		<official-title>To provide improvements for the operations of the Federal
		  courts, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Federal Judiciary Administrative
			 Improvements Act of 2009</short-title></quote>.</text>
		</section><section id="idCE0BE6A7E2FD42B785CE602463FDA0F9"><enum>2.</enum><header>Senior judge
			 governance correction</header><text display-inline="no-display-inline">Section
			 631(a) of title 28, United States Code, is amended in the first sentence by
			 striking <quote>(including any judge in regular active service and any judge
			 who has retired from regular active service under section 371(b) of this title,
			 when designated and assigned to the court to which such judge was
			 appointed)</quote>.</text>
		</section><section id="id4FBED51DBA4B406283EEEF705FF3C682"><enum>3.</enum><header>Revision of
			 statutory description of the district of North Dakota</header><text display-inline="no-display-inline">Chapter 5 of title 28, United States Code,
			 is amended by striking section 114 and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="idC3EA614F979F4AFA91CA038948EEAF63" style="USC">
				<section id="id812B681DC9BA4C16B1E2A3831567FD3E"><enum>114.</enum><header>North
				Dakota</header><text display-inline="no-display-inline">North Dakota
				constitutes one judicial district.</text>
					<paragraph id="id0D4B6D9B192A4F39B5859C032BF1BF24"><enum></enum><text>Court shall be
				held at Bismarck, Fargo, Grand Forks, and
				Minot.</text>
					</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idDC66AA3DC9034789A547A680BE714E67"><enum>4.</enum><header>Disability
			 retirement and cost-of-living adjustments of annuities for territorial
			 judges</header><text display-inline="no-display-inline">Section 373 of title
			 28, United States Code, is amended—</text>
			<paragraph id="id7828C901F6E243D899EE532211018C5B"><enum>(1)</enum><text>in subsection
			 (c), by striking paragraph (4) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id19725922F220476F9E9FCBDC6A626C9E" style="OLC">
					<paragraph id="id460DC2559F38489C9034B5FB8FB0ACAF"><enum>(4)</enum><text>Any senior judge
				performing judicial duties pursuant to recall under paragraph (2) of this
				subsection shall be paid, while performing such duties, the same compensation
				(in lieu of the annuity payable under this section) and the same allowances for
				travel and other expenses as a judge on active duty with the court being
				served.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id11D6772B7DB74AA1A65E3AA7E6B458C1"><enum>(2)</enum><text>by amending
			 subsection (e) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id17D1E7F87C1048CAB4F4E7F42939F94E" style="OLC">
					<subsection id="idF9F9E83E1E994695B346B230F3C559DD"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF3F8AF96D4FF450DA48619F384160936"><enum>(1)</enum><text>Any judge of the
				District Court of Guam, the District Court of the Northern Mariana Islands, or
				the District Court of the Virgin Islands who is not reappointed (as judge of
				such court) shall be entitled, upon attaining the age of 65 years or upon
				relinquishing office if the judge is then beyond the age of 65 years—</text>
							<subparagraph id="idB2AD094DD5834417843E31DC8EE4477A" indent="up1"><enum>(A)</enum><text>if the judicial service of such judge,
				continuous or otherwise, aggregates 15 years or more, to receive during the
				remainder of the life of such judge an annuity equal to the salary received
				when the judge left office; or</text>
							</subparagraph><subparagraph id="id2EC3BF3F3DBF45A99C4F4809F0F88FB9" indent="up1"><enum>(B)</enum><text>if such judicial service, continuous
				or otherwise, aggregated less than 15 years, to receive during the remainder of
				the life of such judge an annuity equal to that proportion of such salary which
				the aggregate number of years of service of such judge bears to 15.</text>
							</subparagraph></paragraph><paragraph id="id01FF10C102964D508CCF408002B4F040" indent="up1"><enum>(2)</enum><text>Any judge of the District Court of
				Guam, the District Court of the Northern Mariana Islands, or the District Court
				of the Virgin Islands who has served at least 5 years, continuously or
				otherwise, and who retires or is removed upon the sole ground of mental or
				physical disability, shall be entitled to receive during the remainder of the
