		<section commented="no" display-inline="no-display-inline" id="idC12C253621CA476E991F05949103CD77" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Harmful Restraint and
			 Seclusion in Schools Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idB5F93EB694D741D392D8A680860A70E9" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H81FE8A2B883C4454A40BDA69A9AFCC2A"><enum>(1)</enum><text display-inline="yes-display-inline">Seclusion and physical restraint have
			 resulted in physical injury, psychological trauma, and death to children in
			 public and private schools. National research shows children have been
			 subjected to inappropriate seclusion and physical restraint in schools as a
			 means of discipline, to force compliance, or as a substitute for appropriate
			 educational support.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H93EC928E039C4C1D80A39417DB55218A"><enum>(2)</enum><text display-inline="yes-display-inline">Despite the widely recognized risks of
			 seclusion and physical restraint, a substantial disparity exists between States
			 and localities with regard to the protection and oversight of the rights of
			 children to a safe learning environment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C5C00E16D12486AABA2733A4D536F2D"><enum>(3)</enum><text display-inline="yes-display-inline">Children are protected from inappropriate
			 physical restraint and seclusion in other settings, such as hospitals, health
			 facilities, and non-medical community-based facilities. Similar protections are
			 needed in schools, yet such protections must acknowledge the differences of the
			 school environment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6029A37BD10147CFACAA6727B2F441A0"><enum>(4)</enum><text display-inline="yes-display-inline">Research confirms that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idB26DF7D4EFC64E53B085C024199685B1"><enum>(A)</enum><text display-inline="yes-display-inline">seclusion and physical restraint are not
			 therapeutic; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB2D731531A6A426E87851ACA32E0703B"><enum>(B)</enum><text display-inline="yes-display-inline">these practices are not effective means to
			 calm or teach children and may have an opposite effect while simultaneously
			 decreasing a child’s ability to learn.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC42477800CAB41A2AB3C2BBBEC523617"><enum>(5)</enum><text display-inline="yes-display-inline">Children are subjected to seclusion and
			 physical restraint at higher rates than adults, and are at greater risk of
			 injury. Physical restraint that restricts air flow to the lungs, as well as
			 seclusion in the absence of continuous face-to-face monitoring, have resulted
			 in the deaths of children in schools.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD098133B5CA34FDBBEB41FE71DBAA7AC"><enum>(6)</enum><text display-inline="yes-display-inline">Behavioral interventions for children must
			 promote the right of all children to be treated with dignity. All children have
			 the right to be free from physical or mental abuse, aversive behavioral
			 interventions that compromise health and safety, and any physical restraint or
			 seclusion imposed for purposes of discipline or convenience.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA2A816F8B29A4F71BCFAB4B539FC0997"><enum>(7)</enum><text display-inline="yes-display-inline">Safe, effective, evidence-based strategies
			 are available to support children who display challenging behaviors in school
			 settings. Staff training focused on the dangers of seclusion and physical
			 restraint, as well as training in evidence-based positive behavioral
			 interventions and supports, de-escalation techniques, and seclusion and
			 physical restraint prevention, can reduce injury, trauma, and death.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD831A7A01B34938BE29D919FD81CBA3"><enum>(8)</enum><text display-inline="yes-display-inline">School personnel have the right to work in
			 a safe environment and should be provided training and support to prevent
			 injury and trauma to themselves and others.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C44381AF64F48A0B4FE8EFBEE57D792"><enum>(9)</enum><text display-inline="yes-display-inline">The effective implementation of school-wide
			 positive behavior supports is linked to greater academic achievement,
			 significantly fewer disciplinary problems, increased instruction time, and
			 staff perception of a safer teaching environment.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID58df95ad0a5f41aaa9039748758f0e15"><enum>(10)</enum><text display-inline="yes-display-inline">Perspectives of relevant community and
			 advocacy organizations, including those run by individuals with disabilities,
			 are important when developing and implementing strategies, policies, and
			 procedures to prevent or reduce seclusion and physical restraint in
			 schools.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H1CA87FE08D054B468707B45A008234CB" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id1BF659199B7541FD8B171A205E4CC596"><enum>(1)</enum><text display-inline="yes-display-inline">prevent and reduce the use of seclusion and
			 physical restraint;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54795AD330114CF28F356B730D1D4154"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the safety of all students and
			 personnel in schools and promote a positive school culture and climate;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H203BCC2C226E46388770A5C582592940"><enum>(3)</enum><text display-inline="yes-display-inline">protect students from—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H11C0E2293BA74E42AB67C5E1810B3304"><enum>(A)</enum><text display-inline="yes-display-inline">physical or mental abuse;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B55DD9FCE9143D6A5C2C79DF4465E0E"><enum>(B)</enum><text display-inline="yes-display-inline">aversive behavioral interventions that
