		  construction and infrastructure improvements at United States land ports of
		  entry, to open additional inspection lanes, to hire more inspectors, and to
		  provide recruitment and retention incentives for United States Customs and
		  Border Protection officers who serve on the Southern Border.</official-title>

		<section id="IDee3250c2d79d4c13a4ad0c2b0f8a9a7a" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Port of Entry Personnel and
			 Infrastructure Funding Act of 2009</short-title></quote>.</text>
		</section><section id="IDb4bb53fc781e4b16bdf89c4400be840d"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID90b93a4d289e406092904acc3bdf77fc"><enum>(1)</enum><header>Northern
			 border</header><text>The term <term>Northern border</term> means the
			 international border between the United States and Canada.</text>
			</paragraph><paragraph id="IDb86e9c5eea9845be8135a31a79126b35"><enum>(2)</enum><header>Southern
			 border</header><text>The term <term>Southern border</term> means the
			 international border between the United States and Mexico.</text>
			</paragraph></section><section id="ID0afd2a72edb540b09016fdfbd21689a0"><enum>3.</enum><header>Customs and
			 border protection personnel</header>
			<subsection id="ID018f9ec4ef9b44618918dd1bda41b0fa"><enum>(a)</enum><header>Staff
			 enhancements</header>
				<paragraph id="idAD96DC38D2C740AC8A9F2540254B3A02"><enum>(1)</enum><header>Revisions to
			 fiscal year allocations and funding</header><text>Title II of the Department of
			 Homeland Security Appropriations Act, 2010 (Public Law 111–83), is amended by
			 inserting <quote><italic>Provided further,</italic> That of the total amount
			 provided, $40,000,000 shall be used to pay the salaries and related
			 compensation for 250 additional Customs and Border Protection officers and 25
			 associated support staff personnel, who shall be devoted to new inspection
			 lanes at new land ports of entry on the Southwest border</quote> before the
			 period at the end of the first paragraph.</text>
				</paragraph><paragraph id="id689BE36D533546D9A7CEDEEF58ED8F7A"><enum>(2)</enum><header>New
			 personnel</header><text>In addition to positions authorized before the date of
			 the enactment of this Act and any existing officer vacancies within United
			 States Customs and Border Protection on such date, the Secretary of Homeland
			 Security shall hire, train, and assign to duty, not later than September 30,
			 2013—</text>
					<subparagraph id="ID8a0d7f527d19493db3c55cc2ae108e04"><enum>(A)</enum><text>2,500 full-time
			 Customs and Border Protection officers to serve on all inspection lanes
			 (primary, secondary, incoming, and outgoing) and enforcement teams at United
			 States land ports of entry on the Northern border;</text>
					</subparagraph><subparagraph id="ID6e7da056ad674842b07bbb8ddb09d80e"><enum>(B)</enum><text>2,500 full-time
			 Customs and Border Protection officers to serve on all inspection lanes
			 (primary, secondary, incoming, and outgoing) and enforcement teams at United
			 States land ports of entry on the Southern border; and</text>
					</subparagraph><subparagraph id="ID9d0131846f1a4b6097287bb357f1ee72"><enum>(C)</enum><text>350 full-time
			 support staff for all United States ports of entry.</text>
					</subparagraph></paragraph></subsection><subsection id="IDb6c19f2312fa4c268394de645b9c52d5"><enum>(b)</enum><header>Waiver of FTE
			 limitation</header><text>The Secretary of Homeland Security may waive any
			 limitation on the number of full-time equivalent personnel assigned to the
			 Department of Homeland Security in order to fulfill the requirements under
			 subsection (a).</text>
			</subsection><subsection id="ID74b8103b94f246afad03bacc4b51b31a"><enum>(c)</enum><header>Report to
			 Congress</header>
				<paragraph id="idA916FAEB647E4985B14098272747D4AD"><enum>(1)</enum><header>Outbound
			 inspections</header><text>Not later than 90 days after the date of the
			 enactment of this Act, the Secretary of Homeland Security shall submit a report
			 containing the Department of Homeland Security’s plans for ensuring the
