		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Organ Mountains-Desert Peaks
			 Wilderness Act</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="ID42846fbad9e349809cd7b1e935c7d1d1" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID5b2f924a5ee04becb8e9ad8cfad23b8c"><enum>(1)</enum><header>Conservation
			 area</header><text>The term <term>Conservation Area</term> means each of the
			 Organ Mountains National Conservation Area and the Desert Peaks National
			 Conservation Area established by section 4(a).</text>
			</paragraph><paragraph id="ID2f97fba4027f4d41a9c94a5fa561ddff"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Conservation Areas developed under section 4(d).</text>
			</paragraph><paragraph id="ID8700389f5a5a4a75b40e006fa6b3ce57"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="ID46d846164ca1430aa329b1c80b779f2f"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="ID515850eb3d444a0fb7449017de1c1ce1" reported-display-style="strikethrough"><enum>3.</enum><header>Designation of
			 wilderness areas</header>
			<subsection id="ID35f563b3b5fe4551b2d835f57bf8c046"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.), the following areas in the State are designated as wilderness and as
			 components of the National Wilderness Preservation System:</text>
				<paragraph id="ID70370fa89493467985f7f788088f01c1"><enum>(1)</enum><header>Aden lava flow
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 27,650 acres as
			 generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated September 16, 2009, which shall be known as the
			 <quote>Aden Lava Flow Wilderness</quote>.</text>
				</paragraph><paragraph id="ID860f478aefed4704bbbbac07105c2ddd"><enum>(2)</enum><header>Broad canyon
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 13,900 acres as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Broad Canyon Wilderness</quote>.</text>
				</paragraph><paragraph id="ID951698b519d54448a83a9c5a3ca9c9fc"><enum>(3)</enum><header>Cinder cone
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 16,950 acres as
			 generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated September 16, 2009, which shall be known as the
			 <quote>Cinder Cone Wilderness</quote>.</text>
				</paragraph><paragraph id="ID71164cfd96b94ab1812535efef9190a0"><enum>(4)</enum><header>Organ mountains
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 19,400 acres as
			 generally depicted on the map entitled <quote>Organ Mountains National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Organ Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="IDa68f5730e69b4fba9de14bdb0a2796b6"><enum>(5)</enum><header>Potrillo
			 mountains wilderness</header><text>Certain land administered by the Bureau of
			 Land Management in Doña Ana and Luna counties comprising approximately 143,450
			 acres as generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated September 16, 2009, which shall be known as the
			 <quote>Potrillo Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="ID9bc994bb0eb44c53a645e4132a30dd99"><enum>(6)</enum><header>Robledo
			 mountains wilderness</header><text>Certain land administered by the Bureau of
			 Land Management in Doña Ana County comprising approximately 17,000 acres as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Robledo Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="IDdb1113c0bd9a4b698dbdd45c667bbd4d"><enum>(7)</enum><header>Sierra de las
			 uvas wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 11,100 acres as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Sierra de las Uvas Wilderness</quote>.</text>
				</paragraph><paragraph id="ID028517681b3748078c85878f4cef525c"><enum>(8)</enum><header>Whitethorn
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana and Luna counties comprising approximately 9,600 acres
			 as generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated September 16, 2009, which shall be known as the
			 <quote>Whitethorn Wilderness</quote>.</text>
				</paragraph></subsection><subsection id="ID1660de600c70458fac764ff064ef0c22"><enum>(b)</enum><header>Management</header><text>Subject
			 to valid existing rights, the wilderness areas designated by subsection (a)
			 shall be administered by the Secretary in accordance with this Act and the
			 Wilderness Act (16 U.S.C. 1131 et seq.), except that any reference in the
			 Wilderness Act to the effective date of that Act shall be considered to be a
			 reference to the date of enactment of this Act.</text>
			</subsection><subsection id="IDff81f624739b4bd6ae99a8551291591a"><enum>(c)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land or interest in land
			 that is within the boundary of a wilderness area designated by subsection (a)
			 that is acquired by the United States shall—</text>
				<paragraph id="ID27b6d5c1346b4131b9a748a9a0f45a35"><enum>(1)</enum><text>become part of the
			 wilderness area within the boundaries of which the land is located; and</text>
				</paragraph><paragraph id="ID1906626379594e4d9fd7c78fcacd140b"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
					<subparagraph id="IDd1e61986309b4d3fb3cf6bfa74c01a05"><enum>(A)</enum><text>the Wilderness Act
			 (16 U.S.C. 1131 et seq.);</text>
					</subparagraph><subparagraph id="IDb7d31f00ca06458e859a86045c99fef5"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="ID952e4905f9e846bba2b2702448f3c530"><enum>(C)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0ddb95ad53b9447d943b75f2fcd6277c"><enum>(d)</enum><header>Grazing</header><text>Grazing
			 of livestock in the wilderness areas designated by subsection (a), where
			 established before the date of enactment of this Act, shall be administered in
			 accordance with—</text>
				<paragraph id="ID0f7ba22e3e1a42b6b86c30ecf17a6b51"><enum>(1)</enum><text>section 4(d)(4) of
			 the Wilderness Act (16 U.S.C. 1133(d)(4)); and</text>
				</paragraph><paragraph id="ID954f343e2d0045538719fd7b765bdbac"><enum>(2)</enum><text>the guidelines set
			 forth in appendix A of the Report of the Committee on Interior and Insular
			 Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text>
				</paragraph></subsection><subsection id="ID5e63e3e6e05a4d699762bbfd0abbba55"><enum>(e)</enum><header>Military
			 overflights</header><text>Nothing in this section restricts or
			 precludes—</text>
				<paragraph id="IDe15185b1caab49ebb30a644f9ee7e81c"><enum>(1)</enum><text>low-level
			 overflights of military aircraft over the wilderness areas designated by
			 subsection (a), including military overflights that can be seen or heard within
			 the wilderness areas;</text>
				</paragraph><paragraph id="ID4b698dee98ce4d3091f8cf8b25663308"><enum>(2)</enum><text>flight testing and
			 evaluation; or</text>
				</paragraph><paragraph id="ID6ce0656fdd3a4894bb5d21622f362b0c"><enum>(3)</enum><text>the designation or
			 creation of new units of special use airspace, or the establishment of military
			 flight training routes, over the wilderness areas.</text>
