			 1861 note, and 50 U.S.C. 1862 note) is amended by striking <quote>2009</quote>
			 and inserting <quote>2013</quote>.</text>

			 sunset relating to individual terrorists as agents of foreign powers</header>
				<paragraph id="idF114F6AE8FD04C3584A7035BC4E09F51"><enum>(1)</enum><header>In
			 general</header><text>Section 6001(b) of the Intelligence Reform and Terrorism
			 Prevention Act of 2004 (Public Law 108–458; 50 U.S.C. 1801 note) is amended to
			 read as follows:</text>

				(50 U.S.C. 1801(b)(1)), as added by subsection (a), is repealed effective
				December 31, 2013.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1a44613776b541bfac288b26994a9712"><enum>(2)</enum><header>Transition
				provision</header><text>Notwithstanding paragraph (1), subparagraph (C) of
				section 101(b)(1) of the Foreign Intelligence Surveillance Act of 1978 (50
				U.S.C. 1801(b)(1)) shall continue to apply after December 31, 2013, with
				respect to any particular foreign intelligence investigation or with respect to
				any particular offense or potential offense that began or occurred before
				December 31,
				2013.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE8A2D5E9AF11405690B3C69C2694903F"><enum>(2)</enum><header>Conforming
			 amendment</header>
					<subparagraph id="idBCB6638BC61D4899BD784EB2D34ECE3A"><enum>(A)</enum><header>In
			 general</header><text>Section 601(a)(2) of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1871(a)(2)) is amended by striking the
			 semicolon at the end and inserting <quote>pursuant to subsection (b)(2) of
			 section 6001 of the Intelligence Reform and Terrorism Prevention Act of 2004
			 (Public Law 108–458; 50 U.S.C. 1801 note);</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06CDD2AF5DA74C119162C7936748BC89"><enum>(B)</enum><header>Effective
			 date</header><text>The amendment made by subparagraph (A) shall take effect on
			 December 31, 2013.</text>

			 security letters</header>

			 general</header><text>Effective on December 31, 2013, the following provisions
			 of law are repealed:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1D640FFBE4B446ABBC8E9051DA781F0E"><enum>(A)</enum><text>Section 2709 of
			 title 18, United States Code.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE67F4ACB6834E4FBC2F5807CB96F663"><enum>(B)</enum><text>Section 1114(a)(5)
			 of the Right to Financial Privacy Act of 1978 (12 U.S.C. 3414(a)(5)).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4346D16A34B1489CB1CCDCD0AE60EE93"><enum>(C)</enum><text>Subsections (a)
			 and (b) of section 626 of the Fair Credit Reporting Act (15 U.S.C.
			 1681u).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA09CC449D47A431CB1AEDD12E4C65484"><enum>(D)</enum><text>Section 627 of the
			 Fair Credit Reporting Act (15 U.S.C. 1681v).</text>

			 National Security Act of 1947 (50 U.S.C. 436).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id385E5BB255024DD495E1FF0C99DF69F7"><enum>(2)</enum><header display-inline="yes-display-inline">Transition provision</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the

			 18</header><text>Title 18, United States Code, is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="id68BAA994714545C0B3E9B2996023EEE4"><enum>(i)</enum><text>in the table of
			 sections for chapter 121, by striking the item relating to section 2709;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idABBDC39941A34F9EADA4134B12B82D75"><enum>(ii)</enum><text>by striking
			 section 3511; and</text>

			 Reporting Act</header><text>The Fair Credit Reporting Act (15 U.S.C. 1681) is

			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861) is
			 amended—</text>
				<paragraph id="idF89AB9A201D846C5935C4ABF138BBF0C"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="OLC">certain
			 business records</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">tangible things</header-in-text></quote>;</text>
				</paragraph><paragraph id="idDC0FCC2D96654FD381F535ED7FF80BFA"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking
			 subparagraphs (A) and (B) and inserting the following:</text>

				power or an agent of a foreign power;</text>
								</subclause><subclause changed="deleted" committee-id="SSJU00" id="id367F460F40A34221BD0B9C4D783291F9" indent="up1" reported-display-style="strikethrough"><enum>(II)</enum><text>are relevant to
				the activities of a suspected agent of a foreign power who is the subject of
				such authorized investigation; or</text>
								</subclause><subclause changed="deleted" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="idAF47E63AD9274345B1CFFD15D98E5A7F" indent="up1" reported-display-style="strikethrough"><enum>(III)</enum><text>pertain to an
				individual in contact with, or known to, a suspected agent of a foreign power;
				and</text>
								</subclause></clause></subparagraph><subparagraph id="ID6b7de10644b34fc4bd031d361cf23288"><enum>(B)</enum><text>a statement of
				proposed minimization procedures.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE81AFD5B2077441EA02250C4909BE4D1"><enum>(3)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id4FDE50A490B5458BAE8B2FD12D41B961"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="idE498BDCCD25C44E59726BD70646C7C8C"><enum>(i)</enum><text>by inserting

					<subparagraph commented="no" display-inline="no-display-inline" id="ID9feb40a5305747e2818f535d202b08cd"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">Section 401 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1841) is amended by adding at the end the
			 following:</text>
						<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id6C5197F28BA74980AFCB567E13054723" reported-display-style="strikethrough" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="ID80394579b26e42ed924a44f027424ff6"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>minimization
				procedures</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDb88e0f6d273d47d6800fbf9f46aae9b8"><enum>(A)</enum><text display-inline="yes-display-inline">specific procedures that are reasonably
				designed in light of the purpose and technique of an order for the installation
				and use of a pen register or trap and trace device, to minimize the acquisition
				and retention, and prohibit the dissemination, of nonpublicly available
				information concerning unconsenting United States persons consistent with the
				need of the United States to obtain, produce, and disseminate foreign
				intelligence information;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDecc182087619473ca6ad44903231e7cf"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly
				available information, which is not foreign intelligence information, as
				defined in section 101(e)(1), shall not be disseminated in a manner that
				identifies any United States person, without such person’s consent, unless such
				person’s identity is necessary to understand foreign intelligence information
				or assess its importance; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82a756ef51eb4de3972ea5f4c0279447"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B),
				procedures that allow for the retention and dissemination of information that
				is evidence of a crime which has been, is being, or is about to be committed
				and that is to be retained or disseminated for law enforcement
				purposes.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3A163DC2A84E42818BFC4353ED8E4866"><enum>(B)</enum><header display-inline="yes-display-inline">Pen registers and trap and trace
			 devices</header><text display-inline="yes-display-inline">Section 402 of the
			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1842) is
			 amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID72aa9f47083148f3887f421c1fa4b851"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idDE9984D8D4B545D6BDF0A44C8DCEFCCC"><enum>(I)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, and
			 that the proposed minimization procedures meet the definition of minimization
			 procedures under this title</quote> before the period at the end; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id980E97D882DA47BD9AD3CDB137D5EE0D"><enum>(II)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)—</text>
								<item commented="no" display-inline="no-display-inline" id="id1919F40056204CB288F092B30E4AF699"><enum>(aa)</enum><text display-inline="yes-display-inline">in clause (ii)(II), by striking
			 <quote>and</quote> after the semicolon; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="idCD81D6D9A3404B1CAA2C90EAF6E04CC2"><enum>(bb)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

								<subsection commented="no" display-inline="no-display-inline" id="idCA08630B9AA14249808BBDF06A82B066"><enum>(h)</enum><text display-inline="yes-display-inline">At or before the end of the period of time
				for which the installation and use of a pen register or trap and trace device
				is approved under an order or an extension under this section, the judge may
				assess compliance with the minimization procedures by reviewing the
				circumstances under which information concerning United States persons was
				acquired, retained, or
				disseminated.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa18dea7cba74a2abb05800ef707a4d1"><enum>(C)</enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 403 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1843) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="id2BA5BBA4BA8E4AFBA299FDE51C8A0FEC"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as (d);
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idAC0F340F22594C59AB4A344BD1229DCF"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
							<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idF46B50E75C3749018E314B8AE0A3371B" reported-display-style="strikethrough" style="OLC">

				emergency installation and use of a pen register or trap and trace device under
				this section, the Attorney General shall require that the minimization
				procedures required by this title for the issuance of a judicial order be

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39FF099F02CD4C8881935B0C67811654"><enum>(D)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Section 405(a) of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1845(a)) is amended by striking
			 <quote>provisions of</quote> and inserting <quote>minimization procedures
			 required under</quote>.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="idB4D275955B45478F90818903B69E8F0A" reported-display-style="strikethrough"><enum>5.</enum><header>Limitations on
			 disclosure of national security letters</header>
			<subsection id="id2F92600DF150442185B65C6C700AC833"><enum>(a)</enum><header>In
			 general</header><text>Section 2709 of title 18, United States Code, is amended
			 by striking subsection (c) and inserting the following:</text>

							<subparagraph id="idB59C7C6F8A484F078826E4E6FE86114A"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (4) is provided, no wire
				or electronic communication service provider, or officer, employee, or agent
				thereof, that receives a request under subsection (a), shall disclose to any
				person the particular information specified in the certification during the
				time period to which the certification applies, which may be not longer than 1
				year.</text>
							</subparagraph><subparagraph id="id12A63FA1452142309FBFB6E9C6703435"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="id891922E4935345B290CBB3963E54736E"><enum>(i)</enum><text>a danger to the
				national security of the United States;</text>
								</clause><clause id="idD0AC179C891043A2BDE6EAFC515425F2"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id81E70715ADE3497FB65D85EB7DD1A8E7"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="id0CE0E3941D6C4490BF4DD5B8CE5E8AA7"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="ID7bcd6e8ea6b2485b9e6792a81ca76757"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="ID5657f502970f4acd8dca8eebac363a33"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communication service provider, or
				officer, employee, or agent thereof, that receives a request under subsection
				(a) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="ID13e84d7d38754bb8b7eeae982afcdbc0"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="IDe84f0a74792a47e2b5d169b130b4f37e"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="ID4302ef3de4f54b8d96cde540cb76b1a8"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="ID3c9c2b39a8e24518963610ac051886cc"><enum>(B)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="IDaf2a26b254ac42a58b08288ad13874b8"><enum>(C)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="IDe264ebf598a645f8b09815482b46cb2b"><enum>(3)</enum><header>Extension</header><text>The
				Director of the Federal Bureau of Investigation, or a designee of the Director
				whose rank shall be no lower than Deputy Assistant Director at Bureau
				headquarters or a Special Agent in Charge in a Bureau field office, may extend
				a nondisclosure requirement for additional periods of not longer than 1 year
				if, at the time of each extension, a new certification is made under paragraph
				(1)(B) and notice is provided to the recipient of the applicable request that
				the nondisclosure requirement has been extended and the recipient has the right
				to judicial review of the nondisclosure requirement.</text>
						</paragraph><paragraph id="id8155AACA99404902AC38621225BA024F"><enum>(4)</enum><header>Right to
				judicial review</header>
							<subparagraph id="id35CFF67A57934AC4AE15E96FA1E07D5B"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communications service provider that
				receives a request under subsection (a) shall have the right to judicial review
				of any applicable nondisclosure requirement and any extension thereof.</text>
							</subparagraph><subparagraph id="id106F2708A9634F6EA78F6BA18FC8D171"><enum>(B)</enum><header>Timing</header>
								<clause id="id640CF72291F1409780347E30A1FFB8C7"><enum>(i)</enum><header>In
				general</header><text>A request under subsection (a) shall state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall notify the Government not later than 21 days after the date of
				receipt of the request.</text>
								</clause><clause id="idDD95917864B2495CAB4343B695D551CD"><enum>(ii)</enum><header>Extension</header><text>A
				notice that the applicable nondisclosure requirement has been extended under
				paragraph (3) shall state that if the recipient wishes to have a court review
				the nondisclosure requirement, the recipient shall notify the Government not
				later than 21 days after the date of receipt of the notice.</text>
								</clause></subparagraph><subparagraph id="id441BB1B2610E4C2BA6617074FD792F05"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of this
				title.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04A461DBC0CF43BC98BEF84991563BC9"><enum>(5)</enum><header>Termination</header><text>If
				the facts supporting a nondisclosure requirement cease to exist prior to the
				applicable time period of the nondisclosure requirement, an appropriate
				official of the Federal Bureau of Investigation shall promptly notify the wire
				or electronic service provider, or officer, employee, or agent thereof, subject
				to the nondisclosure requirement that the nondisclosure requirement is no
				longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE9B1CF8D634B4F33AEFF0894E04ACBB3"><enum>(b)</enum><header>Identity of
			 financial institutions and credit reports</header><text>Section 626 of the Fair
			 Credit Reporting Act (15 U.S.C. 1681u) is amended by striking subsection (d)
			 and inserting the following:</text>

