<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>The Social Security and Medicare Solvency Commission Act</short-title></quote>.</text> </section>
<section commented="no" display-inline="no-display-inline" id="idBDBB6A0EF56A4163B81272437F2167DE" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id9AD8D8DE7D404298A11C0E30876A967B"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of the Centers for Medicare &amp; Medicaid Services.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id9BB858D53EB441E8BD727A19EDDCB4DE"><enum>(2)</enum><header display-inline="yes-display-inline">Calendar day</header><text display-inline="yes-display-inline">The term <quote>calendar day</quote> means a calendar day other than one in which either House is not in session because of an adjournment of more than 3 days to a date certain.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idFA1743982869410EBA05AFE09AA99B70"><enum>(3)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <quote>Commission</quote> means the National Commission on Entitlement Solvency established under section 3(a).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idBEDFDC1A9C85427ABDFE8471FA84F5CA"><enum>(4)</enum><header display-inline="yes-display-inline">Commission bill</header><text display-inline="yes-display-inline">The term <quote>Commission bill</quote> means a bill consisting of the proposed legislative language submitted by the Commission under section 3(c)(2)(A) that is introduced under section 7(a).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id4D8D1A16D0BE4C3D8BD0FA0BB932780E"><enum>(5)</enum><header display-inline="yes-display-inline">Commissioner</header><text display-inline="yes-display-inline">The term <quote>Commissioner</quote> means the Commissioner of Social Security.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idA0D13AAA1C1E492A965A13CAA4BFAB2F"><enum>(6)</enum><header display-inline="yes-display-inline">Long-term</header><text display-inline="yes-display-inline">The term <quote>long-term</quote> means a period of not less than 75 years beginning on the date of enactment of this Act.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id85D6E389AD04457EABCAE0BC4C0AAD61"><enum>(7)</enum><header display-inline="yes-display-inline">Medicaid</header><text display-inline="yes-display-inline">The term <quote>Medicaid</quote> means the program established under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idA6BE66275CD740969D91492C67D33427"><enum>(8)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">The term <quote>Medicare</quote> means the program established under title XVIII of the Social Security Act (42 U.S.C. 1395 et seq.).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6B4168E693F24F7EBDAF1B8BFA9F7718"><enum>(9)</enum><header display-inline="yes-display-inline">Social Security</header><text display-inline="yes-display-inline">The term <quote>Social Security</quote> means the program of old-age, survivors, and disability insurance benefits established under title II of the Social Security Act (42 U.S.C. 401 et seq.).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id51714AFECDE748F780877B9183ACF353"><enum>(10)</enum><header display-inline="yes-display-inline">Solvency of medicare program</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="id78AEDA81AEEF43DBA0F9C351D8D3BCA9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term <quote>solvency</quote>, in relation to the Medicare program, means any year in which there is not excess general revenue Medicare funding (as defined in section 801(c)(1) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (Public Law 108–173; 117 Stat. 2358)).</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idA62B3E5C9B504671AC0886928CB75AE3"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment of new revenue</header> 
<clause commented="no" display-inline="no-display-inline" id="idA4A1A50AAFCF44F9B0B232E94D86328F"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of the requirement that the Commission evaluate the solvency of the Medicare program and recommend legislation to restore such solvency as needed, the Commission shall treat any new revenue that is a result of any action taken or any legislation enacted by Congress pursuant to the recommendations of the Commission, as being a dedicated medicare financing source (as defined in section 801(c)(3) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (Public Law 108–173; 117 Stat. 2358)).</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id10961FAB4B674E5EBB56B12C61EAB584"><enum>(ii)</enum><header display-inline="yes-display-inline">Definition of new revenue</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term <quote>new revenue</quote> means only those revenues collected as a result of legislation enacted by Congress pursuant to section 7 of this Act. The term <quote>new revenue</quote> shall not include any revenue otherwise collected under law, including any such revenue that is dedicated to the Federal Hospital Insurance Trust Fund under section 1817 of the Social Security Act (42 U.S.C. 1395i) or the Federal Supplementary Medical Insurance Trust Fund under section 1841 of such Act (42 U.S.C. 1395t).</text> </clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID360da635b0cd43b3b08036986f26ed82"><enum>(11)</enum><header display-inline="yes-display-inline">Solvency of social security program</header><text display-inline="yes-display-inline">The term <quote>solvency</quote>, in relation to Social Security, means any year in which the balance ratio (as defined under section 709(b) of the Social Security Act (42 U.S.C. 910(b)) of the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund established under section 201 of the Social Security Act (42 U.S.C. 401) is greater than zero.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="id45471127484E49A1B514C65E3324AA50" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Establishment of Commission</header> 
