<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Unemployed Workers Act</short-title></quote>.</text> </section>
<section id="H1DB5E90E04284F63B9C769FD89AC2888" section-type="subsequent-section"><enum>2.</enum><header>Extension of emergency unemployment compensation program</header> 
<subsection id="H0511C2CD6CD8412DAC1EF0B123DB55C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4007 of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note), as amended by section 4 of the Unemployment Compensation Extension Act of 2008 (Public Law 110–449; 122 Stat. 5015) and section 2001(a) of the Assistance for Unemployed Workers and Struggling Families Act (Public Law 111–5; 123 Stat. 436), is amended—</text> 
<paragraph id="HCC4EACD4F1ED45CB893C1B472E2BB77F"><enum>(1)</enum><text>by striking <quote>December 31, 2009</quote> each place it appears and inserting <quote>December 31, 2010</quote>;</text> </paragraph>
<paragraph id="H068E07F8926F41C8001621881B268CC2"><enum>(2)</enum><text>in the heading for subsection (b)(2), by striking <quote><header-in-text level="paragraph" style="OLC">december 31, 2009</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">december 31, 2010</header-in-text></quote>; and</text> </paragraph>

<subsection id="idE5F5CC8BF8704523A02995678CCA764F"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect as if included in the enactment of the Supplemental Appropriations Act, 2008.</text> </subsection></section>
<section id="id5B6D789D0A78453DA9EDB303F609EACC"><enum>3.</enum><header>Extension of increase in unemployment compensation benefits</header> 
<subsection id="idABA4D3D4382249768C84EE3C1C5CBB71"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2002(e) of the Assistance for Unemployed Workers and Struggling Families Act (Public Law 111–5; 123 Stat. 438) is amended—</text> 
<paragraph id="idB047971B9C354BBDB14431D2DFCE05B8"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>January 1, 2010</quote> and inserting <quote>January 1, 2011</quote>;</text> </paragraph>
<paragraph id="id63F622932AA64F33880E25EB05FD3E95"><enum>(2)</enum><text>in the heading for paragraph (2), by striking <quote><header-in-text level="paragraph" style="OLC">january 1, 2010</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">january 1, 2011</header-in-text></quote>; and</text> </paragraph>

<section id="id6198A086473E4933807FACE759ECC4AF"><enum>4.</enum><header>Extension of full Federal funding of extended unemployment compensation for a limited period</header> 
<subsection id="id40822B1F32B140F29CAF13DA01FB614F"><enum>(a)</enum><header>In general</header><text>Section 2005 of the Assistance for Unemployed Workers and Struggling Families Act (Public Law 111–5; 26 U.S.C. 3304 note) is amended—</text> 
<paragraph id="id04BDE6FF634B4656B1702283E3C61717"><enum>(1)</enum><text>by striking <quote>January 1, 2010</quote> each place it appears and inserting <quote>January 1, 2011</quote>; and</text> </paragraph>
<paragraph id="id3524108074F940509F6DB547D387A6B8"><enum>(2)</enum><text>in subsection (c), by striking <quote>June 1, 2010</quote> and inserting <quote>June 1, 2011</quote>.</text> </paragraph></subsection>
<subsection id="H8D5E99477A2F4BB58938A1003462B996"><enum>(b)</enum><header>Extension of temporary Federal matching for the first week of extended benefits for States with no waiting week</header><text>Section 5 of the Unemployment Compensation Extension Act of 2008 (Public Law 110–449; 26 U.S.C. 3304 note), as amended by section 2005(d) of the Assistance for Unemployed Workers and Struggling Families Act (Public Law 111–5; 26 U.S.C. 3304 note), is amended by striking <quote>May 30, 2010</quote> and inserting <quote>May 30, 2011</quote>.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="id309AC3ADB95542759B4FC5237D32D255"><enum>(c)</enum><header>Effective dates</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id7AD356EED3B04C3BA2B85E7D382B6E3F"><enum>(1)</enum><header>In general</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of the Assistance for Unemployed Workers and Struggling Families Act.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4AD448711CD346DABAD03E891327EBB2"><enum>(2)</enum><header>First week</header><text>The amendment made by subsection (b) shall take effect as if included in the enactment of the Unemployment Compensation Extension Act of 2008.</text> </paragraph></subsection></section>
