			</subsection></section><section id="H95A0E0CF883E4A3FA6210791AADEDE31"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H3CFD68926A5A46F585FBD6F6A6EA2BC2"><enum>(1)</enum><text>over 15,000,000
			 students have no place to go after school hours, which is associated with high
			 rates of juvenile crime;</text>
			</paragraph><paragraph id="H2FCB5051C52C4EFEBFC8F514C75FE0F6"><enum>(2)</enum><text>studies show that
			 almost <fraction>1/3</fraction> of all public high school students in the
			 United States fail to graduate;</text>
			</paragraph><paragraph id="H9DDFA439659642D3AE15143D30C44106"><enum>(3)</enum><text>high school
			 dropouts—</text>
				<subparagraph id="id2F7DF67FEEA94B4B9951D62C064414F6"><enum>(A)</enum><text>on average, earn
			 less than high school graduates; and</text>
				</subparagraph><subparagraph id="id70AA49AAF30F449DA16AD439D6FC6C5D"><enum>(B)</enum><text>are more likely
			 than high school graduates to be unemployed;</text>
				</subparagraph></paragraph><paragraph id="H16D3F9AF07564C1FA4E237CC8EEB69A2"><enum>(4)</enum><text>high dropout rates
			 have a significant effect on communities through—</text>
				<subparagraph id="id7C58557A28364FCCAB2F7704CB480160"><enum>(A)</enum><text>loss of
			 productivity and revenues; and</text>
				</subparagraph><subparagraph id="idDCCA0341B9734E6FBC8ECE4BDA382D36"><enum>(B)</enum><text>higher costs
			 associated with incarceration, health care, and social services;</text>
				</subparagraph></paragraph><paragraph id="HCACC82E4BF954FEBB1583801476B5FA6"><enum>(5)</enum><text>students
			 consistently cite a lack of interest in core curriculum and a lack of relevancy
			 to future careers as the major reasons for dropping out of high school;</text>
			</paragraph><paragraph id="H0A98B8B891D44A2BB553CE1C017D33AA"><enum>(6)</enum><text>it is in the best
			 interest of the United States to ensure students are qualified to compete in
			 the global economy;</text>
			</paragraph><paragraph id="HBBE551E3AD024D23887D4543E2192D0A"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7C1C0BD02A604432AF328FC432A17DF5"><enum>(A)</enum><text>80 percent of jobs are
			 classified as skilled jobs; and</text>
				</subparagraph><subparagraph id="idFFD004CDB1024507A8C25095FAD9E240" indent="up1"><enum>(B)</enum><text>only 32 percent of high school
			 graduates are prepared for college;</text>
				</subparagraph></paragraph><paragraph commented="no" id="H5AE2D974BC78492382C4408350DBE73A"><enum>(8)</enum><text>Microsoft’s Bill
			 Gates warned that American companies <quote>face a severe shortfall of
			 scientists and engineers with expertise to develop the next generation of
			 breakthroughs</quote>;</text>
			</paragraph><paragraph id="HF81F60C906F54174890C9A768AD08A13"><enum>(9)</enum><text>business leaders
			 have stated that a qualified workforce is important to keeping jobs in the
			 United States;</text>
			</paragraph><paragraph id="H2BF9112F57D644F8B3453A09CA672764"><enum>(10)</enum><text>Corporate Voices
			 for Working Families has called for public and private efforts to create
			 after-school programs in which young people can develop skills for the 21st
			 century;</text>
			</paragraph><paragraph id="H8877F6F4C5934714BB797F1DB991CBD8"><enum>(11)</enum><text>opportunities for
			 real-world learning and seeing the connection between school and getting a good
			 job improve students’ chances of staying in school;</text>
			</paragraph><paragraph id="HCE2075B2A88E4013812670300A51FA79"><enum>(12)</enum><text>students involved
			 in after-school programs have significantly higher school attendance rates,
			 score higher on mathematics and writing assessments, and are more likely to
			 graduate from high school than those who are not involved in such
			 programs;</text>
			</paragraph><paragraph id="HE7346C010D414507B3DAD55D57D3A637"><enum>(13)</enum><text>reinforcing core
			 curricula by integrating academic work within alternative course material can
			 lead to significant improvements in student achievement and engagement, as
			 shown by the National Research Center for Career and Technical
			 Education;</text>
			</paragraph><paragraph id="HC223F42E05A04A58B9B5CABFDE19AC86"><enum>(14)</enum><text>after-school
			 programs and community partnerships offer youth opportunities—</text>
				<subparagraph id="idC0157045A39B4A58A7165835AA423201"><enum>(A)</enum><text>to develop social
			 and citizenship skills; and</text>
				</subparagraph><subparagraph id="id087B73594E6A40B4B6BE2509BD649730"><enum>(B)</enum><text>to have access to
			 a variety of mentors and role models from their communities; and</text>
				</subparagraph></paragraph><paragraph id="HB0EDDB0DFE1646A6BEE01197B57EB593"><enum>(15)</enum><text>after-school
			 programs can also provide opportunities, for youth who have extra time, to
			 experience the academic enrichment, career exploration, and skills development
			 the youth need to succeed.</text>
			</paragraph></section><section id="HEFDF8DAD85BF4F8FA050916E48169A6B"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish and
			 expand after-school programs and other similar programs—</text>
			<paragraph id="HF4B6BCBB34ED47A1BC91FDD4672EF6DF"><enum>(1)</enum><text>to improve middle
			 school and high school student academic achievement, overall school success,
			 and graduation rates by reinforcing core curriculum;</text>
			</paragraph><paragraph id="H7208200029EF4033B097FD5ABA384116"><enum>(2)</enum><text>to increase
			 student knowledge of, and interest in, high-demand career opportunities;</text>
			</paragraph><paragraph id="H0902ADA6667741CA866A108019FEF64C"><enum>(3)</enum><text>to increase
			 student engagement in learning by—</text>
				<subparagraph id="id850687226A764F40A81CE425FAC506E5"><enum>(A)</enum><text>demonstrating the
			 means by which academic content relates to career opportunities;</text>
				</subparagraph><subparagraph id="id4306543FB6314BE5971DC4B7C4420467"><enum>(B)</enum><text>providing
			 opportunities for civic engagement and service learning; and</text>
				</subparagraph><subparagraph id="id05891691B06441DFB22A87B7F07DF655"><enum>(C)</enum><text>providing
			 students with marketable skills; and</text>
				</subparagraph></paragraph><paragraph id="H9138623702BF4494A0ABA05B820F48AA"><enum>(4)</enum><text>to provide
			 opportunities for students to broaden curricula, to expose students to learning
			 opportunities outside a core curriculum of study, and to provide opportunities
			 for students to gain credit toward high school graduation through learning
			 outside a traditional classroom.</text>
			</paragraph></section><section id="HDF727FB1903D4948936AF71A4090BB0C"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H0404C1670F9A40278235C36A86063527"><enum>(1)</enum><header>In
			 general</header><text>The terms <term>local educational agency</term> and
			 <term>State educational agency</term> have the meanings given the terms in
			 section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801).</text>
