		<section commented="no" display-inline="no-display-inline" id="idBDBB8AD9BF1E479E920B9CE3CCBDC436" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair Sentencing Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID3f3fa10b475149428fb67b642a859b41" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Cocaine sentencing disparity
			 reduction</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8f34d6200bf54810971fd18ff60f765e"><enum>(a)</enum><header display-inline="yes-display-inline">CSA</header><text display-inline="yes-display-inline">Section 401(b)(1) of the Controlled
			 Substances Act (21 U.S.C. 841(b)(1)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDde6c443f8fa5404a850051dcac2c4d17"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(iii), by striking
			 <quote>50 grams</quote> and inserting <quote>280 grams</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8be6c381929943388f6bc0a52471025d"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iii), by striking
			 <quote>5 grams</quote> and inserting <quote>28 grams</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe8e8ab71ac124948a0afbc322da1b400"><enum>(b)</enum><header display-inline="yes-display-inline">Import and Export Act</header><text display-inline="yes-display-inline">Section 1010(b) of the Controlled
			 Substances Import and Export Act (21 U.S.C. 960(b)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDc2e1a979d34b471d96155a9320f31785"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(C), by striking <quote>50
			 grams</quote> and inserting <quote>280 grams</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5b04a93efacb4f8abd4c30b34b8dd818"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by striking <quote>5
			 grams</quote> and inserting <quote>28 grams</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID76e26bbfd91e49d4ab7835d80510ef6b" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Elimination of mandatory minimum sentence
			 for simple possession</header><text display-inline="no-display-inline">Section
			 404(a) of the Controlled Substances Act (21 U.S.C. 844(a)) is amended by
			 striking the sentence beginning <quote>Notwithstanding the preceding
			 sentence,</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDe42da80bf5ae4c3aba8185e33229f3be" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Increased penalties for major drug
			 traffickers</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDca5007b8d0324a4a8c0605380b5c5af8"><enum>(a)</enum><header display-inline="yes-display-inline">Increased penalties for manufacture,
			 distribution, dispensation, or possession with intent To manufacture,
			 distribute, or dispense</header><text display-inline="yes-display-inline">Section 401(b)(1) of the Controlled
			 Substances Act (21 U.S.C. 841(b)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3ecae7e48b56410991217712c5744052"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>$4,000,000</quote>, <quote>$10,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$20,000,000</quote> and inserting
			 <quote>$10,000,000</quote>, <quote>$50,000,000</quote>,
			 <quote>$20,000,000</quote>, and <quote>$75,000,000</quote>, respectively;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3c650089afdc4f78831975f7ae7270be"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>$2,000,000</quote>, <quote>$5,000,000</quote>,

			 exportation</header><text display-inline="yes-display-inline">Section 1010(b)
			 of the Controlled Substances Import and Export Act (21 U.S.C. 960(b)) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDa1d58d26f5be4c7f861e2324ee05c69a"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>$4,000,000</quote>, <quote>$10,000,000</quote>,
			 <quote>$8,000,000</quote>, and <quote>$20,000,000</quote> and inserting
			 <quote>$10,000,000</quote>, <quote>$50,000,000</quote>,
			 <quote>$20,000,000</quote>, and <quote>$75,000,000</quote>, respectively;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID340a8e66950a462099cc02c6eba71e61"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>$2,000,000</quote>, <quote>$5,000,000</quote>,
			 <quote>$4,000,000</quote>, and <quote>$10,000,000</quote> and inserting
			 <quote>$5,000,000</quote>, <quote>$25,000,000</quote>,

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID770dd72413c2427d8fb2863c3ed675d3" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Enhancements for acts of violence during
			 the course of a drug trafficking offense</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and amend the Federal sentencing guidelines to ensure that the
			 guidelines provide an additional penalty increase of at least 2 offense levels
			 if the defendant used violence, made a credible threat to use violence, or
			 directed the use of violence during a drug trafficking offense.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID87d1ec7c8010470d9992e18046c3a544" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Increased emphasis on defendant’s role and
			 certain aggravating factors</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and amend the Federal sentencing guidelines to ensure an additional
