189B6C0F13FC8C0754"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <quote>person</quote> means a
				provider of services, supplier, Medicaid managed care organization (as defined
				in section 1903(m)(1)(A)), Medicare Advantage organization (as defined in
				section 1859(a)(1)), or PDP sponsor (as defined in section
				1860D–41(a)(13)).</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id9BBCB0D97C8A46CAAE7F443172FB906A"><enum>(ii)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">Such term does not include a
				beneficiary.</text>
										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id47672EFB6FDF4EB28F1F2FFDD777D872"><enum>(e)</enum><header display-inline="yes-display-inline">Inclusion of national provider identifier
				on all applications and claims</header><text display-inline="yes-display-inline">The Secretary shall promulgate a regulation
				that requires, not later than January 1, 2011, all providers of medical or
				other items or services and suppliers under the programs under titles XVIII and
				XIX that qualify for a national provider identifier to include their national
				provider identifier on all applications to enroll in such programs and on all
				claims for payment submitted under such
				programs.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id6835826B10FE49D8A0878B291028E3AA"><enum>(b)</enum><header display-inline="yes-display-inline">Access to data</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD2CB3762FC224813A1F5B05385A0CF67"><enum>(1)</enum><header display-inline="yes-display-inline">Medicare part D</header><text display-inline="yes-display-inline">Section 1860D–15(f)(2) of the Social
			 Security Act (42 U.S.C. 1395w–116(f)(2)) is amended by striking <quote>may be
			 used by</quote> and all that follows through the period at the end and
			 inserting “may be used—</text>
						<quoted-block display-inline="no-display-inline" id="id93EF20DD765044738E8054585E56EF4B" style="OLC">

			 States Code, is amended—</text>

			 of Social Security</header><text display-inline="yes-display-inline">Section
			 205(r) of the Social Security Act (42 U.S.C. 405(r)) is amended by adding at
			 the end the following new paragraph:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id6114674CE68140608DB90B0679FCD243"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1A7DC0BDF1B5454E919243452EBC846D"><enum>(A)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall,
				upon the request of the Secretary or the Inspector General of the Department of
				Health and Human Services—</text>
									<clause commented="no" display-inline="no-display-inline" id="id52AE7B43E16D47A9B61097FB14B60729" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">enter into an agreement with the Secretary
				or such Inspector General for the purpose of matching data in the system of
				records of the Social Security Administration and the system of records of the
				Department of Health and Human Services; and</text>

				assure the maintenance of the confidentiality of any information

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0DE53DFC198E456EA72ABFFAFFE61154" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<quote>system of records</quote> has the meaning given such term in section
				552a(a)(5) of title 5, United States
				Code.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7513fb64265e473aa4d3f72228567263"><enum>(c)</enum><header display-inline="yes-display-inline">Withholding of federal matching payments
			 for States that fail To report enrollee encounter data in the Medicaid

			 penalties</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idEAD4858E8C4D406CB8F623AE9151C467"><enum>(1)</enum><header display-inline="yes-display-inline">Permissive exclusions</header><text display-inline="yes-display-inline">Section 1128(b) of the Social Security Act

				health care program (as defined in section 1128B(f)), including Medicare
				Advantage organizations under part C of title XVIII, prescription drug plan
				sponsors under part D of title XVIII, Medicaid managed care organizations under
				title XIX, and entities that apply to participate as providers of services or
				suppliers in such managed care organizations and such
				plans.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BAD9E24EBF94B44B1DD94D2A138F9AA"><enum>(2)</enum><header display-inline="yes-display-inline">Civil monetary penalties</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id6BA7FA7D2F5D49E5A896E1C7510513B8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1128A(a) of the Social Security Act
			 (42 U.S.C. 1320a–7a(a)) is amended—</text>

				false statement, omission, or misrepresentation of a material fact in any
				application, bid, or contract to participate or enroll as a provider of
				services or a supplier under a Federal health care program (as so defined),
				including Medicare Advantage organizations under part C of title XVIII,
				prescription drug plan sponsors under part D of title XVIII, Medicaid managed
				care organizations under title XIX, and entities that apply to participate as
				providers of services or suppliers in such managed care organizations and such
				plans;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34D1EDBF38604409B38C3013383F7CAC"><enum>(10)</enum><text display-inline="yes-display-inline">knows of an overpayment (as defined in
				paragraph (4) of section 1128G(d)) and does not report and return the
				overpayment in accordance with such
				section;</text>
									</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
							</clause><clause commented="no" display-inline="no-display-inline" id="id589596F4A39D4CEDB7E54365F47BB69B"><enum>(iv)</enum><text display-inline="yes-display-inline">in the first sentence—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idDF50A00647D7490B9ED9659DE40D958C"><enum>(I)</enum><text display-inline="yes-display-inline">by striking the <quote>or</quote> after
			 <quote>prohibited relationship occurs;</quote>; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id434BA4621CBA4E49977C50E2429AA20A"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>act)</quote> and
			 inserting <quote>act; or in cases under paragraph (9), $50,000 for each false

								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8AA3ABE8FBFF4CEDA47E552579659268"><enum>(v)</enum><text display-inline="yes-display-inline">in the second sentence, by striking
			 <quote>purpose)</quote> and inserting <quote>purpose; or in cases under
			 paragraph (9), an assessment of not more than 3 times the total amount claimed
			 for each item or service for which payment was made based upon the application
			 containing the false statement or misrepresentation of a material
			 fact)</quote>.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb6606c31697d406784e42179655a9d31"><enum>(B)</enum><header display-inline="yes-display-inline">Clarification of treatment of certain
			 charitable and other innocuous programs</header><text display-inline="yes-display-inline">Section 1128A(i)(6) of the Social Security
			 Act (42 U.S.C. 1320a–7a(i)(6)) is amended—</text>
							<clause commented="no" display-inline="no-display-inline" id="id83A37CB223A84A8BAFD725B099B80613"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking
			 <quote>or</quote> at the end;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7bed837f711e46d5b873d39a1ce69a39"><enum>(G)</enum><text display-inline="yes-display-inline">the offer or transfer of items or services
				for free or less than fair market value by a person, if—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDda3894a70fbe4a7ba551043bd61792c0"><enum>(i)</enum><text display-inline="yes-display-inline">the items or services consist of coupons,
				rebates, or other rewards from a retailer;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID923da2733dea4bbeacc96db8f8c535eb"><enum>(ii)</enum><text display-inline="yes-display-inline">the items or services are offered or
				transferred on equal terms available to the general public, regardless of
				health insurance status; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID629c902618ea47e885e8086926761307"><enum>(iii)</enum><text display-inline="yes-display-inline">the offer or transfer of the items or
				services is not tied to the provision of other items or services reimbursed in
				whole or in part by the program under title XVIII or a State health care
				program (as defined in section 1128(h));</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa18e71ee69a9458089e8890458420da2"><enum>(H)</enum><text display-inline="yes-display-inline">the offer or transfer of items or services
				for free or less than fair market value by a person, if—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDb81b02c4c6524c07863f5c362867f355"><enum>(i)</enum><text display-inline="yes-display-inline">the items or services are not offered as
				part of any advertisement or solicitation;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID34e8a4c9957f499599f95401bfb5bddc"><enum>(ii)</enum><text display-inline="yes-display-inline">the items or services are not tied to the
				provision of other services reimbursed in whole or in part by the program under
				title XVIII or a State health care program (as so defined);</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID9e1cee06d3e540f2929e05dfd7f4ece9"><enum>(iii)</enum><text display-inline="yes-display-inline">there is a reasonable connection between
				the items or services and the medical care of the individual; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID91570292ec564260ab58cd2bf0c6eb02"><enum>(iv)</enum><text display-inline="yes-display-inline">the person provides the items or services
				after determining in good faith that the individual is in financial need;
				or</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6362048652F84E71BC46068C8F40868C"><enum>(I)</enum><text display-inline="yes-display-inline">effective on a date specified by the
				Secretary (but not earlier than January 1, 2011), the waiver by a PDP sponsor
				of a prescription drug plan under part D of title XVIII or an MA organization
				offering an MA–PD plan under part C of such title of any copayment for the
				first fill of a covered part D drug (as defined in section 1860D–2(e)) that is
				a generic drug for individuals enrolled in the prescription drug plan or MA–PD

				services or supplier described in paragraph (2) to provide the Secretary on a
				continuing basis with a surety bond in a form specified by the Secretary in an
				amount (not less than $50,000) that the Secretary determines is commensurate
				with the volume of the billing of the provider of services or supplier. The
				Secretary may waive the requirement of a bond under the preceding sentence in
				the case of a provider of services or supplier that provides a comparable
				surety bond under State law.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36EB81BF6C2941A7B29E1936656AC0D5"><enum>(2)</enum><header display-inline="yes-display-inline">Provider of services or supplier

								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7489c32683974fa09eeca870726634d5"><enum>(h)</enum><header display-inline="yes-display-inline">Suspension of Medicare and Medicaid
			 payments pending investigation of credible allegations of fraud</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id65CF27EED73A4BD19371567EF078B3CE"><enum>(1)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">Section 1862 of the Social Security Act (42
			 U.S.C. 1395y), as amended by subsection (g)(3), is amended by adding at the end
			 the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="id356FECECFDD54D77B798E7A153AB8319" style="OLC">