				receives a request or order under subsection (a), (b), or (c), shall disclose
				to any person the particular information specified in the certification during
				the time period to which the certification applies, which may be not longer
				than 1 year.</text>
							</subparagraph><subparagraph id="idDD23B27BE81A4076991772EB0FAC34DB"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="idA91EBD5949A647A5862349DF1EA61D67"><enum>(i)</enum><text>a danger to the
				national security of the United States;</text>
								</clause><clause id="id587FA338296345FF9B5555A219A38B3F"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="idE709A3B6ABA1420DA72FB27EC513B223"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="id0D538E58C29D475C89DA33576160273E"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id9DFD30910250441EB01930CE263C1FE7"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id7C97E016B6A0469BABC37A7D75B58C93"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request or order under subsection (a), (b), or
				(c) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="idFCF0AC24F0FD4F2382745B0EB12AAF10"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request or
				order;</text>
								</clause><clause id="id5DB52A62D4CC4A5083378D870AC7ADB1"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request or order;
				or</text>
								</clause><clause id="id81EA281AA591495496FBD9BAA5904C3C"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="id9382417D3D4B4FE197D8F0FE8BC7ED57"><enum>(B)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request or order is issued under subsection (a), (b), or
				(c) in the same manner as the person to whom the request or order is
				issued.</text>
							</subparagraph><subparagraph id="idE3EFFCAF139A4A58A8B7D6D2BB977357"><enum>(C)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="idC359A067F8D7432B8BF0960187B66CD6"><enum>(3)</enum><header>Extension</header><text>The
				Director of the Federal Bureau of Investigation, or a designee of the Director
				whose rank shall be no lower than Deputy Assistant Director at Bureau
				headquarters or a Special Agent in Charge in a Bureau field office, may extend
				a nondisclosure requirement for additional periods of not longer than 1 year
				if, at the time of each extension, a new certification is made under paragraph
				(1)(B) and notice is provided to the recipient of the applicable request or
				order that the nondisclosure requirement has been extended and the recipient
				has the right to judicial review of the nondisclosure requirement.</text>
						</paragraph><paragraph id="idA6F772887EAC48468FB8290839E680E0"><enum>(4)</enum><header>Right to
				judicial review</header>
							<subparagraph id="id7B00C546D68E4598B3570CF739DAB3BD"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request or
				order under subsection (a), (b), or (c) shall have the right to judicial review
				of any applicable nondisclosure requirement and any extension thereof.</text>
							</subparagraph><subparagraph id="idDC0DCD2C98E94107AC3C40BDA8C5BFB6"><enum>(B)</enum><header>Timing</header>
								<clause id="id11BFCE6F894A48EB9CE4F6393EABBBCE"><enum>(i)</enum><header>In
				general</header><text>A request or order under subsection (a), (b), or (c)
				shall state that if the recipient wishes to have a court review a nondisclosure
				requirement, the recipient shall notify the Government not later than 21 days
				after the date of receipt of the request or order.</text>
								</clause><clause id="idC333B809261E413DB3C45481159BB389"><enum>(ii)</enum><header>Extension</header><text>A
				notice that the applicable nondisclosure requirement has been extended under
				paragraph (3) shall state that if the recipient wishes to have a court review
				the nondisclosure requirement, the recipient shall notify the Government not
				later than 21 days after the date of receipt of the notice.</text>
								</clause></subparagraph><subparagraph id="id2BD6CB1E67694330BAEF7C7B5446F0A2"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request or order under subsection
				(a), (b), or (c) makes a notification under subparagraph (B), the Government
				shall initiate judicial review under the procedures established in section 3511
				of title 18, United States Code.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id298BC59671E149508F64A60DED8CDCEB"><enum>(5)</enum><header>Termination</header><text>If
				the facts supporting a nondisclosure requirement cease to exist prior to the
				applicable time period of the nondisclosure requirement, an appropriate
				official of the Federal Bureau of Investigation shall promptly notify the
				consumer reporting agency, or officer, employee, or agent thereof, subject to
				the nondisclosure requirement that the nondisclosure requirement is no longer
				in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE2085FB98C8F4BF19DA3312E08AFF61B"><enum>(c)</enum><header>Disclosures to
			 Governmental agencies for counterterrorism purposes</header><text>Section 627
			 of the Fair Credit Reporting Act (15 U.S.C. 1681v) is amended by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idA7EE650A788D41A9B75123383CE4B87D" reported-display-style="strikethrough" style="OLC">
					<subsection id="id1412ED28761C4146A31EB43D670D136C"><enum>(c)</enum><header>Prohibition of

						<paragraph id="id4E51758FCB384AF58FE1A5BAF37AFBC9"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="idCDDCB224C8B549E6AED6E838676A30B3"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (4) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person the
				particular information specified in the certification during the time period to
				which the certification applies, which may be not longer than 1 year.</text>
							</subparagraph><subparagraph id="id3AA36CB71E834F3B8FD91329D763D389"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of a government agency
				authorized to conduct investigations of intelligence or counterintelligence
				activities or analysis related to international terrorism, or a designee,
				certifies that, absent a prohibition of disclosure under this subsection, there
				may result—</text>
								<clause id="id7966998B88A44E409F58094EBFA4777D"><enum>(i)</enum><text>a danger to the
				national security of the United States;</text>
								</clause><clause id="id961C44BF706E4CB6A6BDE705B64A7E8E"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="idFA16872B3A7C4F418AC89EA84F091652"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="id27C3F22E4DEE4AA9BE2D1786EEDBDC77"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id0B99F0D8F52D45229D53A2DB9DA37F79"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id200DDB33085141B49C6F31BC74B2685C"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="id9F04EADD56CC430FA9E493B155AD147B"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="idD0F3239872394428A8B46FCAD3211613"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id3A6729844F6745579C95482D13AC6FDE"><enum>(iii)</enum><text>other persons as
				permitted by the head of the government agency authorized to conduct
				investigations of intelligence or counterintelligence activities or analysis
				related to international terrorism, or a designee.</text>
								</clause></subparagraph><subparagraph id="id36618074FBCA448E9EC8EF08A0BC60B8"><enum>(B)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="id8163CE23C8EC4A9185791CC8FA047CBE"><enum>(C)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="idE7C1DDACD2AC4E478F3C7D72FE6092F4"><enum>(3)</enum><header>Extension</header><text>The
				head of a government agency authorized to conduct investigations of
				intelligence or counterintelligence activities or analysis related to
				international terrorism, or a designee, may extend a nondisclosure requirement
				for additional periods of not longer than 1 year if, at the time of each
				extension, a new certification is made under paragraph (1)(B) and notice is
				provided to the recipient of the applicable request that the nondisclosure
				requirement has been extended and the recipient has the right to judicial
				review of the nondisclosure requirement.</text>
						</paragraph><paragraph id="id0672E2F4BBA2468E8807BAAD39754F13"><enum>(4)</enum><header>Right to
				judicial review</header>
							<subparagraph id="id64A846BCA6BD4F58B927EE799BD5DAF9"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request under
				subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement and any extension thereof.</text>
							</subparagraph><subparagraph id="id1982A7F3476B4886AEE6593263015C7A"><enum>(B)</enum><header>Timing</header>
								<clause id="id1C3356425289477BBB8E398596B967BB"><enum>(i)</enum><header>In
				general</header><text>A request under subsection (a) shall state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall notify the Government not later than 21 days after the date of
				receipt of the request.</text>
								</clause><clause id="idF6F9E72F8C984F11A916509A203823D0"><enum>(ii)</enum><header>Extension</header><text>A
				notice that the applicable nondisclosure requirement has been extended under
				paragraph (3) shall state that if the recipient wishes to have a court review
				the nondisclosure requirement, the recipient shall notify the Government not
				later than 21 days after the date of receipt of the notice.</text>
								</clause></subparagraph><subparagraph id="idE3061BC7536341EDB9B4D125E3B654C7"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id123486DEE9324A3893F4B0B2AA9C5E2C"><enum>(5)</enum><header>Termination</header><text>If
				the facts supporting a nondisclosure requirement cease to exist prior to the
				applicable time period of the nondisclosure requirement, an appropriate
				official of the government agency authorized to conduct investigations of
				intelligence or counterintelligence activities or analysis related to
				international terrorism shall promptly notify the consumer reporting agency, or
				officer, employee, or agent thereof, subject to the nondisclosure requirement
				that the nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2A51859EE3C5408A823E41C111501341"><enum>(d)</enum><header>Financial
			 records</header><text>Section 1114(a)(5) of the Right to Financial Privacy Act
			 (12 U.S.C. 3414(a)(5)) is amended by striking subparagraph (D) and inserting
			 the following:</text>

