		<section id="id91385BC656944DA58C1ABC4F59602B25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Transitional Federal Medical
			 Assistance Percentage Act</short-title></quote>.</text>
		</section><section id="idC9221BAF21134D82A786FC604BF6D282" section-type="subsequent-section"><enum>2.</enum><header>Extension of ARRA
			 increase in FMAP</header><text display-inline="no-display-inline">Section 5001
			 of ARRA is amended—</text>
			<paragraph id="id08EFCA2FD32E4BCBAD303D5FB87E1716"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by striking
			 <quote>first calendar quarter</quote> and inserting <quote>first 3 calendar
			 quarters</quote>;</text>
			</paragraph><paragraph id="id2C245F4E35C340818946EB0CEC8DFB7E"><enum>(2)</enum><text>in subsection
			 (b)(2), by inserting before the period at the end the following: <quote>and
			 such paragraph shall not apply to calendar quarters beginning on or after
			 October 1, 2010</quote>;</text>
			</paragraph><paragraph id="id427D8103E8AC4B18AEC26975C065122D"><enum>(3)</enum><text>in subsection
			 (d), by inserting <quote>ending before October 1, 2010</quote> after
			 <quote>entire fiscal years</quote> and after <quote>with respect to fiscal
			 years</quote>;</text>
			</paragraph><paragraph id="idD67061E9E2BF44E59C8C82A69AEFA9BE"><enum>(4)</enum><text>in subsection
			 (g)(1), by striking <quote>September 30, 2011</quote> and inserting
			 <quote>December 31, 2011</quote>; and</text>
			</paragraph><paragraph id="id0D60F7F5053C428BB56FAE8EF1FE1E33"><enum>(5)</enum><text>in subsection
			 (h)(3), by striking <quote>December 31, 2010</quote> and inserting <quote>June
			 30, 2011</quote>.</text>
			</paragraph></section><section id="idED281FCE95D94529A099F0082FF524DB" section-type="subsequent-section"><enum>3.</enum><header>ARRA transitional
			 assistance period</header><text display-inline="no-display-inline">For each
			 fiscal quarter occurring during the period beginning on July 1, 2011, and
			 ending on December 31, 2013 (referred to in this Act as the <quote>ARRA
			 transitional assistance period</quote>), a State's FMAP shall be equal to the
			 sum of—</text>
			<paragraph id="id5956840AC715473CA39073ACC548950A"><enum>(1)</enum><text display-inline="yes-display-inline">the adjusted base FMAP (as determined under
			 section 4(a)(1));</text>
			</paragraph><paragraph id="id80A2A5F7EF334787A5569337B05E844C"><enum>(2)</enum><text display-inline="yes-display-inline">the general FMAP adjustment (as determined
			 under section 4(a)(2)); and</text>
			</paragraph><paragraph id="id65D0D7F8DA2A419AAF9E8227883B0620"><enum>(3)</enum><text display-inline="yes-display-inline">the unemployment FMAP adjustment (as
			 determined under section 4(a)(3)).</text>
			</paragraph></section><section id="id606509AB857F48C5BFE3B53F40D7AB98" section-type="subsequent-section"><enum>4.</enum><header>Adjustments to Federal
			 medical assistance percentage</header>
			<subsection id="id07EA115896164FC98CCE3B64EA1F1BBD"><enum>(a)</enum><header>Determination
			 of adjusted FMAP</header>
				<paragraph id="id4F6626429310411AB6470FEDE39D47CF"><enum>(1)</enum><header>Adjusted base
			 FMAP</header>
					<subparagraph id="id436285F0680341B58A833612E72094CC"><enum>(A)</enum><header>In
			 General</header><text>Subject to subparagraph (B), the adjusted base FMAP is
			 determined as follows:</text>
						<clause id="idC536E8E9FE984661ADB9CA454C0E47FD"><enum>(i)</enum><text>For
			 the fourth quarter of fiscal year 2011, the FMAP that would have applied to the
			 State under section 5001(a) of ARRA (assuming that such section applied) for
			 such fiscal quarter minus 2 percentage points.</text>
						</clause><clause id="id9A9F36870BF14DD1B5D92E8B8525D9D8"><enum>(ii)</enum><text>For any
			 subsequent fiscal quarter occurring during the ARRA transitional assistance
			 period, the FMAP as determined under this paragraph for the preceding fiscal
			 quarter minus 2 percentage points.</text>
						</clause></subparagraph><subparagraph commented="no" id="id9AB2EF1415454A6D994B7E0DCA21CE4B"><enum>(B)</enum><header>Elimination of
			 negative adjustment</header><text>If the adjusted base FMAP applicable to a
			 State under this paragraph for any fiscal quarter occurring during the ARRA
