			</subsection><subsection id="H158AFE2C227B49EAB5A7DDB7050152D1"><enum>(b)</enum><header>References</header><text display-inline="yes-display-inline">Except as otherwise specified, whenever in
			 this Act an amendment is expressed in terms of an amendment to a section or
			 other provision, the reference shall be considered to be made to a section or
			 other provision of the Public Health Service Act (42 U.S.C. 201 et
			 seq.).</text>
			</subsection></section><section id="HFD4B3C0EAD1F47FD9403DD3904368FAE" section-type="subsequent-section"><enum>2.</enum><header>Reauthorization of HIV
			 health care services program</header>
			<subsection commented="no" id="H66F0B0F053DF4C9FADF6D29363BB82B7"><enum>(a)</enum><header>Elimination of
			 sunset provision</header>
				<paragraph id="HF020CE2BB89248A09E7225DAFCFEA9DD"><enum>(1)</enum><header>In
			 general</header><text>The Ryan White HIV/AIDS Treatment Modernization Act of
			 2006 (Public Law 109–415; 120 Stat. 2767) is amended by striking section
			 703.</text>
				</paragraph><paragraph id="idF8FB1B7B93D04D00B86D8CD36907236E"><enum>(2)</enum><header>Effective
			 date</header><text>Paragraph (1) shall take effect as if enacted on September
			 30, 2009.</text>
				</paragraph><paragraph commented="no" id="HB1DD7DF6BE8F48618A123F319F48BD70"><enum>(3)</enum><header>Contingency
			 provisions</header><text>Notwithstanding section 703 of the Ryan White HIV/AIDS
			 Treatment Modernization Act of 2006 (Public Law 109–415; 120 Stat. 2767) and
			 section 139 of the Continuing Appropriations Resolution, 2010—</text>
					<subparagraph commented="no" id="HF2FA6D43717B44209699CB49FCEC2E98"><enum>(A)</enum><text display-inline="yes-display-inline">the provisions of title XXVI of the Public
			 Health Service Act (42 U.S.C. 300ff et seq.), as in effect on September 30,
			 2009, are hereby revived; and</text>
					</subparagraph><subparagraph commented="no" id="HC14A9F40EF6D4F6E89AF6A1183A409EF"><enum>(B)</enum><text display-inline="yes-display-inline">the amendments made by this Act to title

			 such title as so revived and shall take effect as if enacted on September 30,

				carrying out subsection (b)(1)(C) shall be the same as the schedule applicable
				to grants for early intervention services under part C.</text>

						</clause></subparagraph></paragraph><paragraph id="idFC9B21DDC7034B5C97AB27D9055F7054"><enum>(3)</enum><header>HHS
			 report</header><text>Not later than 6 months after the publication of the
			 Government Accountability Office Report on the Minority Aids Initiative
			 described in section 2686, the Secretary of Health and Human Services shall
			 submit to the appropriate committees of Congress a Departmental plan for using
			 funding under section 2693 of the Public Health Service Act (42 U.S.C.
			 300ff-93) in all relevant agencies to build capacity, taking into consideration
			 the best practices included in such Report.</text>
				</paragraph></subsection><subsection id="idEB8EF4F747DB4E4F9EDC8970A4B46758"><enum>(g)</enum><header>GAO
			 report</header><text>Section 2686 (42 U.S.C. 300ff-86) is amended to read as
			 follows:</text>

					<section id="idEA9A63E023EE49918A926A3C9CD17304"><enum>2686.</enum><header>GAO
				report</header><text display-inline="no-display-inline">The Comptroller General
				of the Government Accountability Office shall, not less than 1 year after the
				date of enactment of the <short-title>Ryan White HIV/AIDS
				Treatment Extension Act of 2009</short-title>, submit to the appropriate
				committees of Congress a report describing Minority AIDS Initiative activities
				across the Department of Health and Human Services, including programs under
				this title and programs at the Centers for Disease Control and Prevention, the
				Substance Abuse and Mental Health Services Administration, and other
				departmental agencies. Such report shall include a history of program
				activities within each relevant agency and a description of activities
				conducted, people served and types of grantees funded, and shall collect and
				describe best practices in community outreach and capacity-building of
				community based organizations serving the communities that are
				disproportionately affected by
				HIV/AIDS.</text>

			 exemption period for names-based reporting</header>

			 adjustment for names-based reporting</header>

				Centers for Disease Control and Prevention to be 3 percent higher than the

				2007, such area was a transitional area;</text>

				was the first year in which the count of living non-AIDS cases of HIV in such
				area, for purposes of this section, was based on a names-based reporting
				system; and</text>

			 grants</header><text>Section 2618(a)(2)(D)(vi) (42 U.S.C.