			 placement of sufficient United States Customs and Border Protection officers on
			 outbound inspections at all Southern border land ports of entry to—</text>
					<subparagraph id="id5989CE1F9D134A2B899968A627147AE6"><enum>(A)</enum><text>the
			 <committee-name committee-id="SSJU00">Committee on the Judiciary of the
			 Senate</committee-name>;</text>
					</subparagraph><subparagraph id="idF6DDBE19F84D442A8C36E8A9F068B7E4"><enum>(B)</enum><text>the
			 <committee-name committee-id="">Committee on the Judiciary of the House of
			 Representatives</committee-name>;</text>
					</subparagraph><subparagraph id="idE0393DEBB8B845208FCD3BA89F5E8A95"><enum>(C)</enum><text>the
			 <committee-name committee-id="SSGA00">Committee on Homeland Security and
			 Governmental Affairs of the Senate</committee-name>; and</text>
					</subparagraph><subparagraph id="id8C76F4C42A824DD886D378DB239FAF0E"><enum>(D)</enum><text>the
			 <committee-name committee-id="">Committee on Homeland Security of the House of
			 Representatives</committee-name>.</text>
					</subparagraph></paragraph><paragraph id="ID91aac10466d444d2816f2140a8f5998f"><enum>(2)</enum><header>Agricultural
			 specialists</header><text>Not later than 90 days after the date of the
			 enactment of this Act, the Secretary of Homeland Security, in consultation with
			 the Secretary of Agriculture, shall submit a report to the committees set forth
			 in paragraph (1) that contains plans for ensuring the placement of sufficient
			 agriculture specialists at all Southern border land ports of entry.</text>
				</paragraph></subsection><subsection id="id2F11F32B36D443BBBA7430F73B11F505"><enum>(d)</enum><header>Retention
			 incentives and salaries</header>
				<paragraph id="id89406C74CCAE42708F63C526EA6D949F"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Homeland Security shall ensure that the
			 requirements under this subsection are met.</text>
				</paragraph><paragraph commented="no" id="ID7ff23d48e1254a60b8f86f5a8f5c2894"><enum>(2)</enum><header>Recruitment and
			 retention payments</header><text>The Secretary may make incentive payments of
			 $5,000 to $10,000, during the 6-year period beginning on October 1, 2009, to
			 the extent necessary to recruit and retain qualified United States Customs and
			 Border Protection port of entry officers.</text>
				</paragraph><paragraph commented="no" id="idDBAF56B3744E40F69E8247EB0DA0ACA4"><enum>(3)</enum><header>Special rules
			 for incentive payments</header>
					<subparagraph commented="no" id="ID9587e379c1d647c488411fcd47616285"><enum>(A)</enum><header>Recruitment
			 incentives</header><text>Each recruitment incentive payment made under this
			 subsection shall be paid to each new employee, in a lump sum, after the
			 employee has entered on duty and completed 6 months of service.</text>
					</subparagraph><subparagraph commented="no" id="ID905c3a88886a4550b43aa3b511b2242a"><enum>(B)</enum><header>Retention
			 incentives</header><text>Each retention incentive payment—</text>
						<clause commented="no" id="idF3522897291F41D6AD8CFE551567C57B"><enum>(i)</enum><text>shall be paid to
			 an employee, in a lump sum, at the end of the fiscal year in which the
			 qualified employee is selected by the Secretary, or a delegate of the
			 Secretary, for receipt of such payment;</text>
						</clause><clause commented="no" id="id1B4A3FCF0A9E465D98D5AA5A69FFA727"><enum>(ii)</enum><text>shall not be
			 limited solely to work performance, but may be based on criteria such
			 as—</text>
							<subclause commented="no" id="idFFBF41701E0B4298AF7E9A1967E707B3"><enum>(I)</enum><text>comparative
			 salaries for law enforcement officers in other Federal agencies;</text>
							</subclause><subclause commented="no" id="id19FDD439DDC7442081D46C1A22115DF7"><enum>(II)</enum><text>costs for
			 replacement and training of a new employee; and</text>
							</subclause><subclause commented="no" id="idACB92653E74D4118B5E108BAAAD21E49"><enum>(III)</enum><text>volume of work
			 at the port of entry;</text>
							</subclause></clause><clause commented="no" id="id9CD0D23C8345425F8B37BEA0EF08DEB6"><enum>(iii)</enum><text>shall be
			 contingent upon the selected employee signing an agreement, under penalty of