			 transitional assistance period would be less than the FMAP determined for the
			 State for such quarter without regard to this paragraph, this paragraph shall
			 not apply to such State.</text>
					</subparagraph></paragraph><paragraph id="id971B67A320EA410D868032437596D14C"><enum>(2)</enum><header>General FMAP
			 adjustment</header><text>The general FMAP adjustment shall be equal to the
			 following:</text>
					<subparagraph id="idFB4947315AEE49DABE85C5F5B0643D60"><enum>(A)</enum><text>For the fourth
			 quarter of fiscal year 2011, 5.7 percentage points.</text>
					</subparagraph><subparagraph id="idF808FE6A21C841D2878372F31F4864CB"><enum>(B)</enum><text>For the first
			 quarter of fiscal year 2012, 4.95 percentage points.</text>
					</subparagraph><subparagraph id="idB6128EEB58F54C73AB4ADC512321095F"><enum>(C)</enum><text>For the second
			 quarter of fiscal year 2012, 3.95 percentage points.</text>
					</subparagraph><subparagraph id="id5754E2ABEC0B494794C9EDD484BAACA0"><enum>(D)</enum><text>For the third
			 quarter of fiscal year 2012, 2.7 percentage points.</text>
					</subparagraph><subparagraph id="id47179FE0185B4CE8A43D728DE508EFFE"><enum>(E)</enum><text>For the fourth
			 quarter of fiscal year 2012, 1.2 percentage points.</text>
					</subparagraph><subparagraph id="idE56BC1922D63463BB701699FDC3D8A2A"><enum>(F)</enum><text>For any
			 subsequent fiscal quarter occurring during the ARRA transitional assistance
			 period, 0.2 percentage points.</text>
					</subparagraph></paragraph><paragraph id="idF721196BA4AB4E90BA5DC2B8AEC864A8"><enum>(3)</enum><header>Unemployment
			 FMAP adjustment</header>
					<subparagraph id="idBDD445763AEE42B6A2843FD7429A2E59"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraphs (C) and (D), the unemployment
			 FMAP adjustment shall be equal to the increase in the State's FMAP that would
			 have applied to the State under section 5001(c) of ARRA (assuming that such
			 section applied) for such fiscal quarter minus the applicable reduction amount
			 (as described under subparagraph (B)).</text>
					</subparagraph><subparagraph id="id5411FC861F304103B934216F4D0049CE"><enum>(B)</enum><header>Applicable
			 reduction amount</header><text>For purposes of subparagraph (A), the applicable
			 reduction amount shall be equal to the following:</text>
						<clause id="id2A84190A801F44428D56AEF5B08BD44D"><enum>(i)</enum><text>For
			 the fourth fiscal quarter of fiscal year 2011, 0.20 percentage points.</text>
						</clause><clause id="id68F4052118B64C6AB6EC7B54A250B5DB"><enum>(ii)</enum><text>For any
			 subsequent fiscal quarter occurring during the ARRA transitional assistance
			 period, the sum of—</text>
							<subclause id="id645AEF9DCF374BA09A9376189D56707C"><enum>(I)</enum><text>the applicable
			 reduction amount for the preceding fiscal quarter; and</text>
							</subclause><subclause id="id10C441A669D54051B74CD910A6158035"><enum>(II)</enum><text>0.05 percentage
			 points.</text>
							</subclause></clause></subparagraph><subparagraph commented="no" id="idA73EE22D81C0411A9EB2807B6CD1BCFD"><enum>(C)</enum><header>Elimination of
			 negative adjustment</header><text>If the unemployment FMAP adjustment
			 applicable to a State under this paragraph for any fiscal quarter during the
			 ARRA transitional assistance period would be less than zero, this paragraph
			 shall not apply to such State.</text>
					</subparagraph><subparagraph commented="no" id="id7BABA3ED083A4C5F98CCB9416E072F3E"><enum>(D)</enum><header>Special
			 rule</header>
						<clause commented="no" id="idEFF1BF7930F24C47857CA48D58839834"><enum>(i)</enum><header>In
			 general</header><text>For purposes of subparagraph (A), with respect to the
			 computation of the state unemployment increase percentage (as described under
			 section 5001(c)(4) of ARRA) for the last 2 fiscal quarters of the ARRA
			 transitional assistance period, the most recent previous 3-consecutive-month
			 period (as described under section 5001(c)(4)(A)(i) of ARRA) shall be the
			 3-consecutive-month period beginning with December 2012, or, if it results in a
			 higher applicable percent under section 5001(c)(3) of ARRA, the
			 3-consecutive-month period beginning with January 2013.</text>