				which the count of living non-AIDS cases of HIV in such area, for purposes of
				this part, was based on a names-based reporting system; and</text>

				amount of funding that such State received under this part for fiscal year 2007

				estimated number of individuals within the State with HIV/AIDS who do not know
				their status;</text>
						</subparagraph><subparagraph id="HEA95B67C142746978BB57EED8093595B"><enum>(C)</enum><text>describing
				activities undertaken by the State to find the individuals described in
				subparagraph (A) and to make such individuals aware of their status;</text>
						</subparagraph><subparagraph id="H43011102E70B494AB0A310FC520D3D91"><enum>(D)</enum><text>describing the
				manner in which the State will provide undiagnosed individuals who are made
				aware of their status with access to medical treatment for their HIV/AIDS;
				and</text>
						</subparagraph><subparagraph id="H01D0F8A8A6384EB2B205A2DB0FB5D7D0"><enum>(E)</enum><text>describing efforts
				to remove legal barriers, including State laws and regulations, to routine
				testing.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H4AFFA70AA6E640B7BC0A8F9D7731DDF6"><enum>10.</enum><header>ADAP rebate
			 funds</header>
			<subsection commented="no" id="H237FB32B314D4D75A437C4BC666E2B7C"><enum>(a)</enum><header>Use of
			 unobligated funds</header><text>Section 2622(d) (42 U.S.C. 300ff-31a(d)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="yes-display-inline" id="HF37BF51A0B13419CA491EB1E47DF5A59" style="OLC">
					<text>If
			 an expenditure of ADAP rebate funds would trigger a penalty under this section
			 or a higher penalty than would otherwise have applied, the State may request
			 that for purposes of this section, the Secretary deem the State's unobligated
			 balance to be reduced by the amount of rebate funds in the proposed
			 expenditure. Notwithstanding 2618(a)(2)(F), any unobligated amount under
			 section 2618(a)(2)(F)(ii)(V) that is returned to the Secretary for reallocation
			 shall be used by the Secretary for—</text><paragraph commented="no" id="HBB473303691B421299C4EBB03B257D4D"><enum>(1)</enum><text>the ADAP
				supplemental program if the Secretary determines appropriate; or</text>
					</paragraph><paragraph commented="no" id="H414864AD75FD4F55A82205BFF06CF81A"><enum>(2)</enum><text display-inline="yes-display-inline">for additional amounts for grants pursuant
				to section
				2620.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HC80F86E9B34A4810947F6E88C1E4E60F"><enum>(b)</enum><header>Technical
			 correction</header><text>Subclause (V) of section 2618(a)(2)(F)(ii) (42 U.S.C.
			 300ff–28(a)(2)(F)(ii)) is amended by striking <quote>, subject to subclause
			 (VI)</quote>.</text>

			</subsection></section><section id="H220B3467E5FE4389A2B952358D64E522"><enum>12.</enum><header>National
			 HIV/AIDS testing goal</header><text display-inline="no-display-inline">Part E
			 of title XXVI (42 U.S.C. 300ff-81 et seq.) is amended—</text>
			<subsection id="HDB10FD809C77416E97EDC5C1AE9E3D6D"><enum>(a)</enum><text display-inline="yes-display-inline">by redesignating section 2688 as section
			 2689; and</text>
			</subsection><subsection id="H129DDBB64C5545A38F4514C756155091"><enum>(b)</enum><text display-inline="yes-display-inline">by inserting after section 2687 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HFFFAC3DBE84441CAB9C94FAD007F2B0D" style="OLC">
					<section id="HC4038F23BB0047B3AF8DC7075CB81C19"><enum>2688.</enum><header>National
				HIV/AIDS testing goal</header>
						<subsection id="HC73880F1B95648A2A530ED718CD181F9"><enum>(a)</enum><header>In
				general</header><text>Not later than January 1, 2010, the Secretary shall
				establish a national HIV/AIDS testing goal of 5,000,000 tests for HIV/AIDS
				annually through federally-supported HIV/AIDS prevention, treatment, and care
				programs, including programs under this title and other programs administered
				by the Centers for Disease Control and Prevention.</text>
						</subsection><subsection id="HD1FC78CE88FD4E12A012BABB01CC30E0"><enum>(b)</enum><header>Annual
				report</header><text>Not later than January 1, 2011, and annually thereafter,
				the Secretary, acting through the Director of the Centers for Disease Control
				and Prevention, shall submit to Congress a report describing, with regard to
				the preceding 12-month reporting period—</text>
							<paragraph id="H9E74238FAFB74DF1A5DF3157D0DFD867"><enum>(1)</enum><text>whether the
				testing goal described in subsection (a) has been met;</text>
							</paragraph><paragraph id="HE58A19C637374E94AEEDBBA2FC624540"><enum>(2)</enum><text>the total number
				of individuals tested through federally-supported and other HIV/AIDS
				prevention, treatment, and care programs in each State;</text>
							</paragraph><paragraph id="H4733CE09147140888E9D9FAEF2A2F70E"><enum>(3)</enum><text>the number of
				individuals who—</text>
								<subparagraph id="H5E3B01DE0E514251AACBF5147D2C9AAB"><enum>(A)</enum><text>prior to such