			</paragraph><paragraph id="H42153B5087EF40B2874C198E73FD0280"><enum>(2)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term>—</text>
				<subparagraph id="id64314DBD35EB4776BE559A7B8497F6B7"><enum>(A)</enum><text>when used with
			 respect to a grant awarded under section 5, means a partnership that
			 includes—</text>
					<clause id="H6720390324F24AA0AFF9A6E9BD7E9CE1"><enum>(i)</enum><text>not
			 less than 1—</text>
						<subclause id="H4C6A04D6B24C4E7C8F99AC385E4E7BDB"><enum>(I)</enum><text>State educational
			 agency; or</text>
						</subclause><subclause id="HCAF4583D02724577A228B64B9F7A47F5"><enum>(II)</enum><text>local educational
			 agency serving a high school or middle school; and</text>
						</subclause></clause><clause id="H78A2B58AD4C34E7BABB4FA7D97CD9BB6"><enum>(ii)</enum><text>not
			 less than 1—</text>
						<subclause id="H485531E22A9C47BFA875E4DC735E7D2E"><enum>(I)</enum><text>career technical
			 student organization;</text>
						</subclause><subclause id="H5E98D27548AA4D28B55D580F6B225A62"><enum>(II)</enum><text>institution of
			 higher education or tribal college or university;</text>
						</subclause><subclause id="H2C5F8605826E45B786AEF18A44AC9A07"><enum>(III)</enum><text>nonprofit
			 organization;</text>
						</subclause><subclause id="HF7EEEACCBB2E4798B7C612A2DF69C6AC"><enum>(IV)</enum><text>community-based
			 organization;</text>
						</subclause><subclause id="HE9EB674A689A443FBD21F5CF4DE180E7"><enum>(V)</enum><text>tribal
			 organization;</text>
						</subclause><subclause id="H14B68C0F5A4F46CE90CF980368E5694E"><enum>(VI)</enum><text>business;
			 or</text>
						</subclause><subclause id="HEDFD890E042B45A285CA38FF5DFF71E6"><enum>(VII)</enum><text>labor union;
			 and</text>
						</subclause></clause></subparagraph><subparagraph id="id79F3C8BB4633400FB7304294BF1102D1"><enum>(B)</enum><text>when used with
			 respect to a subgrant awarded under section 7, means a partnership that
			 includes—</text>
					<clause id="idBDA2E779EF6446B4AD728146ADB86D63"><enum>(i)</enum><text>a
			 local educational agency that—</text>
						<subclause id="id0A4E6D2B9E4649EA9EE42E6F78E1453A"><enum>(I)</enum><text>serves a high
			 school or middle school; and</text>
						</subclause><subclause id="id6D86E2ABC4414EBC8CFFCF037994E615"><enum>(II)</enum><text>does not
			 participate in a partnership that received a grant under section 5; and</text>
						</subclause></clause><clause id="id7421789ADF4748DABF1CCC3E995712AE"><enum>(ii)</enum><text>not less than 1
			 of the entities described in subparagraph (A)(ii).</text>
					</clause></subparagraph></paragraph><paragraph id="idE582DE23CD194656829A59A9065D264A"><enum>(3)</enum><header>High
			 school</header><text>The term <term>high school</term> means a secondary school
			 as defined in section 9101 of the Elementary and Secondary Education Act of
			 1965.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="H2A14500C68854012923E054E020A9F33"><enum>(4)</enum><header>Institution of
			 higher education</header><text display-inline="yes-display-inline">The term
			 <term>institution of higher education</term> has the meaning given the term in
			 section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001).</text>
			</paragraph><paragraph id="H66BA228AC5894A9BA8E36C649D60F4DB"><enum>(5)</enum><header>National model
			 after-school interdisciplinary education program</header><text display-inline="yes-display-inline">The term <term>national model after-school
			 interdisciplinary education program</term> means a high-quality, multisite,
			 after-school program that operates in not less than 5 States.</text>
			</paragraph><paragraph display-inline="no-display-inline" id="H9E7E056C92894166B2DB510ADC482235"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Education.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08C33B100A384B2E9393B1B7740140E3"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idA2C362EA1E604AF786D9628C68A191E5"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18A38CA95DFF477E8C17019F35E77CEF"><enum>(B)</enum><text>the District of
			 Columbia;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CD7ADA749E9413CB1B7D353A2484C05"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6C3542E25864ADEA5A2CFAB50FC096C"><enum>(D)</enum><text>the United States
			 Virgin Islands;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C3C11404338452683A47E2CCF82925C"><enum>(E)</enum><text>Guam;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E0A8213B22741D2B3DD44DE42F6C6A0"><enum>(F)</enum><text>American
			 Samoa;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1928AD8569BE4FEBBF2BEDE3FA5371ED"><enum>(G)</enum><text>the Commonwealth
			 of the Northern Mariana Islands; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id295A4AE2486E43D6906C6A74B4489110"><enum>(H)</enum><text>the Republic of
			 Palau.</text>
				</subparagraph></paragraph><paragraph id="H658C2F2D9233440C9D942D6D99902088"><enum>(8)</enum><header>Struggling
			 student</header>
				<subparagraph id="id4CA19BCF47DC4939B55A7FBE5BD9962F"><enum>(A)</enum><header>In
			 general</header><text>The term <term>struggling student</term> means a middle
			 school-aged or high school-aged student who is not making sufficient progress
			 toward graduating from high school with a regular diploma in the standard
			 number of years.</text>
				</subparagraph><subparagraph id="idAD0D5A33674C430194D2761C12E86986"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>struggling student</term> includes a student who—</text>
					<clause id="HB75B62D6B7E746F188F321043D4CC479"><enum>(i)</enum><text>has
			 been retained in a grade level; or</text>
					</clause><clause id="H2FB5F496FBFE4F639EC699B06BC7E10D"><enum>(ii)</enum><text>is
			 a high school student who—</text>
						<subclause id="id96FD92BAE45D4A9BB5A06A8FA16A23FC"><enum>(I)</enum><text>lacks the
			 necessary credits or courses, as determined by the local educational agency or
			 State educational agency serving the student, to graduate from high school with
			 a regular diploma in the standard number of years; or</text>
						</subclause><subclause id="HD030713C8214460A9D54AF966D8D7F7C"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id3A43EA0F3BDC4BB0BD53CA7F5847D32B"><enum>(aa)</enum><text>enters a school served
			 by a local educational agency at grade 9 or higher; and</text>
							</item><item commented="no" display-inline="no-display-inline" id="HA71C2F67E6274B429C5BD4B10D31B5C1" indent="up1"><enum>(bb)</enum><text>is identified by the local
			 educational agency as—</text>
								<subitem commented="no" display-inline="no-display-inline" id="idC1B9FDE956D14461B24D4A6E3E4D111E"><enum>(AA)</enum><text>being limited English-proficient;
			 and</text>
								</subitem><subitem commented="no" display-inline="no-display-inline" id="id45669DAEBB9645EF80DDEEF82D6300DC"><enum>(BB)</enum><text>having experienced interrupted formal
			 education.</text>
								</subitem></item></subclause></clause></subparagraph></paragraph></section><section id="HD58D89DC67264161A9FAE3DF53EEB797"><enum>5.</enum><header>National model
