		<official-title>To amend the Internal Revenue Code of 1986 to limit the
		  penalty for failure to disclose reportable transactions based on resulting tax
		  benefits, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Small Business Penalty Relief Act
			 of 2009</short-title></quote>.</text>
		</section><section id="HF142D55FF1044A1DB46F147EC92F9D2C"><enum>2.</enum><header>Limitation on
			 penalty for failure to disclose reportable transactions based on resulting tax
			 benefits</header>
			<subsection id="H58F2131E0F714629B94BC9B1E6986306"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 6707A of the Internal Revenue Code of 1986 is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H82CED96E1CC04BF5AD765CAE9F4C2E36" style="OLC">
					<subsection id="H6200EBFDCA724C729168CF0D997F04D2"><enum>(b)</enum><header>Amount of
				penalty</header>
						<paragraph id="H4E61EC676BBD40B39AA41AE0EE91C335"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, the amount of the penalty under subsection (a)
				with respect to any reportable transaction shall be 75 percent of the decrease
				in tax shown on the return as a result of such transaction (or which would have
				resulted from such transaction if such transaction were respected for Federal
				tax purposes).</text>
						</paragraph><paragraph id="HA8B2736D5D1E46239A7F98CD527D411D"><enum>(2)</enum><header>Maximum
				penalty</header><text>The amount of the penalty under subsection (a) with
				respect to any reportable transaction shall not exceed—</text>
							<subparagraph id="H15039E86B7EF482EA27EE976C3D6F2BC"><enum>(A)</enum><text>in the case of a
				listed transaction, $200,000 ($100,000 in the case of a natural person),</text>
							</subparagraph><subparagraph id="H080E9919D6ED4FB598C6181A21A020D0"><enum>(B)</enum><text>in the case of any
				other reportable transaction, $50,000 ($10,000 in the case of a natural
				person).</text>
							</subparagraph></paragraph><paragraph id="H4BD6F4FB875946B990D020A3537C5DE0"><enum>(3)</enum><header>Minimum penalty
				for listed transactions</header><text>In the case of a listed transaction, the
				amount of the penalty under subsection (a) with respect to such transaction
				shall not be less than $10,000 ($5,000 in the case of a natural
				person).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2910D5A01A08440CA1CB8E904034F087"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to penalties
			 assessed after December 31, 2006.</text>
			</subsection></section><section id="idD89B61A5EBF444C39208D5FCFA6388FE"><enum>3.</enum><header>Report on tax
			 shelter penalties and certain other enforcement actions</header>
			<subsection id="id7BB5F86C471041A1ACBEEA8F63052F24"><enum>(a)</enum><header>In
			 general</header><text>The Commissioner of Internal Revenue, in consultation
			 with the Secretary of the Treasury, shall submit to the Committee on Ways and
			 Means of the House of Representatives and the Committee on Finance of the
			 Senate an annual report on the penalties assessed by the Internal Revenue
			 Service during the preceding year under each of the following provisions of the
			 Internal Revenue Code of 1986:</text>
				<paragraph id="idCA5ECD950DCB41E3A9E26297725B9915"><enum>(1)</enum><text>Section 6662A
			 (relating to accuracy-related penalty on understatements with respect to
			 reportable transactions).</text>
				</paragraph><paragraph id="id5C8F53B0841F40A088B170C24AC4F443"><enum>(2)</enum><text>Section 6700(a)
			 (relating to promoting abusive tax shelters).</text>
				</paragraph><paragraph id="idC650537D665F44AC93EFB00BE8246B2C"><enum>(3)</enum><text>Section 6707
			 (relating to failure to furnish information regarding reportable
			 transactions).</text>
				</paragraph><paragraph id="id4461833E48D14444B00BAD557EDE95B3"><enum>(4)</enum><text>Section 6707A
			 (relating to failure to include reportable transaction information with
			 return).</text>
				</paragraph><paragraph id="id16D5EA50D54949B08FDEE677B04DDB91"><enum>(5)</enum><text>Section 6708
			 (relating to failure to maintain lists of advisees with respect to reportable
			 transactions).</text>
				</paragraph></subsection><subsection id="id562265DC806B4D5587BEBCA54684EB4E"><enum>(b)</enum><header>Additional
			 information</header><text>The report required under subsection (a) shall also
			 include information on the following with respect to each year:</text>
				<paragraph id="idB926ACD6EA194DF58CAAB05F080B1707"><enum>(1)</enum><text>Any action taken
			 under section 330(b) of title 31, United States Code, with respect to any
			 reportable transaction (as defined in section 6707A(c) of the Internal Revenue
			 Code of 1986).</text>
				</paragraph><paragraph id="id39B9E2B97D6340C984D4974412FE99AD"><enum>(2)</enum><text>Any extension of
			 the time for assessment of tax enforced, or assessment of any amount under such
			 an extension, under paragraph (10) of section 6501(c) of the Internal Revenue
			 Code of 1986.</text>
				</paragraph></subsection><subsection id="id0208A7320C08443D81DCB959EBB9D75B"><enum>(c)</enum><header>Date of
			 report</header><text>The first report required under subsection (a) shall be
			 submitted not later than June 1, 2010.</text>