						<clause id="id9C3ADE6DF1794E4AA2E6067307509496"><enum>(i)</enum><header>Prohibition</header>
							<subclause id="idE046A1F1F46444D899FCA51E6E4E94D8"><enum>(I)</enum><header>In
				general</header><text>If a certification is issued under subclause (II) and
				notice of the right to judicial review under clause (iv) is provided, no
				financial institution, or officer, employee, or agent thereof, that receives a
				request under subparagraph (A), shall disclose to any person the particular
				information specified in the certification during the time period to which the
				certification applies, which may be not longer than 1 year.</text>
							</subclause><subclause id="id5028E88C29D549A4A099872C471FCC38"><enum>(II)</enum><header>Certification</header><text>The
				requirements of subclause (I) shall apply if the Director of the Federal Bureau
				of Investigation, or a designee of the Director whose rank shall be no lower
				than Deputy Assistant Director at Bureau headquarters or a Special Agent in
				Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subparagraph, there may result—</text>
								<item id="id1311E533903B48ABA3286FFA9BB1FFF5"><enum>(aa)</enum><text>a danger to the
				national security of the United States;</text>
								</item><item id="idBDBE0BAC02E74FBEBAD8D27528EF5735"><enum>(bb)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</item><item id="id4674C41CF6004BFF8730814B849BAEF3"><enum>(cc)</enum><text>interference with
				diplomatic relations; or</text>
								</item><item id="idF07901730D154BE28F505FD85911845F"><enum>(dd)</enum><text>danger to the
				life or physical safety of any person.</text>
								</item></subclause></clause><clause id="id2472CD13D498406EB633484495454B41"><enum>(ii)</enum><header>Exception</header>
							<subclause id="id2CAFE82B4615469D8B3C281782FA7A75"><enum>(I)</enum><header>In
				general</header><text>A financial institution, or officer, employee, or agent
				thereof, that receives a request under subparagraph (A) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<item id="id9A7F79ACBED942FEB9F3618B87055480"><enum>(aa)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</item><item id="idE1EDE49FF1B1406DBBE3E1D9905374DD"><enum>(bb)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</item><item id="idACBC7A0E4CFB4DF79CE55F807F2C3C08"><enum>(cc)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</item></subclause><subclause id="id6A205BC5314248509F159FA1367AE956"><enum>(II)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under subclause
				(I) shall be subject to the nondisclosure requirements applicable to a person
				to whom a request is issued under subparagraph (A) in the same manner as the
				person to whom the request is issued.</text>
							</subclause><subclause id="id675F64399FE74D219F17E06DCA3EE5AA"><enum>(III)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subclause (I) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subclause></clause><clause id="id72AA6A1444F046A58E0D807875B6DB1D"><enum>(iii)</enum><header>Extension</header><text>The
				Director of the Federal Bureau of Investigation, or a designee of the Director
				whose rank shall be no lower than Deputy Assistant Director at Bureau
				headquarters or a Special Agent in Charge in a Bureau field office, may extend
				a nondisclosure requirement for additional periods of not longer than 1 year
				if, at the time of each extension, a new certification is made under clause

				general</header><text>A request under subparagraph (A) shall state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall notify the Government not later than 21 days after the date of
				receipt of the request.</text>
								</item><item id="id9A04099F8987448E9674744C3AC18AA0"><enum>(bb)</enum><header>Extension</header><text>A
				notice that the applicable nondisclosure requirement has been extended under
				clause (iii) shall state that if the recipient wishes to have a court review
				the nondisclosure requirement, the recipient shall notify the Government not
				later than 21 days after the date of receipt of the notice.</text>
								</item></subclause><subclause id="idFF03D45B47554E6C85CB5A19EFA87EAE"><enum>(III)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subparagraph (A)
				makes a notification under subclause (II), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id104162D8B3DD4561AD7D489E44C329AF"><enum>(v)</enum><header>Termination</header><text>If
				the facts supporting a nondisclosure requirement cease to exist prior to the
				applicable time period of the nondisclosure requirement, an appropriate
				official of the Federal Bureau of Investigation shall promptly notify the
				financial institution, or officer, employee, or agent thereof, subject to the
				nondisclosure requirement that the nondisclosure requirement is no longer in
				effect.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id213BD1C55BFB47D689A02A160DDA465E"><enum>(e)</enum><header>Requests by
			 authorized investigative agencies</header><text>Section 802 of the National
			 Security Act of 1947 (50 U.S.C. 436), is amended by striking subsection (b) and
			 inserting the following:</text>

					<subsection id="id2216FC506DB941248B7D679EE388FB8D"><enum>(b)</enum><header>Prohibition of

						<paragraph id="idDD278B90C4EF4AF99B3820DAEE9BA950"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="idE22D147136324A20A4B15F5691C61270"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (4) is provided, no
				governmental or private entity, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person the
				particular information specified in the certification during the time period to
				which the certification applies, which may be not longer than 1 year.</text>
							</subparagraph><subparagraph id="id5915FD3E5F2E48AAB04A93168F4719ED"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of an authorized
				investigative agency described in subsection (a), or a designee, certifies
				that, absent a prohibition of disclosure under this subsection, there may
				result—</text>
								<clause id="id7E8C37DC521B4F1B9373D6863CCAA5EA"><enum>(i)</enum><text>a danger to the
				national security of the United States;</text>
								</clause><clause id="idD801004FEF504FC1B015B0EF93D75BC5"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id4DA3DB676CAD470ABF74A19DF4C9BFBB"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="id0EBFCE010E3B4F6A9E03682606E33D74"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="idC380A230C64F4DAA91F9940E781B939E"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id3E64A97368E9412B8829F54FD2893B82"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity, or officer, employee,
				or agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="idC06C6936518F4922A86C1E39875FE51A"><enum>(i)</enum><text>those persons to
				whom disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="idD7D57482A6A9404FA248BED6FAB1C6C7"><enum>(ii)</enum><text>an attorney in
				order to obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id14F06505D92F4EE6A9CCAF3F21D872EA"><enum>(iii)</enum><text>other persons as
				permitted by the head of the authorized investigative agency described in
				subsection (a).</text>
								</clause></subparagraph><subparagraph id="id6707F4F409444F589EFCB2B0F975FA3C"><enum>(B)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="id9EDFBCB59FCB4F8D8A79298AEF3844A0"><enum>(C)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id6D16CB501B574C169DA101FAE5B66C3F"><enum>(3)</enum><header>Extension</header><text>The
				head of an authorized investigative agency described in subsection (a), or a
				designee, may extend a nondisclosure requirement for additional periods of not
				longer than 1 year if, at the time of each extension, a new certification is
				made under paragraph (1)(B) and notice is provided to the recipient of the
				applicable request that the nondisclosure requirement has been extended and the
				recipient has the right to judicial review of the nondisclosure
				requirement.</text>
						</paragraph><paragraph id="idBD30947A67DC42629F043B199CEBFE83"><enum>(4)</enum><header>Right to
				judicial review</header>
							<subparagraph id="id49C8D1B267814A39AABB8288C01A1638"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity that receives a request
				under subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement and any extension thereof.</text>

				general</header><text>A request under subsection (a) shall state that if the

				recipient shall notify the Government not later than 21 days after the date of
				receipt of the request.</text>
								</clause><clause id="id11F6DBEEC69845249F48CD65A6A85F16"><enum>(ii)</enum><header>Extension</header><text>A
				notice that the applicable nondisclosure requirement has been extended under
				paragraph (3) shall state that if the recipient wishes to have a court review
				the nondisclosure requirement, the recipient shall notify the Government not
				later than 21 days after the date of receipt of the notice.</text>
								</clause></subparagraph><subparagraph id="idA3D9EADCA0824398873E4B95412CBE71"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate

				or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="id46236717A1F44439A3DB74ADC997270F" reported-display-style="strikethrough"><enum>6.</enum><header>Judicial review
			 of FISA orders and national security letters</header>
			<subsection id="id1FC7D84D18B046C1AB637B7ACA2E5483"><enum>(a)</enum><header>FISA</header><text>Section
			 501(f)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(f)(2)) is amended—</text>
				<paragraph id="id4CE45E2453454D749961452B2E81A805"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="idA706982F32794306A801AEA9378B4169"><enum>(A)</enum><text>in clause
			 (i)—</text>
						<clause id="id8ABCAEBBE32F4A988B0AFE753CFA4466"><enum>(i)</enum><text>by striking
			 <quote>a production order</quote> and inserting <quote>a production order or
			 nondisclosure order</quote>; and</text>
						</clause><clause id="idCEE51DCB52984AF080244479E7916681"><enum>(ii)</enum><text>by striking
			 <quote>Not less than 1 year</quote> and all that follows;</text>
						</clause></subparagraph><subparagraph id="id091B442546EA4670B2B170B7AF49658A"><enum>(B)</enum><text>in clause (ii), by
			 striking <quote>production order or nondisclosure</quote>; and</text>
					</subparagraph></paragraph><paragraph id="id81A957298FF4482CB5C842E128B642FB"><enum>(2)</enum><text>in subparagraph
			 (C)—</text>
					<subparagraph id="id2EFE6871572F4FF295C9A3BA2A12AA1E"><enum>(A)</enum><text>by striking clause
			 (ii); and</text>
					</subparagraph><subparagraph id="id90EDB30B58514D418F64407DB3635D82"><enum>(B)</enum><text>by redesignating
			 clause (iii) as clause (ii).</text>
					</subparagraph></paragraph></subsection><subsection id="IDe3f17d57dd9849368c2362e97ed550ff"><enum>(b)</enum><header>Judicial review
			 of national security letters</header><text>Section 3511(b) of title 18, United
			 States Code, is amended to read as follows:</text>

