		<official-title>To amend the Immigration and Nationality Act to modify
		  the requirements for participation in the visa waiver program and for other
		  purposes.</official-title>

		<section id="IDE3EDBE20EF414A84B0B8782DF62BA623" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening the Visa Waiver Program
			 to Secure America Act</short-title></quote>.</text>
		</section><section id="idBD739105FBAB4A049F54DBFC88441F17" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id1A7D137AB4C44156ADB261CD226BE2D8"><enum>(1)</enum><header>Program
			 country</header><text display-inline="yes-display-inline">The term
			 <quote>program country</quote> means a country designated as a program country
			 under section 217(c)(1) of the Immigration and Nationality Act (8 U.S.C.
			 1187(c)(1)).</text>
			</paragraph><paragraph id="id3593D9701E7447D883B3F05EBF495002"><enum>(2)</enum><header>Secretary</header><text>Except
			 as otherwise provided, the term <quote>Secretary</quote> means the Secretary of
			 Homeland Security.</text>
			</paragraph><paragraph id="id1C7D1CB40E894EF8A3CA7A9F00D97C09"><enum>(3)</enum><header>Visa waiver
			 program</header><text>The term <quote>visa waiver program</quote> means the
			 visa waiver program carried out under section 217 of the Immigration and
			 Nationality Act (8 U.S.C. 1187).</text>
			</paragraph></section><section id="idC88BFA549AF64154B651F1D3A896EBB9"><enum>3.</enum><header>Enforcement of
			 requirement to report lost or stolen passports</header>
			<subsection id="idBF5B0447FD8049E99DECF7B336ECF503"><enum>(a)</enum><header>Enforcement of
			 existing requirement</header><text display-inline="yes-display-inline">Not
			 later than 180 days after the date of the enactment of this Act, each program
			 country shall have in effect an agreement with the United States as required by
			 section 217(c)(2)(D) of the Immigration and Nationality Act (8 U.S.C.
			 1187(c)(2)(D)).</text>
			</subsection><subsection id="idA5902978E5874398911A6A70FAD6E36C"><enum>(b)</enum><header>Failure To
			 agree To report</header>
				<paragraph id="idACDB28AEA5CB4B30970F126E54895ABD"><enum>(1)</enum><header>Suspension from
			 the program</header><text display-inline="yes-display-inline">If a program
			 country does not meet the requirements of subsection (a), the Secretary, in
			 consultation with the Secretary of State, shall immediately suspend the program
			 country's participation in the visa waiver program.</text>
				</paragraph><paragraph id="id2992C3B0C5F34C6EA44E445A8BEE0F9C"><enum>(2)</enum><header>Restoration to
			 the program</header><text>With respect to a country that is suspended from
			 participation in the visa waiver program under paragraph (1), the Secretary
			 shall restore the country's participation on the date that the Secretary
			 determines that the country meets the requirements of paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8A4444CA37934DAE9CE333E58C96220E"><enum>(c)</enum><header>Limitation on
			 new program countries</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary may not designate a country as a program country until after the
			 date that the Secretary certifies to Congress that the requirements of
			 subsection (a) have been met.</text>
			</subsection></section><section id="id80A6AA79944E40A89D6BE2D815B926D0"><enum>4.</enum><header>Enforcement of
			 requirement for periodic evaluations of program countries</header>
			<subsection id="id7799630393AF4DC5BE4D0C30747F5048"><enum>(a)</enum><header>Enforcement of
			 existing requirement</header><text>Not later than 1 year after the date of the
			 enactment of this Act, the Secretary, in consultation with the Secretary of
			 State, shall evaluate under section 217(c)(5)(A) of the Immigration and
			 Nationality Act (8 U.S.C. 1187(c)(5)(A)) each program country that was
			 designated as a program country prior to January 1, 2009. Such evaluation shall
			 include the visa overstay rate for each program country for the 1-year period
			 ending on the date of the enactment of this Act.</text>
			</subsection><subsection id="idAA01BA7EDDA94A3787917DE0AA52039F"><enum>(b)</enum><header>Visa overstay
			 rate defined</header><text>In this section, the term <quote>visa overstay
