		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Forest Insect and Disease
			 Emergency Act of 2009</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="ID5854e96e32c3468995b2ee19b2ca7532" reported-display-style="strikethrough"><enum>2.</enum><header>
			 Purposes</header><text display-inline="no-display-inline">The purposes of this
			 Act are—</text>
			<paragraph id="ID0d677b5b973046ec82e91e0146aa2fe2"><enum>(1)</enum><text>to ensure that
			 adequate emphasis is placed on the mitigation of hazards posed by large-scale
			 infestations of bark beetles and other insects through the establishment of
			 insect and disease emergency areas;</text>
			</paragraph><paragraph id="IDd0d6c38d23fa4d13815729d6808b248b"><enum>(2)</enum><text>to ensure that
			 increased resources are available within each designated insect and disease
			 emergency area to mitigate hazards associated with—</text>
				<subparagraph id="id6E3495A8A7E244F0B8F35D9FAF0B5E85"><enum>(A)</enum><text>falling
			 trees;</text>
				</subparagraph><subparagraph id="idB719DFAC01A1497EBE4772C399D95AD1"><enum>(B)</enum><text>increased fire
			 hazards; and</text>
				</subparagraph><subparagraph id="idBDDBAC9B85944BB4947155B6DBCD49BC"><enum>(C)</enum><text>the restoration of
			 National Forest System land; and</text>
				</subparagraph></paragraph><paragraph id="IDd2069244630a4ea8a66c0d9777e4d491"><enum>(3)</enum><text>to make permanent,
			 as of the date of enactment of this Act, existing good neighbor and stewardship
			 contracting authorities.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDe1958763530c49ad9a047a05531d3d13" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID895b2eeaa4d644bbbdc7c7e2bd4a7932"><enum>(1)</enum><header>Affected
			 State</header><text>The term <term>affected State</term> includes each of the
			 States of—</text>
				<subparagraph id="idD23E61C81FEA4B2591672D9C26C78299"><enum>(A)</enum><text>Arizona;</text>
				</subparagraph><subparagraph id="idE34AE62152FE479B9D1D23446C03DDEB"><enum>(B)</enum><text>California;</text>
				</subparagraph><subparagraph id="idA6DB5852354F41F3BB9BA9F1F1EBFF9A"><enum>(C)</enum><text>Colorado;</text>
				</subparagraph><subparagraph id="id55C2B1798B7841218B6E4D76B7872A27"><enum>(D)</enum><text>Idaho;</text>
				</subparagraph><subparagraph id="id028AA2B03C6F4D99B3C5236E4BD6BF92"><enum>(E)</enum><text>Montana;</text>
				</subparagraph><subparagraph id="id2D4B20BB37594C7891C557AE0209348C"><enum>(F)</enum><text>Nevada;</text>
				</subparagraph><subparagraph id="idDB2881548BE04D8C8DB26B009F461DF5"><enum>(G)</enum><text>New Mexico;</text>
				</subparagraph><subparagraph id="id1A0E1B4138D34B40B7C5F6862239A23C"><enum>(H)</enum><text>Oregon;</text>
				</subparagraph><subparagraph id="id2C78CAB19D7F464AA78013424E7A46A3"><enum>(I)</enum><text>South
			 Dakota;</text>
				</subparagraph><subparagraph id="id56425DBA35114CE49D6E0325D36A919E"><enum>(J)</enum><text>Utah;</text>
				</subparagraph><subparagraph id="id262D643649164154840741E992E1A613"><enum>(K)</enum><text>Washington;
			 and</text>
				</subparagraph><subparagraph id="idBCF797CF8C3F4494934FCFF7A7016CA2"><enum>(L)</enum><text>Wyoming.</text>
				</subparagraph></paragraph><paragraph id="id0D187C8CDE5940349401EFE024792A09"><enum>(2)</enum><header>Insect and
			 disease emergency area</header><text>The term <term>insect and disease
			 emergency area</term> means an area of National Forest System land—</text>
				<subparagraph id="id4C0B33EBD5C6406B90442D49FD09C02F"><enum>(A)</enum><text>that is located in
			 an affected State that is not—</text>
					<clause id="id94DB2C163E854AA6A7ED8B04E1F7586E"><enum>(i)</enum><text>designated as
			 wilderness; or</text>
					</clause><clause id="id2E68FDF37C9D40C982C53EBE8116EB6B"><enum>(ii)</enum><text>an area
			 recommended for wilderness in a forest land and resource management
			 plan;</text>
					</clause></subparagraph><subparagraph id="id43D4119A8A5D43ADBECD4B776174C2D8"><enum>(B)</enum><text>in which an insect
			 and disease infestation emergency exists, as determined by the Secretary;
			 and</text>
				</subparagraph><subparagraph id="id9613A7F351274CB5A90D4BD0A8704D4F"><enum>(C)</enum><text>that is designated
			 by—</text>
					<clause id="idF34ED59E13A34689AE2C1D9F7F419C08"><enum>(i)</enum><text>section 4(a);
			 or</text>
					</clause><clause id="idF99598016B7C419689F9FB8845D34600"><enum>(ii)</enum><text>the Secretary
			 under section 4(c).</text>
					</clause></subparagraph></paragraph><paragraph id="ID2e3f0eb81e5342e983e9921ad9ac8dbc"><enum>(3)</enum><header>Insect and
			 disease infestation emergency</header><text>The term <term>insect and disease
			 infestation emergency</term> means an insect or disease infestation that has
			 resulted in—</text>
				<subparagraph id="ID1efed5db9e944737a3d213bad328e6d1"><enum>(A)</enum><text>a current or
			 future increased risk of catastrophic wildland fire; or</text>
				</subparagraph><subparagraph id="ID546296ea1d6c4f7d90dd41edfc71dbb3"><enum>(B)</enum><text>an increased