			 increase of at least 2 offense levels if—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID6cdff079b0e44d99ab00add2a19d027d"><enum>(1)</enum><text display-inline="yes-display-inline">the defendant bribed, or attempted to
			 bribe, a Federal, State, or local law enforcement official in connection with a
			 drug trafficking offense;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDad6482db3d7f4c47bcb4c53061b97ef9"><enum>(2)</enum><text display-inline="yes-display-inline">the defendant maintained an establishment
			 for the manufacture or distribution of a controlled substance, as generally
			 described in section 416 of the Controlled Substances Act (21 U.S.C. 856);
			 or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID19312c979316499f834a8d2cd0f0b237"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idEC091DF84014456CB1A89163B98131AC"><enum>(A)</enum><text display-inline="yes-display-inline">the defendant is an organizer, leader,
			 manager, or supervisor of drug trafficking activity subject to an aggravating
			 role enhancement under the guidelines; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID68d025b60602497c940b791e7c6be6a8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the offense involved 1 or more of the
			 following super-aggravating factors:</text>
					<clause commented="no" display-inline="no-display-inline" id="ID7ff16810e7d6432b817f09479c720f08"><enum>(i)</enum><text display-inline="yes-display-inline">The defendant—</text>
						<subclause commented="no" display-inline="no-display-inline" id="ID8e1672784f0a4a70b389e5c6dd2e211e"><enum>(I)</enum><text display-inline="yes-display-inline">used another person to purchase, sell,
			 transport, or store controlled substances;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa1ea0f6cf8a0447e9e59bd51cc7baaa5"><enum>(II)</enum><text display-inline="yes-display-inline">used impulse, fear, friendship, affection,
			 or some combination thereof to involve such person in the offense; and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID9cea401496d54126b9e2485823e9cf48"><enum>(III)</enum><text display-inline="yes-display-inline">such person had a minimum knowledge of the
			 illegal enterprise and was to receive little or no compensation from the
			 illegal transaction.</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDa6325d98919c423bba5ebec04ca9a5c0"><enum>(ii)</enum><text display-inline="yes-display-inline">The defendant—</text>
						<subclause commented="no" display-inline="no-display-inline" id="ID09872b19c9a4444b9e495dfe94cd47a2"><enum>(I)</enum><text display-inline="yes-display-inline">knowingly distributed a controlled
			 substance to a person under the age of 18 years, a person over the age of 64
			 years, or a pregnant individual;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="IDe502b13752de4d14b5aa6c31bf58178e"><enum>(II)</enum><text display-inline="yes-display-inline">knowingly involved a person under the age
			 of 18 years, a person over the age of 64 years, or a pregnant individual in
			 drug trafficking;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8a1e19350e644ce686905a97dfc56435"><enum>(III)</enum><text display-inline="yes-display-inline">knowingly distributed a controlled
			 substance to an individual who was unusually vulnerable due to physical or
			 mental condition, or who was particularly susceptible to criminal conduct;
			 or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID237dad8a5c8c4458ba971cf891a48061"><enum>(IV)</enum><text display-inline="yes-display-inline">knowingly involved an individual who was
			 unusually vulnerable due to physical or mental condition, or who was
			 particularly susceptible to criminal conduct, in the offense.</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDbb4fd6828ec64e3481290e27ac8d423a"><enum>(iii)</enum><text display-inline="yes-display-inline">The defendant was involved in the
			 importation into the United States of a controlled substance.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID5e23e7bf063d4438b8c4d9087528ea0d"><enum>(iv)</enum><text display-inline="yes-display-inline">The defendant engaged in witness
			 intimidation, tampered with or destroyed evidence, or otherwise obstructed
			 justice in connection with the investigation or prosecution of the
			 offense.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="ID34c4898817d84226a1152e02724649cb"><enum>(v)</enum><text display-inline="yes-display-inline">The defendant committed the drug
			 trafficking offense as part of a pattern of criminal conduct engaged in as a
			 livelihood.</text>
					</clause></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4878a86a9e1a4422aef90c9cc2aa7c54" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Increased emphasis on defendant’s role and
			 certain mitigating factors</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, the United States Sentencing Commission shall
			 review and amend the Federal sentencing guidelines and policy statements to
			 ensure that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID7ce40a9d95424346aee34a7b460b7e09"><enum>(1)</enum><text display-inline="yes-display-inline">if the defendant is subject to a minimal
			 role adjustment under the guidelines, the base offense level for the defendant