			 compromise health and safety; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC8B99A56A4234E66963DD79480D86A93"><enum>(C)</enum><text display-inline="yes-display-inline">any physical restraint or seclusion imposed
			 for purposes of discipline or convenience;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA7A4D9D1B2694735AA2CCA97C4E2EAAC"><enum>(4)</enum><text display-inline="yes-display-inline">ensure that seclusion and physical
			 restraint are imposed in school only when a student’s behavior poses an
			 imminent danger of physical injury to the student, school personnel, or others;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB7CE885B80E94890A9F0E3353FFBA9C6"><enum>(5)</enum><text display-inline="yes-display-inline">assist States, local educational agencies,
			 and schools in—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HCBBF1DDCF5514840B0FC71BA12475C70"><enum>(A)</enum><text display-inline="yes-display-inline">establishing policies and procedures to
			 keep all students and school personnel safe, including students with the most
			 complex and intensive behavioral needs;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4FB364D40E2D4338A1016CB0CAC9DF02"><enum>(B)</enum><text display-inline="yes-display-inline">providing school personnel with the
			 necessary tools, training, and support to ensure the safety of all students and
			 promoting a positive school culture and climate;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA86D20BE2C6F4FCFB5777F2ACCC6C3DF"><enum>(C)</enum><text display-inline="yes-display-inline">collecting and analyzing data on seclusion
			 and physical restraint in schools as a means to reduce such incidents;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4C7D144A097B4D5CA0D75BA63356292C"><enum>(D)</enum><text display-inline="yes-display-inline">identifying and implementing effective
			 evidence-based models to prevent and reduce seclusion and physical restraint in
			 schools.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H125DEDDD8C764F8188D2E2E9D9900336" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idD89A99690864426C83C9425A8F6C8EBE"><enum>(1)</enum><header display-inline="yes-display-inline">ESEA definitions</header><text display-inline="yes-display-inline">The terms <term>educational service
			 agency</term>, <term>elementary school</term>, <term>local educational
			 agency</term>, <term>parent</term>, <term>secondary school</term>, and
			 <term>State</term> have the meanings given such terms in section 9101 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA907CCF9E31E4941880B38FDEFEAC69A"><enum>(2)</enum><header display-inline="yes-display-inline">Public Health Service Act
			 definitions</header><text display-inline="yes-display-inline">The terms
			 <term>mechanical restraint</term>, <term>physical escort</term>, <term>physical
			 restraint</term>, <term>seclusion</term>, and <term>time out</term> have the
			 meanings given such terms in section 595(d) of the Public Health Service Act
			 (42 U.S.C. 290jj(d)), except that the meanings of such terms shall be applied
			 by substituting <term>student</term> or <term>student's</term> for
			 <term>resident</term> or <term>resident's</term>, respectively.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC93BE6F4A10B4A149B5EFC4E01FCA676"><enum>(3)</enum><header display-inline="yes-display-inline">Applicable program</header><text display-inline="yes-display-inline">The term <term>applicable program</term>
			 has the meaning given the term in section 400(c) of the General Education
			 Provisions Act (20 U.S.C. 1221(c)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95AD2E3325EE4B16B78B99217259900D"><enum>(4)</enum><header display-inline="yes-display-inline">Chemical restraint</header><text display-inline="yes-display-inline">The term <quote>chemical restraint</quote>
			 means a drug or medication used on a student to control behavior or restrict
			 freedom of movement that is not—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id6E76F076B0264007A9CE81B0658349D9"><enum>(A)</enum><text display-inline="yes-display-inline">prescribed by a licensed physician for
			 standard treatment of the student’s medical or psychiatric condition;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3A3C1DFC120D46AC804CAD29E8AC15B9"><enum>(B)</enum><text display-inline="yes-display-inline">administered for that purpose.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4379C535FB794E9DAE3E935404F8BAF8"><enum>(5)</enum><header display-inline="yes-display-inline">Positive behavior supports</header><text display-inline="yes-display-inline">The term <quote>positive behavior
			 supports</quote> means a systematic approach to embed evidence-based practices
			 and data-driven decisionmaking to improve school climate and culture, including
			 a range of systemic and individualized strategies to reinforce desired
			 behaviors and diminish reoccurrence of problem behaviors, in order to achieve
			 improved academic and social outcomes and increase learning for all students,
			 including those with the most complex and intensive behavioral needs.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F28A978CE7747DB80CE6B4D81400E94"><enum>(6)</enum><header display-inline="yes-display-inline">Protection and advocacy
			 system</header><text display-inline="yes-display-inline">The term
			 <quote>protection and advocacy system</quote> means a protection and advocacy
			 system established under section 143 of the Developmental Disabilities
