		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to specify the purposes for which funds provided under part A of title I
		  of that Act may be used.</official-title>

		<section id="ID3EDED26C6BA644FDAEF2157F803CCAA7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Title I Education Funding Integrity
			 Act of 2009</short-title></quote>.</text>
		</section><section id="IDCF000A09A48D417DB76011D5475E5FC5"><enum>2.</enum><header>Direct and
			 indirect instructional services</header><text display-inline="no-display-inline">Subpart 1 of part A of title I of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20
			 U.S.C. 6311</external-xref> et seq.) is amended by adding at the end the
			 following:</text>

				<section id="IDB92573286F2149E09181E38EC6C358EF"><enum>1120C.</enum><header>Direct and
				indirect instructional services</header>
					<subsection id="ID92A54C2496824615B7FA4B49B8EE74F9"><enum>(a)</enum><header>In
				general</header>
						<paragraph id="IDAAD789448DD4430D9599EFF9AC233C99"><enum>(1)</enum><header>Use of
				funds</header><text>Notwithstanding any other provision of this Act, a local
				educational agency shall use funds received under this part only for direct
				instructional services and indirect instructional services.</text>
						</paragraph><paragraph id="ID56B54F0FEC2C43D6A04EE87169BF8581"><enum>(2)</enum><header>Limitation on
				indirect instructional services</header><text>A local educational agency may
				use not more than 10 percent of funds received under this part for indirect
				instructional services.</text>
						</paragraph></subsection><subsection id="ID831F00BBD35E409684F8796D8D487765"><enum>(b)</enum><header>Instructional
				services</header>
						<paragraph id="IDDB0FC9E1F4E743E3A0ABAE663D5F845F"><enum>(1)</enum><header>Direct
				instructional services</header><text>In this section, the term <term>direct
				instructional services</term> means—</text>
							<subparagraph id="ID9368C999B761495980E3CBCB93BFCCE5"><enum>(A)</enum><text>the
				implementation of instructional interventions and corrective actions to improve
				student achievement;</text>
							</subparagraph><subparagraph id="IDFA2271828B8C4B6FADB2EFD8B6F9B771"><enum>(B)</enum><text>the extension of
				academic instruction beyond the normal school day and year, including during
				summer school;</text>
							</subparagraph><subparagraph id="ID661D57F5FB2C4511886591001CA7D802"><enum>(C)</enum><text>the employment of
				teachers and other instructional personnel, including providing teachers and
				instructional personnel with employee benefits;</text>
							</subparagraph><subparagraph id="ID2AF411FC088C4468A7FB59CB5862CE9F"><enum>(D)</enum><text>the provision of
				instructional services to prekindergarten children to prepare such children for
				the transition to kindergarten;</text>
							</subparagraph><subparagraph id="ID898AF71C92684060998D5638C8C5CE55"><enum>(E)</enum><text>the purchase of
				instructional resources, such as books, materials, computers, other
				instructional equipment, and wiring to support instructional equipment;</text>
							</subparagraph><subparagraph id="ID8940A02820ED4EAFA992EA70DDBF8D4B"><enum>(F)</enum><text>the development
				and administration of curricula, educational materials, and assessments;</text>
							</subparagraph><subparagraph id="ID70B71D87BD3842C8B1006C86AB69FA00"><enum>(G)</enum><text>the
				transportation of students to assist the students in improving academic
				achievement;</text>
							</subparagraph><subparagraph id="ID0A07C96474C84B5DA21E2741E8FDE1F8"><enum>(H)</enum><text>the employment of
				title I coordinators, including providing title I coordinators with employee
				benefits; and</text>
							</subparagraph><subparagraph id="IDABECE80851084037AB7134A2E3081C22"><enum>(I)</enum><text>the provision of
				professional development for teachers and other instructional personnel.</text>
							</subparagraph></paragraph><paragraph id="ID164CC36653954F31ABF4A2E57CAEEB5D"><enum>(2)</enum><header>Indirect
				instructional services</header><text>In this section, the term <term>indirect
				instructional services</term> includes—</text>
							<subparagraph id="ID6C1258C8B0A14BED89F895D1F883F5E9"><enum>(A)</enum><text>the purchase or
				provision of facilities maintenance, gardening, landscaping, or janitorial
				services, or the payment of utility costs;</text>
							</subparagraph><subparagraph id="IDAD7517A39A3E438FA07296A19CF7E796"><enum>(B)</enum><text>the payment of
				travel and attendance costs at conferences or other meetings;</text>
							</subparagraph><subparagraph id="ID975B519423254114BC584275DC4FDD49"><enum>(C)</enum><text>the payment of
				legal services;</text>
							</subparagraph><subparagraph id="IDCE0BD6E5672547E3B49444D14644ECC9"><enum>(D)</enum><text>the payment of
				business services, including payroll, purchasing, accounting, and data
				processing costs; and</text>
							</subparagraph><subparagraph id="ID31122D3334FB4795ABDF5D913FDCFB6D"><enum>(E)</enum><text>any other
				services determined appropriate by the Secretary that indirectly improve
				student
				achievement.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
