		<official-title>To amend the Controlled Substances Act to provide
		  enhanced penalties for marketing controlled substances to
		  minors.</official-title>

		<section id="id632ab9a3-1a55-4744-a75d-8b26023a6768" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Saving Kids From Dangerous Drugs Act
			 of 2009</short-title></quote>.</text>
		</section><section id="id8490285c-ae8f-457c-8b99-52091329cb62"><enum>2.</enum><header>Offenses
			 involving controlled substances marketed to minors</header><text display-inline="no-display-inline">Section
			 401 of the Controlled Substances Act (21 U.S.C. 841) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idEDAE1FBF8B4A4308B759D84E6CDFAC35" style="OLC">
				<subsection id="IDe0e6b6b9d4dc402095c850fe3960d07b"><enum>(h)</enum><header>Offenses
				involving controlled substances marketed to minors</header>
					<paragraph id="ID8102b538cefe4ea0b0c8d3cb429c9c02"><enum>(1)</enum><header>Unlawful
				acts</header><text>Except as authorized under this title, including paragraph
				(3), it shall be unlawful for any person at least 18 years of age to knowingly
				or intentionally manufacture, create, distribute, dispense, or possess with
				intent to manufacture, create, distribute, or dispense, a controlled substance
				listed in schedule I or II that is—</text>
						<subparagraph id="idEA922D486F0243D48DC8DB57768951D8"><enum>(A)</enum><text>combined with a
				candy product;</text>
						</subparagraph><subparagraph id="idC9C3BB6F9CA54FE19C2F6AC9B6C5000A"><enum>(B)</enum><text>marketed or
				packaged to appear similar to a candy product; or</text>
						</subparagraph><subparagraph id="id68BABC9F6D6D4D64AD0A97B963228EF3"><enum>(C)</enum><text>modified by
				flavoring or coloring the controlled substance with the intent to distribute,
				dispense, or sell the controlled substance to a person under 21 years of
				age.</text>
						</subparagraph></paragraph><paragraph id="IDdf1150e2ebac47108c94e7393e314577"><enum>(2)</enum><header>Penalties</header><text>Except
				as provided in section 418, 419, or 420, any person who violates paragraph (1)
				of this subsection shall be subject to—</text>
						<subparagraph id="id66B3001F9F5741CC876B6100F4D5F223"><enum>(A)</enum><text>2 times the
				maximum punishment and at least 2 times any term of supervised release
				authorized by subsection (b) of this section for a first offense involving the
				same controlled substance and schedule; and</text>
						</subparagraph><subparagraph id="id4477B376F45A4E0F8C567D7A0C8B71B7"><enum>(B)</enum><text>3 times the
				maximum punishment and at least 3 times any term of supervised release
				authorized by subsection (b) of this section for a second or subsequent offense
				involving the same controlled substance and schedule.</text>
						</subparagraph></paragraph><paragraph id="ID6c18f52ea01b42d6a56da7c5efb30fd2"><enum>(3)</enum><header>Exceptions</header><text>Paragraph
				(1) shall not apply to any controlled substance that—</text>
						<subparagraph id="id517265285CD54EED93FEE4C5B026BDE0"><enum>(A)</enum><text>has been approved
				by the Secretary under section 505 of the Federal Food, Drug, and Cosmetic Act
				(21 U.S.C. 355), if the contents, marketing, and packaging of the controlled
				substance have not been altered from the form approved by the Secretary;
				or</text>
						</subparagraph><subparagraph id="id53E9852504364DB8881752284558490A"><enum>(B)</enum><text>has been altered
				at the direction of a practitioner who is acting for a legitimate medical
				purpose in the usual course of professional
				practice.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
