			<paragraph commented="no" display-inline="no-display-inline" id="ID578965422e7e459a8b4be8af392f4a4a"><enum>(1)</enum><text display-inline="yes-display-inline">to conserve and restore the eastside
			 forests of the State;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID187713c118754a61af5176ca392c96e8"><enum>(2)</enum><text display-inline="yes-display-inline">to create an immediate, predictable, and
			 increased timber flow to support locally based restoration economies;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1264ddac1a004b6e9377a40bcea06123"><enum>(3)</enum><text display-inline="yes-display-inline">to make the eastside forests of the State
			 more resistant and resilient to, and to mitigate the effects of, climate
			 change;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2096d730d8584f7bbb31fc6d2b3436de"><enum>(4)</enum><text display-inline="yes-display-inline">to protect, restore, and increase old
			 growth forest stands and trees in the eastside forests of the State;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb346f18bd3247eb87008b3c7a8e2f25"><enum>(5)</enum><text display-inline="yes-display-inline">to expedite actions to conserve and restore
			 forests in the eastside forests of the State that achieve ecological objectives
			 and provide economic and social benefits;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf901d8022211447e81870943a870f76b"><enum>(6)</enum><text display-inline="yes-display-inline">to promote collaboration in communities of
			 the eastside forests of the State to support natural resource- and
			 restoration-based economies;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed0968e623784b2e94bd9b04c620cb5e"><enum>(7)</enum><text display-inline="yes-display-inline">to streamline administrative processes for
			 ecological restoration projects in the eastside forests of the State that
			 result in improved forest and watershed health;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2000961aba204a43a618353ab02781e6"><enum>(8)</enum><text display-inline="yes-display-inline">to conserve and restore the ecological
			 health and natural processes of aquatic and riparian ecosystems and watersheds
			 in the State;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2bc609fc330141bebae9e055f267676c"><enum>(9)</enum><text display-inline="yes-display-inline">to prioritize and strategically target
			 restoration projects to improve forest and watershed health in old growth
			 forests—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id4A8D09AD67E34193954D235511ADEA79"><enum>(A)</enum><text display-inline="yes-display-inline">with uncharacteristic conditions;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ECCC97E85C94CD49FA27C9BD1083717"><enum>(B)</enum><text display-inline="yes-display-inline">located in the eastside forests of the
			 State;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6f9c0ca1a0eb40528f62abc33cbdc705"><enum>(10)</enum><text display-inline="yes-display-inline">to provide periodic independent review of
			 agency programs in carrying out this Act;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID40c381772e0441fca1e3ee01cd091cc8"><enum>(11)</enum><text display-inline="yes-display-inline">to recognize that the threats to forest
			 health, watershed health, and rural economies have reached an emergency status;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd61898cbeb6644a094451e7b7fa3b40f"><enum>(12)</enum><text display-inline="yes-display-inline">to ensure that Federal land managers in the
			 State are good neighbors to private landowners.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID1676c7993ade43b79ffce0a8d7effd9a" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDe8facea54af544ac946f039c38a83a5f"><enum>(1)</enum><header display-inline="yes-display-inline">Advisory
			 panel</header><text display-inline="yes-display-inline">The term <term>advisory
			 panel</term> means the Eastside Forest Scientific and Technical Advisory Panel
			 established under section 7(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A1836E27C2248B78FD2A417E6B322F3"><enum>(2)</enum><header display-inline="yes-display-inline">Collaborative group</header><text display-inline="yes-display-inline">The term <term>collaborative group</term>
			 means an ad hoc association—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id5CABBF97BA494773B50C128ACA9926E2"><enum>(A)</enum><text display-inline="yes-display-inline">described in section 10; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id210AB47724F34C629C22501C41AEBAF6"><enum>(B)</enum><text display-inline="yes-display-inline">comprised of citizens of the State
			 who—</text>
					<clause commented="no" display-inline="no-display-inline" id="id42BBCBB01CDF4BF6852F20A175CDBCD6"><enum>(i)</enum><text display-inline="yes-display-inline">represent various interests of the State;
			 and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id6F2034EB7EAB476F87C5E10D73DA54B8"><enum>(ii)</enum><text display-inline="yes-display-inline">as a condition of membership in the
			 collaborative group, have agreed to work cooperatively to effectuate the
			 purposes of this Act.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd91f6cbf1d8e415aa7681d9612e7a4c2"><enum>(3)</enum><header display-inline="yes-display-inline">Covered area</header><text display-inline="yes-display-inline">The term <term>covered area</term> means
			 any area of the State that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDeb7497086c63430fb012a99e420f3bdb"><enum>(A)</enum><text display-inline="yes-display-inline">managed by the Chief of the Forest Service;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbe5d213702eb4a3bacc2f02ee7497c01"><enum>(B)</enum><text display-inline="yes-display-inline">not covered by the Northwest Forest
			 Plan.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa045323896c14da3b396a12d39ec592c"><enum>(4)</enum><header display-inline="yes-display-inline">Decommission</header><text display-inline="yes-display-inline">The term <term>decommission</term> means
			 the conduct of a restoration activity on a road to return the road to a more
			 natural state.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1e7a50b98156482abbd303ea3161915c"><enum>(5)</enum><header display-inline="yes-display-inline">Emergency condition</header><text display-inline="yes-display-inline">The term <term>emergency condition</term>
			 means a condition—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id4BA7F56DCC9C4B38920581A793A5BCC8"><enum>(A)</enum><text display-inline="yes-display-inline">that results in an—</text>
					<clause commented="no" display-inline="no-display-inline" id="ID1381ad5ce92a4a1f8448c695ccc2eb28"><enum>(i)</enum><text display-inline="yes-display-inline">imminent risk to life or property;
			 or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID77ce3be38a0340869d84705b87d4e3ff"><enum>(ii)</enum><text display-inline="yes-display-inline">immediate impairment of the public use and
			 enjoyment of a trail, road, highway, or public facility; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF6EAF3E5915B4EFA84149E35C6FF55D2"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to subparagraph (A)(ii), the
			 probability of effective remediation of which outweighs the benefits of the
			 knowledge of the public (including the benefits of public comment) regarding
			 the condition, as determined by the Secretary.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID180ce8e4c74241549849ab6956daf847"><enum>(6)</enum><header display-inline="yes-display-inline">Forest health</header><text display-inline="yes-display-inline">The term <term>forest health</term> means
			 conditions that enable forested land—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDda8cc1a9ab234ab39d248894ffd020b3"><enum>(A)</enum><text display-inline="yes-display-inline">to be durable, resilient, and less prone to
			 uncharacteristic wildfire, insect, or pathogen outbreaks, while—</text>
					<clause commented="no" display-inline="no-display-inline" id="idB885D4CE894644239256BDCD9C9BE3EF"><enum>(i)</enum><text display-inline="yes-display-inline">supporting ecosystem services and
			 populations of native species; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idB1B76B5F62EB4E209AD0625ED6D91457"><enum>(ii)</enum><text display-inline="yes-display-inline">allowing for natural disturbances;</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4177ddf9dfdb4acc82093d578c9cb3f4"><enum>(B)</enum><text display-inline="yes-display-inline">to maintain or develop species composition,
			 ecosystem function and structure, hydrologic function, carbon cycling, and
			 sediment regimes that are within an acceptable range that considers—</text>
					<clause commented="no" display-inline="no-display-inline" id="id8BAF28AB6E934ED993EB4BF90509330E"><enum>(i)</enum><text display-inline="yes-display-inline">historic variability; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id3B44DB02950D41929B24A17F90422AC0"><enum>(ii)</enum><text display-inline="yes-display-inline">anticipated future conditions; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91f686aeda6745de9519f22340573693"><enum>(C)</enum><text display-inline="yes-display-inline">to be resistant and resilient to
			 uncharacteristic events.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5449e7cfb6524956bfd0714eab322525"><enum>(7)</enum><header display-inline="yes-display-inline">Forest plan</header><text display-inline="yes-display-inline">The term <term>forest plan</term> means a
			 National Forest management plan under the National Forest Management Act of
			 1976 (16 U.S.C. 1600 et seq.).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98bbd8de25d4465a92484dcd641ec49b"><enum>(8)</enum><header display-inline="yes-display-inline">Forest stand</header><text display-inline="yes-display-inline">The term <term>forest stand</term> means a
			 contiguous area of trees that are sufficiently uniform in composition,
			 constitution, age, spatial arrangement, structure, or condition to be
			 distinguishable as a unit.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(9)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
			 meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance
			 Act</act-name> (25 U.S.C. 450b).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1f26d34b6f6d4932b68ef44ece30543d"><enum>(10)</enum><header display-inline="yes-display-inline">INFISH</header><text display-inline="yes-display-inline">The term <term>INFISH</term> means the land
			 and resource management plan amendments made before the date of enactment of
			 this Act arising from the document—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idBEB835203F3449C49A84A20B434153C0"><enum>(A)</enum><text display-inline="yes-display-inline">entitled <quote>Inland Native Fish
			 Strategy</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFA54C62C18348A5A38BCF5E4C8FBED6"><enum>(B)</enum><text display-inline="yes-display-inline">published by the Department of Agriculture;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24A5430CEB594029B7826B924308428A"><enum>(C)</enum><text display-inline="yes-display-inline">dated July 28, 1995.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94E91C7760CA457EAD83C56F5434FFE9"><enum>(11)</enum><header display-inline="yes-display-inline">Landscape scale</header><text display-inline="yes-display-inline">The term <term>landscape scale</term> means
			 a scale that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDc76295b9cb8549eba0b6de723ea7bb96"><enum>(A)</enum><text display-inline="yes-display-inline">applies to a large geographic area that is
			 normally measured in terms of a watershed of approximately 25,000 acres or a
			 subbasin of approximately 1,000,000 acres; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf4846505aede46298d6731338689cfd7"><enum>(B)</enum><text display-inline="yes-display-inline">may exhibit similarities that enable
			 Federal forest managers to develop and implement management activities to
			 address issues relating to—</text>
					<clause commented="no" display-inline="no-display-inline" id="IDaad57cc9d1de4f968faaf4de0e3c3777"><enum>(i)</enum><text display-inline="yes-display-inline">potential natural vegetation;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDef8b9277459f4ada9513f5f3652cdd2d"><enum>(ii)</enum><text display-inline="yes-display-inline">surface features;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDa7a08ade685d40cba50eec7fd0b02f4a"><enum>(iii)</enum><text display-inline="yes-display-inline">water flow or distribution;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID4b56257a5c634dec902593a1243c430f"><enum>(iv)</enum><text display-inline="yes-display-inline">wildlife; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID221d8fc1b2414635a502db8bdbb013e2"><enum>(v)</enum><text display-inline="yes-display-inline">natural disturbances associated with
			 flooding, wind, or fire.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9BCBF5345F5E4544882FC73A20592343"><enum>(12)</enum><header display-inline="yes-display-inline">National Forest System</header><text display-inline="yes-display-inline">The term <term>National Forest
			 System</term> has the meaning given the term in section 11(a) of the Forest and
			 Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1609(a)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0122a38aa33c463d95257981417cdeb0"><enum>(13)</enum><header display-inline="yes-display-inline">Northwest forest plan</header><text display-inline="yes-display-inline">The term <term>Northwest Forest Plan</term>
			 means the plan that is comprised of—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDd54bc98ece6146159a5d2b1e1dd2052d"><enum>(A)</enum><text display-inline="yes-display-inline">the Final Supplemental Environmental Impact
			 Statement on Management of Habitat for Late-Successional and Old-Growth Forest
			 Related Species Within the Range of the Northern Spotted Owl (2 volumes), dated
			 February 1994;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9172d81c82b14746864799c5e86f27af"><enum>(B)</enum><text display-inline="yes-display-inline">the Record of Decision for Amendments to
			 Forest Service and Bureau of Land Management Planning Documents Within the
			 Range of the Northern Spotted Owl, dated April 1994; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5ea10d11c4f148258367cb6c2a0301f8"><enum>(C)</enum><text display-inline="yes-display-inline">the Standards and Guidelines for Management
			 of Habitat for Late-Successional and Old-Growth Forest Related Species Within

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6049fcf0e42541a28ed2645cb6386097"><enum>(14)</enum><header display-inline="yes-display-inline">Old growth</header><text display-inline="yes-display-inline">The term <term>old growth</term> means the
			 oldest stage at which a plant community or a tree is capable of existing on a
			 site, given the frequency of natural disturbance events.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID38fd6a87d98040008f3212d3c2a010b8"><enum>(15)</enum><header display-inline="yes-display-inline">PACFISH</header><text display-inline="yes-display-inline">The term <term>PACFISH</term> means the
			 land and resource management plan amendments made before the date of enactment
			 of this Act arising from the document—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id28039BE759474C98BBFF022324AD8330"><enum>(A)</enum><text display-inline="yes-display-inline">entitled <quote>PACFISH–Implementation of
			 Interim Strategies for Managing Anadromous Fish Producing Watersheds in Eastern
			 Oregon and Washington, Idaho, and Portions of California</quote>;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D7A6465C0A241F1B927921F72C15DDE"><enum>(B)</enum><text display-inline="yes-display-inline">published by—</text>

			 road</header><text display-inline="yes-display-inline">The term <term>permanent
			 road</term> means a road—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idA0FC634092EA40ED844B6DFE76EE67DD"><enum>(A)</enum><text display-inline="yes-display-inline">constructed, reconstructed, maintained, or
