			 <quote><short-title>Federal Land Avalanche Protection Act
			 of 2009</short-title></quote>.</text>
		</section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="H70A56561D907411A9212E000466B80D5" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H13570564771B49B68F111B26C078F026"><enum>(1)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
			 avalanche protection program established under section 3(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDE1C82610644B76897B8B5CA8B868F9"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Agriculture.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="H3B571D8D5BF4405291C2122F90246E90" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>Avalanche protection
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="HD68EB1B5D9B24AA7B94B8DB9D1AA82BB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, acting through the Chief of
			 the Forest Service, shall establish a coordinated avalanche protection program
			 to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H6797A1FE8AF948AAABEFD09515D50069"><enum>(1)</enum><text display-inline="yes-display-inline">identify the potential for avalanches on
			 Federal lands and inform the public, including users of those lands and other
			 potentially affected parties, about the probability of such avalanches and
			 their potential adverse effects on neighboring communities and on
			 transportation and utility corridors;</text>
				</paragraph><paragraph id="HDA229F41223E4A40AFC94B00A24FEC8E"><enum>(2)</enum><text>carry out ongoing
			 research regarding the causes of avalanche development, so as to improve
			 forecasting of avalanche events; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC092B9708701485DB000B003334F8079"><enum>(3)</enum><text display-inline="yes-display-inline">reduce the risks of avalanches on Federal
			 lands and mitigate their effects on users of those lands, neighboring
			 communities, and transportation and utility corridors.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF4EE8395B1B248F3AF009D004C6BE93D"><enum>(b)</enum><header>Coordination</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HC437FD41FA01470CB352C7B7698F3555"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In developing and
			 implementing the program, the Secretary shall consult with the Secretary of the
			 Interior, and coordinate the program to ensure adequate levels of protection
			 for recreational users of public land under the jurisdiction of such
			 Secretary.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7E51B71EC72B474A824B0185BE39C650"><enum>(2)</enum><header>Resources</header><text display-inline="yes-display-inline">In carrying out this section, the
			 Secretary—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H12D8E64123A1447F8708B24C4100E17C"><enum>(A)</enum><text display-inline="yes-display-inline">shall, to the maximum extent practicable,
			 use the resources of the National Avalanche Center of the Forest Service;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H00A8F5A4D3C7459295722E146EE433FE"><enum>(B)</enum><text display-inline="yes-display-inline">may use such other resources as the
			 Secretary has available in the development and implementation of the
			 program.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8672B575587D4A5A8D00106724F79755"><enum>(c)</enum><header>Advisory
			 Committee</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H450D68280A6B431DA9BF3161E15EC542"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 establish an advisory committee of 15 members, appointed by the Secretary, to
			 assist in the development and implementation of the program.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HADF9650F8C5B4CCABDEC00C429D3339"><enum>(2)</enum><header>Membership</header><text>The
			 membership of the advisory committee established pursuant to paragraph (1)
			 shall include representatives of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H51514E05E748413C93AEBC8360BC8663"><enum>(A)</enum><text display-inline="yes-display-inline">Federal land management agencies and
			 concessionaires or permittees that are exposed to the threat of
			 avalanches;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48A14E1F663440CEBB4B6BEE4FD3FD4D"><enum>(B)</enum><text display-inline="yes-display-inline">State departments of transportation that
			 have experience in dealing with the effects of avalanches;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD346764D844463296B712DDA4518174"><enum>(C)</enum><text>the Alaska
			 railroad;</text>
					</subparagraph><subparagraph id="H907683E7A5FC4664A7E2A4876BA96E5F"><enum>(D)</enum><text>the United States
			 Geological Survey;</text>
					</subparagraph><subparagraph id="H8FE93A848FDF44E79833F4BDFFC47413"><enum>(E)</enum><text display-inline="yes-display-inline">the National Oceanic and Atmospheric
			 Administration;</text>
					</subparagraph><subparagraph id="H811B033162E24F1DA37E393C8190DDD9"><enum>(F)</enum><text display-inline="yes-display-inline">the National Weather Service;</text>
