		<official-title>To amend the Hate Crime Statistics Act to include crimes
		  against the homeless.</official-title>

		<section id="H88E7E61A136C427EA019086BDFB74B81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hate Crimes Against the Homeless
			 Statistics Act of 2009</short-title></quote>.</text>
		</section><section id="HEDCABE6F3701476DA455C59B6099E90A"><enum>2.</enum><header>Inclusion of
			 homeless</header><text display-inline="no-display-inline">Section (1)(b) of the
			 Hate Crime Statistics Act is amended—</text>
			<paragraph id="HE8D73C464DAE408A9D33CB0E1FD8BD9C"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>homeless status,</quote> after <quote>sexual
			 orientation,</quote>; and</text>
			</paragraph><paragraph id="H9B6C4D0CECE84CBC8302EBEA25460395"><enum>(2)</enum><text>by adding the end
			 the following:</text>
				<quoted-block id="HC57B358BB9BA495DA5B37D6A1A65098D" style="OLC">
					<paragraph id="H52C4B664215D495EB106FEA620E116FF"><enum>(6)</enum><text>As used in this
				subsection, the term <quote>homeless status</quote> with respect to an
				individual, refers to an individual who—</text>
						<subparagraph id="HE186D3AD2A7342F9BA1A1ACB494324E4"><enum>(A)</enum><text>lacks a fixed,
				regular, and adequate nighttime residence; or</text>
						</subparagraph><subparagraph id="H454450B0950743269499F14B9992122D"><enum>(B)</enum><text>has a primary
				nighttime residence that is—</text>
							<clause id="H88745A6E2C12420B819B4D19E0D22D50"><enum>(i)</enum><text>a
				public or private place not designed for, or ordinarily used as, a regular
				sleeping accommodation for human beings, including cars, parks, public spaces,
				abandoned buildings, substandard housing, bus or train stations, or similar
				settings;</text>
							</clause><clause id="HBBE574A5B85E42809B8AF3C731C2EFC0"><enum>(ii)</enum><text>a
				supervised publicly or privately operated shelter designed to provide temporary
				living accommodations, including motels, hotels, congregate shelters, and
				transitional housing; or</text>
							</clause><clause id="H8F823BEA35404E2A88F485835A31B24E"><enum>(iii)</enum><text>housing of other
				persons in which the individual is temporarily staying due to loss of housing,
				economic hardship, or a similar
				reason.</text>