			 threat posed by hazard trees to—</text>
					<clause id="id3220EF431D1145BF86BC7517780EC766"><enum>(i)</enum><text>utility
			 corridors;</text>
					</clause><clause id="id2BE784B36B89433A80CBFC253123792C"><enum>(ii)</enum><text>communication
			 sites;</text>
					</clause><clause id="IDe785fc2f0d4e432897542841f157831b"><enum>(iii)</enum><text>roads;</text>
					</clause><clause id="ID9326c82347c341f3a68f5a2456d94893"><enum>(iv)</enum><text>recreation
			 sites;</text>
					</clause><clause id="ID94cd4a236c5441e7975c81852462603c"><enum>(v)</enum><text>water structures
			 (such as reservoirs and water conveyance systems); or</text>
					</clause><clause id="idD3D02462395D4E689D76DEC6F2F27462"><enum>(vi)</enum><text>other
			 infrastructure.</text>
					</clause></subparagraph></paragraph><paragraph id="IDb1b7fe459722429493fb6c506712bc2e"><enum>(4)</enum><header>
			 Map</header><text>The term <term>map</term> means the map entitled
			 <quote>Insect Emergency Areas</quote>.</text>
			</paragraph><paragraph id="id094B3415D3244930B4EE625E264A949E"><enum>(5)</enum><header>National Forest
			 System</header><text>The term <term>National Forest System</term> has the
			 meaning given the term in section 11(a) of the Forest and Rangeland Renewable
			 Resources Planning Act of 1974 (16 U.S.C. 1609(a)).</text>
			</paragraph><paragraph id="ID17a39a47a8594513855ef96011a8b13b"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDf57b45d1f8894f20b657cd433a81d8b6" reported-display-style="strikethrough"><enum>4.</enum><header>Designation of
			 insect and disease emergency areas</header>
			<subsection id="IDf1485f5341894253870742b1a8d951c8"><enum>(a)</enum><header>Designation</header><text>Each
			 area depicted on the map is designated as an insect and disease emergency area
			 under this Act.</text>
			</subsection><subsection id="ID415420c22545441bb1191d2e59954345"><enum>(b)</enum><header>Map</header>
				<paragraph id="IDafb7383ff33c4b8b8be217b7f53b4979"><enum>(1)</enum><header>Duty of
			 Secretary</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file the map for insect and disease emergency
			 areas designated by subsection (a) with—</text>
					<subparagraph id="ID39dc32d9f54d445b97d28eb173c311cd"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate;</text>
					</subparagraph><subparagraph id="id2FD4C68B63844B8891F998FF704E724C"><enum>(B)</enum><text>the Committee on
			 Agriculture, Nutrition, and Forestry of the Senate;</text>
					</subparagraph><subparagraph id="IDdefacb71ab7f49ef8fd7db69d87d4f5b"><enum>(C)</enum><text>the Committee on
			 Natural Resources of the House of Representatives; and</text>
					</subparagraph><subparagraph id="ID508eca1323a04ef8bf1a55a7d7b2117a"><enum>(D)</enum><text>the Committee on
			 Agriculture of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="IDe380e711eece4484b4c4bae735e269e4"><enum>(2)</enum><header>Force of
			 law</header><text>The map filed under paragraph (1) shall have the same force
			 and effect as if included in this subsection, except that the Secretary may
			 correct typographical errors in the map and the legal descriptions.</text>
				</paragraph><paragraph id="IDcd1fd760ecbf49909386708baeb11c35"><enum>(3)</enum><header>Public
			 availability</header><text>The map filed under paragraph (1) shall be on file
			 and available for public inspection in the appropriate offices of the Forest
			 Service.</text>
				</paragraph></subsection><subsection id="ID9e833564e323413f98195d1945721e03"><enum>(c)</enum><header>Designation by
			 Secretary</header>
				<paragraph id="IDef6d7b9059464f659109fbd2a5d68d16"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may designate additional insect and disease
			 emergency areas in accordance with each requirement described in this
			 subsection.</text>
				</paragraph><paragraph id="ID132fbed83abc44439a2c088ddede5925"><enum>(2)</enum><header>Initiation</header><text>The
			 designation of an insect and disease emergency area may be made by the
			 Secretary—</text>
					<subparagraph id="idCB501CD8F20441D9BD1BEBB2044FD502"><enum>(A)</enum><text>on the initiative
			 of the Secretary; or</text>
					</subparagraph><subparagraph id="idCFDC483AECB74019995C6165A4E37B21"><enum>(B)</enum><text>in response to a
			 request by any Governor of an affected State.</text>
					</subparagraph></paragraph><paragraph id="ID410db241841d49cfa5bf149a54591f77"><enum>(3)</enum><header>Deadline</header><text>If
			 the Governor of a State described in paragraph (2)(B) requests the Secretary to
			 designate as an insect and disease emergency area an area located in the State,
			 the Secretary shall accept or deny the request by a date that is not later than
			 90 days after the date on which the Secretary receives the request.</text>
				</paragraph><paragraph id="IDb987a0df70cb4dfd922decd70262f739"><enum>(4)</enum><header>Limitation on
			 delegation</header><text>With respect to National Forest System land, the