			 rate</quote> has the meaning given that term in section 217(c)(8)(C) of the
			 Immigration and Nationality Act (8 U.S.C. 1187(c)(8)(C)), as amended by section
			 6.</text>
			</subsection><subsection id="id03B950365DF3442495895A3810012EA1"><enum>(c)</enum><header>Failure To
			 comply with program requirements</header>
				<paragraph id="id214D446858EE46C3BDC98D9CF22CB473"><enum>(1)</enum><header>Suspension from
			 the program</header><text>If the periodic evaluation prepared under subsection
			 (a) shows that a program country has a visa overstay rate that exceeds 2
			 percent, the Secretary, in consultation with the Secretary of State, shall
			 immediately suspend the program country's participation in the visa waiver
			 program.</text>
				</paragraph><paragraph id="id1710D1B8B64E423F8ACB8628C6C21B5C"><enum>(2)</enum><header>Restoration to
			 the program</header><text>With respect to a country that is suspended from
			 participation in the visa waiver program under paragraph (1), the Secretary
			 shall restore the country's participation on the date that the Secretary
			 determines that the country's visa overstay rate does not exceed 2
			 percent.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id261701B0B263414C9A17A8EB7D63C9F6"><enum>(d)</enum><header>Limitation on
			 new program countries</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary may not designate a country as a program country until after the
			 date that the Secretary certifies to Congress that the requirements of
			 subsection (a) have been met.</text>
			</subsection></section><section id="id4BD48DA6AF184672BB74A4F85BD87EF9"><enum>5.</enum><header>Arrival and
			 departure verification</header>
			<subsection id="idD074367DF06E45DB93CB8C95A9643CC8"><enum>(a)</enum><header>Requirement for
			 verification</header>
				<paragraph id="id71C4CE3AD2414F66B4AD80478B02D086"><enum>(1)</enum><header>In
			 general</header><text>Subparagraph (A) of section 217(c)(8) of the Immigration
			 and Nationality Act (8 U.S.C. 1187(c)(8)) is amended—</text>
					<subparagraph id="idE07A14523A504110856F8FC8537962B5"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="idDC467627F2DB4A06B7BA6881111DBBE3"><enum>(i)</enum><text>by
			 striking <quote>can verify</quote> and inserting
			 <quote>verifies</quote>;</text>
						</clause><clause id="id9B967EB40399448484466633162A7CD6"><enum>(ii)</enum><text>by
			 inserting <quote>arrival and</quote> before <quote>departure</quote>;
			 and</text>
						</clause><clause id="id0D5F57973C9D497AB506ACEEDC734F94"><enum>(iii)</enum><text>by inserting
			 <quote>entry and</quote> before <quote>exit</quote>; and</text>
						</clause></subparagraph><subparagraph id="idA62E4CFFCA574321BD8C63312D50C101"><enum>(B)</enum><text>in clause (ii) by
			 inserting <quote>entry and</quote> before <quote>exit</quote>.</text>
					</subparagraph></paragraph><paragraph id="idD0AF692F732A4577AA8C0878BA2D61A8"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Subparagraph (C) of such section 217(c)(8) is amended
			 by inserting <quote>entry and</quote> before <quote>exit</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id27C5045DBE554BDB8B936EB6B01FA192"><enum>(b)</enum><header>Limitation on
			 new program countries</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary may not designate a country as a program country until after the
			 date that the Secretary certifies to Congress that the requirements of clause
			 (i) of subsection (c)(8)(A) of section 217 of the Immigration and Nationality
			 Act, as amended by subsection (a)(1), are met.</text>
			</subsection><subsection id="idEF70DB1881084F63869F20F53F41AED6"><enum>(c)</enum><header>Audit</header>
				<paragraph id="id1F5163007B8D4B70BB9BFEC0D858770F"><enum>(1)</enum><header>Requirement to
			 conduct</header><text>Not later than 180 days after the date that the
			 certification described in clause (i) of subsection (c)(8)(A) of section 217
			 the Immigration and Nationality Act (8 U.S.C. 1187), as amended by subsection
			 (a)(1), is submitted to Congress, the Comptroller of the United States shall
			 conduct an audit of the travel authorization system described in subsection
			 (h)(3) of that section and submit a report on such audit to Congress.</text>
