		<official-title>To require lenders of loans with Federal guarantees or
		  Federal insurance to consent to mandatory mediation.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Foreclosure Mandatory Mediation
			 Act of 2009</short-title></quote>.</text>
		</section><section id="id70094AADD6C441A489DDB5E5D728F056"><enum>2.</enum><header>Mandatory
			 mediation</header><text display-inline="no-display-inline">Title I of the
			 Helping Families Save Their Homes Act of 2009 (Public Law 111–22; 12 U.S.C.
			 5201 note) is amended by adding at the end the following:</text>

				<section id="id45E63885D3554C56876023B1F8AE2EF5"><enum>106.</enum><header>Mandatory
				mediation</header>
					<subsection id="id90E2422F6EA24B5C8DA2182AC9316455"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, before a
				qualified mortgagee may initiate a foreclosure proceeding or a sheriff sale,
				the qualified mortgagee shall conduct, consistent with any applicable State or
				local requirements, a one-time mediation with the affected mortgagor and a
				housing counseling agency, at the expense of the qualified mortgagee.</text>
					</subsection><subsection id="id2E9D798736AD485D928232A5BB7BDD37"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
						<paragraph id="id2D0FB0D24C0045319A8BB1B1C3E2C370"><enum>(1)</enum><text>the term
				<term>housing counseling agency</term> means—</text>
							<subparagraph id="id244228CA6A644304AD20D309F90EC445"><enum>(A)</enum><text>a housing
				counseling agency certified by the Secretary under section 106(e) of the
				Housing and Urban Development Act of 1968 (12 U.S.C. 1701x(e)); or</text>
							</subparagraph><subparagraph id="id0499FB3FE54D4C81A66B870685DBDD6C"><enum>(B)</enum><text>a neighborhood
				housing services program established by the Neighborhood Reinvestment
				Corporation under section 606 of the Housing and Community Development
				Amendments of 1978 (42 U.S.C. 8105); and</text>
							</subparagraph></paragraph><paragraph id="id18C98E450D28406AB90769491069DB94"><enum>(2)</enum><text>the term
				<term>qualified mortgagee</term> means an entity—</text>
							<subparagraph id="idECD39C2B3F484A1ABDED9FCEFB4562CE"><enum>(A)</enum><text>that makes a
				mortgage loan for, or holds a note secured by, a one- to four-family residence
				that is—</text>
								<clause commented="no" display-inline="no-display-inline" id="id52F05C72868F41169A6910EE6E1DF256"><enum>(i)</enum><text display-inline="yes-display-inline">insured under title II of the National
				Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12
				U.S.C. 1707 et seq.</external-xref>);</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id78974014637F4F01AA4C9D15A9C93607"><enum>(ii)</enum><text display-inline="yes-display-inline">guaranteed, insured, or made under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38,
				United States Code;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idE9E01CD96E0746689D69EE2EDA77D496"><enum>(iii)</enum><text display-inline="yes-display-inline">made, guaranteed, or insured under title V
				of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471 et seq.</external-xref>); or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id321A812378784F29930361DEE108F330"><enum>(iv)</enum><text display-inline="yes-display-inline">eligible for purchase by the Federal
				National Mortgage Association or the Federal Home Loan Mortgage Corporation;
				or</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFDA9994494F430897EB995A103581ED"><enum>(B)</enum><text display-inline="yes-display-inline">that is acting, or otherwise authorized to
				act, as the mortgagee of record for a lender, including any entity, such as the
				Mortgage Electronic Registration Systems or MERS, acting as a nominee for a
				lender in any suit brought against a
				mortgagor.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