<section id="id888169CC14AC4D249266CFD4D53343A6"><enum>5.</enum><header>Modification to eligibility requirements for emergency unemployment compensation</header> 
<subsection id="idBAB4A460E53B42F28DB1D36C2E8F6A78"><enum>(a)</enum><header>Individual Not ineligible by reason of subsequent entitlement to regular benefits</header><text>Section 4001 of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="id844602257E2C4E7D84F9B41F760FAE66" style="OLC"> 
<subsection id="id40D161B379094B2FB221CE8E573B4639"><enum>(g)</enum><header>Certain rights to regular compensation disregarded</header><text>If an individual exhausted the individual's rights to regular compensation for any benefit year, such individual's eligibility to receive emergency unemployment compensation under this title in respect of such benefit year shall be determined without regard to any rights to regular compensation for a subsequent benefit year if such individual does not file a claim for regular compensation for such subsequent benefit year.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="idF8EC93E0A26B44D1AB18706BA03C5F2B"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="id6A98159EC2514A208D9F45481CFFFA31"><enum>(1)</enum><header>In general</header><text>The amendment made by this section shall apply to weeks of unemployment beginning after the date of the enactment of this Act.</text> </paragraph>
<paragraph id="id50631F11508D4579871B67163F43D81B"><enum>(2)</enum><header>Transition rules</header> 
<subparagraph id="id2964A520BFEE43CBB7E3FF447AB1CBFF"><enum>(A)</enum><header>Waiver of recovery of certain overpayments</header><text>On and after the date of the enactment of this Act, no repayment of any emergency unemployment compensation shall be required under section 4005 of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note) if the individual would have been entitled to receive such compensation had the amendment made by subsection (a) applied to all weeks beginning on or before the date of the enactment of this Act.</text> </subparagraph>
<subparagraph id="id407DACF1B34C484DB2B6D851FD1544F2"><enum>(B)</enum><header>Waiver of rights to certain regular benefits</header><text>If—</text> 
<clause id="id4E62D3E8BD0242D6B26B86F985640A61"><enum>(i)</enum><text>before the date of the enactment of this Act, an individual exhausted the individual's rights to regular compensation for any benefit year, and</text> </clause>
<clause id="idD267BE1172E843A8B2AB24FFD7EED348"><enum>(ii)</enum><text>after such exhaustion, such individual was not eligible to receive emergency unemployment compensation under title IV of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note) by reason of being entitled to regular compensation for a subsequent benefit year,</text> </clause><continuation-text continuation-text-level="subparagraph">such individual may elect to defer the individual's rights to regular compensation for such subsequent benefit year with respect to weeks beginning after such date of enactment until such individual has exhausted the individual's rights to emergency unemployment compensation in respect of the benefit year referred to in clause (i), and such individual shall be entitled to receive emergency unemployment compensation for such weeks in the same manner as if the individual had not been entitled to the regular compensation to which the election applies.</continuation-text></subparagraph></paragraph></subsection></section>
<section id="id8D4B550ACF59450486D7094C8015B2BF"><enum>6.</enum><header>Suspension of tax on portion of unemployment compensation</header> 
<subsection id="id37AEC128DB374D7B954420ED64CC6FBE"><enum>(a)</enum><header>In general</header><text>Section 85(c) of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="id14A19A6FBD4141ECBDB34746469F8FF2"><enum>(1)</enum><text>by inserting <quote>or 2010</quote> after <quote>in 2009</quote>, and</text> </paragraph>
<paragraph id="id99DE4AAA024A42F5B94E4A4891C595F2"><enum>(2)</enum><text>by inserting <quote><header-in-text level="subsection" style="OLC">and 2010</header-in-text></quote> in the heading after <quote><header-in-text level="subsection" style="OLC">2009</header-in-text></quote>.</text> </paragraph></subsection>