<subsection commented="no" display-inline="no-display-inline" id="id885EFF08F9DE429B9BA8390F076F2DEF"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is permanently established an independent and bipartisan commission to be known as the <quote>National Commission on Entitlement Solvency</quote>.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="idF178419C7C204399892E7E21EC12B930"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The Commission shall conduct a comprehensive review of the Social Security and Medicare programs for the following purposes:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id9B303EEC57FC4036BB1094C2CE78464D"><enum>(1)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Reviewing relevant analyses of the current and long-term actuarial financial condition of the Social Security and Medicare programs.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id8821C5A66AAE4DFA8DF18FFA28E7112B"><enum>(2)</enum><header display-inline="yes-display-inline">Identifying problems</header><text display-inline="yes-display-inline">Identifying problems that may threaten the long-term solvency of the Social Security and Medicare programs.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id34FAE097BA6841FF9E613822EFF00F26"><enum>(3)</enum><header display-inline="yes-display-inline">Analyzing potential solutions</header><text display-inline="yes-display-inline">Analyzing potential solutions to problems that threaten the long-term solvency of the Social Security and Medicare programs.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idFD081942B52E468D8B96BFED0C509EBB"><enum>(4)</enum><header display-inline="yes-display-inline">Providing recommendations and proposed legislative language</header><text display-inline="yes-display-inline">Providing recommendations and proposed legislative language that will ensure the long-term solvency of the Social Security and Medicare programs and the provision of appropriate benefits.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id7145B7CCCF7148E1A654896DD09B9B21"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idB4750EE214BA458BB9F9D4DDEC97F2D3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall conduct a comprehensive review of the Social Security and Medicare programs consistent with the purposes described in subsection (b) and shall submit the report required under paragraph (2).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id299A2043E38E43D28F9CE3633B2A4A52"><enum>(2)</enum><header display-inline="yes-display-inline">Report, recommendations, and proposed legislative language</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idFA176CFBB95D4CD6A750C17431A0C0DD"><enum>(A)</enum><header display-inline="yes-display-inline">Report</header> 
<clause commented="no" display-inline="no-display-inline" id="id9DD5B6E3428A42BE92B5B5BDDB3F10C4"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and every 5 years thereafter, the Commission shall submit a report on the long-term solvency of the Social Security and Medicare programs that contains a detailed statement of the findings, conclusions, recommendations, and the proposed legislative language (as required under subparagraph (C)) of the Commission to the President, Congress, the Commissioner, and the Administrator.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id00AC5B43FE3344F5A2C3AD6EF03C6B50"><enum>(ii)</enum><header display-inline="yes-display-inline">Proposed legislative language</header><text display-inline="yes-display-inline">The Commission shall submit the proposed legislative language (as required under clause (i)) in the form of a proposed bill for introduction in Congress.</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id450C4F42F4E942119137D92B7E659664"><enum>(B)</enum><header display-inline="yes-display-inline">Findings, conclusions, and recommendations</header><text display-inline="yes-display-inline">A finding, conclusion, or recommendation of the Commission shall be included in the report under subparagraph (A) only if not less than 10 members of the Commission voted for such finding, conclusion, or recommendation.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id2E5A03D45AD143D791FB5AF06075A1A5"><enum>(C)</enum><header display-inline="yes-display-inline">Legislative language</header> 
<clause commented="no" display-inline="no-display-inline" id="id5CE681A36A044B9A92D8AF0C9740B0B8"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a recommendation submitted with respect to the Social Security or Medicare programs under subparagraph (A) involves legislative action, the report shall include proposed legislative language to carry out such action. Such legislative language shall only be included in the report under subparagraph (A) if the Commission has considered the impact the recommendation would have on the Medicaid program.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id11DAF738F5904EB99F491C3A581CCC50"><enum>(ii)</enum><header display-inline="yes-display-inline">Exclusion of recommendations with respect to medicaid</header><text display-inline="yes-display-inline">Proposed legislative language to carry out any recommendation submitted by the Commission with respect to the Medicaid program shall not be included in the legislative language submitted under clause (i).</text> </clause></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="idF742E93736EB48C6A29E1CFCA26C6D1B" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Structure and membership of the commission</header> 
