			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name></header><text display-inline="yes-display-inline">Subparagraph
			 (A) of section 602(2) of the <act-name parsable-cite="ERISA">Employee
			 Retirement Income Security Act of 1974</act-name> (29 U.S.C. 1162(2)(A)) is
			 amended by adding at the end the following:</text>

				workers</header>
							<subclause commented="no" display-inline="no-display-inline" id="IDA0A47D0526124C25B81118D635EC8D1D"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subparagraph, in the case of a qualifying event described in section 603(2)
				relating to a reduction of hours of an employee described in subclause (II),
				the date which is 36 months after the date of the qualifying event, except that
				the period of coverage under this clause shall end on the date on which the
				employee becomes entitled to benefits under title XVIII of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> based on
				age.</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB3F6D44573264C628BCE4DF09E2D7E9E"><enum>(II)</enum><header display-inline="yes-display-inline">Employee described</header><text display-inline="yes-display-inline">An employee is described in this subclause
				if such employee, on the date of the qualifying event, is at least the early
				retirement age (as defined in section 216(l)(2) of the
				<act-name parsable-cite="SSA">Social Security Act</act-name>) but not yet
				entitled to benefits under title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> based on
				age.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6358C2B3DD3547749B157864B3057BB6"><enum>(b)</enum><header display-inline="yes-display-inline">Amendments to the
			 <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name></header><text display-inline="yes-display-inline">Section
			 2202(2)(A) of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name> (42 U.S.C. 300bb–2(2)(A)) is amended by inserting after clause
			 (iv) the following:</text>

				relating to a reduction of hours of an employee described in subclause (II),
				the date which is 36 months after the date of the qualifying event, except that
				the period of coverage under this clause shall end on the date on which the
				employee becomes entitled to benefits under title XVIII of the
				<act-name parsable-cite="SSA">Social Security Act</act-name> based on
				age.</text>

			 4980B(f)(2)(B)(i) of the Internal Revenue Code of 1986 is amended by inserting
			 after subclause (V) the following:</text>