<subsection id="id00B860F42E154A50B67A92A457CC1155"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2009.</text> </subsection></section>
<section id="ID9c09011e293a4cc18a18fec0ab99a2b0"><enum>7.</enum><header>Treatment of short-time compensation programs</header> 
<subsection id="ID4b45dde7a55746c6bce2bf9df49aac58"><enum>(a)</enum><header>In general</header><text>Section 3306 of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="idA5EA934CFCC844ABA03CB0570EADFB45" style="OLC"> 
<subsection id="ID6e5f245c2dc14fee804f6fb79d0105f4"><enum>(v)</enum><header>Short-Time compensation program</header><text>For purposes of this chapter, the term <term>short-time compensation program</term> means a program under which—</text> 
<paragraph id="ID91f8c5fe9b4f433a9e4cc3f3bbba327c"><enum>(1)</enum><text>the participation of an employer is voluntary;</text> </paragraph>
<paragraph id="IDd34a212dff5e4bfe9d107477c3bfc815"><enum>(2)</enum><text>an employer reduces the number of hours worked by employees through certifying that such reductions are in lieu of temporary layoffs;</text> </paragraph>
<paragraph id="IDd748e1fb1536440b9cf2bbcaa7187780"><enum>(3)</enum><text>such employees whose workweeks have been reduced by at least 10 percent are eligible for unemployment compensation;</text> </paragraph>
<paragraph id="ID770ad4a045734ab5a8163b00aadd1b4b"><enum>(4)</enum><text>the amount of unemployment compensation payable to any such employee is a pro rata portion of the unemployment compensation which would be payable to the employee if such employee were totally unemployed;</text> </paragraph>
<paragraph id="IDcc35c51477fa4a849a8aebf67cf4f2de"><enum>(5)</enum><text>such employees are not expected to meet the availability for work or work search test requirements while collecting short-time compensation benefits, but are required to be available for their normal workweek;</text> </paragraph>
<paragraph id="ID37ce8b17a63648e6a15a64e02cd6947b"><enum>(6)</enum><text>eligible employees may participate in an employer-sponsored training program to enhance job skills if such program has been approved by the State agency;</text> </paragraph>
<paragraph id="IDc248ee09bc504a47ac9c015871356a13"><enum>(7)</enum><text>beginning on the date which is 2 years after the date of enactment of this subsection, the employer certifies that continuation of health benefits and retirement benefits under a defined benefit pension plan (as defined in section 3(35) of the Employee Retirement Income Security Act of 1974) is not affected by participation in the program;</text> </paragraph>
<paragraph id="ID8f4a863c48384e1cbe267f91cad08426"><enum>(8)</enum><text>the employer (or an employer's association which is party to a collective bargaining agreement) submits a written plan describing the manner in which the requirements of this subsection will be implemented and containing such other information as the Secretary of Labor determines is appropriate;</text> </paragraph>
<paragraph id="IDe16a18ca6f334ff89a7bbb05abeffbb0"><enum>(9)</enum><text>in the case of employees represented by a union, the appropriate official of the union has agreed to the terms of the employer’s written plan and implementation is consistent with employer obligations under the National Labor Relations Act; and</text> </paragraph>
<paragraph id="ID6a56bca278994389ac5476108c2caee6"><enum>(10)</enum><text>the program meets such other requirements as the Secretary of Labor determines appropriate.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="ID7fb31e92d88c44399f970428420e1a6e"><enum>(b)</enum><header>Assistance and guidance in implementing programs</header> 
<paragraph id="id28837DC54945431A99FB853E6A0F6E07"><enum>(1)</enum><header>Assistance and guidance</header> 
<subparagraph id="id5BADBA1D179744B893AB66DF14B9D170"><enum>(A)</enum><header>In general</header><text>In order to assist States in establishing, qualifying, and implementing short-time compensation programs, as defined in section 3306(v) of the Internal Revenue Code of 1986 (as added by subsection (a)), the Secretary of Labor (in this section referred to as the <term>Secretary</term>) shall—</text> 