				12-month period, were unaware of their HIV status; and</text>
								</subparagraph><subparagraph id="H43ACB0B3A017440CA912E87497669E27"><enum>(B)</enum><text>through
				federally-supported and other HIV/AIDS prevention, treatment, and care
				programs, were diagnosed and referred into treatment and care during such
				period;</text>
								</subparagraph></paragraph><paragraph id="H4036FF6BC5B346E29F2E38145BDEF765"><enum>(4)</enum><text>any barriers,
				including State laws and regulations, that the Secretary determines to be a
				barrier to meeting the testing goal described in subsection (a);</text>
							</paragraph><paragraph id="H78B2ADBEDDA745B99D40F85ADDF83074"><enum>(5)</enum><text>the amount of
				funding the Secretary determines necessary to meet the annual testing goal in
				the following 12 months and the amount of Federal funding expended to meet the
				testing goal in the prior 12-month period; and</text>
							</paragraph><paragraph id="H456DDE2D5C0A45C48549179763FCD08F"><enum>(6)</enum><text>the most
				cost-effective strategies for identifying and diagnosing individuals who were
				unaware of their HIV status, including voluntary testing with pre-test
				counseling, routine screening including opt-out testing, partner counseling and
				referral services, and mass media campaigns.</text>
							</paragraph></subsection><subsection id="HFF271528F0544A0EA07D3E22E48C37FD"><enum>(c)</enum><header>Review of
				program effectiveness</header><text>Not later than 1 year after the date of
				enactment of this section, the Secretary, in consultation with the Director of
				the Centers for Disease Control and Prevention, shall submit a report to
				Congress based on a comprehensive review of each of the programs and activities
				conducted by the Centers for Disease Control and Prevention as part of the
				Domestic HIV/AIDS Prevention Activities, including the following:</text>
							<paragraph id="H0267293CD0D4462B98E6529E983B367B"><enum>(1)</enum><text>The amount of
				funding provided for each program or activity.</text>
							</paragraph><paragraph id="HC0BAED3A73A54316AD4A49B4AF07D5F3"><enum>(2)</enum><text>The primary
				purpose of each program or activity.</text>
							</paragraph><paragraph id="HC920A4829AC24BDB9EBB5F16AF9FEC82"><enum>(3)</enum><text>The annual goals
				for each program or activity.</text>
							</paragraph><paragraph id="HF7B3A3E62AC04041B99A061C6B23D792"><enum>(4)</enum><text>The relative
				effectiveness of each program or activity with relation to the other programs
				and activities conducted by the Centers for Disease Control and Prevention,
				based on the—</text>
								<subparagraph id="H3E2CF2065DE9435DB7AB9786726F778F"><enum>(A)</enum><text>number of
				previously undiagnosed individuals with HIV/AIDS made aware of their status and
				referred into the appropriate treatment;</text>
								</subparagraph><subparagraph id="H5F97640F0C494C129AD85A65F8D7AA27"><enum>(B)</enum><text>amount of funding
				provided for each program or activity compared to the number of undiagnosed
				individuals with HIV/AIDS made aware of their status;</text>
								</subparagraph><subparagraph id="HDFEC1C4AF59B405C97E039162F3AD47F"><enum>(C)</enum><text>program’s
				contribution to the National HIV/AIDS testing goal; and</text>
								</subparagraph><subparagraph id="H1DBA1EF91E924BB6BFC6659444B8BA80"><enum>(D)</enum><text>progress made
				toward the goals described in paragraph (3).</text>
								</subparagraph></paragraph><paragraph id="HE292E90219624B63A6421888997F10DB"><enum>(5)</enum><text>Recommendations if
				any to Congress on ways to allocate funding for domestic HIV/AIDS prevention
				activities and programs in order to achieve the National HIV/AIDS testing
				goal.</text>
							</paragraph></subsection><subsection id="HA3739CEB57484E8CB1D0E26171EC1A57"><enum>(d)</enum><header>Coordination
				with other Federal activities</header><text>In pursuing the National HIV/AIDS
				testing goal, the Secretary, where appropriate, shall consider and coordinate
				with other national strategies conducted by the Federal Government to address
				HIV/AIDS.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HFF09F4ABBBE34BC5848389AB73F8F8FC"><enum>13.</enum><header>Notification of
			 possible exposure to infectious diseases</header><text display-inline="no-display-inline">Title XXVI (42 U.S.C. 300ff-11 et seq.) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H897DD58F265D470F93D5EFD699A80020" style="OLC">
				<part id="HCF0C944DB3984343AFB1A80AF4E99A58"><enum>G</enum><header>Notification of
				possible exposure to infectious diseases</header>
					<section id="HBA92DBF3CA1844DCA91C81F6C9965B2A"><enum>2695.</enum><header>Infectious
				diseases and circumstances relevant to notification requirements</header>
						<subsection id="H0BEE580723214CFC9F71F895D857EDAE"><enum>(a)</enum><header>In
				general</header><text>Not later than 180 days after the date of the enactment