				date which is 36 months after the date of the qualifying event, except that the

				</subsection></section></title><title commented="no" id="id091BB5D14EB8435EB97181E16D35AE68" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Employment and training</header>
			<section commented="no" display-inline="no-display-inline" id="ID68C3887487CD4FC993A255D19A689D0E" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 101 of the Workforce Investment Act
			 of 1998 (29 U.S.C. 2801) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID1381909C87944A33842A53B26B20C3A1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (17) through
			 (53) as paragraphs (18) through (54), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4AFE394D35D54FB0851C6CB794BFE13B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (16) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="ID635E61FE4E0640F8AABE9CFD5C34C1AE" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID8A5F6932D94E49BCB992E5AACEE1BD21"><enum>(17)</enum><header display-inline="yes-display-inline">Hard-to-serve populations</header><text display-inline="yes-display-inline">The term <term>hard-to-serve
				populations</term> means populations of individuals who are hard to serve,
				including displaced homemakers, low-income individuals, Native Americans,
				individuals with disabilities, older individuals, ex-offenders, homeless
				individuals, individuals with limited English proficiency, individuals who do
				not meet the definition of literacy in section 203, individuals facing
				substantial cultural barriers, migrant and seasonal farmworkers, individuals
				within 2 years of exhausting lifetime eligibility under part A of title IV of
				the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 601
				et seq.), single parents (including single pregnant women), and such other
				groups as the Governor determines to be hard to
				serve.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID9C83F755C5C142E89AE07517F5F623D6" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Statewide employment and training
			 activities</header><text display-inline="no-display-inline">Section
			 134(a)(3)(A) of the Workforce Investment Act of 1998 (29 U.S.C. 2864(a)(3)(A))
			 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDA77AD752909F43E8A8F86FA97ED5D07B"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (vi), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1534F93D46E54CF7B637CCF5202E27A1"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating clause (vii) as clause
			 (viii); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID57AAA352C0974E449BA7E9E4C22FACC1"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after clause (vi) the
			 following:</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID82F9FD5449554902A3BF20BA3F23120E" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Local employment and training
			 activities</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID48B549EB6BEB4A6DB6C9AB300D4B3CD7"><enum>(a)</enum><header display-inline="yes-display-inline">Intensive Services</header><text display-inline="yes-display-inline">Section 134(d)(3) of the Workforce
			 Investment Act of 1998 (29 U.S.C. 2864(d)(3)) is amended by striking
			 subparagraph (A) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID21E689F72C1E44B4A9832D8BA76D5E24" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDA47B37400E874285B8246842899389FD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header>
							<clause commented="no" display-inline="no-display-inline" id="ID3DECF880371245809EFBE55B428EECEB"><enum>(i)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">Except as provided in clause (iii), funds
				allocated to a local area for adults under paragraph (2)(A) or (3), as
				appropriate, of section 133(b), and funds allocated to the local area for
				dislocated workers under section 133(b)(2)(B), shall be used to provide
				intensive services to adults and dislocated workers, respectively—</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDD9B3E6C7C1AD4BF5BB4815998283BABA"><enum>(I)</enum><text display-inline="yes-display-inline">who are unemployed and who, after an
				interview, evaluation, or assessment, have been determined by a one-stop
				operator or one-stop partner to be—</text>
									<item commented="no" display-inline="no-display-inline" id="IDDB682452295C4856A3E9DB435B1B14D1"><enum>(aa)</enum><text display-inline="yes-display-inline">unlikely or unable to obtain employment,
				that leads to self-sufficiency or wages comparable to or higher than previous
				employment, through core services described in paragraph (2); and</text>
									</item><item commented="no" display-inline="no-display-inline" id="ID3568DE93E66243119E4A4483ACC72F64"><enum>(bb)</enum><text display-inline="yes-display-inline">in need of intensive services to obtain
				employment that leads to self-sufficiency or wages comparable to or higher than
				previous employment; or</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID5B9C2DC789B245CE9A111235C139CCEE"><enum>(II)</enum><text display-inline="yes-display-inline">who are employed, but who, after an
