		<section commented="no" display-inline="no-display-inline" id="id5DC7B4279F644F5DA4A919CB5FF9E18A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Acquisition Institute Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id75825FE17B07482DB0C386D96F30B51D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Acquisition workforce improvements</header>
			<subsection commented="no" display-inline="no-display-inline" id="idA59DF1349F4B42F7BB10483059BABDBF"><enum>(a)</enum><header display-inline="yes-display-inline">Workforce improvements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idF63B423E284A45E088C57B5A6285722E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 855 of the National Defense
			 Authorization Act for Fiscal Year 2008 (41 U.S.C. 433a) is transferred so as to
			 appear after section 37 of the Office of Federal Procurement Policy Act (41
			 U.S.C. 433), redesignated as section 37A of the Office of Federal Procurement
			 Policy Act, and amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id85AD176119044F53A7B7E94B132EA741"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
						<clause commented="no" display-inline="no-display-inline" id="idBCE7CE2B067844AC9BD9F9ABC12242D0"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting after the first sentence the
			 following: <quote>The Associate Administrator shall be chosen on the basis of
			 demonstrated knowledge and expertise in acquisition, human capital, and
			 management.</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9C30E9ED062F4817A6D5E51A1821942E"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>The Associate
			 Administrator for Acquisition Workforce Programs shall be located in the
			 Federal Acquisition Institute (or its successor).</quote> and inserting
			 <quote>The Associate Administrator shall be located in the Office of Federal
			 Procurement Policy.</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2F5F7C8926474015BB28A8804A39FDA0"><enum>(iii)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as
			 subparagraph (6);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id6F2699513EAC46549D23ED9C647FE565"><enum>(iv)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>;
			 and</quote> and inserting a semicolon; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF67E573815FD4541AD198405650753FA"><enum>(v)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the
			 following new paragraph:</text>
							<quoted-block act-name="" display-inline="no-display-inline" id="id8E6DF6745F1442888A7FAB8E3949DEAA" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="id70FB3DE77CC6460D873D5FE5D418E6DC"><enum>(5)</enum><text display-inline="yes-display-inline">implementing workforce programs under
				subsections (f) through (i) of section 37;
				and</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC0C5DD21C45494FAED6166B328AEC94"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsection (h) and inserting
			 the following new subsections:</text>
						<quoted-block act-name="" display-inline="no-display-inline" id="id9D4DC6BAB74F43F48098F4060C606029" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id24A2FA005647496D916B531A5CB6C5E3"><enum>(h)</enum><header display-inline="yes-display-inline">Federal acquisition Institute</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id2A0D8AD16E384236A92F6261A2AB0AA0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established a Federal Acquisition
				Institute (FAI) in order to—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID3B6C076FC62C423EA7AFCD4B34A5AA08"><enum>(A)</enum><text display-inline="yes-display-inline">foster and promote the development of a
				professional acquisition workforce Government-wide;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFBE7C1CA21C24FA2B4AEEDBC576339D5"><enum>(B)</enum><text display-inline="yes-display-inline">promote and coordinate Government-wide
				research and studies to improve the procurement process and the laws, policies,
				methods, regulations, procedures, and forms relating to acquisition by the
				executive agencies;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID59AD2DCCD5D24CB4A624ADF9320D19F3"><enum>(C)</enum><text display-inline="yes-display-inline">collect data and analyze acquisition
				workforce data from the Office of Personnel Management, the heads of executive
				agencies, and, through periodic surveys, from individual employees;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC014A9C5DB774008B59DF8BB9D9C70CC"><enum>(D)</enum><text display-inline="yes-display-inline">periodically analyze acquisition career
				fields to identify critical competencies, duties, tasks, and related academic
				prerequisites, skills, and knowledge;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID83DC43598403474786AEC466E3F24817"><enum>(E)</enum><text display-inline="yes-display-inline">coordinate and assist agencies in
				identifying and recruiting highly qualified candidates for acquisition
				fields;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID65173A1EBD1E4034B7544047BEDDEE43"><enum>(F)</enum><text display-inline="yes-display-inline">develop instructional materials for
				acquisition personnel in coordination with private and public acquisition
				colleges and training facilities;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6B97BC7951B340518AA4B65727E59AA9"><enum>(G)</enum><text display-inline="yes-display-inline">evaluate the effectiveness of training and