					<subsection id="ID0a684a6852784b9996ca410cea15476e"><enum>(b)</enum><header>Nondisclosure</header>
						<paragraph id="IDc4702fc320a2483cb2ccbdd8e3451580"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="id7FC28763062D4AAF8EC720F023E52812"><enum>(A)</enum><header>Notice</header><text>If
				a recipient of a request or order for a report, records, or other information
				under section 2709 of this title, section 626 or 627 of the Fair Credit
				Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to
				Financial Privacy Act (12 U.S.C. 3414), or section 802 of the National Security
				Act of 1947 (50 U.S.C. 436), wishes to have a court review a nondisclosure
				requirement imposed in connection with the request, the recipient shall notify
				the Government not later than 21 days after the date of receipt of the request
				or of notice that an applicable nondisclosure requirement has been
				extended.</text>
							</subparagraph><subparagraph id="idED456BCCFFFD414FBD423DB0F25F211E"><enum>(B)</enum><header>Application</header><text>Not
				later than 21 days after the date of receipt of a notification under
				subparagraph (A), the Government shall apply for an order prohibiting the
				disclosure of particular information about the existence or contents of the
				relevant request or order. An application under this subparagraph may be filed
				in the district court of the United States for any district within which the
				authorized investigation that is the basis for the request or order is being
				conducted. The applicable nondisclosure requirement shall remain in effect
				during the pendency of proceedings relating to the requirement.</text>
							</subparagraph><subparagraph id="idA2BED03AABBA4D9FB81B08148B7FF9BE"><enum>(C)</enum><header>Consideration</header><text>A
				district court of the United States that receives an application under
				subparagraph (B) should rule expeditiously, and may issue a nondisclosure order
				for a period of not longer than 1 year, unless the facts justify a longer
				period of nondisclosure.</text>
							</subparagraph><subparagraph id="idE22FC78475DE4D0A9099EE96C76D1BC4"><enum>(D)</enum><header>Denial</header><text>If
				a district court of the United States rejects an application for a
				nondisclosure order or extension thereof, the nondisclosure requirement shall
				no longer be in effect.</text>
							</subparagraph></paragraph><paragraph id="id2891F9B9EBB743E891C40416E5B61880"><enum>(2)</enum><header>Application
				contents</header><text>An application for a nondisclosure order or extension
				thereof under this subsection shall include—</text>
							<subparagraph id="idA532CE57875C47F794FBEF82AE7EEE90"><enum>(A)</enum><text>a statement of the
				facts indicating that, absent a prohibition of disclosure under this
				subsection, there may result—</text>
								<clause id="idD15ADAD2F6D94752BD5D358EB0FE2F6A"><enum>(i)</enum><text>a danger to the
				national security of the United States;</text>
								</clause><clause id="idF19AE1C39326465E9997D10CE1F97FD1"><enum>(ii)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id8D3FEC4C42384FF79E2BC6AFDF41A990"><enum>(iii)</enum><text>interference
				with diplomatic relations; or</text>
								</clause><clause id="idF0DDEB92D48A42D9931597CF6DE1DA49"><enum>(iv)</enum><text>danger to the
				life or physical safety of any person; and</text>
								</clause></subparagraph><subparagraph id="ID301ad0ad6a4647e6876a0ce293f125e5"><enum>(B)</enum><text>the time period
				during which the Government believes the nondisclosure requirement should
				apply.</text>
							</subparagraph></paragraph><paragraph id="IDfc7f794023ad498d905f1a7fbd06c708"><enum>(3)</enum><header>Standard</header><text>A
				district court of the United States may issue a nondisclosure requirement order
				or extension thereof under this subsection if the court determines that there
				is reason to believe that disclosure of the information subject to the
				nondisclosure requirement during the applicable time period will result
				in—</text>
							<subparagraph id="idA57DF0E4C44646479664C354EBBAAFBB"><enum>(A)</enum><text>a danger to the
				national security of the United States;</text>
							</subparagraph><subparagraph id="id509D3F9A72CF4593A1E34F64AE35F538"><enum>(B)</enum><text>interference with
				a criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="idF7D7C4A91B1544028911E1E43427883B"><enum>(C)</enum><text>interference with
				diplomatic relations; or</text>
							</subparagraph><subparagraph id="id4D8AAE18071E49CEB0A8C6FE5F9BBADF"><enum>(D)</enum><text>danger to the life
				or physical safety of any person.</text>

				nondisclosure order under this subsection may be renewed for additional periods
				of not longer than 1 year, unless the facts of the case justify a longer period
				of nondisclosure, upon submission of an application meeting the requirements of
				paragraph (2), and a determination by the court that the circumstances
				described in paragraph (3) continue to
				exist.</text>

			 501(g) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1861(g))

			 title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0F8F273E743041C594A75D1ADA9BA04A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>certifies in
			 writing</quote> and inserting <quote>provides a written certification by the
			 Director (or a designee)</quote>; and</text>

				</paragraph></subsection><subsection id="id87D3C55F16C840B2A17596248B21DABA"><enum>(b)</enum><header>Identity of
			 financial institutions and credit reports</header><text>Section 626 of the Fair
			 Credit Reporting Act (15 U.S.C. 1681u) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idA2C4E940D2FB46F6AE07857B95B199A2"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>has determined in writing, that such information is sought
			 for</quote> and inserting <quote>provides to the consumer reporting agency a
			 written determination that includes a statement of facts showing that there are
			 reasonable grounds to believe that such information is relevant to</quote>;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32EFFE924F514C35A32B2EDE0BB801D4"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>has determined in writing that such information is sought
			 for</quote> and inserting <quote>provides to the consumer reporting agency a
			 written determination that includes a statement of facts showing that there are
			 reasonable grounds to believe that such information is relevant
			 to</quote>.</text>
				</paragraph></subsection><subsection id="idE5ADF432933B407DAA5CC6C45C8E7571"><enum>(c)</enum><header>Disclosures to
			 Governmental agencies for counterterrorism purposes</header><text>Section
			 627(a) of the Fair Credit Reporting Act (15 U.S.C. 1681v(a)) is amended by
			 inserting <quote>that includes a statement of facts showing that there are
			 reasonable grounds to believe</quote> before <quote>that such information is
			 necessary for</quote>.</text>
			</subsection><subsection id="id9B427E52115443E69840F5D70E2646C3"><enum>(d)</enum><header>Financial
			 records</header><text>Section 1114(a)(5)(A) of the Right to Financial Privacy
			 Act (12 U.S.C. 3414(a)(5)(A)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id872968DCF27642199BD9595D158F91F7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>certifies in
			 writing</quote> and inserting <quote>provides a written certification by the
			 Director (or a designee)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC04039777D6143CA8A913B02F97AE86F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>that such records are
			 sought for foreign counter intelligence purposes</quote> and inserting
			 <quote>that includes a statement of facts showing that there are reasonable
			 grounds to believe that such records are relevant to a foreign
			 counterintelligence investigation</quote>.</text>
				</paragraph></subsection><subsection id="idE0F1E2418CD54475872C3EEF25E7F2AD"><enum>(e)</enum><header>Requests by
			 authorized investigative agencies</header><text>Section 802(a)(3) of the
			 National Security Act of 1947 (50 U.S.C. 436(a)(3)), is amended—</text>
				<paragraph id="id006BF43FE8DE4141A69B4BFF89FDB755"><enum>(1)</enum><text>by redesignating
			 subparagraphs (B), (C), and (D) as subparagraphs (C), (D), and (E),
			 respectively; and</text>
				</paragraph><paragraph id="id2FFC783ED7554FB2B769EADEA1535734"><enum>(2)</enum><text>by inserting after
			 subparagraph (A) the following:</text>

			 and trap and trace devices</header>
				<paragraph id="ID1b0805dd9e714e678e4488efdc3791e2"><enum>(1)</enum><header>Audits</header><text>The
			 Inspector General of the Department of Justice shall perform comprehensive
			 audits of the effectiveness and use, including any improper or illegal use, of
			 pen registers and trap and trace devices under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 (50 U.S.C. 1841 et seq.) during the
			 period beginning on January 1, 2007 and ending on December 31, 2012.</text>
				</paragraph><paragraph id="ID347381109727432abb8dc5d983cd1914"><enum>(2)</enum><header>Requirements</header><text>The
			 audits required under paragraph (1) shall include—</text>
					<subparagraph id="IDba299cb9696b45d99aed947dfd5cdd24"><enum>(A)</enum><text>an examination of
			 each instance in which the Attorney General or any other attorney for the
			 Government submitted an application for an order or extension of an order under
			 title IV of the Foreign Intelligence Surveillance Act of 1978, including
			 whether the court granted, modified, or denied the application (including an
			 examination of the basis for any modification or denial);</text>
					</subparagraph><subparagraph id="idF2FAB4840F4A462A8F670F5AD54FC656"><enum>(B)</enum><text>an examination of
			 each instance in which the Attorney General authorized the installation and use
			 of a pen register or trap and trace device on an emergency basis under section
			 403 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1843);</text>
					</subparagraph><subparagraph id="ID970eb3d4faa04b4795d712ebe1dcd954"><enum>(C)</enum><text>whether the
			 Federal Bureau of Investigation requested that the Department of Justice submit
			 an application for an order or extension of an order under title IV of the
			 Foreign Intelligence Surveillance Act of 1978 and the request was not submitted
			 to the court (including an examination of the basis for not submitting the
			 application);</text>
					</subparagraph><subparagraph id="ID49c24912b33d4d9b898d0a2cf18ee840"><enum>(D)</enum><text>whether
			 bureaucratic or procedural impediments to the use of pen registers and trap and
			 trace devices under title IV of the Foreign Intelligence Surveillance Act of
			 1978 prevent the Federal Bureau of Investigation from taking full advantage of
			 the authorities provided under that title;</text>
					</subparagraph><subparagraph id="IDfc1f39ecfaf04e1baa026277a1d801c0"><enum>(E)</enum><text>any noteworthy
			 facts or circumstances relating to the use of a pen register or trap and trace
			 device under title IV of the Foreign Intelligence Surveillance Act of 1978,
			 including any improper or illegal use of the authority provided under that
			 title; and</text>
					</subparagraph><subparagraph id="IDdc892447a38145c6a972df9a2019eb79"><enum>(F)</enum><text>an examination of
			 the effectiveness of the authority under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 as an investigative tool, including—</text>
						<clause id="ID0939abdf379c4758b39ead46e843ba2e"><enum>(i)</enum><text>the importance of
			 the information acquired to the intelligence activities of the Federal Bureau
			 of Investigation or any other department or agency of the Federal
			 Government;</text>
						</clause><clause id="IDefd75249d3dd412e897af1ccc1d450e3"><enum>(ii)</enum><text>the manner in
			 which the information is collected, retained, analyzed, and disseminated by the
			 Federal Bureau of Investigation, including any direct access to the information
			 provided to any other department, agency, or instrumentality of Federal, State,
			 local, or tribal governments or any private sector entity;</text>
						</clause><clause id="ID5245e0aa0e604e0d9bcbba656d2dc597"><enum>(iii)</enum><text>with respect to
			 calendar years 2010 through 2012, an examination of the minimization procedures
			 used in relation to pen registers and trap and trace devices under title IV of
			 the Foreign Intelligence Surveillance Act of 1978 and whether the minimization
			 procedures protect the constitutional rights of United States persons;</text>
						</clause><clause id="ID38840c9640604babb6e822b784fa9272"><enum>(iv)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation used information acquired under a
			 pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to produce an analytical intelligence
			 product for distribution within the Federal Bureau of Investigation, to the
			 intelligence community (as defined in section 3(4) of the National Security Act
			 of 1947 (50 U.S.C. 401a(4))), or to other Federal, State, local, or tribal
			 government departments, agencies, or instrumentalities; and</text>
						</clause><clause id="ID9b5fd467faf24aeeb4402cf8cdcb8f70"><enum>(v)</enum><text>whether, and how
			 often, the Federal Bureau of Investigation provided information acquired under
			 a pen register or trap and trace device under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 to law enforcement authorities for use in
			 criminal proceedings.</text>
						</clause></subparagraph></paragraph><paragraph id="IDe07000835dbe4cd8a93bf5749a867590"><enum>(3)</enum><header>Submission
			 dates</header>
					<subparagraph id="ID8f5e42d3eebd4a56a3a5c85735e55344"><enum>(A)</enum><header>Prior
			 years</header><text>Not later than December 31, 2010, the Inspector General of
			 the Department of Justice shall submit to the Committee on the Judiciary and
			 the Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representatives a report containing the results of the audit conducted under
			 this section for calendar years 2007 thorough 2009.</text>
					</subparagraph><subparagraph id="ID82f57325aab3494aac0ae40e9d99cf7c"><enum>(B)</enum><header>Calendar years
			 2010 through 2012</header><text>Not later than December 31, 2011, and every
			 year thereafter through 2013, the Inspector General of the Department of
			 Justice shall submit to the Committee on the Judiciary and the Select Committee
			 on Intelligence of the Senate and the Committee on the Judiciary and the
			 Permanent Select Committee on Intelligence of the House of Representatives a
			 report containing the results of the audit conducted under this section for the
			 previous calendar year.</text>
					</subparagraph></paragraph><paragraph id="IDd719d0922f1f43278898444b7e77e0d1"><enum>(4)</enum><header>Prior notice to
			 Attorney General and Director of National Intelligence; comments</header>
					<subparagraph id="ID266493b54afa48a9a63e341bbf19bcb4"><enum>(A)</enum><header>Notice</header><text>Not
			 less than 30 days before the submission of a report under subparagraph (A) or
			 (B) of paragraph (3), the Inspector General of the Department of Justice shall
			 provide the report to the Attorney General and the Director of National
			 Intelligence.</text>

