		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Water Transfer Facilitation Act of
			 2009</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="idA2A363A398534CC18DB87112BDE56A3D" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Authorization of
			 irrigation water transfers, Central Valley Project</header>
			<subsection id="idE8827C65C8C542E5B92C1947429CF382"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (b), the following voluntary water transfers shall be considered to meet the
			 conditions described in subparagraphs (A) and (I) of section 3405(a)(1) of the
			 Reclamation Projects Authorization and Adjustment Act of 1992 (Public Law
			 102–575; 106 Stat. 4709):</text>
				<paragraph id="idD1E38334A7FD49908BE695084167E87B"><enum>(1)</enum><text display-inline="yes-display-inline">A transfer of irrigation water among
			 Central Valley Project contractors from the Friant, San Felipe, West San
			 Joaquin, and Delta divisions.</text>
				</paragraph><paragraph id="id8328A86A062F4797A7FFFDB02AD65FE6"><enum>(2)</enum><text display-inline="yes-display-inline">A transfer of water among current or prior
			 temporary or long-term water service, repayment, water rights settlement, or
			 exchange contractors within a division of the Central Valley Project.</text>
				</paragraph></subsection><subsection id="id7AF03B1493A24152AF737C13460FA2DE"><enum>(b)</enum><header>Condition</header><text display-inline="yes-display-inline">A transfer under subsection (a) shall be
			 subject to the condition that the transfer not interfere with—</text>
				<paragraph id="id5CE14BA5396544E5AB8D19EF93FCD2BE"><enum>(1)</enum><text display-inline="yes-display-inline">the San Joaquin River Restoration
			 Settlement Act (Public Law 111–11; 123 Stat. 1349), including the priorities
			 described in section 10004(a)(4)(B) of that Act (123 Stat. 1350) relating to
			 implementation of paragraph 16 of the Settlement (as defined in section 10003
			 of that Act (123 Stat. 1349)); and</text>
				</paragraph><paragraph id="id4E33C6A8EFFB4E9799D94C5E9FC18146"><enum>(2)</enum><text display-inline="yes-display-inline">the Settlement.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="idD4CEA2015CC74C2FA33E45CA584F3261" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>Facilitation of water
			 transfers, Central Valley Project</header>
			<subsection id="id4CCA4C75DA2A4401BAB18B0CD2343859"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Secretary of the
			 Interior, acting through the Director of the United States Fish and Wildlife
			 Service and the Commissioner of the Bureau of Reclamation (referred to in this
			 section as the <quote>Secretary</quote>), using such sums as are necessary,
			 shall initiate and complete, on the most expedited basis practicable, the
			 programmatic development of environmental documentation to facilitate voluntary
			 water transfers within the Central Valley Project.</text>
			</subsection><subsection id="id918E85AF52004014A6605CD6C8DCADBF"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The environmental documentation under
			 subsection (a) shall include all applicable environmental reviews, permitting,
			 and consultations, including the environmental documentation needed to address
			 concerns with respect to the Giant Garter Snake (Thamnophis gigas).</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="id83770844D7BE412DA4F14C5EBD2EBCD3" reported-display-style="strikethrough"><enum>4.</enum><header>Report on Central
			 Valley Project water transfers</header>
			<subsection id="idA8341D4D68904E97AD3C7A8980B71172"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than
			 January 10, 2010, the Commissioner of the Bureau of Reclamation (referred to in
			 this section as the <quote>Commissioner</quote>) shall submit to the
			 appropriate committees of Congress a report that—</text>
				<paragraph id="id87FEB478D8DD4947B3B847537C60C157"><enum>(1)</enum><text display-inline="yes-display-inline">describes the status of efforts to help
			 facilitate and improve the water transfers under this Act; and</text>
				</paragraph><paragraph id="idE8FED69CEE5E4ED9ADC3622DE09892BE"><enum>(2)</enum><text>provides
			 recommendations on ways to facilitate, and improve the process for—</text>
					<subparagraph id="idB621D75E05EF407EB4992B53C78DB181"><enum>(A)</enum><text>water transfers
			 within the Central Valley Project; and</text>
					</subparagraph><subparagraph id="idC8FF2725B10F488F9CD9F065A8B668F1"><enum>(B)</enum><text>water transfers
			 between the Central Valley Project and State water projects.</text>
					</subparagraph></paragraph></subsection><subsection id="id459009232F0C4C338AF7D70E3E1846DF"><enum>(b)</enum><header>Updates</header><text display-inline="yes-display-inline">Not later than July 15, 2010, and every 180
			 days thereafter until the Commissioner determines that no further Federal
			 action is warranted or authorized with respect to the water transfers under
			 this Act, the Commissioner shall update the report submitted under subsection
			 (a).</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="id85EC91A5B43E40639011E3A16456C2DB" reported-display-style="strikethrough"><enum>5.</enum><header>Technical
			 corrections</header><text display-inline="no-display-inline">Section 3405(a)(1)
			 of the Central Valley Project Improvement Act (Public Law 102–575; 106 Stat.