				of this part, the Secretary shall complete the development of—</text>
							<paragraph id="H45776182816649A1A4D2DCA16E045A1F"><enum>(1)</enum><text>a list of
				potentially life-threatening infectious diseases, including emerging infectious
				diseases, to which emergency response employees may be exposed in responding to
				emergencies;</text>
							</paragraph><paragraph id="H77DDFBE1127F4514AF9641CE56BBF14D"><enum>(2)</enum><text>guidelines
				describing the circumstances in which such employees may be exposed to such
				diseases, taking into account the conditions under which emergency response is
				provided; and</text>
							</paragraph><paragraph id="H1FF990E90B234C3F895D7E92121AC27B"><enum>(3)</enum><text>guidelines
				describing the manner in which medical facilities should make determinations
				for purposes of section 2695B(d).</text>
							</paragraph></subsection><subsection id="H1F4DD1FDD33446019C8AF77AC8B7EB63"><enum>(b)</enum><header>Specification of
				airborne infectious diseases</header><text>The list developed by the Secretary
				under subsection (a)(1) shall include a specification of those infectious
				diseases on the list that are routinely transmitted through airborne or
				aerosolized means.</text>
						</subsection><subsection id="HFF24EC6937AA4C708218C2A738C92858"><enum>(c)</enum><header>Dissemination</header><text>The
				Secretary shall—</text>
							<paragraph id="H9165F359A36B493DAA16A5075C435C3D"><enum>(1)</enum><text>transmit to State
				public health officers copies of the list and guidelines developed by the
				Secretary under subsection (a) with the request that the officers disseminate
				such copies as appropriate throughout the States; and</text>
							</paragraph><paragraph id="HC8DAED68BB234FDE82A02628F35A5F28"><enum>(2)</enum><text>make such copies
				available to the public.</text>
							</paragraph></subsection></section><section id="H46490F15323E47FA8CEE74AE2BFA1E74"><enum>2695A.</enum><header>Routine
				notifications with respect to airborne infectious diseases in victims
				assisted</header>
						<subsection id="H85028EEFA83F4945B2299F493C689D01"><enum>(a)</enum><header>Routine
				notification of designated officer</header>
							<paragraph id="HEB97EC13B35846DBBD89F6A6AF1A2746"><enum>(1)</enum><header>Determination by
				treating facility</header><text>If a victim of an emergency is transported by
				emergency response employees to a medical facility and the medical facility
				makes a determination that the victim has an airborne infectious disease, the
				medical facility shall notify the designated officer of the emergency response
				employees who transported the victim to the medical facility of the
				determination.</text>
							</paragraph><paragraph id="H4995AAD3570F4A9581CD3F5BE44AD3E0"><enum>(2)</enum><header>Determination by
				facility ascertaining cause of death</header><text>If a victim of an emergency
				is transported by emergency response employees to a medical facility and the
				victim dies at or before reaching the medical facility, the medical facility
				ascertaining the cause of death shall notify the designated officer of the
				emergency response employees who transported the victim to the initial medical
				facility of any determination by the medical facility that the victim had an
				airborne infectious disease.</text>
							</paragraph></subsection><subsection id="HD1B1E2B8AAB64D9182F22F16A9FB4DE8"><enum>(b)</enum><header>Requirement of
				prompt notification</header><text>With respect to a determination described in
				paragraph (1) or (2) of subsection (a), the notification required in each of
				such paragraphs shall be made as soon as is practicable, but not later than 48
				hours after the determination is made.</text>
						</subsection></section><section id="H0539FD4EBE174F52B2640BFE918909D2"><enum>2695B.</enum><header>Request for
				notification with respect to victims assisted</header>
						<subsection id="HBEB3C854C785423EA3EE727C4101488F"><enum>(a)</enum><header>Initiation of
				process by employee</header><text>If an emergency response employee believes
				that the employee may have been exposed to an infectious disease by a victim of
				an emergency who was transported to a medical facility as a result of the
				emergency, and if the employee attended, treated, assisted, or transported the
				victim pursuant to the emergency, then the designated officer of the employee
				shall, upon the request of the employee, carry out the duties described in
				subsection (b) regarding a determination of whether the employee may have been
				exposed to an infectious disease by the victim.</text>
						</subsection><subsection id="HF8EB3DD73E71403E9A8B474EBCFA0B09"><enum>(b)</enum><header>Initial
				determination by designated officer</header><text>The duties referred to in
				subsection (a) are that—</text>
							<paragraph id="HE7CCD1A79A9A4FA494C113217F973BA1"><enum>(1)</enum><text>the designated