			 Assistance and Bill of Rights Act of 2000 (42 U.S.C. 15043).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4DBECFE24364293B0DBB29CC269F911"><enum>(7)</enum><header display-inline="yes-display-inline">School</header><text display-inline="yes-display-inline">The term <quote>school</quote> means an
			 entity that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H66E3327FB50B403FBC81E85EB7C9C9F1"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text>
					<clause commented="no" display-inline="no-display-inline" id="H86691B6743C4488EB5A90CB1CC3F6138"><enum>(i)</enum><text display-inline="yes-display-inline">a public or private day or residential
			 elementary school or secondary school; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H2BFD6B6650E84A219DC186EC51E589DE"><enum>(ii)</enum><text display-inline="yes-display-inline">an early childhood, elementary school, or
			 secondary school program that is under the jurisdiction of a school,
			 educational service agency, or other educational institution or program;
			 and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9BE539D5B6864CE886BEDE3BA181DE76"><enum>(B)</enum><text display-inline="yes-display-inline">receives, or serves students who receive,
			 support in any form from any program supported in whole or in part, directly or
			 indirectly, with funds appropriated to the Department of Education.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5AE033C8AC6043E6997F4F710E562623"><enum>(8)</enum><header display-inline="yes-display-inline">School personnel</header><text display-inline="yes-display-inline">The term <quote>school personnel</quote>
			 means school personnel and school resource officers, as such terms are defined
			 in section 4151 of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 7161).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF1979089463456DA0A214FC5D4A811B"><enum>(9)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Education.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE0BEECD0CF59473BB5F28C709A836DF3"><enum>(10)</enum><header display-inline="yes-display-inline">State-approved training
			 program</header><text display-inline="yes-display-inline">The term
			 <quote>State-approved training program</quote> means a training program
			 approved by a State that, at a minimum, provides—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H1C2EA99159EE405291C43158FF4C0B3E"><enum>(A)</enum><text display-inline="yes-display-inline">evidence-based techniques shown to be
			 effective in the prevention, and safe use, of seclusion and physical
			 restraint;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94E8891E87284D518CBBD45CF4956E37"><enum>(B)</enum><text display-inline="yes-display-inline">evidence-based skills training that is
			 related to positive behavior supports, conflict prevention, de-escalation, and
			 conflict management;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF60431032D4B4284AB8BC006CB1F337A"><enum>(C)</enum><text display-inline="yes-display-inline">first aid and cardiopulmonary
			 resuscitation; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11AFEC8BADFA497AAD9450F0ABDAFA29"><enum>(D)</enum><text display-inline="yes-display-inline">certification for school personnel in the
			 techniques and skills described in subparagraphs (A) through (C), which shall
			 be required to be renewed on a periodic basis.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF15E028F9094B52B9EAC4087824D855"><enum>(11)</enum><header display-inline="yes-display-inline">State educational agency</header><text display-inline="yes-display-inline">The term <term>State educational
			 agency</term> means a State educational agency, as defined in section 9101 of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801), that
			 receives support in any form from an applicable program.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H794C1490ABBD483DAFC695E925CC6C35"><enum>(12)</enum><header display-inline="yes-display-inline">Student</header><text display-inline="yes-display-inline">The term <quote>student</quote> means a
			 student—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H602D719F0C084A00A707D5342ED586FC"><enum>(A)</enum><text display-inline="yes-display-inline">who is enrolled in a school; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H62D186E60B464C998567774CE2F1CDCB"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a student enrolled in a
			 private school, who receives support in any form from any applicable program or
			 any program supported in whole, in part, directly, or indirectly with funds
			 appropriated to the Department of Education or under the Head Start Act (42
			 U.S.C. 9831 et seq.).</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H8232DBCE6BFB41928253D0D69B36ADF6" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Minimum standards; rule of
			 construction</header>
			<subsection commented="no" display-inline="no-display-inline" id="H3ED8C8FAAE36411EB2A34A24868E267B"><enum>(a)</enum><header display-inline="yes-display-inline">Minimum standards</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Secretary shall prescribe regulations to protect
			 each student from physical or mental abuse, aversive behavioral interventions
			 that compromise student health and safety, or any physical restraint or
			 seclusion imposed for purposes of discipline or convenience or in a manner
			 otherwise inconsistent with this Act. Such regulations shall, at a minimum,
			 include regulations for the following standards:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H5546F1A1EFC748B095779A60B7539588"><enum>(1)</enum><text display-inline="yes-display-inline">School personnel shall be prohibited from