				</paragraph></subsection><subsection id="ID8efc51ebe6fc494394dfb01ce71eb62f"><enum>(f)</enum><header>Buffer
			 zones</header>
				<paragraph id="IDbbe75bb3c99842c683d22d73870a93c4"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this section creates a protective perimeter or
			 buffer zone around any wilderness area designated by subsection (a).</text>
				</paragraph><paragraph id="ID5e4562a38f39431681ef6f5f70614815"><enum>(2)</enum><header>Activities
			 outside wilderness areas</header><text>The fact that an activity or use on land
			 outside any wilderness area designated by subsection (a) can be seen or heard
			 within the wilderness area shall not preclude the activity or use outside the
			 boundary of the wilderness area.</text>
				</paragraph></subsection><subsection id="IDab52abf83a274c368a42068c9f6f7d88"><enum>(g)</enum><header>Potential
			 wilderness area</header>
				<paragraph id="ID066ea949783a4c39acb8f6434240db47"><enum>(1)</enum><header>Robledo
			 mountains potential wilderness area</header>
					<subparagraph id="IDc15cc117c64f4c74a26bcb005a3856d0"><enum>(A)</enum><header>In
			 general</header><text>Certain land administered by the Bureau of Land
			 Management, comprising approximately 100 acres as generally depicted as
			 <quote>Potential Wilderness</quote> on the map entitled <quote>Desert Peaks
			 National Conservation Area</quote> and dated September 16, 2009, is designated
			 as a potential wilderness area.</text>
					</subparagraph><subparagraph id="ID07a13868553642348e56ff91cc740d88"><enum>(B)</enum><header>Designation as
			 wilderness</header>
						<clause id="id2EF3FD8910804C79966D5179A581A4B6"><enum>(i)</enum><header>In
			 general</header><text>On the date on which the Secretary publishes in the
			 Federal Register the notice described in clause (ii), the potential wilderness
			 area designated under subparagraph (A) shall be—</text>
							<subclause id="idA3146DFCD2A5452A970FFAE165676B50"><enum>(I)</enum><text>designated as
			 wilderness and as a component of the National Wilderness Preservation System;
			 and</text>
							</subclause><subclause id="id0179A8BA7A334F578AEEDDA6969C4D46"><enum>(II)</enum><text>incorporated into
			 the Robledo Mountains Wilderness designated by subsection (a)(6).</text>
							</subclause></clause><clause id="id99EFE1F6BB46457D811A7F6D51A88DA0"><enum>(ii)</enum><header>Notice</header><text>The
			 notice referred to in clause (i) is notice that—</text>
							<subclause id="IDb0aa53b31e3b4df9a5ee2029e98854c1"><enum>(I)</enum><text>the communications
			 site within the potential wilderness area designated under subparagraph (A) is
			 no longer used;</text>
							</subclause><subclause id="ID579ecad6dd8f469fa83154ee35d4b55a"><enum>(II)</enum><text>the associated
			 right-of-way is relinquished or not renewed; and</text>
							</subclause><subclause id="ID1a052243c2e54d8e9ad2b52983986d63"><enum>(III)</enum><text>the conditions
			 in the potential wilderness area designated by subparagraph (A) are compatible
			 with the Wilderness Act (16 U.S.C. 1131 et seq.).</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID4fb4270fb7b344de88ac7972595d726d"><enum>(h)</enum><header>Release of
			 wilderness study areas</header><text>Congress finds that, for purposes of
			 section 603(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1782(c)), the public land in Doña Ana County administered by the Bureau of Land
			 Management not designated as wilderness by subsection (a)—</text>
				<paragraph id="ID2ab8c2274b0e473d86c265f388721d77"><enum>(1)</enum><text>has been
			 adequately studied for wilderness designation;</text>
				</paragraph><paragraph id="IDb62e6788063c4384996e69119eb5e5b7"><enum>(2)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1782(c)); and</text>
				</paragraph><paragraph id="ID09eec871833b4d9a833ffec89ffd1408"><enum>(3)</enum><text>shall be managed
			 in accordance with—</text>
					<subparagraph id="ID719237a5b8db4b4888b6e05832a4cf1e"><enum>(A)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
					</subparagraph><subparagraph id="IDaaec45d9b1a44a4a91d09c656daf2961"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="IDf0946bd9846143178de0548f630166b3"><enum>(C)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID91aaea76eacd4108a316bf2511b0d282" reported-display-style="strikethrough"><enum>4.</enum><header>Establishment of
			 national conservation areas</header>
			<subsection id="ID0ba1432f99f14af0bee5ec2cb29f900e"><enum>(a)</enum><header>Establishment</header><text>The
			 following areas in the State are established as National Conservation
			 Areas:</text>
				<paragraph id="IDbd27677208de447194abcbfb8ec3c4ad"><enum>(1)</enum><header>Organ mountains
			 national conservation area</header><text>Certain land administered by the
			 Bureau of Land Management in Doña Ana County comprising approximately 86,650
			 acres as generally depicted on the map entitled <quote>Organ Mountains National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Organ Mountains National Conservation Area</quote>.</text>
				</paragraph><paragraph id="ID7dd4a0945830490c8b1b13d39123620b"><enum>(2)</enum><header>Desert peaks
			 national conservation area</header><text>Certain land administered by the
			 Bureau of Land Management in Doña Ana County comprising approximately 75,600
			 acres, as generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated September 16, 2009, which shall be known as
			 the <quote>Desert Peaks National Conservation Area</quote>.</text>
				</paragraph></subsection><subsection id="IDa71d20c043964accaee6afd4550283ed"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the Conservation Areas are to conserve, protect, and enhance for
			 the benefit and enjoyment of present and future generations the cultural,
			 archaeological, natural, geological, historical, ecological, wildlife,
			 educational, recreational, and scenic resources of the Conservation
			 Areas.</text>
			</subsection><subsection id="IDf6fd1c382ac24bbe8a89a3f88be01b5d"><enum>(c)</enum><header>Management</header>
				<paragraph id="ID791f2d3eae16486aa099761ebe92fa6a"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the Conservation Areas—</text>
					<subparagraph id="IDb8dcfcfbfd8a4974a7123b4be70ff432"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the Conservation Areas;
			 and</text>
					</subparagraph><subparagraph id="ID16a69b1ea44042ef9e6dfc2a92454fad"><enum>(B)</enum><text>in accordance
			 with—</text>
						<clause id="ID0523e6db33d549ef928ac1a10d61bf46"><enum>(i)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
						</clause><clause id="IDa671063a4c71428ab812e999b2484a7e"><enum>(ii)</enum><text>this Act;
			 and</text>
						</clause><clause id="IDe3344821ec9443a481f821934f41b1a3"><enum>(iii)</enum><text>any other
			 applicable laws.</text>
						</clause></subparagraph></paragraph><paragraph id="IDcd581123c28f4d3fa64eb9e0f8119462"><enum>(2)</enum><header>Uses</header>