			 4710) is amended—</text>
			<paragraph id="IDabd5eb0cbe31410d9b9ff9ebb7b44342"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>transfers to</quote> and inserting
			 <quote>transfers of</quote>; and</text>
			</paragraph><paragraph id="ID8bbcf4380af8452892ff8a49fbed9a88"><enum>(2)</enum><text>in subparagraph
			 (A), by striking <quote>to combination</quote> and inserting <quote>or
			 combination</quote>.</text>

		<section changed="added" committee-id="SSEG00" id="idc79d725a-bb77-4ad2-b1ff-400034ee25ab" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Water Transfer Facilitation Act of
			 2009</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="idec068946-99cd-411d-84ed-002ca17da616" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Authorization of water
			 transfers, Central Valley Project</header>
			<subsection id="ide02db440-1353-4619-a678-04dfc70ad927"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (b), the following voluntary water transfers shall be considered to meet the
			 conditions described in subparagraphs (A) and (I) of section 3405(a)(1) of the
			 Reclamation Projects Authorization and Adjustment Act of 1992 (Public Law
			 102–575; 106 Stat. 4709):</text>
				<paragraph id="id8aae9719-1334-4167-a758-3cadafaa3569"><enum>(1)</enum><text display-inline="yes-display-inline">A transfer of irrigation water among
			 Central Valley Project contractors from the Friant, San Felipe, West San
			 Joaquin, and Delta divisions.</text>
				</paragraph><paragraph id="id43b20cf3-f3a7-4095-963c-2b7bf36bf48c"><enum>(2)</enum><text display-inline="yes-display-inline">A transfer from a long-term Friant Division
			 water service or repayment contractor to a temporary or prior temporary water
			 service contractor within the place of use in existence on the date of the
			 transfer, as identified in the Bureau of Reclamation water rights permits for
			 the Friant Division.</text>
				</paragraph></subsection><subsection id="id5b618304-1def-4806-9d14-1b3e73da167b"><enum>(b)</enum><header>Condition</header><text display-inline="yes-display-inline">A transfer under subsection (a) shall
			 comply with all applicable Federal and State law.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="ided903e4f-e285-460d-b008-5680af04d148" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Facilitation of water
			 transfers, Central Valley Project</header><text display-inline="no-display-inline">As soon as practicable after the date of
			 enactment of this Act, the Secretary of the Interior, acting through the
			 Director of the United States Fish and Wildlife Service and the Commissioner of
			 the Bureau of Reclamation, using such sums as are necessary, shall initiate and
			 complete, on the most expedited basis practicable, programmatic documentation
			 to facilitate voluntary water transfers within the Central Valley Project,
			 consistent with all applicable Federal and State law.</text>
		</section><section changed="added" committee-id="SSEG00" id="idd8390e75-deb2-4513-84ca-a6b218f4b38b" reported-display-style="italic"><enum>4.</enum><header>Report on Central Valley
			 Project water transfers</header>
			<subsection id="id14345c4d-4b64-4241-a5c3-648b04c00e4b"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Commissioner of the Bureau of
			 Reclamation (referred to in this section as the <quote>Commissioner</quote>)
			 shall submit to the appropriate committees of Congress a report that—</text>
				<paragraph id="idcca20d29-deb9-4095-be06-bc72c971d402"><enum>(1)</enum><text display-inline="yes-display-inline">describes the status of efforts to help
			 facilitate and improve the water transfers under this Act;</text>
				</paragraph><paragraph id="ID9fafddb264ae4acaa2aaaf0a23c13414"><enum>(2)</enum><text>evaluates potential
			 effects of this Act on Federal programs, Indian tribes, Central Valley Project
			 operations, the environment, groundwater aquifers, refuges, and communities;
			 and</text>
				</paragraph><paragraph id="idd0564520-ba15-484d-bf88-af6f9b7e299e"><enum>(3)</enum><text>provides recommendations
			 on ways to facilitate, and improve the process for—</text>
					<subparagraph id="idb668fb76-0057-43c9-a63e-44b5c81afd7f"><enum>(A)</enum><text>water transfers within
			 the Central Valley Project; and</text>
					</subparagraph><subparagraph id="idc0d94af3-3ff4-4858-8c3e-a7ecde5addc6"><enum>(B)</enum><text>water transfers between
			 the Central Valley Project and other water projects in the State of
			 California.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide29ee8fb-99fc-465a-ab33-e003bc4fa1f9"><enum>(b)</enum><header>Updates</header><text display-inline="yes-display-inline">Not later than the end of the water year in
			 which the report is submitted under subsection (a) and each of the 4 water
			 years thereafter, the Commissioner shall update the report.</text>
