				Secretary of Energy shall, as a part of the Marshall Islands program conducted
				under subparagraph (A), periodically (but not less frequently than every 4
				years) survey radiological conditions on Runit Island.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA863922F96D54058995AD6BE4E7AA77F"><enum>(ii)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee
				on Energy and Natural Resources of the Senate, and the Committee on Natural
				Resources of the House of Representatives, a report that describes the results
				of each survey conducted under clause (i), including any significant changes in
				conditions on Runit
				Island.</text>

			 administration</header><text display-inline="yes-display-inline">Section 3621
			 of the Energy Employees Occupational Illness Compensation Program Act of 2000
			 (42 U.S.C. 7384<italic>l</italic>) is amended by adding at the end the
			 following:</text>

			 U.S.C. 7385s(1)) is amended by inserting before the period at the end the
			 following: <quote>, including a citizen of the Trust Territory of the Pacific

				the Compact of Free Association</header>
						<subsection commented="no" display-inline="no-display-inline" id="id4839D7AB6E2D4594ACA57C530F04C81F"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Compact of Free
				Association</header><text display-inline="yes-display-inline">In this section,
				the term <term>Compact of Free Association</term> means—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id7BAD27D395724DC6A3B46CC83EF1927B"><enum>(1)</enum><text display-inline="yes-display-inline">the Compact of Free Association between the
				Government of the United States of America and the Governments of the Marshall
				Islands and the Federated States of Micronesia (48 U.S.C. 1901 note);
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE2926827152A4A37A3EE53D1CA9BB3CE"><enum>(2)</enum><text display-inline="yes-display-inline">the Compact of Free Association between the
				Government of the United States of America and the Government of Palau (48
				U.S.C. 1931 note).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCC4666795F9D4D7F81B04AE2EA0BBB5E"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">Subject to subsection (c), an individual
				who has been awarded compensation under this subtitle, and who has also
				received compensation benefits under the Compact of Free Association by reason
				of the same covered illness, shall receive the compensation awarded under this
				subtitle reduced by the amount of any compensation benefits received under the
				Compact of Free Association, other than medical benefits and benefits for
				vocational rehabilitation that the individual received by reason of the covered
				illness, after deducting the reasonable costs (as determined by the Secretary)
				of obtaining those benefits under the Compact of Free Association.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6c46a2dbb6b84e3a8a61cdc9a9a43775"><enum>(c)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Secretary may waive the application of
				subsection (b) if the Secretary determines that the administrative costs and
				burdens of applying subsection (b) to a particular case or class of cases
				justifies the
				waiver.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id11EDC5EF96CB4478829E16D39581C5EC" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Four atoll health care
			 program</header><text display-inline="no-display-inline">Section 103(h) of the
			 Compact of Free Association Amendments Act of 2003 (48 U.S.C. 1921b(h)) is
			 amended by adding at the end the following:</text>
			<quoted-block changed="deleted" committee-id="SSEG00" display-inline="no-display-inline" id="id8A4AB5E27C8441B4A1C156C1C4A7112F" reported-display-style="strikethrough" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="id8DC77DC8EF6F4BDBB2DF0094F74B375C"><enum>(4)</enum><header display-inline="yes-display-inline">Supplemental health care funding</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID19dfee20db3341418986bf52e11803a2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to amounts provided under
				section 211 of the U.S.–RMI Compact (48 U.S.C. 1921 note), the Secretary of the
				Interior shall annually use the amounts made available under subparagraph (B)
				to supplement health care in the communities affected by the nuclear testing
				program of the United States, including capital and operational support of
				outer island primary healthcare facilities of the Ministry of Health of the
				Republic of the Marshall Islands in the communities of—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID53177fd0b8d34e5eb7f05f98797ae48a"><enum>(i)</enum><text display-inline="yes-display-inline">Enewetak Atoll;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDd31fe2ceb1064119a455027b02ed7806"><enum>(ii)</enum><text display-inline="yes-display-inline">Kili (until the resettlement of
				Bikini);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID72df6306b15544c185c4bd6e45d1f273"><enum>(iii)</enum><text display-inline="yes-display-inline">Majetto Island in Kwajalein Atoll (until
				the resettlement of Rongelap Atoll); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID0efefd5a04d5468095643a74ac943e61"><enum>(iv)</enum><text display-inline="yes-display-inline">Utrik Atoll.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9085016adebe4fe4bfbbcbfb7b206975"><enum>(B)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">As authorized by section 105(c), there is
				appropriated to the Secretary of the Interior, out of funds in the Treasury not
				otherwise appropriated, to carry out this paragraph $2,000,000 for each of
				fiscal years 2012 through 2028, as adjusted for inflation in accordance with
				section 218 of the U.S.–FSM Compact and the U.S.–RMI Compact, to remain
				available until
				expended.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="ID0ca250eabe634d56b34ac86e9cfdcfbd" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Assessment of health care needs of the
			 Marshall Islands</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDff3a4c748a2241a7b68f7cb3902759f5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Interior shall enter
			 into an agreement with the National Academy of Sciences under which the
			 National Academy of Sciences shall conduct an assessment of the health impacts
			 of the United States nuclear testing program conducted in the Republic of the
			 Marshall Islands on the residents of the Republic of the Marshall
			 Islands.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf445ec6544d84854826bc6a4b6318b61"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">On completion of the assessment under
			 subsection (a), the National Academy of Sciences shall submit to Congress, the
			 Secretary, the Committee on Energy and Natural Resources of the Senate, and the
			 Committee on Natural Resources of the House of Representatives, a report on the
			 results of the assessment.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4e547153df554e4fac34825c5c843e87"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 section.</text>