					<subparagraph id="ID30b994dd02a14d90863b34f2f9e20215"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall allow only such uses of the
			 Conservation Areas that the Secretary determines would further the purposes
			 described in subsection (b).</text>
					</subparagraph><subparagraph id="ID3e1c6ea74bd64a808574d7b302cf2d1c"><enum>(B)</enum><header>Use of motorized
			 vehicles</header>
						<clause id="IDbff5b9527fc24ec392c92a2140f2b4ab"><enum>(i)</enum><header>In
			 general</header><text>Except as needed for administrative purposes or to
			 respond to an emergency, the use of motorized vehicles in the Conservation
			 Areas shall be permitted only on roads designated for use by motorized vehicles
			 in the management plan.</text>
						</clause><clause id="ID5ad4b01eb0264e349b5cee937e47180c"><enum>(ii)</enum><header>New
			 roads</header><text>No additional road shall be built within the Conservation
			 Areas after the date of enactment of this Act unless the road is necessary for
			 public safety or natural resource protection.</text>
						</clause></subparagraph><subparagraph id="ID5ee81e0b865b4cf09fc27900db61a191"><enum>(C)</enum><header>Grazing</header><text>The
			 Secretary shall permit grazing within the Conservation Areas, where established
			 before the date of enactment of this Act—</text>
						<clause id="IDe328892349e74bd4aae73dde398b6dd9"><enum>(i)</enum><text>subject to all
			 applicable laws (including regulations) and Executive orders; and</text>
						</clause><clause id="ID1fc5c84bd6324300b0e05cd2bf722afa"><enum>(ii)</enum><text>consistent with
			 the purposes described in subsection (b).</text>
						</clause></subparagraph><subparagraph id="ID37dbc9b3cc414a0e9b5a5f825d4a6bca"><enum>(D)</enum><header>Utility
			 right-of-way upgrades</header><text>Nothing in this section precludes the
			 Secretary from renewing or authorizing the upgrading (including widening) of an
			 existing utility right-of-way through the Organ Mountains National Conservation
			 Area—</text>
						<clause id="ID31ba1b7777354d08bdb43e53f0292ec1"><enum>(i)</enum><text>in accordance
			 with—</text>
							<subclause id="id7DCD38970DAF4D11BB16B39DD3D5C59F"><enum>(I)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text>
							</subclause><subclause id="IDbc480e08e5ff4ed1bcb73cfe3c56e133"><enum>(II)</enum><text>any other
			 applicable law; and</text>
							</subclause></clause><clause id="ID58c16a3d8f4a422186933ed0928a97c5"><enum>(ii)</enum><text>subject to such
			 terms and conditions as the Secretary determines to be appropriate.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID76c055e558664cf494077b2898a86c22"><enum>(d)</enum><header>Management
			 plan</header>
				<paragraph id="ID5b4d86cf50a64dbdbb18e6ef2d819e5c"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall develop a management plan for each of the
			 Conservation Areas.</text>
				</paragraph><paragraph id="IDdfb66c4ae01042f89f7a9402486d460d"><enum>(2)</enum><header>Consultation</header><text>The
			 management plans shall be developed in consultation with—</text>
					<subparagraph id="ID899e1f393a914ef8b8429c9921e1e0f1"><enum>(A)</enum><text>State, tribal, and
			 local governments; and</text>
					</subparagraph><subparagraph id="ID35f9e2c25d3c4d3487748c866ac138e4"><enum>(B)</enum><text>the public.</text>
					</subparagraph></paragraph><paragraph id="ID1ab775532b1a4f80b25065bb3e6b3b49"><enum>(3)</enum><header>Considerations</header><text>In
			 preparing and implementing the management plans, the Secretary shall consider
			 the recommendations of Indian tribes and pueblos on methods for—</text>
					<subparagraph id="ID0a3cb95595cd463ca2aa4dfc18850e43"><enum>(A)</enum><text>ensuring access
			 to, and protection for, traditional cultural and religious sites in the
			 Conservation Areas; and</text>
					</subparagraph><subparagraph id="IDa40ed26261b54241a7cc5f0e07fddc58"><enum>(B)</enum><text>enhancing the
			 privacy and continuity of traditional cultural and religious activities in the
			 Conservation Areas.</text>
					</subparagraph></paragraph></subsection><subsection id="IDe234db3fa22448f880cc989f76ba641f"><enum>(e)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land or interest in land
			 that is within the boundary of a Conservation Area designated by subsection (a)
			 that is acquired by the United States shall—</text>
				<paragraph id="ID4de0a3f2573649c59d1bc5ffc238ec6d"><enum>(1)</enum><text>become part of the
			 Conservation Area within the boundaries of which the land is located;
			 and</text>
				</paragraph><paragraph id="ID692926406d6a46e6ab8826485e4bddd9"><enum>(2)</enum><text>be managed in
			 accordance with—</text>
					<subparagraph id="ID20bc8dc6d87249099d50e225025e639b"><enum>(A)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="IDf6442471f3f84528b395f96b7909a4ce"><enum>(B)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5abc931c3bed4e7dba3403b1a100b563"><enum>(f)</enum><header>Transfer of
			 administrative jurisdiction</header><text>On the date of enactment of this Act,
			 administrative jurisdiction over the approximately 2,050 acres of land
			 generally depicted as <quote>Transfer from DOD to BLM</quote> on the map
			 entitled <quote>Organ Mountains National Conservation Area</quote> and dated
			 September 16, 2009, shall—</text>
				<paragraph id="ID544b7a018cb04b588f4ad70c5ded3924"><enum>(1)</enum><text>be transferred
			 from the Secretary of Defense to the Secretary;</text>
				</paragraph><paragraph id="ID00a488d9d6004d1cb72b62af9cde8b06"><enum>(2)</enum><text>become part of the
			 Organ Mountains National Conservation Area; and</text>
				</paragraph><paragraph id="IDea2553eb9dbb4e098778d9c3c5ad79b8"><enum>(3)</enum><text>be managed in
			 accordance with—</text>
					<subparagraph id="ID7250eb2201d74442a983bf775050a4f4"><enum>(A)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="ID847229ba404c4a378871cf3a440c83eb"><enum>(B)</enum><text>any other
			 applicable laws.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID7fc2f836399c426a932c52c9e9abf7e0" reported-display-style="strikethrough"><enum>5.</enum><header>General
			 provisions</header>
			<subsection id="ID64d282dfb1c1457aa4223b950c81ac3a"><enum>(a)</enum><header>Maps and legal
			 descriptions</header>
				<paragraph id="IDf1dc59ab93b44d8a8cda07aff036a9b6"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file maps and legal descriptions of the
			 Conservation Areas and the wilderness areas designated by section 3(a)
			 with—</text>
					<subparagraph id="IDc61fe2e940d44748a36603eaf403cf69"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="IDc768dd63a01741db93de219f349f8f8d"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="IDb4e6658d820b4b31b61946dfbfe51519"><enum>(2)</enum><header>Force of
			 law</header><text>The maps and legal descriptions filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary may correct errors in the maps and legal descriptions.</text>
