		  effective sampling and testing program to test for E. coli
		  O157<added-phrase>:</added-phrase>H7 in boneless beef manufacturing trimmings
		  and other raw ground beef components, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>E. Coli Eradication Act of
			 2009</short-title></quote>.</text>
		</section><section id="id500C748B009B40C9AB6D1B27FE05E158"><enum>2.</enum><header>
			 E. coli eradication in ground beef</header><text display-inline="no-display-inline">Title I of the Federal Meat Inspection Act
			 (21 U.S.C. 601 et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idCC205B64312D4BF789E4A4BACB6948AE" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id82B5C5EE41B94E76995E5C3E315A6C05" section-type="subsequent-section"><enum>26.</enum><header display-inline="yes-display-inline">E. coli eradication in ground beef</header>
					<subsection id="IDe505e41be4cf42b681864dfc16cf3ae9"><enum>(a)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this section, the Secretary shall require that slaughterhouses, processing
				establishments, and grinding facilities described in subsection (b) test for
				the presence of E. coli O157<header-in-text level="subsection">:</header-in-text>H7 (referred to in this section as
				<quote>E. coli</quote>) at the following points:</text>
						<paragraph id="idAB3D3483E46C4720A3674AC11EE11C74"><enum>(1)</enum><text>One test at the
				slaughterhouse or processing establishment at which source trim was produced
				and 1 test of the source trim or bench trim at the receiving facility prior to
				combining with other lots from different sources.</text>
						</paragraph><paragraph id="idCBF082C6F7B2418BAFE4663A290C25F5"><enum>(2)</enum><text>If the source
				trim and grinding occurs at the same facility, 1 test of the source trim and 1
				test of the final ground product.</text>
						</paragraph></subsection><subsection id="id997CD4C2E6E54A3A97781BBD9C476D46"><enum>(b)</enum><header>Application</header><text>This
				section applies—</text>
						<paragraph id="id5CE63620BD9F430F8211D47E444D3304"><enum>(1)</enum><text>effective
				beginning on the date that is 180 days after the date of enactment of this
				section, to—</text>
							<subparagraph id="id6F8D1789D860443EBE68392972319360"><enum>(A)</enum><text>all
				slaughterhouses or processing establishments that produce more than 25,000
				pounds of trim per day; or</text>
							</subparagraph><subparagraph id="idA831FA3CFAB44F5BA52A19D3FEB70FA7"><enum>(B)</enum><text>grinding
				facilities that grind more than 25,000 pounds of trim or bench trim per day;
				and</text>
							</subparagraph></paragraph><paragraph id="idF84910EF59584301B578C87342E46C99"><enum>(2)</enum><text>effective
				beginning on the date that is 3 years after the date of enactment of this
				section, to all slaughterhouses, processing establishments, and grinding
				facilities that produce or grind trim or bench trim.</text>
						</paragraph></subsection><subsection id="id0239F95CA82C4A3FA2E286832B0D6467"><enum>(c)</enum><header>Administration</header><text>To
				carry out this section, the Secretary shall—</text>
						<paragraph id="ID18002b2e3ff1435a9607ceae0304ce73"><enum>(1)</enum><text>approve
				definitions of lot sizes established by establishments, except that an
				establishment—</text>
							<subparagraph id="idCB5CEB6B03994449AF966C53A34283A3"><enum>(A)</enum><text>shall demonstrate
				to the Secretary scientific justification for the definition of the lot;
				and</text>
							</subparagraph><subparagraph id="id213903D74E274374B3DA33E58933680F"><enum>(B)</enum><text>shall not define
				a lot as more than 2,000 pounds;</text>
							</subparagraph></paragraph><paragraph id="ID00b1cc8884c44b64bbb16c034d22be9a"><enum>(2)</enum><text>establish testing
				standards;</text>
						</paragraph><paragraph id="ID5ae5bb56eb5b4711b7a44590f6f3ece9"><enum>(3)</enum><text>assist processors
				in establishing appropriate sampling plans for establishments; and</text>
						</paragraph><paragraph id="id9F9006A89EDC4033AEA224CC1338B277"><enum>(4)</enum><text>in the case of a
				positive sample that indicates the presence of E. coli in a lot of an
				establishment—</text>
							<subparagraph id="id4191CDC540094DB689337BE323DA997D"><enum>(A)</enum><text>verify that meat
				or meat food products contaminated with the E. coli, and the entire lot that is
				represented by the sample, are disposed of or treated to eradicate the E. coli
				(in accordance with guidelines of the Secretary) before entry into commerce;
				and</text>
							</subparagraph><subparagraph id="ID3bbbbfc808dc4234a5e2c2960399e665"><enum>(B)</enum><text>promulgate
				regulations that require that the slaughterhouse or processing establishment
				takes corrective action and take measures to prevent reoccurrence.</text>
