		  the Small Business Act and the Small Business Investment Act of 1958, and for

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Small Business Emergency Loan
			 Relief Act of 2009</short-title></quote>.</text>
		</section><section id="idE0349599B0D74B25B57F6336525D3996"><enum>2.</enum><header>Temporary
			 increase in maximum loan amounts and use of refinances</header>
			<subsection id="id4919429FEAD44FFFA6C419DC28CBEF5B"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="idF056929C2E4F4D1AAEF712BDB2EE4B8E"><enum>(1)</enum><header>Maximum amounts
			 for 7<enum-in-header>(a)</enum-in-header> loans</header><text display-inline="yes-display-inline">Section 7(a)(3)(A) of the Small Business
			 Act (15 U.S.C. 636(a)(3)(A)) is amended by striking <quote>$1,500,000 (or if
			 the gross loan amount would exceed $2,000,000</quote> and inserting
			 <quote>$4,500,000 (or if the gross loan amount would exceed
			 $5,000,000</quote>.</text>
				</paragraph><paragraph id="id01C696B14E9841D8A2DC28BCBCB20EBB"><enum>(2)</enum><header>Maximum loan
			 amounts under 504 program</header><text display-inline="yes-display-inline">Section 502(2)(A) of the Small Business
			 Investment Act of 1958 (15 U.S.C. 696(2)(A)) is amended—</text>
					<subparagraph id="idF759E346C9324FECA7B487357A077353"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking
			 <quote>$1,500,000</quote> and inserting <quote>$4,000,000</quote>;</text>
					</subparagraph><subparagraph id="id3C72C7A0D93B445B88FEC8F4D6B8C411"><enum>(B)</enum><text>in clause (ii),
			 by striking <quote>$2,000,000</quote> and inserting
			 <quote>$5,000,000</quote>;</text>
					</subparagraph><subparagraph id="id2EA89A4CE5F8400AAB56E48780DBCF88"><enum>(C)</enum><text>in clause (iii),
			 by striking <quote>$4,000,000</quote> and inserting
			 <quote>$5,500,000</quote>;</text>
					</subparagraph><subparagraph id="id30B228EF4B484334A38F7A6B1DE36C65"><enum>(D)</enum><text>in clause (iv),
			 by striking <quote>$4,000,000</quote> and inserting <quote>$5,500,000</quote>;
			 and</text>
					</subparagraph><subparagraph id="id84690A2BA71345CEA4D3638AAE4C2955"><enum>(E)</enum><text>in clause (v), by
			 striking <quote>$4,000,000</quote> and inserting
			 <quote>$5,500,000</quote>.</text>
					</subparagraph></paragraph><paragraph id="idC2C46E26A65F48F7A92172C7CC2859FF"><enum>(3)</enum><header>Maximum loan
			 limits under microloan program</header><text display-inline="yes-display-inline">Section 7(m) of the Small Business Act (15
			 U.S.C. 636(m)) is amended—</text>
					<subparagraph id="id4D5581257B744A929B004CC1340F0DE5"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(iii), by striking
			 <quote>$35,000</quote> and inserting <quote>$50,000</quote>;</text>
					</subparagraph><subparagraph id="id266BB2655C4D401C93C03A063D71D725"><enum>(B)</enum><text>in paragraph
			 (3)(E), by striking <quote>$35,000</quote> each place it appears and inserting
			 <quote>$50,000</quote>; and</text>
					</subparagraph><subparagraph id="idE3D30B0546ED42F5AABE37E561D06D61"><enum>(C)</enum><text>in paragraph
			 (11)(B), by striking <quote>$35,000</quote> and inserting
			 <quote>$50,000</quote>.</text>
					</subparagraph></paragraph><paragraph id="IDf655abc101f74b42b9c962da2c3f1176"><enum>(4)</enum><header>Low interest
			 refinancing under the local development business loan
			 program</header><text>Section 502(7) of the Small Business Investment Act of
			 1958 (15 U.S.C. 696(7)) is amended—</text>
					<subparagraph id="id91979400B30D410785D23B45A85346C4"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>, including a financing that does not involve an
			 expansion of a small business concern,</quote> after <quote>under this
			 title</quote>; and</text>
					</subparagraph><subparagraph id="id0F4AF311DCF543A28F7765B156235DD6"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id99733BEB1F9846C785A14B51175AE85F" style="OLC">
							<subparagraph id="idEA20F706E1664B49810368E07337F513"><enum>(C)</enum><header>Refinancing not
				involving expansions</header><text>If the project for which a financing is
				approved under this title does not involve the expansion of a small business
				concern, any amount of existing indebtedness may be refinanced and added to the
				project cost if—</text>
								<clause id="IDd8d1aa549ece4e65a89f5ca44bb4ef9e"><enum>(i)</enum><text>the total amount
				of the financing is not more than 80 percent of the value of the collateral for
				the financing;</text>
								</clause><clause id="ID74857fd8722048f785d6ee8f8165c856"><enum>(ii)</enum><text>the small
				business concern has been in operation for all of the 2-year period ending on
				the date of the financing;</text>
								</clause><clause id="ID0b06bd80e83f49b4a86eebcbe8d80d46"><enum>(iii)</enum><text>the existing
				indebtedness was not incurred during the 2-year period ending on the date of
				the financing;</text>
								</clause><clause id="ID65d697007aa34599a3aa098009900baa"><enum>(iv)</enum><text>the existing
				indebtedness is not subject to a guarantee by any Federal agency; and</text>
								</clause><clause id="IDfe2d5056ab43420cb5ed46f03c2feb64"><enum>(v)</enum><text>in any case in
				which the Administrator determines that there will be an additional cost for
				making a loan that includes the refinancing of the existing indebtedness, the
				borrower agrees to pay a fee in an amount equal to the anticipated additional
				cost.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idF60FB9D3FFC145D5BBBA3EF0B175A49E"><enum>(5)</enum><header>Business
			 stabilization program</header><text>Section 506(d) of division A of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
			 157) is amended by striking <quote>$35,000</quote> and inserting
			 <quote>$50,000</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC40549576291403DBB3EA15D03EEF202"><enum>(b)</enum><header>Fees</header><text>During
			 the period beginning on the date of enactment of this Act and ending on January
			 1, 2011—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4643C90C47B946B3A20C402289334308"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to each loan guaranteed under
			 section 7(a) of the Small Business Act (15 U.S.C. 636(a)), the Administrator of
			 the Small Business Administration (in this subsection referred to as the
			 <quote>Administrator</quote>) shall, in lieu of the fees otherwise applicable
			 under paragraphs (23)(A) and (18)(A) of section 7(a) of the Small Business Act
			 (15 U.S.C. 636(a)), collect no fee;</text>
				</paragraph><paragraph id="IDfccfd96173e94164ae10025fa7c0a575"><enum>(2)</enum><text>the Administrator
			 shall, in lieu of the fee otherwise applicable under section 503(d)(2) of the
			 Small Business Investment Act of 1958 (15 U.S.C. 697(d)(2)) for an institution
			 described in subclause (I), (II), or (III) of section 502(3)(B)(i) of that Act
			 (15 U.S.C. 696(3)(B)(i)), for any loan guarantee or project subject to such
			 subsection, collect no fee; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20D9C786FB22407F92D9C566D4637E23"><enum>(3)</enum><text>the Administrator
			 shall, in lieu of the fee otherwise applicable under section 503(d)(3) of the
			 Small Business Investment Act of 1958 (15 U.S.C. 697(d)(3)), collect no
			 fee.</text>
				</paragraph></subsection><subsection id="id2CF5C22B161C434A9DE28AA4E7D0B8A4"><enum>(c)</enum><header>Prospective
			 repeal</header>
				<paragraph id="id2A45B75B200147EE9AD3422B977FFFAD"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="id5CAFA9CFE6A54FDC988844009C7B2EA4"><enum>(A)</enum><header>Maximum amounts
			 for 7<enum-in-header>(a)</enum-in-header> loans</header><text display-inline="yes-display-inline">Section 7(a)(3)(A) of the Small Business
			 Act (15 U.S.C. 636(a)(3)(A)) is amended by striking <quote>$4,500,000 (or if
			 the gross loan amount would exceed $5,000,000</quote> and inserting
			 <quote>$1,500,000 (or if the gross loan amount would exceed
			 $2,000,000</quote>.</text>
					</subparagraph><subparagraph id="id26D25EC8E1CF4087B17EF055068B2F8B"><enum>(B)</enum><header>Maximum loan