			 Secretary, acting through the Chief of the Forest Service, may delegate the
			 authority to make a designation under this subsection only to a Regional
			 Forester of the National Forest System land.</text>
				</paragraph><paragraph id="ID822d28e1a420477698ec71f51e4fd2ad"><enum>(5)</enum><header>Procedure</header><text>If
			 the Secretary designates an additional insect and disease emergency area under
			 paragraph (1), the Secretary shall—</text>
					<subparagraph id="IDcf44928fa51943669ea1bf45199e68e1"><enum>(A)</enum><text>publish a notice
			 of the designation of the insect and disease emergency area (including a map of
			 the insect and disease emergency area) in the Federal Register; and</text>
					</subparagraph><subparagraph id="IDbe1156123b9c4710b3f5e3f093b4decd"><enum>(B)</enum><text>notify—</text>
						<clause id="id1B9358486566458AB3181654455F5539"><enum>(i)</enum><text>each appropriate
			 State; and</text>
						</clause><clause id="id079A702DC5CF429584479AAC5A902401"><enum>(ii)</enum><text>the appropriate
			 committees of Congress.</text>
						</clause></subparagraph></paragraph><paragraph id="IDaac7a46ab19948828fc0df383d54d481"><enum>(6)</enum><header>Applicability</header><text>A
			 designation made by the Secretary under paragraph (1) shall not be subject
			 to—</text>
					<subparagraph id="idFC8CFF0F607F4B388C590AF53B14FFFB"><enum>(A)</enum><text>the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.);</text>
					</subparagraph><subparagraph id="id82E235ED0A27480EBBCCA3796C754A90"><enum>(B)</enum><text>section 322 of the
			 Department of the Interior and Related Agencies Appropriations Act, 1999
			 (Public Law 105–277; 112 Stat. 2681–289); or</text>
					</subparagraph><subparagraph id="id2A18410B54C44888951DA009C6DC59E5"><enum>(C)</enum><text>any other
			 applicable law (including regulations).</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID175028aa9b0f41abb0b85af8d8f313ea" reported-display-style="strikethrough"><enum>5.</enum><header>Response to
			 emergency designation</header>
			<subsection id="ID1321fb16e0cf46cca24fce3242f658f8"><enum>(a)</enum><header>Priority
			 treatments</header><text>In carrying out the management of an insect and
			 disease emergency area, the Secretary shall give priority consideration
			 to—</text>
				<paragraph id="IDa0a18ae63a2644b1b14bce49d7db260b"><enum>(1)</enum><text>the removal of
			 hazardous fuels and hazard trees on, and the restoration of the health of,
			 National Forest System land located in the insect and disease emergency area;
			 and</text>
				</paragraph><paragraph id="ID15d7c6b5af2f458eaa84f8558bb0203d"><enum>(2)</enum><text>the provision of
			 assistance to State and local governments, Indian tribes, and private
			 landowners for the removal of hazardous fuels and hazard trees on, and the
			 restoration of the health of, each parcel of land located in the insect and
			 disease emergency area—</text>
					<subparagraph id="id72EBC84B545049FDB4FF912BE91159AF"><enum>(A)</enum><text>that is under the
			 jurisdiction of the State or local government or Indian tribe; or</text>
					</subparagraph><subparagraph id="id2A408C50D4844223AE2904579F20A970"><enum>(B)</enum><text>the title of which
			 is held by a private landowner; and</text>
					</subparagraph></paragraph><paragraph id="id0CA2168EE853492D87D2D3114636B25B"><enum>(3)</enum><text>the making of
			 payments under section 9011(d)(1)(B) of the Farm Security and Rural Investment
			 Act of 2002 (7 U.S.C. 8111(d)(1)(B)) to each individual or entity that collects
			 or harvests renewable biomass from a parcel of National Forest System land
			 located in an insect and disease emergency area.</text>
				</paragraph></subsection><subsection id="ID2c09c88090a649dc9fbc046628c4e622"><enum>(b)</enum><header>Emergency forest
			 restoration</header><text>In implementing the emergency forest restoration
			 program under section 407 of the Agricultural Credit Act of 1978 (16 U.S.C.
			 2206), the Secretary may make payments to an owner of a parcel of nonindustrial
			 private forest land that is located in an insect and disease emergency area to
			 carry out emergency measures in response to an insect and disease infestation
			 emergency under this Act.</text>
			</subsection><subsection id="ID2e2b044344644f419d1c98933acdf779"><enum>(c)</enum><header>Biomass</header><text>Any
			 biomass removed from a parcel of land located in an insect and disease
			 emergency area shall be considered to be renewable biomass for purposes of the
			 renewable fuel standard under section 211(o) of the Clean Air Act (42 U.S.C.
			 7545(o)).</text>
			</subsection><subsection id="IDcbc681eb09c049dc99814e972ed10f5a"><enum>(d)</enum><header>Healthy forest
			 restoration</header>
				<paragraph id="ID13d001da985d4332bfe3d9e0ae211cc4"><enum>(1)</enum><header>Authority of
			 Secretary</header><text>The Secretary may apply each requirement described in
			 sections 104 and 105 of the Healthy Forests Restoration Act of 2003 (16 U.S.C.
