		<official-title>To amend the Internal Revenue Code of 1986 to deny the
		  deduction for direct to consumer advertising expenses for prescription
		  pharmaceuticals and to provide a deduction for fees paid for the participation
		  of children in certain organizations which promote physical
		  activity.</official-title>

			 direct to consumer advertising expenses for prescription
			 pharmaceuticals</header>
			<subsection id="idEFBA57D965B141029623D6D9F280E653"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part IX of subchapter
			 B of chapter 1 of subtitle A of the Internal Revenue Code of 1986 (relating to
			 items not deductible) is amended by adding at the end the following new
			 section:</text>

					<section id="id0D3C6EDA0156494885B148661B88E5BC"><enum>280I.<?LEXA-Enum 280I.?></enum><header>Disallowance of deduction for direct to
				consumer advertising expenses for prescription pharmaceuticals</header><text display-inline="no-display-inline">No deduction shall be allowed under this
				chapter for expenses relating to direct to consumer advertising in any media
				for the sale and use of prescription pharmaceuticals for any taxable
				year.</text>

			</subsection><subsection id="id8449FEC2D4DD43199B6939F268C7BF0B"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for such part IX of the Internal
			 Revenue Code of 1986 is amended by adding after the item relating to section
			 280H the following new item:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id5989EA6032C74C01A77FBE2109F3B5E8"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 paid or incurred after the date of the enactment of this Act, in taxable years
			 ending after such date.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id4496DEC96CD14C1AA32B243834DCF0B5"><enum>2.</enum><header>Physical
			 Lifestyles for America's Youth (PLAY) deduction</header>
			<subsection commented="no" display-inline="no-display-inline" id="idC7DDFFE02EDB4DB89DC14E8F4E7DB001"><enum>(a)</enum><header>In
			 general</header><text>Part VII of subchapter B of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by redesignating section 224 as section 225 and
			 inserting after section 223 the following new section:</text>

					<section commented="no" display-inline="no-display-inline" id="id93C514F6B2B34F5EA58695CB233A26C7"><enum>224.</enum><header>Fees for
				organizations promoting children's physical activity</header>
						<subsection commented="no" display-inline="no-display-inline" id="idE97F10B07D1B42FC8E28188C8C201E3E"><enum>(a)</enum><header>General
				rule</header><text display-inline="yes-display-inline">There shall be allowed
				as a deduction under this chapter an amount equal to the lesser of—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idD95BE364F94D46D9B8B364B77D5F497C"><enum>(1)</enum><text display-inline="yes-display-inline">the amount paid or incurred by the taxpayer
				during the taxable year for the participation of a qualifying child (as defined
				in section 152(c)) of the taxpayer in a qualified organization, or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6BE74F28FAF43FE8E73C4305D2D8062"><enum>(2)</enum><text>$500.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id36C5B58EB5B4422EBD609B3FACBC609A"><enum>(b)</enum><header>Limitations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id8A9173C6AD7A4AF4AD64868760FD383C"><enum>(1)</enum><header>In
				general</header><text>No deduction shall be allowed under subsection (a) with
				respect to any taxpayer whose adjusted gross income for the taxable year
				exceeds $250,000.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id97371481ACEF45328AC2123C20EF36F0"><enum>(2)</enum><header>Adjusted gross
				income</header><text>For purposes of this subsection, adjusted gross income
				shall be determined—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id63EEFEB3023744AE8F801F893FD1FA74"><enum>(A)</enum><text>without regard to
				this section and sections 199, 911, 931, and 933, and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD059108387514630AB20F3127033FA15"><enum>(B)</enum><text>after the
				application of sections 86, 135, 137, 219, 221, 222, and 469.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id684A1A72A1114431AA04C3958454A745"><enum>(c)</enum><header>Qualified
				organization</header><text>For purposes of this section, the term
				<term>qualified organization</term> means any other organization the principal
				activities of which are designed to promote or provide for the physical
				activity of children, as determined under guidelines published by the Secretary
				in consultation with the Secretary of Health and Human
				Services.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9E148A530BED44BC882743A533F0963E"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for part VII of subchapter B of
			 chapter 1 of such Code is amended by redesignating the item relating to section
			 224 as relating to section 225 and inserting after the item relating to section
			 223 the following new item:</text>
