			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Classified Information
			 Procedures Reform Act of 2009</short-title></quote>.</text>
			</section><section id="ID22464f15514140d6bf654eae4047f50c"><enum>202.</enum><header>Definitions</header>
				<subsection id="idD3BE41C852FB41C692509AAADD2F1494"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1 of the
			 Classified Information Procedures Act (18 U.S.C. App.) is amended—</text>
					<paragraph id="idEF2D73791BB1466786F658851EC4CD93"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (c); and</text>
					</paragraph><paragraph id="id6241F959BE3B4DF6BEB410F19B86900E"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="idEBFDD655ADEF45A186788D95E159779C" style="OLC">
							<subsection id="IDde94a1e474f64336a9bff0c35bd88c3b"><enum>(b)</enum><text><quote>Disclosure</quote>,
				as used in this Act—</text>
								<paragraph id="id7391A2F2D06444E29F3FF80B88EF66B1"><enum>(1)</enum><text>means the
				release, transmittal, or making available of, or providing access to,
				classified information to any person (including a defendant or counsel for a
				defendant) during discovery, or to a participant or member of the public at any
				proceeding; and</text>
								</paragraph><paragraph id="idD573DB3F05814C0094ABE3B9DE49139D"><enum>(2)</enum><text>does not include
				the release, transmittal, or making available of, or providing access to,
				classified information by the defendant to an attorney representing the
				defendant in a matter who has received—</text>
									<subparagraph id="id1255840B3DD147AEBBBAD5DDBF9A167B"><enum>(A)</enum><text>the necessary
				security clearance to receive the classified information; and</text>
									</subparagraph><subparagraph id="id410E2CF7732549F2BED3A759B2F74CAE"><enum>(B)</enum><text>if the classified
				information has been designated as sensitive compartmented information or
				special access program information, any additional required authorization to
				receive the classified
				information.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id42EB13B82CF946CEAD523885148BC848"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>Section 501(3) of the Immigration and
			 Nationality Act (8 U.S.C. 1531(3)) is amended by striking <quote>section
			 1(b)</quote> and inserting <quote>section 1</quote>.</text>
				</subsection></section><section id="IDd009731a6a5b490297d56c97b8b6d25c"><enum>203.</enum><header>Ex parte
			 authorizations under the Classified Information Procedures Act</header><text display-inline="no-display-inline">Section 4 of the Classified Information
			 Procedures Act (18 U.S.C. App.) is amended—</text>
				<paragraph id="ID51620076b6eb4994828f1e6816ee837e"><enum>(1)</enum><text>in the second
			 sentence—</text>
					<subparagraph id="id298263C117ED40CAAB9517D252C0AD77"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph id="ID5b747b31b0324c1bb5a8729a64485b6e"><enum>(B)</enum><text>by striking
			 <quote>authorization in the form of a written statement to be inspected</quote>
			 and inserting <quote>authorization, together with any argument in support of
			 that request, in the form of a statement made ex parte and to be
			 considered</quote>; and</text>
					</subparagraph></paragraph><paragraph id="ID8f6cf2e4b965497ab71540ecf4e5f582"><enum>(2)</enum><text>in the third
			 sentence—</text>
					<subparagraph id="id1B90D0AB897B43B6BDEACF6620EC3084"><enum>(A)</enum><text>by striking
			 <quote>If the court enters an order granting relief following such an ex parte
			 showing, the</quote> and inserting <quote>The</quote>; and</text>
					</subparagraph><subparagraph id="ID7c3a3e7877b24180a8216ad6907a6c9f"><enum>(B)</enum><text>inserting
			 <quote>, and the transcript of any argument and any summary of the classified
			 information the defendant seeks to obtain,</quote> after <quote>text of the
			 statement of the United States</quote>.</text>
					</subparagraph></paragraph></section><section id="ID4eae6cd4b758458bbdb01cbd4a58a6ad"><enum>204.</enum><header>Application of
			 Classified Information Procedures Act to nondocumentary
			 information</header><text display-inline="no-display-inline">Section 4 of the
			 Classified Information Procedures Act (18 U.S.C. App.), as amended by section
			 203 of this Act, is amended—</text>
				<paragraph id="IDfe6543ad884c415f8998caf7330e5ee5"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="traditional">and access to</header-in-text></quote> after