			 operated on; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE1E48A8F42CF4C1EAC1AE3AF45A8DEC6"><enum>(B)</enum><text display-inline="yes-display-inline">that is determined by the Secretary to be

				<subparagraph commented="no" display-inline="no-display-inline" id="id2AD78876B49A4110AC38A2C4C258F23B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>plant association</term>
			 means a description of the vegetation community that—</text>
					<clause commented="no" display-inline="no-display-inline" id="id3EE0E31AC95642469866AFE765F4B0D3"><enum>(i)</enum><text display-inline="yes-display-inline">would potentially, in the absence of a
			 disturbance, occupy a site; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idD12700B9C21345918C866143A7C547C1"><enum>(ii)</enum><text display-inline="yes-display-inline">may be aggregated into 1 or more groups
			 based on similarities in plant species, composition, environment, and
			 productivity.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC17CCEB43B404CEF8FFD5342054A3777"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>plant association</term>
			 includes, with respect to a forested site, species representing tree, shrub,
			 and herbaceous layers.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38535C1974B74072B4261345AEBC4F68"><enum>(18)</enum><header display-inline="yes-display-inline">Restoration activity</header><text display-inline="yes-display-inline">The term <term>restoration activity</term>,
			 with respect to the decommissioning of a road, includes—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id9F2DF4C9E0A54110929F996629E38A87"><enum>(A)</enum><text display-inline="yes-display-inline">the reestablishment of former drainage
			 patterns;</text>

			 restoration of natural contours and slopes; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9627239790474BB38D9B95C7A6DDCD5C"><enum>(L)</enum><text display-inline="yes-display-inline">any other method that is designed to
			 address each specific condition of the road.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7579B52E94DE49D4916A2675D6CD74F0"><enum>(19)</enum><header display-inline="yes-display-inline">Restoration assessment</header><text display-inline="yes-display-inline">The term <term>restoration
			 assessment</term> means the Eastside Landscape Forest Restoration Assessment
			 prepared under section 8(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID036a53deb064499899b1a003912b3f0b"><enum>(20)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Agriculture (acting through the Chief of the Forest
			 Service).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7f0ee7da834f405a90010c835cb5b67b"><enum>(21)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State
			 of Oregon.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID061d75fcb4a349098ec400b9b209589f"><enum>(22)</enum><header display-inline="yes-display-inline">Temporary
			 road</header><text display-inline="yes-display-inline">The term <term>temporary
			 road</term> means a road that is—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idDF6DB2C0ADF44E21976A01E7ED142D0D"><enum>(A)</enum><text display-inline="yes-display-inline">constructed or reconstructed as part of any
			 project; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id606405D7B01F443580348CF817A133D4"><enum>(B)</enum><text display-inline="yes-display-inline">not a permanent road, as determined by the
			 Secretary.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID903f9a68c68741238517eb4f815031cf"><enum>(23)</enum><header display-inline="yes-display-inline">Uncharacteristic</header><text display-inline="yes-display-inline">The term <term>uncharacteristic</term>
			 means, with respect to a wildfire, outbreak of insects or pathogens, or a level
			 of forest fuel, a wildfire, outbreak, or level of fuel the severity, size,
			 frequency, or quantity of which exceeds any similar natural process, event, or
			 condition as in existence before the date of Euro-American settlement of the
			 land on which the wildfire, outbreak, or level of fuel occurs.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe251c5401cbd411ca0c0db6ed84a0176"><enum>(24)</enum><header display-inline="yes-display-inline">Watershed health</header><text display-inline="yes-display-inline">The term <term>watershed health</term>
			 means landscape conditions that enable riparian and aquatic ecosystems—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID25c8ef01fdb645d4a2e654297d45e5a8"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id8C08D8E9DFA04480B7B40A12EC9CF0B7"><enum>(i)</enum><text display-inline="yes-display-inline">to capture, store, and release water,
			 sediment, wood, and nutrients; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idDEC73478B0A04BBFBE90D815D24DA21D" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide for water temperatures that are
			 within the range of variability of the natural regimes for the processes
			 described in clause (i); and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID719b1601e2704fe2b5968d7ff4ec7c8d"><enum>(B)</enum><text display-inline="yes-display-inline">to create and sustain functional riparian,
			 aquatic, and wetland habitats that are capable of supporting diverse
			 populations of native aquatic- and riparian-dependent species.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5472501cdd564da89967be3a087e37ac"><enum>(25)</enum><header display-inline="yes-display-inline">Wildland-urban interface</header><text display-inline="yes-display-inline">The term <term>wildland-urban
			 interface</term> has the meaning given the term in section 101 of the Healthy
			 Forests Restoration Act of 2003 (16 U.S.C. 6511).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID17c2d69e04f24218b12275f77a31a727" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Forest management</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID320f27173b3e4bcea6e22126f4086792"><enum>(a)</enum><header display-inline="yes-display-inline">Management goals</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0d7b5c4f013b4a0babb049754aa78f36"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the covered area, after considering the
			 best available science, the Secretary shall manage the forest, stream,
			 grassland, wetland, alpine, and other land and water located in the covered
			 area—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDedb86064c2274151babce325e86da7ea"><enum>(A)</enum><text display-inline="yes-display-inline">to conserve and restore the health, natural
			 structure, processes, and functions of the forests and watersheds located in
			 the covered area;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfcfb999ccb9948e6acec887a0266cf90"><enum>(B)</enum><text display-inline="yes-display-inline">to reduce the risk of uncharacteristic
			 disturbances from fire, insects, and disease;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8af02d3f10324e859befb0d3b002cc47"><enum>(C)</enum><text display-inline="yes-display-inline">to allow for characteristic natural
			 disturbances; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa740b2ff8b434c2f99ab73b8fbf971c6"><enum>(D)</enum><text display-inline="yes-display-inline">to increase the resistance and resiliency
			 of the covered land to uncharacteristic events.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe43b775b16d24f068bb32caec218e2b6"><enum>(2)</enum><header display-inline="yes-display-inline">Implementation</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id783954980E14474FA1D3E4C5119BA90B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To achieve each goal described in paragraph
			 (1), the Secretary shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="idC25A7E0A129E4A86A3E7F682650CDCD9"><enum>(i)</enum><text display-inline="yes-display-inline">use landscape scale planning to implement
			 ecological restoration projects in the covered area; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id7654B9318AB343E6A31A1F4C80C9371F"><enum>(ii)</enum><text display-inline="yes-display-inline">carry out the implementation of each
			 ecological restoration project activity of the Secretary in a manner consistent
			 with the advice of the advisory panel.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id168CE98866A142E19EFDC610D0100EC5"><enum>(B)</enum><header display-inline="yes-display-inline">Projects</header><text display-inline="yes-display-inline">In carrying out projects and other
			 activities to achieve each goal described in paragraph (1), the Secretary shall
			 consider methodologies that could potentially help achieve—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID771a43798f734466bdf750e7314e3340"><enum>(i)</enum><text display-inline="yes-display-inline">reduced basal areas in overstocked forest
			 stands;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDa8bb5042252641aabc124d906f59995d"><enum>(ii)</enum><text display-inline="yes-display-inline">increased mean diameter of forest
			 stands;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8ad1cec1064e4dbf9515c190053dbe0d"><enum>(iii)</enum><text display-inline="yes-display-inline">a forest composition that focuses on more
			 fire- and drought-tolerant species;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDddbe25974af846b8ab0ee2cb363fa277"><enum>(iv)</enum><text display-inline="yes-display-inline">restored historical levels of within-forest
			 stand spatial heterogeneity;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID49cb4c1559dd4cffa4cd5e53d8756026"><enum>(v)</enum><text display-inline="yes-display-inline">the conservation and restoration of old
			 growth;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8eff274bb9944c50b4e3929668cfcd2b"><enum>(vi)</enum><text display-inline="yes-display-inline">a reduced risk from uncharacteristic
			 wildfire, disease, climate change, and competition;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDcd03bdaf58554f22b4a81651d2c95636"><enum>(vii)</enum><text display-inline="yes-display-inline">the restoration and maintenance of historic
			 population levels of older trees;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDde271e525d474b1c8f94b3593eb7a35b"><enum>(viii)</enum><text display-inline="yes-display-inline">the restoration of ecologically sustainable
			 forest stands and landscapes to incorporate characteristic forest stand
			 structures and older tree populations;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDadc3e81cd14f4749b42d6d60fbad6c83"><enum>(ix)</enum><text display-inline="yes-display-inline">wood harvests to sustain adequate levels of
			 industry infrastructure;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID536238cdaabd4aa3a6af82c946114594"><enum>(x)</enum><text display-inline="yes-display-inline">the maintenance of sustainable and
			 fire-resilient conditions in perpetuity through active management (including
			 management through prescribed or wildland fire and mechanical
			 activities);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDa3bde43bfb8a4824867c6b53c3049281"><enum>(xi)</enum><text display-inline="yes-display-inline">ecologically appropriate spatial complexity
			 (including a range of open to dense forest patches at scales from the forest
			 stand to the landscape);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID4e9f35c73a544eec84202778dc704c4e"><enum>(xii)</enum><text display-inline="yes-display-inline">spatial heterogeneity as an essential
			 element in restoring and sustaining forests and landscapes;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID1754406272e4474e996136b1fa854a27"><enum>(xiii)</enum><text display-inline="yes-display-inline">nonuniform effects by avoiding extensive
			 areas of uniform treatment except for certain treatments (such as broadcast
			 burns) that are carried out to enhance the spatial heterogeneity of the forest
			 site;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID1ea65a0441eb4f67b7f7ccd6ce14ae79"><enum>(xiv)</enum><text display-inline="yes-display-inline">increased stakeholder participation through
			 collaborative groups; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID3d0791e6c8fe4d6c90b177c542b5c626"><enum>(xv)</enum><text display-inline="yes-display-inline">appropriate understory plant community
			 composition and condition, including—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id9CEB8706AF3847808B158A33771F7451"><enum>(I)</enum><text display-inline="yes-display-inline">the restoration and maintenance of native
			 ground cover; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id4A97A95DB0EE49809476417F92615504"><enum>(II)</enum><text display-inline="yes-display-inline">the reduction of the potential for exotic
			 and other invasive species.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4f0809ff035c4f21818aa6e65bb8a714"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibitions on removal of certain
			 trees</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID038a0dbc4ef8453da80e697913a2cdf9"><enum>(1)</enum><header display-inline="yes-display-inline">Larger trees</header><text display-inline="yes-display-inline">Subject to paragraph (2) and except as
			 provided in paragraph (3), the Secretary shall prohibit the cutting or removal
			 of any live tree located in the covered area, the diameter of which exceeds 21
			 inches measured at breast height.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72e955aca2084922a4bdee6adf8f71b3"><enum>(2)</enum><header display-inline="yes-display-inline">Smaller trees</header><text display-inline="yes-display-inline">The Secretary shall prohibit the cutting or
			 removal of a live tree located in the covered area, the diameter of which is
			 less than 21 inches measured at breast height, if the Secretary determines that
			 the prohibition is—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3A105AE68A194526AE14B743A07C4392"><enum>(A)</enum><text display-inline="yes-display-inline">consistent with the goals described in
			 subsection (a)(1);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8BD6126D20CD46A4B1DEF4F20F7C1E1A"><enum>(B)</enum><text display-inline="yes-display-inline">consistent with the advice relating to the
			 conservation and restoration of old growth provided by the advisory panel;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ED466F875C7462B84E0A802A24DF8C8"><enum>(C)</enum><text display-inline="yes-display-inline">carried out in consultation with the
			 affected collaborative group.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfb82270db4174158899a5b06ad66f066"><enum>(3)</enum><header display-inline="yes-display-inline">Exceptions</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID8f0638271a2f4294b6c6a5179ebef7eb"><enum>(A)</enum><header display-inline="yes-display-inline">Ecological exception</header><text display-inline="yes-display-inline">The Secretary shall permit the cutting or
			 removal of a tree described in paragraph (1) if the Secretary determines that
			 the cutting or removal of the tree is—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID0c69854f9b8642109349f725b92b30d9"><enum>(i)</enum><text display-inline="yes-display-inline">consistent with the goals described in
			 subsection (a)(1);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID5ebe9621b4794c33b018a1c3bdefc251"><enum>(ii)</enum><text display-inline="yes-display-inline">consistent with the advice relating to the
			 conservation and restoration of old growth provided by the advisory panel;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID70e4ff552ea3401082a87263fc0e4edc"><enum>(iii)</enum><text display-inline="yes-display-inline">carried out in consultation with the
			 affected collaborative group.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDed2889153f824e35bea5dc63b251ea30"><enum>(B)</enum><header display-inline="yes-display-inline">Administrative exception</header>
						<clause commented="no" display-inline="no-display-inline" id="ID215dcffe2d4b4c1e9b52dc0c22506033"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall permit the cutting or
