		<section id="id5699EB08ABE3455F93B34B28977D7317" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>United States Secret Service
			 Retirement Act of 2009</short-title></quote>.</text>
		</section><section id="id62007815A80C491A8F66C6010D0AA962"><enum>2.</enum><header>Retirement
			 treatment of certain Secret Service employees</header>
			<subsection id="id0D0466B3BEDC43118DE9EDF331CADC19"><enum>(a)</enum><header>Definition</header><text>In
			 this Act, the term <term>covered employee</term> means an individual
			 who—</text>
				<paragraph id="id3F53E73ED664448AB63240C6C2DC5A08"><enum>(1)</enum><text>was hired as a
			 member of the United States Secret Service Division or the United States Secret
			 Service Uniformed Division during the period beginning on January 1, 1984
			 through December 31, 1986;</text>
				</paragraph><paragraph commented="no" id="IDa77c57f6631649bda4579a9c92d6ee87"><enum>(2)</enum><text>has actively
			 performed duties other than clerical for 10 or more years directly related to
			 the protection mission of the United States Secret Service described under
			 section 3056 of title 18, United States Code;</text>
				</paragraph><paragraph id="id89CFEBF1E9BB48368EF78885A3DE091B"><enum>(3)</enum><text>is serving as a
			 member of the United States Secret Service Division or the United States Secret
			 Service Uniformed Division (or any successor entity) on the effective date of
			 this Act; and</text>
				</paragraph><paragraph id="idB82E4F59A5AC4B8EB1AFEE946271F37A"><enum>(4)</enum><text>files an election
			 to be a covered employee under subsection (b)(1).</text>
				</paragraph></subsection><subsection id="id15A12DF9C4D34074BDDD26D95F01B96C"><enum>(b)</enum><header>Election of
			 coverage</header>
				<paragraph id="idBCF7A9AF866F4BE2AC8D8EF65716A967"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the date of enactment of
			 this Act, an individual described under subsection (a) (1), (2), and (3) may
			 file an election with the United States Secret Service to be a covered employee
			 and to transition to the District of Columbia Police and Firefighters
			 Retirement and Disability System.</text>
				</paragraph><paragraph id="idAB2FDE87AFDD4F04928B97245150928C"><enum>(2)</enum><header>Notification</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Office of
			 Personnel Management and the United States Secret Service shall notify
			 employees of the United States Secret Service of the enactment of this Act and
			 that individuals described under subsection (a) (1), (2), and (3) are qualified
			 to file an election under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID990626033C3E4BE688645116CD184BFF"><enum>(c)</enum><header>Retirement
			 coverage conversion</header>
				<paragraph id="IDb69df213d4e14cc894660a83e7b620fe"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, and in consultation with the Secretary of Homeland Security and the
			 Thrift Savings Board, the Office of Personnel Management shall prescribe
			 regulations to carry out the responsibilities of the Federal Government under
			 this Act. The regulations prescribed under this paragraph shall provide for
			 transition of covered employees from the Federal Employees' Retirement System
			 to the Civil Service Retirement System.</text>
				</paragraph><paragraph id="IDf1faed476b144cf286e53650cadac3f3"><enum>(2)</enum><header>Treatment of
			 covered employees</header>
					<subparagraph commented="no" id="id8284C4350F744832BB97BD787722EFFE"><enum>(A)</enum><header>Election of
			 coverage</header>
						<clause commented="no" id="id28BCA726814C4D75A0C0F633A44DD562"><enum>(i)</enum><header>In
			 general</header><text>After a covered employee files an election under
			 subsection (b)(1), the covered employee shall, subject to clause (ii), be
			 converted from the Federal Employees' Retirement System to the Civil Service
			 Retirement System.</text>
						</clause><clause id="IDf3b9d2bc4a2f460d9bd7c675a5236e6b"><enum>(ii)</enum><header>Coverage in
			 District of Columbia retirement system</header>
							<subclause id="IDa77991de379648b59e1a0f640c454ee3"><enum>(I)</enum><header>In
			 general</header><text>Chapter 7 of title 5 of the District of Columbia Code
			 shall apply with respect to a covered employee on the date on which the covered
			 employee transitions to the Civil Service Retirement System.</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id9C5A91DCBD7E4DA2B402213C9B4BE3B5"><enum>(II)</enum><header>Authorization
			 for District of Columbia</header><text>The government of the District of
			 Columbia shall provide for the coverage of covered employees in the District of