			 imposing on any student the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H8AE340FF5D0544809A94C05254A5E4B1"><enum>(A)</enum><text display-inline="yes-display-inline">Mechanical restraint.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA1B1E703C99C4B868259B05582E873B9"><enum>(B)</enum><text display-inline="yes-display-inline">Chemical restraint.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A82769E87DE4ED3897A58765078D033"><enum>(C)</enum><text display-inline="yes-display-inline">Physical restraint that restricts air flow
			 to the lungs.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA8A2F682CEF4316B54DBACFA6092C7B"><enum>(D)</enum><text display-inline="yes-display-inline">Aversive behavioral intervention that
			 compromises health and safety.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF264AA4B70524506AE1726B0C9AEAF8C"><enum>(2)</enum><text display-inline="yes-display-inline">School personnel shall be prohibited from
			 imposing physical restraint or seclusion on a student unless—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H0C40838916C6452AA89D002A4DE30C09"><enum>(A)</enum><text display-inline="yes-display-inline">the student’s behavior poses an imminent
			 danger of physical injury to the student, school personnel, or others;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA0948BB2E2954C7BBA1E221CE29B68DD"><enum>(B)</enum><text display-inline="yes-display-inline">less restrictive interventions would be
			 ineffective in stopping such imminent danger of physical injury.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B8E35B0CD8246FA9DB06CC3ECC6A668"><enum>(3)</enum><text display-inline="yes-display-inline">In the event physical restraint or
			 seclusion is imposed upon a student, such physical restraint or seclusion
			 shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDD5F0CEAB9E74067B354CD26E0597051"><enum>(A)</enum><text display-inline="yes-display-inline">end upon the cessation of the conditions
			 described in
			 <internal-xref idref="HF264AA4B70524506AE1726B0C9AEAF8C" legis-path="3.(a)(1)">paragraph (2)</internal-xref>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4DE851D7B5674D80ABF398AA6B2C1A37"><enum>(B)</enum><text display-inline="yes-display-inline">be imposed by school personnel who—</text>
						<clause commented="no" display-inline="no-display-inline" id="HC37C43552D564DF59FA9CCEAB715D3D7"><enum>(i)</enum><text display-inline="yes-display-inline">continuously monitor the student
			 face-to-face; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HFBF418BC3E834ECC9C0510AA585BE29B"><enum>(ii)</enum><text display-inline="yes-display-inline">if school personnel safety is significantly
			 compromised by such face-to-face monitoring, are in continuous direct visual
			 contact with the student; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA96FD9E6A6CF48E688533A62297ADB33"><enum>(C)</enum><text display-inline="yes-display-inline">be imposed by—</text>
						<clause commented="no" display-inline="no-display-inline" id="H0922FEB5F49C411D851E98C528FCC231"><enum>(i)</enum><text display-inline="yes-display-inline">school personnel trained and certified by a
			 State-approved training program that is approved by the Secretary; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HAC42DDB89D0540A8A3862FD63503F388"><enum>(ii)</enum><text display-inline="yes-display-inline">other school personnel in the case of a
			 rare and clearly unavoidable emergency circumstance when school personnel
			 trained and certified as described in
			 <internal-xref legis-path="3.(a)(2)(C)(iii)(I)">clause (i)</internal-xref> are
			 not immediately available due to the unforeseeable nature of the emergency
			 circumstance.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA5F18C3E0FB5475BBCAC92BB26247634"><enum>(4)</enum><text display-inline="yes-display-inline">Each State and local educational agency
			 shall ensure that a sufficient number of school personnel are trained and
			 certified by a State-approved training program to meet the needs of the
			 specific student population in each school in the State or served by the local
			 educational agency, respectively.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H519B9659C9F745528EDACEDC81D04969"><enum>(5)</enum><text display-inline="yes-display-inline">The use of physical restraint or seclusion
			 as a planned intervention shall not be written into a student’s education plan,
			 individual safety plan, behavioral plan, or individualized education program
			 (as defined in section 614(d) of the Individuals with Disabilities Education
			 Act (20 U.S.C. 1414(d))).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35AA580DA2914ABB8676C2F588B48429"><enum>(6)</enum><text display-inline="yes-display-inline">Within 72 hours after the imposition of
			 physical restraint or seclusion upon a student, all school personnel involved
			 in the physical restraint or seclusion and appropriate supervisory and
			 administrative staff shall participate in a debriefing session, which shall
			 include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id618DCE7BA3CF497399A65947881AA0DA"><enum>(A)</enum><text display-inline="yes-display-inline">documentation of antecedents to the
			 physical restraint or seclusion; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFC8F7E3026584351851093DE7F2CCBA9"><enum>(B)</enum><text display-inline="yes-display-inline">prevention planning.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD110120C2D4D4C58B22A3C96B249E047"><enum>(7)</enum><text display-inline="yes-display-inline">Each school shall establish procedures to
			 be followed after each incident involving the imposition of physical restraint