			 6514, 6515) to projects that are carried out to remove hazardous fuels and
			 hazard trees on, and to restore the health of, National Forest System land that
			 is located in an insect and disease emergency area.</text>
				</paragraph><paragraph id="ID082c0ba1b740428ab6eaf688dedacfdd"><enum>(2)</enum><header>Judicial
			 review</header><text>Section 106 of the Healthy Forests Restoration Act of 2003
			 (16 U.S.C. 6516) shall apply to each project described in paragraph (1).</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="IDf7f7f8a16e0c410fb62ee198b78a4119" reported-display-style="strikethrough"><enum>6.</enum><header>Good neighbor
			 authority</header>
			<subsection id="ID0f35a2bf612d4370a3e04cd844678b15"><enum>(a)</enum><header>State forest
			 services</header>
				<paragraph id="idAEE24FF37E964AA3A78730592772FBAE"><enum>(1)</enum><header>Authority of
			 Secretary</header><text>Notwithstanding chapter 63 of title 31, United States
			 Code, and any provisions of law related to competition, the Secretary may enter
			 into a contract (including a sole source contract) or agreement (including an
			 agreement for the mutual benefit of the Secretary and the State), as
			 appropriate and consistent with all applicable general and specific operating
			 procedures established by the Forest Service for such contracts and agreements
			 (including labor and wage requirements), with a State to permit the State to
			 perform watershed restoration and protection services on National Forest System
			 land located in the State if the State is carrying out similar and
			 complementary watershed restoration and protection services on adjacent State
			 or private land.</text>
				</paragraph><paragraph id="id006143A661814C0AB764537621A3F324"><enum>(2)</enum><header>Authorized
			 services</header><text>Watershed restoration and protection services described
			 in paragraph (1) include—</text>
					<subparagraph id="id6B5CFB53F9BC488D9DFDB4A88EEC972F"><enum>(A)</enum><text>the treatment of
			 insect-infested trees;</text>
					</subparagraph><subparagraph id="id5C73307173144AF492C14E89CC3A0B05"><enum>(B)</enum><text>the reduction of
			 hazardous fuels; and</text>
					</subparagraph><subparagraph id="id4FAA80634D8C465792CC0F676027E3F0"><enum>(C)</enum><text>any other activity
			 that is carried out to restore or improve watersheds or fish and wildlife
			 habitat across ownership boundaries.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5fdb72f932874c93a7ca9a9b9ec6ad8d"><enum>(b)</enum><header>Administrative
			 provisions</header>
				<paragraph id="ID07705ff8b5b64aa0a18c5746aedaae60"><enum>(1)</enum><header>National Forest
			 Management Act of 1976</header><text>Subsections (d) and (g) of section 14 of
			 the National Forest Management Act of 1976 (16 U.S.C. 472a) shall not apply to
			 services performed under a contract or other agreement under subsection
			 (a)(1).</text>
				</paragraph><paragraph id="IDdf4a46f2a5ff4de6ad013a3ed2c6c5f5"><enum>(2)</enum><header>Assumption of
			 liability</header><text>The State shall assume liability, to the extent allowed
			 by Federal, State, and local law, for the actions or omissions of employees or
			 subcontractors of the State in preparing or implementing a contract or
			 agreement under this title.</text>
				</paragraph><paragraph id="ID800495e57ccf4053ba32d64e892968e2"><enum>(3)</enum><header>Subcontracts</header><text>A
			 State may subcontract, to the extent allowed by State and local law, to prepare
			 or implement a contract or agreement under this title.</text>
				</paragraph><paragraph id="IDeb095e58afde474d99d5b9cbf8d796de"><enum>(4)</enum><header>Dispute
			 resolution</header><text>Any dispute under a contract or agreement under
			 subsection (a)(1) shall be resolved in accordance with, as applicable—</text>
					<subparagraph id="id4764FE24226C4E908ECDE72098CE87BF"><enum>(A)</enum><text>the dispute clause
			 of the contract or agreement;</text>
					</subparagraph><subparagraph id="id5A1080F03D1044F7B5DBA6949BCD251D"><enum>(B)</enum><text>the Contract
			 Disputes Act of 1978 (41 U.S.C. 601 et seq.); or</text>
					</subparagraph><subparagraph id="id80760DB5A5A0436BBC61FD200759DAC4"><enum>(C)</enum><text>section 1491 of
			 title 28, United States Code.</text>
					</subparagraph></paragraph></subsection><subsection id="IDf793eda94c2d4256bea0852959df0c82"><enum>(c)</enum><header>Retention of
			 responsibilities under National Environmental Policy Act of
			 1969</header><text>With respect to any watershed restoration and protection
			 service on National Forest System land that is proposed to be carried out by a
			 State under subsection (a), any decision required to be made under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.) may not be delegated to the State or
			 any officer or employee of the State.</text>
			</subsection><subsection id="IDf7100049b49f49da8f9502b5dfcef1d0"><enum>(d)</enum><header>Applicability</header>
				<paragraph id="ID4eada2902759466aada29d4600a6ad4a"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the authority provided by this
			 section applies only to National Forest System land located in affected
			 States.</text>
				</paragraph><paragraph id="ID9d442946ebcb41fd9d79b03042f861b1"><enum>(2)</enum><header>Secretary of the
			 Interior</header><text>With respect to public land that is located in an
			 affected State and administered by the Secretary of the Interior (acting
			 through the Bureau of Land Management), the Secretary of the Interior may carry
			 out activities under this section on the public land.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="IDe327a5b5ddad44cfa3aa426689755114" reported-display-style="strikethrough"><enum>7.</enum><header>Stewardship