				officer involved collect the facts relating to the circumstances under which,
				for purposes of subsection (a), the employee involved may have been exposed to
				an infectious disease; and</text>
							</paragraph><paragraph id="HC84513FF43904F108A59D63EBA3EE9FD"><enum>(2)</enum><text>the designated
				officer evaluate such facts and make a determination of whether, if the victim
				involved had any infectious disease included on the list issued under paragraph
				(1) of section 2695(a), the employee would have been exposed to the disease
				under such facts, as indicated by the guidelines issued under paragraph (2) of
				such section.</text>
							</paragraph></subsection><subsection id="H29AF8626CE6E40C7A9462EB3CC7C8FDD"><enum>(c)</enum><header>Submission of
				request to medical facility</header>
							<paragraph id="H66A07FD5597E40939179C717B6B24BC3"><enum>(1)</enum><header>In
				general</header><text>If a designated officer makes a determination under
				subsection (b)(2) that an emergency response employee may have been exposed to
				an infectious disease, the designated officer shall submit to the medical
				facility to which the victim involved was transported a request for a response
				under subsection (d) regarding the victim of the emergency involved.</text>
							</paragraph><paragraph id="HDC60F09A0E374E0E8B1D0C274AA3763F"><enum>(2)</enum><header>Form of
				request</header><text>A request under paragraph (1) shall be in writing and be
				signed by the designated officer involved, and shall contain a statement of the
				facts collected pursuant to subsection (b)(1).</text>
							</paragraph></subsection><subsection id="HE3CC20663554452ABCF2D402BB7A1F8B"><enum>(d)</enum><header>Evaluation and
				response regarding request to medical facility</header>
							<paragraph id="H5B73FA64931F47F99592412B93687A1D"><enum>(1)</enum><header>In
				general</header><text>If a medical facility receives a request under subsection
				(c), the medical facility shall evaluate the facts submitted in the request and
				make a determination of whether, on the basis of the medical information
				possessed by the facility regarding the victim involved, the emergency response
				employee was exposed to an infectious disease included on the list issued under
				paragraph (1) of section 2695(a), as indicated by the guidelines issued under
				paragraph (2) of such section.</text>
							</paragraph><paragraph id="HEBB2E2E3936143889008D52508E49A36"><enum>(2)</enum><header>Notification of
				exposure</header><text>If a medical facility makes a determination under
				paragraph (1) that the emergency response employee involved has been exposed to
				an infectious disease, the medical facility shall, in writing, notify the
				designated officer who submitted the request under subsection (c) of the
				determination.</text>
							</paragraph><paragraph id="H7B3E4C3F39D4470184FD58668BE5927E"><enum>(3)</enum><header>Finding of no
				exposure</header><text>If a medical facility makes a determination under
				paragraph (1) that the emergency response employee involved has not been
				exposed to an infectious disease, the medical facility shall, in writing,
				inform the designated officer who submitted the request under subsection (c) of
				the determination.</text>
							</paragraph><paragraph id="H652BA1340D1C491B8F2857DFF6ECDFE2"><enum>(4)</enum><header>Insufficient
				information</header>
								<subparagraph id="H28A8FEF1BC82445BA9B6E23A4CF7A08F"><enum>(A)</enum><text>If a medical
				facility finds in evaluating facts for purposes of paragraph (1) that the facts
				are insufficient to make the determination described in such paragraph, the
				medical facility shall, in writing, inform the designated officer who submitted
				the request under subsection (c) of the insufficiency of the facts.</text>
								</subparagraph><subparagraph id="HD7FA1B5B45954C2AB8C8470C447A0096"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id6EA33BA7580B4F4184F65EBA79E85F2B"><enum>(i)</enum><text>If a medical facility
				finds in making a determination under paragraph (1) that the facility possesses
				no information on whether the victim involved has an infectious disease
				included on the list under section 2695(a), the medical facility shall, in
				writing, inform the designated officer who submitted the request under
				subsection (c) of the insufficiency of such medical information.</text>
									</clause><clause id="id292B78ACB64B4CAB8C50B2E7BB0DF8EA" indent="up1"><enum>(ii)</enum><text>If after making a response under
				clause (i) a medical facility determines that the victim involved has an
				infectious disease, the medical facility shall make the determination described
				in paragraph (1) and provide the applicable response specified in this
				subsection.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HE58E60E83CF245A18C06E779B93493A6"><enum>(e)</enum><header>Time for making