					</subparagraph><subparagraph id="H42E4BC230A24451E009922AEB18BEC84"><enum>(G)</enum><text display-inline="yes-display-inline">entities with interest in the program that
			 the Secretary considers appropriate for representation on the board;</text>
					</subparagraph><subparagraph id="H75762CF255FC44648803C23D3172C23"><enum>(H)</enum><text display-inline="yes-display-inline">authorized users of artillery, other
			 military weapons, or weapons alternatives used for avalanche control;
			 and</text>
					</subparagraph><subparagraph id="H17317968E3054AAA93C25B6B66DC59B"><enum>(I)</enum><text display-inline="yes-display-inline">such other members as the Secretary
			 considers appropriate.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1E189200C0A64C62824DD87FAB84EA73"><enum>(d)</enum><header>Central
			 depository</header><text display-inline="yes-display-inline">The Secretary, the
			 Secretary of Transportation, and the Secretary of the Army shall establish a
			 central depository for weapons, ammunition, and parts for avalanche control
			 purposes, including an inventory that can be made available to Federal and
			 non-Federal entities for avalanche control purposes under the program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4EFABE9F629A4D9AA3BF1B3E18F58910"><enum>(e)</enum><header>Grants</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2FED8B227B8B41788D3C259908E05D8"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 make grants to carry out projects and activities under the program—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H6EFB28B25CD4459C8056501C78DC9D7D"><enum>(A)</enum><text display-inline="yes-display-inline">to assist in the prevention, forecasting,
			 detection, and mitigation of avalanches for the safety and protection of
			 persons, property, and at-risk communities;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB655239ECA18475F979774D145C24931"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain essential transportation,
			 utilities, and communications affected or potentially affected by
			 avalanches;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFBC5283B721A463486E6A3A360DA2FEC"><enum>(C)</enum><text display-inline="yes-display-inline">to assist avalanche artillery users to
			 ensure the availability of adequate supplies of artillery and other unique
			 explosives required for avalanche control in or affecting—</text>
						<clause commented="no" display-inline="no-display-inline" id="HA6D1A112DF344E83A085A00B136CA80"><enum>(i)</enum><text display-inline="yes-display-inline">Federal land used for recreation purposes;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H6A50C939A6B34195B2DAA54E5F24BC5"><enum>(ii)</enum><text display-inline="yes-display-inline">adjacent communities, and essential
			 transportation corridors, that are at risk of avalanches; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDDE582BB85104C0FA2423000787B93B9"><enum>(D)</enum><text display-inline="yes-display-inline">to assist public or private persons and
			 entities in public education regarding avalanches and in conducting research
			 and development activities for cost-effective and reliable alternatives to
			 minimize reliance on military weapons for avalanche control.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB1F897050C54CA4835FBEB7E209C4BC"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">For each fiscal year for which funds are
			 made available under section 4, the Secretary shall give priority to projects
			 and activities carried out in avalanche zones—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H8259ADF2CEC544649EFFA3CD3C287AC"><enum>(A)</enum><text display-inline="yes-display-inline">with a high frequency or severity of
			 avalanches; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E83951A209A4ACB94D6FBA59FF3C934"><enum>(B)</enum><text display-inline="yes-display-inline">in which deaths or serious injuries to
			 individuals, or loss or damage to public facilities and communities, have
			 occurred or are likely to occur.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8854D57378AB4D9F9D13AAB5FE589646"><enum>(f)</enum><header>Surplus
			 ordinance</header><text display-inline="yes-display-inline">Section 549(c)(3)
			 of title 40, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE440E45146F74C31B83F8039C6FC900"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>or</quote> after the semicolon at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2E04EEB12F084A6F8D003C67C9FBDD39"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period
			 at the end and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1807500BBFBC4B5383738F922C9B8778"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block changed="deleted" committee-id="SSEG00" display-inline="no-display-inline" id="H67A16AC296B341BF8E722953E5592F75" reported-display-style="strikethrough" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="HFE5E75BF2289416C8FD502AD65EA4749"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of surplus artillery ordinance
				that is suitable for avalanche control purposes, to a user of such
