		<official-title>To provide for an exchange of land between the Department
		  of Homeland Security and the South Carolina State Ports
		  Authority.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Former Charleston Naval Base Land
			 Exchange Act of 2009</short-title></quote>.</text>
		</section><section id="idAB89F14EC5914B46ACDA7AE0D12ACD15"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id0F4FDBCE78BF4E0FAA1793C6A4BF938F"><enum>(1)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the parcels
			 consisting of approximately 10.499 acres of land (including improvements) that
			 is owned by the United States, located on the former U.S. Naval Base Complex in
			 North Charleston, South Carolina, and described on the map entitled
			 <quote>Charleston County Assessors Map</quote> as Tax Map Number 400–00–00–004,
			 with the deed recorded in the Charleston County RMC Office on Book X23, at page
			 245.</text>
			</paragraph><paragraph id="idBC0AFA24DBC5497CAC65FF2BFD3D169B"><enum>(2)</enum><header>Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means the 2 parcels
			 of land (including improvements) to be conveyed to the United States under this
			 Act.</text>
			</paragraph><paragraph id="id539AD27544904E83A13F075A6061E105"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>
			</paragraph><paragraph id="idE5EBBBD546B84ACD9419ED4924B9CFDF"><enum>(4)</enum><header>State Ports
			 Authority</header><text>The term <term>State Ports Authority</term> means the
			 South Carolina State Ports Authority, an agency of the State of South
			 Carolina.</text>
			</paragraph></section><section id="id35BA348853184698A123F2E1F977FB57"><enum>3.</enum><header>Land
			 exchange</header><text display-inline="no-display-inline">In exchange for the
			 conveyance to the Secretary of the non-Federal land owned by the State Ports
			 Authority, the Secretary is authorized to convey to the State Ports Authority,
			 by quitclaim deed, all right, title, and interest of the United States in and
			 to the Federal land.</text>
			<subsection id="idBA10AB50B19545B386BDB991C2723D14"><enum>(a)</enum><header>Land exchange
			 required</header><text>If the State Ports Authority offers to convey to the
			 Secretary all right, title, and interest of the State Ports Authority in and to
			 the non-Federal parcels identified in subsection (b)—</text>
				<paragraph id="id95AC1DA94C2B485FB7B873C10B1E4BA1"><enum>(1)</enum><text>the Secretary
			 shall accept the offer; and</text>
				</paragraph><paragraph id="idE65D6218B6694C85A67C458B0E0FC672"><enum>(2)</enum><text>the Secretary
			 shall simultaneously convey to the State Ports Authority all right, title, and
			 interest of the United States in and to approximately 10.499 acres of Federal
			 land.</text>
				</paragraph></subsection><subsection id="id34533761B9FC430FAD3CC3405E397470"><enum>(b)</enum><header>Non-Federal
			 land described</header><text>The non-Federal land (including improvements) to
			 be conveyed under this section consists of—</text>
				<paragraph id="idFD9A7D8F54EC4174A94DDBEFDF4B3242"><enum>(1)</enum><text>the approximately
			 18.736 acres of land that is owned by the State Ports Authority, located on S.
			 Hobson Avenue, and depicted on the map entitled <quote>Charleston Country
			 Assessors Map</quote> as Tax Map Number 400–00–00–051, with the deed recorded
			 in the Charleston County RMC Office in Book EL, at page 280;</text>
				</paragraph><paragraph id="id591FA3B540C6410784F8BA8751D4E86D"><enum>(2)</enum><text>the approximately
			 4.069 acres of land that is owned by the State Ports Authority, located on
			 Juneau Avenue and the Cooper River, and depicted on the map entitled
			 <quote>Charleston County Assessors Map</quote> as a Tax Map Number
			 400–00–00–004, with the deed recorded in the Charleston County RMC Office in
			 Book L09, at page 0391; and</text>
				</paragraph><paragraph id="id3CD893B3675B409DB5E27B7523D143EF"><enum>(3)</enum><text>the approximately
			 2.568 acres of land that is owned by the State Ports Authority, located on
			 Partridge Avenue, and depicted on the map entitled <quote>Charleston County
			 Assessors Map</quote> as Tax Map Number 400–00–00–004, with the deed recorded
			 in the Charleston County RMC Office in Book L09, at page 0391.</text>
				</paragraph></subsection><subsection id="id3A4CC114FA1946B69E99FD082C2D79A0"><enum>(c)</enum><header>Land
			 title</header><text>Title to the non-Federal land conveyed to the Secretary
			 under this section shall—</text>
				<paragraph id="id534F6BB6D3B647ECBBF1F5B92004D0CF"><enum>(1)</enum><text>be acceptable to
			 the Secretary; and</text>
				</paragraph><paragraph id="id55B0C2BAC9754CC8BE41AEB9FFA4BA22"><enum>(2)</enum><text>conform to the
			 title approval standards of the Attorney General of the United States
			 applicable to land acquisitions by the Federal Government.</text>
				</paragraph></subsection></section><section id="idCB3C54DF4C114016B0653C437F037907"><enum>4.</enum><header>Exchange terms
			 and conditions</header>
			<subsection id="id7B2CF84AC6494A67BBEC5E088D6CE1D9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The conveyance of
			 Federal land under section 3 shall be subject to—</text>
				<paragraph id="id908E804D5A9E4D2785C99FE3F9167031"><enum>(1)</enum><text display-inline="yes-display-inline">any valid existing rights; and</text>
				</paragraph><paragraph id="id612B18BBD63A4598A5F1A994ADEFF5EB"><enum>(2)</enum><text display-inline="yes-display-inline">any additional terms and conditions that
			 the Secretary determines to be appropriate to protect the interests of the
			 United States.</text>
				</paragraph></subsection><subsection id="idA931685375204C5AAE9BB909047F6430"><enum>(b)</enum><header>Costs</header><text display-inline="yes-display-inline">The costs of carrying out the exchange of
			 land under section 3 shall be shared equally by the Secretary and the State
			 Ports Authority.</text>
			</subsection><subsection id="idAA97F856A25A4BA48099BB860CB2DEC1"><enum>(c)</enum><header>Equal value
			 exchange</header><text display-inline="yes-display-inline">Notwithstanding the
			 appraised value of the land exchanged under section 3, the values of the
			 Federal and non-Federal land in the land exchange under section 3 shall be
			 considered to be equal.</text>
			</subsection></section><section id="id900D38D7B82E4D5487B7553660F9B2C8"><enum>5.</enum><header>Boundary
			 adjustment</header><text display-inline="no-display-inline">On acceptance of
			 title to the non-Federal land by the Secretary—</text>
			<paragraph id="id17412D60555F481581B41D1D3319305A"><enum>(1)</enum><text display-inline="yes-display-inline">the non-Federal land shall be added to and
			 administered as part of the Federal Law Enforcement Training Center; and</text>
			</paragraph><paragraph id="id90BD0F858501415A9ED9B7C0EF3D899F"><enum>(2)</enum><text display-inline="yes-display-inline">the boundaries of the Federal Law
			 Enforcement Training Center shall be adjusted to exclude the exchanged Federal
			 land.</text>
			</paragraph></section></legis-body>