				accordance with subsection (a)(2) to obtain foreign intelligence information
				not concerning a United States person or to protect against international
				terrorism or clandestine intelligence activities; and</text>
								</clause><clause id="IDdf247272ab5d4f4bbd62c0a26bef7759"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1C1A7931EF1C4CFEA1C199DB96742071"><enum>(I)</enum><text>pertain to a foreign
				power or an agent of a foreign power;</text>
									</subclause><subclause changed="added" committee-id="SSJU00" id="ID1bf2e279e5d042cb99ba8c4bf49714ab" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>are relevant to the
				activities of a suspected agent of a foreign power who is the subject of such
				authorized investigation; or</text>
									</subclause><subclause changed="added" committee-id="SSJU00" id="IDf369fe8e070548738f9f2b5be8461d57" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>pertain to an

			 Surveillance Act of 1978 (50 U.S.C. 1841) is amended by adding at the end the
			 following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id8b18b314-bcd9-4eba-b474-3a513b21901f"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>minimization
				procedures</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id485b2187-da93-4165-a6b4-dad6f4addf6c"><enum>(A)</enum><text display-inline="yes-display-inline">specific procedures, that are reasonably
				designed in light of the purpose and technique of an order for the installation
				and use of a pen register or trap and trace device, to minimize the retention,
				and prohibit the dissemination, of nonpublicly available information known to
				concern unconsenting United States persons consistent with the need of the
				United States to obtain, produce, and disseminate foreign intelligence
				information;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd101b69-d70c-43c5-9970-341ed626dbde"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly
				available information, which is not foreign intelligence information shall not
				be disseminated in a manner that identifies any United States person, without
				such person’s consent, unless such person’s identity is necessary to understand
				foreign intelligence information or assess its importance; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32cee1c0-830e-469b-af91-1966f8ff2dee"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B),
				procedures that allow for the retention and dissemination of information that
				is evidence of a crime which has been, is being, or is about to be committed
				and that is to be retained or disseminated for law enforcement
				purposes.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4492d10-2dcf-418a-9a92-2811a2aad344"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(2)</added-phrase></enum><header display-inline="yes-display-inline">Pen registers and trap and trace
			 devices</header><text display-inline="yes-display-inline">Section 402 of the
			 Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1842) is
			 amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id59372832-79ca-4a5d-adcc-ce8cad6c69b3"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(A)</added-phrase></enum><text display-inline="yes-display-inline">in subsection (d)—</text>

				for which the installation and use of a pen register or trap and trace device
				is approved under an order or an extension under this section, the judge may
				assess compliance with any applicable minimization procedures by reviewing the
				circumstances under which information concerning United States persons was
				retained or
				disseminated.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id154a6c68-cefb-427e-8c3b-336c94965c45"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(3)</added-phrase></enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 403 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1843) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ida16535e1-c82a-4473-b8b8-691b46f35fd0"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(A)</added-phrase></enum><text display-inline="yes-display-inline">by redesignating subsection (c) as
			 subsection (d); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9089d332-16c6-44a5-af96-415f7f2ea845"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(B)</added-phrase></enum><text display-inline="yes-display-inline">by inserting after subsection (b) the
			 following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id7b86b8a4-98f0-4bf7-a016-3ba62d104f5f" reported-display-style="italic" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idf54b891a-70db-4c82-85a0-cd08cbe227e9"><enum>(c)</enum><text display-inline="yes-display-inline">If the Attorney General authorizes the
				emergency installation and use of a pen register or trap and trace device under
				this section, the Attorney General shall require that minimization procedures
				be followed, if
				appropriate.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8826675-d114-4200-ac00-c0d5e7b11f3d"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(4)</added-phrase></enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Section 405(a)(1) of the Foreign
			 Intelligence Surveillance Act of 1978 (50 U.S.C. 1845(a)(1)) is amended by
			 striking <quote>provisions of this section</quote> and inserting
			 <quote>minimization procedures required under this title</quote>.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="id6335e547-9ad3-4e70-ad14-295e70890893" reported-display-style="italic"><enum>5.</enum><header>Limitations on
			 disclosure of national security letters</header>
			<subsection id="id7536795c-6c25-4e9a-857f-f12f301d2bcd"><enum>(a)</enum><header>In
			 general</header><text>Section 2709 of title 18, United States Code, is amended
			 by striking subsection (c) and inserting the following:</text>

					<subsection id="ide110467a-faea-43f0-abc8-9e3c8e27d387"><enum>(c)</enum><header>Prohibition of certain
				disclosure</header>
						<paragraph id="id781f9ff3-5666-4691-8622-01c7c1b610b3"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="id62582bd9-0ce5-4adf-88bf-1136435b8732"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no wire
				or electronic communication service provider, or officer, employee, or agent
				thereof, that receives a request under subsection (a), shall disclose to any
				person that the Director of the Federal Bureau of Investigation has sought or
				obtained access to information or records under this section.</text>
							</subparagraph><subparagraph id="id8985ae92-ccdb-4deb-81bd-f1c6ea1189aa"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="idbf42c9e5-3002-4c53-9847-a26d129a4219"><enum>(i)</enum><text>a danger to the national
				security of the United States;</text>
								</clause><clause id="id2dfaec0f-608d-42cb-87a4-ad6cdc01d02b"><enum>(ii)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id16a4a767-baff-4858-865d-19bacd125ef1"><enum>(iii)</enum><text>interference with
				diplomatic relations; or</text>
								</clause><clause id="id25772468-ac8b-487a-b5e7-078ff73c001c"><enum>(iv)</enum><text>danger to the life or
				physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="idd840aaa0-ae2d-4ce4-ac45-2ce42d3a5fcc"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="idf58cddb9-d405-4d3c-8b4f-b904cc6a4246"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communication service provider, or
				officer, employee, or agent thereof, that receives a request under subsection
				(a) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="id3614e18c-5b70-4d14-9659-1bcf580f9f64"><enum>(i)</enum><text>those persons to whom
				disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id432b1ca2-87e4-42a7-870e-e8876cd4350e"><enum>(ii)</enum><text>an attorney in order to
				obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id28acaba7-f18e-4ea4-ada4-2dce951318f8"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="idFBE37D3B35EA44AB89E95E5F9AF7FF01"><enum>(B)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the Director of the Federal Bureau
				of Investigation or the designee of the Director, those persons to whom
				disclosure will be made under subparagraph (A)(i) or to whom such disclosure
				was made before the request shall be identified to the Director or the
				designee.</text>
							</subparagraph><subparagraph id="id6918fec0-a2ec-4429-b416-f0e773fa5498"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="id05d305a1-2f86-46fd-a003-d055bfc0fa87"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id5d640c23-475e-4bcd-bb09-a2c6cb198620"><enum>(3)</enum><header>Right to judicial
				review</header>
							<subparagraph id="idf6f2aac7-7998-46f6-b6ce-40832fa24d02"><enum>(A)</enum><header>In
				general</header><text>A wire or electronic communications service provider that
				receives a request under subsection (a) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph id="id030a8b35-498d-430f-997e-6026a486b559"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall state that if the recipient wishes to have a
				court review a nondisclosure requirement, the recipient shall notify the
				Government.</text>
							</subparagraph><subparagraph id="id471a6b9c-329a-43b7-b799-1a9de49151fb"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of this title,
				unless an appropriate official of the Federal Bureau of the Investigation makes
				a notification under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8897783d-8991-435d-a599-d6ce5ee3b500"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a recipient has submitted a notification
				under paragraph (3)(B), if the facts supporting a nondisclosure requirement
				cease to exist, an appropriate official of the Federal Bureau of Investigation
				shall promptly notify the wire or electronic service provider, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7e1d2505-b66e-45ac-aee9-cc80f2683e0b"><enum>(b)</enum><header>Identity of financial
			 institutions and credit reports</header><text>Section 626 of the Fair Credit
			 Reporting Act (15 U.S.C. 1681u) is amended by striking subsection (d) and
			 inserting the following:</text>