								<paragraph commented="no" display-inline="no-display-inline" id="id845DFFB95B2F4654B9929DF66B830EE5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall suspend payment to a
				provider of services or supplier under this title pending an investigation of
				credible allegations of fraud against the provider of services or supplier,
				unless the Secretary finds good cause not to suspend such payment.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBEC60BAF217F4139BE61F408BADE38EE"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall consult with the
				Inspector General of the Department of Health and Human Services in determining
				whether there is a credible allegation of fraud against a provider of services
				or supplier.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9054DA84E3554EE7A99345852D1FB3A5"><enum>(3)</enum><header display-inline="yes-display-inline">Promulgation of regulations</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations
				to carry out this subsection and section
				1903(i)(2)(C).</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3CB7E5D9C4D744008A0F61EBD97DD74D"><enum>(2)</enum><header display-inline="yes-display-inline">Medicaid</header><text display-inline="yes-display-inline">Section 1903(i)(2) of such Act (42 U.S.C.

				promulgated by the Secretary for purposes of section 1862(o) and this
				subparagraph, unless the State determines in accordance with such regulations
				there is good cause not to suspend such payments;
				or</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7bd389c66444464d8ef702c04fc92de9"><enum>(i)</enum><header display-inline="yes-display-inline">Extension of number of days in which
			 medicare claims are required To be paid in order to prevent or combat fraud,
			 waste, or abuse</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDb58131beb7ec48fcae17d2eb54db4faa"><enum>(1)</enum><header display-inline="yes-display-inline">Part A claims</header><text display-inline="yes-display-inline">Section 1816(c)(2) of the Social Security
			 Act (42 U.S.C. 1395h(c)(2)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID12217f32f0b64531834077ad524ec234"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii)(V), by striking
			 <quote>with respect</quote> and inserting <quote>subject to subparagraph (D),
			 with respect</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID560d37f993a2443387862cc96e2c00e8"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID16b51e5b67ca43dca97ca40c593e879b"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id3E529AC705564A899C8E592ADD3DA2C5"><enum>(i)</enum><text display-inline="yes-display-inline">Upon a determination by the Secretary that
				there is a likelihood of fraud, waste, or abuse involving a particular category
				of providers of services or suppliers, categories of providers of services or
				suppliers in a certain geographic area, or individual providers of services or
				suppliers, the Secretary shall extend the number of calendar days described in
				subparagraph (B)(ii)(V) to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id9A848EB2D3104C378740277469823B7D" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">up to 365 calendar days with respect to
				claims submitted by—</text>
											<item commented="no" display-inline="no-display-inline" id="id5DDE2B713B3E4576BE8DA4066A6129A7"><enum>(aa)</enum><text display-inline="yes-display-inline">categories of providers of services or
				suppliers; or</text>
											</item><item commented="no" display-inline="no-display-inline" id="idE44AEC877A6547E1833C2C02A2BC17C2"><enum>(bb)</enum><text display-inline="yes-display-inline">categories of providers of services or
				suppliers in a certain geographic area; or</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id1A28F6881F594C2F89AF5C751443D540" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">such time that the Secretary determines is
				necessary to ensure that the claims with respect to individual providers of
				services or suppliers are clean claims.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1903E2AE9FAB45CBAA26597713CCCE2E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">During the extended period of time under
				subclauses (I) and (II) of clause (ii), the Secretary shall engage in
				heightened scrutiny of claims, such as prepayment review and other methods the
				Secretary determines to be appropriate.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idB2FF86A042D6468FABC9F643F4C98A6E" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of
				enactment of this subparagraph and not less than annually thereafter, the
				Inspector General of the Department of Health and Human Services shall submit
				to the Secretary a report containing recommendations with respect to the
				application of this subparagraph and section 1842(c)(2)(D). Not later than 60
				days after receiving such a report, the Secretary shall submit to the Inspector
				General a written response to the recommendations contained in the
				report.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id25141297C764444DAAB742ABA2556329" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">There shall be no administrative or
				judicial review under section 1869, section 1878, or otherwise of the
				implementation of this subparagraph by the
				Secretary.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5bd92281675d4ce2912639df964d2fa6"><enum>(2)</enum><header display-inline="yes-display-inline">Part B claims</header><text display-inline="yes-display-inline">Section 1842(c)(2) of the Social Security
			 Act (42 U.S.C. 1395u(c)(2)) is amended—</text>

				there is a likelihood of fraud, waste, or abuse involving a particular category
				of providers of services or suppliers, categories of providers of services or
				suppliers in a certain geographic area, or individual providers of services or
				suppliers, the Secretary shall extend the number of calendar days described in
				subparagraph (B)(ii)(V) to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="idECE5809F8013464CAC0957EBC06E34B8" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">up to 365 calendar days with respect to
				claims submitted by—</text>

											</item><item commented="no" display-inline="no-display-inline" id="idCFF0687C84664A349A16BB3913EA3EA8"><enum>(bb)</enum><text display-inline="yes-display-inline">categories of providers of services or
				suppliers in a certain geographic area; or</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id215D92468DC241D8829558467D90D1D0" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">such time that the Secretary determines is
				necessary to ensure that the claims with respect to individual providers of
				services or suppliers are clean claims.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id018041CECA0D4816948C43AB4A273D33" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">During the extended period of time under
				subclauses (I) and (II) of clause (ii), the Secretary shall engage in
				heightened scrutiny of claims, such as prepayment review and other methods the
				Secretary determines to be appropriate.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdf592af04899444bbb007ddde1136f79"><enum>(3)</enum><header display-inline="yes-display-inline">Effective date</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2d1d6009ef7541b18a1093bcd420edfc"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The amendments made by this subsection
			 shall take effect on the day that is 6 months after the date of the enactment
			 of this Act.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc2359b86f8564c1ba5081cfc0694c6c6"><enum>(B)</enum><header display-inline="yes-display-inline">Expediting implementation</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations
			 to carry out the amendments made by this subsection which may be effective and
			 final immediately on an interim basis as of the date of publication of the
			 interim final regulation. If the Secretary provides for an interim final
			 regulation, the Secretary shall provide for a period of public comment on such
			 regulation after the date of publication. The Secretary may change or revise
			 such regulation after completion of the period of public comment.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H91523E82020541979EFA1533C9BE63BC"><enum>(j)</enum><header display-inline="yes-display-inline">Increased funding To fight fraud and
			 abuse</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HF30373968E34415B9FC22500EBE53BCA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1817(k) of the Social Security Act

					<paragraph commented="no" display-inline="no-display-inline" id="ID3058e0c52edb4f43b6050065b41840a7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting

				forth in subsection (d), and shall furnish the information collected under this
				section to the National Practitioner Data Bank established pursuant to the
				Health Care Quality Improvement Act of 1986 (42 U.S.C. 11101 et
				seq.).</text>
							</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8b091b07995d42c69ac9ec528e3e7285"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (d) and inserting
			 the following:</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID935e970fdf02404092a37408ebc2a825"><enum>(2)</enum><header display-inline="yes-display-inline">Fees for disclosure</header><text display-inline="yes-display-inline">The Secretary may establish or approve
				reasonable fees for the disclosure of information under this section. The
				amount of such a fee may not exceed the costs of processing the requests for
				disclosure and of providing such information. Such fees shall be available to
				the Secretary to cover such
				costs.</text>
								</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