						</clause><clause commented="no" id="idCE4820D879F247D5A64E794452128EFA"><enum>(ii)</enum><header>Repeal of
			 special rule under ARRA for last 2 calendar quarters of the recession
			 adjustment period</header><text>Section 5001(c)(4) of ARRA is amended by
			 striking subparagraph (C) and inserting the following:</text>
							<quoted-block act-name="" id="idF4C6B35D3FF6472D9376CD7D416910AB" style="OLC">
								<subparagraph id="id05D390C3373C4933826BBD64627E1CA0"><enum>(C)</enum><header>Special
				rule</header><text>With respect to the first 2 calendar quarters of the
				recession adjustment period, the most recent previous 3-consecutive-month
				period described in subparagraph (A)(i) shall be the 3-consecutive-month period
				beginning with October
				2008.</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection><subsection id="id90B92439CAFA44478E1C06BDB28831F1"><enum>(b)</enum><header>Scope of
			 application</header><text>The adjustments in the FMAP for a State under this
			 section shall apply for purposes of title XIX of the Social Security Act and
			 shall not apply with respect to—</text>
				<paragraph id="ID2d17bc0cdfc946049ae62fea4a0ca5f8"><enum>(1)</enum><text>disproportionate
			 share hospital payments described in section 1923 of such Act (42 U.S.C.
			 1396r–4);</text>
				</paragraph><paragraph id="IDa43f8f204c9c40bd81c854eeee43237c"><enum>(2)</enum><text>payments under
			 title IV of such Act (42 U.S.C. 601 et seq.) (except that the increases under
			 paragraphs (1) and (2) of subsection (a) shall apply to payments under part E
			 of title IV of such Act (42 U.S.C. 670 et seq.) and, for purposes of the
			 application of this section to the District of Columbia, payments under such
			 part shall be deemed to be made on the basis of the FMAP applied with respect
			 to such District for purposes of title XIX and as increased under subsection
			 (a)(2));</text>
				</paragraph><paragraph id="ID9efe23ad45a44752b794b688e15b62cd"><enum>(3)</enum><text>any payments
			 under title XXI of such Act (42 U.S.C. 1397aa et seq.);</text>
				</paragraph><paragraph id="ID13f413305532425d80079769d517bbc8"><enum>(4)</enum><text>any payments
			 under title XIX of such Act that are based on the enhanced FMAP described in
			 section 2105(b) of such Act (42 U.S.C. 1397ee(b)); or</text>
				</paragraph><paragraph id="IDfeade93288ef48eca5989712e9fc94bd"><enum>(5)</enum><text>any payments
			 under title XIX of such Act that are attributable to expenditures for medical
			 assistance provided to individuals made eligible under a State plan under title
			 XIX of the Social Security Act (including under any waiver under such title or
			 under section 1115 of such Act (42 U.S.C. 1315)) because of income standards
			 (expressed as a percentage of the poverty line) for eligibility for medical
			 assistance that are higher than the income standards (as so expressed) for such
			 eligibility as in effect on July 1, 2008, (including as such standards were
			 proposed to be in effect under a State law enacted but not effective as of such
			 date or a State plan amendment or waiver request under title XIX of such Act
			 that was pending approval on such date).</text>
				</paragraph></subsection><subsection id="id5C8907146A494C789A0191041DA65353"><enum>(c)</enum><header>State
			 ineligibility; limitation; special rules</header>
				<paragraph id="id0F6BD09C6BC64B78BA6D44884FA3983F"><enum>(1)</enum><header>Maintenance of
			 eligibility requirements</header>
					<subparagraph id="idCF75354BB9714D26A396152807878C08"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B) and (C), a State is not
			 eligible for an increase in its FMAP under subsection (a) if eligibility
			 standards, methodologies, or procedures under its State plan under title XIX of
			 the Social Security Act (including any waiver under such title or under section
			 1115 of such Act (42 U.S.C. 1315)) are more restrictive than the eligibility
			 standards, methodologies, or procedures, respectively, under such plan (or
			 waiver) as in effect on July 1, 2008.</text>
					</subparagraph><subparagraph id="idA14C4DD04231426DA53A049FB0DC39FC"><enum>(B)</enum><header>State
			 reinstatement of eligibility permitted</header><text>Subject to subparagraph