			 perjury, to remain in Federal service as a United States Customs and Border
			 Protection officer serving at a land port of entry for at least 3 years;
			 and</text>
						</clause><clause commented="no" id="id34B8AA8BDB3345EA8E8E51293B6678DD"><enum>(iv)</enum><text>shall be subject
			 to reimbursement if the employee fails to complete the required 3 years of
			 Federal service due to voluntary or involuntary separation from service.</text>
						</clause></subparagraph><subparagraph commented="no" id="idFF7CC74D9348441686BF062EAC142860"><enum>(C)</enum><header>Limitations</header>
						<clause commented="no" id="id27940FB092994800BC48BD012B43E7F3"><enum>(i)</enum><header>Fiscal year
			 2010</header><text>In fiscal year 2010, the Secretary may not make more than
			 1,500 incentives payments under this subsection.</text>
						</clause><clause commented="no" id="id52430EF74E6E4D3B8237ED3E0953B166"><enum>(ii)</enum><header>Fiscal year
			 2011 through 2015</header><text>In each of the fiscal years 2011 through 2015,
			 the Secretary may not make more than 500 incentive payments under this
			 subsection.</text>
						</clause><clause commented="no" id="id1A0DECE0D37A417791908F398CB4E159"><enum>(iii)</enum><header>Eligibility</header><text>Any
			 individual receiving an incentive payment in a given fiscal year shall not be
			 eligible to receive another incentive payment until the individual completes at
			 least 2 years of service with the Department of Homeland Security after
			 receiving the payment.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="IDf2f46ae353b7407cb098ac3eb9cbd4c3"><enum>4.</enum><header>Secure
			 communication; equipment; and grants for border personnel</header>
			<subsection id="ID365e0171e47e497dbf5420ea4774804a"><enum>(a)</enum><header>Secure
			 communication</header><text>The Secretary of Homeland Security shall ensure
			 that each United States Customs and Border Protection officer is equipped with
			 a secure 2-way communication and satellite-enabled device, supported by system
			 interoperability, that allows such officers to communicate between ports of
			 entry and inspection stations, and with other Federal, State, local, and tribal
			 law enforcement entities.</text>
			</subsection><subsection id="ID9f20406456624b2991fa44498f4260a7"><enum>(b)</enum><header>Border Area
			 Security Initiative Grant Program</header><text>The Secretary of Homeland
			 Security shall establish a program for awarding grants for the purchase of
			 detection equipment at land ports of entry and mobile, hand-held, 2-way
			 communication and biometric devices for State and local law enforcement
			 officers serving on the Southern border.</text>
			</subsection></section><section id="IDe1c830b788204634a5698b0d423b2bd2"><enum>5.</enum><header>Infrastructure
			 improvements and expansion of Texas land ports of entry</header>
			<subsection id="id474A3099E88E4B8DAEFD535309BA20FE"><enum>(a)</enum><header>Amendments to
			 American Recovery and Reinvestment Act of 2009</header><text>Title VI of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5), under the
			 heading entitled <quote><header-in-text level="subsection" style="appropriations">construction</header-in-text></quote> is amended—</text>
				<paragraph id="id2BB74BDF19DA450D81C0670B9190CCAA"><enum>(1)</enum><text>by striking
			 <quote>U.S. Customs and Border Protection owned</quote>; and</text>
				</paragraph><paragraph id="idF35E50E8F69048EA83FC64303D13A41C"><enum>(2)</enum><text>by inserting
			 <quote><italic>Provided further,</italic> That $100,000,000 shall be used for
			 infrastructure improvements, expansion, and new construction (or reimbursement
			 for new construction costs incurred during fiscal years 2007 through 2009) of
			 high-volume ports of entry in Texas, regardless of port ownership</quote>
			 before the period at the end.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd307cb6a8d9f42c8990c542736304920"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made under subsection (a) shall take effect
			 as if included in the American Recovery and Reinvestment Act of 2009, as of the
