		<official-title display="yes">To amend title XVIII of the Social Security
		  Act to provide for the application of a consistent Medicare part B premium for
		  all Medicare beneficiaries in a budget neutral manner for 2010, to provide an
		  additional round of economic recovery payments to certain beneficiaries, and to
		  assess the need for a consumer price index for elderly consumers to compute
		  cost-of-living increases for certain governmental benefits.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H20ACCB1F16764BC7A12FE9160EA5139B" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Economic Fairness for Seniors
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H6D0E8F29F50040E4AB627B65A0BD5ABD" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Medicare part B premium for
			 2010</header><text display-inline="no-display-inline">Section 1839 of the
			 Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r</external-xref>) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HF0DFFE5DFCDC462EAE9F4C6ECDCED45B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H1581BF34847F4B39948D5553AA792BB8" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H98808015D9B64B4DAA2294D22402F974" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The monthly premium under this subsection
				for 2010 shall be the monthly premium under this subsection for
				2009.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F3DD6A10D9B4D05865C251C818F7AE7"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (i)(3)(A), by adding after
			 and below clause (ii) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H559081F122E549B28620530AE2544FBE" style="OLC">
					<quoted-block-continuation-text commented="no" quoted-block-continuation-text-level="subparagraph">In applying clause (ii) for 2010,
				the monthly actuarial rate described in such clause shall be such monthly
				actuarial rate for
				2009.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id0C69AC05B2AD4847A47D257B318D1AB3" section-type="subsequent-section"><enum>3.</enum><header>Extension of certain
			 economic recovery payments</header>
			<subsection id="idD52142BE2F9949D9A0C3231164A2FF87"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2201 of the
			 American Recovery and Reinvestment Tax Act of 2009 is amended—</text>
				<paragraph id="id6DE9281E8B814B0C9DBB84F6C5481D59"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>in each of calendar
			 years 2009 and 2010</quote> after <quote>the Secretary of the Treasury shall
			 disburse</quote> in subsection (a)(1)(A);</text>
				</paragraph><paragraph id="id42CC91E2A4434B618C3F4B8E10EA9354"><enum>(2)</enum><text>by inserting
			 <quote>(for purposes of payments made for calendar year 2009), or the 3-month
			 period ending with the month which ends prior to the month that includes the
			 date of the enactment of the <short-title>Economic
			 Fairness for Seniors Act</short-title> (for purposes of payments made for
			 calendar year 2010)</quote> after <quote>the month that includes the date of
			 the enactment of this Act</quote> in subsection (a)(1)(A);</text>
				</paragraph><paragraph id="id5317C20BBD584B01AB89A7997639D776"><enum>(3)</enum><text>by inserting
			 <quote>(for purposes of payments made under this paragraph for calendar year
			 2009), or the 3 month period ending with the month which ends prior to the
			 month that includes the date of the enactment of the
			 <short-title>Economic Fairness for Seniors
			 Act</short-title> (for purposes of payments made under this paragraph for
			 calendar year 2010)</quote> after <quote>the month that includes the date of
			 the enactment of this Act</quote> in subsection (a)(1)(B)(iii);</text>
				</paragraph><paragraph id="id6DDCF08DA463442A99B36C9AE9E8ECC1"><enum>(4)</enum><text>by inserting
			 <quote>for any calendar year</quote> after <quote>1 payment under this
			 section</quote> in subsection (a)(3);</text>
				</paragraph><paragraph id="idF435EBF49FB840F196C1898C7E790CEF"><enum>(5)</enum><text>by inserting
			 <quote>An individual who is entitled to, or eligible for, a benefit or cash
			 payment described in paragraph (1) in both of the 3-month periods described in