			 (C), a State that has restricted eligibility standards, methodologies, or
			 procedures under its State plan under title XIX of the Social Security Act
			 (including any waiver under such title or under section 1115 of such Act (42
			 U.S.C. 1315)) after July 1, 2008, is no longer ineligible under subparagraph
			 (A) beginning with the first calendar quarter in which the State has reinstated
			 eligibility standards, methodologies, or procedures that are no more
			 restrictive than the eligibility standards, methodologies, or procedures,
			 respectively, under such plan (or waiver) as in effect on July 1, 2008.</text>
					</subparagraph><subparagraph id="idAC3905647E6D4A53B9AD453BF9E79426"><enum>(C)</enum><header>Special
			 rules</header><text>A State shall not be ineligible under subparagraph
			 (A)—</text>
						<clause id="idC93C92421D494A75B8171EE92A75AAD5"><enum>(i)</enum><text>for
			 the fiscal quarters before October 1, 2011, on the basis of a restriction that
			 was applied after July 1, 2008, and before the date of the enactment of this
			 Act, if the State prior to October 1, 2011, has reinstated eligibility
			 standards, methodologies, or procedures that are no more restrictive than the
			 eligibility standards, methodologies, or procedures, respectively, under such
			 plan (or waiver) as in effect on July 1, 2008; or</text>
						</clause><clause id="id3C27ECC8996246FDB07E1B465F434EED"><enum>(ii)</enum><text>on
			 the basis of a restriction that was directed to be made under State law as in
			 effect on July 1, 2008, and would have been in effect as of such date, but for
			 a delay in the effective date of a waiver under section 1115 of such Act with
			 respect to such restriction.</text>
						</clause></subparagraph></paragraph><paragraph id="id6E98794E3E604A4892CBB77124D6AD07"><enum>(2)</enum><header>Compliance with
			 prompt pay requirements</header>
					<subparagraph id="idFDC67D00D0FF4524BD0C0A703BBB19A2"><enum>(A)</enum><header>Application to
			 practitioners</header>
						<clause id="idA4744CDB55F04D929479ACFED0DACE6A"><enum>(i)</enum><header>In
			 general</header><text>Subject to the succeeding provisions of this
			 subparagraph, no State shall be eligible for an increased FMAP rate as provided
			 under this section for any claim received by a State from a practitioner
			 subject to the terms of section 1902(a)(37)(A) of the Social Security Act (42
			 U.S.C. 1396a(a)(37)(A)) for such days during any period in which that State has
			 failed to pay claims in accordance with such section as applied under title XIX
			 of such Act.</text>
						</clause><clause id="idB5F633C4BF9D4438A91787F08A5008F2"><enum>(ii)</enum><header>Reporting
			 requirement</header><text>Each State shall report to the Secretary, on a
			 quarterly basis, its compliance with the requirements of clause (i) as such
			 requirements pertain to claims made for covered services during each month of
			 the preceding quarter.</text>
						</clause><clause id="id46E26AF458BB42288F09D1C0615C9DF2"><enum>(iii)</enum><header>Waiver
			 authority</header><text>The Secretary may waive the application of clause (i)
			 to a State, or the reporting requirement imposed under clause (ii), during any
			 period in which there are exigent circumstances, including natural disasters,
			 that prevent the timely processing of claims or the submission of such a
			 report.</text>
						</clause><clause id="idD7F17556919341558D8E89FD0887DF0A"><enum>(iv)</enum><header>Application to
			 claims</header><text>Clauses (i) and (ii) shall only apply to claims made for
			 covered services after the date of enactment of this Act.</text>
						</clause></subparagraph><subparagraph id="id11ECB5A5DD354496959648675C3E0CCC"><enum>(B)</enum><header>Application to
			 nursing facilities and hospitals</header><text>The provisions of subparagraph
			 (A) shall apply with respect to a nursing facility or hospital, insofar as it
			 is paid under title XIX of the Social Security Act on the basis of submission
			 of claims, in the same or similar manner (but within the same timeframe) as
			 such provisions apply to practitioners described in such subparagraph.</text>