							</subparagraph></paragraph></subsection><subsection id="ID1c171a6561f24596aef5811bb5cb56d9"><enum>(d)</enum><header>Testing</header>
						<paragraph id="IDfdc387a5df114229944a019be5c35885"><enum>(1)</enum><header>In
				general</header><text>A slaughterhouse or processing establishment producing or
				a grinding facility receiving trimmings shall test each lot using sampling
				standards and procedures determined by the Secretary.</text>
						</paragraph><paragraph id="id6A8D69DA74E74F219C02152FDC6163AC"><enum>(2)</enum><header>Testing
				facilities</header>
							<subparagraph id="id0B5C6394EE0F42848274A5797D5BB044"><enum>(A)</enum><header>In
				general</header><text>An establishment shall use an independent testing
				facility that uses methods that are at least equivalent in specificity and
				sensitivity to the methods used by the Secretary to test beef trimmings.</text>
							</subparagraph><subparagraph id="id78F6B8B5027B4808AF35CBD9E99D10B0"><enum>(B)</enum><header>Administration</header><text>In
				using an independent testing facility under subparagraph (A), the
				establishment—</text>
								<clause id="id23B1C37B36C447EEBCDD8D327F21E4B1"><enum>(i)</enum><text>shall contract
				with the facility on an annual basis; and</text>
								</clause><clause id="id0B07D26E4CD14542B9946672D6956BA8"><enum>(ii)</enum><text>shall not
				terminate the contract on the basis of positive test results reported by the
				facility.</text>
								</clause></subparagraph></paragraph><paragraph id="id85CAB71F7B954242BD5826E365FCE200"><enum>(3)</enum><header>Proficiency
				testing service</header><text>A laboratory that tests beef for E. coli shall
				contract with a testing service to verify the proficiency of the
				laboratory.</text>
						</paragraph><paragraph id="ID53f4700cf9e044a9b8a4163c5adc0cde"><enum>(4)</enum><header>Transmission of
				testing results</header>
							<subparagraph id="idC8BD51E6BAB742B6AE13B7A2E356AB17"><enum>(A)</enum><header>In
				general</header><text>Test results of any testing conducted under this
				subsection shall be sent to the applicable slaughterhouse, processing
				establishment, or grinding facility as soon as results are ready.</text>
							</subparagraph><subparagraph id="idED941C1B942046479B766B60ADA4E43B"><enum>(B)</enum><header>Transmission to
				Secretary</header><text>The slaughterhouse, processing establishment, or
				grinding facility shall report any positive or presumptive positive results
				directly to the Secretary through electronic means not later than 24 hours
				after receipt of results from a testing facility.</text>
							</subparagraph></paragraph><paragraph id="idA3D5B650237643059F6CDEC2DAFA66E1"><enum>(5)</enum><header>Habitual
				violators</header><text>A slaughterhouse or processing establishment that
				produces or distributes trim that receives positive results that exceed the
				maximum allowable percentage of positive results for 3 consecutive days or more
				than 10 instances per year shall be listed on the public website of the
				Secretary as a habitual violator.</text>
						</paragraph><paragraph id="ID62ad7274da5c4cd19fce7513387dbc93"><enum>(6)</enum><header>Compliance</header><text>The
				Secretary shall take necessary regulatory action with respect to an
				establishment that fails to test, notify the Secretary of positive results, or
				otherwise comply with this subsection.</text>
						</paragraph></subsection><subsection id="ID1ca64412d34e435da60f2a9fe3835b22"><enum>(e)</enum><header>Imported ground
				beef</header>
						<paragraph id="id6C36625795864437A10795E0CBF1AD78"><enum>(1)</enum><header>In
				general</header><text>Any trim, bench trim, and ground beef originating from
				outside the United States shall be subject to the same requirements as apply to
				domestic trim, bench trim, and ground beef under this section.</text>
						</paragraph><paragraph id="idE9E0D205EFBC40E3B6704B0296675CF7"><enum>(2)</enum><header>Verification</header>
							<subparagraph id="id0D3C4674F8CA4A6EA508667A135C30CA"><enum>(A)</enum><header>In
				general</header><text>To be eligible for importation into the United States, a
				foreign facility shall provide a certification of compliance with paragraph (1)
				to a domestic slaughterhouse, processing establishment, or grinding
				facility.</text>
							</subparagraph><subparagraph id="id7C04977E9B3E497F8010614176E5552A"><enum>(B)</enum><header>Secondary
				testing</header><text>The domestic slaughterhouse, processing establishment, or
				grinding facility shall verify the results of the certification by conducting
				secondary testing of the trim, bench trim, or ground beef before processing
				into a final ground beef
				product.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