					<subsection id="id89d5b50d-3d26-4780-ad25-962c02f5c418"><enum>(d)</enum><header>Prohibition of certain
				disclosure</header>
						<paragraph id="id87470686-f866-4d6f-8917-aa7689114ea5"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="idf8767a8c-b381-4641-8701-2b07868a9a1f"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request or order under subsection (a), (b), or (c), shall disclose
				or specify in any consumer report, that the Federal Bureau of Investigation has
				sought or obtained access to information or records under subsection (a), (b),
				or (c).</text>
							</subparagraph><subparagraph id="id32002943-bdd5-4fd5-a348-72457d59135c"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the Director of the Federal
				Bureau of Investigation, or a designee of the Director whose rank shall be no
				lower than Deputy Assistant Director at Bureau headquarters or a Special Agent
				in Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subsection, there may result—</text>
								<clause id="id00a7c55c-34d4-4414-acdf-29c830a9e90f"><enum>(i)</enum><text>a danger to the national
				security of the United States;</text>
								</clause><clause id="idfa888f38-fe2c-4d54-b407-ca55809a5b51"><enum>(ii)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="ida9308afb-738f-4875-829f-ae7e77491530"><enum>(iii)</enum><text>interference with
				diplomatic relations; or</text>
								</clause><clause id="id4e329b27-e987-4070-b11d-c8b0e16927c3"><enum>(iv)</enum><text>danger to the life or
				physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id7fa4f547-59c3-418f-9749-261e3982af2e"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="idf8a8971e-9370-4364-8686-cec1c40efdbd"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request or order under subsection (a), (b), or
				(c) may disclose information otherwise subject to any applicable nondisclosure
				requirement to—</text>
								<clause id="id1afd2382-1217-4988-9a65-fde1f3311e19"><enum>(i)</enum><text>those persons to whom
				disclosure is necessary in order to comply with the request or order;</text>
								</clause><clause id="idd029f519-83f8-4254-ab35-8e96484bf146"><enum>(ii)</enum><text>an attorney in order to
				obtain legal advice or assistance regarding the request or order; or</text>
								</clause><clause id="id27c2dcf5-fb2f-4cb8-8d17-b89da0df0ead"><enum>(iii)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</clause></subparagraph><subparagraph id="id5AA81DE9F35040DDAB6F1D4CEB2AA123"><enum>(B)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the Director of the Federal Bureau
				of Investigation or the designee of the Director, those persons to whom
				disclosure will be made under subparagraph (A)(i) or to whom such disclosure
				was made before the request shall be identified to the Director or the
				designee.</text>
							</subparagraph><subparagraph id="id34d942f5-4694-4d77-a1c5-4ce9b9873871"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request or order is issued under subsection (a), (b), or
				(c) in the same manner as the person to whom the request or order is
				issued.</text>
							</subparagraph><subparagraph id="id83e66c7e-0167-4b3e-bd8f-94e0b4e5fcb0"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id91efc1c0-3cec-4968-a64a-9d039f837312"><enum>(3)</enum><header>Right to judicial
				review</header>
							<subparagraph id="id621aef60-32ca-40d1-9464-42fef9da72de"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request or
				order under subsection (a), (b), or (c) shall have the right to judicial review
				of any applicable nondisclosure requirement.</text>
							</subparagraph><subparagraph id="idda30673d-1805-4b57-b358-bc95a8e3dbde"><enum>(B)</enum><header>Notification</header><text>A
				request or order under subsection (a), (b), or (c) shall state that if the
				recipient wishes to have a court review a nondisclosure requirement, the
				recipient shall notify the Government.</text>
							</subparagraph><subparagraph id="idc004b4ee-d74f-4b1b-b685-5179eed369d7"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request or order under subsection
				(a), (b), or (c) makes a notification under subparagraph (B), the Government
				shall initiate judicial review under the procedures established in section 3511
				of title 18, United States Code, unless an appropriate official of the Federal
				Bureau of Investigation makes a notification under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec02643e-e30d-4d39-b0d2-3ef19c0ff2c8"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request or order for which a consumer reporting agency has
				submitted a notification under paragraph (3)(B), if the facts supporting a
				nondisclosure requirement cease to exist, an appropriate official of the
				Federal Bureau of Investigation shall promptly notify the consumer reporting
				agency, or officer, employee, or agent thereof, subject to the nondisclosure
				requirement that the nondisclosure requirement is no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id153a1004-f260-40a9-9cbf-c5de819621c3"><enum>(c)</enum><header>Disclosures to
			 Governmental agencies for counterterrorism purposes</header><text>Section 627
			 of the Fair Credit Reporting Act (15 U.S.C. 1681v) is amended by striking
			 subsection (c) and inserting the following:</text>

					<subsection id="idd9b37ff4-9f2b-4a2e-a8bb-af831f40d580"><enum>(c)</enum><header>Prohibition of certain
				disclosure</header>
						<paragraph id="id507787a5-8214-41a1-b961-bb2c6888e697"><enum>(1)</enum><header>Prohibition</header>
							<subparagraph id="id8288662b-ee91-46f5-886d-23f3a451aefc"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				consumer reporting agency, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person or
				specify in any consumer report, that a government agency has sought or obtained
				access to information under subsection (a).</text>
							</subparagraph><subparagraph id="ide1706381-3318-4e60-80b7-3e1247930f9d"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of a government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism, or a designee,
				certifies that, absent a prohibition of disclosure under this subsection, there
				may result—</text>
								<clause id="id0a42d0de-54bf-4431-992c-dc4e65a198ab"><enum>(i)</enum><text>a danger to the national
				security of the United States;</text>
								</clause><clause id="idb29c9a65-a011-47b6-aefd-bae6781d45dd"><enum>(ii)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id793f835b-6d84-4e08-97ce-b1252e5ec731"><enum>(iii)</enum><text>interference with
				diplomatic relations; or</text>
								</clause><clause id="ida85cf065-5a11-4949-95bb-1defca320de8"><enum>(iv)</enum><text>danger to the life or
				physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="id7bd1508a-b612-466f-82ff-4f97d4163d31"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id5bae4fec-f3d7-471b-a2e9-dc06841e4f80"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency, or officer, employee, or
				agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="id106ee67a-70a6-4b86-9064-5397d65f7fef"><enum>(i)</enum><text>those persons to whom
				disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id4a6d1704-926d-404d-baa5-52b80489dc13"><enum>(ii)</enum><text>an attorney in order to
				obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="idf52cf3f9-18ba-48ab-b71f-858c12db111d"><enum>(iii)</enum><text>other persons as
				permitted by the head of the government agency authorized to conduct
				investigations of, or intelligence or counterintelligence activities or
				analysis related to, international terrorism, or a designee.</text>
								</clause></subparagraph><subparagraph id="id7BAC30ABAF3B434EA6FD7B6F889D9543"><enum>(B)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the head of a government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism, or a designee,
				those persons to whom disclosure will be made under subparagraph (A)(i) or to
				whom such disclosure was made before the request shall be identified to the
				head of the government agency or the designee.</text>
							</subparagraph><subparagraph id="id325e51f0-c0d3-4d1f-93f7-b27f23681947"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="ide0f3a894-4a08-442a-9ec0-af57b039ff5a"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id30d4afd8-3349-4bd0-8a8d-4da407c78ef9"><enum>(3)</enum><header>Right to judicial
				review</header>
							<subparagraph id="idfb3dc4f0-0872-4e9a-859e-d02305d8dd95"><enum>(A)</enum><header>In
				general</header><text>A consumer reporting agency that receives a request under
				subsection (a) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subparagraph><subparagraph id="id10bb638d-8557-44a6-8a5b-1174ba63f288"><enum>(B)</enum><header>Notification</header><text>A
				request under subsection (a) shall state that if the recipient wishes to have a
				court review a nondisclosure requirement, the recipient shall notify the
				government.</text>
							</subparagraph><subparagraph id="id2e044c8f-33b1-4717-b414-fe52778b0302"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism makes a notification
				under paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f0e87c4-d2db-446f-b5da-434cc494a716"><enum>(4)</enum><header>Termination</header><text>In
				the case of any request for which a consumer reporting agency has submitted a
				notification under paragraph (3)(B), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the government agency
				authorized to conduct investigations of, or intelligence or counterintelligence
				activities or analysis related to, international terrorism shall promptly
				notify the consumer reporting agency, or officer, employee, or agent thereof,
				subject to the nondisclosure requirement that the nondisclosure requirement is
				no longer in
				effect.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0f260240-f1ad-4753-afd3-8d888fd1dca9"><enum>(d)</enum><header>Financial
			 records</header><text>Section 1114(a)(5) of the Right to Financial Privacy Act
			 of 1978 (12 U.S.C. 3414(a)(5)) is amended by striking subparagraph (D) and
			 inserting the following:</text>
				<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id416be3cb-a7e6-4a02-b8d3-cb16ce389fac" reported-display-style="italic" style="OLC">
					<subparagraph id="ida9cd8132-930b-4107-8d9d-ce90becfdd47" indent="up2"><enum>(D)</enum><header>Prohibition of certain
				disclosure</header>
						<clause id="id11c7bb0b-3f84-4f2f-851a-a1a39dfbff47"><enum>(i)</enum><header>Prohibition</header>
							<subclause id="idcb1176c5-a719-4e28-8a89-eb63e04d9cf3"><enum>(I)</enum><header>In
				general</header><text>If a certification is issued under subclause (II) and
				notice of the right to judicial review under clause (iii) is provided, no
				financial institution, or officer, employee, or agent thereof, that receives a
				request under subparagraph (A), shall disclose to any person that the Federal
				Bureau of Investigation has sought or obtained access to information or records
				under subparagraph (A).</text>
							</subclause><subclause id="id51b17ffc-30e7-473e-bf84-c4bb43f5a86e"><enum>(II)</enum><header>Certification</header><text>The
				requirements of subclause (I) shall apply if the Director of the Federal Bureau
				of Investigation, or a designee of the Director whose rank shall be no lower
				than Deputy Assistant Director at Bureau headquarters or a Special Agent in
				Charge of a Bureau field office, certifies that, absent a prohibition of
				disclosure under this subparagraph, there may result—</text>
								<item id="id4653e484-0eaa-4c57-8ebc-bcb33616eb0c"><enum>(aa)</enum><text>a danger to the national
				security of the United States;</text>
								</item><item id="ide812dca6-08e8-42b4-ab21-9d0ae7a2a08c"><enum>(bb)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
								</item><item id="idd9ea5190-a9fe-46ae-b58d-c06e76314440"><enum>(cc)</enum><text>interference with
				diplomatic relations; or</text>
								</item><item id="id7922ebc1-f0da-4448-95b4-0014f7ef35a5"><enum>(dd)</enum><text>danger to the life or
				physical safety of any person.</text>
								</item></subclause></clause><clause id="idf5d52511-57c2-4990-8fb1-f921563ca67b"><enum>(ii)</enum><header>Exception</header>
							<subclause id="idece8238f-0fd8-4fda-a4d3-b4ef33b384c5"><enum>(I)</enum><header>In
				general</header><text>A financial institution, or officer, employee, or agent
				thereof, that receives a request under subparagraph (A) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<item id="id2690b089-9525-4c0a-b882-b75a9b608952"><enum>(aa)</enum><text>those persons to whom
				disclosure is necessary in order to comply with the request;</text>
								</item><item id="id7f63bd93-934d-4491-afbd-488738357285"><enum>(bb)</enum><text>an attorney in order to
				obtain legal advice or assistance regarding the request; or</text>
								</item><item id="ide4072c18-34f3-46b4-bbad-fb8045bd2225"><enum>(cc)</enum><text>other persons as
				permitted by the Director of the Federal Bureau of Investigation or the
				designee of the Director.</text>
								</item></subclause><subclause id="id5B514CB4A130451F96A7B331BDD795BA"><enum>(II)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the Director of the Federal Bureau
				of Investigation or the designee of the Director, those persons to whom
				disclosure will be made under subclause (I)(aa) or to whom such disclosure was
				made before the request shall be identified to the Director or the
				designee.</text>
							</subclause><subclause id="idb3f843dd-06f7-4ea5-90a5-9780c296edb6"><enum>(III)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under subclause
				(I) shall be subject to the nondisclosure requirements applicable to a person
				to whom a request is issued under subparagraph (A) in the same manner as the
				person to whom the request is issued.</text>
							</subclause><subclause id="idd241e843-4b1b-4737-87a2-bfecbc3797d9"><enum>(IV)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subclause (I) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subclause></clause><clause id="id4be5f6a5-8b41-44cd-8736-659c57d24884"><enum>(iii)</enum><header>Right to judicial
				review</header>
							<subclause id="idd9ef7fa9-9841-409b-b4c2-c48bd10e53df"><enum>(I)</enum><header>In
				general</header><text>A financial institution that receives a request under
				subparagraph (A) shall have the right to judicial review of any applicable
				nondisclosure requirement.</text>
							</subclause><subclause id="id3c7ed1fd-fed1-464d-bd43-c03c1884eec2"><enum>(II)</enum><header>Notification</header><text>A
				request under subparagraph (A) shall state that if the recipient wishes to have
				a court review a nondisclosure requirement, the recipient shall notify the
				Government.</text>
							</subclause><subclause id="idbb14a88b-58c3-4934-a7f9-365d4cb3b0ac"><enum>(III)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subparagraph (A)
				makes a notification under subclause (II), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the Federal Bureau of
				Investigation makes a notification under clause (iv).</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id675c467a-f5ed-4ee7-9216-9ed440657b29"><enum>(iv)</enum><header>Termination</header><text>In
				the case of any request for which a financial institution has submitted a
				notification under clause (iii)(II), if the facts supporting a nondisclosure
				requirement cease to exist, an appropriate official of the Federal Bureau of
				Investigation shall promptly notify the financial institution, or officer,
				employee, or agent thereof, subject to the nondisclosure requirement that the
				nondisclosure requirement is no longer in
				effect.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idd6d8ddfe-1d83-4435-a7da-797188863717"><enum>(e)</enum><header>Requests by authorized
			 investigative agencies</header><text>Section 802 of the National Security Act
			 of 1947 (50 U.S.C. 436), is amended by striking subsection (b) and inserting
			 the following:</text>