				life of such judge an annuity equal to 40 percent of the salary received when
				the judge left office or, in the case of a judge who has served at least 10
				years, continuously or otherwise, an annuity equal to that proportion of such
				salary which the aggregate number of years of judicial service of such judge
				bears to 15.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id61DE12ACAAC74E90831D347B14A3D198"><enum>(3)</enum><text>by amending
			 subsection (g) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id126424E86ACF4BFC8FA5D3CF73756E10" style="OLC">
					<subsection id="idDE92DDCE4A534C1EAD04B154A7678270"><enum>(g)</enum><text>Any retired judge
				who is entitled to receive an annuity under this section shall be paid a
				cost-of-living adjustment as provided under section 8340(b) of title 5, except
				that in no case may the annuity payable to such retired judge, as increased
				under this subsection, exceed the salary of a judge in regular active service
				with the court on which the retired judge served before
				retiring.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idD3585AC7C3C84338BC1AA72913685D10"><enum>5.</enum><header>Annual leave
			 limit for Judicial Branch executives</header><text display-inline="no-display-inline">Section 6304(f)(1) of title 5, United States
			 Code, is amended—</text>
			<paragraph id="id4E688B3BEB594425BA618F83897EBE1C"><enum>(1)</enum><text>in subparagraph
			 (F), by striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="id3E8DEEE6799B471ABCE52359FCE0F6E1"><enum>(2)</enum><text>in subparagraph
			 (G), by striking the period and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="id3DD9A223B3564D67959483C89CA4EDF6"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id38D477094D47405AACF403B8E8BA9F86" style="OLC">
					<subparagraph id="id5FA72162F73C46399DDA351F54E61870"><enum>(H)</enum><text>a position in the
				judicial branch designated as a senior executive position—</text>
						<clause id="id8889D6104FBB47F4A26ECEF05DD0A753"><enum>(i)</enum><text>in the United
				States Courts by the Judicial Conference of the United States;</text>
						</clause><clause id="idF2E1020B94B7415FB90B396DAD632411"><enum>(ii)</enum><text>in the Federal
				Judicial Center by the Board of the Federal Judicial Center; or</text>
						</clause><clause id="id5984A67F948A4E8E9C21A67B4270D0F6"><enum>(iii)</enum><text>in the United
				States Sentencing Commission by the
				Commission.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id76E63C2137AA4D009E06E98E453CB815"><enum>6.</enum><header>Federal Judicial
			 Center personnel matters</header><text display-inline="no-display-inline">Section 625 of title 28, United States Code,
			 is amended—</text>
			<paragraph id="idBF234D5457A14049A46534A574FA90E0"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="id33C926942E40419CB2BDDC49BC4BC9AE"><enum>(A)</enum><text>by striking
			 <quote>, United States Code, governing</quote> and inserting
			 <quote>governing</quote>;</text>
				</subparagraph><subparagraph id="idCDDA9F7D13EF47F8AD7C84C1DCDC9FAE"><enum>(B)</enum><text>by striking
			 <quote>pay rates, section 5316, title 5, United States Code</quote> and
			 inserting <quote>under section 5316 of title 5, except that the Director may
			 fix the compensation of 4 positions of the Center at a level not to exceed the
			 annual rate of pay in effect for level IV of the Executive Schedule under
			 section 5315 of title 5</quote>; and</text>
				</subparagraph><subparagraph id="id46273E2C931B475FA70CEF8DD3EFC10A"><enum>(C)</enum><text>by striking
			 <quote>the Civil Servive</quote> and all that follows and inserting
			 <quote>subchapter III of chapter 83 of title 5 shall be adjusted under section
			 8344 of such title, and the salary of a reemployed annuitant under chapter 84
			 of title 5 shall be adjusted under section 8468 of such title</quote>;</text>
				</subparagraph></paragraph><paragraph id="id78EBB8FDC8384BA49B31188C9F93C333"><enum>(2)</enum><text>in subsections
			 (c) and (d), by striking <quote>, United States Code,</quote> each place that
			 term appears; and</text>
			</paragraph><paragraph id="idD0642C62208B44CCBA7A5E2A2655D3A2"><enum>(3)</enum><text>in subsection
			 (d), by striking <quote>, United States Code.</quote> and inserting a
			 period.</text>
			</paragraph></section><section id="id4A6EAF9BFB17415087CFED0B505CEBE8"><enum>7.</enum><header>Separation of
