		<section commented="no" display-inline="no-display-inline" id="HE8C9E30045FF4605BF90B87B367C50F3" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Permanent resident status for Hotaru Nakama
			 Ferschke</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDFC4389ED5C24054882EBD788B6BE2FF"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b) of
			 section 201 of the <act-name parsable-cite="INA">Immigration and Nationality
			 Act</act-name>, Hotaru Nakama Ferschke shall be eligible for issuance of an
			 immigrant visa or for adjustment of status to that of an alien lawfully
			 admitted for permanent residence upon filing an application for issuance of an
			 immigrant visa under section 204 of such Act or for adjustment of status to
			 lawful permanent resident.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD2C95CB6AA8643D9AA37B1183006C141"><enum>(b)</enum><header display-inline="yes-display-inline">Adjustment of Status</header><text display-inline="yes-display-inline">If Hotaru Nakama Ferschke enters the United
			 States before the filing deadline specified in subsection (c), she shall be
			 considered to have entered and remained lawfully and shall, if otherwise
			 eligible, be eligible for adjustment of status under section 245 of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> as of
			 the date of the enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H29ABCE04CA7849AEB98F2A8CF133D2F1"><enum>(c)</enum><header display-inline="yes-display-inline">Deadline for Application and Payment of
			 Fees</header><text display-inline="yes-display-inline">Subsections (a) and (b)
			 shall apply only if the application for issuance of an immigrant visa or the
			 application for adjustment of status is filed with appropriate fees within 2
			 years after the date of the enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H89FF661FE83D48C3A5D130A0736CBD9F"><enum>(d)</enum><header display-inline="yes-display-inline">Reduction of Immigrant Visa
			 Number</header><text display-inline="yes-display-inline">Upon the granting of
			 an immigrant visa or permanent residence to Hotaru Nakama Ferschke, the
			 Secretary of State shall instruct the proper officer to reduce by 1, during the
			 current or next following fiscal year, the total number of immigrant visas that
			 are made available to natives of the country of the alien’s birth under section
			 203(a) of the <act-name parsable-cite="INA">Immigration and Nationality
			 Act</act-name> or, if applicable, the total number of immigrant visas that are
			 made available to natives of the country of the alien’s birth under section
			 202(e) of such Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB8D709DF0C8D4CBA85D7ED27E1F2A92C"><enum>(e)</enum><header>PAYGO</header><text>The
			 budgetary effects of this Act, for the purpose of complying with the Statutory
			 Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest
			 statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this
			 Act, submitted for printing in the Congressional Record by the Chairman of the
			 Senate Budget Committee, provided that such statement has been submitted prior
			 to the vote on passage.</text>