				information</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID49ad3d64fdbe4867a36f7074fbaeb393"><enum>(1)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">With respect to information reported
				pursuant to subsection (a)(1), the Secretary shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDfe1fd941f9ee43c39f693555a7b21e4d"><enum>(A)</enum><text display-inline="yes-display-inline">provide for disclosure of the information,
				upon request, to the health care practitioner who, or the entity that, is the
				subject of the information reported; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf8a189e9773749829319a30ad47ca4a2"><enum>(B)</enum><text display-inline="yes-display-inline">establish procedures for the case where the
				health care practitioner or entity disputes the accuracy of the information
				reported.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0d8025c465cf47b1902b54d8dfb50c63"><enum>(2)</enum><header display-inline="yes-display-inline">Corrections</header><text display-inline="yes-display-inline">Each State licensing or certification
				agency and State law or fraud enforcement agency shall report corrections of
				information already reported about any formal proceeding or final adverse
				action described in subsection (a), in such form and manner as the Secretary
				prescribes by regulation.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID718fe5b473c040d8927730278f92d5a2"><enum>(e)</enum><header display-inline="yes-display-inline">Fees for disclosure</header><text display-inline="yes-display-inline">The Secretary may establish or approve
				reasonable fees for the disclosure of information under this section. The
				amount of such a fee may not exceed the costs of processing the requests for
				disclosure and of providing such information. Such fees shall be available to
				the Secretary to cover such costs.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID388bed4f54b840a48b2cd5e12390aa57"><enum>(f)</enum><header display-inline="yes-display-inline">Protection from liability for
				reporting</header><text display-inline="yes-display-inline">No person or
				entity, including any agency designated by the Secretary in subsection (b),
				shall be held liable in any civil action with respect to any reporting of
				information as required under this section, without knowledge of the falsity of
				the information contained in the report.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe26916ff9f1e48109477bfe9e81f0651"><enum>(g)</enum><header display-inline="yes-display-inline">References</header><text display-inline="yes-display-inline">For purposes of this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID139b5ddd51b649a58e8503408cb77f0e"><enum>(1)</enum><header display-inline="yes-display-inline">State licensing or certification
				agency</header><text display-inline="yes-display-inline">The term <term>State
				licensing or certification agency</term> includes any authority of a State (or
				of a political subdivision thereof) responsible for the licensing of health
				care practitioners (or any peer review organization or private accreditation
				entity reviewing the services provided by health care practitioners) or
				entities.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb416852b5a7a4077978a2449cf985eea"><enum>(2)</enum><header display-inline="yes-display-inline">State law or fraud enforcement
				agency</header><text display-inline="yes-display-inline">The term <term>State
				law or fraud enforcement agency</term> includes—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDc637b790fb1c48c7bc5bb71ea212ac92"><enum>(A)</enum><text display-inline="yes-display-inline">a State law enforcement agency; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc8a16430cfe14514b4f8cf28c66b6dbb"><enum>(B)</enum><text display-inline="yes-display-inline">a State Medicaid fraud control unit (as
				defined in section 1903(q)).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaea35bb74af24a42b4898731fe192ab3"><enum>(3)</enum><header display-inline="yes-display-inline">Final adverse action</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID137bea4137e54a1e9935bceeef03b9d7"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term
				<term>final adverse action</term> includes—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDf3f9c850e4ca466da60091913d8d4e1e"><enum>(i)</enum><text display-inline="yes-display-inline">civil judgments against a health care
				provider, supplier, or practitioner in State court related to the delivery of a
				health care item or service;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDf38233549c404135a607c0544626dcb4"><enum>(ii)</enum><text display-inline="yes-display-inline">State criminal convictions related to the
				delivery of a health care item or service;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID6ebb8505cb0b43bb857f5d6114c2128b"><enum>(iii)</enum><text display-inline="yes-display-inline">exclusion from participation in State
				health care programs (as defined in section 1128(h));</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID8b864de2166344978601b4669f13e84b"><enum>(iv)</enum><text display-inline="yes-display-inline">any licensing or certification action
				described in subsection (a)(1)(A) taken against a supplier by a State licensing
				or certification agency; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID97f73228dfdc4201814535bd232df7db"><enum>(v)</enum><text display-inline="yes-display-inline">any other adjudicated actions or decisions
				that the Secretary shall establish by regulation.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID007f3f0cb40b401e97a1279509d7c9f7"><enum>(B)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Such term does not include any action with
				respect to a malpractice claim.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID264d845b7e7c43f19baa46e29fc5527f"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (h), as so redesignated, by
			 striking <quote>The Secretary</quote> and all that follows through the period
			 at the end and inserting <quote>In implementing this section, the Secretary
			 shall provide for the maximum appropriate coordination with part B of the
			 Health Care Quality Improvement Act of 1986 (42 U.S.C. 11131 et seq.) and
			 section 1128E.</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfa2f5783a5f84b029f855a1cf57355f7"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1128C(a)(1) of the Social Security
			 Act (42 U.S.C. 1320a–7c(a)(1)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDee12b1bbcb04487da654bc903b157199"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C), by adding
			 <quote>and</quote> after the comma at the end;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID35a831ddaafb46dcabbf36aaef4a65ee"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>,
			 and</quote> and inserting a period; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDeeba0196b7354287a22d2e6fa2dfc5ce"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subparagraph (E).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5c8364c8b1e04aafa8802071f97b4deb"><enum>(d)</enum><header display-inline="yes-display-inline">Transition process; effective date</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID720c32a86561481ab92fc409de2d66b5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Effective on the date of enactment of this
			 Act, the Secretary of Health and Human Services (in this section referred to as
			 the <quote>Secretary</quote>) shall implement a transition process under which,
			 by not later than the end of the transition period described in paragraph (5),
			 the Secretary shall cease operating the Healthcare Integrity and Protection
			 Data Bank established under section 1128E of the Social Security Act (as in
			 effect before the effective date specified in paragraph (6)) and shall transfer
			 all data collected in the Healthcare Integrity and Protection Data Bank to the
			 National Practitioner Data Bank established pursuant to the Health Care Quality
			 Improvement Act of 1986 (42 U.S.C. 11101 et seq.). During such transition
			 process, the Secretary shall have in effect appropriate procedures to ensure
			 that data collection and access to the Healthcare Integrity and Protection Data
			 Bank and the National Practitioner Data Bank are not disrupted.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc91879a027f143d8833e0f7008db77fc"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations
			 to carry out the amendments made by subsections (a) and (b).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfe4192c59cbf41a69e6ffe59075a0011"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID487edc0f3ab443aa882ff8bf76d9ab7b"><enum>(A)</enum><header display-inline="yes-display-inline">Availability of fees</header><text display-inline="yes-display-inline">Fees collected pursuant to section
			 1128E(d)(2) of the Social Security Act prior to the effective date specified in
			 paragraph (6) for the disclosure of information in the Healthcare Integrity and
			 Protection Data Bank shall be available to the Secretary, without fiscal year
			 limitation, for payment of costs related to the transition process described in
			 paragraph (1). Any such fees remaining after the transition period is complete
			 shall be available to the Secretary, without fiscal year limitation, for
			 payment of the costs of operating the National Practitioner Data Bank.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID23217457fdf24328bb95770dac9a53dc"><enum>(B)</enum><header display-inline="yes-display-inline">Availability of additional
			 funds</header><text display-inline="yes-display-inline">In addition to the fees
			 described in subparagraph (A), any funds available to the Secretary or to the
			 Inspector General of the Department of Health and Human Services for a purpose
			 related to combating health care fraud, waste, or abuse shall be available to
			 the extent necessary for operating the Healthcare Integrity and Protection Data
			 Bank during the transition period, including systems testing and other
			 activities necessary to ensure that information formerly reported to the
			 Healthcare Integrity and Protection Data Bank will be accessible through the
			 National Practitioner Data Bank after the end of such transition period.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8cff87c40314960adddc1b1025e2fe4"><enum>(4)</enum><header display-inline="yes-display-inline">Special provision for access to the
			 national practitioner data bank by the department of veterans affairs</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDfcd3f0d9d1214fe79842b61dcb99800f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 during the 1-year period that begins on the effective date specified in
			 paragraph (6), the information described in subparagraph (B) shall be available
			 from the National Practitioner Data Bank to the Secretary of Veterans Affairs
			 without charge.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb8679e369a4b42c89924c5a0cdfcfab4"><enum>(B)</enum><header display-inline="yes-display-inline">Information described</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the
			 information described in this subparagraph is the information that would, but
			 for the amendments made by this section, have been available to the Secretary
			 of Veterans Affairs from the Healthcare Integrity and Protection Data
			 Bank.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15b93fb683a74bf38dbd895074e09e2f"><enum>(5)</enum><header display-inline="yes-display-inline">Transition period defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term
			 <term>transition period</term> means the period that begins on the date of
			 enactment of this Act and ends on the later of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID06abd6ab089c4a71b2c2a2ce95980771"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 1 year after such date of
			 enactment; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID154001f8337f414e83872f13a1c4cd03"><enum>(B)</enum><text display-inline="yes-display-inline">the effective date of the regulations
			 promulgated under paragraph (2).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc078fdca592046a7874fc9465fc8f4b4"><enum>(6)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsections (a), (b), and (c) shall take effect on the first day after the
			 final day of the transition period.</text>

			 claims reduced to not more than 12 months</header>

			 submission</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H7B1E5922858C4FE6B45D49DABA1B12B2"><enum>(1)</enum><header display-inline="yes-display-inline">Part A</header><text display-inline="yes-display-inline">Section 1814(a) of the Social Security Act

						<subparagraph commented="no" display-inline="no-display-inline" id="idA9B30B19003C4E419AD67B608A1041D9"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1842(b)(3) of such Act (42 U.S.C.
			 1395u(b)(3)(B)) is amended—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="id0B013BC87661497587DC50FF27F6849A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall
			 apply to services furnished on or after March 1, 2010.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A3B5D5B2787402F8929211139BAE882"><enum>(2)</enum><header display-inline="yes-display-inline">Services furnished before March
			 2010</header><text display-inline="yes-display-inline">In the case of services
			 furnished before March 1, 2010, a bill or request for payment under section
			 1814(a)(1), 1842(b)(3)(B), or 1835(a) shall be filed not later that December
			 31, 2010.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7962718055D144589DE915D0AFB1125E" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Physicians who order items or services
			 required to be Medicare enrolled physicians or eligible professionals</header>
				<subsection commented="no" display-inline="no-display-inline" id="HC4014C18169447E1988C286BD5D64756"><enum>(a)</enum><header display-inline="yes-display-inline">DME</header><text display-inline="yes-display-inline">Section 1834(a)(11)(B) of the Social
			 Security Act (42 U.S.C. 1395m(a)(11)(B)) is amended by striking
			 <quote>physician</quote> and inserting <quote>physician enrolled under section
			 1866(j) or an eligible professional under section 1848(k)(3)(B) that is
			 enrolled under section 1866(j)</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD862AE1BBA864A2998E67CEA99BDA9D4"><enum>(b)</enum><header display-inline="yes-display-inline">Home health services</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H96550DC28B4146D48DC0AB5A96E41EC6"><enum>(1)</enum><header display-inline="yes-display-inline">Part A</header><text display-inline="yes-display-inline">Section 1814(a)(2) of such Act (42 U.S.C.
			 1395(a)(2)) is amended in the matter preceding subparagraph (A) by inserting
			 <quote>in the case of services described in subparagraph (C), a physician
			 enrolled under section 1866(j) or an eligible professional under section
			 1848(k)(3)(B),</quote> before <quote>or, in the case of