				</paragraph><paragraph id="idCD2CC01F41CF40F799561AF187DA6703"><enum>(2)</enum><header>Elements</header><text>The
			 report by paragraph (1) shall include—</text>
					<subparagraph id="idBED44943FD134CE0914CB72C09B2F8B1"><enum>(A)</enum><text>a description of
			 the data collected by such system;</text>
					</subparagraph><subparagraph id="idAC3D3DFA258C48099992F2C748ED9A43"><enum>(B)</enum><text>the number of
			 individuals who were identified by such system as being in violation of the
			 immigration laws, disaggregated by country; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCC32C35B4ACE4C5C88EE22AAB88DB7A6"><enum>(C)</enum><text>an explanation of
			 any problems in implementing such system encountered during the early stages of
			 implementation to better identify high-risk travelers and countries of origin
			 of such travelers.</text>
					</subparagraph></paragraph></subsection></section><section id="idB1DEB58A19A7404686AB3C658EFFAC6B"><enum>6.</enum><header>Visa overstay
			 rates</header><text display-inline="no-display-inline">Subparagraph (C) of
			 section 217(c)(8) of the Immigration and Nationality Act (8 U.S.C. 1187(c)(8)),
			 as amended by section 5(a)(2), is further amended—</text>
			<paragraph id="id5D059F45ADE243408B5A3C92FCC079AB"><enum>(1)</enum><text>in clause (i), by
			 striking the period at the end of the first sentence and inserting <quote>,
			 except that in no case may a maximum visa overstay rate exceed 2
			 percent.</quote>;</text>
			</paragraph><paragraph id="id68F5200EB25B4D488C8F7BE724D58AC5"><enum>(2)</enum><text>by redesignating
			 clause (iii) as clause (iv);</text>
			</paragraph><paragraph id="idB271D94BB173432A9D6E715879451D97"><enum>(3)</enum><text>by inserting
			 after clause (ii) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id433E8174B3FA4D7EBC436441EB07788B" style="OLC">
					<clause id="id32F32AD5D4ED404089A327CA443F2BFE"><enum>(iii)</enum><header>Data
				compilation</header><text>The Secretary of Homeland Security shall compile data
				from all appropriate databases to determine the visa overstay rate for each
				country. Such databases shall include—</text>
						<subclause id="id0580F3E3D2304875AFF9EE205773BC99"><enum>(I)</enum><text>the Advanced
				Passenger Information System (APIS);</text>
						</subclause><subclause id="idE5D5CFFBD36949A4AB14751C38219329"><enum>(II)</enum><text>the Automated
				Fingerprint Identification System (IDENT);</text>
						</subclause><subclause id="id4B13BB0FB2704A4A97A36F9B02134A9E"><enum>(III)</enum><text>the Central
				Index System (CIS);</text>
						</subclause><subclause id="idB6251EBCFA07421482DE085C5FEF1140"><enum>(IV)</enum><text>the Computer
				Linked Application Information Management Systems (CLAIMS);</text>
						</subclause><subclause id="IDe1dfd66fcf844b1fa65a7a59b4d6ab16"><enum>(V)</enum><text>the Deportable
				Alien Control System (DACS);</text>
						</subclause><subclause id="ID843c2bf11dde4340a01dd64c984e8f57"><enum>(VI)</enum><text>the Integrated
				Automated Fingerprint Identification System (IAFIS);</text>
						</subclause><subclause id="id7ED89DFB89C84987B1D1D9FA2079AD2F"><enum>(VII)</enum><text>the
				Nonimmigrant Information System (NIIS);</text>
						</subclause><subclause id="idFAF9D7AB1B184B31B57ECC2811A84D63"><enum>(VIII)</enum><text>the
				Reengineered Naturalization Applications Casework Systems (RNACS); and</text>
						</subclause><subclause id="id52DAAE5DB9E441249BAB835F7BA30058"><enum>(IX)</enum><text>the Refugees,
				Asylum, and Parole System (RAPS).</text>
						</subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idA9CF567024A54191849694F7F0EB6C08"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2DFE5AB2B2434E8EA57CDA428CF5B219" style="OLC">
					<clause id="id099A13637E2F4AE7A5611E9592F5E479"><enum>(v)</enum><header>Annual
				report</header><text>Not less frequently than once each fiscal year, the
				Secretary of Homeland Security shall submit to the Committee on Foreign
				Relations and the Committee on the Judiciary of the Senate and the Committee on
				Foreign Affairs and the Committee on the Judiciary of the House of
				Representatives a report describing the visa overstay rate for the previous
				fiscal year of each country designated as a program country under paragraph
				(1).</text>