				</paragraph><paragraph id="IDc9917f8b73a94b3ba497766c28848d96"><enum>(3)</enum><header>Public
			 availability</header><text>The maps and legal descriptions filed under
			 paragraph (1) shall be on file and available for public inspection in the
			 appropriate offices of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="IDb8e7f1bd334d43108e54fb950a546e44"><enum>(b)</enum><header>National
			 landscape conservation system</header><text>The Conservation Areas and the
			 wilderness areas designated by section 3(a) shall be administered as components
			 of the National Landscape Conservation System.</text>
			</subsection><subsection id="ID2689179275124f7d8a0d78e380de67fa"><enum>(c)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the jurisdiction of the
			 State with respect to fish and wildlife located on public land in the State,
			 except that the Secretary, after consultation with the New Mexico Department of
			 Game and Fish, may designate zones where, and establish periods during which,
			 hunting, or fishing shall not be allowed for reasons of public safety,
			 administration, the protection for nongame species and their habitats, or
			 public use and enjoyment.</text>
			</subsection><subsection id="ID4673a2eea384438abfeffa28a32aed5d"><enum>(d)</enum><header>Withdrawals</header>
				<paragraph id="id62667B9F061E4275B67C4F8E9FC0B2E7"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, the Federal land within
			 the Conservation Areas, the wilderness areas designated by section 3(a), and
			 the approximately 6,300 acres of land generally depicted as <quote>Parcel
			 B</quote> on the map entitled <quote>Organ Mountains National Conservation
			 Area</quote> and dated September 16, 2009, including any land or interest in
			 land that is acquired by the United States after the date of enactment of this
			 Act within such areas, is withdrawn from—</text>
					<subparagraph id="ID5b1b3324bf774b09a02f1b86a5d94310"><enum>(A)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
					</subparagraph><subparagraph id="IDfdc8382746d44be0b5d057dc0c4e0a70"><enum>(B)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
					</subparagraph><subparagraph id="ID2feae9d0e22c471996401736a33785ec"><enum>(C)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
					</subparagraph></paragraph><paragraph id="IDe2ed06d7ee624086ae8b6d049a37fb7c"><enum>(2)</enum><header>Limited
			 withdrawal</header><text>The approximately 1,300 acres of land generally
			 depicted as <quote>Parcel A</quote> on the map entitled <quote>Organ Mountains
			 National Conservation Area</quote> and dated September 16, 2009, is withdrawn
			 in accordance with paragraph (1), except from disposal under the Act of June
			 14, 1926 (commonly known as the <quote>Recreation and Public Purposes
			 Act</quote> (43 U.S.C. 869 et seq.)).</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID66f2ecc819844b78bc06c0dec3636587" reported-display-style="strikethrough"><enum>6.</enum><header>Prehistoric
			 Trackways National Monument Boundary adjustment</header><text display-inline="no-display-inline">Section 2103(b) of the Omnibus Public Land
			 Management Act of 2009 (16 U.S.C. 431 note; Public Law 111–11; 123 Stat. 1097)
			 is amended by striking <quote>December 17, 2008</quote> and inserting
			 <quote>July 30, 2009</quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="IDb3015304c21d4a0aad477517ef2b1d3d" reported-display-style="strikethrough"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id19297143-725b-46a9-8ffc-8ab59f2b8fa6" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Organ Mountains–Desert Peaks
			 Wilderness Act</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="ide19d0664-15db-4cbb-8422-ce6b7c3e2565" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id57abdb04-bbaa-403d-9a62-e5648fe96305"><enum>(1)</enum><header>Conservation
			 area</header><text>The term <term>Conservation Area</term> means each of the
			 Organ Mountains National Conservation Area and the Desert Peaks National
			 Conservation Area established by section 4(a).</text>
			</paragraph><paragraph id="idb8d9d101-e771-43a8-b8fa-62a806b20504"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Conservation Areas developed under section 4(d).</text>
			</paragraph><paragraph id="ide745b2b7-9a91-47c5-b7cf-830cd91b99a1"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="idb83cfa51-4944-4e51-a770-859565316fdd"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means the State of New Mexico.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="id0535b5d2-3330-4598-84a4-b36040def644" reported-display-style="italic"><enum>3.</enum><header>Designation of
			 wilderness areas</header>
			<subsection id="id8afc3ed4-1c8c-44f5-a953-788fec6478fc"><enum>(a)</enum><header>In
			 general</header><text>In accordance with the Wilderness Act (16 U.S.C. 1131 et
			 seq.), the following areas in the State are designated as wilderness and as
			 components of the National Wilderness Preservation System:</text>
				<paragraph id="ideaef277b-b8ea-4590-8f03-0c363fa38ed9"><enum>(1)</enum><header>Aden lava flow
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 27,650 acres, as
			 generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated May 18, 2010, which shall be known as the <quote>Aden
			 Lava Flow Wilderness</quote>.</text>
				</paragraph><paragraph id="id29d299e4-16e4-47aa-ae34-797ff774f793"><enum>(2)</enum><header>Broad canyon
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 13,900 acres, as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Broad Canyon Wilderness</quote>.</text>
				</paragraph><paragraph id="idd828689a-01fb-4b87-98d9-c5fa55b82140"><enum>(3)</enum><header>Cinder cone
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 16,950 acres, as
			 generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Cinder Cone Wilderness</quote>.</text>
				</paragraph><paragraph id="id91bde6bd-6bf6-4ca2-b3d3-e7b53ce8e8bc"><enum>(4)</enum><header>Organ mountains
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 19,400 acres, as
			 generally depicted on the map entitled <quote>Organ Mountains National
			 Conservation Area</quote> and dated June 22, 2010, which shall be known as the
			 <quote>Organ Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="id1e60c313-c34a-4605-bb5a-9a0ceba88891"><enum>(5)</enum><header>Potrillo mountains
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana and Luna counties comprising approximately 125,850
			 acres, as generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Potrillo Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="id10c32ffd-088e-44bb-8e5a-4764dcc38f6e"><enum>(6)</enum><header>Robledo mountains
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 16,950 acres, as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Robledo Mountains Wilderness</quote>.</text>
				</paragraph><paragraph id="idc65356d4-1eea-4cf5-b33a-42fc603d3d9a"><enum>(7)</enum><header>Sierra de las uvas