			 paragraph (1)(A) shall be paid a payment under this section in each of calendar
			 years 2009 and 2010.</quote> at the end of paragraph (3) of subsection
			 (a);</text>
				</paragraph><paragraph id="idC73808E3707645D9AA0BB6CBE56A1571"><enum>(6)</enum><text>by inserting
			 <quote><header-in-text level="paragraph" style="OLC">in same
			 year</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">No double payments</header-in-text></quote> in the heading of
			 paragraph (3) of subsection (a);</text>
				</paragraph><paragraph id="id6C97AACECC224524B72453F8E9E1B1A6"><enum>(7)</enum><text>by inserting
			 <quote>applicable</quote> before <quote>3-month period</quote> in subsection
			 (a)(4)(A);</text>
				</paragraph><paragraph id="idB5BF410998624F7CB046F1B44021B6F7"><enum>(8)</enum><text>by inserting
			 <quote>applicable</quote> before <quote>3 month period</quote> in subsection
			 (a)(4)(B);</text>
				</paragraph><paragraph id="idC78E0A75CE3B4ADF9BA1AADDEE38D363"><enum>(9)</enum><text>by inserting
			 <quote>for purposes of payments made for calendar year 2009, or after December
			 31, 2011, for purposes of payments made for calendar year 2010,</quote> after

			 <quote>2011</quote> in subsection (e) and inserting <quote>2012</quote>;</text>

			 <quote>$90,000,000</quote> in subsection (e)(2)(B) and inserting
			 <quote>$135,000,000</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD2DFAE1D1358492AB44E6EDB9C37CA1F"><enum>(12)</enum><text>by striking
			 <quote>$1,400,000</quote> in subsection (e)(3)(B) and inserting
			 <quote>$2,100,000</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E6B6F224C004EE3938B91D132C46531"><enum>(13)</enum><text>by striking
			 <quote>$100,000</quote> in subsection (e)(4)(A)(ii) and inserting
			 <quote>$150,000</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id205ECEAF5B1E4743AA7BF47D144329F7"><enum>(14)</enum><text>by striking
			 <quote>$7,100,000</quote> in subsection (e)(4)(A)(ii) and inserting
			 <quote>$10,650,000</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id688A4C80282047F595169EEBECC17596"><enum>(b)</enum><header>Extension of
			 special credit for certain government retirees</header><text display-inline="yes-display-inline">In the case of an eligible individual (as
			 defined in section 2202(b) of the American Recovery and Reinvestment Tax Act of
			 2009, applied by substituting <quote>2010</quote> for <quote>2009</quote>),
			 with respect to the first taxable year of such individual beginning in 2010,
			 section 2202 of the American Recovery and Reinvestment Tax Act of 2009 shall be
			 applied by substituting <quote>2010</quote> for <quote>2009</quote> each place
			 it appears.</text>
			</subsection></section><section id="id2D8FECF3595047BFB9565A4409672986"><enum>4.</enum><header>Consumer Price
			 Index for elderly consumers</header>
			<subsection id="id207ED6FE99CF46D3B7A565C7F51A141A"><enum>(a)</enum><header>Study</header><text>The
			 Bureau of Labor Statistics of the Department of Labor shall study whether a
			 consumer price index for elderly consumers (CPI–E) more accurately reflects the
			 true costs of inflation for elderly Americans than the Consumer Price Index for
			 Urban Wage Earners and Clerical Workers (CPI–W) and if the elderly are being
			 financially disadvantaged by the use of the CPI–W in the determination of
			 current benefit levels and, if so, shall prepare such a CPI–E.</text>
			</subsection><subsection id="idE8A232958273489B93EBF2AEAFCA654A"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Bureau of
			 Labor Statistics of the Department of Labor shall report to Congress the
			 results of the study required under subsection (a) and, if appropriate, the
			 creation of a consumer price index for elderly consumers that more accurately
			 reflects the true cost of inflation for the elderly.</text>
			</subsection></section><section id="id87E6F9BF71F545B9950A0216F97956D4"><enum>5.</enum><header>Offset through
			 reduction in TARP funds</header><text display-inline="no-display-inline">Paragraph (3) of section 115(a) of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5225) is amended by
			 striking <quote>$1,259,000,000</quote> and inserting
			 <quote>$39,259,000,000</quote>.</text>