			 removal of a tree described in paragraph (1) or (2) if the Secretary determines
			 that the cutting or removal of the tree is—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID8cf6a8f19c21492eb42ff0b26fc2cc2e"><enum>(I)</enum><text display-inline="yes-display-inline">necessary to protect any life or
			 property;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id9843ED12D836424589DCF0EDF7F27AFE"><enum>(II)</enum><text display-inline="yes-display-inline">necessary to provide for safe
			 administration or facilitate public enjoyment; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0edafb959f89401bbcd1f7bf7238526e"><enum>(III)</enum><text display-inline="yes-display-inline">necessary and incidental to any valid use
			 of National Forest System land if the Secretary avoids cutting protected trees
			 to the maximum extent practicable.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID78f516ba38854972ad0f104d681a5164"><enum>(ii)</enum><header display-inline="yes-display-inline">Notice requirement</header>
							<subclause commented="no" display-inline="no-display-inline" id="id512577D7E44645188F0289788DD275DC"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subclause (II), the Secretary
			 shall provide to the public and each affective collaborative group notice and
			 an opportunity to comment before determining the existence of any exception
			 described in clause (i).</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id47AC6FA1228040B483E3E44D3A3E8C34"><enum>(II)</enum><header display-inline="yes-display-inline">Emergency conditions</header><text display-inline="yes-display-inline">Subclause (I) shall not apply in the case
			 of an emergency condition.</text>
							</subclause></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDfcb4796d29234cdfabcde3f7fa56933b" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Watershed management</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID75cea64c771647998469c24cc8e9bf32"><enum>(a)</enum><header display-inline="yes-display-inline">Delineation of riparian habitat
			 conservation areas</header><text display-inline="yes-display-inline">Each
			 riparian habitat conservation area shall be delineated in each watershed for
			 all permanently flowing streams, lakes, wetlands, seeps, springs, and
			 intermittent streams as follows:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID1cfdc48240f1492ca43ac7bf252260e2"><enum>(1)</enum><header display-inline="yes-display-inline">Fish-bearing streams</header><text display-inline="yes-display-inline">The stream and the area on either side of
			 the stream extending from the edges of the active stream channel to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id296C1FAAAE23487C8F0970CAD00724F1"><enum>(A)</enum><text display-inline="yes-display-inline">the top of the inner gorge;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id580D24FB46FC41949C98801B11B518F1"><enum>(B)</enum><text display-inline="yes-display-inline">the outer edges of the 100-year
			 floodplain;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8C7B9CEE1B74F0EB2F76AF5439A12DE"><enum>(C)</enum><text display-inline="yes-display-inline">the outer edges of riparian vegetation;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87962E631F334E96A5E490B1A3103DA8"><enum>(D)</enum><text display-inline="yes-display-inline">the greater of—</text>

			 (600 feet, including both sides of the stream channel).</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3d6f58bffd9544f7b71d85d75b27399c"><enum>(2)</enum><header display-inline="yes-display-inline">Permanently flowing nonfish bearing
			 streams</header><text display-inline="yes-display-inline">The stream and the
			 area on either side of the stream extending from the edges of the active stream
			 channel to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id42D20A3D1F51487D8D732400FF93CE13"><enum>(A)</enum><text display-inline="yes-display-inline">the top of the inner gorge;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2373B564755D49D88CC962478112B31A"><enum>(B)</enum><text display-inline="yes-display-inline">the outer edges of the 100-year flood
			 plain;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69F0E48BF88C4736A72466F0231CC40C"><enum>(C)</enum><text display-inline="yes-display-inline">the outer edges of riparian vegetation;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CF020FE2F144C4283F99A226C7FBBB0"><enum>(D)</enum><text display-inline="yes-display-inline">the greater of—</text>
						<clause commented="no" display-inline="no-display-inline" id="id4F82B51A5B72494FBE1EB4912A6204A8"><enum>(i)</enum><text display-inline="yes-display-inline">a distance equal to the height of 1
			 site-potential tree; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2E1CEBB52E6C496D8BF5D4B2975A4861"><enum>(ii)</enum><text display-inline="yes-display-inline">a slope distance of not less than 150 feet
			 (300 feet, including both sides of the stream channel).</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60e2f62dcc554f039dbf2687d01b1857"><enum>(3)</enum><header display-inline="yes-display-inline">Ponds, lakes, reservoirs, and wetlands
			 greater than 1 acre</header><text display-inline="yes-display-inline">The body
			 of water or wetland and the area to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id78D87322BD484395B7DB4E62E161FEA2"><enum>(A)</enum><text display-inline="yes-display-inline">the outer edges of the riparian

			 unstable areas; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2B52004830E14427A68DFEB20DAE506A"><enum>(D)</enum><text display-inline="yes-display-inline">the greater of—</text>
						<clause commented="no" display-inline="no-display-inline" id="idBCDE35129D3544D7BD83097A1E74E666"><enum>(i)</enum><text display-inline="yes-display-inline">a distance equal to the height of 1
			 site-potential tree; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id4C4E5303B6C34B31871E208BE49B613A"><enum>(ii)</enum><text display-inline="yes-display-inline">a slope distance from the greater
			 of—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id7A73C0D0A3E14CA98A7C7777ECFE432E"><enum>(I)</enum><text display-inline="yes-display-inline">the edge of the maximum pool elevation of
			 constructed ponds and reservoirs; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id193C2EB56F53415F93A7506FC43A2391"><enum>(II)</enum><text display-inline="yes-display-inline">the edge of the wetland, pond, or
			 lake.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3dbfa86214c84e18af0fab4616e30e11"><enum>(4)</enum><header display-inline="yes-display-inline">Seasonally flowing or intermittent streams,
			 wetlands less than 1 acre, landslides, and landslide-prone areas</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id25BB828666B847108B85FE0A242B985A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with subparagraph (B), the
			 riparian conservation area described in this paragraph shall include features
			 with high variability in size and site-specific characteristics.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07D959BF879A48B19E7FB3F188327166"><enum>(B)</enum><header display-inline="yes-display-inline">Minimum requirements</header><text display-inline="yes-display-inline">At a minimum, the riparian conservation
			 area described in this paragraph shall include—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDc77201e4d0c644448ae7d54b7b160524"><enum>(i)</enum><text display-inline="yes-display-inline">the extent of landslide and landslide-prone
			 areas;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDbf00298fe73a43019fe6cb8a67074fed"><enum>(ii)</enum><text display-inline="yes-display-inline">the intermittent stream channel and the
			 area to the top of the inner gorge;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID3dda99ab05044644a1f1b2b8b8f0c621"><enum>(iii)</enum><text display-inline="yes-display-inline">the intermittent stream channel or wetland
			 and the area to the outer edges of the riparian vegetation;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID9984805d655b47a1944d6bfa5e097eb7"><enum>(iv)</enum><text display-inline="yes-display-inline">with respect to key and priority
			 watersheds, as identified under PACFISH and INFISH, the area from the edges of
			 the stream channel, wetland, landslide, or landslide-prone area to a distance
			 equal to the greater of—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id4D3AD85221A54508A7543E3C523B8762"><enum>(I)</enum><text display-inline="yes-display-inline">the height of 1 site-potential tree;
			 or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id53F65648FB1A4F6C950CF8E6593D374F"><enum>(II)</enum><text display-inline="yes-display-inline">a slope distance of not less than 100 feet;
			 and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID407ec3d9dd0d4874a80ae0e03e77dfa7"><enum>(v)</enum><text display-inline="yes-display-inline">for watersheds not identified as key and
			 priority watersheds, as identified under PACFISH and INFISH, the area from the
			 edges of the stream channel, wetland, landslide, or landslide-prone area to a
			 distance equal to the greater of—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idF149F7A0AF984525B2F0FE9182BA2131"><enum>(I)</enum><text display-inline="yes-display-inline">the height of 1 site-potential tree;
			 or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id748F9E87931B47FBB417CE706CAD6C91"><enum>(II)</enum><text display-inline="yes-display-inline">a slope distance of not less than 50
			 feet.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5834ea87096c4f81858f40eca3bee826"><enum>(b)</enum><header display-inline="yes-display-inline">National Forest land</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id832672D2377F48CEB50DD57068F3E3FD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Within each parcel of National Forest
			 located within the covered area, the Secretary shall conserve and restore
			 aquatic and riparian resources as required by each applicable land and resource
			 management plan, as amended by PACFISH and INFISH.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3018CDB2755E4AE49FD53772382C873F"><enum>(2)</enum><header display-inline="yes-display-inline">Modifications</header><text display-inline="yes-display-inline">The Secretary may modify the aquatic and
			 riparian protection requirements of any land and resource management plan that
			 applies to the covered area if the Secretary determines, after taking into
			 consideration the best available science, that a modification to PACFISH or
			 INFISH, as appropriate, would provide equivalent or additional protection with
			 respect to aquatic or riparian resources.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa78a9b9b140543b696f5067c55c56f0c"><enum>(c)</enum><header display-inline="yes-display-inline">Authority of Secretary</header><text display-inline="yes-display-inline">In determining whether a portion of a
			 project may occur in a riparian habitat conservation area, the Secretary may
			 permit short-term negative effects to aquatic or riparian conditions from
			 activities within the riparian habitat conservation area if the project is
			 designed—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7B04E7AAD08A4A3E823738ECF61094AD"><enum>(1)</enum><text display-inline="yes-display-inline">in a manner that takes into consideration
			 the best available science; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id737AB21058404F2FAE0F04EFB3E6C932"><enum>(2)</enum><text display-inline="yes-display-inline">to accomplish the long-term restoration of
			 the riparian habitat conservation area.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID54113044237b40a5a4f9866a40a44356"><enum>(d)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Nothing in this Act—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idFB15D91EE00A46508B3C54D42F3D5659"><enum>(1)</enum><text display-inline="yes-display-inline">supersedes any biological opinion that
			 addresses any land and resource management plan, as amended by PACFISH or
			 INFISH with respect to the covered area; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E9008162CA245468B9CCC8941B591F0"><enum>(2)</enum><text display-inline="yes-display-inline">modifies any requirement described in the
			 <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
			 U.S.C. 1531 et seq.).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID65277cb335114eb2af850b1e5d18ed3c" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Roads</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDd040539c5a184acb9e8107f9b0d0a15e"><enum>(a)</enum><header display-inline="yes-display-inline">Permanent roads limitation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFA750D97343246A8AB628AC36F739C15"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
			 Secretary may not construct a permanent road in the covered area.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34E7FDE88A554791849AA013791FE1A6"><enum>(2)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The Secretary may construct a permanent
			 road under paragraph (1) if—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id29B6073B7BD34391A43E6FF9C9DF48A9"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines that—</text>
						<clause commented="no" display-inline="no-display-inline" id="id87CF521763D646F98376B200B2021DA8"><enum>(i)</enum><text display-inline="yes-display-inline">the road is a justifiable realignment,
			 restoration, or correction to the placement of a permanent road that is—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id04FFF9012EFC4B7F955822792F53F78B"><enum>(I)</enum><text display-inline="yes-display-inline">in existence as of the date of enactment of
			 this Act; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id14D20D16AFC34675A7194EC0DA8AD6E8"><enum>(II)</enum><text display-inline="yes-display-inline">to be decommissioned; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA2EB37D1476B4DBAB5838B40EB43F260"><enum>(ii)</enum><text display-inline="yes-display-inline">the health of the affected forest or
			 watershed would be improved through the replacement of the road decommissioned
			 under clause (i)(II); or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA57953DE0C7D47B997A9252CF8E6A153"><enum>(B)</enum><text display-inline="yes-display-inline">the permanent road is incidental to other
			 valid uses relating to the National Forest System land on which the permanent
			 road is constructed if the Secretary, if no practicable alternative exists,
			 avoids the siting of the uses in any area that contains trees protected under
			 section 4(b).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA7CCFF1A9A4A4229806B7E152FAA78A8"><enum>(3)</enum><header display-inline="yes-display-inline">Requirements for constructed permanent
			 roads</header><text display-inline="yes-display-inline">With respect to each
			 permanent road constructed under this section, the Secretary shall ensure that
			 the effects on the health of each affected forest and watershed shall be
			 mitigated in a manner that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id33AE1D37A18C41618B07BB37668BF022"><enum>(A)</enum><text display-inline="yes-display-inline">is consistent with the best management
			 practices; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91C57FEB590C42F5A5A5925BBFB6599B"><enum>(B)</enum><text display-inline="yes-display-inline">takes into consideration the best available
			 science.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5BA71F8841D44812B07A5B54375D09C4"><enum>(4)</enum><header display-inline="yes-display-inline">Classification of constructed and
			 reconstructed roads</header><text display-inline="yes-display-inline">The
			 Secretary may not classify as permanent any road that is constructed or
			 reconstructed under this section if the Secretary determines that the Secretary
			 will remove and remediate the road by the completion date of the project that