			 or seclusion upon a student, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H60036A62A2484F9190E4D5812ADC7383"><enum>(A)</enum><text display-inline="yes-display-inline">procedures to provide to the parent of the
			 student, with respect to each such incident—</text>
						<clause commented="no" display-inline="no-display-inline" id="H7A6B931A4AEE4BB584EDFF54B33A1A17"><enum>(i)</enum><text display-inline="yes-display-inline">a documented, reasonable attempt to provide
			 immediate verbal or electronic communication on the same day as each such
			 incident;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HE3DFFAC765554E47B2B8F4D819F90998"><enum>(ii)</enum><text display-inline="yes-display-inline">within 24 hours of each such incident,
			 written notification; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA0F1748CF03E4E57BD200A8615F1227C"><enum>(iii)</enum><text display-inline="yes-display-inline">advance notice of the debriefing session
			 described in paragraph (6) that will be held regarding such incident and an
			 opportunity to attend the debriefing session; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86D742172EF543BC8177657DD81B38D9"><enum>(B)</enum><text display-inline="yes-display-inline">in a case where serious bodily injury (as
			 defined in section 1365(h) of title 18, United States Code) or death of a
			 student of the school occurs from the use of seclusion or physical restraint,
			 procedures to notify, in writing, the State protection and advocacy system
			 within 24 hours after such incident occurs.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9A42228D59404F9782FFE7BC5C67E411"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to authorize the Secretary to promulgate regulations prohibiting the use
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id91CDC5405D0548619B7CF5B20005D465"><enum>(1)</enum><text display-inline="yes-display-inline">time out; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdac3d70477a1407594d71cc89c281262"><enum>(2)</enum><text display-inline="yes-display-inline">devices implemented by a trained school
			 personnel, or utilized by a student, for the specific and approved therapeutic
			 or safety purposes for which such devices were designed, and, if applicable,
			 prescribed, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID11fc2b8230dc4f10b528dcbbd4691141"><enum>(A)</enum><text display-inline="yes-display-inline">restraints for medical
			 immobilization;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDCD93080A10A4B31B2106D054CE606F4"><enum>(B)</enum><text display-inline="yes-display-inline">adaptive devices or mechanical supports
			 used to achieve proper body position, balance, or alignment to allow greater
			 freedom of mobility than would be possible without the use of such a mechanical
			 support; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE75CF0F0E354F57B39E47856B9DFEC0"><enum>(C)</enum><text display-inline="yes-display-inline">vehicle safety restraints when used as
			 intended during the transport of a student in a moving vehicle.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDeddbc81e234947819b5e9dfda3b9ee66" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">State plan and data collection requirements
			 and enforcement</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID57c4b4c6fbc54db2b1addc469879aea6"><enum>(a)</enum><header display-inline="yes-display-inline">State plan</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, and each year thereafter, each State educational agency
			 shall submit to the Secretary a State plan that provides—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd434a1ef1c4c4ede8f983a512fbbe5be"><enum>(1)</enum><text display-inline="yes-display-inline">assurances to the Secretary that the State
			 has in effect—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID914704f653d045e496e20792ebf874d0"><enum>(A)</enum><text display-inline="yes-display-inline">State policies and procedures that meet the
			 minimum standards required by the regulations prescribed by the Secretary
			 pursuant to section 5(a); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6e240e94f9ab421a880d89602db7484f"><enum>(B)</enum><text display-inline="yes-display-inline">a State mechanism to effectively monitor
			 and enforce the minimum standards;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53415933eb5542caaa04e06c515a3e45"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the State policies and
			 procedures described in paragraph (1)(A); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C9AFDB019E644FABAEA2C3390D4949C"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the plans to ensure school
			 personnel and parents are aware of the State policies and procedures.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF637EEA1306F47AD82F2C14E1E01B3DD"><enum>(b)</enum><header display-inline="yes-display-inline">Reporting</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HEBA7B08D3B564AFE9F4ED575F54945F4"><enum>(1)</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="yes-display-inline">Not later than 2 years after the date the
			 Secretary promulgates regulations pursuant to section 5(a), and each year
			 thereafter, each State educational agency shall (in compliance with the
			 requirements of section 444 of the General Education Provisions Act (commonly
			 known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>)
			 (20 U.S.C. 1232g)) prepare and submit to the Secretary, and make available to
			 the public, a report with respect to each local educational agency, and each
			 school not under the jurisdiction of a local educational agency, located in the
			 same State as such State educational agency, that includes the information