<clause id="ID08040e44ffec4a5a8d70e113c05ade0a"><enum>(i)</enum><text>develop model legislative language which may be used by States in developing and enacting short-time compensation programs and shall periodically review and revise such model legislative language;</text> </clause>
<clause id="ID1d1b651a693b4ae5abdb3b671a466bd3"><enum>(ii)</enum><text>provide technical assistance and guidance in developing, enacting, and implementing such programs;</text> </clause>
<clause id="idD0082A525E53483E9DF92523ED18E972"><enum>(iii)</enum><text>establish biannual reporting requirements for States, including number of averted layoffs, number of participating companies and workers, and retention of employees following participation; and</text> </clause>
<clause id="id43A95C4F27634ED59B2C3D4617C857D7"><enum>(iv)</enum><text>award start-up grants to State agencies under subparagraph (B).</text> </clause></subparagraph>
<subparagraph id="id750ABC305AF54237A65ED73CE796DDB7"><enum>(B)</enum><header>Grants</header> 
<clause id="id02C7A0413EC14113A82850E7D79E1E19"><enum>(i)</enum><header>In general</header><text>The Secretary shall award start-up grants to State agencies that apply not later than June 30, 2011, in States that enact short-time compensation programs after the date of enactment of this Act for the purpose of creating such programs. The amount of such grants shall be awarded depending on the costs of implementing such programs.</text> </clause>
<clause id="id54C660D06205431380A215B4DC566A76"><enum>(ii)</enum><header>Eligibility</header><text>In order to receive a grant under clause (i) a State agency shall meet requirements established by the Secretary, including any reporting requirements under clause (iii). Each State agency shall be eligible to receive not more than one such grant.</text> </clause>
<clause id="id66794CC51AB74FD2B3AECE73697D0243"><enum>(iii)</enum><header>Reporting</header><text>The Secretary may establish reporting requirements for State agencies receiving a grant under clause (i) in order to provide oversight of grant funds used by States for the creation of short-time compensation programs.</text> </clause>
<clause id="idA5C3620A6B9F437A93BEBE7B9F4782BF"><enum>(iv)</enum><header>Funding</header><text>There are appropriated, out of any moneys in the Treasury not otherwise appropriated, to the Secretary, such sums as the Secretary certifies as necessary for the period of fiscal years 2010 and 2011 to carry out this subparagraph.</text> </clause></subparagraph></paragraph>
<paragraph id="idA24AC52FAE5D48C1832862FB974B882E"><enum>(2)</enum><header>Timeframe</header><text>The initial model legislative language referred to in paragraph (1)(A) shall be developed not later than 60 days after the date of enactment of this Act.</text> </paragraph></subsection>
<subsection id="ID53e9d0cd138c442f92acfb55c7152098"><enum>(c)</enum><header>Reports</header> 
<paragraph id="IDd06c5c45b2d647e5b3f44435fc6af618"><enum>(1)</enum><header>Initial report</header><text>Not later than 4 years after the date of enactment of this Act, the Secretary shall submit to Congress and to the President a report or reports on the implementation of this section. Such report or reports shall include—</text> 
<subparagraph id="idB2035884E3F049A78B925881912DCD1C"><enum>(A)</enum><text>a study of short-time compensation programs;</text> </subparagraph>
<subparagraph id="id68F93D2F7B7244C2A845C96D15DD9336"><enum>(B)</enum><text>an analysis of the significant impediments to State enactment and implementation of such programs; and</text> </subparagraph>
<subparagraph id="id1B5177EEB674409AAB77D8B04D553DEA"><enum>(C)</enum><text>such recommendations as the Secretary determines appropriate.</text> </subparagraph></paragraph>
<paragraph id="ID534a0534aaa3423c88a6f9cbaaa6730e"><enum>(2)</enum><header>Subsequent reports</header><text>After the submission of the report under paragraph (1), the Secretary may submit such additional reports on the implementation of short-time compensation programs as the Secretary deems appropriate.</text> </paragraph>