			 date of the enactment of such Act.</text>
			</subsection></section><section id="id692D3B0371474623910633CC182F2DE4"><enum>6.</enum><header>Additional
			 authorities for port of entry construction</header>
			<subsection id="IDc1be5b7e445d49caabd4fc20f9ac21a4"><enum>(a)</enum><header>In
			 general</header><text>In order to aid in the enforcement of Federal customs,
			 immigration, and agriculture laws, the Customs and Border Protection
			 Commissioner may—</text>
				<paragraph id="idACC3610C2927424982CAB7D39BE779F2"><enum>(1)</enum><text>design,
			 construct, and modify land ports of entry and other structures and facilities,
			 including living quarters for officers, agents, and personnel;</text>
				</paragraph><paragraph id="idB97CD33C15814B279FE4A68CCB8FBAF3"><enum>(2)</enum><text>acquire, by
			 purchase, donation, exchange or otherwise, land or any interest in land
			 determined to be necessary to carry out the Commissioner’s duties under this
			 section; and</text>
				</paragraph><paragraph id="id3D6C6081EA334121A515A0C92FF112FC"><enum>(3)</enum><text>construct
			 additional ports of entry along the Southern border and the Northern
			 border.</text>
				</paragraph></subsection><subsection id="IDfce983a6b19947cd95669aa2758c5ae4"><enum>(b)</enum><header>Consultation</header>
				<paragraph id="id08F5E17CDE034826B38E856306F68781"><enum>(1)</enum><header>Locations for
			 new ports of entry</header><text>The Secretary of Homeland Security is
			 encouraged to consult with the Secretary of the Interior, the Secretary of
			 Agriculture, the Secretary of State, the International Boundary and Water
			 Commission, the International Joint Commission, and appropriate representatives
			 of States, local governments, Indian tribes, and property owners to—</text>
					<subparagraph id="idF61EB096C1654A5BBBE557D9BB9D6558"><enum>(A)</enum><text>determine
			 locations for new ports of entry; and</text>
					</subparagraph><subparagraph id="id45AF1602EDED4CBD86E64BCFF5155548"><enum>(B)</enum><text>minimize adverse
			 impacts from such ports on the environment, historic and cultural resources,
			 commerce, and quality of life for the communities and residents located near
			 such ports.</text>
					</subparagraph></paragraph><paragraph id="id738315040B824553919EFD1155CC6C8B"><enum>(2)</enum><header>Savings
			 provision</header><text>Nothing in this subsection may be construed to—</text>
					<subparagraph id="id614C290EDD9747EE88EA10F9A6F2C41F"><enum>(A)</enum><text>create any right
			 or liability of the parties described in paragraph (1);</text>
					</subparagraph><subparagraph id="id032A6330B5A1421FBFD6FC97C88E711C"><enum>(B)</enum><text>affect the
			 legality and validity of any determination under this Act by the Secretary;
			 or</text>
					</subparagraph><subparagraph id="id38E8FA92AA0849D7B1546F4F0A0D9B67"><enum>(C)</enum><text>affect any
			 consultation requirement under any other law.</text>
					</subparagraph></paragraph></subsection></section><section id="ID824f24d80a454542a07b21911af28dd9"><enum>7.</enum><header>Authority to
			 acquire leaseholds</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Homeland Security may acquire a leasehold interest in real
			 property, and may construct or modify any facility on the leased property, if
			 the Secretary determines that the acquisition of such interest, and such
			 construction or modification, are necessary to facilitate the implementation of
			 this Act.</text>
		</section><section id="IDaeeb41cae45146ac960a538eb2819fa0"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated, to carry out this Act during the 6-year period
			 beginning on October 1, 2009, $6,000,000,000, of which—</text>
			<paragraph id="id58F492A55CC442ACB69696D1EF70B19F"><enum>(1)</enum><text display-inline="yes-display-inline">$55,000,000 shall be used for incentive
			 payments authorized under section 3(d); and</text>
			</paragraph><paragraph id="idC7A34A11A31E4090AF31683924CCFAEA"><enum>(2)</enum><text>$30,000,000 shall
			 be used for Border Area Security Grants authorized under section 4(b).</text>
			</paragraph></section></legis-body>