				containment and groundwater monitoring</header><text>Effective beginning
				January 1, 2008, the Secretary of Energy shall, as a part of the Marshall
				Islands program conducted under subparagraph (A), periodically (but not less
				frequently than every 4 years) conduct—</text>
							<subclause id="ID92443d7eaacf4495afa309cb3ee32dd5"><enum>(I)</enum><text>a visual study of the
				concrete exterior of the Cactus Crater containment structure on Runit Island;
				and</text>
							</subclause><subclause id="ID1763362434334860803600554b79efa4"><enum>(II)</enum><text>a radiochemical analysis
				of the groundwater surrounding and in the Cactus Crater containment structure
				on Runit Island.</text>
							</subclause></clause><clause id="ID2b69595ef2ba441694dcb3c2de8f09f3"><enum>(ii)</enum><header>Report</header><text>The
				Secretary shall submit to the Committee on Energy and Natural Resources of the
				Senate, and the Committee on Natural Resources of the House of Representatives,
				a report that contains—</text>
							<subclause id="IDf0d38179c7194113a3a66a0d417e6039"><enum>(I)</enum><text>a description of—</text>
								<item id="ID8249fc865a4541a88cd494305899db1d"><enum>(aa)</enum><text>the results of each
				visual survey conducted under clause (i)(I); and</text>
								</item><item id="ID7be817fd2be143449bd74937a8011bf5"><enum>(bb)</enum><text>the results of the
				radiochemical analysis conducted under clause (i)(II); and</text>
								</item></subclause><subclause id="ID3482478968a34626bf3497ae8a05c757"><enum>(II)</enum><text>a determination on
				whether the surveys and analyses indicate any significant change in the health
				risks to the people of Enewetak from the contaminants within the Cactus Crater
				containment structure.</text>
							</subclause></clause><clause id="IDa634e60690934d5bbc77100964b01f4d"><enum>(iii)</enum><header>Funding for
				groundwater monitoring</header><text>The Secretary of the Interior shall make
				available to the Department of Energy, Marshall Islands Program, from funds
				available for the Technical Assistance Program of the Office of Insular
				Affairs, the amounts necessary to conduct the radiochemical analysis of
				groundwater under
				clause(i)(II).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="IDbab6dbab69eb491bb5a42d68c8d27f25" reported-display-style="italic"><enum>3.</enum><header>Clarification of
			 eligibility under Energy Employees Occupational Illness Compensation Program
			 Act of 2000</header>
			<subsection id="ID80e0f059448245a0b1efb14813b6ec7e"><enum>(a)</enum><header>Definitions for program
			 administration</header><text>Section 3621 of the Energy Employees Occupational
			 Illness Compensation Program Act of 2000 (42 U.S.C. 7384<added-phrase reported-display-style="italic">l</added-phrase>) is amended by adding at the
			 end the following:</text>