				career development programs for acquisition personnel;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1D99C0A1D0FB4EF1994B917C6B28EF6B"><enum>(H)</enum><text display-inline="yes-display-inline">promote the establishment and utilization
				of academic programs by colleges and universities in acquisition fields;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB5C7665A6B8544029B340008185D13A4"><enum>(I)</enum><text display-inline="yes-display-inline">facilitate, to the extent requested by
				agencies, interagency intern and training programs; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5872C184A9CC480D972691EF19BDA9E0"><enum>(J)</enum><text display-inline="yes-display-inline">perform other career management or research
				functions as directed by the Administrator.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB118D88676A9442C9351A9471A7940A4"><enum>(2)</enum><header display-inline="yes-display-inline">Budget resources and authority</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id7BCF81E56D8741BEA8D3A02E35AFE83F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of the Office of Management
				and Budget and the Administrator of General Services shall provide the Federal
				Acquisition Institute with the necessary budget resources and authority to
				support government-wide training standards and certification requirements
				necessary to enhance the mobility and career opportunities of the Federal
				acquisition workforce.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0969D0F683E0467D8AC9209FE8A1CDEC"><enum>(B)</enum><header display-inline="yes-display-inline">Acquisition workforce training
				fund</header><text display-inline="yes-display-inline">Subject to the
				availability of funds, the Administer of General Services shall provide the
				Federal Acquisition Institute with amounts from the acquisition workforce
				training fund established under section 37(h)(3) sufficient to meet the annual
				budget for the Federal Acquisition Institute requested by the Administrator for
				Federal Procurement Policy.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE01D9EEE77D04DAC9984536894F7C261"><enum>(3)</enum><header display-inline="yes-display-inline">Federal Acquisition Institute Board of
				Directors</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id73BF47E2694647D783A7B75D99C36421"><enum>(A)</enum><header display-inline="yes-display-inline">Reporting to Administrator</header><text display-inline="yes-display-inline">The Federal Acquisition Institute shall
				report through its Board of Directors directly to the Administrator for Federal
				Procurement Policy.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC14689F71CE94DBCB05152EBCFB7BD43"><enum>(B)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Board shall be composed of not more
				than 8 individuals from the Federal Government representing a mix of
				acquisition functional areas, all of whom shall be appointed by the
				Administrator.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7320DD809AE445D2851E9C40629BE333"><enum>(C)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Board shall provide general direction
				to the Federal Acquisition Institute to ensure that the Institute—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID7ba9a308131a47baaa4b4f7a5af1ea45"><enum>(i)</enum><text display-inline="yes-display-inline">meets its statutory requirements;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDc76e6a8bc5114cbd8163b6d5bcb953cc"><enum>(ii)</enum><text display-inline="yes-display-inline">meets the needs of the Federal acquisition
				workforce;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID7c5855a83e4645a0b1b3305c772f87b8"><enum>(iii)</enum><text display-inline="yes-display-inline">implements appropriate programs;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID473e86e007304b9591d4441e0a754152"><enum>(iv)</enum><text display-inline="yes-display-inline">coordinates with appropriate organizations
				and groups that have an impact on the Federal acquisition workforce;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID54ec684ea9ac47a68e839c4db71739f7"><enum>(v)</enum><text display-inline="yes-display-inline">develops and implements plans to meet
				future challenges of the Federal acquisition workforce; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID1b49726ab38547448efec6a8ac87cea7"><enum>(vi)</enum><text display-inline="yes-display-inline">works closely with the Defense Acquisition
				University.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D0215893E834A2680CD4D3C16D2E153"><enum>(D)</enum><header display-inline="yes-display-inline">Recommendations</header><text display-inline="yes-display-inline">The Board shall make recommendations to the
				Administrator regarding the development and execution of the annual budget of
				the Federal Acquisition Institute.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id170A6425CF0E4FE3B00179BEDF1AA132"><enum>(4)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The Director of the Federal Acquisition
				Institute shall be appointed by, and report directly to, the
				Administrator.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1CA5D316A141402FB58E824B7AE41A99"><enum>(i)</enum><header display-inline="yes-display-inline">Government-wide training standards and
				certification</header><text display-inline="yes-display-inline">The