				response</header><text>After receiving a request under subsection (c)
				(including any such request resubmitted under subsection (g)(2)), a medical
				facility shall make the applicable response specified in subsection (d) as soon
				as is practicable, but not later than 48 hours after receiving the
				request.</text>
						</subsection><subsection id="H06326154D2B144E6BC8B5320AC63C07C"><enum>(f)</enum><header>Death of victim
				of emergency</header>
							<paragraph id="HF012C897BFEB48669545ADBAE9C43E1C"><enum>(1)</enum><header>Facility
				ascertaining cause of death</header><text>If a victim described in subsection
				(a) dies at or before reaching the medical facility involved, and the medical
				facility receives a request under subsection (c), the medical facility shall
				provide a copy of the request to the medical facility ascertaining the cause of
				death of the victim, if such facility is a different medical facility than the
				facility that received the original request.</text>
							</paragraph><paragraph id="H030C0CD5DCB54E649916A076EF098812"><enum>(2)</enum><header>Responsibility
				of facility</header><text>Upon the receipt of a copy of a request for purposes
				of paragraph (1), the duties otherwise established in this subpart regarding
				medical facilities shall apply to the medical facility ascertaining the cause
				of death of the victim in the same manner and to the same extent as such duties
				apply to the medical facility originally receiving the request.</text>
							</paragraph></subsection><subsection id="H20C46865750E4BA4BD16AB4AB0A4BF39"><enum>(g)</enum><header>Assistance of
				public health officer</header>
							<paragraph id="H44FAA453E24B478AB43D25EE5CF7D4EF"><enum>(1)</enum><header>Evaluation of
				response of medical facility regarding insufficient facts</header>
								<subparagraph id="H02D9533811BA44ECB72C23C7967093A7"><enum>(A)</enum><text>In the case of a
				request under subsection (c) to which a medical facility has made the response
				specified in subsection (d)(4)(A) regarding the insufficiency of facts, the
				public health officer for the community in which the medical facility is
				located shall evaluate the request and the response, if the designated officer
				involved submits such documents to the officer with the request that the
				officer make such an evaluation.</text>
								</subparagraph><subparagraph id="H53D208AE3E604860905E4FD91DD1AFEF"><enum>(B)</enum><text>As soon as is
				practicable after a public health officer receives a request under subparagraph
				(A), but not later than 48 hours after receipt of the request, the public
				health officer shall complete the evaluation required in such paragraph and
				inform the designated officer of the results of the evaluation.</text>
								</subparagraph></paragraph><paragraph id="HBAA9A3E8AF3E479DAEB31642F042E195"><enum>(2)</enum><header>Findings of
				evaluation</header>
								<subparagraph id="H9BA182C8A0DA4E83AFA7F0D0F8BC6D8B"><enum>(A)</enum><text>If an evaluation
				under paragraph (1)(A) indicates that the facts provided to the medical
				facility pursuant to subsection (c) were sufficient for purposes of
				determinations under subsection (d)(1)—</text>
									<clause id="H392194C1A0BA4B00A8533F0B61108BF9"><enum>(i)</enum><text>the public health
				officer shall, on behalf of the designated officer involved, resubmit the
				request to the medical facility; and</text>
									</clause><clause id="HA798BB3653474C0E82B87138CB0CDB7A"><enum>(ii)</enum><text>the medical
				facility shall provide to the designated officer the applicable response
				specified in subsection (d).</text>
									</clause></subparagraph><subparagraph id="H2A29C83A55B245A9A323EA26E24C2EB8"><enum>(B)</enum><text>If an evaluation
				under paragraph (1)(A) indicates that the facts provided in the request to the
				medical facility were insufficient for purposes of determinations specified in
				subsection (c)—</text>
									<clause id="H4DAF0963ED30400696F18BA1B5EB3577"><enum>(i)</enum><text>the public health
				officer shall provide advice to the designated officer regarding the collection
				and description of appropriate facts; and</text>
									</clause><clause id="H9FCFF6C4FAD64FC8BA18A7779716A744"><enum>(ii)</enum><text>if sufficient
				facts are obtained by the designated officer—</text>
										<subclause id="H09B59540FD944C0DB918CCBD436E81CD"><enum>(I)</enum><text>the public health
				officer shall, on behalf of the designated officer involved, resubmit the
				request to the medical facility; and</text>
										</subclause><subclause id="H0C450C286138422DA8748666727354C3"><enum>(II)</enum><text>the medical
				facility shall provide to the designated officer the appropriate response under
				subsection (c).</text>
										</subclause></clause></subparagraph></paragraph></subsection></section><section id="HF2B31421FE6C486991F0C314065DF38D"><enum>2695C.</enum><header>Procedures
				for notification of exposure</header>