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 11,100 acres, as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Sierra de las Uvas Wilderness</quote>.</text>
				</paragraph><paragraph id="id27f67b13-c138-428b-afde-885e37a8b5f8"><enum>(8)</enum><header>Whitethorn
			 wilderness</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana and Luna counties comprising approximately 9,600 acres,
			 as generally depicted on the map entitled <quote>Potrillo Mountains
			 Complex</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Whitethorn Wilderness</quote>.</text>
				</paragraph></subsection><subsection id="idde887607-e5f2-4789-9f40-f471a573b890"><enum>(b)</enum><header>Management</header><text>Subject
			 to valid existing rights, the wilderness areas designated by subsection (a)
			 shall be administered by the Secretary in accordance with this Act and the
			 Wilderness Act (16 U.S.C. 1131 et seq.) except that—</text>
				<paragraph id="ID3b8e255f58634ea3aa9d2a8fc1fbac60"><enum>(1)</enum><text>any reference in the
			 Wilderness Act to the effective date of that Act shall be considered to be a
			 reference to the date of enactment of this Act; and</text>
				</paragraph><paragraph id="ID362f89c800d34adcbb20f6e753361449"><enum>(2)</enum><text>any reference in the
			 Wilderness Act to the Secretary of Agriculture shall be considered to be a
			 reference to the Secretary of the Interior.</text>
				</paragraph></subsection><subsection id="id6c8b89b8-2ecd-4a03-a1e8-4e35d37cf04e"><enum>(c)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land or interest in land
			 that is within the boundary of a wilderness area designated by subsection (a)
			 that is acquired by the United States shall—</text>
				<paragraph id="id6f35e663-c8c0-4b49-b7eb-c9ea8549c604"><enum>(1)</enum><text>become part of the
			 wilderness area within the boundaries of which the land is located; and</text>
				</paragraph><paragraph id="id2ae7e1a0-198f-4cca-8270-cdb308bc93e9"><enum>(2)</enum><text>be managed in accordance
			 with—</text>
					<subparagraph id="id339ff989-46a0-48ae-9b15-654b42cca354"><enum>(A)</enum><text>the Wilderness Act (16
			 U.S.C. 1131 et seq.);</text>
					</subparagraph><subparagraph id="idf0befae5-45ce-4908-9f1d-3ed7830f4582"><enum>(B)</enum><text>this Act; and</text>
					</subparagraph><subparagraph id="idb5c7cd33-4086-4e69-8ba7-c469f55d1eec"><enum>(C)</enum><text>any other applicable
			 laws.</text>
					</subparagraph></paragraph></subsection><subsection id="id618ad291-ecce-4e9f-8247-735ad51a6c72"><enum>(d)</enum><header>Grazing</header><text>Grazing
			 of livestock in the wilderness areas designated by subsection (a), where
			 established before the date of enactment of this Act, shall be administered in
			 accordance with—</text>
				<paragraph id="ide07026ee-297f-485c-82a5-9f7a395ccd9e"><enum>(1)</enum><text>section 4(d)(4) of the
			 Wilderness Act (16 U.S.C. 1133(d)(4)); and</text>
				</paragraph><paragraph id="idcabb1576-554c-434f-a4f8-47e673bf401d"><enum>(2)</enum><text>the guidelines set forth
			 in Appendix A of the Report of the Committee on Interior and Insular Affairs to
			 accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text>
				</paragraph></subsection><subsection id="ide1a4051f-346f-4f44-8117-0e3abcc16aab"><enum>(e)</enum><header>Military
			 overflights</header><text>Nothing in this section restricts or
			 precludes—</text>
				<paragraph id="id58c1a7f0-f886-4284-8136-22ea6723bda8"><enum>(1)</enum><text>low-level overflights of
			 military aircraft over the wilderness areas designated by subsection (a),
			 including military overflights that can be seen or heard within the wilderness
			 areas;</text>
				</paragraph><paragraph id="ID13f807b850bc4448b4f56f54ac5c2dab"><enum>(2)</enum><text>the designation of new
			 units of special airspace over the wilderness areas or wilderness additions
			 designated by this Act; or</text>
				</paragraph><paragraph id="ID008c36d5e22a4b90883bbd700e42a64f"><enum>(3)</enum><text>the use or establishment
			 of military flight training routes over wilderness areas or wilderness
			 additions designated by this Act.</text>
				</paragraph></subsection><subsection id="id56f3b18f-e2c4-450d-ad69-360a4e45bff3"><enum>(f)</enum><header>Buffer zones</header>
				<paragraph id="idc57be001-59e4-4a56-befd-b7a77d4c9a61"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this section creates a protective perimeter or
			 buffer zone around any wilderness area designated by subsection (a).</text>
				</paragraph><paragraph id="id097f34ed-0fbe-4759-9759-6ccdee6c360d"><enum>(2)</enum><header>Activities outside
			 wilderness areas</header><text>The fact that an activity or use on land outside
			 any wilderness area designated by subsection (a) can be seen or heard within
			 the wilderness area shall not preclude the activity or use outside the boundary
			 of the wilderness area.</text>
				</paragraph></subsection><subsection id="ID7f74bbfa09ed49bdbca29ba169a0602e"><enum>(g)</enum><header>Permit
			 authorization</header><text>The Secretary may continue to authorize the
			 competitive running event permitted from 1970 through 2010 in the vicinity of
			 the boundaries of the Organ Mountains Wilderness designated by subsection
			 (a)(4) in a manner compatible with the preservation of the area as
			 wilderness.</text>
			</subsection><subsection id="ida5e99b00-4b76-489e-ba35-8e11195e182a"><enum>(h)</enum><header>Potential wilderness
			 area</header>
				<paragraph id="id5614e707-2f68-4d19-afe6-43a1c6bea42f"><enum>(1)</enum><header>Robledo mountains
			 potential wilderness area</header>
					<subparagraph id="id363b386a-3d4b-44cc-a73f-bc51b02caa52"><enum>(A)</enum><header>In
			 general</header><text>Certain land administered by the Bureau of Land
			 Management, comprising approximately 100 acres as generally depicted as
			 <quote>Potential Wilderness</quote> on the map entitled <quote>Desert Peaks
			 National Conservation Area</quote> and dated May 18, 2010, is designated as a
			 potential wilderness area.</text>
					</subparagraph><subparagraph id="ID19da22a85fec4e35b048b0897cf86e67"><enum>(B)</enum><header>Uses</header><text>The
			 Secretary shall permit only such uses on the land described in subparagraph (A)
			 that were permitted on the date of enactment of this Act.</text>
					</subparagraph><subparagraph id="id0f3ba122-30c7-4fab-b510-7d9329f0f852"><enum>(C)</enum><header>Designation as
			 wilderness</header>
						<clause id="id5c111d25-3708-4727-a5a3-ebc848508d34"><enum>(i)</enum><header>In
			 general</header><text>On the date on which the Secretary publishes in the
			 Federal Register the notice described in clause (ii), the potential wilderness
			 area designated under subparagraph (A) shall be—</text>
							<subclause id="idd653a924-af2c-455c-b801-59d0a5224512"><enum>(I)</enum><text>designated as wilderness
			 and as a component of the National Wilderness Preservation System; and</text>
							</subclause><subclause id="id6fb7baf1-0689-440c-b5b0-319fa5403f76"><enum>(II)</enum><text>incorporated into the