				interview, evaluation, or assessment, are determined by a one-stop operator or
				one-stop partner to be in need of intensive services to obtain or retain
				employment that leads to self-sufficiency.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDEF0A840E22F0467A919984E3DC20AB03"><enum>(ii)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">For purposes of determining whether an
				adult or dislocated worker meets the requirements of clause (i)(I)(aa), a
				one-stop operator or one-stop partner shall consider whether the adult or
				dislocated worker is a member of a hard-to-serve population.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID4C89BD872E404ED397ECAF467259D6B8"><enum>(iii)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">A new interview, evaluation, or assessment
				of a participant is not required under clause (i) if the one-stop operator or
				one-stop partner determines that it is appropriate to use a recent assessment
				of the participant conducted pursuant to another education or training
				program.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC7976F3E52B442D1944068ECF69D307F"><enum>(b)</enum><header display-inline="yes-display-inline">Training Services</header><text display-inline="yes-display-inline">Section 134(d)(4) of such Act (29 U.S.C.
			 2864(d)(4)) is amended by striking subparagraph (A) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="ID8E23BCD1563F4189B46AADD2EEEC6A71" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID2236DADFA2914BC1BD5AB24B5B9B7873"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header>
							<clause commented="no" display-inline="no-display-inline" id="ID45F985EFF8D9460BA4762091D9D416A0"><enum>(i)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">Except as provided in clause (iii), funds
				allocated to a local area for adults under paragraph (2)(A) or (3), as
				appropriate, of section 133(b), and funds allocated to the local area for
				dislocated workers under section 133(b)(2)(B), shall be used to provide
				training services to adults and dislocated workers, respectively—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID8AD814A2369244F7A3FAE97F99D384A9"><enum>(I)</enum><text display-inline="yes-display-inline">who, after an interview, evaluation, or
				assessment, and case management, have been determined by a one-stop operator or
				one-stop partner, as appropriate, to—</text>
									<item commented="no" display-inline="no-display-inline" id="ID39A11BE64638461883ED2583C4B06226"><enum>(aa)</enum><text display-inline="yes-display-inline">be unlikely or unable to obtain or retain
				employment, that leads to self-sufficiency or wages comparable to or higher
				than previous employment, through the intensive services described in paragraph
				(3);</text>
									</item><item commented="no" display-inline="no-display-inline" id="ID930B795DFF0C42C39425A018642F080E"><enum>(bb)</enum><text display-inline="yes-display-inline">be in need of training services to obtain
				or retain employment that leads to self-sufficiency or wages comparable to or
				higher than previous employment; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="IDD82FC7FD0A9B4547BC3F6BFA1E018470"><enum>(cc)</enum><text display-inline="yes-display-inline">have the skills and qualifications to
				successfully participate in the selected program of training services;</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID5B3CB5CF9D924620B4477FBCDC5A62B7"><enum>(II)</enum><text display-inline="yes-display-inline">who select programs of training services
				that are directly linked to the employment opportunities in the local area or
				region involved or in another area to which the adults or dislocated workers
				are willing to commute or relocate;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID755C1185131A413BAEBB02F623DF9B9F"><enum>(III)</enum><text display-inline="yes-display-inline">who meet the requirements of subparagraph
				(B); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDC2A7C050A98744958FC6FA10680E232D"><enum>(IV)</enum><text display-inline="yes-display-inline">who are determined to be eligible in
				accordance with the priority system in effect under subparagraph (E).</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDF832FB6D4EF84D8CBCA8A27C80316D1B"><enum>(ii)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">For purposes of determining whether an
				adult or dislocated worker meets the requirements of clause (i)(I)(aa), a
				one-stop operator or one-stop partner shall consider whether the adult or
				dislocated worker is a member of a hard-to-serve population.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID73FD183E1D7348A09FAE3DCA5714AECA"><enum>(iii)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">A new interview, evaluation, or assessment
				of a participant is not required under clause (i) if the one-stop operator or
				one-stop partner determines that it is appropriate to use a recent assessment

