		<official-title display="yes">To amend the Public Utility Regulatory
		  Policies Act of 1978 to authorize the Secretary of Energy to make loans to
		  publicly owned electric utilities to finance and refinance projects to comply
		  with any Federal energy efficiency resource standard, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Loans to publicly owned electric utilities
			 to comply with Federal energy efficiency resource standard and for other
			 purposes</header><text display-inline="no-display-inline">Title VI of the
			 Public Utility Regulatory Policies Act of 1978 (16 U.S.C. 2601 et seq.) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id7E8F7A9D672747CEAE5511CEA113E27D" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="IDb0cfc3dc4f3f41719743fed9cd9e827e" section-type="subsequent-section"><enum>610.</enum><header display-inline="yes-display-inline">Loans to publicly owned electric utilities
				to comply with Federal energy efficiency resource standard and for other
				purposes</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID9ad01927c5db40cdba9ee2ec4286e9e2"><enum>(a)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID9ad6eaea2bfb4492a998f7746e3c9f60"><enum>(1)</enum><text display-inline="yes-display-inline">to reduce the cost incurred by publicly
				owned electric utilities in complying with any Federal energy efficiency
				resource standard and for other purposes; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc2bed46999e74cfba91c132c066a7b12"><enum>(2)</enum><text display-inline="yes-display-inline">to minimize the impact of compliance on
				electricity rates for consumers.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID691849b8add84b788b6f24ebbe47eb03"><enum>(b)</enum><header display-inline="yes-display-inline">Definition of publicly owned electric
				utility</header><text display-inline="yes-display-inline">In this section, the
				term <term>publicly owned electric utility</term> means a State utility with a
				service obligation, as those terms are defined in section 217 of the Federal
				Power Act (16 U.S.C. 824q) (as in effect on the date of enactment of this
				section).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDdad290ba540f4535837fc9803ffd2b62"><enum>(c)</enum><header display-inline="yes-display-inline">Loans</header><text display-inline="yes-display-inline">The Secretary shall make loans available to
				publicly owned electric utilities to carry out qualified projects approved by
				the Secretary.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53e053417a6643dea5ea43d38090133d"><enum>(d)</enum><header display-inline="yes-display-inline">Qualified projects</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDcfa97d78a4f449cca958738270bd1084"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A loan may be made under this
				section—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAA97C52CB3D84C38865BB01E408EF7FD"><enum>(A)</enum><text display-inline="yes-display-inline">to finance or refinance the costs of the
				acquisition, construction, or improvement of an electric generation,
				transmission, or distribution facility or utility property or assets, including
				the costs of any indirect acquisition of such a facility or any utility
				property or assets; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id978F878AD06846F2AA45C74AD84734B4"><enum>(B)</enum><text display-inline="yes-display-inline">to refinance bonds issued by a State
				utility described in section 10631(c)(3) of the Revenue Act of 1987 (Public Law
				100–203; 101 Stat. 1330–455).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8af5ac00b83743509df1a316a6ea4f8f"><enum>(2)</enum><header display-inline="yes-display-inline">Disapproval</header><text display-inline="yes-display-inline">The Secretary may disapprove an application
				for a loan for a project under this section if the Secretary determines that
				the revenues available to repay the loan are unlikely to be sufficient to cover
				the repayment obligations of the proposed loan.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2671f36d00a342df9566a421673680dd"><enum>(e)</enum><header display-inline="yes-display-inline">Terms</header><text display-inline="yes-display-inline">A loan made by the Secretary to a publicly
				owned electric utility under this section shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID8637c985c529450c8b33cc5af31d1a61"><enum>(1)</enum><text display-inline="yes-display-inline">be for a term of not to exceed 30
				years;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43862d010b5b43bfa621b12408250f1f"><enum>(2)</enum><text display-inline="yes-display-inline">be secured in a manner that is consistent
				with customary financing arrangements for publicly owned electric utilities;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID61ed50a972b0435297d322757c5dcae7"><enum>(3)</enum><text display-inline="yes-display-inline">bear an annual interest rate that is not
				more than the lesser of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id0774A6DC8BDA47AEBBD18FF569BD319F"><enum>(A)</enum><text display-inline="yes-display-inline">50 basis points more than the Federal funds
				rate established by the Board of Governors of the Federal Reserve System;
				or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB6FD3EFFF1A2456181E667B83966987E"><enum>(B)</enum><text display-inline="yes-display-inline">2 percent.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf6309523ecc34124903dc5008567653b"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section such sums as are
				necessary.</text>