			 contracting</header>
			<subsection id="ID5a7b9e6ad26545e8b76e97b40f031626"><enum>(a)</enum><header>Cancellation
			 costs</header>
				<paragraph id="IDdaccfc343d184aef8169328131cebd21"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, including
			 section 304B of the Federal Property and Administrative Services Act of 1949
			 (41 U.S.C. 254c), the Secretary may not obligate funds to cover the cost of
			 canceling a Forest Service multiyear stewardship contract under section 347 of
			 the Department of the Interior and Related Agencies Appropriations Act, 1999
			 (16 U.S.C. 2104 note; Public Law 105–277) until the date on which the multiyear
			 stewardship contract is cancelled.</text>
				</paragraph><paragraph id="ID2d70d7c047a54205b165d10b50b17eb8"><enum>(2)</enum><header>Costs of
			 cancellation or termination</header><text>The costs of any cancellation or
			 termination of a multiyear stewardship contract described in paragraph (1) may
			 be paid from any appropriations that are made available to the Forest
			 Service.</text>
				</paragraph><paragraph id="ID013b0f1e225246fc91c73e7d232f2263"><enum>(3)</enum><header>Anti-Deficiency
			 Act</header><text>In the case in which the appropriations described in
			 paragraph (2) are exhausted—</text>
					<subparagraph id="ID3bf41306117844e5988be3d3ff6a52cb"><enum>(A)</enum><text>the exhaustion
			 shall not be considered to be a violation of section 1341 of title 31, United
			 States Code; and</text>
					</subparagraph><subparagraph id="IDe9c28e7c0d2d43f385518b16b6b5a711"><enum>(B)</enum><text>the Secretary
			 shall seek a supplemental appropriation.</text>
					</subparagraph></paragraph></subsection><subsection id="IDa1c7472a89874b0d9f8172114a06f30f"><enum>(b)</enum><header>Permanent
			 authority</header><text>Section 347(a) of the Department of the Interior and
			 Related Agencies Appropriations Act, 1999 (16 U.S.C. 2104 note; Public Law
			 105–277) is amended by striking <quote>Until September 30, 2013, the</quote>
			 and inserting <quote>The</quote>.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="IDe2b38a7cbdbe405080680ab481412bfd" reported-display-style="strikethrough"><enum>8.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act affects or diminishes
			 the rights of any owner of private property.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id5DD3383F43D345D48E1BBA55EDFC9577" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Forest Insect and Disease
			 Emergency Act of 2010</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="id9DE1FE436D3540A2898D7F0FF3201728" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="ID2bff7c987bb84047b4be71e71f35b285"><enum>(1)</enum><text>to ensure that adequate
			 emphasis is placed on the mitigation of hazards posed by landscape-scale
			 epidemics of bark beetles and other insects and diseases through the
			 identification of areas affected by the epidemics, including areas in which
			 resulting hazard trees pose a high risk to public health and safety;</text>
			</paragraph><paragraph id="IDde2a5856513e48dea3005b6a04bfb96c"><enum>(2)</enum><text>to help focus resources
			 within areas characterized by landscape-scale insect or disease epidemics to
			 mitigate hazards associated with—</text>
				<subparagraph id="ID008e89a18f3846a7af52ae2e2483ba09"><enum>(A)</enum><text>falling trees; and</text>
				</subparagraph><subparagraph id="ID45252885e53e404292419833b75dc264"><enum>(B)</enum><text>wildfire; and</text>
				</subparagraph></paragraph><paragraph id="ID3fcee630b8aa4bc1a48864ab4c23f6e0"><enum>(3)</enum><text>to authorize good
			 neighbor agreements between State and Federal agencies to provide more
			 effective and efficient forest management across certain Federal land
			 boundaries.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="id232756010B4E4A3AB725207780AC71E4" reported-display-style="italic"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID4cc2c86304994b68bc84fdee8acdce12"><enum>(1)</enum><header>Affected
			 State</header><text>The term <term>affected State</term> includes each of the
			 States of—</text>
				<subparagraph id="id29C123E0E64E4C31B750EA604A2883D1"><enum>(A)</enum><text>Alaska;</text>
				</subparagraph><subparagraph id="ID18843d4bc0cb41bea8188010ec420da2"><enum>(B)</enum><text>Arizona;</text>
				</subparagraph><subparagraph id="ID83a85451c9874704bbccb8068a07b819"><enum>(C)</enum><text>California;</text>
				</subparagraph><subparagraph id="IDbb8c73c71a3248de9c73f61867c06ac8"><enum>(D)</enum><text>Colorado;</text>
				</subparagraph><subparagraph id="IDdca2dce529bf45b59f8d9747c5483fb9"><enum>(E)</enum><text>Idaho;</text>
				</subparagraph><subparagraph id="IDb0458f4b9d5a4faca580c648588a2f79"><enum>(F)</enum><text>Montana;</text>
				</subparagraph><subparagraph id="ID1bf44dffe6ba4c85ac4628d927d6775d"><enum>(G)</enum><text>Nevada;</text>

				</subparagraph><subparagraph id="ID44d9dabce4f9490f861a3e18f3b2cec7"><enum>(M)</enum><text>Wyoming.</text>
				</subparagraph></paragraph><paragraph id="ID87d4408be8a744008d5c86f6a9319391"><enum>(2)</enum><header>High-risk
			 area</header><text>The term <term>high-risk area</term> means a road, trail, or
			 other area that poses a high risk to public health or safety due to hazard
			 trees resulting from landscape-scale tree mortality caused by an insect or
			 disease epidemic.</text>
			</paragraph><paragraph id="IDed9ef201391f4230a47552d1e2c3197b"><enum>(3)</enum><header>Insect or disease
			 epidemic area</header><text>The term <term>insect or disease epidemic
			 area</term> means an area of National Forest System land in which
			 landscape-scale tree mortality caused by an insect or disease epidemic