			 Robledo Mountains Wilderness designated by subsection (a)(6).</text>
							</subclause></clause><clause id="id1e970a70-55d4-4ad8-a966-f3fdb8db8195"><enum>(ii)</enum><header>Notice</header><text>The
			 notice referred to in clause (i) is notice that—</text>
							<subclause id="id380452b1-6534-4829-88fd-494d1c618d79"><enum>(I)</enum><text>the communications site
			 within the potential wilderness area designated under subparagraph (A) is no
			 longer used;</text>
							</subclause><subclause id="id67ffa1ed-ae48-40e0-b472-28394576e2e9"><enum>(II)</enum><text>the associated
			 right-of-way is relinquished or not renewed; and</text>
							</subclause><subclause id="idb7d21d02-8e21-4a62-bcac-57ba1478ed97"><enum>(III)</enum><text>the conditions in the
			 potential wilderness area designated by subparagraph (A) are compatible with
			 the Wilderness Act (16 U.S.C. 1131 et seq.).</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="id288164f6-b851-48c0-91d7-766dec25675a"><enum>(i)</enum><header>Release of wilderness
			 study areas</header><text display-inline="yes-display-inline">Congress finds
			 that, for purposes of section 603(c) of the Federal Land Policy and Management
			 Act of 1976 (43 U.S.C. 1782(c)), the public land in Doña Ana County
			 administered by the Bureau of Land Management not designated as wilderness by
			 subsection (a)—</text>
				<paragraph id="ide9da5c1f-b63f-4e94-927d-3d4bbbe00b68"><enum>(1)</enum><text>has been adequately
			 studied for wilderness designation;</text>
				</paragraph><paragraph id="id5fce927b-62ac-4cd3-aaf6-6e581ac98689"><enum>(2)</enum><text>is no longer subject to
			 section 603(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1782(c)); and</text>
				</paragraph><paragraph id="id10f12701-2800-4b5e-b618-eaa8805396f1"><enum>(3)</enum><text>shall be managed in
			 accordance with—</text>
					<subparagraph id="ida9393e3e-da42-4b43-a5bd-e3b2142a6278"><enum>(A)</enum><text>the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
					</subparagraph><subparagraph id="id59a5fe4d-bbd1-4dd9-85ea-261887d7576c"><enum>(B)</enum><text>this Act; and</text>
					</subparagraph><subparagraph id="id0f11849a-cd3d-40aa-8f58-e74d1522a9ad"><enum>(C)</enum><text>any other applicable
			 laws.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="id5a76d68b-83ba-4948-bb78-558effdd0a11" reported-display-style="italic"><enum>4.</enum><header>Establishment of
			 national conservation areas</header>
			<subsection id="idc55ef894-361c-4b21-89fb-717383afc4aa"><enum>(a)</enum><header>Establishment</header><text>The
			 following areas in the State are established as National Conservation
			 Areas:</text>
				<paragraph id="id693c46b4-8996-4512-9f10-23a7da842940"><enum>(1)</enum><header>Organ mountains
			 national conservation area</header><text>Certain land administered by the
			 Bureau of Land Management in Doña Ana County comprising approximately 84,950
			 acres, as generally depicted on the map entitled <quote>Organ Mountains
			 National Conservation Area</quote> and dated June 22, 2010, which shall be
			 known as the <quote>Organ Mountains National Conservation Area</quote>.</text>
				</paragraph><paragraph id="idfc3c54c1-9a8f-4a90-8af9-c239682c9aa7"><enum>(2)</enum><header>Desert peaks national
			 conservation area</header><text>Certain land administered by the Bureau of Land
			 Management in Doña Ana County comprising approximately 75,550 acres, as
			 generally depicted on the map entitled <quote>Desert Peaks National
			 Conservation Area</quote> and dated May 18, 2010, which shall be known as the
			 <quote>Desert Peaks National Conservation Area</quote>.</text>
				</paragraph></subsection><subsection id="id22790b6d-3a52-414b-be3d-8700e6dcfe28"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the Conservation Areas are to conserve, protect, and enhance for
			 the benefit and enjoyment of present and future generations the cultural,
			 archaeological, natural, geological, historical, ecological, watershed,
			 wildlife, educational, recreational, and scenic resources of the Conservation
			 Areas.</text>
			</subsection><subsection id="id77938fba-1254-4e3a-8cc4-ec7b5eb88a55"><enum>(c)</enum><header>Management</header>
				<paragraph id="idff5ced82-6ced-4e1c-b66e-fe9f211ea104"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage the Conservation Areas—</text>
					<subparagraph id="id28b65855-ec86-4979-8b89-f6a26dccec2c"><enum>(A)</enum><text>in a manner that
			 conserves, protects, and enhances the resources of the Conservation Areas;
			 and</text>
					</subparagraph><subparagraph id="id2cd1a390-c100-4e91-a91c-4b5a2bc4dcaa"><enum>(B)</enum><text>in accordance
			 with—</text>
						<clause id="id655c927d-2020-4f36-b182-abab11615410"><enum>(i)</enum><text>the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
						</clause><clause id="id57252886-6664-47c3-b4dc-424e7f20d87d"><enum>(ii)</enum><text>this Act; and</text>
						</clause><clause id="ide45433ef-7537-477b-9b15-5b5abea50200"><enum>(iii)</enum><text>any other applicable
			 laws.</text>
						</clause></subparagraph></paragraph><paragraph id="id13536888-44a7-4c6a-bc59-9766b3af1ac4"><enum>(2)</enum><header>Uses</header>
					<subparagraph id="idb4c245b9-2148-42df-914d-45aa0a26bd13"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall allow only such uses of the
			 Conservation Areas that the Secretary determines would further the purposes
			 described in subsection (b).</text>
					</subparagraph><subparagraph id="id865e3838-2d86-4f95-87b1-df678edc6563"><enum>(B)</enum><header>Use of motorized
			 vehicles</header>
						<clause id="idf26b1ff8-39c7-44d7-bf0a-a2301b5d5f2c"><enum>(i)</enum><header>In
			 general</header><text>Except as needed for administrative purposes or to
			 respond to an emergency, the use of motorized vehicles in the Conservation
			 Areas shall be permitted only on roads designated for use by motorized vehicles
			 in the management plan.</text>
						</clause><clause id="id8dcdde7f-1fe4-4799-8c91-7079a46db009"><enum>(ii)</enum><header>New
			 roads</header><text>No additional road shall be built within the Conservation
			 Areas after the date of enactment of this Act unless the road is necessary for
			 public safety or natural resource protection.</text>
						</clause></subparagraph><subparagraph id="idd1adbaf3-546c-4e6d-998d-0fb7528abe7d"><enum>(C)</enum><header>Grazing</header><text>The
			 Secretary shall permit grazing within the Conservation Areas, where established
			 before the date of enactment of this Act—</text>
						<clause id="id951370e6-ff39-42d8-b1fa-9f947d854914"><enum>(i)</enum><text>subject to all applicable
			 laws (including regulations) and Executive orders; and</text>
						</clause><clause id="id5698c460-6c9c-4801-bd0a-6feb5ae2421c"><enum>(ii)</enum><text>consistent with the
			 purposes described in subsection (b).</text>
						</clause></subparagraph><subparagraph id="iddb2eb23f-b0d7-47b3-bdc1-e61ab6baefe6"><enum>(D)</enum><header>Utility right-of-way