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H27CE6E69B89D41239D94D326C756862A"><enum>(c)</enum><header display-inline="yes-display-inline">Application to other items or
			 services</header><text display-inline="yes-display-inline">The Secretary may
			 extend the requirement applied by the amendments made by subsections (a) and
			 (b) to durable medical equipment and home health services (relating to
			 requiring certifications and written orders to be made by enrolled physicians
			 and health professions) to all other categories of items or services under
			 title XVIII of the Social Security Act (42 U.S.C. 1395 et seq.), including
			 covered part D drugs as defined in section 1860D–2(e) of such Act (42 U.S.C.
			 1395w–102), that are ordered, prescribed, or referred by a physician enrolled
			 under section 1866(j) of such Act (42 U.S.C. 1395cc(j)) or an eligible
			 professional under section 1848(k)(3)(B) of such Act (42 U.S.C.
			 1395w–4(k)(3)(B)).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H286A054806184B939DA1798208407F60"><enum>(d)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to written orders and certifications made on or after
			 July 1, 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HFA367008047443D9AE7D97029DB76471" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Requirement for physicians to provide
			 documentation on referrals to programs at high risk of waste and abuse</header>
				<subsection commented="no" display-inline="no-display-inline" id="HF720C8047924418883605B85716758AD"><enum>(a)</enum><header display-inline="yes-display-inline">Physicians and other
			 suppliers</header><text display-inline="yes-display-inline">Section 1842(h) of
			 the Social Security Act (42 U.S.C. 1395u(h)) is amended by adding at the end
			 the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H37DDD7D39332485091F08ABF11D8AD5D" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H7672D71BFE2247519EBC3F541FFA5BF4" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">The Secretary may revoke enrollment, for a
				period of not more than one year for each act, for a physician or supplier
				under section 1866(j) if such physician or supplier fails to maintain and, upon
				request of the Secretary, provide access to documentation relating to written
				orders or requests for payment for durable medical equipment, certifications
				for home health services, or referrals for other items or services written or
				ordered by such physician or supplier under this title, as specified by the
				Secretary.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H3C01053D58E04C32BE8633D0A628C0C1"><enum>(b)</enum><header display-inline="yes-display-inline">Providers of services</header><text display-inline="yes-display-inline">Section 1866(a)(1) of such Act (42 U.S.C.
			 1395cc) is further amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HECF4994B4D66434F81443A5E450865D2"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (U), by striking at the end
			 <quote>and</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0B7A0142ECBE4B848BF38F72940AEE89"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (V), by striking the period
			 at the end and adding <quote>; and</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A5B842951644BE897AA63F8826081D5"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraph:</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB077C12B295A46F58D94081802A3ECF2"><enum>(c)</enum><header display-inline="yes-display-inline">OIG permissive exclusion
			 authority</header><text display-inline="yes-display-inline">Section 1128(b)(11)
			 of the Social Security Act (42 U.S.C. 1320a–7(b)(11)) is amended by inserting
			 <quote>, ordering, referring for furnishing, or certifying the need for</quote>
			 after <quote>furnishing</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H68861B6E4A22427F90CAE8C29DF3BAD4"><enum>(d)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to orders, certifications, and referrals made on or
			 after March 1, 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HECA83A37EB4649668B66407621326E40" section-type="subsequent-section"><enum>107.</enum><header display-inline="yes-display-inline">Face to face encounter with patient
			 required before physicians may certify eligibility for home health services or
			 durable medical equipment under Medicare</header>
				<subsection commented="no" display-inline="no-display-inline" id="H166D60C2463C4EADB35AB8A11B5A5AF3"><enum>(a)</enum><header display-inline="yes-display-inline">Condition of payment for home health
			 services</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HE1E75D77B3E5477C959FD810BD9E6943"><enum>(1)</enum><header display-inline="yes-display-inline">Part A</header><text display-inline="yes-display-inline">Section 1814(a)(2)(C) of such Act is
			 amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H44E462DA02304CB68CB0A249909BDA52"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and such
			 services</quote> and inserting <quote>such services</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2110FA3BD6804095BB0D0DEA8FBFC0AC"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after <quote>care of a
			 physician</quote> the following: <quote>, and, in the case of a certification
			 made by a physician after March 1, 2010, prior to making such certification the
			 physician must document that the physician himself or herself has had a
			 face-to-face encounter (including through use of telehealth, subject to the
			 requirements in section 1834(m), and other than with respect to encounters that
			 are incident to services involved) with the individual within a reasonable
			 timeframe as determined by the Secretary</quote>.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32BBF3201F574787B5B4D2FF09CD0DD2"><enum>(2)</enum><header display-inline="yes-display-inline">Part B</header><text display-inline="yes-display-inline">Section 1835(a)(2)(A) of the Social
			 Security Act is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H8C8362F892E14925BE44584BFB3533EB"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> before
			 <quote>(iii)</quote>; and</text>

			 that are incident to services involved) with the individual during the 6-month

			 determined by the Secretary</quote>.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id213E402C46934F4F853715560F93D117"><enum>(b)</enum><header display-inline="yes-display-inline">Condition of payment for durable medical
			 equipment</header><text display-inline="yes-display-inline">Section
			 1834(a)(11)(B) of the Social Security Act (42 U.S.C. 1395m(a)(11)(B)) is
			 amended—</text>

				require that such an order be written pursuant to the physician documenting
				that a physician, a physician assistant, a nurse practitioner, or a clinical
				nurse specialist (as those terms are defined in section 1861(aa)(5)) has had a
				face-to-face encounter (including through use of telehealth under subsection
				(m) and other than with respect to encounters that are incident to services
				involved) with the individual involved during the 6-month period preceding such
				written order, or other reasonable timeframe as determined by the
				Secretary.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEC671FC6DD55478E89C132F5E96A4DD7"><enum>(c)</enum><header display-inline="yes-display-inline">Application to other areas under
			 Medicare</header><text display-inline="yes-display-inline">The Secretary may
			 apply the face-to-face encounter requirement described in the amendments made
			 by subsections (a) and (b) to other items and services for which payment is
			 provided under title XVIII of the Social Security Act based upon a finding that
			 such an decision would reduce the risk of waste, fraud, or abuse.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H00B82C81A46C4FC988EA87C8E04ABF46"><enum>(d)</enum><header display-inline="yes-display-inline">Application to Medicaid</header><text display-inline="yes-display-inline">The requirements pursuant to the amendments
			 made by subsections (a) and (b) shall apply in the case of physicians making
			 certifications for home health services under title XIX of the Social Security
			 Act in the same manner and to the same extent as such requirements apply in the
			 case of physicians making such certifications under title XVIII of such
			 Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HF716F07471A04D6CA042C7BF1B4BD2CF" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Enhanced penalties</header>
				<subsection commented="no" display-inline="no-display-inline" id="id34B3F89ADAB94A128E0B1E6254C45CD2"><enum>(a)</enum><header display-inline="yes-display-inline">Civil monetary penalties for false
			 statements or delaying inspections</header><text display-inline="yes-display-inline">Section 1128A(a) of the Social Security Act
			 (42 U.S.C. 1320a–7a(a)), as amended by section 102(d)(2)(A), is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id2766132617B945F5B7917F571094E8DF"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after paragraph (10) the
			 following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H05FCD5AF39604103982BC388D33E79BD" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="HF7B33569263E4391AB63BF4C417FDF06"><enum>(11)</enum><text display-inline="yes-display-inline">knowingly makes, uses, or causes to be made

				for payment for items and services furnished under a Federal health care

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BE5F97935494999BED6A8F661E05ACB"><enum>(12)</enum><text display-inline="yes-display-inline">fails to grant timely access, upon
				reasonable request (as defined by the Secretary in regulations), to the
				Inspector General of the Department of Health and Human Services, for the
				purpose of audits, investigations, evaluations, or other statutory functions of
				the Inspector General of the Department of Health and Human
				Services;</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2FBB4B1418934EECB3AF7C10DCBBD440"><enum>(2)</enum><text display-inline="yes-display-inline">in the first sentence (as so
			 amended)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H3B06C9C604C04B42AEF9C6321F6CFBB5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or in cases under
			 paragraph (9)</quote> and inserting <quote>in cases under paragraph
			 (9)</quote>; and</text>

					<paragraph commented="no" display-inline="no-display-inline" id="H5EC35120694A4685B3138A2A2F6361B3"><enum>(1)</enum><header display-inline="yes-display-inline">Ensuring timely inspections relating to
			 contracts with MA organizations</header><text display-inline="yes-display-inline">Section 1857(d)(2) of such Act (42 U.S.C.
			 1395w–27(d)(2)) is amended—</text>