			 required the construction or reconstruction of the road.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2b5f695893a84924b137a571d91db3bf"><enum>(b)</enum><header display-inline="yes-display-inline">Temporary roads limitation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9b91bf8c017c445e9f4713ce09334d33"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with paragraph (2), the
			 Secretary may construct a temporary road—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5F6D52099B7A47359DD51A8612E94361"><enum>(A)</enum><text display-inline="yes-display-inline">if the Secretary—</text>
						<clause commented="no" display-inline="no-display-inline" id="id9815DD7CD01045E79FA4B7AA53549738"><enum>(i)</enum><text display-inline="yes-display-inline">determines that—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idC03192A83BB5426F990E796B7B212019"><enum>(I)</enum><text display-inline="yes-display-inline">the construction of the temporary road
			 would further the goals described in section 4(a)(1); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID352dbf6fed54400a809d6df7f87c7df6"><enum>(II)</enum><text display-inline="yes-display-inline">after consideration of both ecological and
			 economic criteria, the construction of the temporary road would be reasonable;
			 and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID5c2c57868e1c43b0ab4978d6df6e1259"><enum>(ii)</enum><text display-inline="yes-display-inline">carries out the construction of the road in
			 a manner consistent with any advice or recommendation relating to roads
			 submitted to the Secretary by the advisory panel; or</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3646A991372C440C9EFBE9A870DBE962"><enum>(B)</enum><text display-inline="yes-display-inline">if the Secretary determines that the
			 temporary road is incidental to other valid uses relating to the National
			 Forest System land on which the temporary road is constructed if the Secretary,
			 to the maximum extent practicable, avoids the siting of the uses in any area
			 that contains trees protected under section 4(b).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61F3123F1534457FBC9D948E1C129463"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements for constructed temporary
			 roads</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5AA578B22EDF419F87EC050E95DFCB2A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to each temporary road
			 constructed under this section, the Secretary shall ensure that the effects to
			 the health of each affected forest and watershed shall be mitigated in a
			 manner—</text>
						<clause commented="no" display-inline="no-display-inline" id="id8A4620E2F64540E0907FFD6BBA73797C"><enum>(i)</enum><text display-inline="yes-display-inline">consistent with the best management
			 practices; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id367003ED16924E94994806D2E81C4EDD"><enum>(ii)</enum><text display-inline="yes-display-inline">that takes into consideration the best
			 available science.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEFA8E4CB8986465892B1A91082F407C3"><enum>(B)</enum><header display-inline="yes-display-inline">Decommissioning of roads</header><text display-inline="yes-display-inline">As soon as practicable after the completion
			 date of a project the conduct of which required the construction of a temporary
			 road, the Secretary shall decommission the temporary road.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA1222D4864A54BB69213F2AD9F13E0FB"><enum>(3)</enum><header display-inline="yes-display-inline">Classification of temporary
			 roads</header><text display-inline="yes-display-inline">The Secretary may not
			 classify as permanent any temporary road described in this subsection unless
			 the Secretary constructs the permanent road in a manner consistent with
			 subsection (a).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe547a93c49ab4937a5843f007b6ed362"><enum>(c)</enum><header display-inline="yes-display-inline">Net road reduction</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID1210a72407b642259b59e5d5dc164bda"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In developing ecological restoration
			 projects under this Act, the Secretary shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id07AEDD2E2886499891BB7FBC145BD8B6"><enum>(A)</enum><text display-inline="yes-display-inline">examine opportunities for, and achieve, a
			 net reduction in the permanent road system; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65DE53A6BF144DCFBA596FB7A9777F95"><enum>(B)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, improve
			 forest and watershed health.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID163c233f6865415a8b653d8689fde1e8"><enum>(2)</enum><header display-inline="yes-display-inline">Reduction of existing roads</header><text display-inline="yes-display-inline">In decommissioning and closing nonessential
			 roads pursuant to the restoration assessment or an ecological restoration
			 project, the Secretary shall, to the maximum extent practicable, improve forest
			 and watershed health.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID4f2a1c3698a74dedadb604ca4247c957" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Eastside Forest Scientific and Technical
			 Advisory Panel</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID83a00f096fa945b2a8df5120c81fb880"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Secretary shall establish an advisory panel—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0FC513C2E8C447F8BB786944361558DE"><enum>(1)</enum><text display-inline="yes-display-inline">to be known as the <quote>Eastside Forest
			 Scientific and Technical Advisory Panel</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id196DB3E0980E4DC2B592AE12409DADFA"><enum>(2)</enum><text display-inline="yes-display-inline">to advise periodically the Secretary,
			 collaborative groups, and the public regarding the development and
			 implementation of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idEC39474C1B2C47A78EA339E2AD0FDD8F"><enum>(A)</enum><text display-inline="yes-display-inline">forest and watershed management
			 goals;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51451263E0D14D7D98D3F79F91911826"><enum>(B)</enum><text display-inline="yes-display-inline">the restoration assessment; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02AE84DB19E545D7915CEBB65BBF7A47"><enum>(C)</enum><text display-inline="yes-display-inline">ecological restoration projects.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id38F95268C5974FCA8FB1A11AD315C2EC"><enum>(b)</enum><header display-inline="yes-display-inline">Composition</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idF9D0E809FFDE4B9E9EF50BCDE0593F72"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The advisory panel shall be composed of 7
			 members, each of whom shall be appointed by the Secretary, in consultation with
			 the appropriate committees of Congress.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0445B989B117433B96C1C2AFD1DF3E3F"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idA8C42D37A0BD4BB4973BC35ECA101593"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In appointing individuals under paragraph
			 (1), the Secretary shall ensure that—</text>
						<clause commented="no" display-inline="no-display-inline" id="id875CE4BE690846C3900465F52C712781"><enum>(i)</enum><text display-inline="yes-display-inline">the advisory panel shall consist of
			 individuals representing experts recommended by an institution of higher
			 education (as defined in section 101(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20 U.S.C.
			 1001(a))) or a professional society; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa6fe787a44e74e95a57c56ce18eeae36"><enum>(II)</enum><text display-inline="yes-display-inline">wildlife ecology;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5ce5d4a323054d25904d9dca2d652c32"><enum>(III)</enum><text display-inline="yes-display-inline">aquatic and riparian ecology;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID52c3d5deb409410ca7ec7b5ea5479ad0"><enum>(IV)</enum><text display-inline="yes-display-inline">silviculture;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID819b5b00a4bc43728a4f34ccc7198a8c"><enum>(V)</enum><text display-inline="yes-display-inline">road and logging engineering;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5b89140128f84010bbdc8050b1ecdf09"><enum>(VI)</enum><text display-inline="yes-display-inline">ecological restoration;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf2b60d66141b41e7a739b5efc7e22eb2"><enum>(VII)</enum><text display-inline="yes-display-inline">wildland fire;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID372031e4e0894689a7c76479cea3eaeb"><enum>(VIII)</enum><text display-inline="yes-display-inline">ecosystem services economics;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID11d4d849ff10424a8536421b713fc137"><enum>(IX)</enum><text display-inline="yes-display-inline">timber economics;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9d3c487fd8bb4f7ca517729b78adb0e2"><enum>(X)</enum><text display-inline="yes-display-inline">invasive species;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc0d598e9d941436fab5b7b2be01c507c"><enum>(XI)</enum><text display-inline="yes-display-inline">soil science and geology;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6f926c2e572a497b9a1f0950ce1a6363"><enum>(XII)</enum><text display-inline="yes-display-inline">water quantity and water quality;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDaf3bb2d1178247b8bcaf40771caec8b8"><enum>(XIII)</enum><text display-inline="yes-display-inline">hydrology; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd74efd79e7bf4cd085502ae29fca376e"><enum>(XIV)</enum><text display-inline="yes-display-inline">forest carbon life-cycle.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89D03C6CD7E54FFC8505B0719A311ADB"><enum>(B)</enum><header display-inline="yes-display-inline">Goals of Secretary</header><text display-inline="yes-display-inline">In appointing individuals under paragraph
			 (1), the Secretary shall ensure that the collective appointment of the
			 individuals will result in—</text>
						<clause commented="no" display-inline="no-display-inline" id="id144F18F8F24F4CAB9C54CE6A6D5D8227"><enum>(i)</enum><text display-inline="yes-display-inline">the representation of a broad array of
			 fields described in subparagraph (A)(ii); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id89FFD91342E94C7A99ABAC76A1078722"><enum>(ii)</enum><text display-inline="yes-display-inline">through the collaboration of the
			 individuals appointed under paragraph (1) with scientific, professional, or
			 technical experts, a broad coverage of the fields described in subparagraph
			 (A)(ii).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDed7e0e0be2cb443f91cee0d1b31a1e30"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id72742F74DABE4A1A889C155E84B5880F"><enum>(1)</enum><header display-inline="yes-display-inline">Recommendations report</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4B9ABB7DBC8845CDAA589CDB5942FC2D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on
			 which the Secretary establishes the advisory panel under subsection (a), the
			 advisory panel shall submit to the Secretary and make available to the public a
			 report that contains recommendations regarding the manner by which the
			 Secretary may best achieve the goals described in section 4(a)(1).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD765EF74F60F4F90A680ABEA326432BE"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the
			 advisory panel shall ensure that the recommendations contained in the
			 report—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7EC493264FD44D96823D1345F5A9AE12"><enum>(i)</enum><text display-inline="yes-display-inline">are based on the best available science;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2C7923D5720041259E2D028BA57EF1DA"><enum>(ii)</enum><text display-inline="yes-display-inline">provide management guidance to the
			 Secretary regarding—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID602f8b7d672848cdaa73cbf695c77bac"><enum>(I)</enum><text display-inline="yes-display-inline">various plant association groups;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5cd485f982f84c9f88d65259c3ca0a3d"><enum>(II)</enum><text display-inline="yes-display-inline">the differing qualities to be protected and
			 restored in each plant association group;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDba94109f63d54b38ac2a0e866dbfb531"><enum>(III)</enum><text display-inline="yes-display-inline">terrestrial, aquatic, riparian, wildlife,
			 fish, vegetation, soil, carbon, and other resources to be protected;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5dff73f4e9f24a149299ee245d2e8d11"><enum>(IV)</enum><text display-inline="yes-display-inline">the types of restoration necessary and
			 desirable to restore forest and watershed health (including thinning,
			 prescribed and natural fire, and other appropriate activities);</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDcaa37d8ec5f5452e8a412532a82a63cd"><enum>(V)</enum><text display-inline="yes-display-inline">instances during which the cutting of trees
			 described in section 4(b)(3)(A) would generally be considered to be
			 scientifically appropriate;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3fa9bb51513346b29fcea1c7b2783ff3"><enum>(VI)</enum><text display-inline="yes-display-inline">instances during which the cutting of trees
			 described in section 4(b)(2) would generally not be considered to be
			 scientifically appropriate; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID13f11281c6b442a8ac5f47f19ba5b292"><enum>(VII)</enum><text display-inline="yes-display-inline">the size and scope of necessary interim,
			 experimental, and ecological restoration projects.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb2407acbd6f94fdebf635063415d3ddf"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8903787F7DBF4F459F740A609B86DBD1"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), to the maximum
			 extent practicable, the advisory panel shall achieve a consensus with respect
			 to each recommendation included in the report under paragraph (1).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46B14AFDD8D1437792F46A222E1B1A33"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion of dissenting
			 opinions</header><text display-inline="yes-display-inline">If the advisory
			 panel fails to achieve a consensus with respect to any recommendation included
			 in a report under paragraph (1), the advisory panel shall include in the report
			 each dissenting opinion relating to the recommendation to enable the Secretary
			 to consider each opinion in making a management determination.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID269ca8d84b71434ca9b5ae297c1bbf4e"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID4a8fdcaffa60441dafa505dc23ecae7d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of
			 enactment of this Act, the advisory panel shall submit to the appropriate
			 committees of Congress a report that contains—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3F339D3DA6B240828E3D634F1A60BBA0"><enum>(A)</enum><text display-inline="yes-display-inline">an evaluation by the advisory panel with
			 respect to the implementation and effectiveness of this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8140BB1CF9C41E89034E439CDAC1632"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations to improve the
			 implementation or effectiveness of this Act (including any appropriate
			 legislative action) to further the purposes and goals of this Act.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce2cc4be52044f02a65bc729340ef184"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In preparing the report under paragraph
			 (1), the advisory panel shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID4450a55637f0409997b13db7fc9e2133"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an assessment regarding the
