		<section commented="no" display-inline="no-display-inline" id="idBCB5A6FB60104FBA962BA9F79B5D2FC1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Credit Card Rate Freeze Act of
			 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idF4EFC8F889444C09A688FC319A16E7EC" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Moratorium on rate increases</header><text display-inline="no-display-inline">During the period beginning on the date of
			 enactment of this Act and ending 9 months after the date of enactment of the
			 Credit Card Accountability Responsibility and Disclosure Act of 2009, in the
			 case of any credit card account under an open end consumer credit plan—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDb743fbf37f46471ab49526af7ebe66d1"><enum>(1)</enum><text display-inline="yes-display-inline">no creditor may increase any annual
			 percentage rate, fee, or finance charge applicable to any outstanding balance,
			 except as permitted under subsection 171(b) of the Truth in Lending Act (as
			 added by Public Law 111-24); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4242d0b2e503451db86a4be951014057"><enum>(2)</enum><text display-inline="yes-display-inline">no creditor may change the terms governing
			 the repayment of any outstanding balance, except as set forth in section 171(c)
			 of the Truth in Lending Act (as added by Public Law 111-24).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDce17d3c17c704dbda1f0be54703b5f88" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Defined terms</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id0CB78C2456464F5294BA8F7B7653A402"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>annual percentage
			 rate</quote> means an annual percentage rate, as determined under section 107
			 of the Truth in Lending Act (15 U.S.C. 1606);</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCDA50B9CC0764D74B0BD092E1CF9C7A2"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>finance charge</quote>
			 means a finance charge, as determined under section 106 of the Truth in Lending
			 Act (15 U.S.C. 1605);</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3093495D86054AF8929B51C5DC4A03F5"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>outstanding balance</quote>
			 has the same meaning as in section 171(d) of the Truth in Lending Act (as added
			 by Public Law 111-24); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54D1DAF3E0344735A48D7A30C30330B6"><enum>(4)</enum><text display-inline="yes-display-inline">the terms used in this Act that are defined
			 in section 103 of the Truth in Lending Act (15 U.S.C. 1602) and are not
			 otherwise defined in this Act shall have the same meanings as in section 103 of
			 the Truth in Lending Act.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idF3F9848F58A34ADB9AC27B2C2BD255D2" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Regulatory authority</header>
			<subsection commented="no" display-inline="no-display-inline" id="id699F5006BE904E28B8824A6E3A52AF72"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal
			 Reserve System may issue such rules as may be necessary to carry out this
			 Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDcc4b4cb08a024fcb953847e87f7325f0"><enum>(b)</enum><header display-inline="yes-display-inline">Date of enactment</header><text display-inline="yes-display-inline">The provisions of this Act shall take
			 effect upon the date of enactment of this Act, regardless of whether rules are
			 issued under subsection (a).</text>