<paragraph id="idC1A57480501E471492BF4FD903C78E7A"><enum>(3)</enum><header>Funding</header><text>There are appropriated, out of any moneys in the Treasury not otherwise appropriated, to the Secretary, $1,500,000 to carry out this subsection, to remain available without fiscal year limitation.</text> </paragraph></subsection>
<subsection id="IDa222fd6b208243d0a8630fc465fdf7ba"><enum>(d)</enum><header>Conforming amendments</header> 
<paragraph id="id4096CB34B75845DB8F4DA9748B77503F"><enum>(1)</enum><header>Internal Revenue Code of 1986</header> 
<subparagraph id="IDe2ccbd504926420f8fda0fba5873c098"><enum>(A)</enum><text>Subparagraph (E) of section 3304(a)(4) of the Internal Revenue Code of 1986 is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="id0E9AB5D90CA340B9B1F9BF178A38B0E2" style="OLC"> 
<subparagraph id="ID17d309bd8fac4288b70629f62f1582ae"><enum>(E)</enum><text>amounts may be withdrawn for the payment of short-time compensation under a short-time compensation program (as defined in section 3306(v));</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="ID1a83c8a532754999a2cd6661eadf6d1f"><enum>(B)</enum><text>Subsection (f) of section 3306 of the Internal Revenue Code of 1986 is amended—</text> 
<clause id="id0BE062D2136A44849CEA406E97B3E982"><enum>(i)</enum><text>by striking paragraph (5) (relating to short-term compensation) and inserting the following new paragraph:</text>

<paragraph id="IDdb5a5c75be7b486385262214b50e0aac"><enum>(5)</enum><text>amounts may be withdrawn for the payment of short-time compensation under a short-time compensation program (as defined in subsection (v));</text> </paragraph><after-quoted-block>, and</after-quoted-block></quoted-block> </clause>
<clause id="id4D8747ECAE7549D5AED11A5478907E5C"><enum>(ii)</enum><text>by redesignating paragraph (5) (relating to self-employment assistance program) as paragraph (6).</text> </clause></subparagraph></paragraph>
<paragraph id="ID0f23dcfab1d949b69b807e9e0919a11d"><enum>(2)</enum><header>Social Security Act</header><text>Section 303(a)(5) of the Social Security Act is amended by striking <quote>the payment of short-time compensation under a plan approved by the Secretary of Labor</quote> and inserting <quote>the payment of short-time compensation under a short-time compensation program (as defined in section 3306(v) of the Internal Revenue Code of 1986)</quote>.</text> </paragraph>
<paragraph commented="no" id="idE23EC36AEFC8488394C64A3FF3496A5B"><enum>(3)</enum><header>Repeal</header><text>Subsections (b) through (d) of section 401 of the Unemployment Compensation Amendments of 1992 (26 U.S.C. 3304 note) are repealed.</text> </paragraph></subsection>
<subsection id="idD79A679DE21A41FC831BE5A6E026DAAE"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of enactment of this Act.</text> </subsection></section>
<section id="IDcc0e3d4776484e41b39332f5c58575b7"><enum>8.</enum><header>Temporary financing of certain short-time compensation programs</header> 
<subsection id="ID19523f569bfa4507beca34367aa65be7"><enum>(a)</enum><header>Payments to States with certified programs</header> 
<paragraph id="ID93c9ad340b5f450d89060397a4a6106d"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall establish a program under which the Secretary shall make payments to any State unemployment trust fund to be used for the payment of unemployment compensation if the Secretary approves an application for certification submitted under paragraph (3) for such State to operate a short-time compensation program (as defined in section 3306(v) of the Internal Revenue Code of 1986 (as added by section 7(a))) which requires the maintenance of health and retirement employee benefits as described in paragraph (7) of such section 3306(v), in addition to other requirements of this Act and notwithstanding the otherwise effective date of such requirement.</text> </paragraph>
<paragraph id="ID63dafcaa46194d4cb23e242344ab5ab6"><enum>(2)</enum><header>Reimbursement</header><text>Subject to subsection (d), the payment to a State under paragraph (1) shall be an amount equal to 100 percent of the total amount of benefits paid to individuals by the State pursuant to the short-time compensation program during the weeks of unemployment—</text> 