			 described in paragraph (2).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2AE7979B07D6428C890C014C912B79D4"><enum>(2)</enum><header display-inline="yes-display-inline">Information requirements</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC0BF04B201A8456BA9A794298FE5DF8D"><enum>(A)</enum><header display-inline="yes-display-inline">General information
			 requirements</header><text display-inline="yes-display-inline">The report
			 described in paragraph (1) shall include information on—</text>
						<clause commented="no" display-inline="no-display-inline" id="H528C6CC871DA46FE95AFFDC4AF1CAEEA"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of incidents in the
			 preceding full academic year in which physical restraint was imposed upon a
			 student; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HC79A049878D244ABAB7CDC2E0028ABF6"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of incidents in the
			 preceding full academic year in which seclusion was imposed upon a
			 student.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94C49788DE1048BE9B21668C70B9F02A"><enum>(B)</enum><header display-inline="yes-display-inline">Disaggregation</header>
						<clause commented="no" display-inline="no-display-inline" id="H4C80094B8102484E9B6FA96799262FD9"><enum>(i)</enum><header display-inline="yes-display-inline">General disaggregation
			 requirements</header><text display-inline="yes-display-inline">The information
			 described in subparagraph (A) shall be disaggregated by—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H44959DD7D69D4A909FC04AF131A310CD"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of incidents in which
			 physical restraint or seclusion was imposed upon a student—</text>
								<item commented="no" display-inline="no-display-inline" id="H2C5E685380924FFF88C4B8C4CB0A3D4A"><enum>(aa)</enum><text display-inline="yes-display-inline">that resulted in injury;</text>
								</item><item commented="no" display-inline="no-display-inline" id="H75038722C11E4A55B63089438F32B1B3"><enum>(bb)</enum><text display-inline="yes-display-inline">that resulted in death; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H0DDABB06AD624F89B696C17ED047312B"><enum>(cc)</enum><text display-inline="yes-display-inline">in which the school personnel imposing
			 physical restraint or seclusion were not trained and certified as described in
			 section 5(a)(3)(C)(i); and</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="HC9B4711C7D524C048B1468CCF7AD9CFD"><enum>(II)</enum><text display-inline="yes-display-inline">the demographic characteristics of all
			 students upon whom physical restraint or seclusion was imposed,
			 including—</text>
								<item commented="no" display-inline="no-display-inline" id="HE592B9DC761647B3952D487E3F216DD8"><enum>(aa)</enum><text display-inline="yes-display-inline">the categories described in section
			 1111(h)(1)(C)(i) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6311(h)(1)(C)(i));</text>
								</item><item commented="no" display-inline="no-display-inline" id="HD1AC4AA4FC6F4CFC9D0528EB064D9C24"><enum>(bb)</enum><text display-inline="yes-display-inline">age; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H2FD050E27C7347F589B8CDAEDBF7EE38"><enum>(cc)</enum><text display-inline="yes-display-inline">disability status, which has the meaning
			 given the term <term>individual with a disability</term> in paragraph (20)
			 (except for subparagraph (A) of section 7 of the Rehabilitation Act of 1973)
			 (29 U.S.C. 705(20)).</text>
								</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H33A14B374F58402EBC22660733BADA28"><enum>(ii)</enum><header display-inline="yes-display-inline">Unduplicated count; exception</header><text display-inline="yes-display-inline">The disaggregation required under clause
			 (i) shall—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H1755D4C496844E5BA14B3FAC0198BE1E"><enum>(I)</enum><text display-inline="yes-display-inline">be carried out in a manner to ensure an
			 unduplicated count of the—</text>
								<item commented="no" display-inline="no-display-inline" id="H11BCE8D3123247478DAE4EB7A5865807"><enum>(aa)</enum><text display-inline="yes-display-inline">total number of incidents in the preceding
			 full-academic year in which physical restraint was imposed upon a student;
			 and</text>
								</item><item commented="no" display-inline="no-display-inline" id="H21A21DA7B6A040DDB0B58439E0E90D05"><enum>(bb)</enum><text display-inline="yes-display-inline">total number of incidents in the preceding
			 full-academic year in which seclusion was imposed upon a student; and</text>
								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="HA512F5203A9A48CBADD9549A010775A4"><enum>(II)</enum><text display-inline="yes-display-inline">not be required in a case in which the
			 number of students in a category would reveal personally identifiable
			 information about an individual student.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D03EDBB6A7F4A96A6A781DEACAF7B9D"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HDE227672C3E34B9CAB0E3BD87F978D32"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HA1458009EC8E4AFFA900F09C895184B8"><enum>(A)</enum><header display-inline="yes-display-inline">Use of remedies</header><text display-inline="yes-display-inline">If a State educational agency fails to
			 comply with <internal-xref legis-path="102.(a)">subsection (a)</internal-xref>
			 or <internal-xref legis-path="4.(b)(2)">(b)(2)</internal-xref>, the Secretary
			 shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="H31EC8D40588744BE84760B37180464D3"><enum>(i)</enum><text display-inline="yes-display-inline">withhold from the State educational agency,
			 in whole or in part, further payments under an applicable program in accordance
			 with section 455 of the General Education Provisions Act (20 U.S.C.