						<subsection id="HE9D368BDC3C44502B2113F0795179623"><enum>(a)</enum><header>Contents of
				notification to officer</header><text>In making a notification required under
				section 2695A or section 2695B(d)(2), a medical facility shall provide—</text>
							<paragraph id="H5FA3BB89820047AABF273D1EC63C2AAF"><enum>(1)</enum><text>the name of the
				infectious disease involved; and</text>
							</paragraph><paragraph id="HF4C85F2390864288B2DF99183FFA6857"><enum>(2)</enum><text>the date on which
				the victim of the emergency involved was transported by emergency response
				employees to the medical facility involved.</text>
							</paragraph></subsection><subsection id="H4F8A86A162294F00B7811F18CE39C178"><enum>(b)</enum><header>Manner of
				notification</header><text>If a notification under section 2695A or section
				2695B(d)(2) is mailed or otherwise indirectly made—</text>
							<paragraph id="HFF93A22CB3294A34A014858D50457348"><enum>(1)</enum><text>the medical
				facility sending the notification shall, upon sending the notification, inform
				the designated officer to whom the notification is sent of the fact that the
				notification has been sent; and</text>
							</paragraph><paragraph id="H83321A42851541A1BC6D96C93748101E"><enum>(2)</enum><text>such designated
				officer shall, not later than 10 days after being informed by the medical
				facility that the notification has been sent, inform such medical facility
				whether the designated officer has received the notification.</text>
							</paragraph></subsection></section><section id="H17E956110AC149E68A1DE826C15AB76F"><enum>2695D.</enum><header>Notification
				of employee</header>
						<subsection id="H5804C7CE52D048539E4AE76C1254C7A0"><enum>(a)</enum><header>In
				general</header><text>After receiving a notification for purposes of section
				2695A or 2695B(d)(2), a designated officer of emergency response employees
				shall, to the extent practicable, immediately notify each of such employees
				who—</text>
							<paragraph id="HE002811549174772A99D31EC0D6FDF4D"><enum>(1)</enum><text>responded to the
				emergency involved; and</text>
							</paragraph><paragraph id="HEC223B561D99456A84C78AEBC1C7DAFD"><enum>(2)</enum><text>as indicated by
				guidelines developed by the Secretary, may have been exposed to an infectious
				disease.</text>
							</paragraph></subsection><subsection id="HE4DB4FEA8D404A99A43FF438B717AF9F"><enum>(b)</enum><header>Certain contents
				of notification to employee</header><text>A notification under this subsection
				to an emergency response employee shall inform the employee of—</text>
							<paragraph id="H2478B47B112544B5BCE4AC4558DFEFFA"><enum>(1)</enum><text>the fact that the
				employee may have been exposed to an infectious disease and the name of the
				disease involved;</text>
							</paragraph><paragraph id="H34C209AFA3D24B4B82AECE9775B79EB9"><enum>(2)</enum><text>any action by the
				employee that, as indicated by guidelines developed by the Secretary, is
				medically appropriate; and</text>
							</paragraph><paragraph id="H1ABF54FACA1A4D59A9A746FC3777A8F9"><enum>(3)</enum><text>if medically
				appropriate under such criteria, the date of such emergency.</text>
							</paragraph></subsection><subsection id="H5343B95DCB854E7997DDE7924E67CD1D"><enum>(c)</enum><header>Responses other
				than notification of exposure</header><text>After receiving a response under
				paragraph (3) or (4) of subsection (d) of section 2695B, or a response under
				subsection (g)(1) of such section, the designated officer for the employee
				shall, to the extent practicable, immediately inform the employee of the
				response.</text>
						</subsection></section><section id="HBFAAE88DB69F49468588F79F275E1642"><enum>2695E.</enum><header>Selection of
				designated officers</header>
						<subsection id="H16FCF65F1CE74764B93679CE9FC2EA1B"><enum>(a)</enum><header>In
				general</header><text>For the purposes of receiving notifications and responses
				and making requests under this subpart on behalf of emergency response
				employees, the public health officer of each State shall designate 1 official
				or officer of each employer of emergency response employees in the
				State.</text>
						</subsection><subsection id="H03D2FA7AA2224596A12C06C97F1917BE"><enum>(b)</enum><header>Preference in
				making designations</header><text>In making the designations required in
				subsection (a), a public health officer shall give preference to individuals
				who are trained in the provision of health care or in the control of infectious
				diseases.</text>
						</subsection></section><section id="H1E273A377A55491D91AF8C9DBEEE66AD"><enum>2695F.</enum><header>Limitation
				with respect to duties of medical facilities</header><text display-inline="no-display-inline">The duties established in this subpart for a
				medical facility—</text>
						<paragraph id="H991469D2B4A44A8C82D456F7A0F5565C"><enum>(1)</enum><text>shall apply only