			 Act (42 U.S.C. 1395w–27(g)(1)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HA01132F20E0947DBBB488B7618AE9288"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B2D5260E881487A8E2B2127EC85EEC0"><enum>(I)</enum><text display-inline="yes-display-inline">transfers an individual enrolled under this
				part from one plan to another without the prior consent of the individual or
				the designee of the individual or solely for the purpose of earning a
				commission;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64C16B69FE8F4D54BB7A4144C81194D2"><enum>(J)</enum><text display-inline="yes-display-inline">fails to comply with marketing restrictions
				described in subsections (h) and (j) of section 1851 or applicable implementing
				regulations or guidance; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H27CFF6637B9D4CB887DCEC76070413A2"><enum>(K)</enum><text display-inline="yes-display-inline">employs or contracts with any individual or
				entity who engages in the conduct described in subparagraphs (A) through (J) of
				this paragraph;</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA008BAAD50A84B7C99F19D36BB531886"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 sentence: <quote>The Secretary may provide, in addition to any other remedies
			 authorized by law, for any of the remedies described in paragraph (2), if the
			 Secretary determines that any employee or agent of such organization, or any
			 provider or supplier who contracts with such organization, has engaged in any
			 conduct described in subparagraphs (A) through (K) of this
			 paragraph.</quote>.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H63C0904EA4C1459B936AA0F7644B8006"><enum>(3)</enum><header display-inline="yes-display-inline">Provision of false
			 information</header><text display-inline="yes-display-inline">Section
			 1857(g)(2)(A) of the Social Security Act (42 U.S.C. 1395w–27(g)(2)(A)) is
			 amended by inserting <quote>except with respect to a determination under
			 subparagraph (E), an assessment of not more than the amount claimed by such
			 plan or plan sponsor based upon the misrepresentation or falsified information
			 involved,</quote> after <quote>for each such determination,</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7992E226AF0D4D99ABB4F2665258EFA4"><enum>(c)</enum><header display-inline="yes-display-inline">Obstruction of program audits</header><text display-inline="yes-display-inline">Section 1128(b)(2) of the Social Security
			 Act (42 U.S.C. 1320a–7(b)(2)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H2BE5E861AA214E56B6E639D5F208A86A"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting
			 <quote><header-in-text level="paragraph" style="OLC">or
			 audit</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">investigation</header-in-text></quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H521C4A537CFF4D0F96E32D6CFBA2AFFE"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>investigation
			 into</quote> and all that follows through the period and inserting
			 “investigation or audit related to—</text>
						<quoted-block display-inline="no-display-inline" id="H60AE43AD6AF947BC9B9B4E3A62A0AC19" style="OLC">

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB902C5565C44406989A54F4B8E78C923"><enum>(d)</enum><header display-inline="yes-display-inline">Effective date</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD0E6F841BAAE43758AB63C395E912442"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
			 amendments made by this section shall apply to acts committed on or after
			 January 1, 2010.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCAE03BC0F8E6482C8FE888738CE73821"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The amendments made by subsection (b)(1)
			 take effect on the date of enactment of this Act.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8A89E62AA472441DB12E732F3C9BBE6B" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Medicare self-referral disclosure
			 protocol</header>
				<subsection commented="no" display-inline="no-display-inline" id="H9ABBF5E0DC35492280AD486B0894D717"><enum>(a)</enum><header display-inline="yes-display-inline">Development of self-Referral disclosure
			 protocol</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H337E603A8B154091B2E1332660B20FF4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 in cooperation with the Inspector General of the Department of Health and Human
			 Services, shall establish, not later than 6 months after the date of the
			 enactment of this Act, a protocol to enable health care providers of services
			 and suppliers to disclose an actual or potential violation of section 1877 of
			 the Social Security Act (42 U.S.C. 1395nn) pursuant to a self-referral
			 disclosure protocol (in this section referred to as an “SRDP”). The SRDP shall
			 include direction to health care providers of services and suppliers on—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HCDAF56450CEC4E3783CA907A891DAF17"><enum>(A)</enum><text display-inline="yes-display-inline">a specific person, official, or office to
			 whom such disclosures shall be made; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H66B273324D6B4A1C9AA359CDCED6F523"><enum>(B)</enum><text display-inline="yes-display-inline">instruction on the implication of the SRDP
			 on corporate integrity agreements and corporate compliance agreements.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7090176608494DAD9BBEF47B07D9BE38"><enum>(2)</enum><header display-inline="yes-display-inline">Publication on Internet website of SRDP
			 information</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall post information on the public Internet website
			 of the Centers for Medicare &amp; Medicaid Services to inform relevant
			 stakeholders of how to disclose actual or potential violations pursuant to an
			 SRDP.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF47926FC810C44368EB539404D59A4B3"><enum>(3)</enum><header display-inline="yes-display-inline">Relation to advisory opinions</header><text display-inline="yes-display-inline">The SRDP shall be separate from the
			 advisory opinion process set forth in regulations implementing section 1877(g)
			 of the Social Security Act.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFAEA74FFE718453DB6F26501ACA298F5"><enum>(b)</enum><header display-inline="yes-display-inline">Reduction in amounts owed</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 is authorized to reduce the amount due and owing for all violations under
			 section 1877 of the Social Security Act to an amount less than that specified
			 in subsection (g) of such section. In establishing such amount for a violation,
			 the Secretary may consider the following factors:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HC3F08C06236C415B8EFF9FF8887D933D"><enum>(1)</enum><text display-inline="yes-display-inline">The nature and extent of the improper or
			 illegal practice.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE53760C0071440B9A56CD7FD7D646EA0"><enum>(2)</enum><text display-inline="yes-display-inline">The timeliness of such
			 self-disclosure.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H706EB231D0434CA8A0A2E86DC40930C7"><enum>(3)</enum><text display-inline="yes-display-inline">The cooperation in providing additional
			 information related to the disclosure.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F13B75FB8B14E1D999AE6DD30482296"><enum>(4)</enum><text display-inline="yes-display-inline">Such other factors as the Secretary
			 considers appropriate.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4C9088D069B94606A98F9C6EC0F814E0"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date on
			 which the SRDP protocol is established under subsection (a)(1), the Secretary
			 shall submit to Congress a report on the implementation of this section. Such
			 report shall include—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H30C3AAE2A7DF4E44BB1E9DE091F0B61A"><enum>(1)</enum><text display-inline="yes-display-inline">the number of health care providers of
			 services and suppliers making disclosures pursuant to the SRDP;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4590DB1166A4AED9D905B1BB5872572"><enum>(2)</enum><text display-inline="yes-display-inline">the amounts collected pursuant to the
			 SRDP;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE5A56CA4D6B4997B9DA556CAFF49DB6"><enum>(3)</enum><text display-inline="yes-display-inline">the types of violations reported under the
			 SRDP; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42B8F1ABD68344749818F001A987F324"><enum>(4)</enum><text display-inline="yes-display-inline">such other information as may be necessary
			 to evaluate the impact of this section.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id4694306FA4C6434884EA180C266A6BE6" section-type="subsequent-section"><enum>110.</enum><header display-inline="yes-display-inline">Expansion of the Recovery Audit Contractor
			 (RAC) program</header>
				<subsection commented="no" display-inline="no-display-inline" id="id9EBD301CED8C4304B8218CEBCC4A0107"><enum>(a)</enum><header display-inline="yes-display-inline">Expansion to Medicaid</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idDA322CD1A826406B81463186F2FEE800"><enum>(1)</enum><header display-inline="yes-display-inline">State plan amendment</header><text display-inline="yes-display-inline">Section 1902(a)(42) of the Social Security
			 Act (42 U.S.C. 1396a(a)(42)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id43BE96D95D0B42429FA70856B0EEBCB7"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>that the records</quote>
			 and inserting “that—</text>
							<quoted-block display-inline="no-display-inline" id="id98E250FC75474BC69937C4F8FB144D9C" style="OLC">