			 <quote><header-in-text level="section" style="traditional">of</header-in-text></quote>;</text>
				</paragraph><paragraph id="IDdbcb8877b20648699812c3580a6df1ce"><enum>(2)</enum><text>by inserting
			 <quote>(a) <header-in-text level="subsection" style="traditional">In
			 general</header-in-text>.—</quote> before <quote>The court, upon</quote>;
			 and</text>
				</paragraph><paragraph id="ID65de2abbe2ef42068f7b438f084f6d92"><enum>(3)</enum><text>by adding the
			 following at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id13370E85F4784844B3A9D9924177F909" style="traditional">
						<subsection id="IDb9bf31e8369f4171b3f716668ca20de2"><enum>(b)</enum><header>Access to other
				classified information</header><paragraph commented="no" display-inline="yes-display-inline" id="idF7BAFE8840F74F31B025173CA0582A40"><enum>(1)</enum><text>If the defendant seeks
				access through deposition under the Federal Rules of Criminal Procedure or
				otherwise to nondocumentary information from a potential witness or other
				person which the defendant knows or reasonably believes is classified, the
				defendant shall notify the attorney for the United States and the district
				court in writing. Such notice shall specify with particularity the classified
				information sought by the defendant and the legal basis for such access. At a
				time set by the court, the United States may oppose such access to the
				classified information.</text>
							</paragraph><paragraph id="ID4d4591eae8484e469320aa4e852c37d2" indent="up1"><enum>(2)</enum><text>If, after consideration of any
				objection raised by the United States, including any objection asserted on the
				basis of privilege, the court determines that the defendant is legally entitled
				to have access to the information specified in a notice made under paragraph
				(1), the United States may request the substitution of a summary of the
				classified information or the substitution of a statement admitting relevant
				facts that the classified information would tend to prove.</text>
							</paragraph><paragraph id="ID4a8549bceb8d4858b6d4d2bbb75a3786" indent="up1"><enum>(3)</enum><text>The court shall permit the United
				States to make an objection to access to classified information under paragraph
				(1) or a request for a substitution under paragraph (2) in the form of a
				statement made ex parte and to be considered by the court alone. The entire
				text of the statement of the United States, and any summary of the classified
				information the defendant seeks to obtain, shall be sealed and preserved in the
				records of the court and made available to the appellate court in the event of
				an appeal.</text>
							</paragraph><paragraph id="IDf9f925baf176479182899b633ab03409" indent="up1"><enum>(4)</enum><text>A court shall grant the request of
				the United States to substitute a summary of the classified information or to
				substitute a statement admitting relevant facts that the classified information
				would tend to prove under paragraph (2) if the court finds that the summary or
				statement will provide the defendant with substantially the same ability to
				make a defense as would disclosure of the specific classified
				information.</text>
							</paragraph><paragraph id="ID91a6a08459aa4c89aef3c1d9fab9adae" indent="up1"><enum>(5)</enum><text>A defendant may not obtain access to
				classified information subject to this subsection except as provided in this
				subsection. Any proceeding, whether by deposition under the Federal Rules of
				Criminal Procedure or otherwise, in which a defendant seeks to obtain access to
				classified information subject to this subsection not previously authorized by
				a court for disclosure under this subsection shall be discontinued or may
				proceed only as to lines of inquiry not involving the classified
				information.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID2140b7170ad4466bb2a0fd2a8480b983"><enum>205.</enum><header>Interlocutory
			 appeals under the Classified Information Procedures Act</header><text display-inline="no-display-inline">Section 7(a) of the Classified Information
			 Procedures Act (18 U.S.C. App.) is amended by adding the following at the end:
			 <quote>The right of the United States to appeal under this subsection applies
			 without regard to whether the order appealed from was entered under this
			 Act.</quote>.</text>
			</section></title><title id="id2F679FD8CC2E4987989730D3EDDD114B"><enum>III</enum><header>Additional