			 after-school interdisciplinary education program grants</header>
			<subsection id="HAC61DDF2237549D6A59F062FD9CF2CED"><enum>(a)</enum><header>Authorization of
			 grants</header>
				<paragraph id="H69C7A955B5A04E3385D8A739440C6771"><enum>(1)</enum><header>In
			 general</header><text>From amounts made available under section 13(b)(1), the
			 Secretary shall award grants, on a competitive basis, to eligible entities to
			 enable the eligible entities to establish or expand, in accordance with section
			 9, national model after-school interdisciplinary education programs
			 that—</text>
					<subparagraph id="id9906CF7D99DE4F17BB63E72BD250F3C2"><enum>(A)</enum><text>expand the
			 knowledge base for other after-school interdisciplinary education programs;
			 and</text>
					</subparagraph><subparagraph id="id4AAE24FD030742AAB30979E1CF0B2591"><enum>(B)</enum><text>disseminate
			 information regarding effective practices to those other programs.</text>
					</subparagraph></paragraph><paragraph id="HC00AE4FFE9C0400A95A392EF3FBFB56B"><enum>(2)</enum><header>Duration of
			 grants</header><text>Each grant awarded under this section shall be—</text>
					<subparagraph id="id1094A0DB11184C6EB1328F2F0A59F5B0"><enum>(A)</enum><text>for a period of
			 not less than 3 years and not more than 5 years; and</text>
					</subparagraph><subparagraph id="idE0713EA3C85246EB899985A755B5CDA4"><enum>(B)</enum><text>renewable, based
			 on performance, for a period of not less than 3 years and not more than 5
			 years.</text>
					</subparagraph></paragraph><paragraph id="H47B3937C19DF46A2A06694C31696C208"><enum>(3)</enum><header>Grant
			 amounts</header><text>The total amount of a grant awarded under this section
			 shall be not less than $5,000,000 for the period of the grant.</text>
				</paragraph><paragraph id="H974F298556F6407FB6CDF638BCD2543A"><enum>(4)</enum><header>Matching
			 funds</header><text>As a condition of receiving a grant under this section, an
			 eligible entity shall match the grant amount with private funding on an equal
			 basis.</text>
				</paragraph></subsection><subsection id="HA8528A3A0E0A4AE1BA568DEBF065E0A1"><enum>(b)</enum><header>Priority</header><text>In
			 awarding grants under this section, the Secretary shall give priority to
			 applications for assistance under this section that propose to target services
			 to—</text>
				<paragraph id="H20B33410E7144D5486D7C47BB31B457B"><enum>(1)</enum><text>a
			 high percentage of students who—</text>
					<subparagraph id="HE02D8A16420947508205C0D6AF083E51"><enum>(A)</enum><text>are from
			 low-income families;</text>
					</subparagraph><subparagraph id="H54864D2071C44469903A3A955A4A833E"><enum>(B)</enum><text>are struggling
			 students; or</text>
					</subparagraph><subparagraph id="H4A478CE273474100B0BD01CCDFEAF499"><enum>(C)</enum><text>attend schools
			 located in a rural, sparsely populated area; and</text>
					</subparagraph></paragraph><paragraph id="HDD0746F2CD9A44B6AAD69C37CC563C76"><enum>(2)</enum><text>the families of
			 students described in paragraph (1).</text>
				</paragraph></subsection></section><section id="HEB402795699B410283B37786F2CB760C"><enum>6.</enum><header>State
			 grants</header>
			<subsection id="H44154D8A09254295A421D9F6D1D3C59A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">From amounts made
			 available under section 13(b)(2), the Secretary shall award grants, from
			 allotments under subsection (b), to States having applications approved under
			 subsection (c) to enable the States to award subgrants to eligible entities
			 under section 7.</text>
			</subsection><subsection id="H103C89C27DF44022A5D393B318562BAF"><enum>(b)</enum><header>Allotments</header>
				<paragraph commented="no" id="HADC116A28F104AB58EBEE050C1A87044"><enum>(1)</enum><header>Formula</header>
					<subparagraph commented="no" id="id97027C8CA6584195B1FDA543B30EBF41"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), of the amounts
			 made available under section 13(b)(2) that remain after the reservation
			 required under subsection (d), the Secretary shall allot to each State for each
			 applicable fiscal year an amount that bears the same relationship to that
			 remainder as—</text>
						<clause commented="no" id="id1C4ACA2A65044FABB28CDE8E87BADAB3"><enum>(i)</enum><text>the amount the
			 State received under subpart 2 of part A of title I of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6331 et seq.) for the preceding
			 fiscal year; bears to</text>
						</clause><clause commented="no" id="id9B8447AD866242FCAE13D1AFC83D07B3"><enum>(ii)</enum><text>the amount all
			 States received under that subpart for the preceding fiscal year.</text>
						</clause></subparagraph><subparagraph commented="no" id="id57836EAFB8FA420896487EBDF5F5BF2B"><enum>(B)</enum><header>Exception</header><text>No
			 State shall receive less than an amount equal to <fraction>1/2</fraction> of 1
			 percent of the total amount made available to all States under this
			 subsection.</text>
					</subparagraph></paragraph><paragraph id="H30CBDE1EA6A14A5FAF8CDF82566C9592"><enum>(2)</enum><header>Reallotment of
			 unused funds</header><text>If a State does not receive an allotment under this
			 section for a fiscal year, the Secretary shall reallot the amount of the
			 allotment of the State to the remaining States in accordance with this
			 subsection.</text>
				</paragraph></subsection><subsection id="H0479C17389374868BD4BED9448394699"><enum>(c)</enum><header>State
			 application and application procedures</header>
				<paragraph id="H1CD3623F975B4C7EB3B953C76337FEE5"><enum>(1)</enum><header>Application
			 requirements</header><text display-inline="yes-display-inline">To be eligible
			 to receive a grant under this section for any fiscal year, a State shall submit
			 to the Secretary, in such form and manner as the Secretary may require, an
			 application that—</text>
					<subparagraph id="H62BFD87DAC894F90B3AA4A5135329B2C"><enum>(A)</enum><text>designates the
			 State educational agency of the State as the agency responsible for the
			 administration and supervision of programs assisted under this section;</text>
					</subparagraph><subparagraph id="HBA594A8AE9614B87B7D77B8F2329D4E4"><enum>(B)</enum><text>describes the
			 means by which the State educational agency will use funds received under this
			 section, including funds reserved for State-level activities;</text>
					</subparagraph><subparagraph id="H21FC98933AE24B6BB802A95306EB112A"><enum>(C)</enum><text>contains an
			 assurance that the State educational agency will award subgrants under section
			 7 only to eligible entities that propose to serve—</text>
						<clause id="H1923953BE2D245D7B26D19AE0C6D121A"><enum>(i)</enum><text>a
			 high percentage of students who—</text>
							<subclause id="H1D2AF555202E47DDA61E131D99420306"><enum>(I)</enum><text>are from
			 low-income families;</text>
							</subclause><subclause id="H5B9395A1AC0B4B0C83B7E40D3E83E33B"><enum>(II)</enum><text>are struggling