							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4D45607DE6364D99ABD61F8C1A823180"><enum>(c)</enum><header display-inline="yes-display-inline">Local Employment and Training
			 Activities</header><text display-inline="yes-display-inline">Section
			 134(e)(1)(A) of such Act (29 U.S.C. 2864(e)(1)(A)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID898786AF71BA4FE4A58F293F4D055CD3"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>and</quote> at the end;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID19EB5C72B5AF4AAF8221A06E96ABBF75"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period
			 and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCF9D96E1BEFB4DF5890F76EC58F49E65"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="IDC247A909D1D44B3BABC1E29EB667EA37" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="ID37E770DC8987409592542C99EAAD07E3"><enum>(C)</enum><text display-inline="yes-display-inline">customer support to enable members of
				hard-to-serve populations, including individuals with disabilities, to navigate
				among multiple services and activities for such
				populations.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

				<subsection commented="no" display-inline="no-display-inline" id="ID9FB327BA8E1543E084A29ECBD3154C9E"><enum>(a)</enum><header display-inline="yes-display-inline">State Performance Measures</header><text display-inline="yes-display-inline">Section 136(b)(3)(A)(iv)(II) of the
			 Workforce Investment Act of 1998 (29 U.S.C. 2871(b)(3)(A)(iv)(II)) is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDEF752543D9784B6A8BB0C8044BCFF4A0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>taking into
			 account</quote> and inserting <quote>and shall ensure that the levels involved
			 are adjusted, using objective statistical methods, based on</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID396CE57EBCBD448EB4822E4FA7CD393B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>(such as differences in
			 unemployment rates and job losses or gains in particular industries)</quote>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8B8BF7851D1D48B5A16C62D431036CFB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From funds reserved under sections 128(a)
				and 133(a)(1), the Governor involved shall award incentive grants to local
				areas for performance described in paragraph (2) in carrying out programs under
				chapters 4 and 5.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID28D833E0C9634C23B595756FFFAED8CD"><enum>(2)</enum><header display-inline="yes-display-inline">Basis</header><text display-inline="yes-display-inline">The Governor shall award the grants on the
				basis that the local areas—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID5E4B75C4615A439989B7050418E60CEB"><enum>(A)</enum><text display-inline="yes-display-inline">have exceeded the performance measures
				established under subsection (c)(2) relating to indicators described in
				subsection (b)(3)(A)(iii); or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID066695A9BDD648A2B3240506283D4641"><enum>(B)</enum><text display-inline="yes-display-inline">have—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID681240193D534567A87E538125B51DB4"><enum>(i)</enum><text display-inline="yes-display-inline">met the performance measures established
				under subsection (c)(2) relating to indicators described in subsection
				(b)(3)(A)(iii); and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDCCE31CF2496C4B0EB88A4E3593F5CE34"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrated exemplary performance in the
				State in serving hard-to-serve populations.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15F04462BE28404BA45ADBD9C1B8D510"><enum>(3)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">The funds awarded to a local area under
				this subsection may be used to carry out activities authorized for local areas
				and such innovative projects or programs that increase coordination and enhance
				service to program participants, particularly hard-to-serve populations, as may
				be approved by the
				Governor.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF899C89723974E0CBCCC1188655596AE"><enum>(c)</enum><header display-inline="yes-display-inline">Incentive Grants for States</header><text display-inline="yes-display-inline">Section 503 of such Act (20 U.S.C. 9273) is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDB25E2E923522477ABF988ADD1E70CBD3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting
			 the following:</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID204BEEA7381E4F4E886681B3969DC8B4"><enum>(A)</enum><header display-inline="yes-display-inline">Prior to July 1, 2010</header><text display-inline="yes-display-inline">Prior to July 1, 2010, the Secretary shall
				award a grant to each State in accordance with the provisions of this section
				as this section was in effect on July 1, 2003.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID051FD4DBF6A1412BBA4F3C8F90ABED5A"><enum>(B)</enum><header display-inline="yes-display-inline">Beginning July 1, 2010</header><text display-inline="yes-display-inline">Beginning on July 1, 2010, the Secretary
				shall award incentive grants to States for performance described in paragraph
				(2) in carrying out innovative programs consistent with the programs under
				chapters 4 and 5 of subtitle B of title I, to implement or enhance innovative
				and coordinated programs consistent with the statewide economic, workforce, and
				educational interests of the State.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID650D73B7A8A34B62933AF4A467CEA856"><enum>(2)</enum><header display-inline="yes-display-inline">Basis</header><text display-inline="yes-display-inline">The Secretary shall award the grants on the
				basis that States—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID6532B50EACEA435E98310645AB2C34EB"><enum>(A)</enum><text display-inline="yes-display-inline">have exceeded the State adjusted levels of
				performance for title I, the adjusted levels of performance for title II, and
				the levels of performance under the Carl D. Perkins Vocational and Technical
				Education Act of 1998 (20 U.S.C. 2301 et seq.); or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD621E0907115425683D92C270EC55763"><enum>(B)</enum><text display-inline="yes-display-inline">have—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDF2F6C62D44CF4254900E385FD933E8F9"><enum>(i)</enum><text display-inline="yes-display-inline">met the State adjusted levels of
				performance for title I, the adjusted levels of performance for title II, and
				the levels of performance under the Carl D. Perkins Vocational and Technical
				Education Act of 1998 (20 U.S.C. 2301 et seq.); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="IDCE120160EB09443A80A330EEE7EAED7A"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrated exemplary performance in
				serving hard-to-serve populations.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID02D2995B88514925B48480CD85FE5B80"><enum>(3)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">The funds awarded to a State under this
				section may be used to carry out activities authorized for States under
				chapters 4 and 5 of subtitle B of title I, title II, and the Carl D. Perkins
				Vocational and Technical Education Act of 1998 (20 U.S.C. 2301 et seq.),
				including demonstration projects, and for such innovative projects or programs
				that increase coordination and enhance service to program participants,
				particularly hard-to-serve populations.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>

			<section commented="no" display-inline="no-display-inline" id="id65D4D5B5AD4F4C8E9787CD52284AF2B5" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="no-display-inline">Not later than 6 months after the date of
			 enactment of this Act, the Secretary of Labor shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id37767E6A6E4A46A2A3DE1D992787FC7D"><enum>(1)</enum><text display-inline="yes-display-inline">identify best practices for hiring and
			 retaining older workers in the private and public sectors; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66042980EB724371BA894833FDC5B46C"><enum>(2)</enum><text display-inline="yes-display-inline">make such information publicly available
			 through the Internet.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id8D8170E00399492CA499A02FBA4B8B17" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Annual
			 updates</header><text display-inline="no-display-inline">The Secretary of Labor
			 shall update the practices identified under section 301(1) and make such
			 information publicly available as provided under section 301(2) on an annual
			 basis.</text>
