		<official-title>To extend and enhance the COBRA subsidy program under the
		  American Recovery and Reinvestment Act of 2009.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>COBRA Subsidy Extension and
			 Enhancement Act of 2009</short-title></quote>.</text>
		</section><section id="idE9B4020F15574C54B958E50C73ABE75E"><enum>2.</enum><header>Extension of
			 COBRA subsidy program</header>
			<subsection id="idC6D86F59AD0C4D34BE530A36BA506E6A"><enum>(a)</enum><header>Amount of
			 required contribution</header><text>Section 3001(a)(1)(A) of division B of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5) is amended by
			 striking <quote>35 percent</quote> and inserting <quote>25
			 percent</quote>.</text>
			</subsection><subsection id="id5A922679DDE44BA98EB0932E2BDADEF5"><enum>(b)</enum><header>Coverage under
			 retiree plans</header><text>Section 3001(a)(2)(A)(i) of division B of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5) is amended by
			 inserting <quote>coverage under retiree group health plan,</quote> after
			 <quote>Code of 1986),</quote>.</text>
			</subsection><subsection id="idA659AAF6785649D4826D955714E7DB1E"><enum>(c)</enum><header>Extension of
			 coverage</header><text>Section 3001(a)(2)(A)(ii) of division B of the American
			 Recovery and Reinvestment Act of 2009 (Public Law 111–5) is amended—</text>
				<paragraph id="id7FFB939614074C83A9B2AD530915C1A5"><enum>(1)</enum><text>in subclause (I),
			 by striking <quote>9 months</quote> and inserting <quote>15
			 months</quote>;</text>
				</paragraph><paragraph id="id36F749422C5D4A26B63CAD65EBB2CDD5"><enum>(2)</enum><text>in subclause
			 (II), by strike <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="id5109EEA5FB0B4418A8E003C57F88E963"><enum>(3)</enum><text>in subclause
			 (III), by striking the period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="idEC07CA9207B84DAB9B458D04286737BB"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id198FC6D793254A97A1D5D19492CC1BEE" style="OLC">
						<subclause id="idE77E5756C4BB482EA9BE5B18EDCF25A5"><enum>(IV)</enum><text>December 31,
				2010.</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id3165B3855C5D4E98B76D0189514F4BB3"><enum>(d)</enum><header>Assistance
			 eligible individuals</header><text>Section 3001(a)(3) of division B of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5) is
			 amended—</text>
				<paragraph id="idD40869B525864398A4ADA8F5C400B656"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>December</quote> and all that follows through <quote>is
			 eligible</quote> and inserting <quote>June 30, 2010, such qualified beneficiary
			 is or will be eligible, in the next 31 days,</quote>; and</text>
				</paragraph><paragraph id="idA352939F9E624AEDB92A407DCA8E9E34"><enum>(2)</enum><text>in subparagraph
			 (C), by inserting <quote>or reduction in hours (for purposes of a qualifying
			 event based on a reduction in hours shall only apply to individuals whose
			 reduction in hours was involuntary and occurred on or after the date of
			 enactment of the <short-title>COBRA Subsidy Extension and
			 Enhancement Act of 2009</short-title>, except that this parenthetical shall not
			 apply to an employee whose involuntary reduction in hours occurred prior to
			 such date of enactment and is covered by COBRA continuation coverage on such
			 date of enactment) of the covered employee</quote> after
			 <quote>employment</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF229776BD6FD41E58C6E839402B226F9"><enum>(e)</enum><header>Effective dates
			 and transition</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFD344B44BCD747D5908AFE48601A1B04"><enum>(1)</enum><header>Effective
			 dates</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id58CB8E9230BA4682B2DC6C86FA543DF9"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 subparagraph (B), the amendments made by this section shall be effective as if
			 included in the enactment of the American Recovery and Reinvestment Act of 2009
			 (Public Law 111–5).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id127F7FDDC19C4316AB5E9E22F9022CEF"><enum>(B)</enum><header>Special
			 effective date</header><text>The amendment made by—</text>
						<clause commented="no" display-inline="no-display-inline" id="id1D30C9C35F5D46B6A9F8EB83CD17D59F"><enum>(i)</enum><text>subsection (a)
			 shall take effect on the date of enactment of this Act and shall apply
			 beginning with the first premium payment made by an assistance eligible
			 individual under section 3001 of division B of the American Recovery and
			 Reinvestment Act of 2009 (Public Law 111–5) after such date of enactment;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id6F1E6547056B4F91B65C43A2294C4907"><enum>(ii)</enum><text>subsection (b)
			 shall take effect on the date of enactment of this Act.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="HB5C6444F7F6B43AB940BC482EC6E0113"><enum>(2)</enum><header>Transitional
			 rule</header>
					<subparagraph commented="no" id="HA8306381CF54451A9200362148211CFA"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of an
			 individual described in subparagraph (B), under rules established jointly by
			 the Secretaries of Health and Human Services, Treasury, and Labor, the
			 individual may elect to continue and extend COBRA continuation coverage as
			 provided under section 3001 of division B of the American Reinvestment and
			 Recovery Act of 2009, through an election similar to the election permitted
			 under section 3001(a)(4)(A) of such division B. In no case shall the extended
			 period of continuation under this paragraph exceed 3 months.</text>
					</subparagraph><subparagraph commented="no" id="HB39A0E340930408D8A245DF2357BE0A9"><enum>(B)</enum><header>Individual
			 described</header><text display-inline="yes-display-inline">An individual
			 described in this subparagraph is an individual whose COBRA continuation
			 coverage—</text>
						<clause commented="no" id="H21527C0486C145AD82485AFA6DAA31BD"><enum>(i)</enum><text>is described in
			 such section 3001;</text>
						</clause><clause commented="no" id="H1A8043245E76498E8B4AAC9AE07C5B67"><enum>(ii)</enum><text>expired by virtue
			 of reaching the maximum required period of continuation coverage before the
			 date of the enactment of this Act; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H4FFFEDC8A64B4A3E93EF3C1AC2917380"><enum>(iii)</enum><text>would, but for
			 the application of such maximum required period of such continuation coverage,
			 have continued after such date.</text>
						</clause></subparagraph></paragraph></subsection></section></legis-body>