				Administrator for Federal Procurement Policy, acting through the Federal
				Acquisition Institute, shall provide and update government-wide training
				standards and certification requirements, including—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idCAC9A056CCBD4D8C8ED3B80D96FAB1DF"><enum>(1)</enum><text display-inline="yes-display-inline">developing and modifying acquisition
				certification programs;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9511DC7F0244EE8964B3C3F33450F55"><enum>(2)</enum><text display-inline="yes-display-inline">ensuring quality assurance for agency
				implementation of government-wide training and certification standards;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80D3297968804C5B898D2662ACF83B37"><enum>(3)</enum><text display-inline="yes-display-inline">analyzing the acquisition training
				curriculum to ascertain if all certification competencies are covered or if
				adjustments are necessary;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A99A99D3DD24E29B480DEA5F1924BAC"><enum>(4)</enum><text display-inline="yes-display-inline">developing career path information for
				certified professionals to encourage retention in government positions;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00A4C4145B6F457E9D1BA637AA4BD6A2"><enum>(5)</enum><text display-inline="yes-display-inline">coordinating with the Office of Personnel
				Management for human capital efforts; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC6A724D576848ABA750C123501F0CB6"><enum>(6)</enum><text display-inline="yes-display-inline">managing rotation assignments to support
				opportunities to apply skills included in certification.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9D2557C1AFF24DA69A9F8FFD32C671E6"><enum>(j)</enum><header display-inline="yes-display-inline">Acquisition internship and training
				programs</header><text display-inline="yes-display-inline">All Federal civilian
				agency acquisition internship or acquisition training programs shall follow
				guidelines provided by the Office of Federal Procurement Policy to ensure
				consistent training standards necessary to develop uniform core competencies
				throughout the Federal Government.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id2fa1df84-a0a1-465d-8cad-14d1a1731476"><enum>(k)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">The Administrator shall submit to the
				Committee on Homeland Security and Governmental Affairs and the Committee on
				Appropriations of the Senate and the Committee on Oversight and Government
				Reform and the Committee on Appropriations of the House of Representatives an
				annual report on the projected budget needs and expense plans of the FAI to
				fulfill its mandate.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idC866B1F8890B45C59D36951595061E97"><enum>(l)</enum><header display-inline="yes-display-inline">Chief Acquisition Officer
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <term>Chief Acquisition Officer</term> means a Chief Acquisition Officer
				for an executive agency appointed pursuant to section
				16.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id768F7234EF4248BCA4B211E29BF1E608"><enum>(2)</enum><header display-inline="yes-display-inline">Expanded scope of acquisition workforce
			 training fund</header><text display-inline="yes-display-inline">Section
			 37(h)(3) of the Office of Federal Procurement Policy Act (41 U.S.C. 433(h)(3))
			 is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idF9A816DB82AA4E5EACD8B64024E4DF17"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>to
			 support the training of the acquisition workforce of the executive
			 agencies</quote> and inserting <quote>to support the activities set forth in
			 section 37A(h)(1)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7D87C5B33EDB492DB7C5383901F45050"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking
			 <quote>ensure that funds collected for training under this section are not used
			 for any purpose other than the purpose specified in subparagraph (A)</quote>
			 and inserting <quote>ensure that funds collected under this section are not
			 used for any purpose other than the activities set forth in section
			 37A(h)(1)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id85FF9EC699D0488487B88FB6822F010C"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 6(d)(5) of the Office of Federal
			 Procurement Policy Act (41 U.S.C. 405(d)(5)) is amended to read as
			 follows:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="id7D43DAD7E5414A2FBFA241112B5FE2B3" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id9AC01150DD8F4F83A096AE1E2C11C80D"><enum>(5)</enum><text display-inline="yes-display-inline">providing for and directing the activities
				of the Federal Acquisition Institute established under section 37A, including
				recommending to the Administrator of General Services a sufficient budget for
				such
				activities;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id07E303DC06A34861A22B455EB4FCF8A8"><enum>(c)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section, or the amendments
			 made by this section, shall be construed to preclude the Secretary of Defense
			 from establishing acquisition workforce policies, procedures, training
			 standards, and certification requirements for acquisition positions in the
			 Department of Defense, as provided in chapter 87 of title 10, United States
			 Code.</text>