			 students; or</text>
							</subclause><subclause id="H6DE1C783E7294B21A157E3935ADF16D3"><enum>(III)</enum><text>attend schools
			 located in a rural, sparsely populated area; and</text>
							</subclause></clause><clause id="H31DC9A082B5F45BBA0E179FA330C4F5E"><enum>(ii)</enum><text>the
			 families of students described in clause (i);</text>
						</clause></subparagraph><subparagraph id="H783B76087B014D75BA383565F8B31DAB"><enum>(D)</enum><text>describes the
			 procedures and criteria the State educational agency will use for reviewing
			 applications and awarding subgrants under section 7 to eligible entities on a
			 competitive basis, which shall include procedures and criteria that take into
			 consideration the likelihood that a proposed program will help participating
			 students meet local content and student academic achievement standards;</text>
					</subparagraph><subparagraph id="H7AC1F6DE22AF44A4A8D763AF3BC65FDF"><enum>(E)</enum><text>describes the
			 means by which the State educational agency will ensure that subgrants awarded
			 under section 7 are—</text>
						<clause id="H6902ECB6A2324FF7B0F463C9C2A857CC"><enum>(i)</enum><text>of
			 sufficient size and scope to support high-quality, effective programs that are
			 consistent with the purpose of this Act; and</text>
						</clause><clause id="HFE6597A25D2C4A98B8350CC30D836A4B"><enum>(ii)</enum><text>in
			 amounts that are consistent with section 7(a)(4);</text>
						</clause></subparagraph><subparagraph id="HE149EEDEA6A746848BD2A6083EAAE470"><enum>(F)</enum><text>describes the
			 measures the State educational agency will take to ensure that relevant
			 programs implement effective strategies, including providing ongoing technical
			 assistance and training, evaluation, and dissemination of information regarding
			 promising practices;</text>
					</subparagraph><subparagraph id="H13254544C6F640E5A9B01AA8B83AADDC"><enum>(G)</enum><text>describes the
			 means by which programs under section 7 will be coordinated with programs under
			 section 5 and other programs as appropriate;</text>
					</subparagraph><subparagraph id="HDD85C34F97D94DD49DAE6E491B5A7AE1"><enum>(H)</enum><text>contains an
			 assurance that the State educational agency will—</text>
						<clause id="H15DCCEEB13234DB5A2E6DC07BA1E954B"><enum>(i)</enum><text>award subgrants
			 under section 7 for a period of not less than 3 years and not more than 5 years
			 that are renewable, based on performance, for a period of not less than 3 years
			 and not more than 5 years; and</text>
						</clause><clause id="HFBEB7B69C9B0496396C13FE3DB825E34"><enum>(ii)</enum><text>require each
			 eligible entity seeking a subgrant to submit a plan describing the means by
			 which the program funded through the subgrant will continue after funding under
			 this Act is terminated;</text>
						</clause></subparagraph><subparagraph id="H60826B87D18D4DAFA8EA2A0DD1C42085"><enum>(I)</enum><text>contains an
			 assurance that funds made available to carry out this section will be used to
			 supplement, and not supplant, other Federal, State, and local public funds
			 expended to provide programs and activities authorized under this Act and other
			 similar programs;</text>
					</subparagraph><subparagraph id="H81B6DE5211CB43F1B34DD2BED5155764"><enum>(J)</enum><text>contains an
			 assurance that the State educational agency will require eligible entities to
			 describe in an application submitted under section 8 the means by which the
			 transportation needs of participating students will be addressed;</text>
					</subparagraph><subparagraph id="HA000C6B85B8E4168AB95CB0F9E25B65E"><enum>(K)</enum><text>contains an
			 assurance that the State application was developed in consultation and
			 coordination with—</text>
						<clause id="idF257DD6BFE82432D85B3C5D9849CC73C"><enum>(i)</enum><text>appropriate State
			 officials, including the chief State school officer and the State director of
			 career technical education;</text>
						</clause><clause id="id6FC1CC1D4C31403495888B366FD229B5"><enum>(ii)</enum><text>other State
			 agencies administering before- and after-school (or summer school) programs;
			 and</text>
						</clause><clause id="id9947BC9D2C72467680ACD3CECF17EB77"><enum>(iii)</enum><text>representatives
			 of teacher organizations, parents, students, the business community,
			 community-based organizations, and labor unions;</text>
						</clause></subparagraph><subparagraph id="HB6F740FB6F2C4300A72BED95CA10A4B6"><enum>(L)</enum><text>describes the
			 results of the needs and resources assessment of the State for before- and
			 after-school activities, which shall be based on the results of ongoing State
			 evaluation activities;</text>
					</subparagraph><subparagraph id="H4F10F36B2F704E02ADA727F43E4EACE9"><enum>(M)</enum><text>describes the
			 means by which the State educational agency will evaluate the effectiveness of
			 programs and activities carried out under section 7, which shall include, at a
			 minimum—</text>
						<clause id="H100F46011F394335A3CDBAD4FD380000"><enum>(i)</enum><text>a
			 description of the performance indicators and performance measures that will be
			 used to evaluate programs and activities; and</text>
						</clause><clause id="HBD7BEF4C1F21420592A8DFA1B232A361"><enum>(ii)</enum><text>public
			 dissemination of the evaluations of programs and activities carried out under
			 section 7; and</text>
						</clause></subparagraph><subparagraph id="H4F414FFAE4F244A6A78B748359C3E0C3"><enum>(N)</enum><text>provides for
			 timely public notice of intent to file an application under this subsection and
			 an assurance that the application will be available for public review after
			 submission.</text>
					</subparagraph></paragraph><paragraph id="H7D4383F8AEE64160820FF14E63091745"><enum>(2)</enum><header>Approval by
			 Secretary</header>
					<subparagraph id="id32D51F3E20E94CB3B932A4655BC3B9F0"><enum>(A)</enum><header>In
			 general</header><text>Not later than 120 days after the date of receipt of an
			 application under paragraph (1), the Secretary shall approve or disapprove the
			 application.</text>
					</subparagraph><subparagraph id="H38B7D1C7D0614005AA3790B70B222123"><enum>(B)</enum><header>Deemed
			 approval</header><text>If the Secretary fails to make a written determination
			 that an application under paragraph (1) is not in compliance with the
			 requirements of this section by the date required under subparagraph (A), the
			 application shall be considered to be approved.</text>
					</subparagraph><subparagraph id="H5DCC5435FAE948F090B29CF72442DEDD"><enum>(C)</enum><header>Disapproval</header>
						<clause id="idFD25825867EF4CCFBD3C5A66C4B50EDB"><enum>(i)</enum><header>In
			 general</header><text>The Secretary shall not finally disapprove an application
			 under paragraph (1) until the State is provided notice and an opportunity for a
			 hearing regarding the application in accordance with clause (ii).</text>
