		<official-title>To amend title XVIII of the Social Security Act to exempt
		  small pharmacies from certain Medicare accreditation requirements for the
		  purpose of providing diabetic testing strips under part B.</official-title>

		<section id="id8F1F4B1A3DEA4742BBA45B2A5545F07F" section-type="section-one"><enum>1.</enum><header>Exemption of small pharmacies
			 providing diabetic testing strips from certain medicare accreditation
			 requirements</header>
			<subsection id="ID0d04c2863f144ffbae67573f5b3b06d7"><enum>(a)</enum><header>In
			 general</header><text>Section 1834(a)(20) of the Social Security Act (42 U.S.C.
			 1395m(a)(20)) is amended—</text>
				<paragraph id="id18367DD79325458F991687AA54B46B61"><enum>(1)</enum><text>in subparagraph
			 (F)—</text>
					<subparagraph id="id1B3245FECF044465BA666C3773B40629"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="id9482B3E58AC24D09BF8847D38C8AC756"><enum>(i)</enum><text>by
			 striking <quote>clause (ii)</quote> and inserting <quote>clauses (ii) and
			 (iii)</quote>; and</text>
						</clause><clause id="idB48790CE93334D58A07854065872D529"><enum>(ii)</enum><text>by
			 striking <quote>and</quote> at the end;</text>
						</clause></subparagraph><subparagraph id="id87313C35F04E4B34B656AB3164AAC0F2"><enum>(B)</enum><text>in clause (ii),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="id9CDE2C760C264225968CD324B8320764"><enum>(C)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="id88623D2D7ED94DBEA37014EE70565CEC" style="OLC">
							<clause id="idFCBA00FEFD1D4605B69F81729CAF265E"><enum>(iii)</enum><text>such standards
				and the accreditation requirement of clause (i) shall not apply to a small
				pharmacy (as defined in subparagraph (G)) with respect to the furnishing of
				diabetic testing strips.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id71E4A24E8E074005AEA2785DFAFF7762"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="idA1313072EAD6489A992683DBA8378A58" style="OLC">
						<subparagraph id="id676EB36B18554439B68B2CE8226C62ED"><enum>(G)</enum><header>Definition of
				small pharmacy</header><text>For purposes of subparagraph (F)(iii), the term
				<quote>small pharmacy</quote> means a pharmacy—</text>
							<clause id="id5708865E26AD4D9F97D531D920830F03"><enum>(i)</enum><text>with 10 or less
				distinct locations under sole or common control or ownership, each of which has
				a license specific to that location; and</text>
							</clause><clause id="idEE546878A18D4C4BAB50A42DC6C39A60"><enum>(ii)</enum><text>whose average
				total sales across all such locations is less than or equal to—</text>
								<subclause id="id580029C9D8824424A2017AC2AD3B8B74"><enum>(I)</enum><text>for 2009,
				$6,500,000; and</text>
								</subclause><subclause id="idC728BAD825A147E6AE71BD64DC4D2AAF"><enum>(II)</enum><text>for a subsequent
				year, the dollar amount specified in this clause for the previous year
				increased by the annual percentage increase in the consumer price index (all
				items; U.S. city average) as of June of such previous
				year.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idEF0B8208047947D2801AA1A99958A5B4"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of section 154(b)(1)(A) of the Medicare Improvements
			 for Patients and Providers Act of 2008 (Public Law 110–275; 122 Stat.
			 2564).</text>
