		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Limitations on Interrogation
			 Techniques Act of 2009</short-title></quote>.</text>
		</section><section id="idC55A1830F8924D3482FE36B51AE4A7A1"><enum>2.</enum><header>Prohibition on
			 the use of certain interrogation techniques</header>
			<subsection id="idA0C03F6635A54F44839C0B290B7306AC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No individual in the
			 custody or under the effective control of personnel of an element of the
			 intelligence community or instrumentality of an element of the intelligence
			 community, regardless of nationality or physical location of the individual or
			 personnel, shall be subject to the following interrogation techniques—</text>
				<paragraph id="ID2393fb9e818b423b9fbd6c4578e7d216"><enum>(1)</enum><text>forcing the
			 individual to be naked, perform sexual acts, or pose in a sexual manner;</text>
				</paragraph><paragraph id="ID357021bb932444fa9f929ebb218eb95d"><enum>(2)</enum><text>placing hoods or
			 sacks over the head of the individual or using duct tape over the individual's
			 eyes;</text>
				</paragraph><paragraph id="ID401171cf00f24d5f9add1af48a7bf095"><enum>(3)</enum><text>applying
			 beatings, electric shock, burns, or similar forms of physical pain;</text>
				</paragraph><paragraph id="ID11a2a2ae9b9447ba87b853a305f38003"><enum>(4)</enum><text>using the
			 technique known as waterboarding;</text>
				</paragraph><paragraph id="ID4583d679cbfe4a53bd4ea07b996079fe"><enum>(5)</enum><text>using military
			 working dogs;</text>
				</paragraph><paragraph id="ID5ee62383ec024532a48d3ebc02c4e7ca"><enum>(6)</enum><text>inducing
			 hypothermia or heat injury;</text>
				</paragraph><paragraph id="ID44926395d3ed4cdf948fa82f75d71155"><enum>(7)</enum><text>conducting mock
			 executions; or</text>
				</paragraph><paragraph id="ID15a7e973a136402dbb8eb9c754f41acf"><enum>(8)</enum><text>depriving the
			 individual of adequate food, water or medical care.</text>
				</paragraph></subsection><subsection id="id3DB04D501AEE41D5BB205C8919C21E44"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id2476D8B6156E4B4A947A66D04057B0B2"><enum>(1)</enum><header>Instrumentality</header><text>The
			 term <term>instrumentality</term>, with respect to an element of the
			 intelligence community, means a contractor or subcontractor at any tier of the
			 element of the intelligence community.</text>
				</paragraph><paragraph id="id63DF988CE6864867A88B63A1520DC4E3"><enum>(2)</enum><header>Intelligence
			 community</header><text>The term <term>intelligence community</term> has the
			 meaning given that term in section 3(4) of the National Security Act of 1947
			 (50 U.S.C. 401a(4)).</text>