			 Government Weapons Against Terrorism Act</header>
			<section id="id553BA4EA4A424AFFB244D8E858B26F55"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Additional Government Weapons
			 Against Terrorism Act of 2009</short-title></quote>.</text>
			</section><section id="IDb2d48391d81c469c9a628811be0994c9"><enum>302.</enum><header>Prevention and
			 deterrence of material support for terrorist suicide bombings</header>
				<subsection id="IDf7f7588037814dbf8ac35cdc965a5111"><enum>(a)</enum><header>In
			 general</header><text>Chapter 113B of title 18, United States Code, is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC6F8D561984E4EAEA37608BE6B1916A4" style="USC">
						<section id="ID1ff30aa57b6c422cabbacf81c4901119"><enum>2339E.</enum><header>Providing
				material support to international terrorism</header>
							<subsection id="ID22a20490402347698d7b104f88e2c706"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="ID7ddfa3bad6c34b6da8eaa45dcc4a2d20"><enum>(1)</enum><text>the term
				<term>facility of interstate or foreign commerce</term> has the meaning given
				that term in section 1958;</text>
								</paragraph><paragraph id="ID01a8fd7cb84943b49685374c18985d1d"><enum>(2)</enum><text>the term
				<term>material support or resources</term> has the meaning given that term in
				section 2339A;</text>
								</paragraph><paragraph id="IDb0d13226b3aa48f1b2af531b88f9a522"><enum>(3)</enum><text>the term
				<term>perpetrator of an act</term> includes any person who—</text>
									<subparagraph id="IDe69f7af17124423d9df42bc892dfb278"><enum>(A)</enum><text>commits the
				act;</text>
									</subparagraph><subparagraph id="IDe574380a88e34007ab9751431423f9b8"><enum>(B)</enum><text>aids, abets,
				counsels, commands, induces, or procures the commission of the act; or</text>
									</subparagraph><subparagraph id="IDf0a0d790ce31492db39530d515c0cedd"><enum>(C)</enum><text>attempts, plots,
				or conspires to commit the act; and</text>
									</subparagraph></paragraph><paragraph id="ID95bd8232e0b349eb893f4df0053a919c"><enum>(4)</enum><text>the term
				<term>serious bodily injury</term> has the meaning given that term in section
				1365.</text>
								</paragraph></subsection><subsection id="ID943d2171abd840719a44a2ff2b1ceeaa"><enum>(b)</enum><header>Prohibition</header><text>Whoever,
				in a circumstance described in subsection (c), provides, or attempts or
				conspires to provide, material support or resources to the perpetrator of an
				act of international terrorism, to a family member of the perpetrator of an act
				of international terrorism perpetrator, or to any other person, with the intent
				to facilitate, reward, or encourage that act or other acts of international
				terrorism, shall be fined under this title, imprisoned not more than 15 years,
				or both, and, if death results, shall be imprisoned for any term of years or
				for life.</text>
							</subsection><subsection id="IDb659a01436584746aa83834f27b46559"><enum>(c)</enum><header>Jurisdictional
				bases</header><text>A circumstance referred to in this subsection is
				that—</text>
								<paragraph id="IDaf3cf4558ca849f3a68805eef5ae0d60"><enum>(1)</enum><text>the offense
				occurs in or affects interstate or foreign commerce;</text>
								</paragraph><paragraph id="ID60e8f49ad3944e71bb0775f9c6f5cb79"><enum>(2)</enum><text>the offense
				involves the use of the mails or a facility of interstate or foreign
				commerce;</text>
								</paragraph><paragraph id="ID0115da7578574ba08fea65836a6db4df"><enum>(3)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that affects interstate or foreign commerce or would have affected interstate
				or foreign commerce had the act been consummated;</text>
								</paragraph><paragraph id="IDb0bcb93e42e6458d972862f9adab27a4"><enum>(4)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that violates the criminal laws of the United States;</text>
								</paragraph><paragraph id="IDdbd79a7914ee4410959979302c7e5917"><enum>(5)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that is designed to influence the policy or affect the conduct of the United
				States Government;</text>
								</paragraph><paragraph id="ID3a350272a84846628081e1eae8feae95"><enum>(6)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that occurs in part within the United States and is designed to influence the
				policy or affect the conduct of a foreign government;</text>
