		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fair Sentencing Act of
			 2009</short-title></quote>.</text>
		</section><section id="ID9376af43f3f544f99272a1cbd7f080b5"><enum>2.</enum><header>Cocaine
			 sentencing disparity elimination</header>
			<subsection id="IDb0b0c4def51b427686b2b3d7df199273"><enum>(a)</enum><header>CSA</header><text>Section
			 401(b)(1) of the Controlled Substances Act (21 U.S.C. 841(b)(1)) is
			 amended—</text>
				<paragraph id="ID474791e62b5845b0ac6e9bf5052a5107"><enum>(1)</enum><text>in subparagraph
			 (A)(iii), by striking <quote>50 grams</quote> and inserting <quote>5
			 kilograms</quote>; and</text>
				</paragraph><paragraph id="ID2e669330d9964c52939fd97626461283"><enum>(2)</enum><text>in subparagraph
			 (B)(iii), by striking <quote>5 grams</quote> and inserting <quote>500
			 grams</quote>.</text>
				</paragraph></subsection><subsection id="IDfb9e0223784d49178e37fc0ab42631ed"><enum>(b)</enum><header>Import and
			 Export Act</header><text>Section 1010(b) of the Controlled Substances Import
			 and Export Act (21 U.S.C. 960(b)) is amended—</text>
				<paragraph id="IDf16d3a1a10604b8db74daa3d71002267"><enum>(1)</enum><text>in paragraph
			 (1)(C), by striking <quote>50 grams</quote> and inserting <quote>5
			 kilograms</quote>; and</text>
				</paragraph><paragraph id="IDf1bf4548d7104547917b59ebf24f41e6"><enum>(2)</enum><text>in paragraph
			 (2)(C), by striking <quote>5 grams</quote> and inserting <quote>500
			 grams</quote>.</text>
				</paragraph></subsection></section><section id="IDb58b8a5599ba46b48c93961afbefdb34"><enum>3.</enum><header>Elimination of
			 mandatory minimum sentence for simple possession</header><text display-inline="no-display-inline">Section 404(a) of the Controlled Substances
			 Act (21 U.S.C. 844(a)) is amended by striking the sentence beginning
			 <quote>Notwithstanding the preceding sentence,</quote>.</text>
		</section><section id="IDd6098593bbe0419a9092d2fbdee24e86"><enum>4.</enum><header>Increased
			 penalties for major drug traffickers</header>
			<subsection id="ID978ddcdd20c74ce2978d1a104cbd7f8b"><enum>(a)</enum><header>Increased
			 penalties for manufacture, distribution, dispensation, or possession with
			 intent To manufacture, distribute, or dispense</header><text>Section 401(b)(1)
			 of the Controlled Substances Act (21 U.S.C. 841(b)) is amended—</text>
				<paragraph id="ID21293cf101884de1bfb32f4b2ec132c4"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>$4,000,000</quote>, <quote>$10,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$20,000,000</quote> and inserting
			 <quote>$10,000,000</quote>, <quote>$50,000,000</quote>,
			 <quote>$20,000,000</quote>, and <quote>$75,000,000</quote>, respectively;
			 and</text>
				</paragraph><paragraph id="IDe4095223d8d14505afd728491d2f1027"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>$2,000,000</quote>, <quote>$5,000,000</quote>,
			 <quote>$4,000,000</quote>, and <quote>$10,000,000</quote> and inserting
			 <quote>$5,000,000</quote>, <quote>$25,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$50,000,000</quote>, respectively.</text>
				</paragraph></subsection><subsection id="ID808c3dde98c94ce59bd021b0b85ab278"><enum>(b)</enum><header>Increased
			 penalties for importation and exportation</header><text>Section 1010(b) of the
			 Controlled Substances Import and Export Act (21 U.S.C. 960(b)) is
			 amended—</text>
				<paragraph id="IDa8aff741184f4690b389e3cecd33d2b6"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>$4,000,000</quote>, <quote>$10,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$20,000,000</quote> and inserting
			 <quote>$10,000,000</quote>, <quote>$50,000,000</quote>,
			 <quote>$20,000,000</quote>, and <quote>$75,000,000</quote>, respectively,
			 and</text>
				</paragraph><paragraph id="ID4341f037ab35483a807044314d74cf58"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>$2,000,000</quote>, <quote>$5,000,000</quote>,