					</subparagraph></paragraph><paragraph id="id8C679ED914D64F6797ADE17E1B8C448D"><enum>(3)</enum><header>State's
			 application toward rainy day fund</header><text>A State is not eligible for an
			 increase in its FMAP under paragraphs (2) or (3) of subsection (a) if any
			 amounts attributable (directly or indirectly) to such increase are deposited or
			 credited into any reserve or rainy day fund of the State.</text>
				</paragraph><paragraph id="id5787434597054F0C922D4EFC7071D11F"><enum>(4)</enum><header>No waiver
			 authority</header><text>Except as provided in paragraph (2)(A)(iii), the
			 Secretary may not waive the application of this subsection or subsection (d)
			 under section 1115 of the Social Security Act or otherwise.</text>
				</paragraph><paragraph id="id8DD290FA618A4736B4810300130C39CF"><enum>(5)</enum><header>Limitation of
			 fmap to 100 percent</header><text>In no case shall an increase in FMAP under
			 this section result in an FMAP that exceeds 100 percent.</text>
				</paragraph></subsection><subsection id="idDEFA8012EDAF4E23896B0217DE30B9C0"><enum>(d)</enum><header>Requirements</header>
				<paragraph id="idC1CCB5B73EE647F2B6F2DB85077EF0DF"><enum>(1)</enum><header>State
			 reports</header><text>Each State that is paid additional Federal funds as a
			 result of this section shall, not later than September 30, 2014, submit a
			 report to the Secretary, in such form and such manner as the Secretary shall
			 determine, regarding how the additional Federal funds were expended.</text>
				</paragraph><paragraph id="id728947F47EF2473A913159507972F39B"><enum>(2)</enum><header>Additional
			 requirement for certain States</header><text>In the case of a State that
			 requires political subdivisions within the State to contribute toward the
			 non-Federal share of expenditures under the State Medicaid plan required under
			 section 1902(a)(2) of the Social Security Act (42 U.S.C. 1396a(a)(2)), the
			 State is not eligible for an increase in its FMAP under paragraphs (2) or (3)
			 of subsection (a) if it requires that such political subdivisions pay for
			 quarters during the ARRA transitional assistance period a greater percentage of
			 the non-Federal share of such expenditures, or a greater percentage of the
			 non-Federal share of payments under section 1923, than the respective
			 percentage that would have been required by the State under such plan on
			 September 30, 2008, prior to application of this section.</text>
				</paragraph></subsection><subsection id="id25E8142821674283A38D9DD8D56A650C"><enum>(e)</enum><header>Definitions</header><text>In
			 this Act, except as otherwise provided:</text>
				<paragraph id="id0F12E6AED7F947BA89B36E59E3AC724F"><enum>(1)</enum><header>ARRA</header><text>The
			 term <term>ARRA</term> means the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–5; 123 Stat. 140).</text>
				</paragraph><paragraph id="idBF3B985E12684205BA39D4C6DE28F1FF"><enum>(2)</enum><header>FMAP</header><text>The
			 term <term>FMAP'</term> means the Federal medical assistance percentage, as
			 defined in section 1905(b) of the Social Security Act (42 U.S.C. 1396d(b)), as
			 determined without regard to this section except as otherwise specified.</text>
				</paragraph><paragraph id="id10AAF8E8135545AC8A98776CF50F6FF7"><enum>(3)</enum><header>Poverty
			 line</header><text>The term <term>poverty line</term> has the meaning given
			 such term in section 673(2) of the Community Services Block Grant Act (42
			 U.S.C. 9902(2)), including any revision required by such section.</text>
				</paragraph><paragraph id="idB70A3FC248194532BB1E2D364FF06DBE"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Health and Human
			 Services.</text>
				</paragraph><paragraph id="id16E0929EB0934E46AAE73677713223E7"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given such term in section 1101(a)(1)
			 of the Social Security Act (42 U.S.C. 1301(a)(1)) for purposes of title XIX of
			 the Social Security Act (42 U.S.C. 1396 et seq.).</text>
				</paragraph></subsection><subsection id="id00E190FB3CCB4B2B98C28CCC6218081A"><enum>(f)</enum><header>Sunset</header><text>This
			 section shall not apply to items and services furnished after the end of the
			 ARRA transitional assistance period.</text>