<subsection commented="no" display-inline="no-display-inline" id="id476FA90E11A04EDEA3FEB86634673A99"><enum>(a)</enum><header display-inline="yes-display-inline">Appointment</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idF344C93E455C45EBACA87F5960059DD5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall be composed of 15 members, of whom—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id930728F841C441E3AF6E702188F49FFF"><enum>(A)</enum><text display-inline="yes-display-inline">7 members shall be appointed by the President—</text> 
<clause commented="no" display-inline="no-display-inline" id="id615468C995CD4077B1E3A704565B29B7"><enum>(i)</enum><text display-inline="yes-display-inline">3 of whom shall be Democrats, appointed in consultation with the majority leader of the Senate and the Speaker of the House of Representatives;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idA66D70782C6F4893A77E0F00504C79E0"><enum>(ii)</enum><text display-inline="yes-display-inline">3 of whom shall be Republicans; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idE563EB40D672414EB995299F98263429"><enum>(iii)</enum><text display-inline="yes-display-inline">1 of whom shall not be affiliated with any political party;</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id0CB57B3697C94CC994D5B2589A631EF3"><enum>(B)</enum><text display-inline="yes-display-inline">2 members shall be appointed by the majority leader of the Senate, 1 of whom is from the Committee on Finance of the Senate;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id10942691FF6E46EFAD7218FA49ED4F31"><enum>(C)</enum><text display-inline="yes-display-inline">2 members shall be appointed by the minority leader of the Senate, 1 of whom is from the Committee on Finance of the Senate;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idBB3D36FA4FA544EC9285ED63CDA3268F"><enum>(D)</enum><text display-inline="yes-display-inline">2 members shall be appointed by the Speaker of the House of Representatives, 1 of whom is from the Committee on Ways and Means of the House of Representatives; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id4B22429968364853B032BFA731E13292"><enum>(E)</enum><text display-inline="yes-display-inline">2 members shall be appointed by the minority leader of the House of Representatives, 1 of whom is from the Committee on Ways and Means of the House of Representatives.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id3F9A1BD6D6C6486F92A6396B1E3513BC"><enum>(2)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">The members shall be individuals who are, by reason of their education, experience, and attainments, exceptionally qualified to perform the duties of members of the Commission.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6ABDBE3CED574EDF806E87AF1B183DD1"><enum>(3)</enum><header display-inline="yes-display-inline">Date</header><text display-inline="yes-display-inline">Members of the Commission shall be appointed by not later than January 1, 2010.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idD1B15A0F3F0440EB9658D69EA3AF1629"><enum>(4)</enum><header display-inline="yes-display-inline">Terms</header><text display-inline="yes-display-inline">A member of the Commission shall be appointed for a single term of 5 years, except the members initially appointed shall be appointed for terms of 6 years.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id027A5FE460074988A3CB0B586DE0F055"><enum>(b)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">A vacancy on the Commission shall be filled not later than 30 calendar days after the date on which the Commission is given notice of the vacancy, in the same manner as the original appointment. The individual appointed to fill the vacancy shall serve only for the unexpired portion of the term for which the individual’s predecessor was appointed.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="idF73A3B5D58B249379A374F0E8DEE02FA"><enum>(c)</enum><header display-inline="yes-display-inline">Committee members of commission</header><text display-inline="yes-display-inline">In the case of an individual appointed to the Commission under subsection (a)(1) who is required to be a member of the Committee on Finance of the Senate or the Committee on Ways and Means of the House of Representatives, if such individual is no longer a member of the required Committee they shall no longer be eligible to serve on the Commission. Such individual shall be removed from the Commission and replaced in accordance with subsection (b).</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="id97D7C5B2D200408E87EF7AB858029B43"><enum>(d)</enum><header display-inline="yes-display-inline">Co-Chairperson</header><text display-inline="yes-display-inline">The Commission shall designate 2 Co-Chairpersons from among the members of the Commission, neither of whom may be affiliated with the same political party.</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="id45DC332C3D894B8C82E0A13675D0937B" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Powers of the Commission</header> 
<subsection commented="no" display-inline="no-display-inline" id="idCB6FD0A7C2F24FE9ABDABD8D194B7A10"><enum>(a)</enum><header display-inline="yes-display-inline">Meetings and hearings</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idFD3E0F6066BD46C9BBD8305798A3A94B"><enum>(1)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Commission shall meet at the call of the Co-Chairpersons. The Co-Chairpersons of the Commission or their designee shall convene and preside at the meetings of the Commission.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idF16A5304F2E64C35ADD50D2FFBA55D4B"><enum>(2)</enum><header display-inline="yes-display-inline">Hearings</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idA28DE0C122B747C199E8E3479F92B45D"><enum>(A)</enum><header display-inline="yes-display-inline">Initial town-hall style public hearings</header> 
