		<official-title display="yes">To amend title 18, United States Code, to
		  prohibit the possession or use of cell phones and similar wireless devices by
		  Federal prisoners.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HD395714F386A4D47819EAC56992E6816" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cell Phone Contraband Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H04716426570F489E97F34260728DD980" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Wireless devices in prison</header><text display-inline="no-display-inline">Section 1791 of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HCBB2125792E74C8483E02C089661A880"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H2FE6694E52AC4787BA404040D882A8F8"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>or
			 (d)(1)(E)</quote> and inserting <quote>, (d)(1)(E), or (d)(1)(F)</quote>;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED9CB5AEF3534483895126B315CA69A1"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>(d)(1)(F)</quote> and inserting <quote>(d)(1)(G)</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7D6973106F734D08B997B5A5D33F07F3"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)(1)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H877566494066421CA48C4DDD32876618"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking
			 <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H237C3E7EFD9E4B3E8A358BF2DDE9A365"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (F) as
			 subparagraph (G); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H043F4EED63F145F4BE39E3443E097A8E"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (E) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HA544FF85E18F4113B9ABE4FB0B3D45A5" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="H7988D1619E59410089C3E9F1A9657B4E"><enum>(F)</enum><text display-inline="yes-display-inline">a phone or other device used by a user of
				commercial mobile service (as defined in section 332(d) of the Communications
				Act of 1934 (47 U.S.C. 332(d))) in connection with such service;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H2FBC220EE066473BB82183313EEE7116" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">GAO study</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Comptroller General shall submit a report to
			 Congress with research and findings on the following issues:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HB9A7426CE50F477CBF4953348DB7F6AD"><enum>(1)</enum><text display-inline="yes-display-inline">A study of telephone rates within Federal
			 prisons to include information on interstate, intrastate and collect calls made
			 by prisoners, including—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HD220733605734069B264BC674362DE2F"><enum>(A)</enum><text display-inline="yes-display-inline">the costs of operating inmate telephone
			 services;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H239D18D5405E4DB3B70ED164A6DD5F10"><enum>(B)</enum><text display-inline="yes-display-inline">the general cost to prison telephone
			 service providers of providing telephone services to the Federal
			 prisons;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAC6DA385637B4ECFA25912748C5D9812"><enum>(C)</enum><text display-inline="yes-display-inline">the revenue obtained from inmate telephone
			 systems;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5306FD5C86584C5DBEE761EE77138C25"><enum>(D)</enum><text display-inline="yes-display-inline">how the revenue from these systems is used
			 by the Bureau of Prisons; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF887F87BBCFF4FBBA36D631DD816D509"><enum>(E)</enum><text display-inline="yes-display-inline">options for lowering telephone costs to
			 inmates and their families, while still maintaining sufficient security.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA73287F92BEE4130850063DE88E07586"><enum>(2)</enum><text display-inline="yes-display-inline">A study of selected State and Federal
			 efforts to prevent the smuggling of cell phones and other wireless devices into
			 prisons, including efforts that selected State and Federal authorities are
			 making to minimize trafficking of cell phones by guards and other prison
			 officials and recommendations to reduce the number of cell phones that are
			 trafficked into prisons.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H254B5669A82548FFB4F3E06837A2C0B4"><enum>(3)</enum><text display-inline="yes-display-inline">A study of cell phone use by inmates in
			 selected State and Federal prisons, including—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H21E6A72538144C5CA9E70B7E47FA74C7"><enum>(A)</enum><text display-inline="yes-display-inline">the quantity of cell phones confiscated by
			 authorities in selected State and Federal prisons; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE809F151DB1F47B194F8850775632CEA"><enum>(B)</enum><text display-inline="yes-display-inline">the reported impact, if any, of: (1) inmate
			 cell phone use on the overall security of prisons; and (2) connections to
			 criminal activity from within prisons.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H289C09B8231948D4B3530273F98D8E30" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Compliance with PAYGO</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Committee on the Budget of the
			 House of Representatives, provided that such statement has been submitted prior
			 to the vote on passage.</text>