			 clause (ii), by striking <quote>$5,000,000</quote> and inserting
			 <quote>$2,000,000</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id79180475B5C44321AD56F7902F726DBB"><enum>(iii)</enum><text>in clause
			 (iii), by striking <quote>$5,500,000</quote> and inserting
			 <quote>$4,000,000</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id18CB6D3D10894FA4B7B6710472FD67DB"><enum>(iv)</enum><text>in clause (iv),
			 by striking <quote>$5,500,000</quote> and inserting <quote>$4,000,000</quote>;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idEAED71BAE48F4787ABEA08EA1A3EFE1B"><enum>(v)</enum><text>in clause (v), by
			 striking <quote>$5,500,000</quote> and inserting
			 <quote>$4,000,000</quote>.</text>
						</clause></subparagraph><subparagraph id="id4C495EC8E6D44ABB93485A1742E39618"><enum>(C)</enum><header>Maximum loan
			 limits under microloan program</header><text display-inline="yes-display-inline">Section 7(m) of the Small Business Act (15
			 U.S.C. 636(m)) is amended—</text>
						<clause id="idC1F1B7A6ED854CCFBA57F702A4483E0E"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(iii), by striking
			 <quote>$50,000</quote> and inserting <quote>$35,000</quote>;</text>
						</clause><clause id="id570946EFE6B74D0487CF985DF95829A2"><enum>(ii)</enum><text>in
			 paragraph (3)(E), by striking <quote>$50,000</quote> each place it appears and
			 inserting <quote>$35,000</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA012C9E10B664B8E825C33D24685EF51"><enum>(iii)</enum><text>in paragraph
			 (11)(B), by striking <quote>$50,000</quote> and inserting
			 <quote>$35,000</quote>.</text>
						</clause></subparagraph><subparagraph id="idB3DBD53F9C134F6899686E76D528B58B"><enum>(D)</enum><header>Low interest
			 refinancing under the local development business loan
			 program</header><text>Section 502(7) of the Small Business Investment Act of
			 1958 (15 U.S.C. 696(7)) is amended—</text>
						<clause id="id5FCBAFF22EF443E3B9681663524EA4E2"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>, including a financing that does not

			 subparagraph (C).</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70CFD0C9377D4B9C9FA14F84D3CB1FA1"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect on
			 January 1, 2011.</text>
