		<official-title>To make improvements to certain loan programs under the
		  Small Business Act and the Small Business Investment Act of 1958, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Helping Small Business Succeed Act
			 of 2009</short-title></quote>.</text>
		</section><section id="id859F0BD6BC194A9B9E1380350BD528B8"><enum>2.</enum><header>Maximum loan
			 amounts under 7<enum-in-header>(a)</enum-in-header> program</header><text display-inline="no-display-inline">Section 7(a)(3)(A) of the Small Business Act
			 (15 U.S.C. 636(a)(3)(A)) is amended by striking <quote>$1,500,000 (or if the
			 gross loan amount would exceed $2,000,000</quote> and inserting
			 <quote>$4,875,000 (or if the gross loan amount would exceed
			 $5,000,000</quote>.</text>
		</section><section id="id01C696B14E9841D8A2DC28BCBCB20EBB"><enum>3.</enum><header>Maximum loan
			 amounts under 504 program</header><text display-inline="no-display-inline">Section 502(2)(A) of the Small Business
			 Investment Act of 1958 (15 U.S.C. 696(2)(A)) is amended—</text>
			<paragraph id="idF759E346C9324FECA7B487357A077353"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking
			 <quote>$1,500,000</quote> and inserting <quote>$4,000,000</quote>;</text>
			</paragraph><paragraph id="id3C72C7A0D93B445B88FEC8F4D6B8C411"><enum>(2)</enum><text>in clause (ii),
			 by striking <quote>$2,000,000</quote> and inserting
			 <quote>$5,000,000</quote>;</text>
			</paragraph><paragraph id="id2EA89A4CE5F8400AAB56E48780DBCF88"><enum>(3)</enum><text>in clause (iii),
			 by striking <quote>$4,000,000</quote> and inserting
			 <quote>$5,500,000</quote>;</text>
			</paragraph><paragraph id="ID71947a710a514bd5a80ba15a0ee90869"><enum>(4)</enum><text>in clause (iv),
			 by striking <quote>$4,000,000</quote> and inserting <quote>$5,500,000</quote>;
			 and</text>

			 striking <quote>$4,000,000</quote> and inserting

			</paragraph></section><section id="idC2C46E26A65F48F7A92172C7CC2859FF"><enum>4.</enum><header>Maximum loan
			 limits under microloan program</header><text display-inline="no-display-inline">Section 7(m) of the Small Business Act (15
			 U.S.C. 636(m)) is amended—</text>
			<paragraph id="id4D5581257B744A929B004CC1340F0DE5"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(iii), by striking
			 <quote>$35,000</quote> and inserting <quote>$50,000</quote>;</text>
			</paragraph><paragraph id="id266BB2655C4D401C93C03A063D71D725"><enum>(2)</enum><text>in paragraph
			 (3)(E), by striking <quote>$35,000</quote> each place that term appears and
			 inserting <quote>$50,000</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE3D30B0546ED42F5AABE37E561D06D61"><enum>(3)</enum><text>in paragraph
			 (11)(B), by striking <quote>$35,000</quote> and inserting
			 <quote>$50,000</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id78F5AB4D01DB4B70AC47CFC2E48B0BFB"><enum>5.</enum><header>Maximum loan
			 guarantee under 7<enum-in-header>(a)</enum-in-header> program</header>
			<subsection commented="no" display-inline="no-display-inline" id="idCDF332C946B84D82A367A1EADDA25EA3"><enum>(a)</enum><header>In
			 general</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id276C5FB52B1D4E5CB75A258697711F9B"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 7(a)(2)(A) of the Small Business
			 Act (15 U.S.C. 636(a)(2)(A)) is amended by striking <quote>equal to—</quote>
			 and all that follows and inserting <quote>equal to 97.5 percent of the amount
			 of the loan.</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84CB69C5218A44D3A6CA131B2B1B181A"><enum>(2)</enum><header>Prospective
			 repeal</header><text>Effective October 3, 2011, section 7(a)(2)(A) of the Small
			 Business Act (15 U.S.C. 636(a)(2)(A)) is amended by striking <quote>equal to
			 97.5 percent of the amount of the loan.</quote> and inserting “equal to—</text>
					<quoted-block display-inline="no-display-inline" id="id75F46EB8664348FEACC4190B5D014FB7" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="idE930879D25CB4AC897709035D42CFC06"><enum>(i)</enum><text>75 percent of the
				balance of the financing outstanding at the time of disbursement of the loan,
				if such balance exceeds $150,000; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9FA3A676D40143AE94ADD5A69EFDAC1E"><enum>(ii)</enum><text>85 percent of
				the balance of the financing outstanding at the time of disbursement of the
				loan, if such balance is less than or equal to
				$150,000.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id61D034074F4447E9AA9658A4B93CEA8A"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 502(a) of
			 title V of division A of the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–5; 123 Stat. 152) is amended by striking <quote>90
			 percent</quote> and inserting <quote>97.5 percent</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id317E7A5F752A4FD19D9C9891FAD5616D"><enum>6.</enum><header>Extension of fee
			 reductions</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0FB8DF211DCA4810933119DEF5229C18"><enum>(a)</enum><header>Extension of
			 fee reductions</header><text display-inline="yes-display-inline">Section 501 of
			 title V of division A of the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–5; 123 Stat. 151) is amended by striking <quote>September 30,