			 semicolon; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7D4014DB51848EFB625E7832F9DFB0E"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idC1AD980B617E4652A82988B0B9EA108E" style="OLC">
								<subparagraph commented="no" display-inline="no-display-inline" id="id2DA758205DF94A758611F91C92E448AA"><enum>(B)</enum><text display-inline="yes-display-inline">not later than December 31, 2010, the State
				shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="id4F6E7DF00B594BD0A4A38D4B6EABC740"><enum>(i)</enum><text display-inline="yes-display-inline">establish a program under which the State
				contracts (consistent with State law and in the same manner as the Secretary
				enters into contracts with recovery audit contractors under section 1893(h),
				subject to such exceptions or requirements as the Secretary may require for
				purposes of this title or a particular State) with 1 or more recovery audit
				contractors for the purpose of identifying underpayments and overpayments and
				recouping overpayments under the State plan and under any waiver of the State
				plan with respect to all services for which payment is made to any entity under
				such plan or waiver; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id821EE50E7B1B464DBB7C9DE875EF9114"><enum>(ii)</enum><text display-inline="yes-display-inline">provide assurances satisfactory to the
				Secretary that—</text>
										<subclause commented="no" display-inline="no-display-inline" id="idCC612542E4F24966B3E35FD6C0D56153"><enum>(I)</enum><text display-inline="yes-display-inline">under such contracts, payment shall be made
				to such a contractor only from amounts recovered;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id851E9EB4DA3F44F0BC36C2CCECD5924F"><enum>(II)</enum><text display-inline="yes-display-inline">from such amounts recovered,
				payment—</text>
											<item commented="no" display-inline="no-display-inline" id="idB4781DEDB2B047668DA064AFBDFF6B77"><enum>(aa)</enum><text display-inline="yes-display-inline">shall be made on a contingent basis for
				collecting overpayments; and</text>
											</item><item commented="no" display-inline="no-display-inline" id="id467D53DB904748D986209BE7A74B53F6"><enum>(bb)</enum><text display-inline="yes-display-inline">may be made in such amounts as the State
				may specify for identifying underpayments;</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="idBA707FECC058467A91F22E2FB3B4F181"><enum>(III)</enum><text display-inline="yes-display-inline">the State has an adequate process for
				entities to appeal any adverse determination made by such contractors;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id4E222203BD3B498EAE0F8E3176F3C93E"><enum>(IV)</enum><text display-inline="yes-display-inline">such program is carried out in accordance
				with such requirements as the Secretary shall specify, including—</text>
											<item commented="no" display-inline="no-display-inline" id="id9778D151C7374A119045C7698F95F210"><enum>(aa)</enum><text display-inline="yes-display-inline">for purposes of section 1903(a)(7), that
				amounts expended by the State to carry out the program shall be considered
				amounts expended as necessary for the proper and efficient administration of
				the State plan or a waiver of the plan;</text>
											</item><item commented="no" display-inline="no-display-inline" id="id8B2CC3ECB3B541EAAA5CD773532107DF"><enum>(bb)</enum><text display-inline="yes-display-inline">that section 1903(d) shall apply to amounts
				recovered under the program; and</text>
											</item><item commented="no" display-inline="no-display-inline" id="id1F989FF68241438D83307B0F4ABF20B8"><enum>(cc)</enum><text display-inline="yes-display-inline">that the State and any such contractors
				under contract with the State shall coordinate such recovery audit efforts with
				other contractors or entities performing audits of entities receiving payments
				under the State plan or waiver in the State, including efforts with Federal and
				State law enforcement with respect to the Department of Justice, including the
				Federal Bureau of Investigations, the Inspector General of the Department of
				Health and Human Services, and the State Medicaid fraud control unit;
				and</text>
											</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66AD99934FE34F25B8679DA5419E497A"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination; regulations</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC76A7E2C1E5B4B24A21C9990DDE4E9B0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 acting through the Administrator of the Centers for Medicare &amp; Medicaid
			 Services, shall coordinate the expansion of the Recovery Audit Contractor
			 program to Medicaid with States, particularly with respect to each State that
			 enters into a contract with a recovery audit contractor for purposes of the
			 State's Medicaid program prior to December 31, 2010.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11090803EBE94AD6B0930908CA364525"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services
			 shall promulgate regulations to carry out this subsection and the amendments
			 made by this subsection, including with respect to conditions of Federal
			 financial participation, as specified by the Secretary.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6291661A78224BC985F787A9ACB72CBB"><enum>(b)</enum><header display-inline="yes-display-inline">Expansion to Medicare parts C and
			 D</header><text display-inline="yes-display-inline">Section 1893(h) of the
			 Social Security Act (42 U.S.C. 1395ddd(h)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idA30C955E53D24FA2AE198A56A07860FD"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding
			 subparagraph (A), by striking <quote>part A or B</quote> and inserting
			 <quote>this title</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF31B2A3D8494E649E10A4A75B9B3FDC"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>parts
			 A and B</quote> and inserting <quote>this title</quote>;</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id0549183128BA49F1AAD78705E4D65A91"><enum>(9)</enum><header display-inline="yes-display-inline">Special rules relating to parts C and
				D</header><text display-inline="yes-display-inline">The Secretary shall enter
				into contracts under paragraph (1) to require recovery audit contractors
				to—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id0F2D3ED69F7F4292A7FCB6B4F2AE132C"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that each MA plan under part C has
				an anti- fraud plan in effect and to review the effectiveness of each such
				anti-fraud plan;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1C1D35FF0BD1436A96C64C6EB8E801E2"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that each prescription drug plan
				under part D has an anti- fraud plan in effect and to review the effectiveness
				of each such anti-fraud plan;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97A0326EA2184BAA863F80986F0B32A8"><enum>(C)</enum><text display-inline="yes-display-inline">examine claims for reinsurance payments
				under section 1860D–15(b) to determine whether prescription drug plans
				submitting such claims incurred costs in excess of the allowable reinsurance
				costs permitted under paragraph (2) of that section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C8B34831B654463A93897D020F66F3F"><enum>(D)</enum><text display-inline="yes-display-inline">review estimates submitted by prescription
				drug plans by private plans with respect to the enrollment of high cost
				beneficiaries (as defined by the Secretary) and to compare such estimates with
				the numbers of such beneficiaries actually enrolled by such
				plans.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3033924750A2434C8AE6F372634915C6"><enum>(c)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 acting through the Administrator of the Centers for Medicare &amp; Medicaid
			 Services, shall submit an annual report to Congress concerning the
			 effectiveness of the Recovery Audit Contractor program under Medicaid and
			 Medicare and shall include such reports recommendations for expanding or
			 improving the program.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id35F097A9A7384B39972224E08982D135" section-type="subsequent-section"><enum>111.</enum><header display-inline="yes-display-inline">Requirements for the transmission of
			 management implication reports by the HHS OIG</header><text display-inline="no-display-inline">Section 1128G of the Social Security Act, as
			 added by section 102(a), is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id7ADAA71FAAB84FF0A912550A72173562" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idF5F6B90D13F249C396513D0C443EEE54"><enum>(f)</enum><header display-inline="yes-display-inline">Transmission of management implication
				reports by the HHS OIG</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id84E31106D155457691C3C9076D500535"><enum>(1)</enum><header display-inline="yes-display-inline">Congressional notification</header><text display-inline="yes-display-inline">Not later than 30 days after the
				transmission by the Inspector General of the Department of Health and Human
				Services to another agency of the Department of Health and Human Services of a
				management implication report, the Inspector General shall notify the relevant
				committees of Congress of such transmission.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04EC4B2D8D9B473092601F0F0941F332"><enum>(2)</enum><header display-inline="yes-display-inline">Secretarial response</header><text display-inline="yes-display-inline">The Secretary shall respond to a management
				implication report transmitted under paragraph (1) not later than 90 days after
				such transmission.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34754AFA78DF48BFB9C2EA20FE328DD1"><enum>(3)</enum><header display-inline="yes-display-inline">Relevant committees of congress
				defined</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>relevant committees of Congress</term> means the Committees on
				Ways and Means and Energy and Commerce of the House of Representatives and the
				Committee on Finance of the
				Senate.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id6A911A1F469549648AE2B5EE78996784" section-type="subsequent-section"><enum>112.</enum><header display-inline="yes-display-inline">Medical ID theft information sharing
			 program and clearinghouse</header>
				<subsection commented="no" display-inline="no-display-inline" id="idFE88849C1A614BCE8CDB85F4755DCA81"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 24 months after the date of
			 enactment of this Act, the Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>), acting through the
			 Administrator of the Centers for Medicare &amp; Medicaid Services and in
			 coordination with the Chairman of the Federal Trade Commission, shall establish
			 an information sharing program regarding beneficiary medical ID theft under the
			 programs under titles XVIII, XIX, and XXI of the Social Security Act (in this
			 section referred to as the <quote>program</quote>).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id647E1FF570434815AE4C3215C2D25167"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of program</header><text display-inline="yes-display-inline">The program shall include—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id81F14985CB744639976A2AAB06BAF53A"><enum>(1)</enum><text display-inline="yes-display-inline">the establishment of methods to identify
			 and detect relevant warning signs of medical ID theft;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA7C6C8E462C247D9974573BDABD3A043"><enum>(2)</enum><text display-inline="yes-display-inline">the establishment of appropriate responses
			 to such warning signs that would mitigate and prevent beneficiary medical ID
			 theft; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42A2CB557B6A42CCA96343AE96B42B5D"><enum>(3)</enum><text display-inline="yes-display-inline">the development of a detailed plan to
			 update the program as appropriate, taking into consideration such warning signs
			 and appropriate responses.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDee8c66ba41db45ae8b2223184f173677"><enum>(c)</enum><header display-inline="yes-display-inline">Establishment of
			 clearinghouse</header><text display-inline="yes-display-inline">The Secretary,
			 in coordination with the Chairman of the Federal Trade Commission, shall
			 establish a clearinghouse at the Centers for Medicare &amp; Medicaid Services
			 that collects reports of ID theft against beneficiaries under the programs
			 under titles XVIII, XIX, and XXI of the Social Security Act from the Federal
			 Trade Commission and other sources determined appropriate by the Secretary.
			 Such clearinghouse shall be used to fight medical ID theft against
			 beneficiaries and to prevent the improper payment of claims under such
			 programs.</text>
				</subsection></section></title><title commented="no" id="id96DFFA8D3EAC4742A9DAA9AD169770E0" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Additional Medicaid Provisions</header>
			<section commented="no" display-inline="no-display-inline" id="H402E10385E434C68B5369F02CB36E3F2" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Termination of provider participation under
			 Medicaid if terminated under Medicare or other State plan</header><text display-inline="no-display-inline">Section 1902(a)(39) of the Social Security
			 Act (42 U.S.C. 42 U.S.C. 1396a(a)) is amended by inserting after
			 <quote>1128A,</quote> the following: <quote>terminate the participation of any
			 individual or entity in such program if (subject to such exceptions as are
			 permitted with respect to exclusion under sections 1128(c)(3)(B) and
			 1128(d)(3)(B)) participation of such individual or entity is terminated under
			 title XVIII or any other State plan under this title,</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H6F3477EEE66E4DDFBA07A0958FBF3B8C" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline"> Medicaid exclusion from participation
			 relating to certain ownership, control, and management
			 affiliations</header><text display-inline="no-display-inline">Section 1902(a)
			 of the Social Security Act (42 U.S.C. 1396a(a)), as amended by section 101(b),
			 is amended by inserting after paragraph (74) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H46FE985943354C92B17D1799CD35C635" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H63C77DECEE3F46668281607E8A2F94EF"><enum>(75)</enum><text display-inline="yes-display-inline">provide that the State agency described in
				paragraph (9) exclude, with respect to a period, any individual or entity from
				participation in the program under the State plan if such individual or entity
				owns, controls, or manages an entity that (or if such entity is owned,
				controlled, or managed by an individual or entity that)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="HC1FB3328B4574699B4F8FB7651A38EC6"><enum>(A)</enum><text display-inline="yes-display-inline">has unpaid overpayments (as defined by the
				Secretary) under this title during such period determined by the Secretary or
				the State agency to be delinquent;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE9138495BCC4109BFC0B8792E902D77"><enum>(B)</enum><text display-inline="yes-display-inline">is suspended or excluded from participation
				under or whose participation is terminated under this title during such period;
				or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H89BAD027EE414078964CC65237A5218B"><enum>(C)</enum><text display-inline="yes-display-inline">is affiliated with an individual or entity
				that has been suspended or excluded from participation under this title or
				whose participation is terminated under this title during such
				period;</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="H28B66EC74CED472D9498FBBAE609330A" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Billing agents, clearinghouses, or other
			 alternate payees required to register under Medicaid</header>
				<subsection commented="no" display-inline="no-display-inline" id="HCF73337802104F1BB1EB1490488F0FA1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act
			 (42 U.S.C. 42 U.S.C. 1396a(a)), as amended by section 202(a), is amended by
			 inserting after paragraph (75) the following:</text>