			 <quote>$4,000,000</quote>, and <quote>$10,000,000</quote> and inserting
			 <quote>$5,000,000</quote>, <quote>$25,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$50,000,000</quote>, respectively.</text>
				</paragraph></subsection></section><section id="IDd7f3b89403a144d589dbbc9f6e6a8b5e"><enum>5.</enum><header>Enhancements for
			 acts of violence during the course of a drug trafficking offense</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and, if appropriate, amend the sentencing guidelines to ensure that the
			 penalties for an offense involving trafficking of a controlled substance
			 provide tiered enhancements for the involvement of a dangerous weapon or
			 violence, including, if appropriate—</text>
			<paragraph id="ID548a20e8b8874696a650a58d936fd537"><enum>(1)</enum><text>an enhancement
			 for the use or brandishing of a firearm or other dangerous weapon;</text>
			</paragraph><paragraph id="ID335118c8a92140b3a4baf490c067ff30"><enum>(2)</enum><text>an enhancement
			 for the use, or threatened use, of violence; and</text>
			</paragraph><paragraph id="IDc3d7d34a04864d11b4780555f8cf391f"><enum>(3)</enum><text>any other
			 enhancement in this respect that the Commission considers necessary.</text>
			</paragraph></section><section id="ID9c6f95769f06485cbfbee280b78e9596"><enum>6.</enum><header>Increased
			 emphasis on defendant’s role and certain aggravating factors</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and, if appropriate, amend the sentencing guidelines to ensure that the
			 penalties for an offense involving trafficking of a controlled substance
			 adequately take into account the culpability of the defendant and the role of
			 the defendant in the offense, including consideration of whether enhancements
			 should be added, or existing enhancements should be increased, for the
			 following aggravating factors associated with the offense:</text>
			<paragraph id="ID665a87d345bb4495a07da09aa0657e24"><enum>(1)</enum><text>The defendant
			 committed the offense as part of a pattern of criminal conduct engaged in as a
			 livelihood.</text>
			</paragraph><paragraph id="IDe9b61d69c1714bc4a310fa4e546e0fd1"><enum>(2)</enum><text>The defendant is
			 an organizer, manager, supervisor, or leader of drug trafficking
			 activities.</text>
			</paragraph><paragraph id="ID35c6a16541014ebf8c508fa806312051"><enum>(3)</enum><text>The defendant
			 maintained an establishment for the manufacture or distribution of the
			 controlled substance.</text>
			</paragraph><paragraph id="ID5a21127f5b4c42d48f7e3e5f356eac13"><enum>(4)</enum><text>The defendant
			 distributed a controlled substance to an individual under the age of 21 years
			 or over the age of 64 years, or to a pregnant individual.</text>
			</paragraph><paragraph id="ID0682fb387b604f3ba223c2707016248a"><enum>(5)</enum><text>The defendant
			 involved an individual under the age of 21 years or over the age of 64 years,
			 or a pregnant individual, in the offense.</text>
			</paragraph><paragraph id="IDbb33a1f82ac24b8a8c68c140a484783f"><enum>(6)</enum><text>The defendant
			 distributed a controlled substance to an individual who was unusually
			 vulnerable due to physical or mental condition, or who was particularly
			 susceptible to criminal conduct.</text>
			</paragraph><paragraph id="IDedef96f212bd40a18e499920156dbfcb"><enum>(7)</enum><text>The defendant
			 involved an individual who was unusually vulnerable due to physical or mental
			 condition, or who was particularly susceptible to criminal conduct.</text>
			</paragraph><paragraph id="IDb4e5b56d2b9a4c779003a77bf05083f2"><enum>(8)</enum><text>The defendant
			 used threats, coercion, or intimidation to involve an individual in the
			 offense.</text>
			</paragraph><paragraph id="IDe44fd67b873542c7a6f7f1af0d7ce6d7"><enum>(9)</enum><text>The defendant
			 manufactured or distributed the controlled substance in a location described in
			 section 416(a) or section 419(a) of the Controlled Substances Act (21 U.S.C.
