		<official-title display="yes">To reauthorize the Congressional Award Act
		  (2 U.S.C. 801 et seq.), and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Congressional Award Program
			 Reauthorization Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id9E40C4F66AC546868AF151D1AA07E379" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Congressional Award Program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id18E54D08FCF946ACBF45CF57C20C3F8C"><enum>(a)</enum><header display-inline="yes-display-inline">Implementation and
			 presentation</header><text display-inline="yes-display-inline">Section 102 of
			 the Congressional Award Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C. 802</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD66E6CDE47374948AB01F73391A26BD5"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter following subsection (b)(5),
			 by striking <quote>under paragraph (3)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1543481B3BB14D318DBA086786CA95FC"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), in the second sentence,
			 by striking <quote>during</quote> and inserting <quote>in connection
			 with</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCACD7B3D7EBB455DBBDA069244BE3C20"><enum>(b)</enum><header display-inline="yes-display-inline">Terms of appointment and
			 reappointments</header><text display-inline="yes-display-inline">Section 103 of
			 the Congressional Award Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C. 803</external-xref>) is amended by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD0E510D34C6D41DCA8A94B565DA4D6DB" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id43BD1648AC794BC8AE50030E0194784D"><enum>(b)</enum><header display-inline="yes-display-inline">Terms of appointed members;
				reappointment</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id367D57E9CD7B4E99A1ECD81BB2A6171E"><enum>(1)</enum><text display-inline="yes-display-inline">Appointed members of the Board shall
				continue to serve at the pleasure of the officer by whom they are appointed,
				and (unless reappointed under paragraph (2)) shall serve for a term of 4
				years.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3E1F0B1DA8B34481A8AC95B72C46DB6C"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id597DDB23E6A74DAB87D0CA670AD108A6"><enum>(A)</enum><text display-inline="yes-display-inline">Subject to the limitations in subparagraph
				(B), members of the Board may be reappointed, except that no member may serve
				more than 2 full consecutive terms. Members may be reappointed to 2 full
				consecutive terms after being appointed to fill a vacancy on the Board.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24446EEA472141C2896C99975EE36556" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Members of the Board shall not be subject
				to the limitation on reappointment in subparagraph (A) during their period of
				service as Chairman of the Board and may be reappointed to an additional full
				term after termination of such Chairmanship.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC526BBFC6E5248ADB516EB02EEE72D6E"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0CE31170DA4A4F679F34722E21392BDD"><enum>(A)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (1) or (2), the
				term of each member of the Board shall begin on October 1 of the even numbered
				year which would otherwise apply with one-half of the Board positions having
				terms which begin in each even numbered year.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CC75573A6A447FF97316DB82057BB4C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) shall apply to
				appointments made to the Board on or after the date of enactment of the
				Congressional Award Program Reauthorization Act of
				2009.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0B490010722E4D0DB02FE96EF6F4362D"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements regarding financial
			 operations</header><text display-inline="yes-display-inline">Section 104(c) of
			 the Congressional Award Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C. 804</external-xref>(c)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id5C35BE6CAA254815819AF1C5D33E213B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), in the third sentence, by
			 striking <quote>, in any calendar year,</quote> and inserting <quote>in any
			 fiscal year</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id314CC4C8B4FA43498B31EEA777597A68"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id64040C0FD1844D5FB37AB2A4DA8F199F" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id20048E6763D84726975DF1094806B066"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB1E129C9763943FC88ACC4FB7CB93F24"><enum>(A)</enum><text display-inline="yes-display-inline">The Comptroller General of the United
				States shall determine for each fiscal year whether the Director has
				substantially complied with paragraph (1). The findings made by the Comptroller
				General under the preceding sentence shall be included in the reports submitted
				under section 107(b).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1575F4552864334B328F047A88917CB" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If
				the Director fails to substantially comply with paragraph (1), the Board shall
				instruct the Director to take such actions as may be necessary to correct such
				deficiencies, and shall remove and replace the Director if such deficiencies
				are not promptly
				corrected.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id425D639D74894AEEA6ED960DAD445BA4"><enum>(d)</enum><header display-inline="yes-display-inline">Funding and expenditures</header><text display-inline="yes-display-inline">Section 106(a) of the Congressional Award
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C.