			 exists.</text>
			</paragraph><paragraph id="ID9a9e65ea5b6f4847b9f441f18f6041fb"><enum>(4)</enum><header>National Forest
			 System</header><text>The term <term>National Forest System</term> has the
			 meaning given the term in section 11(a) of the Forest and Rangeland Renewable
			 Resources Planning Act of 1974 (16 U.S.C. 1609(a)).</text>
			</paragraph><paragraph id="ID688302f7df8f4a5ca7c9e0212a2e9270"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="IDf23c8849bf224633b708535e2800624e" reported-display-style="italic"><enum>4.</enum><header>Designation of
			 areas</header>
			<subsection id="ID5035051adc1b4dbc970a3266f136972b"><enum>(a)</enum><header>Identification of
			 high-risk areas</header>
				<paragraph id="IDec67680fe66f4a3a9548056901a29a54"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall identify by map or other appropriate means
			 high-risk areas within the National Forest System in the affected
			 States.</text>
				</paragraph><paragraph id="ID543021d7c05b465991a16c0609428ea0"><enum>(2)</enum><header>Public
			 education</header><text>In conjunction with the information developed pursuant
			 this subsection, the Secretary shall develop educational materials that
			 describe the risk posed by hazard trees in high-risk areas and measures that
			 can be taken by the public to avoid or reduce that risk.</text>
				</paragraph><paragraph id="ID7bb37293ac814e5c9924293a3ece306f"><enum>(3)</enum><header>Consultation</header><text>In
			 developing the information and educational materials required by this
			 subsection, the Secretary shall consult with interested State, local, and
			 tribal governments, first responders, and other stakeholders.</text>
				</paragraph><paragraph id="ID27aad7a202f94dd08bf939dc33180b71"><enum>(4)</enum><header>Updates</header><text>The
			 Secretary shall periodically review and revise the information and educational
			 materials required by this subsection to reflect the best available
			 information.</text>
				</paragraph><paragraph id="IDd284944477f84654a74403b9bf90a1d7"><enum>(5)</enum><header>Public
			 availability</header><text>The information and associated educational materials
			 required by this subsection shall be on file and available for public
			 inspection, including in the appropriate offices of the Forest Service.</text>
				</paragraph></subsection><subsection id="ID93d519804e2243079d7ddaed4fd87103"><enum>(b)</enum><header> Identification of
			 insect and disease epidemic areas</header>
				<paragraph id="ID39287a82be534e45bf27000bf2021216"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall identify by map or other appropriate means insect
			 or disease epidemic areas within the National Forest System in the affected
			 States.</text>
				</paragraph><paragraph id="IDd8d2700485d04477983311e7d4eccb0b"><enum>(2)</enum><header>Required
			 information</header><text>The information required by paragraph (1) shall
			 include—</text>
					<subparagraph id="id96289BDDC3044ACDB22B420C389F8321"><enum>(A)</enum><text>a geographic estimate of
			 the annual mortality caused by the insect or disease epidemic; and</text>
					</subparagraph><subparagraph id="IDef031e1566d2489b9e6dcaaed80e4f15"><enum>(B)</enum><text>a projection, based on
			 the best available science, of future tree mortality resulting from the insect
			 or disease epidemic.</text>
					</subparagraph></paragraph><paragraph id="ID8d7cfc31c0854324850ceb5275e4040b"><enum>(3)</enum><header>Updates</header><text>The
			 Secretary shall periodically review and revise the information required by
			 paragraph (1) to reflect the best available information.</text>
				</paragraph><paragraph id="ID3b9789fd6e99432c8199ac0b68673cca"><enum>(4)</enum><header>Availability</header><text>The
			 information required by this subsection shall be made available to—</text>
					<subparagraph id="ID1dafdc683f2b485689202272af195927"><enum>(A)</enum><text>communities in or
			 adjacent to an insect or disease epidemic area that have developed a community
			 wildfire protection plan (as defined in section 101 of the Healthy Forests
			 Restoration Act of 2003 (16 U.S.C. 6511));</text>
					</subparagraph><subparagraph id="ID3d7b41c66383463b916e56047d8a0c5a"><enum>(B)</enum><text>fire departments and
			 other wildfire-fighting organizations responding to, or likely to respond to, a
			 wildfire in an insect or disease epidemic area; and</text>
					</subparagraph><subparagraph id="IDaf2466109ecd448c8377692d36b4381e"><enum>(C)</enum><text>the public through the
			 appropriate offices of the Forest Service.</text>
					</subparagraph></paragraph></subsection><subsection id="id71F5404A083A486CAEE04CE1CDF8566B"><enum>(c)</enum><header>Contracts and financial
			 assistance</header><text>To help collect, develop, monitor, and distribute the
			 information and materials required by this section, the Secretary may enter
			 into contracts or provide financial assistance through cooperative agreements
			 in accordance with section 8 of the Cooperative Forestry Assistance Act of 1978
			 (16 U.S.C. 2104) with—</text>
				<paragraph id="id8748D7C736FD4DE69C3F0CDC2A5075C3"><enum>(1)</enum><text>the State Forester or
			 equivalent State official of an affected State;</text>
				</paragraph><paragraph id="id33AEB9E29FC441DB80EAFF3E36559070"><enum>(2)</enum><text>educational institutions;
			 or</text>
				</paragraph><paragraph id="id5033AC5450F64C24993EF7DA031899E4"><enum>(3)</enum><text>other
			 organizations.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="id24B0A8D176B34132B03D8E6EC83C2E69" reported-display-style="italic"><enum>5.</enum><header>Support for restoration
			 and response</header>