			 implementation and effectiveness of this Act with respect to—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID2af0a3a5b49b473d8c077c990aa3cb9e"><enum>(i)</enum><text display-inline="yes-display-inline">quantitative and qualitative improvements
			 to forest and watershed health, including resiliency, aquatic function, and the
			 restoration of plant composition, structure, and function in the covered
			 area;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDbcbe0976dab349db94cba2147a873c41"><enum>(ii)</enum><text display-inline="yes-display-inline">the development of—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id2C56BDD26CAE48D498BFC0338BE38397"><enum>(I)</enum><text display-inline="yes-display-inline">ecological restoration projects;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID96199f0037164436b275035bf0d204c1"><enum>(II)</enum><text display-inline="yes-display-inline">landscape scale planning efforts;
			 and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3aa8dd6c17b64c1fb53573d8dd3cf780"><enum>(III)</enum><text display-inline="yes-display-inline">biomass utilization; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDf9cf9375c9d14480aa4bc6d20e32a421"><enum>(iii)</enum><text display-inline="yes-display-inline">the maintenance of industry infrastructure;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4e74c54ae6c9461bad9ff525141b3e81"><enum>(B)</enum><text display-inline="yes-display-inline">determine whether tree protection criteria
			 not based on a diameter limitation would provide a stronger ecological basis
			 for cutting prohibitions, including whether switching to age-based or other
			 criteria would—</text>
						<clause commented="no" display-inline="no-display-inline" id="idBB951124B9CB40ED89086C9F085C72E8"><enum>(i)</enum><text display-inline="yes-display-inline">be feasible to administer; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idE4688AD2F0C046ABB2E539DD478373EB"><enum>(ii)</enum><text display-inline="yes-display-inline">provide a more scientifically sound basis
			 to protect forest and watershed health.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0b6e7393236545319303af5781ff896c"><enum>(e)</enum><header display-inline="yes-display-inline">Public comment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id8BE139C129EF4891952DA7D729414ADD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 receipt of the report under subsection (d)(1), the Secretary shall provide to
			 the public notice and an opportunity to comment on the report.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B1C94544D074682B382807F24032BBD"><enum>(2)</enum><header display-inline="yes-display-inline">Summary of comments</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 receipt of the report under subsection (d)(1), the Secretary shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id2961B2C96E4C4CA39112BB459F47E176"><enum>(A)</enum><text display-inline="yes-display-inline">prepare a detailed summary of the comments
			 received under paragraph (1);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBB14A156E0C4290BBF6DEA8A10B7AB4"><enum>(B)</enum><text display-inline="yes-display-inline">submit in the report described in
			 subsection (d)(1) the summary described in subparagraph (A); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9db59ef282f14721a5800ed222170d14"><enum>(C)</enum><text display-inline="yes-display-inline">make available to the public the report and
			 the summary in a variety of sources, including online.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID6b177b309a054b63b9a5ded1fb672fbd" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Eastside Landscape Forest Restoration
			 Assessment</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID4a7bd4daebb94a8d8aa1adb983b754d0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, in consultation with each applicable collaborative
			 group, the Secretary shall prepare an assessment to be known as the
			 <quote>Eastside Landscape Forest Restoration Assessment</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID620ac5cb9dbc4ee2a913fcef4ad3dbb3"><enum>(b)</enum><header display-inline="yes-display-inline">Restoration assessment</header><text display-inline="yes-display-inline">In preparing the restoration assessment,
			 the Secretary shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe5b8651632d047a4b42e584f6323d7f8"><enum>(1)</enum><text display-inline="yes-display-inline">consider—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAE8F9D683AA14A4BAFE1DB7C4BDF4326"><enum>(A)</enum><text display-inline="yes-display-inline">the best available science; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id178949842A0646DDA372A70AEDAC9999"><enum>(B)</enum><text display-inline="yes-display-inline">each applicable recommendation provided by
			 the advisory panel;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7F86C7D15E9B405A9221430762864E34"><enum>(2)</enum><text display-inline="yes-display-inline">consider and address forest and watershed
			 health by plant association group or watershed;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID12cc0f47e83c4039920697064e458470"><enum>(3)</enum><text display-inline="yes-display-inline">characterize the health of forests and
			 watersheds;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59DC39CC56B24E068FB8755905C54853"><enum>(4)</enum><text display-inline="yes-display-inline">identify any measure necessary to restore
			 forest and watershed health;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaec22749349542779062c8ace535f823"><enum>(5)</enum><text display-inline="yes-display-inline">identify 1 or more proposed ecological
			 restoration project areas;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID00c815e329834db1ba99b3e6b976e92e"><enum>(6)</enum><text display-inline="yes-display-inline">assess the road network in existence as of
			 the date of enactment of this Act to determine present and future needs, based
			 on consideration of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id79CC926121024BE185145899E219288C"><enum>(A)</enum><text display-inline="yes-display-inline">projected funding levels; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6475B768784E4BC5AF39225F16E5B8E1"><enum>(B)</enum><text display-inline="yes-display-inline">methods to hydrologically and ecologically
			 restore land and water by—</text>
						<clause commented="no" display-inline="no-display-inline" id="id74C105EA9E4141B9B07D7033B2498E88"><enum>(i)</enum><text display-inline="yes-display-inline">decommissioning unnecessary and undesirable
			 roads; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id20563A8BECD746ACA4C269AD576337FB"><enum>(ii)</enum><text display-inline="yes-display-inline">reducing the environmental impact of
			 necessary and desirable roads;</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa3612fdd0fee49f9a148676699391cfb"><enum>(7)</enum><text display-inline="yes-display-inline">establish baseline, ecological, economic,
			 and social conditions;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce2df8d07fb042d8947047b12981617f"><enum>(8)</enum><text display-inline="yes-display-inline">prioritize restoration needs and ecological
			 restoration project areas; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce2adc5202ca45189a60e2c07a4687e5"><enum>(9)</enum><text display-inline="yes-display-inline">evaluate local infrastructure, workforce
			 capacity needs, and local economic value potential relating to comprehensive
			 forest restoration.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5943B2E1B3F846D4978AE716F6AF58DD"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id41486A45321244B9808AF77458B9EDCB"><enum>(1)</enum><header display-inline="yes-display-inline">Restoration plan</header><text display-inline="yes-display-inline">The restoration assessment shall contain a
			 10-year restoration plan that is comprised of activities the conduct of which
			 will provide for the comprehensive ecological restoration of forest and
			 watershed health.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67652D465BE442DC9728043202CAA98F"><enum>(2)</enum><header display-inline="yes-display-inline">Consistency</header><text display-inline="yes-display-inline">The Secretary shall prepare the restoration
			 assessment in a manner consistent with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idEBA6DBF070A84267947391E2F70308BB"><enum>(A)</enum><text display-inline="yes-display-inline">the purposes of this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4529506055C34F47B7B43FD162AF668F"><enum>(B)</enum><text display-inline="yes-display-inline">the goals described in section 4(a);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF70D99D9EDD4E2CAFAFFB90ECD6BDD6"><enum>(C)</enum><text display-inline="yes-display-inline">sections 5 and 6;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F2BDA9777514B8FACCD44223F515C30"><enum>(D)</enum><text display-inline="yes-display-inline">any appropriate guidance provided to the
			 Secretary by the advisory panel; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id896EF507E97B4112B84DDBFC8E035C48"><enum>(E)</enum><text display-inline="yes-display-inline">any other applicable law (including
			 regulations).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id12F24BFA55C74131889FC75C182E7E3D"><enum>(d)</enum><header display-inline="yes-display-inline">Public
			 comment</header><text display-inline="yes-display-inline">In preparing the
			 restoration assessment, the Secretary shall provide to the public—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD4FCC78E58904B3D82016947B06454B7"><enum>(1)</enum><text display-inline="yes-display-inline">a draft copy of the restoration assessment;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC5744CD1CE804BDC8AC2BE062B5A576B"><enum>(2)</enum><text display-inline="yes-display-inline">notice and an opportunity to comment on the
			 draft copy of the restoration assessment.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8981df5d33354091bd6d93080c500e1d"><enum>(e)</enum><header display-inline="yes-display-inline">Effect on forest plans</header><text display-inline="yes-display-inline">Each forest plan shall incorporate the
			 findings of the restoration assessment as each forest plan is revised or
			 amended.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID6d5bd80b30074d84bc06dc97032b03dd" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Ecological restoration projects</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8e499edd13e34933be9dd8b3ff2d7473"><enum>(a)</enum><header display-inline="yes-display-inline">Ecological restoration projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id27C6689FB50E4C73A48891A68A36BC17"><enum>(1)</enum><header display-inline="yes-display-inline">Implementation of projects</header><text display-inline="yes-display-inline">As soon as practicable after the date of
			 enactment of this Act, in accordance with the restoration assessment, and in
			 consultation with the each appropriate collaborative group, the Secretary shall
			 prepare, approve, and implement 1 or more ecological restoration
			 projects.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID70c7510f89a14d5ba540693d061fed02"><enum>(2)</enum><header display-inline="yes-display-inline">Use of projects</header><text display-inline="yes-display-inline">The Secretary shall use landscape scale
			 planning for ecological restoration projects in the covered area.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ca1e137d6f94aa0b09d702dc7814c25"><enum>(3)</enum><header display-inline="yes-display-inline">Boundaries</header><text display-inline="yes-display-inline">To the maximum extent practicable, in
			 defining a landscape located in the covered area, the Secretary shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id57EF1CF3A1284F18B0B637DE69713DD6"><enum>(A)</enum><text display-inline="yes-display-inline">use natural geographical and biological
			 boundaries; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id187B196322724ACAB77ED5E88DA0C016"><enum>(B)</enum><text display-inline="yes-display-inline">collaborate across administrative
			 boundaries as appropriate.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1110de8e8f4742b3a7572ff248ea0b28"><enum>(4)</enum><header display-inline="yes-display-inline">Prioritization</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID24b4a9d4b091482cb461be4db3b639a2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with subparagraph (B), the
			 Secretary shall prioritize ecological restoration projects based on the degree
			 to which the ecological restoration project would improve forest and watershed
			 health, based on—</text>
						<clause commented="no" display-inline="no-display-inline" id="idF8232A5B381E4621B7BBC573FF39E746"><enum>(i)</enum><text display-inline="yes-display-inline">dry and moist forest plant association
			 groups; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAAC6A6227B194060AE51E0739F73DDBF"><enum>(ii)</enum><text display-inline="yes-display-inline">the need to maintain the industry
			 infrastructure that is necessary to carry out restoration activities under this
			 Act.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1e7bb1c1044d411eaed877b43b59b95c"><enum>(B)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the
			 Secretary shall consider the best available science and data in developing
			 projects and activities that would—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID0b94d707c942400582b27e7428d5a308"><enum>(i)</enum><text display-inline="yes-display-inline">minimize and reduce the risk of
			 uncharacteristic fire and insect outbreaks, particularly if critical components
			 and values are at risk, including—</text>
							<subclause commented="no" display-inline="no-display-inline" id="IDe40459d4016b4feaa307131a96768a0f"><enum>(I)</enum><text display-inline="yes-display-inline">communities located in the applicable
			 wildland-urban interface; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID70681b3991d049e4aa9810340df88fae"><enum>(II)</enum><text display-inline="yes-display-inline">valuable forest structures (including old
			 growth and older mature trees);</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDc3bc8290dc3c4b6c88ef8fa8c45a7cf4"><enum>(ii)</enum><text display-inline="yes-display-inline">restore historic stand structure and
			 composition;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idD7B482C1B47B414E81A6BE047AE268CD"><enum>(iii)</enum><text display-inline="yes-display-inline">improve the fire resiliency of the
			 stand;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID67642ec01ca945b0bb872ca01074e000"><enum>(iv)</enum><text display-inline="yes-display-inline">accelerate development of complex forest
			 structure in a young forest that has been simplified through past management,
			 including opportunities—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id1E977F697B9748878803B0B2744C698A"><enum>(I)</enum><text display-inline="yes-display-inline">to create spatial heterogeneity (including
			 the creation of skips and gaps) using mechanical treatments to create wildlife
			 habitat; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id64F878E3B35B41E2ADE1A5171EBF8DB4"><enum>(II)</enum><text display-inline="yes-display-inline">to retain biological legacies (including
			 large standing, downed, live, and dead trees);</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID0b9e469786ef41b1a671c6a3aba1c293"><enum>(v)</enum><text display-inline="yes-display-inline">assist in the implementation of community
			 wildfire protection plans developed by at-risk communities (as those terms are
			 defined in section 101 of the Healthy Forests Restoration Act of 2003 (16
			 U.S.C. 6511));</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID2e927724e46f41568576f1e485c66161"><enum>(vi)</enum><text display-inline="yes-display-inline">prioritize hazardous fuels reduction and
			 vegetation management efforts to forest stands at a high or moderate departure