				behalf of a health care provider must register with the State and the Secretary
				in a form and manner specified by the Secretary;

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HF920FF945A5F45FE8BA3E65179261BE1" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline"> Requirement to report expanded set of data
			 elements under MMIS to detect fraud and abuse</header>
				<subsection commented="no" display-inline="no-display-inline" id="id61D6F2331827497E9BB3EF70ED653E15"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1903(r)(1)(F) of the Social
			 Security Act (42 U.S.C. 1396b(r)(1)(F)) is amended by inserting after
			 <quote>necessary</quote> the following: <quote>and including, for data
			 submitted to the Secretary on or after March 1, 2010, data elements from the
			 automated data system that the Secretary determines to be necessary for program
			 integrity, program oversight, and administration, at such frequency as the
			 Secretary shall determine</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9D6153E2AFB54D4798035A907A03B524"><enum>(b)</enum><header display-inline="yes-display-inline">Managed care organizations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H20D08923F83E43979A6E6CE9401AFB33"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1903(m)(2)(A)(xi) of the Social
			 Security Act (42 U.S.C. 1396b(m)(2)(A)(xi)) is amended by inserting <quote>and
			 for the provision of such data to the State at a frequency and level of detail

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD15A721A0E0478DADFF27D1AF73B3B4"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 paragraph (1) shall apply with respect to contract years beginning on or after
			 March 1, 2010.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id80ACBF7CDC224232B43F69AAB72547BB" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Prohibition on payments to institutions or
			 entities located outside of the United States</header><text display-inline="no-display-inline">Section 1902(a) of the Social Security Act
			 (42 U.S.C. 1396b(a)), as amended by section 203, is amended by inserting after
			 paragraph (76) the following new paragraph:</text>

				any payments for items or services provided under the State plan or under a
				waiver to any financial institution or entity located outside of the United
				States.</text>

			</section><section commented="no" display-inline="no-display-inline" id="idA3DB28CA4D7F43109C7D9179222D33F3" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Overpayments</header>
				<subsection commented="no" display-inline="no-display-inline" id="idF4DB0B4BDCBC442AB25A1EE9D0EF2C7B"><enum>(a)</enum><header display-inline="yes-display-inline">Extension of period for collection of
			 overpayments due to fraud</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idCFA156092B4B49D4AB56DC0D318B21B2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1903(d)(2) of the Social Security
			 Act (42 U.S.C. 1396b(d)(2)) is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id8080059215B743FE9AA42BF3438C813C"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
							<clause commented="no" display-inline="no-display-inline" id="idEA5DECA085124F65BD35F0F56ECA4CE9"><enum>(i)</enum><text display-inline="yes-display-inline">in the first sentence, by striking
			 <quote>60 days</quote> and inserting <quote>1 year</quote>; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idD5B1595AD4F747E893D0085B69302452"><enum>(ii)</enum><text display-inline="yes-display-inline">in the second sentence, by striking

				recover a debt which represents an overpayment (or any portion thereof) made to
				a person or other entity due to fraud within 1 year of discovery because there
				is not a final determination of the amount of the overpayment under an
				administrative or judicial process (as applicable), including as a result of a
				judgment being under appeal, no adjustment shall be made in the Federal payment
				to such State on account of such overpayment (or portion thereof) before the
				date that is 30 days after the date on which a final judgment (including, if
				applicable, a final determination on an appeal) is
				made.</text>
									</clause><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7282DA2691864B6EB0F700708259BA32"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection take effect on the date of enactment of this Act and apply to
			 overpayments discovered on or after that date.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9B3ECC47525C4D38B10AA3974F202476"><enum>(b)</enum><header display-inline="yes-display-inline">Corrective action</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations
			 that require States to correct Federally identified claims overpayments, of an
			 ongoing or recurring nature, with new Medicaid Management Information System
			 (MMIS) edits, audits, or other appropriate corrective action.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idF2DF3C3828F54EAF806CFE3E8C17C213" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Mandatory State use of national correct
			 coding initiative</header><text display-inline="no-display-inline">Section
			 1903(r) of the Social Security Act (42 U.S.C. 1396b(r)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id3F82A9C30A11423F90B1C6F2020834C6"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id0EEECD76839742729BA2AB9AD899C800"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9260e70095694a4a8be9a2d5091bfa89"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (iii), by adding
			 <quote>and</quote> after the semi-colon; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3B9AA6F08F1A480CB84AD1F4F5A50515"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 clause:</text>

				October 1, 2010, incorporate compatible methodologies of the National Correct
				Coding Initiative administered by the Secretary (or any successor initiative to
				promote correct coding and to control improper coding leading to inappropriate
				payment) and such other methodologies of that Initiative (or such other
				national correct coding methodologies) as the Secretary identifies in
				accordance with paragraph (4);</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6587F149A465459CBA44B906848AD54D"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id3D355BA254624DA0ACE0AEB697F840D3" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id87BDE0F2E36A48869F1103E12A3C1837" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1)(B)(iv), the
				Secretary shall do the following:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id4017BBCEB0254CA5918417416D839022"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than September 1, 2010:</text>
								<clause commented="no" display-inline="no-display-inline" id="id6202DBF50AA74AACB596251ECAF91E6E"><enum>(i)</enum><text display-inline="yes-display-inline">Identify those methodologies of the
				National Correct Coding Initiative administered by the Secretary (or any
				successor initiative to promote correct coding and to control improper coding
				leading to inappropriate payment) which are compatible to claims filed under
				this title.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idB225009BE6D4426CA17402661B1681B6"><enum>(ii)</enum><text display-inline="yes-display-inline">Identify those methodologies of such
				Initiative (or such other national correct coding methodologies) that should be
				incorporated into claims filed under this title with respect to items or
				services for which States provide medical assistance under this title and no
				national correct coding methodologies have been established under such
				Initiative with respect to title XVIII.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idFC2005CF0B604759BC24B109B6C5780C"><enum>(iii)</enum><text display-inline="yes-display-inline">Notify States of—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idF09919C081514499AD87070F9E21F3BB"><enum>(I)</enum><text display-inline="yes-display-inline">the methodologies identified under
				subparagraphs (A) and (B) (and of any other national correct coding
				methodologies identified under subparagraph (B)); and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id18181449A3B8475D982243371A546348"><enum>(II)</enum><text display-inline="yes-display-inline">how States are to incorporate such
				methodologies into claims filed under this title.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE770B3A3B0C14ABE8B6808AA2A6046FE"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than March 1, 2011, submit a
				report to Congress that includes the notice to States under clause (iii) of
				subparagraph (A) and an analysis supporting the identification of the
				methodologies made under clauses (i) and (ii) of subparagraph
				(A).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idC598FA52C9934AFBB5885B657D726491" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Payment for illegal unapproved
			 drugs</header>
				<subsection commented="no" display-inline="no-display-inline" id="id2AE48DD8B4A4453DA430CFB9B243E7F5"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that each year, the Medicaid
			 program under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.)
			 pays millions of dollars in reimbursement for covered outpatient drugs that are
			 not approved by the Food and Drug Administration under a new drug application
			 under section 505(b) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C.
			 355(b)) or an abbreviated new drug application under section 505(j) of such
			 Act, or that such drug is not subject such section 505 or section 512 due to
			 the application of section 201(p) of such Act (21 U.S.C. 321(p)).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id13B481DAA5F344EB83D6A3A3AAC16E4A"><enum>(b)</enum><header display-inline="yes-display-inline">Listing of drugs and devices</header><text display-inline="yes-display-inline">Section 510 of the Food, Drug and Cosmetic
			 Act (21 U.S.C. 360) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id91DF58E4FFB444B3B888BFE78175F1D1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (j)(1)(B)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDa51bf2ee733840d4b7aa09944bd26d09"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by inserting <quote>in the
			 case of a drug, the authority under this Act that does not require such drug to
			 be subject to section 505 and section 512,</quote> after <quote>labeling for
			 such drug or device,</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaffcf7c577f040b0942a70464a0049f0"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting <quote>, in
			 the case of a drug, the authority under this Act that does not require such
			 drug to be subject to section 505 and section 512,</quote> after <quote>for
			 such drug or device</quote>; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91EE6091436E445B8BECE7F0DE985499"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (f)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5510E8F3FA4947CDB080E7A976C1A7C8"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(f) The
			 Secretary</quote> and inserting the following:</text>