			<subsection id="ID7354fc8f5e714611a33e846af31fe9ca"><enum>(a)</enum><header>Support for biomass
			 utilization</header><text>To help reduce the risk to public health and safety
			 from hazard trees and wildfires and to restore ecosystems affected by insect
			 and disease epidemics, the Secretary may assist State and local governments,
			 Indian tribes, private landowners, and other persons in affected States with
			 the collection, harvest, storage, and transportation of eligible material from
			 areas identified pursuant to section 4(b) in accordance with section 9011(d) of
			 the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8111(d)).</text>
			</subsection><subsection id="ID389a0a9af92147438924f4d622f31fa9"><enum>(b)</enum><header>Restoration assistance
			 for private landowners</header><text>The Secretary may make payments to an
			 owner of nonindustrial private forest land in an affected State to carry out
			 emergency measures to restore the land after an insect or disease infestation
			 in accordance with the emergency forest restoration program established under
			 section 407 of the Agricultural Credit Act of 1978 (16 U.S.C. 2206).</text>
			</subsection><subsection id="IDa8ca0303755145a9a5c34a24f01b4650"><enum>(c)</enum><header>National forest
			 hazardous fuel reduction</header><text>The Secretary shall carry out authorized
			 hazardous fuel reduction projects in affected States on National Forest System
			 land on which an epidemic of disease or insects poses a significant threat to
			 an ecosystem component, or forest or rangeland resource, in accordance with the
			 Healthy Forests Restoration Act of 2003 (16 U.S.C. 6501 et seq.).</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="ID6e0e70f3eef347be8bc9bd44c5b21472" reported-display-style="italic"><enum>6.</enum><header>Good neighbor
			 authority</header>
			<subsection id="ID628fc842fedf4db298ef87a80486fe1b"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="IDa898184cf5de4a9ca33feea7611767b0"><enum>(1)</enum><header>Authorized restoration
			 services</header><text>The term <term>authorized restoration services</term>
			 means similar and complementary forest, rangeland, and watershed restoration
			 services carried out on adjacent Federal land and non-Federal land by either
			 the Secretary or a Governor pursuant to—</text>
					<subparagraph id="ID0a4f6cb32cd44c9fb19be1877559ddec"><enum>(A)</enum><text>a good neighbor
			 agreement; and</text>
					</subparagraph><subparagraph id="ID5a715588ec0d4d74a79c5b534c7874f2"><enum>(B)</enum><text>a cooperative agreement
			 or contract entered into under subsection (c).</text>
					</subparagraph></paragraph><paragraph id="ID05897c59d3544de191bb042a9929faca"><enum>(2)</enum><header>Federal land</header>
					<subparagraph id="ID8d04bc70960e4d28a2c5422a9525c29a"><enum>(A)</enum><header>In
			 general</header><text>The term <term>Federal land</term> means the following
			 land in a State located in whole or in part west of the 100th meridian:</text>
						<clause id="ID762890c2def1440db50d409bcf6bba47"><enum>(i)</enum><text>National Forest System
			 land.</text>
						</clause><clause id="ID418b5b359aed48cd99f3f9505c0fbba3"><enum>(ii)</enum><text>Public lands (as defined
			 in section 103 of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1702)).</text>
						</clause></subparagraph><subparagraph id="ID0113713f767b4e278b795230c231b08d"><enum>(B)</enum><header>Exclusions</header><text>The
			 term <term>Federal land</term> does not include—</text>
						<clause id="ID10718601490c4976a24c0cfdd55dee6e"><enum>(i)</enum><text>a component of the
			 National Wilderness Preservation System, National Wild and Scenic Rivers
			 System, National Trails System, or National Landscape Conservation
			 System;</text>
						</clause><clause id="IDe8f337120bc34915a370a8c213a03721"><enum>(ii)</enum><text>a National Monument,
			 National Preserve, National Scenic Area, or National Recreation Area; or</text>
						</clause><clause id="ID4fbbebeef5104cebb57c90509d816a20"><enum>(iii)</enum><text>a wilderness study
			 area.</text>
						</clause></subparagraph></paragraph><paragraph id="ID47e2ea950cd44802a2d9a1168ffd9acb"><enum>(3)</enum><header>Forest, rangeland, and
			 watershed restoration services</header><text>The term <term>forest, rangeland,
			 and watershed restoration services</term> means—</text>
					<subparagraph id="IDc802b64c01c74b12aa4fa0dc64366098"><enum>(A)</enum><text>activities to treat
			 insect- and disease-infected trees;</text>
					</subparagraph><subparagraph id="ID3a5ac0d1eb324459ac2f457f801f9e9f"><enum>(B)</enum><text>activities to reduce
			 hazardous fuels;</text>
					</subparagraph><subparagraph id="IDa7c347c6a75248838841e951b2ee2a4e"><enum>(C)</enum><text>activities to maintain
			 roads and trails that cross a boundary between Federal land and non-Federal
			 land; and</text>
					</subparagraph><subparagraph id="IDee9514f5430e4ceaa2f07de6a2b29b30"><enum>(D)</enum><text>any other activities to
			 restore or improve forest, rangeland, or watershed health, including fish and
			 wildlife habitat.</text>
					</subparagraph></paragraph><paragraph id="ID2e07b48261d340c8b82dce7a4eb4e371"><enum>(4)</enum><header> Good neighbor
			 agreement</header><text>The term <term>good neighbor agreement</term>
			 means—</text>
					<subparagraph id="IDd64dfbbb3ec44e2a993709cc2ee1354c"><enum>(A)</enum><text>a nonfunding master
			 cooperative agreement entered into between the Secretary and a Governor under
			 chapter 63 of title 31, United States Code; or</text>
					</subparagraph><subparagraph id="ID6f026210a9d4401bba8dcbb65169659d"><enum>(B)</enum><text>a memorandum of agreement
			 or understanding entered into between the Secretary and a Governor.</text>