			 the judgment and statement of reasons forms</header><text display-inline="no-display-inline">Section 3553(c)(2) of title 18, United
			 States Code, is amended by striking <quote>the written order of judgment and
			 commitment</quote> and inserting <quote>a statement of reasons form issued
			 under section 994(w)(1)(B) of title 28</quote>.</text>
		</section><section id="id73911524948748AD9920EC98254A8BC8"><enum>8.</enum><header>Pretrial
			 services functions for juveniles</header><text display-inline="no-display-inline">Section 3154 of title 18, United States
			 Code, is amended—</text>
			<paragraph id="idBAB67F1100A742309D96DB56481D6C9A"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (14) as
			 paragraph (15); and</text>
			</paragraph><paragraph id="id85311535D62743CA94E049CF97603356"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (13) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id1A8B24C808C04579B8989F32AE2D1F60" style="OLC">
					<paragraph id="id6B51A47157D5499F85831B031C200DBC"><enum>(14)</enum><text>Perform, in a
				manner appropriate for juveniles, any of the functions identified in this
				section with respect to juveniles awaiting adjudication, trial, or disposition
				under chapter 403 of this title who are not
				detained.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id9071B7C5B5F1407FB168AE41176EE854"><enum>9.</enum><header>Statistical
			 reporting schedule for criminal wiretap orders</header><text display-inline="no-display-inline">Section 2519 of title 18, United States
			 Code, is amended—</text>
			<paragraph id="id75BFCDEEFFD648A8AD92CE116D47C4B0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Within
			 thirty days after the expiration of an order (or each extension thereof)
			 entered under section 2518, or the denial of an order approving an
			 interception, the issuing or denying judge</quote> and inserting <quote>In
			 January of each year, any judge who has issued an order (or an extension
			 thereof) under section 2518 that expired during the preceding year, or who has
			 denied approval of an interception during that year,</quote>;</text>
			</paragraph><paragraph id="id5527E3B8657A47BDAA27C9DCC659F040"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>In January of each year</quote> and inserting <quote>In
			 March of each year</quote>; and</text>
			</paragraph><paragraph id="id930C2C155E67436FA1863DCECBA615F8"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>In April of each year</quote> and inserting <quote>In June
			 of each year</quote>.</text>
			</paragraph></section><section id="id9A8C84B674F04D67BC4F8CEF3BB26768"><enum>10.</enum><header>Thresholds for
			 administrative review of other than counsel case compensation</header><text display-inline="no-display-inline">Section 3006A of title 18, United States
			 Code, is amended—</text>
			<paragraph id="id680CC49426B942C5AAFAD5DB61C86B26"><enum>(1)</enum><text>in subsection
			 (e)—</text>
				<subparagraph id="idC2BE88E92F3A49B284545E4C02152C7B"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
					<clause id="id670A2EF953C94AB1B5CF151D2BA1E4EC"><enum>(i)</enum><text>in
			 subparagraph (A), in the second sentence, by striking <quote>$500</quote> and
			 inserting <quote>$800</quote>; and</text>
					</clause><clause id="id9092C58B66C7431992CF5831553D57A1"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>$500</quote> and inserting
			 <quote>$800</quote>; and</text>
					</clause></subparagraph><subparagraph id="id24DB485FCCC443C0831AB1A14898A05D"><enum>(B)</enum><text>in paragraph (3),
			 in the first sentence, by striking <quote>$1,600</quote> and inserting
			 <quote>$2,400</quote>; and</text>
				</subparagraph></paragraph><paragraph id="idF87CF2112F274030AEE0372F584AA916"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id44076FF59A9744A7A002492F2BA39FF0" style="OLC">
					<paragraph id="id0D8D76F922C14EA789D2B6C314A47CE3"><enum>(5)</enum><text>The dollar
				amounts provided in paragraphs (2) and (3) shall be adjusted simultaneously by
				an amount, rounded to the nearest multiple of $100, equal to the percentage of
				the cumulative adjustments taking effect under section 5303 of title 5 in the
				rates of pay under the General Schedule since the date the dollar amounts
				provided in paragraphs (2) and (3), respectively, were last enacted or adjusted
				by
				statute.</text>