			 2010</quote> each place that term appears and inserting <quote>October 3,
			 2011</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0C167A87805A4E849A17AB72BF9E8BD5"><enum>(b)</enum><header>Availability of
			 funds</header><text>The matter under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Business loans program
			 account</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-major" style="OLC">Small Business Administration</header-in-text></quote> in title V
			 of division A of the American Recovery and Reinvestment Act of 2009 (Public Law
			 111–5; 123 Stat. 151) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id668406B3350545A79198DA4CE8F32561"><enum>(1)</enum><text>by striking
			 <quote>to remain available until September 30, 2010</quote> the second place it
			 appears;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1CE51B6191824FC4B0D747786F9EDF2C"><enum>(2)</enum><text>by inserting
			 <quote>and shall remain available until October 3, 2011</quote> after
			 <quote>section 501 of this title</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8C1F23A1016482C9272643A321A9BA7"><enum>(3)</enum><text>by inserting
			 <quote>and shall remain available until September 30, 2010</quote> after
			 <quote>section 506 of this title</quote>.</text>
				</paragraph></subsection></section><section id="idB5AA76306644473B95AE7D37D5971372"><enum>7.</enum><header>Economic
			 disaster loans</header>
			<subsection id="id9F66F875879546F1BB958D4B582A383D"><enum>(a)</enum><header>Authority To
			 make loans</header><text display-inline="yes-display-inline">The Administrator
			 of the Small Business Administration may make a loan to a small business
			 concern (as defined under section 3 of the Small Business Act (15 U.S.C. 632))
			 that is located in an economic disaster area under the same terms and
			 conditions and for the same purposes as a loan under section 7(b)(2) of the
			 Small Business Act (15 U.S.C. 636(b)(2)).</text>
			</subsection><subsection id="id32E0C21A13E84947AE678E79641CF7B8"><enum>(b)</enum><header>Economic
			 disaster area</header><text>For purposes of this section, the term
			 <term>economic disaster area</term> means a geographic area that the
			 Administrator of the Small Business Administration determines has—</text>
				<paragraph id="idE213DA5DF08C4CF282D41D8E4A76A084"><enum>(1)</enum><text>a per capital
			 income of not more than 80 percent of the average per capita income in the
			 United States, based on the most recent available data from the Bureau of Labor
			 Statistics of the Department of Labor;</text>
				</paragraph><paragraph id="id6CE0559DF88D45FDBC4BE4D0F26902F9"><enum>(2)</enum><text>an average
			 unemployment rate that is not less than 1 percentage point greater than the
			 average unemployment rate in the United States, during the most recent 24-month
			 period for which data from the Bureau of Labor Statistics of the Department of
			 Labor are available; and</text>
				</paragraph><paragraph id="id5AAC73FF69794576A5935B6FED49051F"><enum>(3)</enum><text>a special
			 need.</text>
				</paragraph></subsection><subsection id="idFF748FAA06974B948A2E2A90DD84CE08"><enum>(c)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authority of the Administrator of the
			 Small Business Administration to make a loan under subsection (a) shall
			 terminate on October 3, 2011.</text>
			</subsection></section><section id="idB1F06B5B157746A0B806E051CDC10666"><enum>8.</enum><header>Funding</header>
			<subsection id="id2B1C784E7DAB42FDA962F9B6F000D2DD"><enum>(a)</enum><header>Revenue from
			 sale of troubled assets and warrants</header><text display-inline="yes-display-inline">Section 106(d) of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5216(d)) is amended—</text>
				<paragraph id="idF5299A08CC6F49EF8F09015E240B3E19"><enum>(1)</enum><text>by striking
			 <quote>Revenues of</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id77D73C3CF59944429A8EE0C8C93BBC8A" style="OLC">
						<paragraph id="id70D017886BFD4795971E176460E194AB"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), revenues
				of</text>
						</paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id79E9057649E145BE8FB83C73D5451105"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id81805DE1CC9741FAB62DA7A2A01610FF" style="OLC">
						<paragraph id="idA0FF67A939124B5381B28AE83DFCA3B6"><enum>(2)</enum><header>Transfer to
				Small Business Administration</header><text>From amounts received under
				paragraph (1), the Secretary shall transfer to the Administrator of the Small
				Business Administration such amounts as are necessary to carry out the
				<short-title>Helping Small Business Succeed Act of
				2009</short-title> and the amendments made by that
				Act.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id98FB3092AB3E4DFA8DF63EA5FED604B5"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>In addition to any amounts transferred to the
			 Administrator of the Small Business Administration under section 106(d) of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5216(d)), as amended by
			 this Act, there are authorized to be appropriated such sums as may be necessary
			 to carry out this Act and the amendments made by this Act.</text>