					</subparagraph></paragraph><paragraph id="ID45c595330a6e4cf3a6deddb549955428"><enum>(5)</enum><header>Governor</header><text>The
			 term <term>Governor</term> means the Governor or any other appropriate
			 executive official of an affected State.</text>
				</paragraph><paragraph id="ID681bd923e8ed4dfd921456223b00dc60"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means—</text>
					<subparagraph id="ID613276b750fd45a393f46b5b4f70437e"><enum>(A)</enum><text>the Secretary of
			 Agriculture, with respect to National Forest System land; and</text>
					</subparagraph><subparagraph id="ID74f20fae2ca74ce2b11fb1062c1bf8d9"><enum>(B)</enum><text>the Secretary of the
			 Interior, with respect to Bureau of Land Management land.</text>
					</subparagraph></paragraph></subsection><subsection id="ID513e208a9b274d52890872c4246f4b9a"><enum>(b)</enum><header>Good neighbor
			 agreements</header>
				<paragraph id="IDbb814b53ceea411d9487f3fb22c18545"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may enter into a good neighbor agreement
			 with a Governor to coordinate the procurement and implementation of authorized
			 restoration services in accordance with this section.</text>
				</paragraph><paragraph id="ID87c64501366349b580180740658a7d29"><enum>(2)</enum><header>Public notice and
			 comment</header><text>The Secretary shall make each good neighbor agreement
			 available to the public.</text>
				</paragraph></subsection><subsection id="ID8dd64a28325f4e4c9cc1032ec173e311"><enum>(c)</enum><header>Task orders, contracts,
			 and cooperative agreements</header>
				<paragraph id="ID6f96354552fa45749cbf90a19c0842a9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may issue a task order for, or enter into a
			 contract (including a sole source contract) or cooperative agreement with, a
			 Governor to carry out authorized restoration services.</text>
				</paragraph><paragraph id="ID4f12497b7265465fb6b0e1c045c53803"><enum>(2)</enum><header>Requirements</header><text>Each
			 task order, contract, or cooperative agreement entered into under paragraph (1)
			 shall be executed in accordance with—</text>
					<subparagraph id="ID6fcd96ffd3c44e4099156904a5c4e38a"><enum>(A)</enum><text>chapter 63 of title 31,
			 United States Code; and</text>
					</subparagraph><subparagraph id="ID52e5d28940394837bc50ff7e6853cbc5"><enum>(B)</enum><text>the applicable good
			 neighbor agreement.</text>
					</subparagraph></paragraph></subsection><subsection id="ID2e95c406e1da46edaedc02ab41155506"><enum>(d)</enum><header>Contract and
			 subcontract requirements</header>
				<paragraph id="ID76e9c8f9f3ea43358754f41fbb9af7bb"><enum>(1)</enum><header>Requirements for
			 services on Federal land</header>
					<subparagraph id="ID00e84e5f45ea48bbb87bee5a307234a4"><enum>(A)</enum><header>In
			 general</header><text>For authorized restoration services carried out on
			 Federal land under subsection (c), each contract and subcontract issued under
			 the authority of a Governor shall include the provisions described in
			 subparagraph (B) that would have been included in the contract had the
			 Secretary been a party to the contract.</text>
					</subparagraph><subparagraph id="ID62758895b01549b891434995a26d609a"><enum>(B)</enum><header>Applicable
			 provisions</header><text>The provisions referred to in subparagraph (A) are
			 provisions for—</text>
						<clause id="ID6d5b98925909498c83228b6c2ff915b9"><enum>(i)</enum><text>wages and benefits for
			 workers employed by contractors and subcontractors required by—</text>
							<subclause id="IDf548d8aa67c64fa084ef38acf0bdd55d"><enum>(I)</enum><text>subchapter IV of chapter
			 31 of part A of subtitle II of title 40, United States Code; and</text>
							</subclause><subclause id="ID478331e5355c4d779303dcc6bd27cab8"><enum>(II)</enum><text>chapter 6 of title 41,
			 United States Code;</text>
							</subclause></clause><clause id="IDf1a1d23b23424bcb86eadb5ff08faa72"><enum>(ii)</enum><text>nondiscrimination;
			 and</text>
						</clause><clause id="IDd8901d7e27114ca5b47b6b745b9ffc20"><enum>(iii)</enum><text>worker safety and
			 protection.</text>
						</clause></subparagraph></paragraph><paragraph id="ID45bd93463ce5490dae50215bf262a570"><enum>(2)</enum><header> Requirements for small
			 businesses</header><text>Each contract and subcontract for authorized
			 restoration services under subsection (c) shall comply with provisions for
			 small business assistance and protection that would have been applicable to the
			 contract had the Secretary been a party to the contract.</text>
				</paragraph><paragraph id="ID47de0be3e2064036862ace2695e108ac"><enum>(3)</enum><header>Liability</header><text>The
			 Secretary shall include provisions in each good neighbor agreement, contract,
			 or cooperative agreement, as appropriate, governing the potential liability of
			 the State and the Secretary for actions carried out under this Act.</text>
				</paragraph></subsection><subsection id="ID7dbe88daf65748a79db234f583a8e0b6"><enum>(e)</enum><header>Termination of
			 effectiveness</header>
				<paragraph id="IDee455095b7f649e19197a94ee4549749"><enum>(1)</enum><header>In
			 general</header><text>The authority of the Secretary to enter into cooperative

			 Utah</header><text>Section 337 of the Department of the Interior and Related
			 Agencies Appropriations Act, 2005 (Public Law 108–447; 118 Stat. 3102) is
			 repealed.</text>
					</subparagraph></paragraph><paragraph id="ID7e89ada53a3842beafbc6706fe9e999c"><enum>(4)</enum><header>Existing
			 contracts</header><text>Nothing in the amendments made by this section affects
			 contracts in effect on the day before the date of enactment of this Act.</text>