						</clause><clause id="H88FBD648845F4DD38310F196C18FBCCF"><enum>(ii)</enum><header>Notice and
			 hearing</header><text>If the Secretary determines that an application is not in
			 compliance with the requirements of this section, in whole or in part, the
			 Secretary shall provide to the State—</text>
							<subclause id="HCEF88841EF13492FA086EA18377B6E1F"><enum>(I)</enum><text>a
			 notice of the finding of noncompliance, including—</text>
								<item id="H1664E87B18A449D88FE3CEEA31F147C3"><enum>(aa)</enum><text>a
			 description of the specific provisions of the application that are not in
			 compliance; and</text>
								</item><item id="H86113655876C4B78BCF8992A372EC3D9"><enum>(bb)</enum><text>a
			 request for additional information (only regarding the noncompliant provisions)
			 needed to make the application compliant with the requirements of this section;
			 and</text>
								</item></subclause><subclause id="H8185D3396DA34B3AA146A5ED8CF34043"><enum>(II)</enum><text>an opportunity
			 for a hearing regarding the application.</text>
							</subclause></clause></subparagraph><subparagraph id="H153672FC4B374D36A3AF781747E87801"><enum>(D)</enum><header>Response</header>
						<clause id="id21D3BE526DEE4E34B8C6D35460EE1F35"><enum>(i)</enum><header>In
			 general</header><text>A State shall respond, in accordance with clause (ii), to
			 a notice from the Secretary under subparagraph (C)(i) by not later than 45 days
			 after the date of receipt of the notice.</text>
						</clause><clause id="id067CB5F5AD20434A9772E6AC2F542068"><enum>(ii)</enum><header>Contents</header><text>To
			 respond to a notice under clause (i), a State shall resubmit to the Secretary
			 the application of the State, together with such additional information as is
			 requested by the Secretary under subparagraph (C)(ii)(I)(bb).</text>
						</clause><clause id="id42C5303B299D4192B393388CAC15E1D1"><enum>(iii)</enum><header>Approval</header><text>The
			 Secretary shall approve or disapprove an application resubmitted under clause
			 (ii) by not later than the later of—</text>
							<subclause id="idD25824818E41466DB11B28F0407A89AB"><enum>(I)</enum><text>the date that is
			 45 days after the date on which the State resubmits the application; and</text>
							</subclause><subclause id="idA389D98D323F4B238AB805579F330C32"><enum>(II)</enum><text>the expiration
			 of the applicable 120-day period described in subparagraph (A).</text>
							</subclause></clause></subparagraph><subparagraph id="H749933604F294016B92A7A4D3A571364"><enum>(E)</enum><header>Failure to
			 respond</header><text display-inline="yes-display-inline">If the State fails to
			 respond to a notification from the Secretary under subparagraph (C) by the date
			 required under subparagraph (D)(i), the application of the State shall be
			 considered to be disapproved.</text>
					</subparagraph></paragraph></subsection><subsection id="H4F1EA21311DC47DEBF95C107B76A94E3"><enum>(d)</enum><header>Reservation</header><text display-inline="yes-display-inline">Of the amounts made available to carry out
			 this section under section 13(b)(2), the Secretary shall reserve not less than
			 1 percent, but not more than 5 percent, for payment to the Bureau of Indian
			 Affairs, to be allotted in accordance with the needs of the Bureau for
			 assistance under this Act, as determined by the Secretary, to enable the Bureau
			 to carry out the purpose of this Act.</text>
			</subsection><subsection id="H681E0E21CFF547EEB975932C6C50E398"><enum>(e)</enum><header>Use of
			 funds</header>
				<paragraph id="H90CB9B368D42446382FAE44D9B3CC459"><enum>(1)</enum><header>Subgrants</header><text display-inline="yes-display-inline">Each State that receives a grant under this
			 section shall reserve not less than 93 percent of the amount of the grant to
			 award subgrants to eligible entities under section 7.</text>
				</paragraph><paragraph id="HB39E2612EE3640A894900466BD431331"><enum>(2)</enum><header>State
			 administration</header><text>Each State that receives a grant under this
			 section may use not more than 2 percent of the amount of the grant for—</text>
					<subparagraph id="HE00C68B23574406A9E49FBA12F6BA831"><enum>(A)</enum><text>the administrative
			 costs of carrying out this section and section 7;</text>
					</subparagraph><subparagraph id="HFAC2A185F08E4E74ADD88960332C23F3"><enum>(B)</enum><text>establishing and
			 implementing a peer review process for subgrant applications submitted under
			 section 7 (including consultation with other State agencies responsible for
			 administering youth development programs and adult learning activities);
			 and</text>
					</subparagraph><subparagraph id="HD9DE3213AB3743F985333CF45BA6AADC"><enum>(C)</enum><text display-inline="yes-display-inline">supervising the awarding of subgrants to
			 eligible entities under section 7 (including consultation with other State
			 agencies responsible for administering youth development programs and adult
			 learning activities).</text>
					</subparagraph></paragraph><paragraph id="H4A68F1843F5B4C1DBF73374C4B571066"><enum>(3)</enum><header>State
			 activities</header>
					<subparagraph id="H1DC46E194B6F4E5D80AAFF154EFB04AB"><enum>(A)</enum><header>In
			 general</header><text>Each State that receives a grant under this section may
			 use not more than 5 percent of the amount of the grant for the following
			 activities:</text>
						<clause id="H8A9523382E0D49858A287A61317EFEEE"><enum>(i)</enum><header>Monitoring and
			 evaluation</header><text>Monitoring and evaluation of programs and activities
			 assisted under section 7.</text>
						</clause><clause id="H73249D64C708444E988985491B18DC5E"><enum>(ii)</enum><header>Capacity
			 building, training, and technical assistance</header><text>Providing capacity
			 building, training, and technical assistance under section 7.</text>
						</clause><clause id="H9E261342CC08473AA22298B55E9E597E"><enum>(iii)</enum><header>Comprehensive
			 evaluation</header><text>Comprehensive evaluation (directly or through a grant
			 or contract) of the effectiveness of programs and activities under section
			 7.</text>
						</clause><clause id="HDA5283EAB1684701AF98E83D7B7D06E9"><enum>(iv)</enum><header>State-level
			 efforts and infrastructure</header><text>Supporting State-level efforts and
			 infrastructure to ensure the quality and availability of after-school
			 programs.</text>
						</clause></subparagraph><subparagraph id="H393C0B3A6AE648CCB6BB5BEDCEA3FE4B"><enum>(B)</enum><header>Reporting
			 requirement</header><text>Not later than 2 years after the date of enactment of
			 this Act, and annually thereafter, each State using grant funds made available
			 under subparagraph (A) shall submit to the Secretary a report describing how
			 the grant funds are used.</text>
					</subparagraph></paragraph></subsection></section><section id="H56E11AF0DBC84521899915B8945065B3"><enum>7.</enum><header>Subgrants to
			 eligible entities for after-school interdisciplinary education
			 programs</header>