			 1234d);</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H5B22E14225344058B71E77B3A3E533FA"><enum>(ii)</enum><text display-inline="yes-display-inline">require the State educational agency to
			 submit and implement, not later than 1 year after the State's failure to
			 comply, a corrective plan of action, which may include redirection of funds
			 received under an applicable program after the date of enactment of this Act;
			 or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HD9E4D738A7F344A0AFB62AF6847F0CBF"><enum>(iii)</enum><text display-inline="yes-display-inline">issue a complaint to compel compliance of
			 the State educational agency through a cease and desist order, in the same
			 manner the Secretary is authorized to take such action under section 456 of the
			 General Education Provisions Act (20 U.S.C. 1234e).</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A03AD15DF694B2D9D937D58DCDFD8B5"><enum>(B)</enum><header display-inline="yes-display-inline">Cessation of withholding of
			 funds</header><text display-inline="yes-display-inline">Whenever the Secretary
			 determines (whether by certification or other appropriate evidence) that a
			 State educational agency that is subject to the withholding of payments under
			 subparagraph (A)(i) has cured the failure providing the basis for the
			 withholding of payments, the Secretary shall cease the withholding of payments
			 with respect to the State educational agency under such subparagraph.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2971ADDC062E460E915EC4B06B6A90D0"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
			 construed to limit the Secretary’s authority under the General Education
			 Provisions Act (20 U.S.C. 1221 et seq.).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H827EC52F5FC140179F8CBD750C1C7DE6" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Grant authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="HBA62BCC80B9E4C1191724CD5BA3E87A4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From the amount appropriated under
			 <internal-xref idref="H9483A417ED9D42F9B1FED3EA903978DB" legis-path="107.">section 12</internal-xref>, the Secretary may award grants to
			 State educational agencies to assist the State educational agencies in—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H11D5993C24D5421FA7F86137B5D0CE1D"><enum>(1)</enum><text display-inline="yes-display-inline">establishing, implementing, and enforcing
			 the policies and procedures to meet the minimum standards required by
			 regulations prescribed by the Secretary pursuant to
			 <internal-xref idref="H8232DBCE6BFB41928253D0D69B36ADF6" legis-path="4.">section 5(a)</internal-xref>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF42C27D7CD6340F786B8FA203BDB1A40"><enum>(2)</enum><text display-inline="yes-display-inline">improving school climate and culture by
			 implementing school-wide positive behavior support approaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7C3DDB1A6AF34B96A765866E007CBB5C"><enum>(b)</enum><header display-inline="yes-display-inline">Duration of grant</header><text display-inline="yes-display-inline">A grant under this section shall be awarded
			 to a State educational agency for a 3-year period.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H86792DE61AE442219670FBE9C4FE58B3"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">Each State educational agency desiring a
			 grant under this section shall submit an application to the Secretary at such
			 time, in such manner, and accompanied by such information as the Secretary may
			 require, including information on how the State educational agency will target
			 resources to schools and local educational agencies in need of assistance
			 related to preventing and reducing physical restraint and seclusion.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H23EE38E889004F82B1143FE18F1A51F7"><enum>(d)</enum><header display-inline="yes-display-inline">Authority To make subgrants</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H53FE72C165E946A29EA57A444CA92FB8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant under this section may carry out the activities described in subsections
			 (e) and (f), as required under the grant, by awarding subgrants, on a
			 competitive basis, to local educational agencies.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42FB0032A3B5419DBE424F04100209A8"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A local educational agency desiring to
			 receive a subgrant under paragraph (1) shall submit an application to the
			 applicable State educational agency at such time, in such manner, and
			 containing such information as the State educational agency may require.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC316724D30364CA4936E07540A90D849"><enum>(e)</enum><header display-inline="yes-display-inline">Required activities</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant under this section shall use such grant funds to carry out all of the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEF647E4F57124107ACEF2322895072BF"><enum>(1)</enum><text display-inline="yes-display-inline">Researching, developing, implementing, and
			 evaluating strategies, policies, and procedures to reduce or eliminate
			 seclusion and physical restraint in schools, consistent with the minimum
			 standards required by regulations prescribed by the Secretary pursuant to
			 <internal-xref idref="H8232DBCE6BFB41928253D0D69B36ADF6" legis-path="4.">section 5(a)</internal-xref>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36C085529D4A4D2B9A8791E4C5A2279E"><enum>(2)</enum><text display-inline="yes-display-inline">Providing professional development,
			 training, and certification for school personnel to meet such standards.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6466E1570A2450EA9DDFD039F902A46"><enum>(3)</enum><text display-inline="yes-display-inline">Carrying out the reporting requirements
			 under
			 <internal-xref idref="HF637EEA1306F47AD82F2C14E1E01B3DD" legis-path="6.(b)">section 6(b)</internal-xref> and analyzing the information
			 included in a report prepared under such section to identify student, school
			 personnel, and school needs related to use of physical restraint and
			 seclusion.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H57087FDDA2DE489A8485E005C765F454"><enum>(f)</enum><header display-inline="yes-display-inline">Authorized activities</header><text display-inline="yes-display-inline">A State educational agency receiving a
			 grant under this section may use such grant funds for one or more of the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA6B7FCE5D85C4BE89D9C09CF6AE75C01"><enum>(1)</enum><text display-inline="yes-display-inline">Developing and implementing high-quality
			 professional development and training programs to implement evidence-based
			 systematic approaches to school-wide positive behavior supports, including
			 improving coaching, facilitation, and training capacity for administrators,