			 from the historical range of variability; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDaa79d5cf7ccb4a60bd342a82b9c50323"><enum>(vii)</enum><text display-inline="yes-display-inline">use the value of merchantable sawlogs and
			 biomass to help offset the cost of ecological restoration activities.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1467256684084749999515e09606f263"><enum>(b)</enum><header display-inline="yes-display-inline">Expected outcome</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id3D8D983BB0FC45D18C2368EE67E634B0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall ensure that each forest
			 located in the covered area shall be the subject of not less than 1 ecological
			 restoration project that provides landscape scale work covering a gross
			 planning area of not less than 25,000 acres per year by the earlier of the date
			 that is—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5D4D51A4646542568F0B09D0B634D97C"><enum>(A)</enum><text display-inline="yes-display-inline">1 year after the date of completion of the
			 restoration assessment; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9F1F53AE331348A89CAF18ED56D496FD"><enum>(B)</enum><text display-inline="yes-display-inline">3 years after the date of enactment of this
			 Act.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D5AC1225C484314A61F63E42A3B7737"><enum>(2)</enum><header display-inline="yes-display-inline">Project requirements</header><text display-inline="yes-display-inline">Each project described in paragraph (1)
			 shall provide a minimum quantity of timber based on the need to maintain a
			 sustainable industrial capacity to perform the ecological restoration
			 activities under this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd08ce188569f4e32a375c0c8d4c3be2c"><enum>(3)</enum><header display-inline="yes-display-inline">Periodic reports</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idDE9F9BFAE1744AEFB198B107C0337B40"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act and each year thereafter until the date on which the
			 interim period described in subsection (c) is concluded, the Secretary shall
			 submit to Congress a report on the progress of the restoration assessment and
			 the steps taken toward implementing ecological restoration projects.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8CB1DB9BE6A343108F6820843974375E"><enum>(B)</enum><header display-inline="yes-display-inline">Interim
			 period</header><text display-inline="yes-display-inline">If the period
			 beginning on the date of enactment of this Act and ending on the date on which
			 the interim period described in subsection (c) is concluded is expected to
			 exceed 3 years, the Secretary shall include in the applicable reports under
			 subparagraph (A)—</text>
						<clause commented="no" display-inline="no-display-inline" id="id8C03D4F7A44743FC81306F2468263576"><enum>(i)</enum><text display-inline="yes-display-inline">an explanation of the reasons for
			 noncompliance with the deadlines established under this Act; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id290A363842BD45E5BDC17B9399E1931B"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of further actions that are
			 necessary to implement this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID280c202e78f24e758e3d658d58397e6c"><enum>(c)</enum><header display-inline="yes-display-inline">Interim projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3ec8461979ca46d38121435123f4f4d2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Until the date on which the Secretary
			 initiates mechanical treatments under an ecological restoration project in an
			 applicable National Forest (after the date of completion of a restoration
			 assessment with respect to the ecological restoration project), the Secretary
			 shall prepare, approve, and implement interim projects for all vegetation
			 management contracts (including commercial timber sales and stewardship
			 contracts) for the National Forest that are consistent with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID4500e17e5c534f5f80a1814081ee2fa3"><enum>(A)</enum><text display-inline="yes-display-inline">the prohibition on removal of certain trees
			 under section 4(b);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdbfcb8f8492b490ca9715e959992cace"><enum>(B)</enum><text display-inline="yes-display-inline">each limit on activities carried out within
			 a riparian conservation area described in section 5(a);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9d1b5f82bf294e36b29692cc0c380551"><enum>(C)</enum><text display-inline="yes-display-inline">each limitation relating to permanent and
			 temporary roads under section 6; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3126c768cc15423aa04149f31099c420"><enum>(D)</enum><text display-inline="yes-display-inline">each recommendation of the advisory panel
			 determined by the Secretary to be appropriate for the interim project.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa5015f27114c434d838620e331cd1bff"><enum>(2)</enum><header display-inline="yes-display-inline">Appeals</header><text display-inline="yes-display-inline">Until the date on which the Secretary
			 initiates mechanical treatments under an ecological restoration project within
			 an applicable National Forest located in the covered area, the conduct of an
			 interim project shall not be subject to any administrative appeal.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5AC4C3AEC3D2489CBF5825E20B5F78E7"><enum>(3)</enum><header display-inline="yes-display-inline">Final decision of Secretary</header><text display-inline="yes-display-inline">The final decision of the Secretary with
			 respect to any interim project shall be considered to be a final agency action
			 for the purpose of subchapter II of chapter 5, and chapter 7, of title 5,
			 United States Code (commonly known as the <quote>Administrative Procedure
			 Act</quote>).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4D6D944A78C48A5BE7A875BB5484457"><enum>(4)</enum><header display-inline="yes-display-inline">Review period</header><text display-inline="yes-display-inline">Not earlier than the date that is 35 days
			 after the date on which the Secretary makes a final decision with respect to an
			 interim project, ground or vegetation disturbing activities may be commenced
			 under the project.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf9271871cfc1434d9d645837842b4d71"><enum>(5)</enum><header display-inline="yes-display-inline">Implementation of interim projects</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID17791ac639db4ca59beb281cfa225a5f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each fiscal year until the date on
			 which the Secretary initiates mechanical treatments under an ecological
			 restoration project within each National Forest located in the covered area, to
			 address immediately concerns regarding forest health and the maintenance of
			 industry infrastructure to carry out ecological restoration projects under this
			 Act, to the maximum extent practicable, the Secretary shall prepare, offer, and
			 promptly implement 1 or more interim projects, or other projects, that—</text>
						<clause commented="no" display-inline="no-display-inline" id="idE117527C740A4E519F3C41F78478122F"><enum>(i)</enum><text display-inline="yes-display-inline">are predominantly comprised of mechanical
			 treatment in the covered area—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id4383CE20A6BE4177BF273A7181B7F3DA"><enum>(I)</enum><text display-inline="yes-display-inline">for the first fiscal year after the date of
			 enactment of this Act, on not less than 80,000 acres;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idFF53773B0D2E44B6B484DD39197687FC"><enum>(II)</enum><text display-inline="yes-display-inline">for the subsequent fiscal year, on not less
			 than 100,000 acres; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id327A8F03A3A144A4A7C7A7480152A78D"><enum>(III)</enum><text display-inline="yes-display-inline">for the subsequent fiscal year, on not less
			 than 120,000 acres; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id758E949B18DC4AAEB0D647606862EA95"><enum>(ii)</enum><text display-inline="yes-display-inline">emphasize sawtimber as a byproduct.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1EFB07826514EB29556B6A9D4D136CC"><enum>(B)</enum><header display-inline="yes-display-inline">Preparation activities</header><text display-inline="yes-display-inline">Until the date described in subparagraph
			 (A), the Secretary shall prioritize vegetation management, timber management,
			 and hazardous fuels reduction program activities within the covered area to
			 prepare, offer, and promptly implement interim projects in each National Forest
			 described in subparagraph (A).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfcb781072fce4916a2d5ff0c9cb4b055"><enum>(C)</enum><header display-inline="yes-display-inline">Location of treated acres</header><text display-inline="yes-display-inline">To the maximum extent practicable, the
			 Secretary shall distribute the total number of acres of the treatment required
			 under subparagraph (A) based on the proportion that—</text>
						<clause commented="no" display-inline="no-display-inline" id="id1296B619558D4D0E831701D2ECCDE69B"><enum>(i)</enum><text display-inline="yes-display-inline">the quantity of acres of forest land within
			 the covered area at risk of uncharacteristic disturbances from fire, insects,
			 and disease outside of inventoried roadless areas in each National Forest;
			 bears to</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id7A7C22A1197A48F18F0B82D763E77B20"><enum>(ii)</enum><text display-inline="yes-display-inline">the total quantity of acres of forest land
			 within the covered area so at risk outside of those inventoried roadless
			 areas.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDfd9581ce3c1a4c179ba5a1067cd2bcd4"><enum>(d)</enum><header display-inline="yes-display-inline">Experimental ecological restoration
			 projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id5562AB79B30448F2BAF7DCE527575704"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of
			 enactment of this Act, the Secretary shall prepare experimental ecological
			 restoration projects that are designed to use an age limitation that prohibits
			 the harvest of any tree the age of which is greater than 150 years.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB551C35B55E5495AA01216D494DCA955"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability of cutting
			 limitation</header><text display-inline="yes-display-inline">The cutting
			 limitation described in section 4(b) shall not apply to any ecological
			 restoration project carried out under this subsection.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF1936501FC8C4F88A0EDF4376D0B5876"><enum>(3)</enum><header display-inline="yes-display-inline">Protocol</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4748E6CFF440483E92289AA99B0015CA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with subparagraph (B), to
			 develop ecological restoration projects under this subsection, the Secretary
			 shall establish a protocol to efficiently identify tree age.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6B5D205B6B144377AA9CD51D82924F85"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In establishing the protocol under
			 subparagraph (A), the Secretary shall consider—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB8893300CE3C4341BD04F3E6B554CB65"><enum>(i)</enum><text display-inline="yes-display-inline">sampling trees within stands;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idFC41B2197F8448F190CA000D722CBF1A"><enum>(ii)</enum><text display-inline="yes-display-inline">establishing standards for use in
			 determining which stands meet applicable age definitions; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8CB1110812E44A3C8DDB26FB1412EFC9"><enum>(iii)</enum><text display-inline="yes-display-inline">providing for a review by the advisory
			 panel.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55DB5C55743D42F3B44C904828BA7795"><enum>(4)</enum><header display-inline="yes-display-inline">Conduct of projects</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC0B1BD9CDA824B0B9ECA68CB1E31651B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date
			 described in paragraph (1), in accordance with subparagraph (B), in
			 coordination with representatives of private industry and each applicable
			 collaborative group, the Secretary shall implement trial projects.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEB8BD1A8C8A8480E8251C9C6ADC619E6"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The Secretary shall design and carry out
			 each trial project in accordance with recommendations provided to the Secretary
			 by the advisory panel to generate data to assist the advisory panel in
			 preparing the review required under section 7(d).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD53BD759B2DA4D59A5B9EA1C7B8E85BC"><enum>(C)</enum><header display-inline="yes-display-inline">Use of data</header><text display-inline="yes-display-inline">The Secretary shall use data resulting from
			 the conduct of the trial projects—</text>
						<clause commented="no" display-inline="no-display-inline" id="id5D6EB417703A4B7BA9BF2957532D4ACC"><enum>(i)</enum><text display-inline="yes-display-inline">to examine the feasibility of implementing
			 age limits at a broader scale; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAD034606FA3B40E4A52C0E03D7D62154"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide recommendations regarding the
			 manner by which future projects may be carried out more efficiently.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D1F8F70B3A446BCA184FA19B4CD5834"><enum>(D)</enum><header display-inline="yes-display-inline">Periodic reports</header><text display-inline="yes-display-inline">The Secretary shall periodically submit to
			 the advisory panel a report describing the data described subparagraph (B) for
			 use in the review required under section 7(d).</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID280eba52490d4f24940e7a0406cb3c1e" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Collaboration</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID7d733027cbe44e4f919726713033da1d"><enum>(a)</enum><header display-inline="yes-display-inline">Collaborative groups</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5de644dabe4248e3b53f401126048d62"><enum>(1)</enum><header display-inline="yes-display-inline">Encouragement</header><text display-inline="yes-display-inline">The Secretary shall encourage the
			 establishment and maintenance of new and existing collaborative groups to
			 assist in—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB35C61B494EE4982AF02F0CF2968381E"><enum>(A)</enum><text display-inline="yes-display-inline">the development and implementation of the
			 restoration assessment and ecological restoration projects; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC332A2CF7CBB47D5AFA8D4E177B8D8BD"><enum>(B)</enum><text display-inline="yes-display-inline">the implementation of this Act.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE5BC324A01BF44C9B036D3C8AB90E01C"><enum>(2)</enum><header display-inline="yes-display-inline">Recognition</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4398FA10B7D745DC838E373728CE782F"><enum>(A)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be considered by the Secretary to be a
			 recognized collaborative group for a specific area that is the subject of an
			 activity under this Act, a collaborative group shall submit to the Secretary an
			 application at such time, in such manner, and containing such information as
			 the Secretary may require.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID426200ba49374525bc2e7fd50648fbba"><enum>(B)</enum><header display-inline="yes-display-inline">Standards for recognition</header><text display-inline="yes-display-inline">To recognize a collaborative group under
			 subparagraph (A), the Secretary shall ensure that the collaborative