			<subsection id="HDD24C49CC65E46C8955F8D2169DF9A7E"><enum>(a)</enum><header>Subgrants</header>
				<paragraph id="id7B86063CDCE24517908EC131C951C563"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each State that
			 receives a grant under section 6, acting through the State educational agency
			 of the State, shall use the grant funds to award subgrants to eligible entities
			 to enable the eligible entities to establish or expand after-school
			 interdisciplinary education programs in accordance with section 9.</text>
				</paragraph><paragraph id="H8C56FEE7F73F4ACA989D784C6D290196"><enum>(2)</enum><header>Duration of
			 awards</header><text>A subgrant awarded under this section—</text>
					<subparagraph id="id51DF3896D7474A6B9DADAA4571960620"><enum>(A)</enum><text>may be for a
			 period of not less than 3 years and not more than 5 years; and</text>
					</subparagraph><subparagraph id="id8A919302E5DF41EBBDB6937105BB57DB"><enum>(B)</enum><text>shall be
			 renewable, based on performance, for a period of not less than 3 years and not
			 more than 5 years.</text>
					</subparagraph></paragraph><paragraph id="H5812F0DD11F040759C0E413EDDE28147"><enum>(3)</enum><header>Amount</header><text>The
			 amount of a subgrant under this section shall be not less than $50,000 per
			 fiscal year.</text>
				</paragraph><paragraph id="HFECE5D8D676B4306A1EC184ED577B6C6"><enum>(4)</enum><header>Priority</header>
					<subparagraph id="H70C116804DF04922A97FE7F2B11F6838"><enum>(A)</enum><header>In
			 general</header><text>In awarding subgrants under this section, a State shall
			 give priority to applications for assistance under this section that—</text>
						<clause commented="no" id="H3C7BE512A0BC4EEEBF1B6135E5C7F9D6"><enum>(i)</enum><text>propose to
			 serve—</text>
							<subclause commented="no" id="H7F585884E74A4C1C8CA4BCC25CD5DD93"><enum>(I)</enum><text>a high percentage
			 of students who—</text>
								<item commented="no" id="H734D7DD2B69149F9947FF695D617DDA6"><enum>(aa)</enum><text>are from
			 low-income families;</text>
								</item><item commented="no" id="HD4C6357F646D459BA001F9E4E29DB787"><enum>(bb)</enum><text>are struggling
			 students; or</text>
								</item><item commented="no" id="H2233BD0AD203471A9C0CFF5690C22CBD"><enum>(cc)</enum><text>attend schools
			 located in a rural, sparsely populated area; and</text>
								</item></subclause><subclause commented="no" id="H97FE5E9F91A54190927AC3DA9AFF2E60"><enum>(II)</enum><text display-inline="yes-display-inline">the families of students described in
			 subclause (I); or</text>
							</subclause></clause><clause id="H12DD2A6A705248EF83F75A80E1BF83D9"><enum>(ii)</enum><text>are
			 submitted by an eligible entity consisting of not less than 1 local educational
			 agency serving a middle school or high school that receives funds under part A
			 of title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6311 et seq.).</text>
						</clause></subparagraph><subparagraph commented="no" id="H449ADEC86AFD4317AA9222F18D89EE06"><enum>(B)</enum><header>Geographic
			 diversity</header><text>To the maximum extent practicable, a State shall
			 distribute subgrant funds under this section equitably among geographical areas
			 within the State, including urban and rural communities.</text>
					</subparagraph></paragraph></subsection><subsection id="H926CCA9B7F7342A89DC4DBFE9AFD3F1D"><enum>(b)</enum><header>Permissive local
			 match</header>
				<paragraph id="HAE65BC553FEF419EB48E7413AA4EF95C"><enum>(1)</enum><header>Requirement</header>
					<subparagraph id="idD39C7F419FA940ADA729B4FD70D287CE"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), a State may
			 require an eligible entity to match the amount of a subgrant awarded under this
			 section.</text>
					</subparagraph><subparagraph id="idA61AF54D19714AF497743D1D7D211FAD"><enum>(B)</enum><header>Exception</header><text>A
			 contribution by an eligible entity under subparagraph (A) shall not—</text>
						<clause id="id4C009F3D031B46E68BD43724CDC23E7F"><enum>(i)</enum><text>exceed the amount
			 of the subgrant awarded to the eligible entity; or</text>
						</clause><clause id="idB28F190634BB47ACB25201D825EBD2BD"><enum>(ii)</enum><text>be
			 derived from other Federal or State funds.</text>
						</clause></subparagraph></paragraph><paragraph id="H9B05AAB6AD0148468158C9C7802A881E"><enum>(2)</enum><header>Sliding
			 scale</header><text>The amount of a contribution by an eligible entity under
			 paragraph (1) shall be established based on a sliding fee scale that takes into
			 account—</text>
					<subparagraph id="H76DEB985215D4E498FA915FE9C5EA5E4"><enum>(A)</enum><text>the relative
			 poverty of the population targeted by the eligible entity; and</text>
					</subparagraph><subparagraph id="H9CA2ADC2C8C147688156B4141A020345"><enum>(B)</enum><text>the ability of the
			 eligible entity to obtain matching funds.</text>
					</subparagraph></paragraph><paragraph id="HF381AF7321344021AB986AADF4312D3F"><enum>(3)</enum><header>In-kind
			 contributions</header><text>A State that requires an eligible entity to match
			 funds under this subsection shall permit the eligible entity to provide all or
			 any portion of those funds in the form of in-kind contributions.</text>
				</paragraph><paragraph id="H007D9F96D7B045D88DA79BC095F0B2A2"><enum>(4)</enum><header>Consideration</header><text>Notwithstanding
			 any other provision of this subsection, a State shall not take into
			 consideration the ability of an eligible entity to provide sufficient matching
			 funds under this subsection in selecting eligible entities to receive subgrants
			 under this section.</text>
				</paragraph></subsection></section><section id="H02EDDD2CB8A84CE8BC24B135A17C0106"><enum>8.</enum><header>Eligible entity
			 applications</header>
			<subsection id="idDED9E3FF58DF4CB6A6F5DE53A07B3D98"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To be eligible to
			 receive a grant under section 5 or a subgrant under section 7, an eligible
			 entity shall submit to the Secretary or the State, as applicable, an
			 application in such form and manner as the Secretary or State, as applicable,
			 may require.</text>
			</subsection><subsection id="idA048990B5F2444E78A15CEC234A4803F"><enum>(b)</enum><header>Contents</header><text>Each
			 application described in subsection (a) shall include—</text>
				<paragraph id="H8D51C3122BEB4D1B80B2A142AD194806"><enum>(1)</enum><text>a
			 description of the programs and activities to be funded using the grant or
			 subgrant, including—</text>
					<subparagraph id="H5727F85FEF6841BA9AC80E422FEEEE96"><enum>(A)</enum><text>an assurance that
			 the programs and activities will take place in a safe and easily accessible
			 facility;</text>
					</subparagraph><subparagraph id="H15563A6F76004AB78CA5A2CECB951D59"><enum>(B)</enum><text>a description of
			 how students participating in the programs and activities will travel safely to
			 and from the location of the programs; and</text>
					</subparagraph><subparagraph id="HCE95234F2FCF4C2FB20FC924FBBC11D2"><enum>(C)</enum><text>a description of