				section 505 or 512</header><text display-inline="yes-display-inline">Not later
				than January 1, 2011, the Secretary shall make available to the public on the
				Internet website of the Food and Drug Administration a list that includes, for
				each drug described in subsection (j)(1)(B)—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDf762b164c48b49e99568794a75c79762"><enum>(A)</enum><text display-inline="yes-display-inline">the drug;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6F62D5B1D9D74E739F9F8C0EC2F4B3D6"><enum>(B)</enum><text display-inline="yes-display-inline">the person who listed such drug; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF968392652854DBB94BD9A43CEC807F1"><enum>(C)</enum><text display-inline="yes-display-inline">the authority under this Act that does not
				require such drug to be subject to section 505 and section 512, as provided by
				such person in such
				list.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id60E4B9891CD44FC79D0B93E1E2905777"><enum>(c)</enum><header display-inline="yes-display-inline">Payment for covered outpatient
			 drugs</header><text display-inline="yes-display-inline">Section 1927 of the
			 Social Security Act (42 U.S.C. 1396r–8) is amended by inserting at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id1547618E8499421BAFCF59B96655531F" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id609CF4BE75044171919A9FE60C17DBD5"><enum>(l)</enum><header display-inline="yes-display-inline">Condition</header><text display-inline="yes-display-inline">Beginning January 1, 2011, no State shall
				make any payment under this section for any covered outpatient drug unless such
				State first verifies with the Food and Drug Administration that such covered
				outpatient drug has been approved by the Food and Drug Administration under a
				new drug application under section 505(b) of the Federal Food, Drug, and
				Cosmetic Act (21 U.S.C. 355(b)) or an abbreviated new drug application under
				section 505(j) of such Act, or that such drug is not subject such section 505
				or section 512 due to the application of section 201(p) of such Act (21 U.S.C.
				321(p)). The Secretary shall have the authority to proscribe regulations to
				create an information sharing protocol to allow States to verify that a covered
				outpatient drug has been approved by the Food and Drug
				Administration.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id538B8C45288047A19D4CCA578893CC7E" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">General effective date</header>
				<subsection commented="no" display-inline="no-display-inline" id="idAABCE380EF1A4E56A2160245BD87E476"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
			 subtitle, this subtitle and the amendments made by this subtitle take effect on
			 January 1, 2011, without regard to whether final regulations to carry out such
			 amendments and subtitle have been promulgated by that date.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id7897740CFC95477BA0D544821458318F"><enum>(b)</enum><header display-inline="yes-display-inline">Delay if state legislation
			 required</header><text display-inline="yes-display-inline">In the case of a
			 State plan for medical assistance under title XIX of the Social Security Act or
			 a child health plan under title XXI of such Act which the Secretary of Health
			 and Human Services determines requires State legislation (other than
			 legislation appropriating funds) in order for the plan to meet the additional
			 requirement imposed by the amendments made by this subtitle, the State plan or
			 child health plan shall not be regarded as failing to comply with the
			 requirements of such title solely on the basis of its failure to meet this
			 additional requirement before the first day of the first calendar quarter
			 beginning after the close of the first regular session of the State legislature
			 that begins after the date of the enactment of this Act. For purposes of the
			 previous sentence, in the case of a State that has a 2-year legislative
			 session, each year of such session shall be deemed to be a separate regular
			 session of the State legislature.</text>
				</subsection></section></title><title commented="no" id="id5DBD38D0603144EFB2BCBA101A833F8E" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Additional provisions</header>
			<section commented="no" display-inline="no-display-inline" id="id28ABF8E8166C426E93D91495ADD636E1" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Requiring individuals or entities that
			 participate in or conduct activities under Federal health care programs to
			 comply with certain Congressional requests</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC5CAFC503C8A42ECB3304FC96294AD23"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1128G of the Social Security Act,
			 as added by section 102(a) and amended by section 111, is amended by adding at
			 the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="id58A07AF33CA142CFB2CFA9D91731F1CA" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id4E7243734AC244B9BC92B0DB7599AA38"><enum>(g)</enum><header display-inline="yes-display-inline">Compliance with certain requests by
				individuals and entities that participate in or conduct activities under
				Federal health care programs</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id5370833C6FC24834B627336AE14DD303"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any individual or entity that participates
				in or conducts activities under a Federal health care program (as defined in
				section 1128B(f)) shall, as a condition of such participation or such conduct,
				comply (at a time and in a manner specified by the Chairman or ranking member)
				with any request submitted by the Chairman or the ranking member of a relevant
				committee of Congress to the individual or entity for the following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD1C0FB033D99496CA8B2EEE17D9114AA"><enum>(A)</enum><text display-inline="yes-display-inline">Documents.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id05210D817BA040DA917ED445B52C0752"><enum>(B)</enum><text display-inline="yes-display-inline">Information.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id473FD3CF399F4FEA92E6A0500F6F5F18"><enum>(C)</enum><text display-inline="yes-display-inline">Interviews.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id183ECDE328AA425DB05579DDDC2B2126"><enum>(2)</enum><header display-inline="yes-display-inline">Relevant committee of congress
				defined</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>relevant committee of Congress</term> means the Committees on
				Ways and Means and Energy and Commerce of the House of Representatives and the
				Committee on Finance of the
				Senate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB520E45A92C04B4EA8D33446CE305B2B"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date that is 2 years after the date of
			 enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id82D98C1CE86E4B249ADD4D0464299B19" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Amendments to the False Claims
			 Act</header><text display-inline="no-display-inline">Section 3730(h) of title
			 31, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id56364379084E483088E1F281C5215C95"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>or
			 agent on behalf of the employee, contractor, or agent or associated others in
			 furtherance of other efforts to stop 1 or more violations of this
			 subchapter</quote> and inserting <quote>agent or associated others in
			 furtherance of an action under this section or other efforts to stop 1 or more
			 violations of this subchapter</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09D897AB184147ACAA53BC1F950272AB"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id3C1F3F355BCC40F2A00463FF1FF9D9FE" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Dismissal of certain actions or claims
			 under the False Claims Act</header><text display-inline="no-display-inline">Section 3730(e) of title 31, United States
			 Code, is amended by striking paragraph (4) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA49A7933D5F74F72A46DE311F0443D61" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID72a4b56b7eb548de96a55f83867831f6"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5489D0C2F0074F64A6D1413E468D5FE0"><enum>(A)</enum><text display-inline="yes-display-inline">The court shall dismiss an action or claim
				under this section, unless opposed by the Government, if substantially the same
				allegations or transactions as alleged in the action or claim were publicly
				disclosed—</text>
							<clause commented="no" display-inline="no-display-inline" id="id4DBC966056DB41EFAD0D3DA2F076D0D3" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">in a Federal criminal, civil, or
				administrative hearing in which the Government or its agent is a party;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idEDBDC1A11441410DB8DA0FEA26101F62" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in a congressional, Government
				Accountability Office, or other Federal report, hearing, audit, or
				investigation; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idAC43221A50BE4BAA9F3008C8A6780142" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">from the news media, unless the action is
				brought by the Attorney General or the person bringing the action is an
				original source of the information.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2C2D082523E046CD8811069C28866F46" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>original source</term> means an individual who—</text>
							<clause commented="no" display-inline="no-display-inline" id="idBA16901D0A0847A4B3F850E018E84D0B"><enum>(i)</enum><text display-inline="yes-display-inline">prior to a public disclosure under
				subsection (e)(4)(a), has voluntarily disclosed to the Government the
				information on which allegations or transactions in a claim are based;
				or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idC3F150B1470E48B9BB655EF928A4F46A"><enum>(ii)</enum><text display-inline="yes-display-inline">has knowledge that is independent of and
				materially adds to the publicly disclosed allegations or transactions, and has
				voluntarily provided the information to the Government before filing an action
				under this
				section.</text>