			 7385j–2) the following:</text>

				compensation under this title, and who has also received compensation benefits
				under the Compact of Free Association between the United States and the
				Republic of the Marshall Islands (48 U.S.C. 1681 et seq.) (referred to in this
				section as the <quote>Compact of Free Association</quote>), by reason of the
				same illness, shall receive the compensation awarded under this title reduced
				by the amount of any compensation benefits received under the Compact of Free
				Association, other than medical benefits and benefits for vocational
				rehabilitation that the individual received by reason of the illness, after
				deducting the reasonable costs (as determined by the Secretary) of obtaining
				those benefits under the Compact of Free
				Association.</text>

				primary health care, with an emphasis on providing regular screenings for
				radiogenic illnesses by upgrading existing services or by providing quarterly
				medical field team visits, as appropriate, in each of Enewetak, Bikini,
				Rongelap, Utrik, Ailuk, Mejit, Likiep, Wotho, Wotje, and Ujelang Atolls, which
				were affected by the nuclear testing program of the United States; and</text>
							</subclause><subclause changed="added" committee-id="SSEG00" id="idA73616192D1545678C1EECF188A59905" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>to enhance the
				capabilities of the Marshall Islands to provide secondary treatment for
				radiogenic illness; and</text>
							</subclause></clause><clause id="IDf7da09a5055e44108975ff4a184c922b"><enum>(ii)</enum><text>to construct and operate
				a whole-body counting facility on Utrik Atoll.</text>
						</clause></subparagraph><subparagraph id="ID1e5f4c9ac032468b828a173918692c55"><enum>(B)</enum><header>Conditions on health
				care grants</header><text>To ensure the effective use of grants funds under
				clause (i) of subparagraph (A), the Secretary of the Interior, after
				consultation with the Republic of the Marshall Islands, may establish
				additional conditions on the provision of grants under that clause.</text>
					</subparagraph><subparagraph id="IDb53ad55140584355b501edfedc03f790"><enum>(C)</enum><header>Memorandum of
				agreement</header><text>To meet the objectives of clause (ii) of subparagraph
				(A), the Secretary of the Interior, the Secretary of Energy, and the Government
				of the Republic of the Marshall Islands shall enter into a memorandum of
				agreement setting forth the terms, conditions, and respective responsibilities
				of the parties to the memorandum of agreement in carrying out that
				clause.</text>
					</subparagraph><subparagraph id="ID336bef702e364b96a6e4abcb1a9bd443"><enum>(D)</enum><header>Funding</header><text>As
				authorized by section 105(c), there is appropriated to the Secretary of the
				Interior, out of funds in the Treasury not otherwise appropriated, to carry out
				this paragraph $4,500,000 for each of fiscal years 2009 through 2023, as
				adjusted for inflation in accordance with section 218 of the U.S.–RMI Compact,
				to remain available until
				expended.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSEG00" id="ID167312b7205c4779aef8eee2ae68b157" reported-display-style="italic"><enum>5.</enum><header>Assessment of health
			 care needs of the Marshall Islands</header>
			<subsection id="IDfec6095211ee4ce5ba1832dd4d09ae34"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of the Interior shall enter into an
			 agreement with the National Academy of Sciences under which the National
			 Academy of Sciences shall conduct an assessment of the health impacts of the
			 United States nuclear testing program conducted in the Republic of the Marshall
			 Islands on the residents of the Republic of the Marshall Islands.</text>
			</subsection><subsection id="ID9e1a85d38af94c41a0cb1d7fff38a903"><enum>(b)</enum><header>Report</header><text>On
			 completion of the assessment under subsection (a), the National Academy of
			 Sciences shall submit to Congress, the Secretary, the Committee on Energy and
			 Natural Resources of the Senate, and the Committee on Natural Resources of the
			 House of Representatives, a report on the results of the assessment.</text>
			</subsection><subsection id="IDa659e0ba0ccd45c6addd85717f2e8d6c"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as are necessary to carry out this section.</text>