							<subparagraph id="id5ad24b15-0ce3-403b-aa33-9bc04fdcdc0c"><enum>(A)</enum><header>In
				general</header><text>If a certification is issued under subparagraph (B) and
				notice of the right to judicial review under paragraph (3) is provided, no
				governmental or private entity, or officer, employee, or agent thereof, that
				receives a request under subsection (a), shall disclose to any person that an
				authorized investigative agency described in subsection (a) has sought or
				obtained access to information under subsection (a).</text>
							</subparagraph><subparagraph id="id41d4a949-30e2-4e99-99fe-09323dc25c2f"><enum>(B)</enum><header>Certification</header><text>The
				requirements of subparagraph (A) shall apply if the head of an authorized
				investigative agency described in subsection (a), or a designee, certifies
				that, absent a prohibition of disclosure under this subsection, there may
				result—</text>
								<clause id="ided81fdad-c7d1-4db3-aca8-bd5e98831d0b"><enum>(i)</enum><text>a danger to the national
				security of the United States;</text>
								</clause><clause id="idd6814c78-70f7-4c5d-87c0-faf34428ad1a"><enum>(ii)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
								</clause><clause id="id44e38075-010e-4fdd-bb76-f95716a19841"><enum>(iii)</enum><text>interference with
				diplomatic relations; or</text>
								</clause><clause id="idb3948a51-d2b5-4736-a5ad-de65f0b8ddb6"><enum>(iv)</enum><text>danger to the life or
				physical safety of any person.</text>
								</clause></subparagraph></paragraph><paragraph id="idf4099c72-95f9-4615-8141-4c4bc80651a7"><enum>(2)</enum><header>Exception</header>
							<subparagraph id="id000ddeca-ea98-491b-8398-49f657f5dffc"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity, or officer, employee,
				or agent thereof, that receives a request under subsection (a) may disclose
				information otherwise subject to any applicable nondisclosure requirement
				to—</text>
								<clause id="id829f2818-64d3-4134-addd-2987dcd7b656"><enum>(i)</enum><text>those persons to whom
				disclosure is necessary in order to comply with the request;</text>
								</clause><clause id="id3496a517-a6d5-4ef1-ac84-e14020b4cc0d"><enum>(ii)</enum><text>an attorney in order to
				obtain legal advice or assistance regarding the request; or</text>
								</clause><clause id="id67d4f050-85e9-4a46-a902-7ab4f0e511ba"><enum>(iii)</enum><text>other persons as
				permitted by the head of the authorized investigative agency described in
				subsection (a).</text>
								</clause></subparagraph><subparagraph id="idB35F862AD9CB4AB995F42F7B65CD2E90"><enum>(B)</enum><header>Persons necessary for
				compliance</header><text>Upon a request by the head of an authorized
				investigative agency described in subsection (a), or a designee, those persons
				to whom disclosure will be made under subparagraph (A)(i) or to whom such
				disclosure was made before the request shall be identified to the head of the
				authorized investigative agency or the designee.</text>
							</subparagraph><subparagraph id="ide837a1e6-f79c-4982-9deb-bb69830b172c"><enum>(C)</enum><header>Nondisclosure
				requirement</header><text>A person to whom disclosure is made under
				subparagraph (A) shall be subject to the nondisclosure requirements applicable
				to a person to whom a request is issued under subsection (a) in the same manner
				as the person to whom the request is issued.</text>
							</subparagraph><subparagraph id="idea223450-9500-4e8e-835e-327f575c29f9"><enum>(D)</enum><header>Notice</header><text>Any
				recipient that discloses to a person described in subparagraph (A) information
				otherwise subject to a nondisclosure requirement shall inform the person of the
				applicable nondisclosure requirement.</text>
							</subparagraph></paragraph><paragraph id="id58f33987-2caf-4ccd-a4c3-146a2984c3af"><enum>(3)</enum><header>Right to judicial
				review</header>
							<subparagraph id="iddebc1334-93e3-44f6-9d92-a7cf6c94bb15"><enum>(A)</enum><header>In
				general</header><text>A governmental or private entity that receives a request
				under subsection (a) shall have the right to judicial review of any applicable

							</subparagraph><subparagraph id="idbc113ff3-660d-4b65-86f2-507566ac8b51"><enum>(C)</enum><header>Initiation of
				proceedings</header><text>If a recipient of a request under subsection (a)
				makes a notification under subparagraph (B), the Government shall initiate
				judicial review under the procedures established in section 3511 of title 18,
				United States Code, unless an appropriate official of the authorized
				investigative agency described in subsection (a) makes a notification under
				paragraph (4).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e1f92c3-150d-4c66-966f-a2599d19a577"><enum>(4)</enum><header>Termination</header><text>In

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" committee-id="SSJU00" id="idb2209697-b598-45bb-a481-d07cd9c99f3c" reported-display-style="italic"><enum>6.</enum><header>Judicial review of FISA
			 orders and national security letters</header>
			<subsection id="id41486335-a493-4786-a3c2-a18f9dc870f4"><enum>(a)</enum><header>FISA</header><text>Section
			 501(f)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(f)(2)) is amended—</text>
				<paragraph id="id040c5368-a716-4368-bbf9-8256e65c49b9"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="idc1edc359-bb1e-45d8-889b-d16f17c6f103"><enum>(A)</enum><text>in clause (i)—</text>

				under section 2709 of this title, section 626 or 627 of the Fair Credit
				Reporting Act (15 U.S.C. 1681u and 1681v), section 1114 of the Right to
				Financial Privacy Act of 1978 (12 U.S.C. 3414), or section 802 of the National
				Security Act of 1947 (50 U.S.C. 436), wishes to have a court review a
				nondisclosure requirement imposed in connection with the request or order, the
				recipient shall notify the Government.</text>
							</subparagraph><subparagraph id="id86e76d57-5ca4-4015-bef3-c638c7ba06a0"><enum>(B)</enum><header>Application</header><text>Not
				later than 30 days after the date of receipt of a notification under
				subparagraph (A), the Government shall apply for an order prohibiting the
				disclosure of the existence or contents of the relevant request or order. An
				application under this subparagraph may be filed in the district court of the
				United States for any district within which the authorized investigation that
				is the basis for the request or order is being conducted. The applicable
				nondisclosure requirement shall remain in effect during the pendency of
				proceedings relating to the requirement.</text>
							</subparagraph><subparagraph id="idf8b6c320-4c66-416d-ae2e-38b4374c9ad2"><enum>(C)</enum><header>Consideration</header><text>A
				district court of the United States that receives an application under
				subparagraph (B) should rule expeditiously, and shall, subject to paragraph
				(3), issue a nondisclosure order that includes conditions appropriate to the
				circumstances.</text>
							</subparagraph></paragraph><paragraph id="idc1dc1ef9-d5f9-4a64-ab18-a0bd1d868f68"><enum>(2)</enum><header>Application
				contents</header><text>An application for a nondisclosure order or extension
				thereof under this subsection shall include a certification from the Attorney
				General, Deputy Attorney General, an Assistant Attorney General, or the
				Director of the Federal Bureau of Investigation, or in the case of a request by
				a department, agency, or instrumentality of the Federal Government other than
				the Department of Justice, the head or deputy head of the department, agency,
				or instrumentality, containing a statement of specific and articulable facts
				indicating that, absent a prohibition of disclosure under this subsection,
				there may result—</text>
							<subparagraph id="id353e4c6d-51fe-405e-9209-f897b92b3f80"><enum>(A)</enum><text>a danger to the national
				security of the United States;</text>
							</subparagraph><subparagraph id="id83ee5744-0d16-4e5c-b9cb-dfa4cf72b881"><enum>(B)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="id07308386-5c4b-4362-8a7b-138ac5aa62b0"><enum>(C)</enum><text>interference with
				diplomatic relations; or</text>
							</subparagraph><subparagraph id="idaeea9af8-fbdb-4802-a616-68de9ba194ab"><enum>(D)</enum><text>danger to the life or
				physical safety of any person.</text>
							</subparagraph></paragraph><paragraph id="id5eb66235-df47-4a8c-8c0e-9cd4ad6bf9ce"><enum>(3)</enum><header>Standard</header><text>A
				district court of the United States shall issue a nondisclosure requirement
				order or extension thereof under this subsection if the court determines,
				giving substantial weight to the certification under paragraph (2) that there
				is reason to believe that disclosure of the information subject to the
				nondisclosure requirement during the applicable time period will result
				in—</text>
							<subparagraph id="idb4ce2a7e-0e1b-47d5-8534-813ba8d5752c"><enum>(A)</enum><text>a danger to the national
				security of the United States;</text>
							</subparagraph><subparagraph id="id786c9753-6daa-4003-97b4-ed043dccf694"><enum>(B)</enum><text>interference with a
				criminal, counterterrorism, or counterintelligence investigation;</text>
							</subparagraph><subparagraph id="id58d70962-a881-4848-b747-9978f830226a"><enum>(C)</enum><text>interference with
				diplomatic relations; or</text>
							</subparagraph><subparagraph id="id3ed4463c-0d72-4303-b79b-0e8aca5612bc"><enum>(D)</enum><text>danger to the life or
				physical safety of any
				person.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idaa295c7e-9eb4-474e-b78e-d3224a3a4779"><enum>(c)</enum><header>Minimization</header><text>Section
			 501(g)(1) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C.
			 1861(g)(1)) is amended by striking <quote>Not later than</quote> and all that
			 follows and inserting <quote>At or before the end of the period of time for the
			 production of tangible things under an order approved under this section or at
			 any time after the production of tangible things under an order approved under
			 this section, a judge may assess compliance with the minimization procedures by
			 reviewing the circumstances under which information concerning United States
			 persons was retained or disseminated.</quote>.</text>