			 Columbia Police and Firefighters Retirement and Disability System in accordance
			 with this Act.</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDe8587652ba76405a8dc7e2ac5714fa7a"><enum>(III)</enum><header>United States
			 Secret Service Uniformed Division</header><text>In the administration of this
			 clause, a covered employee who is a member of the United States Secret Service
			 Uniformed Division shall be authorized to transfer all funds to his credit in
			 the Civil Service Retirement and Disability Fund continued by sections 8331(5)
			 and 8348 of title 5, United States Code, to the general revenues of the
			 District of Columbia and after the transfer of such funds the salary of such
			 member shall be subject to the same deductions for credit to the general
			 revenues of the District of Columbia as the deductions from salaries of other
			 members under subchapter I of chapter 7 of title 5 of the District of Columbia
			 Code, and he shall be entitled to the same benefits as the other members to
			 whom such sections apply.</text>
							</subclause></clause></subparagraph><subparagraph id="IDc85887cd5fae40908c4df3893a2c32ea"><enum>(B)</enum><header>Thrift savings
			 plan</header><text>A covered employee shall forfeit, under procedures
			 prescribed by the Executive Director of the Federal Retirement Thrift
			 Investment Board, all Thrift Savings Plan contributions and associated earnings
			 made by an employing agency pursuant to section 8432(c) of title 5, United
			 States Code. Any amounts remaining in the Thrift Savings Plan account of the
			 covered employee may be transferred to a private account or the District of
			 Columbia Police and Firefighter Retirement and Disability System.</text>
					</subparagraph><subparagraph id="idD1E842E5CA3141128DC8E93A688D3A3F"><enum>(C)</enum><header>Forfeiture of
			 Social Security benefits</header>
						<clause id="idD1C24662BA674BCD97A4F3ECA23029DE"><enum>(i)</enum><header>Contributions</header><text>Upon
			 conversion into the Civil Service Retirement System, a covered employee shall
			 forfeit all contributions made for purposes of title II of the Social Security
			 Act on the basis of the covered employee's employment with the United States
			 Secret Service under sections 3101(a) and 3111(a) of the Internal Revenue Code
			 of 1986. All forfeited funds shall remain in the Federal Old-Age and Survivors
			 Insurance Trust Fund and the Federal Disability Insurance Trust Fund, as
			 applicable. Notwithstanding paragraphs (4) and (5) of section 205(c) of the
			 Social Security Act, the Commissioner of Social Security shall change or delete
			 any entry with respect to wages of a covered employee that are forfeited under
			 this clause.</text>
						</clause><clause id="id242E5C78887B44199A62241420F5E300"><enum>(ii)</enum><header>Benefits</header>
							<subclause id="id8F05CBEC5F3D41A1A9D3E2289652ABD4"><enum>(I)</enum><header>In
			 general</header><text>No individual shall be entitled to any benefit under
			 title II of the Social Security Act based on wages for which the contributions
			 were forfeited under clause (i).</text>
							</subclause><subclause id="idF1CBEFC40D1D408CBBB2837019A22812"><enum>(II)</enum><header>No effect on
			 medicare benefits</header><text>Notwithstanding the forfeiture by a covered
			 employee under clause (i), such contributions shall continue to be treated as
			 having been made while performing medicare qualified government employment (as
			 defined in section 210(p) of the Social Security Act) for purposes of sections
			 226 and 226A of that Act.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="idB052431B77144E87BCDD671C3BE916F0"><enum>(3)</enum><header>Implementation</header><text>The
			 Office of Personnel Management, the Department of Homeland Security, the Social
			 Security Administration, and the Thrift Savings Board shall take such actions
			 as necessary to provide for the implementation of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAB50B6F620D447799E22760598176497"><enum>(d)</enum><header>Effective
			 Date</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id430C27AF438744EDBA8279A241559870"><enum>(1)</enum><header>In
			 general</header><text>Except as provided under paragraph (2), this Act shall
			 take effect on the first day of the first applicable pay period that begins 180
			 days after the date of enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id946054BCA0404DD6A49013DFE8BF2193"><enum>(2)</enum><header>Elections and
			 implementation</header><text>Subsections (b) and (c)(1) and (3) shall take
			 effect on the date of enactment of this Act.</text>
				</paragraph></subsection></section></legis-body>