				to medical information possessed by the facility during the period in which the
				facility is treating the victim for conditions arising from the emergency, or
				during the 60-day period beginning on the date on which the victim is
				transported by emergency response employees to the facility, whichever period
				expires first; and</text>
						</paragraph><paragraph id="HA9DFF14F50AC420D8D1AC104663FA77F"><enum>(2)</enum><text>shall not apply to
				any extent after the expiration of the 30-day period beginning on the
				expiration of the applicable period referred to in paragraph (1), except that
				such duties shall apply with respect to any request under section 2695B(c)
				received by a medical facility before the expiration of such 30-day
				period.</text>
						</paragraph></section><section id="HED11F4B0224944A6BC5409C03AD6DF6E"><enum>2695G.</enum><header>Miscellaneous
				provisions</header>
						<subsection id="H4B5FE644A84A47AF94AC513CE454819E"><enum>(a)</enum><header>Liability of
				medical facilities, designated officers, and public health
				officers</header><text>This subpart may not be construed to authorize any cause
				of action for damages or any civil penalty against any medical facility, any
				designated officer, or any other public health officer for failure to comply
				with the duties established in this subpart.</text>
						</subsection><subsection id="HC130097775064288B09537E3F31E31C0"><enum>(b)</enum><header>Testing</header><text>This
				subpart may not, with respect to victims of emergencies, be construed to
				authorize or require a medical facility to test any such victim for any
				infectious disease.</text>
						</subsection><subsection id="HE58722719A4C464F9FD3C30157D47282"><enum>(c)</enum><header>Confidentiality</header><text>This
				subpart may not be construed to authorize or require any medical facility, any
				designated officer of emergency response employees, or any such employee, to
				disclose identifying information with respect to a victim of an emergency or
				with respect to an emergency response employee.</text>
						</subsection><subsection id="H18C54D9730FE4D7B8EFC02D4E0087CBD"><enum>(d)</enum><header>Failure to
				provide emergency services</header><text>This subpart may not be construed to
				authorize any emergency response employee to fail to respond, or to deny
				services, to any victim of an emergency.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID200974C49A6246118D60503B46BDE270"><enum>(e)</enum><header display-inline="yes-display-inline">Notification and reporting
				deadlines</header><text display-inline="yes-display-inline">In any case in
				which the Secretary determines that, wholly or partially as a result of a
				public health emergency that has been determined pursuant to section 319(a),
				individuals or public or private entities are unable to comply with the
				requirements of this part, the Secretary may, notwithstanding any other
				provision of law, temporarily suspend, in whole or in part, the requirements of
				this part as the circumstances reasonably require. Before or promptly after
				such a suspension, the Secretary shall notify the Congress of such action and
				publish in the Federal Register a notice of the suspension.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idEC91F794CF9D468C9CFFB7C043928773"><enum>(f)</enum><header>Continued
				application of State and local law</header><text display-inline="yes-display-inline">Nothing in this part shall be construed to
				limit the application of State or local laws that require the provision of data
				to public health authorities.</text>
						</subsection></section><section id="HC9BD09050A6E4D779537232C8053FBC5"><enum>2695H.</enum><header>Injunctions
				regarding violation of prohibition</header>
						<subsection id="H84DE1FA3531D4CD897A8C65BC2E98EA2"><enum>(a)</enum><header>In
				general</header><text>The Secretary may, in any court of competent
				jurisdiction, commence a civil action for the purpose of obtaining temporary or
				permanent injunctive relief with respect to any violation of this
				subpart.</text>
						</subsection><subsection id="H8EB516F2DFC1419FBC1AA613950DE787"><enum>(b)</enum><header>Facilitation of
				information on violations</header><text>The Secretary shall establish an
				administrative process for encouraging emergency response employees to provide
				information to the Secretary regarding violations of this subpart. As
				appropriate, the Secretary shall investigate alleged such violations and seek
				appropriate injunctive relief.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="HB9398FF063754F2EB65619F6FB4B8212" section-type="subsequent-section"><enum>2695I.</enum><header>Applicability of
				subpart</header><text display-inline="no-display-inline">This subpart shall not
				apply in a State if the chief executive officer of the State certifies to the
				Secretary that the law of the State is substantially consistent with this
				subpart.</text>