			 upgrades</header><text>Nothing in this section precludes the Secretary from
			 renewing or authorizing the upgrading (including widening) of a utility
			 right-of-way in existence as of the date of enactment of this Act through the
			 Organ Mountains National Conservation Area—</text>
						<clause id="id04879bd3-a7bf-4347-a4d6-c0bb349084e6"><enum>(i)</enum><text>in accordance
			 with—</text>
							<subclause id="idc9f17844-5f60-4a41-9e52-bd6a187090c6"><enum>(I)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text>
							</subclause><subclause id="idcf498b1e-f36f-4547-98e7-98b48c0c7e7a"><enum>(II)</enum><text>any other applicable
			 law; and</text>
							</subclause></clause><clause id="id7d1f4075-7c1c-40f4-968b-99a6937f966d"><enum>(ii)</enum><text>subject to such terms
			 and conditions as the Secretary determines to be appropriate.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idad34ae55-6da8-4ed1-97ca-51940d9ed539"><enum>(d)</enum><header>Management
			 plan</header>
				<paragraph id="id1f172331-ba03-458c-b7a4-507059f8783a"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall develop a management plan for each of the
			 Conservation Areas.</text>
				</paragraph><paragraph id="idf2fab1c4-1a64-42a7-813d-99abd9cf95f7"><enum>(2)</enum><header>Consultation</header><text>The
			 management plans shall be developed in consultation with—</text>
					<subparagraph id="id01d623c9-8f65-487f-90c8-844f5bf369f9"><enum>(A)</enum><text>interested Federal
			 agencies;</text>
					</subparagraph><subparagraph id="idF88CB1E9A5034C1388AD3F27C4B3B42E"><enum>(B)</enum><text>State, tribal, and local
			 governments; and</text>
					</subparagraph><subparagraph id="idcc2f317a-ba3f-4137-9019-61546fa9a113"><enum>(C)</enum><text>the public.</text>
					</subparagraph></paragraph><paragraph id="id64dc2095-0b71-47f2-b747-1b743136ca55"><enum>(3)</enum><header>Considerations</header><text>In
			 preparing and implementing the management plans, the Secretary shall consider
			 the recommendations of Indian tribes and pueblos on methods for providing
			 access to, and protection for, traditional cultural and religious sites in the
			 Conservation Areas.</text>
				</paragraph></subsection><subsection id="id039c4522-46eb-4f01-81af-cc14356e11ec"><enum>(e)</enum><header>Incorporation of
			 acquired land and interests in land</header><text>Any land or interest in land
			 that is within the boundary of a Conservation Area designated by subsection (a)
			 that is acquired by the United States shall—</text>
				<paragraph id="id5f1c43dc-abb1-4666-91da-a23f2ea42ca1"><enum>(1)</enum><text>become part of the
			 Conservation Area within the boundaries of which the land is located;
			 and</text>
				</paragraph><paragraph id="id75b585e9-d3bd-4524-be16-478fa58aa04c"><enum>(2)</enum><text>be managed in accordance
			 with—</text>
					<subparagraph id="id23990a06-0e03-4686-bda2-ed0bb9430460"><enum>(A)</enum><text>this Act; and</text>
					</subparagraph><subparagraph id="id4f754538-94ea-434f-bea5-5a404fcd8dfd"><enum>(B)</enum><text>any other applicable
			 laws.</text>
					</subparagraph></paragraph></subsection><subsection id="id7bec3567-e913-4a9c-81ba-b51d9eaca09e"><enum>(f)</enum><header>Transfer of
			 administrative jurisdiction</header><text>On the date of enactment of this Act,
			 administrative jurisdiction over the approximately 2,050 acres of land
			 generally depicted as <quote>Transfer from DOD to BLM</quote> on the map
			 entitled <quote>Organ Mountains National Conservation Area</quote> and dated
			 June 22, 2010, shall—</text>
				<paragraph id="idee78cc0c-dec5-4d48-99b8-cdb433086def"><enum>(1)</enum><text>be transferred from the
			 Secretary of Defense to the Secretary;</text>
				</paragraph><paragraph id="id38cc8d9b-0229-4ca1-ad80-8d35666139f8"><enum>(2)</enum><text>become part of the Organ
			 Mountains National Conservation Area; and</text>
				</paragraph><paragraph id="id923f3b33-9b0f-471c-9f6b-44011ebd5c5f"><enum>(3)</enum><text>be managed in accordance
			 with—</text>
					<subparagraph id="ida1da98c7-0796-4e25-96a1-fc39a1f26a12"><enum>(A)</enum><text>this Act; and</text>
					</subparagraph><subparagraph id="idb842414c-3e33-4227-9b8a-e387984519a9"><enum>(B)</enum><text>any other applicable
			 laws.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="id0d878d5e-19a4-4856-99a5-6fc3a6c0bd94" reported-display-style="italic"><enum>5.</enum><header>General
			 provisions</header>
			<subsection id="id7aa70821-afc5-43df-a807-fd9d9595aeab"><enum>(a)</enum><header>Maps and legal
			 descriptions</header>
				<paragraph id="id2d277a6c-2e22-4b66-9bc5-a04a8f269749"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall file maps and legal descriptions of the
			 Conservation Areas and the wilderness areas designated by this Act with—</text>
					<subparagraph id="id5cc5c3b9-b7fe-4132-84e0-9f0bae9502c7"><enum>(A)</enum><text>the Committee on Energy
			 and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="id8cf1fccd-c476-4ff1-82ff-7cc7506ec8b0"><enum>(B)</enum><text>the Committee on Natural
			 Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="id0d34fa87-787e-4e3b-af2e-00832e8182a1"><enum>(2)</enum><header>Force of
			 law</header><text>The maps and legal descriptions filed under paragraph (1)
			 shall have the same force and effect as if included in this Act, except that
			 the Secretary may correct errors in the maps and legal descriptions.</text>
				</paragraph><paragraph id="id171d6d9c-d0e0-4a59-bfc9-21c216ea6313"><enum>(3)</enum><header>Public
			 availability</header><text>The maps and legal descriptions filed under
			 paragraph (1) shall be on file and available for public inspection in the
			 appropriate offices of the Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="id8ffabf20-adcb-4c29-a6a8-e85443755f23"><enum>(b)</enum><header>National landscape
			 conservation system</header><text>The Conservation Areas and the wilderness
			 areas designated by this Act shall be administered as components of the
			 National Landscape Conservation System.</text>
			</subsection><subsection id="idebd55111-61a6-4848-9278-f3928006d1b7"><enum>(c)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the jurisdiction of the
			 State with respect to fish and wildlife located on public land in the State,
			 except that the Secretary, after consultation with the New Mexico Department of
			 Game and Fish, may designate zones where, and establish periods during which,
			 hunting, or fishing shall not be allowed for reasons of public safety,
			 administration, the protection for nongame species and their habitats, or
			 public use and enjoyment.</text>
			</subsection><subsection id="id8b4aee01-aa20-4d07-9369-d50a5346295a"><enum>(d)</enum><header>Withdrawals</header>
				<paragraph id="id5cb75ba4-7bb5-4314-82dc-7426e434c0be"><enum>(1)</enum><header>In
			 general</header><text>Subject to valid existing rights, the Federal land within