			 group—</text>
						<clause commented="no" display-inline="no-display-inline" id="idB5CE60A7B2464294A52CCFD640AF9AED"><enum>(i)</enum><text display-inline="yes-display-inline">represents multiple interested individuals
			 who, in the aggregate, are comprised of diverse backgrounds and represent
			 various interests that include (at a minimum)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID14555444684a40599e1227ea403e4553"><enum>(I)</enum><text display-inline="yes-display-inline">environmental organizations;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd42602ca4f754431a2499ab4e8167b87"><enum>(II)</enum><text display-inline="yes-display-inline">timber and forest products industry
			 representatives; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7c9b97ae24d944e2a7b5c931d8dd7a4f"><enum>(III)</enum><text display-inline="yes-display-inline">county governments (including an alternate
			 designated community representative);</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idCDEA9CCE525E4389B2D022A43EF43244"><enum>(ii)</enum><text display-inline="yes-display-inline">operates—</text>
							<subclause commented="no" display-inline="no-display-inline" id="IDff899ed3151248c8b2d0ea92d79c4f85"><enum>(I)</enum><text display-inline="yes-display-inline">in a transparent and nonexclusive manner;
			 and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id3176434697584C10B03C78F078EF4FB9"><enum>(II)</enum><text display-inline="yes-display-inline">by consensus or in accordance with voting
			 procedures to ensure a high degree of agreement among participants and across
			 various interests; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID36ee818ff3d44faf8822690a2dd3ffec"><enum>(iii)</enum><text display-inline="yes-display-inline">requires a level of participation
			 sufficient to ensure that members of the collaborative group are adequately
			 informed before each vote.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbe4bf857f829424588507cae6a58801d"><enum>(C)</enum><header display-inline="yes-display-inline">Withdrawal of official recognition</header>
						<clause commented="no" display-inline="no-display-inline" id="idA75B869AE0244DB2AD923D0F51B90317"><enum>(i)</enum><header display-inline="yes-display-inline">Review of complaints</header><text display-inline="yes-display-inline">The Secretary shall promptly review any
			 complaint brought by any member of the public that alleges that a collaborative
			 group recognized under subparagraph (A) has failed to meet any requirement
			 described in subparagraph (B).</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id3252A6C3C9F14F15B29D717DBFD7E7E6"><enum>(ii)</enum><header display-inline="yes-display-inline">Effect of determination</header><text display-inline="yes-display-inline">If the Secretary determines that an
			 allegation possesses adequate merit, the Secretary shall withdraw the
			 recognition of the collaborative group.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID590ae3360f3e487eaabda1c94fd5391c"><enum>(3)</enum><header display-inline="yes-display-inline">Public participation</header><text display-inline="yes-display-inline">The Secretary shall provide to the public
			 notice and an opportunity for comment regarding each proposed—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3C210D37664A454A82E0ED441EA382F8"><enum>(A)</enum><text display-inline="yes-display-inline">recognition of a collaborative group;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56F71D06C6F84C1C84EA6837889ED0BE"><enum>(B)</enum><text display-inline="yes-display-inline">withdrawal of recognition of a
			 collaborative group.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa4151a759fee4fa4882a274e5f8d9a2c"><enum>(4)</enum><header display-inline="yes-display-inline">Role of collaborative groups</header><text display-inline="yes-display-inline">In carrying out this Act, the Secretary
			 shall consider the recommendations of each collaborative group recognized under
			 paragraph (2).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID19526310dc834815a953180fb37b90d3"><enum>(5)</enum><header display-inline="yes-display-inline">Multiparty monitoring</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id2FB008964DA049BE8EA69C4023861ABB"><enum>(A)</enum><header display-inline="yes-display-inline">Authority of collaborative
			 groups</header><text display-inline="yes-display-inline">Each collaborative
			 group may monitor and evaluate each ecological restoration project carried out
			 under this Act.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE9278BC6AD884B55A1F98E8E7E86E2D8"><enum>(B)</enum><header display-inline="yes-display-inline">Scope of evaluation</header><text display-inline="yes-display-inline">In carrying out an evaluation under
			 subparagraph (A), a collaborative group may assess each aspect of the
			 ecological restoration project, including—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7B3C35A51AA248F5B6F9DEC44CF2BC3D"><enum>(i)</enum><text display-inline="yes-display-inline">the status of the development, execution,
			 and administration of the ecological restoration project;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id0E7218BB3D794004813DCA20813374AD"><enum>(ii)</enum><text display-inline="yes-display-inline">each specific accomplishment that has
			 resulted from the ecological restoration project; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id860B4373C2E54B61A97004874921590F"><enum>(iii)</enum><text display-inline="yes-display-inline">each ecological, economic, and social
			 benefit, and the cost, to local communities and the Federal Government
			 resulting from the ecological restoration project.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF338898B658046D1AA53455AAC518B03"><enum>(C)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">A collaborative group may submit to the
			 advisory panel a report containing the results of the evaluation of the
			 ecological restoration project that is the subject of the evaluation.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDd74ee98e034d48fa8d3f3c82c36b0192" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Environmental analysis and expedited
			 administrative review</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID529cc4daa5cd4e7581a1d75a74c8678d"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to each ecological restoration
			 project carried out in the covered area under this Act, the Secretary shall be
			 subject to each time line and process described in this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe35fb55353c24fbb866fecce8f416024"><enum>(b)</enum><header display-inline="yes-display-inline">Environmental analysis</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idF5B1B10989314AF0964CFE856FE90D6E"><enum>(1)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Each ecological restoration project carried
			 out under this Act shall be subject to the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
			 U.S.C. 4321 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA13C930BA3ED400FB361A714F0003B50"><enum>(2)</enum><header display-inline="yes-display-inline">Duty of Secretary</header><text display-inline="yes-display-inline">If the Secretary prepares for an ecological
			 restoration project an environmental impact statement or similar analysis
			 required under the <act-name parsable-cite="NEPA69">National Environmental
			 Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.), the Secretary shall, to
			 the maximum extent practicable, prepare an environmental impact statement in a
			 manner to ensure that not more than 1 statement is necessary.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe863a78356fb431abc3bb9949c86b623"><enum>(c)</enum><header display-inline="yes-display-inline">Public notice and comment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDdf307700360048d69d59e57677ac7b32"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Before the beginning of the public comment
			 period described in paragraph (4), the Secretary shall consult with
			 collaborative groups in developing ecological restoration projects.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0CE5680CEC7D49C38C1ADB302FBD9322"><enum>(2)</enum><header display-inline="yes-display-inline">Scoping documents</header><text display-inline="yes-display-inline">The Secretary shall provide informative
			 scoping documents to facilitate early and effective public involvement and
			 collaboration.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9E1FB61FB14B4E4484A0517606843A64"><enum>(3)</enum><header display-inline="yes-display-inline">Public notice</header><text display-inline="yes-display-inline">To provide adequate notice to the public
			 during the scoping period, the Secretary shall, to the maximum extent
			 practicable, include the purpose and need, proposed action, each potential
			 issue, adequate maps, and any other necessary documentation to help the public
			 understand and comment on the location of proposed treatments, and the scope of
			 each ecological restoration project, under this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14707e597de24b2ebdeaa774746b3abb"><enum>(4)</enum><header display-inline="yes-display-inline">Public comment</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id6D67A5A9FA4447E3AC3B9B41A64CA350"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with subparagraph (B), the
			 Secretary shall provide notice and an opportunity for public comment on each
			 draft environmental impact statement or similar analysis prepared by the
			 Secretary under subsection (b)(2).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA62A7461464543368956874ECC4B9248"><enum>(B)</enum><header display-inline="yes-display-inline">Comment periods</header><text display-inline="yes-display-inline">In providing a period for public comment
			 under subparagraph (A), the Secretary shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="idBE1EDEF927DE43C5A9CEFD154004012E"><enum>(i)</enum><text display-inline="yes-display-inline">for each categorical exclusion, provide a
			 period of not less 15 days;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id7C57BF55D3E74EA6B937CFBDE75CE631"><enum>(ii)</enum><text display-inline="yes-display-inline">for each environmental assessment, provide
			 a period of not less than 30 days; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id4EAB087377F544A69D9FCB8CBC6767B1"><enum>(iii)</enum><text display-inline="yes-display-inline">for each environmental impact statement,
			 provide a period of not less than 45 days.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8f198af301a4dd18211793bf3c4101d"><enum>(5)</enum><header display-inline="yes-display-inline">Preparation of final document</header><text display-inline="yes-display-inline">After taking into consideration each
			 comment received under paragraph (4), and the recommendations of each
			 applicable collaborative group, with respect to the ecological restoration
			 project, the Secretary shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAE78BED0717F4642A5C5A7FDF29B7527"><enum>(A)</enum><text display-inline="yes-display-inline">prepare a final document under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.) covering the ecological restoration
			 project; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAFD1D4FFBC9E48709A54072556DC310E"><enum>(B)</enum><text display-inline="yes-display-inline">issue a proposed decision with respect to
			 the ecological restoration project.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb22c4af5af0c4a1bba900c2e582b299e"><enum>(d)</enum><header display-inline="yes-display-inline">Objections to ecological restoration
			 projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID26c1db83876749078d951f12855d927b"><enum>(1)</enum><header display-inline="yes-display-inline">Opportunity to object</header><text display-inline="yes-display-inline">Before issuing a final decision with
			 respect to an ecological restoration project under this Act, the Secretary
			 shall permit persons described in paragraph (2) to submit to the Secretary
			 objections with respect to a proposed decision relating to the ecological
			 restoration project during a 30-day period beginning on the date on which the
			 Secretary issues a proposed decision under subsection (c)(5)(B).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60823211e4f14b1c8e5089a649265cad"><enum>(2)</enum><header display-inline="yes-display-inline">Authorized persons</header><text display-inline="yes-display-inline">A person may submit to the Secretary an
			 objection under paragraph (1) if the person submitted to the Secretary comments
			 during—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idA5D2E002F8C34F13B9E2076E4F364B24"><enum>(A)</enum><text display-inline="yes-display-inline">the development of the ecological
			 restoration project that is the subject of the objection; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFF11CDE856E847E2B9C9EB5D99A95996"><enum>(B)</enum><text display-inline="yes-display-inline">the comment period of the ecological
			 restoration project that is the subject of the objection.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd4b77d01604b43e88d304c5df1fc94d2"><enum>(3)</enum><header display-inline="yes-display-inline">Objection resolution meeting</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idA0C14D81EACF493B9B70C3E01BB0177F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to a request by a person who
			 submitted an objection under paragraph (1) or by the Secretary, and the
			 acceptance by the party receiving the request, the person and the Secretary may
			 conduct an objection resolution meeting.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC8BBBC868E24810A411BC3662F66BC9"><enum>(B)</enum><header display-inline="yes-display-inline">Authority of applicable collaborative
			 group</header><text display-inline="yes-display-inline">Members of a
			 collaborative group the jurisdiction of which covers land on which the conduct
			 of ecological restoration project that is the subject of an objection described
			 in subparagraph (A) is proposed may attend the objection resolution meeting
			 held under that subparagraph.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id475CA6C36B0941B88A24D3DD1BAE5F4E"><enum>(4)</enum><header display-inline="yes-display-inline">Deadline for final determination</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC420FC650433479B9E77AEB921FC9AD4"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the completion
			 of the objection period described in paragraph (1), the Secretary shall make a
			 final determination with respect to each objection submitted to the Secretary
			 under paragraph (1).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD07539C97C394F3DB58F496452F60E27"><enum>(B)</enum><header display-inline="yes-display-inline">Failure to make final
			 determination</header><text display-inline="yes-display-inline">If the
			 Secretary fails to make a final determination with respect to any objection
			 filed under paragraph (1) by the date that is 30 days after the date described
			 in that paragraph—</text>
						<clause commented="no" display-inline="no-display-inline" id="idDA635D309B0545A5862DF712257C416E"><enum>(i)</enum><text display-inline="yes-display-inline">the objection shall be considered to be
			 denied; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id42ED2D4A68C14BB481648FC60A172F8A"><enum>(ii)</enum><text display-inline="yes-display-inline">the proposed decision that is the subject
			 of the objection shall be considered to be a final agency action for purposes
			 of subchapter II of chapter 5, and chapter 7, of title 5, United States Code
			 (commonly known as the <quote>Administrative Procedure Act</quote>).</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7DE17FC80A584F05BD051523F0196442"><enum>(5)</enum><header display-inline="yes-display-inline">Procedure</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id2D4417F0E76C4A549406EA17B8019828"><enum>(A)</enum><header display-inline="yes-display-inline">No objections</header><text display-inline="yes-display-inline">If no objection is submitted under