<subparagraph id="idE264A5896DC04E92BA64298D74ADFA61"><enum>(A)</enum><text>beginning on or after the date the certification is issued by the Secretary with respect to such program; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idC6E519A9A4BE4E56B6C8B01435C2DB12"><enum>(B)</enum><text>ending on or before December 31, 2011.</text> </subparagraph></paragraph>
<paragraph id="ID553d9cd1524245a0998d7aca10d5825f"><enum>(3)</enum><header>Certification requirements</header> 
<subparagraph id="idCA784C4A577C499FA165526BBE4331CC"><enum>(A)</enum><header>In general</header><text>Any State seeking full reimbursement under this subsection shall submit an application for certification at such time, in such manner, and complete with such information as the Secretary may require (whether by regulation or otherwise), including information relating to compliance with the requirements of paragraph (7) of such section 3306(v). The Secretary shall, within 30 days after receiving a complete application, notify the State agency of the State of the Secretary’s findings with respect to the requirements of such paragraph (7).</text> </subparagraph>
<subparagraph id="ID20df19f84ec049549329cda71a4c47ab"><enum>(B)</enum><header>Findings</header><text>If the Secretary finds that the short-time compensation program operated by the State meets the requirements of such paragraph (7), the Secretary shall certify such State's short-time compensation program thereby making such State eligible for reimbursement under this subsection. </text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDbb20cbf4874c447bbfa140206981f3a5"><enum>(b)</enum><header>Timing of application submittals</header><text>No application under subsection (a)(3) may be considered if submitted before the date of enactment of this Act or after the latest date necessary (as specified by the Secretary) to ensure that all payments under this section are made before December 31, 2011.</text> </subsection>
<subsection id="ID4ab24325d1d34a09853970c4f1692c15"><enum>(c)</enum><header>Terms of payments</header><text>Payments made to a State under subsection (a)(1) shall be payable by way of reimbursement in such amounts as the Secretary estimates the State will be entitled to receive under this section for each calendar month, reduced or increased, as the case may be, by any amount by which the Secretary finds that the Secretary's estimates for any prior calendar month were greater or less than the amounts which should have been paid to the State. Such estimates may be made on the basis of such statistical, sampling, or other method as may be agreed upon by the Secretary and the State agency of the State involved.</text> </subsection>
<subsection id="id9831D2BF8355433B9BC0188D6F47A2F6"><enum>(d)</enum><header>Limitations</header> 
<paragraph id="idD15F8EBA27EE4AF4A45AF49C85A0A3BC"><enum>(1)</enum><header>General payment limitations</header><text>No payments shall be made to a State under this section for benefits paid to an individual by the State in excess of 26 weeks of benefits.</text> </paragraph>
<paragraph id="id806A7F0AEFF24F778E288799F596172B"><enum>(2)</enum><header>Employer limitations</header><text>No payments shall be made to a State under this section for benefits paid to an individual by the State pursuant to a short-time compensation program if such individual is employed by an employer—</text> 
<subparagraph id="idA471769B67FF46F58CB5C31BB7F4D8BD"><enum>(A)</enum><text>whose workforce during the 3 months preceding the date of the submission of the employer's short-time compensation plan has been reduced by temporary layoffs of more than 20 percent; or</text> </subparagraph>
<subparagraph id="id6D5D2AF8B28E4F3B800A70D31A5288F2"><enum>(B)</enum><text>on a seasonal, temporary, or intermittent basis.</text> </subparagraph></paragraph>
<paragraph id="id71A37B35277E47DE9330995B7B2E75C3"><enum>(3)</enum><header>Program payment limitation</header><text>In making any payments to a State under this section pursuant to a short-time compensation program, the Secretary may limit the frequency of employer participation in such program.</text> </paragraph></subsection>
<subsection id="ID17972c45190d44cd88c7260ec1c8cd3c"><enum>(e)</enum><header>Retention requirement</header> 
<paragraph id="idB22B6002F6B74C34A857CE429E612D1B"><enum>(1)</enum><header>In general</header><text>A participating employer under this section is required to comply with the terms of the written plan approved by the State agency and act in good faith to retain participating employees.</text> </paragraph>