			 856(a) or 860(a)).</text>
			</paragraph><paragraph id="IDa58f99b0618449ff9c5263724c3f1389"><enum>(10)</enum><text>The defendant
			 bribed, or attempted to bribe, a Federal, State, or local law enforcement
			 officer in connection with the offense.</text>
			</paragraph><paragraph id="IDad194b0108f1428eb546b5d2f63f8412"><enum>(11)</enum><text>The defendant
			 was involved in importation into the United States of a controlled
			 substance.</text>
			</paragraph><paragraph id="IDbf5a714f2b0148a7846f0206480df4aa"><enum>(12)</enum><text>Bodily injury or
			 death occurred in connection with the offense.</text>
			</paragraph><paragraph id="ID7087fa05aed943d6b6d7e3d4049db47a"><enum>(13)</enum><text>The defendant
			 used another person to purchase, sell, transport, or store controlled
			 substances and used impulse, fear, friendship, affection, or some combination
			 thereof to involve such person in the offense when such person had a minimum
			 knowledge of the illegal enterprise and was to receive little or no
			 compensation from the illegal transaction.</text>
			</paragraph><paragraph id="ID7c3731cc90ad4815a225fcb18d66be34"><enum>(14)</enum><text>The defendant
			 engaged in witness intimidation, tampered, or destroyed evidence, or otherwise
			 obstructed justice in conjunction with the investigation or prosecution of the
			 offense.</text>
			</paragraph><paragraph id="IDb663349b9b0d45a7898807563bbbe738"><enum>(15)</enum><text>Any other factor
			 the Commission considers necessary.</text>
			</paragraph></section><section id="ID30c783070cc34794ad8c4ae992a74f7b"><enum>7.</enum><header>Increased
			 emphasis on certain mitigating factors</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and, if appropriate, amend the sentencing guidelines to ensure that the
			 penalties for an offense involving trafficking of a controlled substance
			 adequately take into account mitigating factors associated with the offense,
			 including—</text>
			<paragraph id="ID36ccb3ea9e8d46e0b7e96065061f0909"><enum>(1)</enum><text>whether the
			 defendant had minimum knowledge of the illegal enterprise;</text>
			</paragraph><paragraph id="ID85e38c55a3f945beb38e4a4ec7c8fd18"><enum>(2)</enum><text>whether the
			 defendant received little or no compensation in connection with the
			 offense;</text>
			</paragraph><paragraph id="IDd0715496b7c94c2cbd81fbec0e144d79"><enum>(3)</enum><text>whether the
			 defendant acted on impulse, fear, friendship, or affection when the defendant
			 was otherwise unlikely to commit such an offense; and</text>
			</paragraph><paragraph id="IDe41b4e7254c14d4a8ff4117f33310f86"><enum>(4)</enum><text>whether any
			 maximum base offense level should be established for a defendant who qualifies
			 for a mitigating role adjustment.</text>
			</paragraph></section><section id="IDadf2a1eb0cef4aa0ba7e4ec7e0a0c01e"><enum>8.</enum><header>Emergency
			 authority for United States sentencing commission</header>
			<subsection id="ID985ff0f9df3c4c7799764f5370e5b03e"><enum>(a)</enum><header>In
			 general</header><text>The United States Sentencing Commission, in its
			 discretion, may—</text>
				<paragraph id="ID273e6fe665654fcd90e272c6ebe0c292"><enum>(1)</enum><text>promulgate
			 amendments pursuant to the directives in this Act in accordance with the
			 procedure set forth in section 21(a) of the Sentencing Act of 1987 (Public Law
			 100–182), as though the authority under that Act had not expired; and</text>
				</paragraph><paragraph id="IDf87d07af698e4a4185c73a503cd01b5b"><enum>(2)</enum><text>pursuant to the
			 emergency authority provided in paragraph (1), make such conforming amendments
			 to the Sentencing Guidelines as the Commission determines necessary to achieve
			 consistency with other guideline provisions and applicable law.</text>
				</paragraph></subsection><subsection id="IDc9ca62f9f794433a9b6cfbd1f9d2bc14"><enum>(b)</enum><header>Promulgation</header><text>The
			 Commission shall promulgate any amendments under subsection (a) promptly so
			 that the amendments take effect on the same date as the amendments made by this
			 Act.</text>
			</subsection></section><section id="IDefe7e500dbbb40d19bd1514716d8666d"><enum>9.</enum><header>Report on
			 effectiveness of drug courts</header>
			<subsection id="idB4CE2903FE114E52902B6D75654C99C0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Comptroller General of the United
			 States shall prepare a report analyzing the effectiveness of drug court
			 programs receiving funds from the Drug Court Discretionary Grant Program of the
			 United States Department of Justice’s Office of Justice Programs.</text>
			</subsection><subsection id="id265AD6271D9D495594888A0ABD2917FC"><enum>(b)</enum><header>Focus</header><text display-inline="yes-display-inline">The report required by subsection (a)
			 shall—</text>
				<paragraph id="IDd07aae344ea34695b87b505811fb8f05"><enum>(1)</enum><text>assess the
			 Department of Justice’s efforts to collect data on the performance of federally
			 funded drug courts;</text>
				</paragraph><paragraph id="IDc11fc29a9bd9423095f10b9320b05b13"><enum>(2)</enum><text>address the
			 effect of drug courts on recidivism and substance abuse rates;</text>
				</paragraph><paragraph id="IDc10354d823ec4d8a9305947f6817f8cd"><enum>(3)</enum><text>address any cost
			 benefits resulting from the use of drug courts as alternatives to
			 incarceration;</text>
				</paragraph><paragraph id="IDdf5e25dec05b48869c36a44cd8fd0ce2"><enum>(4)</enum><text>assess the
			 Department of Justice’s response to previous recommendations made by the
			 Comptroller General regarding drug court programs; and</text>
				</paragraph><paragraph id="ID0cc4873b98714ebe943eeae94978fb93"><enum>(5)</enum><text>make
			 recommendations concerning the performance, impact, and cost-effectiveness of
			 federally funded drug court programs.</text>
				</paragraph></subsection></section></legis-body>