<clause commented="no" display-inline="no-display-inline" id="idC93D93360FEB4BF6A8C5E261B6D71F02"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall hold at least 1 town-hall style public hearing within each Federal reserve district not later than the date on which the Commission submits the report required under section 3(c)(2)(A), and shall, to the extent feasible, ensure that there is broad public participation in the hearings.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idE15EB95A2A654CA08796A6B21A5004C7"><enum>(ii)</enum><header display-inline="yes-display-inline">Hearing format</header><text display-inline="yes-display-inline">During each hearing, the Commission shall present to the public, and generate comments and suggestions regarding, the issues reviewed under section 3(b), policies designed to address those issues, and tradeoffs between such policies.</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id5B56932B5C884EFF80A4D958FA5D1F40"><enum>(B)</enum><header display-inline="yes-display-inline">Additional hearings</header><text display-inline="yes-display-inline">In addition to the hearings required under subparagraph (A), the Commission shall hold such other hearings as the Commission determines appropriate to carry out the purposes of this Act.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id87084B1B7E9447B1940D0667C82171F9"><enum>(3)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">Ten members of the Commission shall constitute a quorum for purposes of voting, but a quorum is not required for members to meet and hold hearings.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id1E5257A1C8694303BD18B90683972A52"><enum>(b)</enum><header display-inline="yes-display-inline">Administration</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idA8C2192E056B4FDFA5359DAAA415965E"><enum>(1)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">Each member, other than the Co-Chairpersons, shall be paid at a rate equal to the daily equivalent of the minimum annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission. The Co-Chairpersons shall be paid at a rate equal to the daily equivalent of the minimum annual rate of basic pay prescribed for level III of the Executive Schedule under section 5314 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6AFB6B9B837C4382A0A37CF61C4678B7"><enum>(2)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">Members shall receive travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code, while away from their homes or regular places of business in performance of services for the Commission.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id16F3353CBA124728850C9C0A04CAF409"><enum>(c)</enum><header display-inline="yes-display-inline">Federal advisory committee act</header><text display-inline="yes-display-inline">The Commission shall be exempt from the provisions of the Federal Advisory Committee Act (5 U.S.C. App.).</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="idAA4789A18338463E9C9038D95C726967"><enum>(d)</enum><header display-inline="yes-display-inline">Personnel</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idF0FE6426661A42BA8BDEBD4E7C578F05"><enum>(1)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The Commission shall have a staff headed by an Executive Director. The Executive Director shall be paid at a rate equivalent to a rate established for the Senior Executive Service under section 5382 of title 5, United States Code.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id28EC6931DA03451F81256B8191E336B8"><enum>(2)</enum><header display-inline="yes-display-inline">Staff appointment</header><text display-inline="yes-display-inline">With the approval of the Co-Chairpersons, the Executive Director may appoint such personnel as the Executive Director and the Commission determines to be appropriate.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id4AD511B9D79142D588D4E0EF17C22CBB"><enum>(3)</enum><header display-inline="yes-display-inline">Actuarial experts and consultants</header><text display-inline="yes-display-inline">With the approval of the Co-Chairpersons, the Executive Director may procure temporary and intermittent services under section 3109(b) of title 5, United States Code.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id5249D58B900A46EF8B1C622ABCF6CE7F"><enum>(4)</enum><header display-inline="yes-display-inline">Detail of government employees</header><text display-inline="yes-display-inline">Upon the request of the Co-Chairpersons, the head of any Federal agency may detail, without reimbursement, any of the personnel of such agency to the Commission to assist in carrying out the duties of the Commission. Any such detail shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idC3ED1126011643909FC84BFA49881BC3"><enum>(5)</enum><header display-inline="yes-display-inline">Other resources</header><text display-inline="yes-display-inline">The Commission shall have reasonable access to materials, resources, statistical data, and other information from the Library of Congress, the Chief Actuary of Social Security, the Secretary of Health and Human Services, the Centers for Medicare &amp; Medicaid Services, the Congressional Budget Office, and other agencies and elected representatives of the executive and legislative branches of the Federal Government. The Co-Chairpersons of the Commission shall make requests for such access in writing when necessary.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="idBB21B1310F29446497EC2835C5718FD8" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out the purposes of this Act.</text> </section>