<paragraph id="idA09EDB4CB5344E29821FF7861809C5DB"><enum>(2)</enum><header>Oversight and monitoring</header><text>The Secretary shall establish an oversight and monitoring process by which State agencies will ensure that participating employers comply with the requirements of paragraph (1).</text> </paragraph></subsection>
<subsection id="ID8cd32a6b33684d4a899c1448417e79c8"><enum>(f)</enum><header>Funding</header><text>There are appropriated, from time to time, out of any moneys in the Treasury not otherwise appropriated, to the Secretary, such sums as the Secretary certifies are necessary to carry out this section (including to reimburse any additional administrative expenses by reason of the provision of, and amendments made by, this Act that are incurred by the States in operating such short-time compensation programs).</text> </subsection>
<subsection id="idDC0B7ED21DA348C383BE3E4430F30DCF"><enum>(g)</enum><header>Definition of State</header><text>In this section, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, and the Virgin Islands.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="id1368F7AF08084BC3AA8950BD0BD34D35"><enum>(h)</enum><header>Sunset</header><text>The provisions of this section shall not apply after December 31, 2011.</text> </subsection></section>
<section id="idD9EC017E5527400BAD6FB2DA7BE61821"><enum>9.</enum><header>Study and reports on the emergency unemployment compensation program</header> 
<subsection id="idF6C8629D5D6B47D7926938EF142D98D9"><enum>(a)</enum><header>Study</header><text>The Secretary of Labor (in this section referred to as the <quote>Secretary</quote>) shall conduct a study on the implementation of the emergency unemployment compensation program under title IV of the Supplemental Appropriations Act, 2008 (Public Law 110–252; 26 U.S.C. 3304 note), as amended by section 2 and the Worker, Homeownership, and Business Assistance Act of 2009 (Public Law 111–92). Such study shall include an analysis of—</text> 
<paragraph id="idB715EBCD1AD64BB8B28D04CE629E5F1F"><enum>(1)</enum><text>the different tiers under such program;</text> </paragraph>
<paragraph id="IDf7712cd870c94a07bfa334bfc0aa2bdb"><enum>(2)</enum><text>the number of initial claims under such program, the average duration of benefits under the program, the average sum of benefits under the program, and other areas that demonstrate who received benefits under the program;</text> </paragraph>
<paragraph id="ID17104bda55c9439782e38b4de7283c03"><enum>(3)</enum><text>any significant impediments to State implementation of such program;</text> </paragraph>
<paragraph id="ID647bc629fee14472a91ce4da64cd5b7d"><enum>(4)</enum><text>the significant administration weaknesses and strengths of such programs; and</text> </paragraph>
<paragraph id="IDedb406c426544202b0176f50923ab58d"><enum>(5)</enum><text>other areas determined appropriate by the Secretary.</text> </paragraph></subsection>
<subsection id="id840354F2249340248930D584B807E801"><enum>(b)</enum><header>Reports</header> 
<paragraph id="id35DF1F88F77F464C946A98B832A380D3"><enum>(1)</enum><header>In general</header><text>Not later than 4 years after the date of the enactment of this Act, the Secretary shall submit to Congress and the President a report (or multiple reports) on the study conducted under subsection (a), together with such recommendations as the Secretary determines appropriate.</text> </paragraph>
<paragraph id="IDea9d675e316146d7a209d8c0661089b4"><enum>(2)</enum><header>Subsequent reports</header><text>After the Secretary submits the report (or reports) required under paragraph (1), the Secretary may submit such additional reports on the implementation of emergency unemployment compensation programs as the Secretary deems appropriate.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID4c9aa9674fd7402093d23e135593aa32"><enum>(c)</enum><header>Funding</header><text>There are appropriated, out of any moneys in the Treasury not otherwise appropriated, to the Secretary, $1,250,000 to carry out this section, to remain available without fiscal year limitation.</text> </subsection></section>