			 paragraph (1), on the date that is 30 days after the date on which the public
			 comment period described in that paragraph terminates, the Secretary shall
			 implement each ecological restoration project that is the subject of the public
			 comment period.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16A7295E1885463F91CB42697A6FBB55"><enum>(B)</enum><header display-inline="yes-display-inline">Objections</header><text display-inline="yes-display-inline">If an objection is submitted under
			 paragraph (1)—</text>
						<clause commented="no" display-inline="no-display-inline" id="id4A8A8B3F90CE419DB852D0FAAF8A0C51"><enum>(i)</enum><text display-inline="yes-display-inline">the Chief of the Forest Service may not
			 take any action to implement the ecological restoration project that is the
			 subject of the objection until the date on which a final determination is made
			 or considered to be made under paragraph (4); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idBC32D3CAE3C946638900E7BBAF35AC7A"><enum>(ii)</enum><text display-inline="yes-display-inline">after the date on which a final
			 determination is made or considered to be made under paragraph (4), the Chief
			 of the Forest Service may implement the ecological restoration project that is
			 the subject of the objection.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9a52682a26f5419880a985646ba7fb27"><enum>(e)</enum><header display-inline="yes-display-inline">Judicial review</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0c71b00049ee4b779785eaf1839f90a9"><enum>(1)</enum><header display-inline="yes-display-inline">Expeditious completion of judicial
			 review</header><text display-inline="yes-display-inline">In the judicial review
			 of an action challenging an ecological restoration project developed under this
			 Act, Congress encourages the court of competent jurisdiction to expedite, to
			 the maximum extent practicable, the proceedings in the action with the goal of
			 rendering a final determination on jurisdiction, and (if jurisdiction exists) a
			 final determination on the merits, as soon as practicable after the date on
			 which a complaint or appeal is filed to initiate the action.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb9d46df3b4ee4aa18d091b3f973842f1"><enum>(2)</enum><header display-inline="yes-display-inline">Consideration of potential short- and
			 long-term effects</header><text display-inline="yes-display-inline">In weighing
			 each equity during the consideration of any request for an injunction that
			 applies to an agency action with respect to an ecological restoration project
			 carried out under this Act, the court reviewing the ecological restoration
			 project shall consider the impact to the ecosystem that could potentially
			 result from—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDee38bc7ed9954b70a7e6c81d6259d687"><enum>(A)</enum><text display-inline="yes-display-inline">the short- and long-term effects of
			 undertaking the agency action; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2484eee8f14a42a1a59486ec9a21776a"><enum>(B)</enum><text display-inline="yes-display-inline">the short- and long-term effects of not
			 undertaking the agency action.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1dc50250e65949e4b829af8c38beb7f4"><enum>(f)</enum><header display-inline="yes-display-inline">Implementation of ecological restoration
			 projects</header><text display-inline="yes-display-inline">Given the large
			 backlog of acreage in need of ecological restoration in the covered area, the
			 Secretary shall promptly implement an ecological restoration project following
			 the final agency action.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDccf4081edb7c4256ae43f02cd3ed9048"><enum>(g)</enum><header display-inline="yes-display-inline">Litigation</header><text display-inline="yes-display-inline">Any person who has submitted a comment
			 regarding an interim project or an ecological restoration project may intervene
			 in any legal action that challenges the interim project or ecological
			 restoration project.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID4317237bff4a41ec9958eaf7116c1327" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Biomass</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDac81d92e089248b888613858bd551b06"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law
			 (including regulations) relating to the use of biomass energy, in accordance
			 with each purpose and goal of this Act, and any applicable recommendation of
			 the advisory panel, the Secretary shall take such actions as are necessary to
			 further enhance the use of woody biomass in the covered area.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb301575c782a46858d30765274593da3"><enum>(b)</enum><header display-inline="yes-display-inline">Regional biomass projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID66df03bced6d46808d60676acafe57ca"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On a determination by the Secretary that
			 forest conditions, commercial interests, and an adequate supply from a
			 combination of Federal and non-Federal sources indicate a viable economic
			 supply and demand for establishing a regional biomass project, the Secretary
			 may designate an area within the covered area in which—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDea81c7cc1b8242199440df79b4cf3491"><enum>(A)</enum><text display-inline="yes-display-inline">the removal of biomass is necessary to
			 restore forest health; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7bd1db28ecc0418e96a4a08f5783c1d9"><enum>(B)</enum><text display-inline="yes-display-inline">a sufficient volume of material is expected
			 to be available to support a 20 year-lifespan of capital investments for
			 biomass use.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4725da63f2f94b048dd02f4a261c9450"><enum>(2)</enum><header display-inline="yes-display-inline">Volume estimate</header><text display-inline="yes-display-inline">The Secretary shall develop an estimate of
			 the volume of biomass that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id2540A5BA861044329C7D3511BB5E1003"><enum>(A)</enum><text display-inline="yes-display-inline">consists of slash, brush, and any tree that
			 does not exceed the minimum size standards for sawtimber; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBD39486F1EDE45BB8DBA8EAD4CEC28E2"><enum>(B)</enum><text display-inline="yes-display-inline">can be supplied in a sustainable manner on
			 a contractual basis over a contract term of not more than 20 years.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC43140125A4D4C92AD5545A0EF13EF45"><enum>(3)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that biomass
			 industries arising from the conduct of this subsection will rely on Federal and
			 non-Federal forests for the supply of raw materials.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa81255a424aa47e5b13499f55c0dd084"><enum>(4)</enum><header display-inline="yes-display-inline">Contracts</header><text display-inline="yes-display-inline">Upon the development of an estimate
			 required under paragraph (2), the Secretary may enter into a contract to supply
			 biomass over a term of not more than 20 years, with the option of making
			 adjustments after a period of 10 years based on supply conditions.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDc4a57e946abb42769e1f1001ce480229" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Local contracting</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDde85108507e5443583c72b8bc81dd377"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To carry out restoration projects under
			 this Act, the Secretary shall, to the maximum extent practicable, through
			 agreements or contracts, enter into stewardship contracting projects.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID790a3ab016284bd0a96406cacc0fbb7b"><enum>(b)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">An agreement or contract under subsection
			 (a) shall, to the maximum extent practicable, be in effect for a period of 20
			 years, with the option of adjustments after 10 years based on defined
			 benchmarks.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd0f70c1662c54a0296200a276b7af4a4"><enum>(c)</enum><header display-inline="yes-display-inline">Performance and payment
			 guarantees</header><text display-inline="yes-display-inline">The Secretary may
			 require performance and payment bonds as the Secretary determines to be
			 appropriate, the amounts of which shall be reduced as the subject contractor
			 achieves benchmarks established by the Forest Service.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8a2679f0db0842df8ad696be34d303b0"><enum>(d)</enum><header display-inline="yes-display-inline">Procurement procedure</header><text display-inline="yes-display-inline">In selecting a source for performance of an
			 agreement or contract under subsection (a), the Secretary shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDdd9abc20cef1469aa622cdbb6cc4ee9f"><enum>(1)</enum><text display-inline="yes-display-inline">comply with section 347(c)(1) of the
			 Department of the Interior and Related Agencies Appropriations Act, 1999 (16
			 U.S.C. 2104 note; Public Law 105–277);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID673204d5fe374932a27e0f03f1e63de6"><enum>(2)</enum><text display-inline="yes-display-inline">consider past performance relating to the
			 purposes and goals of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID841a78ebd9ac456383cafe1f53df0a57"><enum>(3)</enum><text display-inline="yes-display-inline">give preference to local businesses located
			 within a 100-mile radius of a National Forest where the project is
			 located.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID30fc6cb2edec463a865ecb06ac3040de" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Administration</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDd84b3933806d432a917f0ca2066f9e4d"><enum>(a)</enum><header display-inline="yes-display-inline">Effect on treaties or other laws</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id40911EBC6F374BBA8D8F490AD0F5043E"><enum>(1)</enum><header display-inline="yes-display-inline">Treaties</header><text display-inline="yes-display-inline">Nothing in this Act increases or diminishes
			 any right described in a treaty between an Indian tribe and the United
			 States.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id325CBB0F601245DBBEDC17E55A451656"><enum>(2)</enum><header display-inline="yes-display-inline">Federal laws</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act,
			 nothing in this Act affects any Federal law (including regulations).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea152633a63e4ceea7745160964c8ab2"><enum>(3)</enum><header display-inline="yes-display-inline">Relationship to other authority</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id43A5DA90AC804481A47C05463FF085FB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may use any authority
			 provided under another provision of law (other than this Act) to carry out
			 projects in a covered area.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03A091C2DE7F417385A1A6B895E89DF3"><enum>(B)</enum><header display-inline="yes-display-inline">Certain projects</header><text display-inline="yes-display-inline">If the Secretary uses the authority
			 provided by sections 9 and 11 to carry out an interim or ecological restoration
			 project, the Secretary may not use authority provided under another provision
			 of law (other than this Act) to carry out the interim or ecological restoration
			 project.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID33a8683e4e1741929d3801a1f04c431f"><enum>(b)</enum><header display-inline="yes-display-inline">Principal agency contact</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id80650E4A06AF473B8F84451AFD085BF3"><enum>(1)</enum><header display-inline="yes-display-inline">Selection</header><text display-inline="yes-display-inline">The Secretary shall select a Deputy
			 Regional Forester to serve as the principal agency contact for the
			 implementation of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79C70413E4234B6DB8ADD8FEC9C3B888"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Deputy Regional Forester shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC74EC4AE766242F4B82FF18463B253C2"><enum>(A)</enum><text display-inline="yes-display-inline">serve as the point-of-contact for—</text>
						<clause commented="no" display-inline="no-display-inline" id="id0249847E87A54A8D8618E5C8D4105F61"><enum>(i)</enum><text display-inline="yes-display-inline">the advisory panel; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id011C8C592A8A46CEB10D65C538F11937"><enum>(ii)</enum><text display-inline="yes-display-inline">each collaborate group;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE0763FE9208A4F90B04F0F70AE7E321E"><enum>(B)</enum><text display-inline="yes-display-inline">resolve disagreements between any
			 collaborative group and the forest officer that serves as the primary
			 point-of-contact of the collaborative group; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id956CC194B0E548719C776976D95DF42D"><enum>(C)</enum><text display-inline="yes-display-inline">facilitate communications among—</text>
						<clause commented="no" display-inline="no-display-inline" id="id13884AB05FBC48A5AD38B6F1A3460426"><enum>(i)</enum><text display-inline="yes-display-inline">the advisory panel;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idB8D0B1DF24E543D688E947C89241DCA1"><enum>(ii)</enum><text display-inline="yes-display-inline">collaborative groups;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA59F4B1234A5495DB2CD4190DCB651AF"><enum>(iii)</enum><text display-inline="yes-display-inline">employees of the Forest Service; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id5C30A96AD245452F8CA363729D4BF9B9"><enum>(iv)</enum><text display-inline="yes-display-inline">any other stakeholders (including the
			 public).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID73ed38c75b104086829056a8bd96df68"><enum>(c)</enum><header display-inline="yes-display-inline">Evaluative criteria</header><text display-inline="yes-display-inline">To determine and ensure compliance with
			 this Act, the Secretary shall use the qualitative criteria described in section
			 4(a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID26f6fe4fef18443c84a714f7dbfe9143" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDcbdde715ad5d49608e4cad709110a0a7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated
			 $50,000,000 to carry out this Act, to remain available until expended.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id645D01E064784E578F59EA7C7395A85D"><enum>(b)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Not more than 3 percent of the amount made
			 available under subsection (a) may be used to pay for costs arising from
			 overhead expenses of the Department of Agriculture.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID44156aa671ea4dc185856c4c52fcc1ae"><enum>(c)</enum><header display-inline="yes-display-inline">Receipts</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID993edd40f7db441aa3d9b524419abd5d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Receipts from sales made under projects
			 authorized under this Act shall be retained and used by the Secretary to
			 conduct further planning and implementation of projects under this Act, without
			 further appropriation or fiscal year limitation.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb9e725d8477c43439aaf0ccdf57ae92d"><enum>(2)</enum><header display-inline="yes-display-inline">Other receipt laws</header><text display-inline="yes-display-inline">Nothing in this Act affects any other
			 Federal law governing the disposition of receipts.</text>
				</paragraph></subsection></section></legis-body>