			 teachers, specialized instructional support personnel, and other staff.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF091B2B77DD34FE6A56E9452089FF842"><enum>(2)</enum><text display-inline="yes-display-inline">Providing technical assistance to develop
			 and implement evidence-based systematic approaches to school-wide positive
			 behavior supports, including technical assistance for data-driven
			 decisionmaking related to behavioral supports and interventions in the
			 classroom.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49F876C0680141158DB3967B5F33B619"><enum>(3)</enum><text display-inline="yes-display-inline">Researching, evaluating, and disseminating
			 high-quality evidence-based programs and activities that implement school-wide
			 positive behavior supports with fidelity.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H826F6DE63EB743279DE38C118CC4A652"><enum>(g)</enum><header display-inline="yes-display-inline">Evaluation and report</header><text display-inline="yes-display-inline">Each State educational agency receiving a
			 grant under this section shall, at the end of the grant
			 period<italic></italic>—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HC0251CFF86844B0B97CCC02CCBF466D6"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the State’s progress toward the
			 reduction and elimination of seclusion and physical restraint in the schools
			 located in the State, consistent with the minimum standards required by
			 regulations prescribed by the Secretary pursuant to section 5(a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H52A26F5A98F148B8B144D0FCF02FC007"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Secretary a report on such
			 progress.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB6FF871561C14A7386C0B0960A96425C" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">National assessment</header>
			<subsection commented="no" display-inline="no-display-inline" id="H5B35419C88324849A5987AF428C68754"><enum>(a)</enum><header display-inline="yes-display-inline">National Assessment</header><text display-inline="yes-display-inline">The Secretary shall carry out a national
			 assessment to determine the effectiveness of this Act, which shall
			 include—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H016116CC25404C74B01F39EBB69ACDD3"><enum>(1)</enum><text display-inline="yes-display-inline">collecting and analyzing data related to
			 seclusion, physical restraint, and aversive behavioral interventions in
			 schools;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H06BBE6E132AF47B68DAC588F8C61312F"><enum>(2)</enum><text display-inline="yes-display-inline">analyzing the effectiveness of Federal,
			 State, and local efforts to reduce the number of seclusion and physical
			 restraint incidents in schools;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2BB4568767C948AA90072EB96897EA55"><enum>(3)</enum><text display-inline="yes-display-inline">identifying the types of programs and
			 services that have demonstrated the greatest effectiveness in preventing and
			 reducing the number of physical restraint and seclusion incidents in schools;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B55CA4D131842729BBC9D69F501AE4E"><enum>(4)</enum><text display-inline="yes-display-inline">identifying personnel training models with
			 demonstrated success in reducing the number of seclusion and physical restraint
			 incidents in schools, including models that emphasize positive behavior
			 supports and de-escalation techniques over physical intervention.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3C6F2F5AB64A48AF8CC7D997AB6DD8FC"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committee
			 on Education and Labor of the House of Representatives and the Committee on
			 Health, Education, Labor, and Pensions of the Senate—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HEC349510B83847F9814FBAB2A28DAF73"><enum>(1)</enum><text display-inline="yes-display-inline">an interim report that summarizes the
			 preliminary findings of the assessment described in
			 <internal-xref idref="H5B35419C88324849A5987AF428C68754" legis-path="104.(a)">subsection (a)</internal-xref> not later than 3 years
			 after the date of enactment of this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H33B2A1BD6FA8481CBC7DD80379D01B2E"><enum>(2)</enum><text display-inline="yes-display-inline">a final report of the findings of the
			 assessment not later than 5 years after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HBA5767DF7CDE4D559CB398DE02DBDF6C" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Protection and advocacy
			 systems</header><text display-inline="no-display-inline">Protection and
			 advocacy systems shall have the authority provided under section 143 of the
			 Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42 U.S.C.
			 15043) to investigate, monitor, and enforce protections provided for students
			 under this Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HCB9391299D454DFA9B4BCCCC4308D55A" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Head Start programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB82260D172994E42A15FCF01ED6728C6"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 in consultation with the Secretary of Education, shall promulgate regulations
			 with respect to Head Start agencies administering Head Start programs under the
			 Head Start Act (42 U.S.C. 9801 et seq.) that establish requirements consistent
			 with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD71F60DB9E4347C6B882096ABB6413D4"><enum>(1)</enum><text display-inline="yes-display-inline">the requirements established by regulations
			 promulgated pursuant to section 5(a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H27D7260A1E1A4FD98CAA2D34F3C92C57"><enum>(2)</enum><text display-inline="yes-display-inline">the reporting and enforcement requirements
			 described in subsections (b) and (c) of section 6.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H145C46B67916463B999684F4982759D6"><enum>(b)</enum><header display-inline="yes-display-inline">Grant authority</header><text display-inline="yes-display-inline">From the amount appropriated under
			 <internal-xref legis-path="12.">section 12</internal-xref>, the Secretary of
			 Education may allocate funds to the Secretary of Health and Human Services to
			 assist the Head Start agencies in establishing, implementing, and enforcing
			 policies and procedures to meet the requirements established by regulations
			 promulgated pursuant to subsection (a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H3D403E1F92DF40698AC4E650A560ECAD" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Limitation of authority</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 restrict or limit, or allow the Secretary to restrict or limit, any other
			 rights or remedies otherwise available to students or the families of students
			 under Federal or State law.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H9483A417ED9D42F9B1FED3EA903978DB" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary for fiscal year 2011 and each of the 4 succeeding fiscal
			 years.</text>