			 how the eligible entity will disseminate information regarding the programs and
			 activities (including the locations of the programs and activities) to the
			 community in a manner that is understandable and accessible;</text>
					</subparagraph></paragraph><paragraph id="H57666914139C46CFBA64C41C662E921E"><enum>(2)</enum><text>a
			 description of how the programs and activities are expected to meet the purpose
			 of this Act;</text>
				</paragraph><paragraph id="HC7D771D52904412480FE564C64EC137A"><enum>(3)</enum><text>an identification
			 of Federal, State, and local programs that will be combined or coordinated with
			 the proposed programs and activities to make the most effective use of public
			 resources;</text>
				</paragraph><paragraph id="H3EDB0740BF8D4EBC8F215C7C3CF12301"><enum>(4)</enum><text>an assurance that
			 the proposed programs and activities were developed, and will be carried out,
			 in active collaboration with schools attended by the students to be served by
			 the eligible entity;</text>
				</paragraph><paragraph id="H87B3D02EE4EE47018210A28363DB9A1D"><enum>(5)</enum><text>a
			 description of the means by which the programs and activities will meet the
			 principles of effectiveness described in section 9(b);</text>
				</paragraph><paragraph id="H16811FA6266043E0A66AEEE3BCEDA5FE"><enum>(6)</enum><text>an assurance that
			 the programs and activities will primarily target students from low-income
			 families or struggling students and the families of those students;</text>
				</paragraph><paragraph id="H809D22FE7C3345C7BC2A13B30156497F"><enum>(7)</enum><text>an assurance that
			 funds provided pursuant to this Act will—</text>
					<subparagraph id="id7D0EE3107531425788D2072B26EBC5B3"><enum>(A)</enum><text>be used to
			 increase the level of State, local, and other non-Federal funds that would, in
			 the absence of funds under this Act, be made available for programs and
			 activities authorized under this Act; and</text>
					</subparagraph><subparagraph id="idDCE58CBE18884ADAB0BD59BC81A72FDA"><enum>(B)</enum><text>in no case
			 supplant any Federal, State, local, or non-Federal funds;</text>
					</subparagraph></paragraph><paragraph id="H92C91D67BB3B408F814613A320982706"><enum>(8)</enum><text>a
			 description of a preliminary plan for the means by which the proposed programs
			 and activities will continue after funding under this Act is terminated;</text>
				</paragraph><paragraph id="H0A49D484297D4A57835F514C1D44A713"><enum>(9)</enum><text>an assurance
			 that—</text>
					<subparagraph id="id54BCA6236AE6464C8B8E4A1C44674FA5"><enum>(A)</enum><text>the affected
			 community will be given notice of an intent to submit an application under this
			 Act; and</text>
					</subparagraph><subparagraph id="id9F85100F0BE94D70B02421A24388A1D4"><enum>(B)</enum><text>the application
			 and any applicable waiver request will be available for public review after
			 submission of the application; and</text>
					</subparagraph></paragraph><paragraph id="HB4B2011195DB417081D6571BDCE0338A"><enum>(10)</enum><text>such other
			 information and assurances as the Secretary or the State, as applicable, may
			 reasonably require.</text>
				</paragraph></subsection><subsection id="HCC8E6BE110FA43748C392A1D5B936B36"><enum>(c)</enum><header>Special rule for
			 subgrant applications</header>
				<paragraph id="HC76CFC72E3B34805A179817CA6C7625D"><enum>(1)</enum><header>Approval of
			 certain applications</header><text>A State may approve an application for a
			 subgrant under section 7, for a program to be located in a facility other than
			 a high school, only if the program will be at least as available and accessible
			 to the students to be served as if the program were located in the high
			 school.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF1B19BCA2498442DBE1EE985400C3290"><enum>(2)</enum><header>Peer
			 review</header><text>In reviewing applications for a subgrant under section 7,
			 a State shall use a peer review process or other method of ensuring the quality
			 of applications, in accordance with section 6(c)(1)(D).</text>
				</paragraph></subsection></section><section id="H1842A4C5B5F3472A924D25F289014C96"><enum>9.</enum><header>Required
			 uses</header>
			<subsection id="H08345A4EDB134F49976496012BEE5E5F"><enum>(a)</enum><header>Required
			 activities</header>
				<paragraph id="HA8F503D044B1481F89E6F56F788AD5A7"><enum>(1)</enum><header>In
			 general</header><text>Each eligible entity that receives a grant under section
			 5 or a subgrant under section 7 shall use the grant or subgrant funds, as
			 applicable, to establish or expand after-school programs and activities that
			 meet the purpose of this Act, including—</text>
					<subparagraph id="H376EFA4F190049DAB628BD48A6E7C8F4"><enum>(A)</enum><text>not less than
			 1—</text>
						<clause id="H67390F39F6E245B3AF518BDB6BEE6642"><enum>(i)</enum><text>mathematics and
			 science education activity;</text>
						</clause><clause id="HEB38F6147A99434AB39E674055B07A46"><enum>(ii)</enum><text>language arts,
			 writing, and reading activity; or</text>
						</clause><clause id="H531B682766124D47AB94D40C482EC593"><enum>(iii)</enum><text>history,
			 geography, or social studies activity; and</text>
						</clause></subparagraph><subparagraph id="HCCB6F61E66954E94ADEAEAD691AE4A18"><enum>(B)</enum><text>not less than
			 1—</text>
						<clause id="H622C7C040619441DBD176EDC4D79A1E7"><enum>(i)</enum><text>career technical
			 education activity;</text>
						</clause><clause id="H602BE7B8DCF548E9B6A5B7B26754B789"><enum>(ii)</enum><text>business and
			 entrepreneurial education program;</text>
						</clause><clause id="H9AF5E3A2DAD042C5AB1A2DEA2B9BCFEA"><enum>(iii)</enum><text>health and
			 wellness activity;</text>
						</clause><clause id="H6AAA444168274DADB8FC4DE16D49C80C"><enum>(iv)</enum><text>environmental and
			 conservation activity; or</text>
						</clause><clause id="H35CC998A5C414FE980744D8869D9B5DA"><enum>(v)</enum><text>arts
			 and music education activity.</text>
						</clause></subparagraph></paragraph><paragraph id="H35287FCAC7A048088FFA34A616D3D63D"><enum>(2)</enum><header>Activity and
			 program times</header><text display-inline="yes-display-inline">In addition to
			 after school, the activities and programs described in paragraph (1) may take
			 place before school or at any other time during which school is not in session,
			 including on weekends and during vacation and summer recess periods.</text>
				</paragraph></subsection><subsection id="H9899DDF01E614BF89028100043D20A7E"><enum>(b)</enum><header>Principles of
			 effectiveness</header>
				<paragraph id="H95A2EDA5667A4DCBAFBCF9DA08D3EA55"><enum>(1)</enum><header>In
			 general</header><text>Each program and activity established or expanded under
			 this Act shall meet principles of effectiveness that are based on—</text>
					<subparagraph id="HC436E3DCB482415980B1B0826FBE8738"><enum>(A)</enum><text>an assessment of