<section commented="no" display-inline="no-display-inline" id="idF2F09A5877E844B59142DF8B4CA2ABFA" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Expedited consideration of Commission recommendations</header> 
<subsection commented="no" display-inline="no-display-inline" id="id194AF59C726446E4A72E18D8EEAFD98F"><enum>(a)</enum><header display-inline="yes-display-inline">Introduction and committee consideration</header> 
<paragraph commented="no" display-inline="no-display-inline" id="ID56211c6db77a45c9982f0ea985d0de5f"><enum>(1)</enum><header display-inline="yes-display-inline">Introduction</header><text display-inline="yes-display-inline">A Commission bill shall be introduced in the Senate by the majority leader, or the majority leader’s designee, and in the House of Representatives, by the majority leader, or the majority leader’s designee. Upon such introduction, the Commission bill shall be referred to the appropriate committees of Congress under paragraph (2). If the Commission bill is not introduced in accordance with the preceding sentence, then any member of Congress may introduce the Commission bill in their respective House of Congress beginning on the date that is the 5th calendar day that such House is in session following the date of the submission of the Commission report under section 3(c)(2)(A).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID0c7920473c4f46f0b025fde8a519a712"><enum>(2)</enum><header display-inline="yes-display-inline">Committee consideration</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="IDaade683c8cad4cbcb13140313f9cf5b8"><enum>(A)</enum><header display-inline="yes-display-inline">Referral</header><text display-inline="yes-display-inline">A Commission bill introduced in the Senate shall be referred to the Committee on Finance of the Senate. A Commission bill introduced in the House of Representatives shall be referred jointly to the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID45aa381e4aa441c39245fc1b46ea7d19"><enum>(B)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 60 calendar days after the introduction of the Commission bill, each Committee of Congress to which the Commission bill was referred shall report the bill. Each such reported bill shall meet the requirement of ensuring the long-term solvency of the Social Security and Medicare programs, and the provision of appropriate benefits, that the proposed legislative language provided by the Commission is subject to under section 3(b)(4).</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDa69e0d649d2f40e2af0f064b7d80ac68"><enum>(C)</enum><header display-inline="yes-display-inline">Discharge of committee</header><text display-inline="yes-display-inline">If a committee to which is referred a Commission bill has not reported such Commission bill at the end of 60 calendar days after its introduction, such committee shall be automatically discharged from further consideration of the Commission bill and it shall be placed on the appropriate calendar.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID2e369d96a73f446090fb7f59a669e58f"><enum>(b)</enum><header display-inline="yes-display-inline">Expedited procedure</header> 
<paragraph commented="no" display-inline="no-display-inline" id="ID2b18fc7149f348409294ff3cb588f60f"><enum>(1)</enum><header display-inline="yes-display-inline">Amendments</header><text display-inline="yes-display-inline">No amendment that is not relevant to the provisions of the Commission bill shall be in order in either the Senate or the House of Representatives. In either House, an amendment, any amendment to an amendment, or any debatable motion or appeal is debatable for not to exceed 5 hours to be divided equally between those favoring and those opposing the amendment, motion, or appeal.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID56dfce2ef2574e30809ca66a6360e881"><enum>(2)</enum><header display-inline="yes-display-inline">Floor consideration in the Senate</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID1d1be302965a424d9ee2889b7d21c18b"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 calendar days after the date on which a committee has reported or has been discharged from consideration of a Commission bill, the majority leader of the Senate, or the majority leader’s designee shall move to proceed to the consideration of the Commission bill. It shall also be in order for any member of the Senate to move to proceed to the consideration of the bill at any time after the conclusion of such 30-day period.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID67d7da865ef748abba749861ff8ef3cb"><enum>(B)</enum><header display-inline="yes-display-inline">Motion to proceed</header><text display-inline="yes-display-inline">A motion to proceed to the consideration of a Commission bill is privileged in the Senate. The motion is not debatable and is not subject to a motion to postpone consideration of the Commission bill or to proceed to the consideration of other business. A motion to reconsider the vote by which the motion to proceed is agreed to or not agreed to shall not be in order. If the motion to proceed is agreed to, the Senate shall immediately proceed to consideration of the Commission bill without intervening motion, order, action, or other business, and the Commission bill shall remain the unfinished business of the Senate until disposed of.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id571A7C04E6454F18B053538991A741C3"><enum>(C)</enum><header display-inline="yes-display-inline">Limited debate</header> 