			 general</header><text display-inline="yes-display-inline">Section 2709 of title
			 18, United States Code, as amended by this Act, is amended—</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67482d42-fcf5-4b74-a063-ebf78582378b"><enum>(b)</enum><header>National security
			 letters</header><text>Section 119 of the USA PATRIOT Improvement and
			 Reauthorization Act of 2005 (Public Law 109–177; 120 Stat. 219) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id91eeef1f-2160-4cd0-a9fa-f42dad77246d"><enum>(1)</enum><text>in subsection (b)(1), by
			 striking <quote>2006</quote> and inserting <quote>2011</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idabe3184d-8db3-4c4d-9464-1b332869b7ce"><enum>(2)</enum><text>in subsection (c), by
			 adding at the end the following:</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id60e30a4c-a66c-44e4-9d40-629ad5d482e1"><enum>(c)</enum><header>Pen registers and trap
			 and trace devices</header>
				<paragraph id="id3212cda5-d492-48ec-a23b-c4fdf482c422"><enum>(1)</enum><header>Audits</header><text>The
			 Inspector General of the Department of Justice shall perform comprehensive
			 audits of the effectiveness and use, including any improper or illegal use, of
			 pen registers and trap and trace devices under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 (50 U.S.C. 1841 et seq.) during the
			 period beginning on January 1, 2007 and ending on December 31, 2011.</text>
				</paragraph><paragraph id="id5aa2b045-baf3-4edc-ae31-63f148f3aaa2"><enum>(2)</enum><header>Requirements</header><text>The
			 audits required under paragraph (1) shall include—</text>
					<subparagraph id="IDf2427f203ec34584a99b523730642245"><enum>(A)</enum><text>an examination of the use
			 of pen registers and trap and trace devices under title IV of the Foreign
			 Intelligence Surveillance Act of 1978 for calendar years 2007 through
			 2011;</text>
					</subparagraph><subparagraph id="id29a615ae-e88b-4b7a-9459-6eed62811426"><enum>(B)</enum><text>an examination of the
			 installation and use of a pen register or trap and trace device on emergency
			 bases under section 403 of the Foreign Intelligence Surveillance Act of 1978
			 (50 U.S.C. 1843);</text>
					</subparagraph><subparagraph id="idebb65ec2-7048-4db9-892b-41ee9f106dae"><enum>(C)</enum><text>any noteworthy facts or
			 circumstances relating to the use of a pen register or trap and trace device
			 under title IV of the Foreign Intelligence Surveillance Act of 1978, including
			 any improper or illegal use of the authority provided under that title;
			 and</text>
					</subparagraph><subparagraph id="id5117c441-7c7c-4f3b-97d1-d03e0aa08d24"><enum>(D)</enum><text>an examination of the
			 effectiveness of the authority under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 as an investigative tool, including—</text>
						<clause id="id5277e149-cfe2-4673-bd0f-833ea982549d"><enum>(i)</enum><text>the importance of the
			 information acquired to the intelligence activities of the Federal Bureau of
			 Investigation or any other department or agency of the Federal
			 Government;</text>
						</clause><clause id="id58131cda-27cf-49a0-8f52-cfbb8d743c4a"><enum>(ii)</enum><text>the manner in which the
			 information is collected, retained, analyzed, and disseminated by the Federal
			 Bureau of Investigation, including any direct access to the information
			 provided to any other department, agency, or instrumentality of Federal, State,
			 local, or tribal governments or any private sector entity;</text>
						</clause><clause id="idd7dd4bf5-0d22-48be-ae4c-c6ba71eec7db"><enum>(iii)</enum><text>with respect to
			 calendar years 2010 and 2011, an examination of the minimization procedures
			 used in relation to pen registers and trap and trace devices under title IV of
			 the Foreign Intelligence Surveillance Act of 1978 and whether the minimization
			 procedures protect the constitutional rights of United States persons (as
			 defined in section 101 of the Foreign Intelligence Surveillance Act of 1978 (50
			 U.S.C. 1801));</text>
						</clause><clause id="idbe567b3d-907d-4173-a09a-7ce4953f5d96"><enum>(iv)</enum><text>whether, and how often,
			 the Federal Bureau of Investigation used information acquired under a pen
			 register or trap and trace device under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 to produce an analytical intelligence product for
			 distribution within the Federal Bureau of Investigation, to the intelligence
			 community (as defined in section 3(4) of the National Security Act of 1947 (50
			 U.S.C. 401a(4))), or to other Federal, State, local, or tribal government
			 departments, agencies, or instrumentalities; and</text>
						</clause><clause id="id41c50515-5a71-4135-82e8-f70c0cba295e"><enum>(v)</enum><text>whether, and how often,
			 the Federal Bureau of Investigation provided information acquired under a pen
			 register or trap and trace device under title IV of the Foreign Intelligence
			 Surveillance Act of 1978 to law enforcement authorities for use in criminal
			 proceedings.</text>
						</clause></subparagraph></paragraph><paragraph id="id0ce27045-aa5e-4502-a6bc-6fd96f79b2fc"><enum>(3)</enum><header>Submission
			 dates</header>
					<subparagraph id="idac2dbd12-eee4-4578-a0c4-450bfc112942"><enum>(A)</enum><header>Prior
			 years</header><text>Not later than June 30, 2011, the Inspector General of the
			 Department of Justice shall submit to the Committee on the Judiciary and the
			 Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representatives a report containing the results of the audit conducted under
			 this section for calendar years 2007 through 2009.</text>
					</subparagraph><subparagraph id="id98d6bcc0-ca9f-4b76-8b8b-0d5f4b5b191d"><enum>(B)</enum><header>Calendar years 2010 and
			 2011</header><text>Not later than December 21, 2012, the Inspector General of
			 the Department of Justice shall submit to the Committee on the Judiciary and
			 the Select Committee on Intelligence of the Senate and the Committee on the
			 Judiciary and the Permanent Select Committee on Intelligence of the House of
			 Representatives a report containing the results of the audit conducted under
			 this section for calendar years 2010 and 2011.</text>
					</subparagraph></paragraph><paragraph id="id1a16360f-ae45-49e2-9e04-0afe05f5739b"><enum>(4)</enum><header>Prior notice to
			 Attorney General and Director of National Intelligence; comments</header>
					<subparagraph id="id7cc98ace-b134-4cad-ae04-3a612e843b8f"><enum>(A)</enum><header>Notice</header><text>Not
			 less than 30 days before the submission of a report under subparagraph (A) or
			 (B) of paragraph (3), the Inspector General of the Department of Justice shall
			 provide the report to the Attorney General and the Director of National
			 Intelligence.</text>
					</subparagraph><subparagraph id="idd9c7a63a-fcc9-48d8-83ca-b385da5c5edd"><enum>(B)</enum><header>Comments</header><text>The
			 Attorney General or the Director of National Intelligence may provide such
			 comments to be included in a report submitted under subparagraph (A) or (B) of
			 paragraph (3) as the Attorney General or the Director of National Intelligence
			 may consider necessary.</text>
					</subparagraph></paragraph><paragraph id="idf43e7b8e-c2a7-46c0-94e9-f77b1a274228"><enum>(5)</enum><header>Unclassified
			 form</header><text>A report submitted under subparagraph (A) or (B) of
			 paragraph (3) and any comments included under paragraph (4)(B) shall be in
			 unclassified form, but may include a classified annex.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="idB0D7A25BF2C54C49B6503C0BD1FE498C" reported-display-style="italic"><enum>11.</enum><header>Delayed notice search
			 warrants</header><text display-inline="no-display-inline">Section 3103a(b)(3)
			 of title 18, United States Code, is amended by striking <quote>30 days</quote>
			 and inserting <quote>7 days</quote>.</text>
		</section><section changed="added" committee-id="SSJU00" id="IDa9c96e87890a4a80bbbf8821aaa7261f" reported-display-style="italic"><enum>12.</enum><header>Minimization</header>
			<subsection id="idC6249B10D4064033A7143E7E4B47C24B"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Attorney General shall—</text>
				<paragraph id="id5858FABB01F84DB094C2DA056A17052F"><enum>(1)</enum><text>establish minimization
			 procedures governing the acquisition, retention, and dissemination by the
			 Federal Bureau of Investigation of any records received by the Federal Bureau
			 of Investigation in response to a national security letter; and</text>
				</paragraph><paragraph id="id44DC9FB9E0D5457B94FE073FFF0FBB95"><enum>(2)</enum><text>submit to the Committee
			 on the Judiciary and the Select Committee on Intelligence of the Senate and the
			 Committee on the Judiciary and the Permanent Select Committee on Intelligence
			 of the House of Representatives a copy of the minimization procedures
			 established under paragraph (1).</text>
				</paragraph></subsection><subsection id="id3D693527F21C47E48809D27FE7F8FB07"><enum>(b)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="idE5DA27EDFA88422791BF086383CC446D"><enum>(1)</enum><text>the term
			 <term>minimization procedures</term> means—</text>
					<subparagraph id="ID2e1b4a73689140089a32950a6ca8b4f4"><enum>(A)</enum><text>specific procedures that
			 are reasonably designed in light of the purpose and technique of a national
			 security letter, to minimize the acquisition and retention, and prohibit the
			 dissemination, of nonpublicly available information concerning unconsenting
			 United States persons (as defined in section 101 of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1801)) consistent with the need of the
			 United States to obtain, produce, and disseminate foreign intelligence
			 information;</text>
					</subparagraph><subparagraph id="ID8d64e79f742b4effa4f92b68001dd0f9"><enum>(B)</enum><text>procedures that require
			 that nonpublicly available information, which is not foreign intelligence
			 information (as defined in section 101(e)(1) of the Foreign Intelligence
			 Surveillance Act of 1978 (50 U.S.C. 1801(e)(1))) shall not be disseminated in a
			 manner that identifies any United States person, without the consent of the
			 United States person, unless the identity of the United States person is
			 necessary to understand foreign intelligence information or assess its
			 importance; and</text>
					</subparagraph><subparagraph id="ID27a7aca5febb4f739da68a9e67117e29"><enum>(C)</enum><text>notwithstanding
			 subparagraphs (A) and (B), procedures that allow for the retention and
			 dissemination of information that is evidence of a crime which has been, is
			 being, or is about to be committed and that is to be retained or disseminated
			 for law enforcement purposes; and</text>
					</subparagraph></paragraph><paragraph id="idB430D624515E487DB289DBDFF154F7D0"><enum>(2)</enum><text>the term <term>national
			 security letter</term> means a national security letter issued under section
			 2709 of title 18, United States Code, section 1114(a)(5) of the Right to
			 Financial Privacy Act of 1978 (12 U.S.C. 3414(5)), subsection (a) or (b) of
			 section 626 of the Fair Credit Reporting Act (15 U.S.C. 1681u), or section 627
			 of the Fair Credit Reporting Act (15 U.S.C. 1681v).</text>