			 objective data regarding the need for the programs and activities described in
			 subsection (a), including activities in the schools and communities;</text>
					</subparagraph><subparagraph id="HAC71088E8C724519AAC72A967D64B0C6"><enum>(B)</enum><text>an established set
			 of performance measures, including academic, social, and behavioral measures,
			 aimed at ensuring opportunities for high-quality academic enrichment and
			 positive youth development; and</text>
					</subparagraph><subparagraph id="H75D7A11553AB48619D3601E1D8E1D2E7"><enum>(C)</enum><text>if appropriate,
			 scientifically based research that provides evidence that the programs or
			 activities will help students improve academic achievement, deepen student
			 engagement in learning, and promote positive youth development.</text>
					</subparagraph></paragraph><paragraph id="HECA3DF16C34A4ECD932EC49087B68FFA"><enum>(2)</enum><header>Periodic
			 evaluation</header>
					<subparagraph id="H49A0947790104D2F992221D2ABC68344"><enum>(A)</enum><header>In
			 general</header><text>Each program and activity established or expanded under
			 this Act shall be subject to periodic evaluation to assess the progress made by
			 the program or activity toward achieving the goal of providing high-quality
			 opportunities for academic enrichment and positive youth development.</text>
					</subparagraph><subparagraph id="H53562F64A2F84E4A83DFAE75AC97816E"><enum>(B)</enum><header>Use of
			 results</header><text>The results of evaluations under subparagraph (A) shall
			 be—</text>
						<clause id="HD66C6693FEAD46A3BAA6E6B14AC903B8"><enum>(i)</enum><text>used—</text>
							<subclause id="id455A375249D4483AA5E7286555D781DE"><enum>(I)</enum><text>to refine,
			 improve, and strengthen each program or activity so evaluated; and</text>
							</subclause><subclause id="id9401AEB3D40143268938E503D27B6F15"><enum>(II)</enum><text>to refine the
			 applicable performance measures; and</text>
							</subclause></clause><clause id="H4D4A80144CD64CF5B76365F5A74D18F4"><enum>(ii)</enum><text>made available to
			 the public—</text>
							<subclause id="id01096C47AD7B44B9ADDA531D6C7C6172"><enum>(I)</enum><text>on request;
			 and</text>
							</subclause><subclause id="idF192BCFC1EFE4FDFBA07CD606A639F3A"><enum>(II)</enum><text>by public
			 notice.</text>
							</subclause></clause></subparagraph></paragraph></subsection></section><section id="HC87749C61A0E466AB54337B901B725A7"><enum>10.</enum><header>Secretarial peer
			 review and approval</header><text display-inline="no-display-inline">The
			 Secretary shall establish—</text>
			<paragraph id="HFADF66CE99EB4AAA951F36862241A1C2"><enum>(1)</enum><text>a
			 peer-review process to assist in the review and approval of grant applications
			 submitted under section 5 and State applications submitted under section 6;
			 and</text>
			</paragraph><paragraph id="HA02D747FF66F4C2480C9858B1976D41B"><enum>(2)</enum><text>appoint to serve
			 the peer-review process individuals who are educators and experts in
			 educational standards, assessments, accountability, high school improvement,
			 youth development, dropout prevention, and other educational needs of high
			 school students.</text>
			</paragraph></section><section id="HBF1CB6A5997D45BDAC879CD0E193846C"><enum>11.</enum><header>National
			 activities</header>
			<subsection id="H217895664CE246B5B5B3B664EDFA1C79"><enum>(a)</enum><header>National
			 activities</header><text>From amounts made available under section 13(b)(3),
			 the Secretary shall carry out national activities (directly or through grants
			 or contracts), such as—</text>
				<paragraph id="idBC059C40652D45039888621BBCACA453"><enum>(1)</enum><text>providing
			 technical assistance as described in subsection (b), to States or eligible
			 entities carrying out programs or activities under this Act; or</text>
				</paragraph><paragraph id="id3D18E4A6DFD64ECE93BD91A229964107"><enum>(2)</enum><text>conducting a
			 national evaluation of the effectiveness of programs and activities under this
			 Act.</text>
				</paragraph></subsection><subsection id="HD7FF91E7ECA843A0B7D0722955CEFDF8"><enum>(b)</enum><header>Technical
			 assistance</header><text display-inline="yes-display-inline">The Secretary may
			 provide, pursuant to subsection (a), technical assistance to States and
			 eligible entities carrying out programs and activities under this Act, such
			 as—</text>
				<paragraph id="HB195BB49BE1A4D0D86F62DE87A9966A2"><enum>(1)</enum><text>conducting
			 outreach to ensure widespread knowledge of the availability of those programs
			 and activities;</text>
				</paragraph><paragraph id="HF3D560B2DB0C41C4BBCCABDA195D5D9A"><enum>(2)</enum><text>annually convening
			 participating States, eligible entities, and organizations providing support to
			 those States or eligible entities, to provide training and education regarding
			 best practices;</text>
				</paragraph><paragraph id="H21F9A4A1DC224C5081F03CFD2FAB127C"><enum>(3)</enum><text>disseminating
			 information regarding best practices and successful program models for serving
			 high school youth; and</text>
				</paragraph><paragraph id="H21954C85274F42538689C2B517111FFF"><enum>(4)</enum><text>providing capacity
			 building and training to ensure high-quality programming.</text>
				</paragraph></subsection></section><section id="HF47268FEAFC444F3B7EC539DB0D0772C"><enum>12.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary shall promulgate such
			 regulations as the Secretary determines to be necessary to carry out this
			 Act.</text>
		</section><section id="HEC519C3056F14F3B81364F6381D3A080"><enum>13.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H9F5F6F69C3414800B0A9EB1E2CFD893E"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Secretary such sums as may be necessary to
			 carry out this Act for fiscal year 2010 and each fiscal year thereafter.</text>
			</subsection><subsection id="H7D6B297F5C434ADCA88EFD0DF7A61110"><enum>(b)</enum><header>Allocations</header><text>Of
			 the amounts appropriated pursuant to subsection (b) for each fiscal year, the
			 Secretary shall allocate for the fiscal year—</text>
				<paragraph id="HF94F16AFD7E546B5BA63E0F17B595CAD"><enum>(1)</enum><text>40 percent for
			 grants under section 5;</text>
				</paragraph><paragraph id="H42C19EC54CAE454687DA9A588E903D70"><enum>(2)</enum><text>50 percent for
			 grants under section 6; and</text>
				</paragraph><paragraph id="H40A675CD76FC4614963DF011AB608C05"><enum>(3)</enum><text>10 percent for
			 national activities under section 11.</text>
				</paragraph></subsection></section><section id="H34448C73034A433AA91B5E305337E57F"><enum>14.</enum><header>Limitation on
			 authority</header><text display-inline="no-display-inline">Any new spending
			 authority or new authority to enter into contracts provided by this Act, and
			 under which the United States is obligated to make outlays, shall be effective
			 only to the extent, and in such amounts, as are provided in advance in
			 appropriations Acts.</text>