<clause commented="no" display-inline="no-display-inline" id="idB764516080344E4F8D0EA43810572CB5"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Consideration in the Senate of the Commission bill and all amendments to such bill, and on all debatable motions and appeals in connection therewith, shall be limited to not more than 40 hours, which shall be equally divided between, and controlled by, the majority leader and the minority leader of the Senate or their designees. A motion further to limit debate on the Commission bill is in order and is not debatable. All time used for consideration of the Commission bill, including time used for quorum calls (except quorum calls immediately preceding a vote), shall come from the 40 hours of consideration.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id580524D312084B34B1C90B4EE205657D"><enum>(ii)</enum><header display-inline="yes-display-inline">Recommittal to committee</header><text display-inline="yes-display-inline">Upon expiration of the 40-hour period provided under clause (i), the Commission bill shall be recommitted to committee for further consideration unless <fraction>3/5</fraction> of the Members, duly chosen and sworn, of the Senate agree to proceed to passage. <paragraph commented="no" display-inline="no-display-inline" id="IDb53454e31d5d4d12acd153ced8784e9e"><enum>(4)</enum><header display-inline="yes-display-inline">Consideration by other house</header><text display-inline="yes-display-inline">If, before the passage by one House of the Commission bill that was introduced in such House, such House receives from the other House a Commission bill as passed by such other House—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID90adef5cfbbf49fc9b8920b26448403d"><enum>(A)</enum><text display-inline="yes-display-inline">the Commission bill of the other House shall not be referred to a committee and may only be considered for passage in the House that receives it under subparagraph (C);</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID7234418342174f02b46831905f7ef7ba"><enum>(B)</enum><text display-inline="yes-display-inline">the procedure in the House in receipt of the Commission bill of the other House, with respect to the Commission bill that was introduced in the receiving House, shall be the same as if no Commission bill had been received from the other House; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDbfa5477ab6484b528e2e8b900d995e1d"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraph (B), the vote on final passage shall be on the Commission bill of the other House.</text> </subparagraph><continuation-text commented="no" continuation-text-level="paragraph">Upon disposition of a Commission bill that is received by one House from the other House, it shall no longer be in order to consider the Commission bill that was introduced in the receiving House.</continuation-text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDE92B1AABDFED4D94B8A39B2890AB20C0"><enum>(5)</enum><header display-inline="yes-display-inline">Consideration in conference</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID62EE5C2B56854333BDB9C9A8FF483F11"><enum>(A)</enum><header display-inline="yes-display-inline">Convening of conference</header><text display-inline="yes-display-inline">In the case of any disagreement between the two Houses of Congress with respect to a Commission bill passed by both Houses, conferees shall be promptly appointed and a conference convened. All motions to proceed to conference are nondebatable. The committee of conference shall make and file a report with respect to such Commission bill within 30 calendar days after the day on which managers on the part of the Senate and the House of Representatives have been appointed. Notwithstanding any rule in either House concerning the printing of conference reports or concerning any delay in the consideration of such reports, such report shall be acted on by both Houses not later than 5 calendar days after the conference report is filed in the House in which such report is filed first. In the event the conferees are unable to agree within 30 calendar days after the date on which the conference was convened, they shall report back to their respective Houses in disagreement.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idCA21ED584E774766A9398755B22F1D61"><enum>(B)</enum><header display-inline="yes-display-inline">Conference report defeated</header><text display-inline="yes-display-inline">Should the conference report be defeated, debate on any request for a new conference and the appointment of conferees shall be limited to 1 hour, to be equally divided between, and controlled by, the manager of the conference report and the minority leader or the minority leader’s designee, and should any motion be made to instruct the conferees before the conferees are named, debate on such motion shall be limited to <fraction>½</fraction> hour, to be equally divided between, and controlled by, the mover and the manager of the conference report. Debate on any amendment to any such instructions shall be limited to 20 minutes, to be equally divided between, and controlled by, the mover and the manager of the conference report. In all cases when the manager of the conference report is in favor of any motion, appeal, or amendment, the time in opposition shall be under the control of the minority leader or the minority leader’s designee.</text> </subparagraph></paragraph></subsection></section>