			 based solely on drug quantity shall not exceed level 32; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcc55f4fc4f07475b8da93a9a2e8ffd57"><enum>(2)</enum><text display-inline="yes-display-inline">there is an additional reduction of 2
			 offense levels if the defendant—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDbc9a326442554c18b5d9270ca3478ae5"><enum>(A)</enum><text display-inline="yes-display-inline">otherwise qualifies for a minimal role
			 adjustment under the guidelines and had a minimum knowledge of the illegal
			 enterprise;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID91dee6bd130e4f36bcab264444badfed"><enum>(B)</enum><text display-inline="yes-display-inline">was to receive no monetary compensation
			 from the illegal transaction; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID04602896ff9345a396c2373c95039cd2"><enum>(C)</enum><text display-inline="yes-display-inline">was motivated by an intimate or familial
			 relationship or by threats or fear when the defendant was otherwise unlikely to
			 commit such an offense.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="IDefda010a689a47e594bf7799da3dd870" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Emergency authority for United States
			 sentencing commission</header><text display-inline="no-display-inline">The
			 United States Sentencing Commission shall—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idCD2621FE015A49AFB03F673CA8401FF6"><enum>(1)</enum><text display-inline="yes-display-inline">promulgate the guidelines, policy
			 statements, or amendments provided for in this Act as soon as practicable, and
			 in any event not later than 90 days after the date of enactment of this Act, in
			 accordance with the procedure set forth in section 21(a) of the Sentencing Act
			 of 1987 (28 U.S.C. 994 note), as though the authority under that Act had not
			 expired; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf0298d6b2e8a4b5c8bf552a44a64999e"><enum>(2)</enum><text display-inline="yes-display-inline">pursuant to the emergency authority
			 provided under paragraph (1), make such conforming amendments to the Federal
			 sentencing guidelines as the Commission determines necessary to achieve
			 consistency with other guideline provisions and applicable law.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID0a819df1293d45528030b7b33009e3ec" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Report on effectiveness of drug
			 courts</header>
			<subsection commented="no" display-inline="no-display-inline" id="id084DB1DE344B43F2A481AE3FEAD95626"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 submit to Congress a report analyzing the effectiveness of drug court programs
			 receiving funds under the drug court grant program under part EE of title I of
			 the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797–u et
			 seq.).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id24DC876AA7374780BF7FC856B0280756"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report submitted under subsection (a)
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDa8f495654f8640dd869a8cacde160f42"><enum>(1)</enum><text display-inline="yes-display-inline">assess the efforts of the Department of
			 Justice to collect data on the performance of federally funded drug
			 courts;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfd29be2176dd4348aea71edf07453d2a"><enum>(2)</enum><text display-inline="yes-display-inline">address the effect of drug courts on
			 recidivism and substance abuse rates;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6bfe8c5c3083476883267b6a31b1d010"><enum>(3)</enum><text display-inline="yes-display-inline">address any cost benefits resulting from
			 the use of drug courts as alternatives to incarceration;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8cfbf831959a48b6b3eb968ce4c03113"><enum>(4)</enum><text display-inline="yes-display-inline">assess the response of the Department of
			 Justice to previous recommendations made by the Comptroller General regarding
			 drug court programs; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce45ee344b504643a368b946d14769fe"><enum>(5)</enum><text display-inline="yes-display-inline">make recommendations concerning the
			 performance, impact, and cost-effectiveness of federally funded drug court
			 programs.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID07ceca5f39f44cdaaf51ea9fb85b7532" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">United States Sentencing Commission report
			 on impact of changes to Federal cocaine sentencing law</header><text display-inline="no-display-inline">Not later than 5 years after the date of
			 enactment of this Act, the United States Sentencing Commission, pursuant to the
			 authority under sections 994 and 995 of title 28, United States Code, and the
			 responsibility of the United States Sentencing Commission to advise Congress on
			 sentencing policy under section 995(a)(20) of title 28, United States Code,
			 shall study and submit to Congress a report regarding the impact of the changes
			 in Federal sentencing law under this Act and the amendments made by this
			 Act.</text>