			 806</external-xref>(a)) is amended by striking paragraph (1) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id8E3D0CA15A244BD393DDB97DD9441E68" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID2dc38ebe38c840b4a6b22058c44c5adc"><enum>(1)</enum><text display-inline="yes-display-inline">the Board shall carry out its functions and
				make expenditures with—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id0271A70DFD5846E8AF5E7EBF2D3363F1"><enum>(A)</enum><text display-inline="yes-display-inline">such resources as are available to the
				Board from sources other than the Federal Government; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCCAEEC2395BB4EC89439F25AC93D91CD"><enum>(B)</enum><text display-inline="yes-display-inline">funds awarded in any grant program
				administered by a Federal agency in accordance with the law establishing that
				grant
				program.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idAA83587FD1894B23BC6BEB0AE91DB8D0"><enum>(e)</enum><header display-inline="yes-display-inline">Statewide Congressional Award
			 Councils</header><text display-inline="yes-display-inline">Section 106(c) of
			 the Congressional Award Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C. 806</external-xref>(c)) is amended by
			 striking paragraph (4) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id799CC7ADC0E34B0BAD75651F00B06992" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID82ff17e5730a4d94879164b2e85fb142"><enum>(4)</enum><text display-inline="yes-display-inline">Each Statewide Council established under
				this section may receive contributions, and use such contributions for the
				purposes of the Program. The Board shall adopt appropriate financial management
				methods in order to ensure the proper accounting of these funds. Each Statewide
				Council shall comply with subsections (a), (d), (e), and (h) governing the
				Board.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id38D7C34EC41A43368C0B40A6F5D03075"><enum>(f)</enum><header display-inline="yes-display-inline">Contracting and use of funds for
			 scholarships</header><text display-inline="yes-display-inline">Section 106 of
			 the Congressional Award Act (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C. 806</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id60F17986888E499EBFDB1CA2BE1AE446"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting <quote>to
			 be</quote> after <quote>expenditure is</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8AEE3D4DC709451D8F4084D4A0229733"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(1)(A), by inserting
			 <quote>or for scholarships</quote> after <quote>local program</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8E00A37A4AE741F4A6C55E06B57BC60B"><enum>(g)</enum><header display-inline="yes-display-inline">Nonprofit corporation</header><text display-inline="yes-display-inline">Section 106 of the Congressional Award Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C.
			 806</external-xref>) is amended by striking subsection (i) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idA454026DFFEF4099A9101DFE2D42C174" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id8F89F2D55E3441CAB08B5DE13E38B6D5"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id97DFBDB3E2FC49ECBBD426C35959EFC4"><enum>(1)</enum><text display-inline="yes-display-inline">The Board shall provide for the
				incorporation of a nonprofit corporation to be known as the Congressional Award
				Foundation (together with any subsidiary nonprofit corporations determined
				desirable by the Board, collectively referred to in this title as the
				<quote>Corporation</quote>) for the sole purpose of assisting the Board to
				carry out the Congressional Award Program, and shall delegate to the
				Corporation such duties as it considers appropriate, including the employment
				of personnel, expenditure of funds, and the incurrence of financial or other
				contractual obligations.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EB8F491E8704110BC94AF0AB176479F" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The articles of incorporation of the
				Congressional Award Foundation shall provide that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id3D4A0833C39D4CC5BF54F1AF62FAA5FF"><enum>(A)</enum><text display-inline="yes-display-inline">the members of the Board of Directors of
				the Foundation shall be the members of the Board, with up to 24 additional
				voting members appointed by the Board, and the Director who shall serve as a
				nonvoting member; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C1CA0F6BE3E4768B2DAD06ADEB27AA0"><enum>(B)</enum><text display-inline="yes-display-inline">the extent of the authority of the
				Foundation shall be the same as that of the Board.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A945219F0274B988D27863929211FFB" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No director, officer, or employee of any
				corporation established under this subsection may receive compensation, travel
				expenses, or benefits from both the Corporation and the
				Board.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idEEF6B2A0C54B44B8947C2158FD8CEBC4"><enum>(h)</enum><header display-inline="yes-display-inline">Termination</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFA9B973784374EB5B34D59929D0FD7C1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 108 of the Congressional Award Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/2/808">2 U.S.C.
			 808</external-xref>) is amended by striking <quote>October 1, 2009</quote> and
			 inserting <quote>October 1, 2013</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCBF5FA5FAF17444B80EC4F3DB7A66CD8"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This subsection shall
			 take effect as of October 1, 2009.</text>
				</paragraph></subsection></section></legis-body>