			 the Conservation Areas, the wilderness areas designated by this Act, and any
			 land or interest in land that is acquired by the United States in the
			 Conservation Areas or wilderness areas after the date of enactment of this Act
			 is withdrawn from—</text>
					<subparagraph id="id03275961-8b31-439e-aaa1-87490f499661"><enum>(A)</enum><text>entry, appropriation, or
			 disposal under the public land laws;</text>
					</subparagraph><subparagraph id="id593d8b1b-251f-4b6a-8335-cd39c1ef77bd"><enum>(B)</enum><text>location, entry, and
			 patent under the mining laws; and</text>
					</subparagraph><subparagraph id="id23b75589-a975-4762-b9f1-51c4bc7bba96"><enum>(C)</enum><text>operation of the mineral
			 leasing, mineral materials, and geothermal leasing laws.</text>
					</subparagraph></paragraph><paragraph id="id67620dc8-e9f8-46ef-ac39-1b7a11e7ac66"><enum>(2)</enum><header>Parcel
			 A</header><text>The approximately 1,300 acres of land generally depicted as
			 <quote>Parcel A</quote> on the map entitled <quote>Organ Mountains National
			 Conservation Area</quote> and dated June 22, 2010, is withdrawn in accordance
			 with paragraph (1), except that the land is not withdrawn from disposal under
			 the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public
			 Purposes Act</quote>) (43 U.S.C. 869 et seq.).</text>
				</paragraph><paragraph id="IDe817d3a3b6b44fa4b5097a1f7adcd5b9"><enum>(3)</enum><header>Parcel
			 B</header><text>The approximately 6,500 acres of land generally depicted as
			 <quote>Parcel B</quote> on the map entitled <quote>Organ Mountains National
			 Conservation Area</quote> and dated June 22, 2010, is withdrawn in accordance
			 with paragraph (1), except that the land is not withdrawn for purposes of the
			 issuance of oil and gas pipeline rights-of-way.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="idbf6c8b1b-90c9-4e13-adac-dd21a961b712" reported-display-style="italic"><enum>6.</enum><header>Prehistoric Trackways
			 National Monument Boundary adjustment</header><text display-inline="no-display-inline">Section 2103 of the Omnibus Public Land
			 Management Act of 2009 (16 U.S.C. 431 note; Public Law 111–11; 123 Stat. 1097)
			 is amended by striking subsection (b) and inserting the following:</text>
			<quoted-block changed="added" committee-id="SSEG00" display-inline="no-display-inline" id="id1B3D52A2039849AB910BEB6DDC802FE8" reported-display-style="italic" style="OLC">
				<subsection id="IDb87b5213ab6e4ce68921f9a2fe70499d"><enum>(b)</enum><header>Description of
				land</header><text>The Monument shall consist of approximately 5,750 acres of
				public land in Donã Ana County, New Mexico, as generally depicted on the map
				entitled <quote>Desert Peaks National Conservation Area</quote> and dated May
				18,
				2010.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSEG00" id="IDb7f76d39b1d847a9ae57a8178a0925da" reported-display-style="italic"><enum>7.</enum><header>Border security</header>
			<subsection id="ID0cc337c224664786a365bca46b222956"><enum>(a)</enum><header>In
			 general</header><text>Nothing in this Act—</text>
				<paragraph id="id48931568125A4046BEF054276959A655"><enum>(1)</enum><text>prevents the Secretary of
			 Homeland Security from undertaking law enforcement and border security
			 activities, in accordance with section 4(c) of the Wilderness Act (16 U.S.C.
			 1133(c)), within the areas designated as wilderness by this Act, including the
			 ability to use motorized access within a wilderness area while in pursuit of a
			 suspect;</text>
				</paragraph><paragraph id="id11E870A3321144FF9F8765A58D61E76A"><enum>(2)</enum><text>affects the 2006
			 Memorandum of Understanding among the Department of Homeland Security, the
			 Department of the Interior, and the Department of Agriculture regarding
			 cooperative national security and counterterrorism efforts on Federal land
			 along the borders of the United States; or</text>
				</paragraph><paragraph id="ID3c808e57fcdf4e3a80810248583d4bae"><enum>(3)</enum><text>prevents the Secretary of
			 Homeland Security from conducting any low-level overflights over the wilderness
			 areas designated by this Act that may be necessary for law enforcement and
			 border security purposes.</text>
				</paragraph></subsection><subsection id="IDff7f092ffc804d8fbb504d79d114604a"><enum>(b)</enum><header>Restricted use
			 area</header>
				<paragraph id="id017ABDBFCF6D44669E6F6DA4B35500CB"><enum>(1)</enum><header>Withdrawal</header><text>The
			 area identified as <quote>Restricted Use Area</quote> on the map entitled
			 <quote>Potrillo Mountains Complex</quote> and dated May 18, 2010 is withdrawn
			 in accordance with section 5(d)(1).</text>
				</paragraph><paragraph id="IDa1162740ec9d48c6b3f38fff34a07d7c"><enum>(2)</enum><header>Administration</header><text>Except
			 as provided in paragraphs (3) and (4), the Secretary shall administer the area
			 described in paragraph (1) in a manner that, to the maximum extent practicable,
			 protects the wilderness character of the area.</text>
				</paragraph><paragraph id="IDd1376a4d754e4ca8b183d9cb8f582b64"><enum>(3)</enum><header>Use of motor
			 vehicles</header><text>The use of motor vehicles, motorized equipment, and
			 mechanical transport shall be prohibited in the area described in paragraph (1)
			 except as necessary for—</text>
					<subparagraph id="id64FCD9A8F0B34D928E923393DAC3A4A5"><enum>(A)</enum><text>the administration of the
			 area (including the conduct of law enforcement and border security activities
			 in the area); or</text>
					</subparagraph><subparagraph id="idF4B86A42DAB646AE93ECED1C4ABC8922"><enum>(B)</enum><text>grazing uses by
			 authorized permittees.</text>
					</subparagraph></paragraph><paragraph id="ID3d373ea6fac84aec98036b8588ebf774"><enum>(4)</enum><header>Effect of
			 subsection</header><text>Nothing in this subsection precludes the Secretary
			 from allowing within the area described in paragraph (1) the installation and
			 maintenance of communication or surveillance infrastructure necessary for law
			 enforcement or border security activities.</text>
				</paragraph></subsection><subsection id="ID46b4d3a348b042fdbb100da348dee238"><enum>(c)</enum><header>Restricted
			 route</header><text>The route excluded from the Potrillo Mountains Wilderness
			 identified as <quote>Restricted–Administrative Access</quote> on the map
			 entitled <quote>Potrillo Mountains Complex</quote> and dated May 18, 2010,
			 shall be—</text>
				<paragraph id="idDDD187367B194D3EA2312BCAE3416BA9"><enum>(1)</enum><text>closed to public access;
			 but</text>
				</paragraph><paragraph id="idC53E88E27A674ABE9F2EC2B1554607CF"><enum>(2)</enum><text>available for
			 administrative and law enforcement uses, including border security
			 activities.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="idedc84258-7c47-4dcb-a495-56b98b66a2dc" reported-display-style="italic"><enum>8.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