				ordinance.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="HAF252D2AE58445AFA465CE6F8C00BF04" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to carry out this Act $4,000,000 for each of
			 fiscal years 2010 through 2014.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="HCDA2B5EC534645ACBB9C01FC8CDA9548" reported-display-style="strikethrough"><enum>5.</enum><header>Limitation</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 require use of artillery or any other avalanche-related actions affecting any
			 unit of the National Park System or any other Federal lands or to limit the
			 applicability of any Federal law or regulation with respect to any such actions
			 on such lands.</text>

		<section changed="added" committee-id="SSEG00" id="id530C78D1C0DC40A381B0E5B895F82A4E" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Land Avalanche Protection Act
			 of 2010</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="ID70970d970e6a4723a1458c58c1fc1820" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID84db67d7a55a44d5b7e846df888fdf42"><enum>(1)</enum><header>Committee</header><text>The
			 term <term>Committee</term> means the Avalanche Artillery Users of North
			 America Committee.</text>
			</paragraph><paragraph id="ID7dd5737f34e54267825f59f2465dfab7"><enum>(2)</enum><header>Program</header><text>The
			 term <term>program</term> means the avalanche protection program established
			 under section 3(a).</text>
			</paragraph><paragraph id="ID1b21a1a61042480a924823e92cad833b"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture, acting through
			 the Chief of the Forest Service.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="ID0c94e1738dc8401a9868dfd62bdeb599" reported-display-style="italic"><enum>3.</enum><header>Avalanche protection
			 program</header>
			<subsection id="IDc839f481f49b4329b9eca6d88bc26d1c"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall establish an avalanche protection program to provide
			 information and assistance to users of avalanche-prone National Forest System
			 land.</text>
			</subsection><subsection id="ID8d20bb72af1148fbb46ce9df205fac67"><enum>(b)</enum><header>Objectives</header><text>The
			 objectives of the program include—</text>
				<paragraph id="IDe59e5ea1b2d84debbcc5e37b8dfc170b"><enum>(1)</enum><text>to inform and educate the
			 public about the risks posed by avalanches to reduce the potential for injury,
			 death, or property damage;</text>
				</paragraph><paragraph id="ID118b577444944bb0a2d561d49b56a52b"><enum>(2)</enum><text>to provide avalanche
			 forecasts for avalanche-prone areas of the National Forest System that are
			 frequented by recreational or other users;</text>
				</paragraph><paragraph id="ID9576ace3768342f29bf8562169f69503"><enum>(3)</enum><text>to provide oversight of
			 activities relating to the prevention and control of avalanches by ski area and
			 other special use permit holders on National Forest System land, including the
			 procurement, control, and use of artillery; and</text>
				</paragraph><paragraph id="ID6d66f1d9ebdf448b8226f9ef406aac18"><enum>(4)</enum><text>to facilitate research on
			 the objectives of the program, including research on the development of
			 alternatives to military artillery.</text>
				</paragraph></subsection><subsection id="IDf1007e135a1c4e18a98e464b9d5cc7a7"><enum>(c)</enum><header>Coordination</header><text>In
			 carrying out this section, the Secretary shall—</text>
				<paragraph id="IDb5a4586272a14ebcaa4f8855f7c26311"><enum>(1)</enum><text>use the resources
			 of—</text>
					<subparagraph id="ID57251b25fffe47fca998a7485fe0e385"><enum>(A)</enum><text>the National Avalanche
			 Center of the Forest Service; and</text>
					</subparagraph><subparagraph id="ID3de90f1b4b424c13a3ff6645598be783"><enum>(B)</enum><text>other partners;
			 and</text>
					</subparagraph></paragraph><paragraph id="ID112591cf01be4a23ade9bce3faee5f0c"><enum>(2)</enum><text>work with the Committee
			 and other partners to improve—</text>
					<subparagraph id="IDa027d9a3a54d474d8c946ab3ada67c45"><enum>(A)</enum><text>coordination among users
			 of artillery used to prevent and control avalanches; and</text>
					</subparagraph><subparagraph id="ID12e0b9e7c0a4430899466e291d4ab7df"><enum>(B)</enum><text>access to, and the
			 control and use of, artillery and other methods to prevent and control
			 avalanches.</text>
					</subparagraph></paragraph></subsection><subsection id="IDaf122ce3c60042db9f28a16066ab6d29"><enum>(d)</enum><header>Grants</header>
				<paragraph id="ID1b7fff7705ff4c0aade4007ea442c47b"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may make grants to any person to further
			 the objectives of the program.</text>
				</paragraph><paragraph id="ID7e3510f757d449d4b92d6af60c03dc82"><enum>(2)</enum><header>Priority</header><text>The
			 Secretary shall give priority to grants under paragraph (1) that enhance public
			 safety.</text>
				</paragraph><paragraph id="ID7c4c18b645be443c9a1685a76afecf1a"><enum>(3)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this subsection $4,000,000 for each of fiscal years 2010 through
			 2014.</text>