								</paragraph><paragraph id="ID7e92f0103e1b42adb2d022a41599a75a"><enum>(7)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that causes or is designed to cause death or serious bodily injury to a
				national of the United States while that national is outside the United States,
				or substantial damage to the property of a legal entity organized under the
				laws of the United States (including any State, district, commonwealth,
				territory, or possession of the United States) while that property is outside
				of the United States;</text>
								</paragraph><paragraph id="IDba874a790f3b4931b4eea60df991e86b"><enum>(8)</enum><text>the offense
				occurs in whole or in part within the United States, and an offender intends to
				facilitate, reward, or encourage an act of international terrorism that is
				designed to influence the policy or affect the conduct of a foreign government;
				or</text>
								</paragraph><paragraph id="ID19b60c61f2c54762a4e57fb741b69c99"><enum>(9)</enum><text>the offense
				occurs in whole or in part outside of the United States, and an offender is a
				national of the United States, a stateless person whose habitual residence is
				in the United States, or a legal entity organized under the laws of the United
				States (including any State, district, commonwealth, territory, or possession
				of the United
				States).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDaa5e934c46d6474cbdd1d44b92e10cba"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
					<paragraph id="ID7b8fcba5047f4bbfaaf3fcbc508eeceb"><enum>(1)</enum><header>Table of
			 sections</header><text>The table of sections for chapter 113B of title 18,
			 United States Code, is amended by adding at the end the following:</text>

			 attempts and conspiracies to obtain military-type training from a foreign
			 terrorist organization</header><text display-inline="no-display-inline">Section
			 2339D(a) of title 18, United States Code, is amended by inserting <quote>, or
			 attempts or conspires to do so,</quote> after <quote>foreign terrorist
			 organization</quote>.</text>

			 use of false travel documents</header>
				<subsection id="ID042c5351a02042f7ac45efc85e6dcccc"><enum>(a)</enum><header>In
			 general</header><text>Section 1028 of title 18, United States Code, is
			 amended—</text>
					<paragraph id="IDbd021b877e4d4035bf871e788b3c2da2"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="USC">false
			 travel documents,</header-in-text></quote> after <quote><header-in-text level="section" style="USC">identification
			 documents,</header-in-text></quote>;</text>
					</paragraph><paragraph id="ID4b9683834f4f49558c0c5931db044d7d"><enum>(2)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="ID9d73daa975b24397b9d78e95e921d648"><enum>(A)</enum><text>in paragraph (1),

									</subparagraph><subparagraph id="IDd1869997a9d942f68ce52e3d5e8d6474"><enum>(B)</enum><text>was issued by or
				under the authority of a commercial airline or mass transportation provider,
				and was subsequently altered for purposes of
				deceit.</text>

				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="IDa48dbaccc9b54742b747f62d1e41c6bb"><enum>(6)</enum><text>in subsection

			 unwarranted release of convicted terrorists and sex offenders pending
			 sentencing or appeal</header>
				<subsection id="IDfaedf1eb67cf4782a476216e49d61f9b"><enum>(a)</enum><header>In
			 general</header><text>Section 3145 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id9593CEBB4DAC4D3298442DF0F413DE54" style="OLC">
						<subsection id="IDc1d095d16076410598d5bcaae0f1c63b"><enum>(d)</enum><header>Application</header><text>No
				person shall be eligible for release under subsection (c) based on exceptional
				reasons if the person is being detained pending sentencing or appeal in a case
				involving—</text>
							<paragraph id="idCB9A9DD115D04D47AE8CF786B8B7C99E"><enum>(1)</enum><text>an offense under
				section 2332b of this title;</text>
							</paragraph><paragraph id="id1DE6BD9385A04C98A01CAC5602F74918"><enum>(2)</enum><text>an offense listed
				in section 2332b(g)(5)(B) of this title for which a maximum term of
				imprisonment of 10 years or more is prescribed; or</text>
							</paragraph><paragraph id="id121579C07C4448CBAD70150315373CB5"><enum>(3)</enum><text>an offense
				involving a minor victim under section 1201, 1591, 2241, 2242, 2244(a)(1),
				2245, 2251, 2251A, 2252(a)(1), 2252(a)(2), 2252(a)(3), 2252A(a)(1),
				2252A(a)(2), 2252A(a)(3), 2252A(a)(4), 2260, 2421, 2422, 2423, or 2425 of this
				title.</text>
